He announced the invoCation tonight will be by Rev, Benjamin Tidwell, Pastor, Westside Baptist Church, which will be followed immediately by the Pledge of A~legiance to the Flag led by Vice Mayor Walter Trauger. Mayor Harmening then introduced the new Recording Secretary, Patr±cia Ramseyer. AGENDA KPPROVAL Vice Mayor Trauger requested the addition under "NEW BUSINESS" of Item B, Letters from Attorney under'Union Contracts, Vice Mayor Trauger also stated he wished to 'add two items under "ADMINISTRATIVE": (~) Question of water conservation program in response to South Water Management District; ~2) Approval of construction trailers. Vice Mayor Trauger asked that the following items be deleted: 1. "IV, BIDS: C. False ~rrest Insurance," "VII. LEGAL: B, 4, Proposed Ordinance. PUBLIC AUDIENCE Mayor Harmening stated if anyone in the audience would like to speak on any ±tem not on the agenda, they may do so at this time. He added if anyone would l±ke to speak on an item on the agenda to please give their name to the City Clerk and they will be called upon when that item is the regular order of business Steve Campbell, 1310 S. ~. 2nd Street, Boynton Beach, a resident for seven years, and employed by the Fire Department, came forward to state he was injured on the job. When he filled out forms for WOrkmen's Compensation, the form said "Revised". He discovered the form was under Resolution 78-SS, when Workmen's Compensation was changed by the City, and that under Resolution 80-NN, a Resolution of the City of Boynton Beach adopting the pay plan for the fiscal year and establishing job descriptions for municipal posts under October 30, 1980, there was a change in Workmen's Compensation, The original is Civil Service Rule 11, Section 5, On the Job Injury. He asked whether there was a change in the Civil Service Rule or what. - 2 - MINUTES - REGULAR CITy COUNCIL MEETING BOYNTON BEACH, FLORIDA June 2, 19.81 Mr, Peter Cheney, City Manager, explained that Mr. Campbell's question was addressed as a benefit in relation to terms and conditions of work. The benefit Mr. Campbell refers to is an amendment to the pay plan and does affect items that would be negotiated with the Union and is an item the Council cannot unilaterally change relative to the Union contract. There- fore, it is clearly not a part of the benefits for a Union member. This was done as an Amendment to the pay plan of the City of Boynton Beach. Mr. Cheney also stated he had d~scussed this with the Union President and if Mr. Campbell did .not feel this was appropriate, he should file an agreement through his attorney that is appro- priate. It is not an item for public forum. Mr. deLong asked whether this would have any effect on the injuries Mr. Campbell received, City Manager Cheney answered that Mr. Campbell is still under the way workmen's compensation was handled prior tO October, 1980, that the Resolution had no affect on him. He does get workmen's compensation as required by State law, He is able to be sure that he has the same take home pay that he had prior to earning Workmen's compensation by taking gredit against his sick leave and annual leave the way al~ employees did prior to November 1, 1980.. Since November 1, 1980, bene- fits have been improved for non-Union employees. ~e is eligible for workmen's compensation and is getting workmen's compensation today. The pay schedule of the City of Boynton Beach is a part of a pay plan adopted by the City Council. As they affect him~ they have not been amended. The Civil Service Rules stand as they are. A year ago, we were receiving 47'¢ for the sale of lime and now receive 80¢ per cubic yard. Mr. deLong moved to accept the recommendation of the Tabulation Committee to award the sale of the lime sludge from the Water Treatment Plant to Herb Willard Trucking, Inc., Lake Worth, Florida. Interior Paintin'g of water TQwer City Manager Cheney stated that Sunshine Painting, Orlando, was the successful bidder on the inside painting of the water tower, is a quality company, and.the Utility Director and the Tabulation Comm±ttee recommehded the granting of the award to them in the amount of $18,400.00, with a completion date of 45 days. Review High Point Recreation Land Value Determination Mr. J. Kenneth Tate, Vice President, came forward to discuss park ordinances and land value. Last month Mr. Tate went before the Planning and Zoning Board. The land value was proposed and approved by the Zoning Board, was to be recommended to Council, but the Council approved a different figure. In discussing it with the City Manager and City Attorney, Mr. Tate asked to be present at this meeting. $50,000,00 an acre figure was approved by the Council on the May 5th meeting. Mr. Tate feels the figure is unrealistic and the land is not worth that kind of value, Mayor Harmening advised him to simply get the appraisers they suggested at a previous meeting and ~he would have no more problems. Mr. Tare replied he was trying to save himself and his consumers the cost of an appraisel, and asked them to reach a fair value on the land at this meeting, City Attorney Vance advised they thought 'Mr. Tate had been notified the matter would be heard but Mr. Tate had not been notified. In