Minutes 06-15-11 MINUTES OF THE CODE COMPLIANCE BOARD MEETING HELD ON WEDNESDAY, JUNE 15,2011, AT 6:30 P.M. Call to Order The meeting was called to order at 6:30 p.m. II. Approval of Agenda Willie Webb, Senior Code Compliance Officer announced the following changes: Case Nos: 08-2511; 09-3194; and 10-3259 should be tabled to July 20,2011. Motion Mr. Foot so moved. Vice Chair Yerzy seconded the motion that unanimously passed. Case Nos: 11-1084; 11-1094; 11-847; and 11-1190 complied. Case Nos: 11-931; 11-940: 11-1054; 11-894; 11-906; 11-1141; and 11-124 were removed from the agenda. Case No. 11-883 should be tabled to July 20,2011. Motion Mr. Foot so moved. Swearing in of witnesses and introduction Attorney Bridgeman explained the hearing procedures. The Recording Secretary administered the oath to all who would be testifying. Case No. 11-891 US Bank National Assoc. (1112 Fosters Mill Dr.) 1112 Fosters Mill Dr CO CH10 SEC. 10-51.5 INC. Property that is vacant or subject to default must be registered with the City and maintained per City Code. Property Address: Violation(s): Vestiguerne Pierre, Senior Code Compliance Officer, presented the case. The mortgage holder cited was US Bank National Association for violations of the Property Registration Ordinance. The Respondent was present. Misty Sheets, with the Law Firm of Marshall Watson, pled no contest and requested 30 days. She had spoken with Officer Pierre. The case was closed and dismissed by the Court and Marshall Watson was re-filing the case. She explained this would take time to register. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Foot moved that this Board find that US Bank National Assoc. (1112 Fosters Mill Drive) is in violation of the City of Boynton Beach Code sections cited and moved to Order that the Respondent correct the violation.s on or before July 15, 2011. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $150 per day for each day the violation continues past July 15, 2011 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Business Tax Receipt required to rent unit. Remove unlicensed and inoperable vehicles from the prem ises. Luney Guillaume, Code Compliance Officer, reported the case was closed. 2 Meeting Minutes Code Compliance Board Boynton Beach, FL June 15, 2011 Motion Mr. Foot moved to amend the agenda to eliminate that item. Ms. Carroll seconded the motion that unanimously passed. Case No. 03-692 Property Address: Violation( s): Boynton JCP Associates 801 N. Congress Avenue PT3 LDR CH 4 SEC 11 PT3LDR CH 7.5-11 SEC 5B Replace missing or dead trees and plant material to comply with site plan on file with the City. Skip Lewis, Senior Code Compliance Officer, presented the case for Pete Roy, Chief Code and Rehabilitation Officer. The case was a City department referral. The initial inspection was on March 4, 2003 for the violations noted above. Staff recommended 30 days be given to correct the violations. Discussion followed. the violation location was the Boynton Beach Mall. Officer Lewis testified this violation was ongoing but was unsure if they were working on it. Usually, Kevin Hallahan, the City Forester, brings the case to the Board if there was no movement. Motion Based on the testimony and evidence presented in the aforementioned case, Ms. Carroll moved that this Board find that Boynton JCP Associates is in violation of the City of Boynton Beach Code sections cited and moved to Order that the Respondent correct the violations on or before July 15, 2011. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $100 per day for each day the violation continues past July 15, 2011 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Mr. Foot seconded the motion for discussion. Mr. Foot requested more information about the violation. Officer Lewis explained part of the mall is privately owned, such as Macy's, Sears and others. The remaining establishments share part of the responsibility for the landscaping. The Respondent was ignoring the violation, and the case originated in 2003. Officer Lewis ascertained Mr. Hallahan had noted there was no recent communication with the Respondent and it was in the news that the mall was up for sale. 3 Meeting Minutes Code Compliance Board Boynton Beach, FL June 15,2011 Vote Ms. Carroll amended her motion to $500 per day. Mr. Foot agreed to the amendment and the motion unanimously passed. Case No. 11-1156 Property Address: Violation( s): Claudia Ortega 206 NW 5th Avenue CO CH4 SEC 4-4, 4-36, 4-37 Each dog must have current tag and be registered with Palm Beach County. Proof of rabies vaccination required. Adhere to Tether regulations. Liz Roehrich, Animal Control Supervisor, presented the case. The location was a single-family homesteaded residence. The case arose from a citizen complaint slightly over a year ago. The location had previous violations. The initial inspection date was May 3, 2011 for the violations noted above. The initial notice was issued on May 16, 2011, and the property was posted on June 2,2011. The homeowner was continuously chaining the dog on the premises with the intent it would bite anyone who comes on the property. Last year, another dog owned by the homeowner severely bit another person. The dog was declared to be dangerous and was euthanized after the homeowner failed to pay the redemption fee. The homeowner had advised Officer Roehrich if she took this dog, he would get two more. She recommended a Cease and Desist order be issued imposing the maximum allowable penalty. Photographs were available depicting the chained dog. Officer Roehrich testified the homeowner was very nasty and had called her cell phone several times. Motion Based on the testimony and evidence presented in the aforementioned case, Ms. Carroll moved that a Cease and Desist Order be issued giving Claudia Ortega until June 22, 2011 to bring the violations of City of Boynton Beach Code sections as cited into compliance. The Board has considered the gravity of the violations, the actions taken by the Respondent, and any previous violations by the Respondent, and hereby orders that a fine in the amount of $500 per recurrence of the violation thereafter shall be imposed upon the Respondent. Vice Chair Yerzy seconded the motion. Mr. Foot inquired if the Board could impose a $1,000 fine and if this was the first time the situation was a violation. Officer Roehrich responded the owner was issued citations and warnings in the past. This was the first time the violations have come before the Board. The Respondent was not a repeat offender as it pertained to the Code Compliance Board. She noted the maximum fine was $1,000 and she requested that amount be imposed because the owner has no