The meeting was called to order at 6:01 p.m.

3. Agenda Approval
Motion
Ms. Glinski moved to approve the agenda. Ms. Hohner seconded the motion that
passed unanimously.
4. Approval of Minutes - October 8, 2009
Ms. Glinski moved to approve the minutes. Ms. Hohner seconded the motion that
passed unanimously.
5. Receipt of Revenue/Expense Sheets - September &. October 2009
Ms. Glinski moved to approve accept the reports. Ms. Hohner seconded the motion that
passed unanimously.
6. Receipt of Sales Reports - October &. November, 2009
Ms. Glinski moved to approve accept the reports as presented. Ms. Hohner seconded
the motion that passed unanimously.

A. Parks Division Reports - November 2009
It was noted a report for October 2009 was also provided. Mr. Balfe read the reports
for the months of October and November 2009 as contained in the meeting materials.
Motion
Ms. Prainito moved to approve. Ms. Glinski seconded the motion that passed
unanimously.
8. New Business
A. Discuss prices for crypts and niches at Boynton Beach Mausoleum.
(Tabled)
Motion
Ms. Glinski moved to remove the item from the table. Ms. Prainito seconded the motion
that passed unanimously.
Jody Rivers, Parks Superintendent, noted the Board had asked staff at the last
meeting to determine what other municipal cemeteries charged and, in particular,
Delray Beach. This information has been added to the comparison chart included with
the meeting materials. Options could include averaging the cost, having the prices
remain as they are, or lowering the costs so that they were closer to Delray's prices.
It was believed the prices set forth on the chart were a bit high. Ms. Rivers noted there
had not been that many prices available for comparison purposes. As such, she
averaged the costs and came up with the prices reflected on the chart. She did,
however, agree that the prices reflected were high. In considering the price range
reflected for Delray Beach, $600-$700, she recommended a range of $700-$900 for
Boynton Beach.
Suggestions by Board members included the following:
. $1,500 to $1,750 for C and D
. $1,000 to $1,200 for A and B
. $800 to $1,000 for E and F

Ms. Hohner felt the middle level, or eye level, should be the most expensive as she
believed it was the most desirable location. She felt the two top tiers were difficult to
reach and should be the least expensive.
Following discussion, the Board agreed on the following prices: $1,000 for A and B,
$1,500 for C and 0 and $700 for E and F.
Motion
Ms. Glinski moved to approve the costs agreed to by the Board: $1,000 for A and B,
$1,500 for C and 0 and $700 for E and F, and to recommend the figures to the City
Commission for approval. Ms. Hohner seconded the motion.
Mr. Balfe pointed out that the niches reached higher than level F. Standard crypts were
at levels A through F and the niches were half of a standard-sized crypt. Niches A, B, C
and 0 should have the same prices as they were equivalent to the height of two crypts.
As such, Ms. Rivers suggested the following:

Motion
Ms. Glinski amended her motion to charge $1,000 for niche levels A through 0, $1,500
for niche levels E through Hand $700 for niche levels I through L, which would include
openings, closings and etchings, and to recommend the figures to the City Commission
for approval. Ms. Hohner seconded the motion that passed unanimously.
B. Discuss the discrepancy regarding emblem engraving prices.
At the July 9, 2009 meeting, action had been taken by the Board to establish a fee of
$75 for emblems reflected on the list provided by Mr. Balfe. Emblems not included on
the list would need to be approved by the Board and a price would be determined at
that time. Thereafter, at the October 8, 2009, action was taken to allow up to two
emblems at $50 each. All requests for emblems would require Board approval.
Discussions at the July meeting revealed the Board felt $75 was a reasonable price for
the emblems. The Board again concurred and agreed a motion should be made to
reestablish a fee of $75 for the emblems.