a matter of fairness, Mr. Tate should be given an opportunity to proceed, Mayor Harmening said the land value can be set by an appraiser or determined by the City Council, but Mr. Tate said the Ordinance he had said it is to be determined by the Planning and Zoning Board. Mr. Tate said he paid $16,000 per acre for a piece of property which closed in February of 1979. Realizing some inflation factor, he coul~ not understand how the Planning and Zoning Board ~oUtd come~i, up with $50,000 an acre in less than 2 years, 3 times the value. The Planning and Zoning Board came up with a figure of $30,000.00 an acre, which he felt was a little bit high but in light of the expense of hiring an outside appraiser and remaining congenial with the City, he would like to find a figure around that level. Mr. Tate further stated he did not know where the $50,000.00 figure came from but knew the Director of Planning and Zoning found one piece of property somewhere in the City which had a price of $8,000.00 a unit .... However, that piece of property was only zoned 4-1/2 units to the acre, It was on a wide open waterway~ had fill and no fill problem. High Point"s property is not on any waterway, substantially below building grade, requires a substantial amount of refill±ng~ and there is a - 7 - MINUTES ~ REGULAR CITY COUNCIL MEETING BOYNTON BE~CH_~, FLORIDA June 2, 1981 great amount of muck on the property which is being removed presently and how the figure of $50,00.,00 came about escapes them, Mayor Harmen~ng explained that the Council did not feel they were qualified to set an appraised value on this and since Mr, Tate was reluctant to hire an appraiser, the Council thought they would set it'high enough to protect the City, Mr. Tate said he believed the Planning and Zoning Board recommended a figure to the Council and asked why the Council turned it down, C~ty Manager Cheney stated that they had indications and made a ~eport to,the 'Council. He said it may be that there were other sales more recent than Mr. Tate's. Land values are going up, Mr. Tate's one sale does not make a market, It makes less of a market than a new sale. He told Mr~ Tate that what Mayor Harmening is suggesting as a solution or answer for everybody is to get an appraisal, That also is provided in the Ordinances, To address th±s question of rapidly changing market value, Mr~ Tate's figure and the figures the Council have heard suggest that the fair way of doing ±t is to have an independent MAI, qualified appraiser, and then the public interest and Mr. Tate's interest is protected. Mr. Tare asked whether the Council would abide by what the Appra±ser finds and asked whether it had to be an MAI Appraiser, as it is not stated in the Ordinance. Mr. Vance, City Attorney replied that he had been given the names of three different MA~ appraisers, that the Council does have the right to approve the appraisal and they want an MAI appraisal. City Manager CheneY told Mr. Tate to go by what City Attorney Vance suggested and the Council will abide by it. Hunters Run Golf & Racquet Club, submitted by Mr. Charles Gilbert, Agent Location: Congress Avenue and Summit Drive - Tract "N" Use: Preliminary Plat - Summit Plat No. 1 (Hunters Run Tract "N") Mr. Carmen Annunziato, City Planne~-showed the site plan a~d pointed out that Hunters Run has an overlay which represents the entire Hunters Run Development. To the right is Congress Avenue, to the South Canal 30, to the North Canal 28, and Summit Drive meanders through the entire Site, ~which forms the main spine that holds the forced mains and water lines which serve the entire tract. - 8 - MINUTES - REGULAR CITY COUNCIL MEETING BOyNTQN BEACH, FLORIDA June 2, 1981 Tracts A, B, BI, B2, M, L and C are in various stages of construction. The item which is on approval now is a preliminary plat for Tract N, which sits somewhat to the South and West of the Club House on the North side of Summit Drive. Mr. Annunziato had an overlay which is to serve as both a site plan and preli~minary plat. He said the tract line is the outside line and the units are noted on a loop road on both sides with the lake being constructed to accept the drainage and provide an esthetic view. In addition, there is a wall being proposed on Summit Drive to offer~some~ privacy for residential users. The preliminary plat is coming to the City for approval and will eventually go to the Clerk of the circuit Court for recording. The preliminary plat provides for definitions as to who is responsible for maintenance of private roads and lakes, and the development plans that come with the plat provide for the construction of the sewer, water, paving and drainage. The plans were reviewed by the Technical Review Board and a recommendation was made to the Planning and Zoning Board that the plans be approved subject to staff comments, which were as follows: Utility Department advised that ~the sewer 1.ine's should be relocated so that they are under pavement instead of cutting across the arc of the road. Also, Mr. Cessna suggested additional manholes be constructed. The Public Works Director notes that there should be no underground garbage cans, Councilman deLong moved, seconded by Council-man Wright, to