regard for the citizens or the dogs. 4 Meeting Minutes Code Compliance Board Boynton Beach, FL June 15, 2011 Vote Ms. Carroll amended her motion to impose a fine of $1,000 per occurrence. Vice Chair Yerzy agreed to the amendment. The motion unanimously passed. When asked if Animal Control could seize the dog, Officer Roehrich testified she could only seize the dog if it was in violation of criminal law and it was not. The owner's intent was to chain any dog on the property. Case No. 11-980 James Johnson Jr. - Seacrest Farm Dairy Store 913 N. Seacrest Boulevard CO CH9 SEC 9-22(C) Fire Inspection Annual Fee. Property Address: Violation(s): Deanna Richardson, Administrative Associate, presented the case as contained in the Notice of Violation. Staff recommended 10 days be given to correct the violation. Motion Based on the testimony and evidence presented in the aforementioned case, Ms. Carroll moved that this Board find that James Johnson Jr. - Sea crest Farm Dairy Store is in violation of the City of Boynton Beach Code Section as cited, and moved to order that the Respondent correct the violation on or before June 25, 2011. The Board has considered the gravity of the violation, the actions taken by the Respondent, and any previous violations by Respondent, and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $100 per day for each day the violation continues past June 25, 2011 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection and verification of payment of the fees to comply with this Order. Congress Ave. CO CH9 SEC 9-22(C) Fire Inspection Annual Fee. Ms. Richardson presented the case as contained in the Notice of Violation. Staff recommended 10 days be given to correct the violation. The Respondent was a repeat violator. 5 Meeting Minutes Code Compliance Board Boynton Beach, FL June 15, 2011 Motion Based on the testimony and evidence presented in the aforementioned case, Vice Chair Yerzy moved that this Board find that Boynton JCP Associates - KIWI (1998) is in violation of the City of Boynton Beach Code Section as cited, and moved to order that the Respondent correct the violation on or before June 25, 2011. The Board has considered the gravity of the violation, the actions taken by the Respondent, and any previous violations by Respondent, and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $250 per day for each day the violation continues past June 25, 2011 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection and verification of payment of the fees to comply with this Order. Ms. Richardson noted the tenant, KIWI, was a repeat violator and this was the second time they did not pay the fee. Both the tenant and the property owner were being cited under the same order. Ms. Carroll seconded the motion that passed unanimously. Case No. 11-1085 Property Address: Violation( s): Seashore Industries, Inc. - Jans Jewelry 515 N. Federal Highway CO CH9 SEC 9-22(C) Fire Inspection Annual Fee. Ms. Richardson presented the case as contained in the Notice of Violation. Staff recommended 10 days be given to correct the violation. Motion Based on the testimony and evidence presented in the aforementioned case, Ms. Carroll moved that this Board find that Seashore Industries, Inc. - Jans Jewelry is in violation of the City of Boynton Beach Code Section as cited, and moved to order that the Respondent correct the violation on or before June 25, 2011. Staff recommended 10 days be given to correct the violation. The property was cited in the past, but staff cited the wrong owner. The pool was unsecured. Case No. 10-2928 Property Address: Violation( s): Randolph II & Martha Williams 2810 SE 5th Circle BBA FBC 04105.1.1 Remove or obtain a new permit for rear porch enclosure. Red tagged. John Herring, Code Compliance Officer, presented the case as contained in the Notice of Violation. Staff recommended 45 days be given to correct the violation. The Respondent has contacted the Building Department and must either remove the porch or have a new contractor pull the permit. An owner/builder permit was not permissible. This case pertained to the permit for a prior case. Staff had previously given time to the Respondent because once an inspection is made on a permit, it automatically extends the permit for six months. The Building Department voided the permit and gave the Respondent the choice to obtain a new permit or remove the structure. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $200 per day for each day the violations continue past June 25, 2011 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Case No. 11-770 Property Address: Violation(s): Jean & Marie Bobo 2212 SE 3rd Street CO CH10 SEC 10-56(B), (D),(G) CO CH15 SEC 15-120(D) 1 INC Repair or replace all broken and missing windows. Mow, weed and trim property. Replace or repair all damaged or rotted fascia and soffits. Remove trash and debris and outside storage items. Officer Herring presented the case as contained in the Notice of Violation. Staff recommended 60 days be given to correct the violations. The Respondents needed time due to a death in the family. About 10 feet of soffit needed to be removed and one window was boarded up but still needed to be replaced. There were no hurricane hazards. Motion Based on the testimony and evidence presented in the aforementioned case, Ms. Carroll moved that this Board find that Jean and Marie Bobo are in violation of the City of Boynton Beach Code sections cited and moved to Order that the Respondents correct the violations on or before August 14, 2011. The Board has considered the gravity of the violations, the actions taken by the Respondents and any previous violations by the Respondents and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $100 per day for each day the violations continue past August 14, 2011 plus administrative costs shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Officer Lewis presented the case as contained in the Notice of Violation. Staff recommended 15 days be given to correct the violation. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Alexis moved that this Board find that Jean & Chrislene Volcy are in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondents correct the violation on or before June 30, 2011. The Board has considered the gravity of the violation, the actions taken by the Respondents and any previous violations by the Respondents and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $150 per day for each day the violation continues past August 30, 2011 plus administrative costs shall be imposed. (2553 SW 10th St.) is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent correct the violation on or before June 30, 2011.