Motion
Secretary Prainito moved to establish the fee of $75 for the emblems that was
approved at the July 9, 2009 meeting and to disregard the motion passed at the
October 8, 2009 meeting.
It was noted the motion passed at the July 9, 2009 meeting required the Board's
approval of the emblems.
Ms. Glinski seconded the motion that passed unanimously.
C. Approve the request from Lucy Velez for a refund on Lot 167-A, Block Y,
Boynton Beach Memorial Park Addition # 1 in the amount of $600. (The
original price was $750 less $250 (20%) for a total refund of $600.
Secretary Prainito noted the paperwork for all the refunds was in order. The Board
agreed to approve all of the refunds in one motion. It was noted a change in Item D
was required. The original price was $50 less $10 for a total refund of $40.
Motion
Secretary Prainito moved to approve the requests for refunds under Items C, D, E and
F. Ms. Glinski seconded the motion that passed unanimously,
D. Approve the request from Linda Barber for a refund on Lot 242, Block L,
Boynton Beach Memorial Park Addition #1 in the amount of $40. (The
original price was $50 less $10 (20%) for a total refund of $50.
E. Approve the request from Louise Santos for a refund on Lots 564-A&B,
Block 0, Boynton Beach Memorial Park Addition #1 in the amount of
$1,200. (The original price was $1,500 less $300 (20%) for a total refund
of $1,200.
F. Approve the request from Donna Petrick for a refund on Lot 394-A, Block
0, Boynton Beach Memorial Park Addition #1 in the amount of $360.
9. Other
A. Discuss engraving of crypts and niches on purchases made through
former Mausoleum operator.

Secretary Prainito noted families had been calling the City Clerk's Office complaining
that their crypts or niches had not been engraved. Brady Osborne sold the
crypts/niches and supposedly was collecting the fees for the engraving. This item was
placed on the agenda to discuss the manner in which this issue should be handled,
especially since it was believed there was no money in the budget for the engraving.
Ms. Rivers confirmed the fact that there was no money in the budget for engraving.
Additionally, as a result of contractual arrangements between Mr. Osborne and his
customers, Mr. Osborne bore the responsibility for the engraving. Staff had been in
discussions with City Attorney Cherof regarding a similar situation, and had been
attempting to make it clear to the individual that the City was not the responsible party.
Calls of this nature were being referred to Mr. Osborne. While staff had previously
arranged for some of the engraving, they did so as they empathized with the families.
However, this could no longer be accomplished in the current economic climate. In
fact, budget transfers were necessary to cover operational expenses. With regard to
the pending litigation, Ms. Rivers noted the attorneys were going forward with the
litigation as opposed to settling the matter.
It was questioned whether a fee could be established for those families wishing to have
the engraving done. Ms. Rivers suggested staff work with Lake Worth Monument to
have the engraving done at cost. Those families that chose not to do that would still
have to pursue their contractual rights through Mr. Osborne.
Mr. Balfe noted the emblems, which cost the City $15 each, were of major concern, in
addition to the inscription of the names and dates. Ms. Hohner felt that the names and
dates should be added to the crypts/niches. If the families wanted to pay for the
inscriptions while a resolution of the litigation was pending, they should be able to do
so. However, she believed the emblems were a separate issue.
Ms. Rivers noted staff could arrange to send the families directly to Lake Worth
Monument in order to pay for the engraving. Mr. Balfe did not believe Lake Worth
Monument would object to charging the families the cost normally extended to the City,
as long as staff notified Lake Worth Monument in advance of the families' arrivals.
After payments were made to Lake Worth Monument, staff would follow the usual
process which included removing the cryptfront, sending it to Lake Worth Monument
and replacing the cryptfront after it was returned. Ms. Rivers would communicate with
Lake Worth Monument to ensure the City was not placing them in an awkward position.
The Board was in agreement with the recommendations.

Motion
Ms. Glinski moved to pursue the recommendations made. Secretary Prainito seconded
the motion that passed unanimously.
The question was raised as to the status of the fountain. Mr. Balfe noted a full-time
electrician would be joining the Facilities Maintenance Department on the 21st and the
fountain would top his list of priorities. The bushes circling the bottom of the fountain
had already been installed, and it was anticipated the fountain would be fully
operational by early January.
10. Future Agenda Items

B. Discuss and make recommendation to the City Commission regarding a

The Grandson is the child of the Daughter (Joan Sove).
The Grandson resides in NY.
Mr. Sove has told me that the Grandson is amenable to the disinurnment of his Grandfather,
There is no estate to be probated, the wife who just passed, had Alzheimer's and was in a home for quite a few
years which left nothing to the estate.
Mr. Sove has informed me again that his wife's brother could care less what happens to their parent's remains
because he disowned his family long ago.