approve the Preliminary Plat for Housing Tract, Summit Plat No. 1 ~Hunters Run Tract "N"), as submitted by Mr. Charles Gilbert, subject to staff comments and a bond in the amount of $79,000.00. It is the site plan which is reviewed for unit location. The landscaping and architectural plans are reviewed by the Community Appearance Board. The proposal is to construct 30 units in fifteen build- ings. These buildings are somewhat of a duplex nature, shar- ing a common wall. In addition, it is proposed that a pool be constructed a~ this location with restrooms. Street lighting will be provided and the remaining facilities such as mail boxes and the underground utilities. This also was' reviewed by the Technical Review Board and it went to the Planning'and Zoning Board with the positive recommendation for the plan to be reviewed, subject to a comment from the Public Works Department which notes no under- ground garbage cans. It ~s a two story-building wh±ch is proposed with a drive through of approximately one-third of the project with an entrance on Seacrest and an entrance on 25th ~enue. This application was reviewed by the Technical Review Board with comments as follows: Building Department: Concrete walks must continue through the driveway approaches. County approval on Seacrest turnout is required, Catch basins and drain fields subject to Engineering approval. Main floor toilet must meet-~hand±cap;~ does-~ot as shown on plans. French drain pipe should be a minimum of 15 inches. Catch basins at each end of the French drains are recommended so that pipe cleaning will be easier and a permit will be required from the County for the turnout onto Seacrest. Police Department Traffic areas and security lightings are suggested. Public Works Department No underground garbage cans. Energy Coordinator Recommend that energy efficient high pressure sodium vapor lightingr~e used~ This application went to the Planning and Zoning Board with a positive recommendation from the staff. The Rlanning and Zoning Board recommends to the City Counc±l unanimously that these plans be approved, subject to staff comments. --The-=plat was reviewed by the Community Appearance Board and also comes to the Council with a positive recommendation. Mr. Kerry Kessel said he was familiar with all the staff comments and will have no problem meeting them. Vice Mayor Trauger asked whether there was an elevator in the building and what about the handicapped in a two story building, Mr. Annunziato explained that this will be a one use building for the Kessel Construction Company, to be utilized by Kessel and their project managers, architects and staff. Ft. ~ffic'e '~uil'd~'ng Mr. Carmen Annunziato, City Planner, said this is a proposed office building located at the intersection of Gulfstream Boule- vard and Old D~x±e Highway in the Southeast corner. Directly to the East of this building, for approximately one-half of the North/South property line is Wendy's, which was previously approved and has now been permitted. They share a common property line. - 11 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA June 2~ 1981 The application proposes to construct an approximately 25,000 square foot office building with access to the site from Gulf- stream Boulevard and from Old Dixie Highway, Future rights-of- way had been accounted for in the proposal with ample right-of- way for both Gulfstream and Old Dixie. Circulation through the site is through the driveways in a manner coming from Old Dixie Eastward and then Northward. The remaining areas are to be landscaped, which are not in pavement or building. There are 66 parking spaces required and 87 are proposed. The site is almost 63,000 square feet in size. The building area accounts for some 20% of the site with approximately 27% of the site in landscaping. The proposal is for a two story building, the central core to access offices on the North and South s~de of the central cores, both on the 1st and 2nd floors. This proposal was-reviewed by~he Technical Review Board and went to the Planning and Zoning Board with a positive recommenda- tion, based on staff comments, as follows: Building Depart. ment 1~ Turnout permits will be required for both driveways. 2) S~dewalks must be constructed to go through the driveways. 3) Location of this site is presently not on the Flood Zone Maps. HOwever, would assume it to be C. The reason for this is that the property was recently annexed into the City less than a year ago. 4) Parking for office calculated by square footage within a building, not leaseable area. Square footage indicates a need for 84 spaces. The plan shows 87. 