2. F AC CRA Functions & Development Department Merger Recommendation -
Dave Madigan
City Commission concurred; no further action required. Status quo.
3. F AC Forest"' & Grounds Recommendation - Merline Pamplona
City Commission reviewed and requested mid-range solution of elimination of all turf
medians and conversion to drought resistant materials. Noted other savings will come
from re-organization.
4. F AC Cell Phone Recommendation - Bill Shulman
City Commission reviewed and concurred generally with approach. City Manager to
come up with further cost containment ideas including further restrictions/reductions
and possible employee cost participation with city-issued equipment. Carriers and
contracts need to be reviewed as to rate impact and use limits.
5. F AC Golf Recommendation - George Feldman
City Commission concurred with status quo.
6. FAC Hiring Freeze Recommendation - Dave Madigan
City Commission concurred with report and noted this has been on-going since 2007
with a soft hiring freeze and the 2010, 2011 Voluntary Separation Program. The
effort should continue.
7. FAC HOA Contribution to City Programs Recommendation - Bill Shulman
Once item was clarified the City Commission concurred with a limited solicitation
program that would not interfere with the fundraising efforts of the Greater Boynton
Beach Foundation.
8. FAC Libra", Recommendation - Merline Pam pion a
City Commission reviewed hours reduction and favored development of an alternate
that would allow for later AM opening hours on weekdays rather than closing earlier.
Staff to come back with supplement as part of budget.

9. F AC Paperless Billing Recommendation - Don Scantlan
City Commission noted that this has been partially implemented with an increase in
the number of customers paying on-line. The paper bill opt out process needs to be
publicized more.
10. FAC Recreation & Parks Recommendation - Merline Pamplona
The contract with East Boynton Beach Little League was discussed. Staff is
recommending it not be renewed. With respect to the F AC recommendation for
recreation fee increases, the City Commission requested comparative information.
The City Manager suggested benchmarking 15 core fees to see where Boynton Beach
compares with other cities and the county.
There was also discussion of installing a parking system at Boat Club Park. Staff to
prepare basic study information on cost benefit.
11. F AC Revenue Increase Recommendations - Bill Shulman
City Commission reviewed the list and agreed to look at a possible Fire Assessment
hike as part of the budget. Other revenue items would also be reviewed by staff as
part of the budget.
12. F AC Sale of Surplus Physical Property Recommendation - Dave Madigan
City Commission reviewed and noted this was an ongoing program.
13. F AC Sale of Surplus Real Property Recommendation - Dave Madigan
City Commission concurred with the F AC recommendation to move forward with a
staff review team for real estate disposal.
14. FAC Solid Waste Franchise Recommendation - Geofl~e Feldman
City Commission discussed and was leaning against pursuing the idea of franchising
solid waste. Matter was left with F AC for further study and review.
15. FAC Solid Waste Recycling Recommendation - George Feldman
City Commission concurred with F AC to continue with the program.
16. FAC Take Home Vehicles and Car Allowance Recommendation - Bill Shulman
City Commission reviewed and requested that staff include as much reductions as
possible (allowances and take-home) for the budget.

City Commission reviewed and noted this program has been implemented.

City Commission reviewed. An on-line bill view feature was noted as being desirable.
Staff is working on this.

City Commission reviewed. The recommendations have been incorporated into the
FY 12 budget.

City Commission and F AC reviewed an updated report. Following discussion, the
matter was referred back to the F AC for further discussion and voting.

and F AC requested to develop alternative transportation sources and an information /
implementation strategy.

,J See. 3.01. Election and term of commissioners; staggered terms.
(a) The election of city commissioners, including the mayor, shall be as provided by
this Charter, general and special law. The terms of the city commissioners and mayor
shall be four (4) years; except, at the presidential election of2012, those elected to three
(3) city commission seats shall be elected for terms of six (6) years in order to institute
staggered terms among members of the city commission in accordance with section 3.04
below. Each city commission seat shall be filled separately; and candidates for the city 3> ~ w-.5
commission or office of mayor shall designate, at the time of qualifying, the office for
which they will run. There shall be six (6) districts. Each commissioner shall reside in
one of the districts, and shall be elected only by the qualified electors who reside in the
same district as the commissioner. The district boundaries shall be set by ordinance and
updated after each decennial census or as otherwise required by law.
(b) No person may appear on the ballot for election as mayor if, by the end of
the current term of office, the person will have served (or, but for resignation,
removal or forfeiture, would have served) in that office for twelve (12) consecutive
years. No person may appear on the ballot for election as city commissioner from a
particular district if, by the end of the current term of office, the person will have served
(or, but for resignation, removal or forreiture, would have served) in the office of city
commissioner from that district for twelve (12) consecutive years. The limitations set
forth in this paragraph shall apply only to terms of office beginning after this paragraph
becomes effective by approval of the electorate.