I just spoke with Mr. Bove, who is the husband of the daughter of Mr. Loeb (the one to be disinurned). He informs
that the Grandson is the executor of the will and does that matter? Also he informs that the will read that
everything was left to the 2 siblings (Mrs. Bove and her Brother who is the one who disowned himself from the
family along time ago). Does this change the outcome of who needs to authorize this disinurnment? When the
family receives the signed copy of the will they are going to fax me a copy.
Below Jim had said to forget the brother but does this new information change his answer?

The family of Mr. Loeb is calling me about this disinurnment. The mother is being cremated in 36 hours and they
really want to get the father's cremains so that they can place them in another location together. Any chance I

Hi Lynn,
I received a request from the daughter of Mr. Joseph Loeb to disinurn him from his Niche which is owned by him
and his late wife. I am sending her our disinurnment/authorization form to fill out and sign. She informs me that
she also has a brother in upstate NY who has disowned himself from the family years ago. Do we need the
brother's consent or is the daughters consent sufficient? If we need the brother's consent as well, does he also
have to sign the same disurnment/authorization form?

Jane Yarborough called me on Friday about getting a refund for her Father's cemetery plot. Her Father, John C.
Williams, is alive and living in Tallahassee with her. He has dementia, is very sick, and may pass very soon. She
has faxed me a copy of Power of Attorney and her marriage license showing her name change. They do not
have the original Deed for the cemetery plot. We do have an affidavit of lost cemetery deed in our office available
for her to sign. Can the daughter sign this in order to proceed with a refund for her Father's cemetery plot?

Kerin Straleau came in today inquiring about placing her Mother's cremains in her Father's Crypt.
Father - Herbert M. Schramm - Sunset Bldg, Sec. D, Crypt D-9 (Single crypt, Tom said the only way to fit an Urn
is to place it inside the Casket) FYI- The father was not embalmed.
Mother - Joan Wathey - she remarried and her 2nd Husband is alive.
There are 2 siblings, Kerin and her Brother, Robert Schramm.
The Certificate of Ownership is only in the Father's name and it does not show any Urn privileges. Kerin stated
that her Mother purchased the crypt when her Father passed away in 1996. I have not located a copy of the
contract showing who signed it nor can Kerin produce a copy. -1
Is this permissible?
If so what documentation do we need?
What fees are involved?

We need legal counsel on the following issue:
\ Tim from Scobee-Combs Funeral Home is trying to get Elaine Mirisola interred in Lot 28 Block H. The owners of
this lot is Louis & Mary Mirisola. They own Lot 27 & 28 in Block H. They are both deceased and in the
Mausoleum. Before Mary passed she gave permission for Frederico Gomes to be buried in Lot 27, who is the
Father of Elaine Mirisola. We have been informed that these lots were not left to anyone in the will but it was
intended for Elaine to be next to her father. There are 2 surviving daughters of Louis & Mary Mirisola, they had a
lSO, n who passed. Elaine Mirisola was the ex-wife to the deceased son. The funeral home is asking if we get a I
notarized letter fram the 2 surviving daughters can we bury Elaine Mirisola in Lot 28 Block H? -.J

Chair of the Cemetery Board. at the request of the City Attorney or City Clerk
shall conyene a Special Meetin!! of the Cemetery Board to consider the request.
The Board is empowered to grant special exceptions to the rules regarding burial
or entombment to address special circumstances and to apply such conditions to
such approval as it deems necessary and prudent.
Section 3.
That each and every other section of said Chapter not herein specifically

amended shall remain in full force and effect as previously enacted.

Section 4.
All ordinances or parts of ordinances in conflict herewith be and the
12 same are hereby repealed.

Section 5.
Should any section or provision of this ordinance or portion hereof, any
14 paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such
15 decision shall not affect the remainder of this
16 ordinance.