5) All requirements must be met for handicapped. Engineering Department 1) Paving and drainage to be done by Florida Registered Engineer with drainage calcu- lations. Elevations are required. They pay that amount, get a- receipt, take the receipt to the Police Department, and in accordance w~th Section E, which says: "Each solicitor, including managers, shall be required to obtain an identifiCat±on badge from the Boynton Beach pol±ce Department. Such badge shall contain the name of the solicitor, as well as the ha-me and address of the organization he represents." The applicant is then sent to the Police Department for a badge~ If there is a list of members of an organization, the list is sent to the Police Department, a copy of the ID they issue is sent back to the Clerk's Office, and as soon as all members that requested ~adges receive them, the permit is issued. He brought out the fact that the City is trying to get a lot of activity for citizens on 150 acres. Mr. Von Hagge recommends not making~ something different than an 18 and 9 will be "Mickey Mousing" around. In this small acreage you would take away so much, you would have neither an 18 regulation course nor a non- executive course, and would reduce the attraction of both courses in the market place. He indicated a course of three 9s or 27 holes has 238 acres. Preserving the executive course, in conjunction with a regular 18 hole development will more adequately provide for meeting the total community golfing needs. Mr. Cheney .read the pros and.cons for these courses. - 20 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, Florida June 2, 1981 Mr. Cheney pointed out that the water on the land does not interfere with the use of any of the land or with play in most of the holes. Contours must be provided, particularly for safety in the fairways, and by taking the dirt out of the lakes, it would provide the protection needed between fairways. It also provides inexpensive space that does not have to be maintained. The space in grass would have to be maintained. ~With water, it does not have to be maintained. Mr. Cheney said Mr. Von Hegey advised that by locating the water where it is, you have eliminated the need to "carry water all over the place." This reduces the construction cost considerably. Dirt will not have to be moved.~ Vice Mayor TraUger asked if the recommendation was for an 18 hole Regulation and 9. hole Executive and asked about the 40 acres in the original plan. Mr. Cheney replied that the 40 acres would still have a 9 on it, but at a later time. Vice Mayor Trauger asked if that would be in five years, and Mr. Cheney said it would be five years ±n the minimum. Mr. Cheney said all we are going with now is the 18 and 9, a total of 27, and not 36. Councilman deLong moved and Vice Mayor Trauger seconded to accept the concept, as presented, of the 18 hole golf course and 9 hole Executive course and the recommendat~on~s of Robert Von Hagge, and through information provided by National Golf Course Foundation through a nationwide survey. Councilman Wright added he hoped it will be a municipal golf course and meet the needs of as many people as possible in the City of Boynton Beach, general advantages of ladies, restricted incomesf and people who have to work for a living. They have attempted to address the financial matters quite conservatively. He advised the City has a lease on what is called the "Pistol Range Area"~ The City has had two leases; one lease was for some t2 acres, and the current lease is for 1.3 acres, The Council expressed a desire to have a pistol range indoors, hopefully operated by the C±ty, that wilI first meet the needs of the Police Department and, secondly, be available for c~t~zen participation and citizen use. It is to be something run'by the City, so we know it is there and operable, and with no criticism of the Fraternal Order of Police, but not contingent uPon'.~the ups and downs of a voluntary organization. The suggestion made by the Fraternal Order of Police, in Mr. Cheney's discussions with them, has been that the City buy out the leasehold interest they have on that one plus acres of land. They would then have some funds to go ahead and build a club house some place; the City would take ownership of the building that is there, which the City would outfit and make available. Councilman deLong asked what the price would be. City Manager Cheney said he looked at the lease, as it had been revised in 1977, and asked the C~ty Attorney what the leasehold interests were that the FOP has. The location and size of sUch utility facilities to be determined solely by the Lessor." - 22 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA June 2, 1981 City Manager Cheney said that the above paragraph says, in general layman's language, that the City has the right to put in almost any kind of a utility facility on that 1.3 acres of land any time they wish to. With that condition in there, the value of that land that the FOP has is not very much. He pointed out the follow- ing: The City may not have meant to say that when they wrote the lease. It may have purposely been left in the revised lease, or it may accidently have been left ~n the revised lease when they reduced it to 1 plus acre but it appears that this condition in the smaller acre lease has a real effect on the value of the interest of the FOP. City Manager Cheney asked for guidance from the Council. Vice Mayor Trauger asked whether anyone was on the Council during 1977 and none of the present Councitmembers were. He asked how much actual funds have been expended Dy the Fraternal Order of Police in building this item so far and if the condition of the building today shows that investment now minus normal wear and tear or depreciation. City Manager Cheney told Vice Mayor Trauger he thought perhaps Vice Mayor Trauger's questions would be the reasonable way to go, that the City should acknowledge what the lease says, what the City has, but that it would be fair to judge that the people who wrote the lease did not mean to have no value in the situation. The FOP has the cost of the construction of the club house. The front porch of that~!