3 AN ORDINANCE OF THE CITY COMMISSION OF
4 THE CITY OF BOYNTON BEACH, FLORIDA
5 AMENDING CHAPTER 26, WATER, SEWERS AND
6 CITY UTILITIES, AMENDING SECTION 26-8,
7 AMENDING SECTION 26-9, REVISING THE RATE
8 SCHEDULE FOR POTABLE WATER AND
9 WASTEWATER; AND PROVIDING FOR CONFLICTS,
10 SEVERABILITY, CODIFICATION AND AN
11 EFFECTIVE DATE.

13 WHEREAS, in order to move forward with the Water & Sewer Utility Capital
14 Improvement Program it is necessary to issue approximately $20,000,000 in Utility Revenue
15 Bonds; and
16 WHEREAS, based on an independent User Rate Update Report completed by
17 CH2MHill the City's will need to adjust its water and wastewater rates in each year over the
18 five-year period from FY20 11-12 through FY 2015-16 to help ensure that sufficient revenues
19 will be generated to meet the new debt service requirements; and
20 WHEREAS, the provisions of Section 180.136, Florida Statutes, requiring notice of
21 proposed increase to any rate, charge or fee for water or sewer utility service, have been
22 satisfied, as the required notice has been furnished to each utility customer through the City's
23 regular billing process; and
24 WHEREAS, in order to ensure that the projected requirement increases are covered,
25 adjustments for potable water and wastewater rates are necessary; and
261 WHEREAS, the City Commission of the City of Boynton Beach, based upon the

27 justification provided by the City's utility system consulting engineer in a report to the City

1 Commission and by City staff, deems it to be in the best interests of the citizens and residents
2 of the City to amend Chapter 26, Water, Sewers and City Utilities, of the City of Boynton
3 Beach Code of Ordinances to provide for these necessary changes.
4 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
5 THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
6 Section 1. Each Whereas clause set forth above is true and correct and
7 incorporated herein by this reference.
8 Section 2. That Chapter 26, Article I, Section 26-9, entitled Water and
9 wastewater rates and charges, is hereby amended, as follows:
10 Sec. 26-9. Water and wastewater rates and charges.
11 The monthly rates and charges for water and wastewater shall be as set forth in
12 the fi.ve-multi year schedules in this section. Such rates shall become effective on
13 MayNovember 1st in FY 2011-12 and October 1st of each of the fiscal years
14 thereafterindicatcd and shall not be prorated:

3 The maximum sewer commodity charge for residential customers (in city or outside city)
4 will be based upon a maximum sewer usage of seven thousand (7,000) gallons per month.
5 Commercial accounts will be billed sewer charges based upon total water usage.

6 I For multi-family buildings (in city or outside city) in which several dwelling units are
7 serviced by a single meter, the base facility charge per meter shall be calculated by
8 multiplying the number of dwelling units times the standard base charges for water, sewer
9 and stormwater. The billing for consumption shall similarly be calculated by dividing the
10 I total monthly consumption for each meter by the number of dwelling units, in order to
11 I determine the billing rate and amount per dwelling which is then multiplied by the number of
12 units on each meter. Billing for utility services for multi-family parcels shall commence on
13 the first day that either a sewer connection is made or a water meter is set in place.

1 If the utility account is temporarily disconnected, there shall continue to be a minimum
2 charge for water and wastewater billed monthly and calculated at the base rate for the
3 applicable billing category.

6 Section 3. Each and every other provision of Chapter 26, not herein specifically
7 amended shall remain in full force and effect as previously enacted.
8 Section 4. All ordinances or parts of ordinances in conflict herewith be and the
9 same are hereby repealed.
10 Section 5. Should any section or provision of this ordinance or portion hereof,
11 any paragraph, sentence or word be declared by a court of competent jurisdiction to be
12 invalid, such decision shall not affect the remainder of this ordinance.
13 Section 6. Authority is hereby granted to codify said ordinance.
14 Section 7. This ordinance shall become effective immediately.