I, BETTY E. PATTERSON, a resident of and domiciled in the City
of Boynton Beach; Cobnty of'Palm Beach, State of Florida, do hereby
make, publish I, and declare the following to be my Last Will and
Testament, hereby rSvoking all wills and codicils by me at any time
heretofore made.
All references in this instrument to "my spouse" are to ROY A.
PATTERSON only.
ARTICLE I
DEBTS 'AND EXPENSES
I direct that all of my just debts, my funeral' expenses, the
expenses of my last i'llness, and the cost of' administration of my
estate, be paid as soon as maybe convenient after my death;
provided, however, my Personal Representative shall not be required
to pay any obligation in advance of its maturity.
ARTICLE II
PAYMENT OF TAXES
I direct that my Personal Representative payout of my
residuary estate as an'administration expense thereof without
apportionment, all estate , inheritance, transfer, succession and
other similar taxes imposed by any jurisdiction whatsoever by
reason of my death, together with any interest and penalties
thereon, whether such taxes are imposed upon or with respect to
property which passes under the provisions of this Will or passes
or has passed otherwise, or imposed upon or with respect to any
recipient thereof.
ARTICLE III
TANGIBLE PERSONAL PROPERTY
All of my clothing , jewelry, personal effects, automobiles,
and all other tangible personal property not otherwise specifically
bequeathed (except 'cash on hand) owned by me at, the time of my
death, 'I bequeath to my husband, ROY A. PATTERSON.
In the event my spouse shall fail to survive me, then my
tangible personal property shall be distributed to my son, JAMES
ROBERT PATTERSON, per stirpes.

ARTICLE IV
UNIFIED CREDIT TRUST
If my spouse shall survive me, I devise to my Trustee,
hereinafter named, in trust (the "Unified Credit Trust"), a
pecuniary amount equal to the largest amount that may be devised
free of Federal estate taxes by reason of the unified credit
allowable to my estate (but no other credit) reduced by (i) devises
under previous Articles of this will which are includable in my
gross estate and which do not qualify for either the estate tax
marital or charitable deduction; (ii) property passing outside of
this Will which is includable in my gross estate and which does not
qualify for either the estate tax marital or charitable deductions,
and (iii) charges to principal that are not allowed as deductions
ln computing my Federal estate tax. For the purposes of
establishing the sum disposed of by this Article, the values
finally fixed in the Federal estate tax proceedings relating to my
estate (or the date of death values, if no Federal estate tax
return is required to be filed) shall be used. I recognize that
possibly no sum may be disposed of by this Article and that the sum
so disposed of may be affected by the action of my Personal
Representative in exercising certain tax elections. My Trustee
shall hold, administer, manage, invest and reinvest the same, upon
the following terms and conditions:
A. The Trustee shall pay to or apply for the benefit of my
spouse all of the annual net income in quarterly or other
convenient installments, or shall apply the same for my spouse's
benefit so long as my spouse shall live.
B. In addition, the non-spouse Trustee may, in the
non-spouse Trustee's sole discretion, pay to or apply for the
benefi t of my spouse such amounts of the principal from time to
time as may be determined as necessary for my spouse's proper
support, health and maintenance, taking into consideration all
other sources available to my spouse without sale of investments or
borrowing. It is my desire to insure that my spouse maintains the
standard of living which we have enjoyed. Therefore, said the
Trustee shall be mindful of this desire in determining whether
principal invasion should be made. The said Trustee is also asked
to consider that my spouse's annual distribution should keep pace
with the cost of living, regardless of actual net income earned by
the trust. Furthermore, the said Trustee is directed to be
concerned with the interest of my spouse, rather than that of the
remaindermen.