~building depreciated- There is-some question as to how many ~years the ~OP used that on~ acre but, obviously, the City could put a water pipe or sewer pipe through there, so that is an impasse. The cement structure at the back of the club house was built entirely with City funds. Mr. Cheney said he suspected there were some expenses that the Fraternal Order of Police should have had, like improvements in fencing and building and insurance, which would be a negative side. He stated he thought it would be the fa±r way to go, to look at the construction value of the building depreciated some several years, the future use of it, and try to arrive at a negotiated value that way. He stat.ed he had read, the four letters with great concern and these four tetters by a so-called attorney from-Palm Springs are all dated on the same day, May 26, 1981, Vice Mayor Trauger said he believed the "supercilious clod" is. demanding, threatening and intimidating the City Council and the City Manager to take the action or to make the decisions, and is telling the City Council what they should do and the City Manager what he should do. Mr. Trauger further stated that it seemed to him that some of these young attorneys who have been appearing here before, who have just passed the bar exam, feel it g~ves them license to threaten and intimidate, He said he really believed about the only bar "this man Vas~allo passed was probably Morey's up here on North Federal." Mayor Harmening assented with, "Amen". Vice Mayor Trauger continued by saying he did not believe Attorney Vassallo learned in jurisprudence that bad manners or a boorish attitude should be condoned by anyone. He should have learned in kindergarten that the little words, "thank you" and "if you please" have more weight than the words he is trying to use in the threats he has made here. He said he did not wish to have the City Council threatened and intimidated in Union negotiations by such an ill mannered young man with such bad manners. There is approximately $200,000,00 in community development funds from current funding and $200,000.00 is anticipated to be added to that as of October 1, the beginning of the new Federal fiscal year, and the seventh year funding coming to the County, Mr. Cheney said the CD had authorized the City to get as much done on this project ahead of time as they could, to go ahead and tackle the tedious process of selecting engineers. The CD office has participated in that. Mr. Cheney also said the CD ~office wants the City to proceed with the beginning of designs and the money we have in the anticipation the funds will co-me, and we can go on, He said, as required by law on Engineers Selection Process, letters were sent out plus the proposalS. Also, many engineers were called~ A number of applications have been received and reviewed, City Manager Cheney appointed, as has been done in the past~ a staff committee of four, and was joined by the County to review the engineers, The engineering firms are now'narrowed down to three. He asked how the three firms line up and stated the task for the Council was to interview those three plus others, interview none, select from the list, or tell them what to do next. M. downstairs. Review Preliminary Report on Dralnaqe Solution - S. W. 6th Street and S. W. 28th Avenue Area - Requested by Vice Mayor Walter Trauger City Manager Cheney explained that this was a Prelimary Report, taking a look at the drainage problems there, in response to some questions of how to solve the problem. It is proposing piping.and two pumps. Councilman deLong asked if this would be a three year project and how soon City Manager Cheney anticipate~i,~working on it. City Manager Cheney replied the assumption is it would handle a three year storm intensity, whatever that would be, and there are no budgeted funds, so he does not anticipate any time unless the City wants to spend the money. Vice Mayor Trauger recommended the plan be taken as now presented and submit it for a budget proposal item in the budget'cu~ent~y being prepared for the next fiscal year. Councilman deLong seconded the motion with the provision3~that there are other areas that should be given priority, such as N. E, 4th Street. Motion carried 5-0. - 27 - MINUTES OF REGHLAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA June 2, 1981 Review Report on Mutual Assistance Agreement with Town of Ocean Ridge - Requested' by 'COuncflman 'Joe deLong City Manager Cheney said in relation to the above, he had prepared a paper on mutual aid in this area, He.said the .City had a mutual aid system W~ich is a "good friend, gentleman's agreement arrange- ment'', but it does not really give us very much of a guarantee. It leaves out some very basic costs of-mutual aid or~'bargaining assurance with them in the past, The City does not have and has no