(c) TERM LIMITS.--
(1) No oerson may serve in the oosition of Mayor for more than two
consecutive terms; provided, however, that service, as Mayor during the unexpired
portion of a term which another person was elected shall not be counted when applying
this limitation. Ifa person who has previously served in the position of Mayor does not
serve in the position of Mayor for at least one full term, that person's prior service shall
no longer be counted when applying this limitation. Service as Mayor resulting from any
election held prior to March 2003 shall not be counted when applying this limitation.
(2) No oerson may serve in the oosition ofCitv Commissioner (re2ardless of
Seat) for more than two consecutive terms; provided, however, that service, as
Commissioner during the unexpired portion of a term which another person was elected
shall not be counted when applying this limitation. If a person who has previously served
in the position of Commissioner does not serve in the position of Commissioner for at
least one full term, that person's prior service shall no longer be counted when applying
this limitation. Service as a Commissioner resulting from any election held prior to
March 2003 shall not be counted when applying this limitation.

.JSECTION 2 TERM OF OFFICE OF COMMISSIONERS.
The Mayor-Commissioner and other City Commissioners shall be elected for a term
of four (4) years or until his or her successor is duly elected and qualified as hereinafter
provided. No oerson shall be elected to the City Commission more than two
consecutive four (4) year terms. The term of office shall begin on the first regular
meeting of the City Commission following the certification of election results, except as

J ~ 4.03. Election and terms.
(a) A Primary Election and a General Election are to be held pursuant to law. The
General Election date for councilpersons from Districts 2, 3, 5, and 7 shall be held on the
first Tuesday after the first Monday in November in odd numbered years beginning in
November, 2007 and every fourth year thereafter. Councilpersons for Districts 1,4, and
6 and the Mayor shall be elected at the general election held on the first Tuesday after the
first Monday beginning in November in odd numbered years beginning in November,
2009, and every fourth year thereafter. Primary Elections shall be held on the second
Tuesday after the first Monday in the month of September.

,J Sec. 2.03. TERM OF OFFICE.
(a) Elected Commissioners shall take office at the beginning of the next official
meeting following the municipal election at which they were elected. They shall hold
office for a term of three (3) years, or until their successors are elected and qualified,
unless:
(1) The individual has been appointed or elected to fulfill the term of a
Commissioner-at-Large who has been removed from office other than by means of recall,
fotfeited the office of Commissioner- at-Large, resigned, or the office has become vacant
due to the death of a Commissioner-at-Large. In such event, a successor Commissioner-
at-Large shall assume office in the manner set forth in Section 2.04. in this Charter.
(2) The individual has been elected to fulfill the term of a Commissioner-at-
Large who has been recalled from said office by the electorate. In such event a newly
elected Commissioner-at-Large who is replacing a Commissioner-at-Large recalled from
office shall serve a term equal in time to what would have otherwise been the time
remaining in the term of the recalled Commissioner-at-Large's term; or
(3) The individual is elected to fill a term otherwise consistent with this Charter.
(b) Neither a commission member or the mayor may Qualify for or serve more
than two (2) comolete consecutive terms and the oortion of an unexoired term
occurrinS! by reason of a vacancy. Notwithstanding the foregoing, an elected city
official, such as a commissioner, who has served the maximum time in office as
permitted by this paragraph, may qualify for and be elected to serve in a difTerent
city elected office, such as mayor. Further, a commissioner or the mayor who has served
the maximum amount of time permitted by this sub- section may again serve on the
commission subject to the time and term limitations of this sub-section; provided, that the
official has not served on the commission for at least one (1) year (three hundred sixty-
five (365) days = one (1) year). Any city elected official who resigns within one (1) year
(three hundred sixty-five (365) days = one (1) year) before the end of the second
consecutive term of office shall be prohibited from qualifying as a candidate for a