C. Upon the death of my spouse the trust shall terminate; and
the Trustee shall distribute the trust estate outright and free of
trust to my son, JAMES ROBER'I' PA'I''l'ERSON, per stirpes.
ARTICLE V
DISPOSITION OF RESIDUAL SHARE IF SPOUSE SURVIVES
If my spouse survives me, all the rest, residue and remainder
of the property which I may own at the time of my death, real,
personal and mixed, and wheresoever situate, including all lapsed
devises, I give and devise to my spouse, ROY A. PATTERSON, outright
and free of trust.
ARTICLE VI
DISPOSITION OF RESIDUAL SHARE IF SPOUSE PREDECEASES
In the event my spouse shall not survive me, all the rest,
residue and remainder of the property which I may own at the time
of my death, real, personal and mixed, and wheresoever situate,
I give and devise to my son, JAMES ROBERT PATTERSON, per stirpes.
I trust my son, JAMES ROBER'l' PATTERSON, to provide for my mother,
should she need financial assistance.
ARTICLE VII
APPOINTMENT OF FIDUCIARIES
I appoint my husband, ROY A. PATTERSON, to be Personal
Representative of this my Last Will and Testament. In the event he
shall not survive me, fails to qualify hereunder, or having quali-
fied, dies or resigns before the administration of my estate has
been completed, I appoint my son, JAMES ROBERT PATTERSON.
I appoint my husband, ROY A. PAT'l'ERSON, and my son, JAMES
ROBERT PATTERSON, as Co-Trustee of any trusts created hereunder. My
son may select a successor Trustee (individual who 1S not an
income beneficiary hereunder or corporate) to succeed him in the
event he shall become unable to serve in the same manner and with
the same powers, including the right to appoint a successor
'l'rustee. In the event he shall not survive me, or having
qualified, dies or res1gns during the administration of my trust, I
appoint CATHERINE ANN PATTERSON, as successor Trustee of any trust
created hereunder.
I direct that no bond or other security shall be required of
any of the above parties serving as my Personal Representative,
or as my Trustee, in any jurisdiction nor shall such fiduciaries
be required to file periodic accountings 10 any court.
ARTICLE VIII
POWERS OF FIDUCIARIES
I hereby grant to my Personal Representative and to my
'l'rustee, collecti vely re fer red to 1.n this Artic Ie as "my
fiduciaries", with respect to my estate and each trust established
hereunder, in addition to those powers cOllferred by law, the

following powers to be exercised without authority from any court
and in their sole and absolute discretion, to deal with any and all
property, real and personal, forming a part of my estate or of any
trust created hereunder, including property held for minors and
whether constituting income or principal.
A. To retain such property regardless of whether it is of the
class or diversification authorized by law for the investment of
trust funds, and to abandon such property or any interest in it as
may be deemed advisable; but my fiduciaries shall not retain any
stock in an "electing small business corporation" as that term is
defined In section 137 (b) of the Internal Revenue Code if such
retention would cause the termination of that particular
corporation's election.
B. 1'0 sell any such property, real or personal, at such
times and upon such terms and conditions, including credit, as may
be deemed advisable at public or private sale, and to exchange,
grant options on or otherwise dispose of such property as may be
deemed advisable, including the authority and power to make such
sale or disposition to any beneficiary hereunder.
C. To enter into a lease for any purpose as lessor or lessee
for such period of time and to grant such options for renewal or
purchase as may be deemed advisable even though such term may
extend beyond the administration of my estate or of any trust
created hereunder.
D. To borrow money from any lender (including my fidu-
c iar ies), as may be necessary to pay taxes or for such other
purposes as may be deemed advisable, and to glve notes or bonds
for the sums borrowed and to encumber, mortgage or pledge any
property held hereunder and to loan money to any person or entity
including a beneficiary hereunder, upon such terms and conditions,
with or without security, and for such purposes as my fiduciaries
may deem advisable.
E. To abandon, compromise, arbitrate or otherwise deal with
and settle claims in favor of or against my estate and any trust
created hereunder as may be deemed advisable.
F. To invest and reinvest in property of any character, real
or personal, foreign or domestic, including but not limited to
stocks, bonds, mutual funds, common trust funds, including those
maintained by my fiduciaries, securities of investment companies
or other securities, unsecured obligations, undivided interests,
and leases, regardless of whether such property is of the class or
diversification authorized by law for the investment of trust
funds.
G. To exercise or sell subscription or conversion rights and
all other rights, options and powers pertaining to any stocks,
bonds or other securities, and to vote or refrain from voting a
security, in person or by general or lImited proxy, all as fully
as might be done by persons owning similar property in their own
rights.
H. To oppose, consent to and participate ln any plan of
reorganization, recapitalization, consolidation, merger, liquida-
tion or similar plan and any proceeding thereunder, including
deposi ting any property with any protective, reorganization, or
similar committee, delegating discretionary power, and paying
expenses and assessments levied thereon.
I. To register and hold such property in the name of a
nominee or in such form as to pass title by delivery.
J. 'l'o employ counsel, accountants and agents deemed advis-
able by my fiduciaries and to pay them reasonable compensation.
K. To make distributions in cash or in kind, or partly in
cash and partly in kind, and to divide, partition, allocate or
distribute particular assets or undivided interests therein,
without any obligation to make proportionate distributions or to
distribute to all beneficiaries property having an equivalent
income tax basis, and without regard to any provision of law
expressing a preference for distributions ln kind, and to value
such property to the extent permitted by law.
L. To pay expenses that are reasonable in the judgement of my
Personal Representative for the delivery of bequests.
N. If, after a diligent search, my Personal Representative
1S unable to locate a beneficiary named in this Will and does not
have a reasonable expectation of finding the beneficiary wi thin
six (6) months after my death, it may be presumed that such
beneficiary predeceased me, and my Personal Representative shall be
protected 1n acting 1n accordance wi th such presumption. Such
benefiCiary's share shall be distributed to the contingent
beneficiary specified, or if none, then to my then living heirs
under the laws of the State of Florida.
N. To consent to or ]Oln ln any gift and income tax returns
filed by or with my spouse and to pay from my estate that amount of
such tax liability as shall be agreed upon by my Personal
Representative and my spouse.
O. To accept and add to the prinCipal of any trust created
hereunder additional property received from any source.