commitment for joint training, replanning, working together, and understanding of what eachorqanization can dO for the other. The City has a tremendous waste of manpower-, quality manpower, and quality equipment sitting around that is not being used adequately. Mr. Cheney further Said the biggest.problem in the Fire Service is they have no fires. They do not have a chance to get any practice, and "we~.all Sit around and talk about that fire that may come." City Manager Cheney said.one of the great opportunities in a good mutual aid assistance program, where we help each other, (talking about Boca, Delray, Del-Trail, Reservation, Ocean Ridge), is it creates an opportunity where they have more of aL chance~.to work together, and the City should move in this direction. He said he would like to see Boynton Beach take the leadership in cooperative buyer response. Some response he gets from neighboring juris- dictions is, "Well, Council doesn't ~ever like to see our truck go out of town." And Mr. Cheney replies; "Yes, but that Council likes to see several other trucks come into town when help is needed." The Mutual Aid Agreement says that if someone decides they do not want to come to_the fire, they do not go to it. Mr. Cheney said he thinks if it is in their jurisdiction, someone should already be there, helping them out"in that jurisdiction at that time. He said he wanted to be sure they had been there before and are will- ing to do pretraining and preplann-lng with us, which means an expansion of manpower, time, gasoline, and equipment but he feels it is the only way in which we can ever really respond to the needs of our own major facility, which is the hospital, which is well protected, but even so, it is our concern of how they would respond to the highschool, which is kind of in "no man's land down there." We should have a prearranged situation of who is going to go to what f~re, where, regardless of what section it is in and who is going to back up and follow up, We should have an understanding that if we have our two trUcks out to another fire, there automatically, without any second guessing, ~ a truck from somewhere to come into our substation and be ready to go. We, likewise, will go to Del-Trail or Delray. - 28- MINUTES OF REGULAR CITY COUNCIL 'MEETING BOYNTON BEACH, FLORIDA June 2, 1981 Mayor Harmening said he agreed with Mr, Cheney wholeheartedly and thought it was one of the~best recommendations they had heard in sometime. He also said he would l~ke to see the press take this up and see if they couldn't stimulate a little interest in the area. Councilman deLong said although he brought this matter up, he doubted whether the City will ever get cooperation from the people in the surrounding area, His~main concern was with the offer that was made by Ocean Ridge insofar asa joint agreement between the Township and the City of Boynton BeaCh. He wanted to know what Ocean Ridge offered 'for ~the reason that our prime resons±bility ±s the protection of the lives and property ±n this city,~nd.£n view of the fact that the City of Boynton Beach does not have an aerial and Ocean Ridge does have an aerial, he thought it would be to Boynton Beach'S advantage ~f there could be some kind of joint agreement if or in the event the City would have to use the service of an aerial. Councilman deLong said the recommendation had been set forth to the City of Boynton Beach last October or November and he has been repeatedly asked by different members of the City Commission of Ocean Ridge what the City intended to do about it. City Manager Cheney said the Ocean Ridge proposal was like all the rest of the agreements and in writing. CitycM~nager~heneysuggested that if we proceed with executing an agreement with Ocean Ridge, that we adopt this kind of procedure, and recommended the City rely on Ocean Ridge's aerial ladder truck without this kind of precooperation and preplanning, He said it would not do any good, and' in a way, the City would be better off not to have a mutual aid agreement w~th Ocean Ridge unless the members follow this approach. Councilman deLong moved to lay this question on the table and requested the City Manager to supply each and every member of the City Council with a copy of the communication which was received last year from Ocean Ridge. There are two deductions for the pipes, one going under the canal and one for the pipes going over the canal, City Manager Cheney recommended approval of the change orders, in the two contracts. City Manager Cheney added that one other aspect of the sewer and water line construction project on Congress Avenue has to do with two small easements, for which appraisals are being obtained, in order to put the line in a location entirely out of the Congress Avenue right-of-way, which had not originally been planned but which he thinks will make sense, He said he hoped to have the appraisals in a day or two~ and hoped to get an order for taking or negotiating those two easements within forty-five or fifty days. City Manager Cheney asked for approval of the change orders under the condition that if the City makes the change in alignment of pipe on Congress Avenue within the next forty-five (45) tQ fifty (50~ days, Southeast Underground Construction w±ll not give us a change order for remobilization of their crew within forty-five (45) to fifty (_50~ days on the left-over Congress Avenue portion, and Southeast Underground has agreed to that condition. Vice Mayor Trauger asked whether they would buy at sixty (60~, and City Manager Cheney replied that he had an agreement for forty-five (45) to fifty ~50~' and thought it should be approved on that. Councilman deLong asked if 60 was recommended and though~ they should try for it. S, 1. Hopefully, this can come into the budget, not to exceed $2,000.00. City Manager Cheney said the City has a South boundary line to start with but the notice o~ entering the City is away down around !5th Avenue. There was discussion about where the City starts, Vice Mayor Trauger said he would like to have'Mr. Sullivan investigate these signs to see. what it would cost for Boynton Beach in the big letters and then the City could do ~its own light- ing. Motion carried 5-0, Schedule a General Info~rmation Discussion on Beach Proposals City Manager Cheney asked for discussion on this issue. He said the-beach plan had been presented to 700 or 80'0 people at 24 or 25 presentations and thought there may be one more to go. He stated he believed it should be scheduled as a general Agenda item if they~want to get a public ±nformation meeting on the question of what should be done with the beach. The original assumption was to go throughout the community, make the presentations to small groups, answer questions, discuss it, and then eventually have a public information meeting and then address the question of a bond issue. Mayor Harmening asked how the reception had been at the meetings. City Manager Cheney replied h±s impression was that the reception had been very positive. If there would be a public £nformation meet- ing, they could take a position if they wanted to and eventually, there would be a referendum on a bon'd issue, Mr. i~Cheney stated he indicated to the people that the bond issue would be in the range of $1,500,000,00, if the~project was done all at once, depending on the length, the issue, ti~me, ±nterest rates etc. City Manager Cheney further reported that he received some interesting comments such as more parking, less picnic area, more picnic area, less parking, but in general he felt very good about the concept. People understand there is a sand problem and a building problem; that the City has an area there that, as they continue to get bigger and keep developing, is not as good look- ing and presentable a beach area as many other places around. It is not serving our citizens as well as many other areas do serve their citizens. City Manager Cheney also stated that he tried to stress if the sand problem was not solved, the beach is going to continue to have a problem. He said the City should solve the sand problem, put in the dunes, and be able to walk along the top so you could see the ocean, sit on benches and in your car and see the ocean. When you raise up the beach, the parking lot, and when that is done, the Whole area will be addressed. Mayor Harmening suggested scheduling it for ~he Regular Meeting on July 7. Councilman Wr±ght asked how long the presentation would be and Mayor Harmening replied it might take at least thirty minutes and it should be at a Regular Meeting because that is when the people would com-e. <The public have to be here to be informed. ADMINISTRATIVE Water Conservation City Manager Cheney stated that as everyone knew, South Florida has indicated that a restriction in conservation level of 10% is what we should be aiming at now, The current Ordinances say between 25% to 30%. The last three or four days it has been about 30%. The question has come up immediately by people, "What are we going to do?" He said he and Mr. Perry Cessna, the Utility Directo~ had talked about it and they suggest that for the next couple of weeks, the City indicate that the restrictions are voluntary, hoping that people will still remember that we are not out of the dry spell yet, but go into the 10% for the next two weeks and see if it stays within the 10% reduction. Councilman deLong moved to accept the recommendation of City Manager Cheney and Utility Director Cessna on the interim policy regarding water usage from 25% to 10% on a voluntary basis. He asked that the City Attorney review page 10, - 36 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA June 2, 1981 Councilman deLong further stated that written requests were made to the City Manager for the establishment and official designation of certain trees located in the City of Boynton Beach as a specimen tree. Upon receipt of such written recommendation, he stated he felt the City Council should notify by certified mail all property owners of a proposed public hearing to consider the report, and designate by Resolution those trees. Mayor Harmen±ng sug.gested a Workshop Session be held or for Councilman deLong to get with City Attorney Vance. Councilman deLong asked why a Workshop shOuld be held. ADJOURNMENT Vice Mayor Trauger moved to adjourn, seconded by Councilmember Woolley. Motion carried 5-0 and the meeting was properly adjourned at 10:45 P. M.