P. To exercise all of the powers and discretions granted
herein, even after the termination of any trust created hereunder,
until the final distribution of all property.
Q. To enter into any transaction with my Personal
Representative or my Trustees or the Trustee under any instrument
other than this Will to the same extent as with any other person
even though my Personal Representative and the Trustee may be
the same entity.
H. Iro do all such acts and exercise all such rights and
privil.eges, al. though not specifically listed hereunder, which my
fiduciaries deem necessary or advisable for the proper and advan-
tageous management, investment and distribution of my estate and
any trust created hereunder, and to make, execute and deliver any
instruments or agreements binding my estate and any such trust.
ARTICLE IX
FIDUCIARIES EXONERATED
My fiduciaries shall be responsible only for due diligence in
the administration and disbursement of my estate and any trust
created hereunder and shall not be responsible for any loss or
subject to any liability except by reason of my fiduciaries I own
negligence or willful default proved by affirmative evidence, and
every election, determination or other exercise by my fiduciaries
of any discretion granted, expressly or by implication under this
Vhl1, or by law made in good faith, shall fully protect my fidu-
ciaries and shall be conclusive and binding upon all persons
interested in my estate and any trust created under this Will.
ARTICLE X
RULES OF INTERPRETATION
A. Unless otherwise clearly indicated, words 1n the singular or
plural shall include the plural and singular respectively, where they
would so apply. Words in the masculine or neuter gender shall include
the feminine, masculine or neuter gender where applicable.
B. Unless otherwise clearly indicated, the word "child" or
"chi ldren" shall mean my lawful child or children, and the word,
"issue" shall mean lawful blood descendants of all degrees of the
individual designated, provided that (i) adopted children mine and
of my issue shall be considered and treated 1n all respects as
children or issue hereunder, and (ii) any child in gestation, later
born alive, shall for purposes of this Agreement be considered as a
child in being.
C. Unless otherwise stated, all statutory references in this
Agreement are to sections of the Internal Revenue Code of 1954, as
amended, and include any corresponding provisions of the Federal tax
law which may, from time to time, be in effect during the duration of
any trust created hereunder.

D. 'l'he term "Trustee" refers to the single, multiple and
successor Trustee who at any time may be appointed and acting in a
fiduciary capacity under the terms of this Agreement.
E. The underlined title of paragraphs herein is to
facilitate reading only, and shall not be construed to assign
meaning or interpretation to the provisions hereof.
ARTICLE XI
RENUNCIA'l'IONS
I authorize any beneficiary under this will to renounce and
disclailn, in whole or in part, any devise to or for the benefit of
such beneficiary. Any such renunciation and disclaimer shall be
made in accordance with state law. In the event of any such
renunciation and disclaimer, the devise (or portion thereof) so
renounced and disclaimed shall be disposed of in accordance with
the terms of this Will as if the beneficiary renouncing and
disclaiming had predeceased me; provided, however, that any
beneficiary who shall so renounce and disclaim a devise under one
provision of this Will shall not (unless such beneficiary so
specifies in the instrument delivered to my Personal
Representative) thereby be deemed to have predeceased me for
purposes of construing and applying any other provis1ons of this
~hll.
ARTICLE XII
SPENDTHRIFT
A beneficiary's interest in any trust created hereunder may
not be pledged, assigned, sold, transferred, alienated, encumbered
or anticipated by such beneficiary in any way: nor shall any such
interest 1n any manner be liable for or subject to the debts,
liabilities or obligations of such beneficiary or claims of any
sort, including those claims of any beneficiary's spouse or former
spouse, against such beneficiary.
ARTICLE XIII
INCOME DISTRIBUTION BASED ON ESTIMATE
Commencing with my death, my Personal l~epresentative may
make distributions of net income based upon estimates, and my
Trustee shall ultimately adjust any difference between such
estimates and the actual amount of income to be distributed, as
finally determined.

any beneficiary there is a deficiency of income thus occasioned,
such deficiency shall be charged to the principal account from

AHTICLE XIV
TRUSTS FOR BENEFICIARIES UNDER TWENTY-ONE
In the event any beneficiary is under the age of twenty-one
(21) years at the time a share is to be distributed absolutely to
such beneficiary, such share shall be held in trust by the Trustee
herein named. In such event and during such time, the Trustee
shall distribute to or for the benefit of such beneficiary so much
of the lllcorne and principal of such beneficiary's trust as the
Trustee, in the Trustee's absolute discretion, shall deem necessary
or desirable to provide for the proper health, maintenance,
education and support of such beneficiary; any income not so
distributed shall be added to the principal thereof at the end of
each fiscal year of such -trust. At the time such beneficiary
attains the age of twenty-one (21) years, or upon his or her death,
whichever occurs first, his or her trust shall terminate, and the
then remaining principal thereof shall be distributed absolutely,
free and clear of any trust, to such beneficiary; or if such
beneficiary is then deceased, to his or her issue, per stirpes.
'rhe interest of any beneficiary in a trust hereby created
shall not be subject to pledge, assignment or legal process, and
may not be voluntarily or involuntarily alienated or encumbered.
ARTICLE XV
DISPOSITION OF MINIMAL SIZED TRUSTS
Notwithstanding any of the foregoing provisions to the
contrary, if at any time the 'l'rustee, In the Trustee's sole and
absolute discretion, shall determine that the trust estate or any
share thereof held under this Agreement is for any reason
uneconomical or impracticle to administer, or does not amount to at
least TWENTY FIVE THOUSAND DOLLARS ($25,000.00) In value at any
time, the Trustee shall have the right to payout to the
beneficiary then entitled to the ll1COme therefrom the then
rema:Ullng principal of such trust estate or share thereof. Any
interest of any other persons in such trust estate or share thereof
shall thereupon cease. If any beneficiary entitled to payment by
reason of this clause be a minor, such payment may be made to the
guardian, par'ent or custodian under the F lor ida Gi ft to Mino1.-s Act,
or person having custody of such minor and the receipt of any person
shall be a full acquittance of the trustees.
ARTICLE XVI
ACCOUNTING BY TRUSTEE
The Trustee shall render at least annually to each person who
is thell an income beneficiary under any trust created hereunder, a
statement of account showing all receipts, disbursements and

distributions of both principal and 1ncome from such trust since
the last such statement. Unless such account is objected to 1n
writing within sixty (60) days from the rendition thereof, such
account shall be deemed approved as stated. The approval of such
persons, or of their guardians or legal representatives, of such
statement, shall, as to all matters and transactions stated in the
amount of shown by it, be final and binding on all persons,
relatives or friends whether or not in being, who are then or who
thereafter may become entitled to share in either the 1ncome or
principal of any trust created herein. Nevertheless, the Trustee
shall at all times be entitled to obtain a judicial settlement of
the Trustee' accounts.
AR'rICLE XVII
COMPENSATORY ADJUSTMENTS
My Personal Representative shall make such elections under
the tax laws as my Personal Representative shall deem advisable,
without regard to the relative interests of the beneficiaries. No
adjustment shall be made between principal and income or in the
relative interests of the beneficiaries to compensate for the
effect of elections under the tax laws made by my Personal
Representative. I direct that no beneficiary shall have any claim
against my Personal Representative or my estate, by reason of the
exercise of my Personal Representative's judgment in this respect.
