Minutes 11-16-11 MINUTES OF THE CODE COMPLIANCE BOARD MEETING HELD ON WEDNESDAY, NOVEMBER 16, 2011, AT 6:30 P.M. Call to Order Chair Costantino called the meeting to order at 6:30 p.m. II.Approval of 9/21/11 Minutes, 10/17/11 Lien Reduction Minutes, and 10/19/11 Minutes The following changes, in strikethrough and underline, were made to the September 21, 2011, minutes: Page 3 – Case No. 98-218 – the address should be changed to read, “112 SW 9th Ave.” Page 30 – Case No. 11-2120 - the motion date should be changed to read: “. . . giving Ying Sem Po Trust until October September 22, 2011, to bring the violations of City of Boynton Beach Code sections as cited into compliance.” Motion Mr. Foot moved to approve the minutes. Mr. Cole seconded the motion that unanimously passed. There were no changes to the October 17, 2011, Lien Reduction minutes. 1 Meeting Minutes Code Compliance Board Boynton Beach, FL November 16, 2011 Motion Mr. Foot moved to approve the minutes. Mr. Alexis seconded the motion that unanimously passed. The following changes, in strikethrough and underline, were made to the October 19, 2011, minutes: Page 10 – Case No. 11-2117 – the motion date should be changed to read, “ . . . for each day the violation continues past August 27, October 29, 2011, plus administrative costs shall be imposed.” Page 29 – Case No. 10-3302 – the motion should be changed to read, “ . . . that this Board certify a fine in the amount of $500 for three occurrences, per occurrence plus administrative costs.” Page 14 – Case No. 11-1631 – since Chair Costantino had disclosed a conflict of interest and abstained from voting, the vote should be changed to read, “ The motion was seconded by Ms. Carroll and unanimously passed 6-0, Chair Costantino abstaining.” Motion Mr. Cole moved to approve the minutes as amended. Mr. Alexis seconded the motion that unanimously passed. III.Approval of Agenda Pete Roy, Chief Code and Rehabilitation Officer, announced the following changes to the agenda: Case No. 09-3194 should be tabled to December 21, 2011. Motion Mr. Foot moved that the aforementioned case be tabled until the Code Compliance Board meeting to be held on December 21, 2011. Mr. Alexis seconded the motion that unanimously passed. Case Nos: 11-1719, 11-2452, 11-2659, 11-2518, and 11-2700 had complied. Case No. 11-2610 was removed. Case No. 11-2618 should be tabled to December 21, 2011. 2 Meeting Minutes Code Compliance Board Boynton Beach, FL November 16, 2011 Motion Mr. Foot moved that the aforementioned case be tabled until the Code Compliance Board meeting to be held on December 21, 2011. Mr. Cole seconded the motion that unanimously passed. Motion Mr. Cole moved to approve the agenda as amended. Mr. Alexis seconded the motion that unanimously passed. IV. Swearing in of Witnesses and Introduction Attorney Bridgeman explained the hearing procedures and administered the oath to all who would be testifying. IV.New Businesses Officer Roy called the roll and determined who was present. Chair Costantino requested the Lien Reductions be heard first. There were no objections to the request. Case No. 10-603 Deutsche Bank National Trust 229 W. Ocean Ave. Officer Roy presented the case. The notice of violation was March 2, 2010, for failing to register a foreclosure property. The hearing was held April 21, 2010, and no one appeared. The Respondent was ordered to comply by May 6, 2010, or incur a fine of $100 per day. The violations were corrected on April 18, 2011. The accrued fine totaled $34,600. Ash Kumar, 229 W. Ocean Avenue, the buyer, stated he corrected the violations with his own money, and he did not know why the Bank had not addressed the issue. The home was a single-family home, and his cousin would live there as it was a family property. The purchase price was approximately $57,000. Mr. Kumar agreed to pay the fine, but noted the Bank had the property for a year. Motion Based on testimony and evidence presented in Case No. 10-603, and having been advised that the Respondent has complied with all lien reduction procedures set forth in Section 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Mr. Foot moved that this Board reduce the fines instituted in the aforementioned case, by virtue of this Board’s Order of April 21, 2010, to an amount of $2,000, including administrative costs. Mr. Alexis seconded the motion. 3 Meeting Minutes Code Compliance Board Boynton Beach, FL November 16, 2011 There was discussion Mr. Kumar spent his own money to bring the home into compliance, and a $1,000 fine may be more appropriate. Mr. Foot disagreed and thought the community suffered. Vote The motion failed 2-3, (Chair Costantino, and Messers. Cole and Bucella dissenting.) Motion Based on testimony and evidence presented in Case No. 10-603, and having been advised that the Respondent has complied with all lien reduction procedures set forth in Section 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Mr. Cole moved that this Board reduce the fines instituted in the aforementioned case, by virtue of this Board’s Order of April 21, 2010, to an amount of $1,000, including administrative costs. Mr. Bucella seconded the motion. Mr. Foot commented the buyer was making an investment, and the cousin would inhabit the home. He saw no reason to favor the applicant. Chair Costantino disagreed and noted times were tough. Sometimes within families, one member is generous to another. Mr. Cole commented the Bank held the home for a year, and he would rather see a family live in the home. Discussion followed the fine of $34,000 accrued due to the Bank failing to register the property. A fine of $2,000 was less than 5% of the fine. The home still needed work, and Mr. Kumar anticipated another $7,000 to $10,000 in repairs was needed. Vote The motion passed 3-2, (Messers. Foot and Alexis dissenting.) Case No. 09-1586 Gordon Bartlett 197 SE 27th Place Officer Roy presented the case. The notice of violation was May 22, 2009, for violations pertaining to trash, broken windows, and needing a Business Tax Receipt. The hearing was held on July 15, 2009, and no one appeared. The Respondent was ordered to comply by July 25, 2009, or incur a fine of $200 per day. The violations were corrected on October 7, 2011. The accrued fine totaled $160,000. Chair Costantino noted the next case involved the same property. Eddie Arboleda, Remax Park Creek, 5481 Wyles Road, Suite 504, Coconut Creek, stated he has a contract on the property. Remax acquired the property from Bank United’s asset management company. He visited the property on April 13, 2011, and was working with Ms. Springer to bring the property into compliance. The problem he 4 Meeting Minutes Code Compliance Board Boynton Beach, FL November 16, 2011 encountered was each time they fixed the dwelling, it was vandalized, and trash was dumped at the premises. As a result, the property could not pass inspection. He spent about $7,500 on the property and has had the contract since August 2, 2011. The contract amount was $49,000. He stated the home was a duplex investment property. Officer Roy testified he inspected the home and the inside needed to be gutted and repaired. Currently, the home was vacant. A recent photograph of the propertywas distributed to the Board. Officer Melillo, Senior Code Compliance Officer, also stated he took over the area last year, and the property was vacant at that time as well. Motion Based on testimony and evidence presented in Case No. 09-1586 and having been advised that the Respondent has complied with all lien reduction procedures set forth in Section 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Mr. Alexis moved that this Board reduce the fines instituted in the aforementioned case, by virtue of this Board’s Order of July 15, 2009, to an amount of $5,000, including administrative costs. Mr. Cole seconded the motion. Chair Costantino inquired if the members wanted to zero out the fine because there was another case on the property. Mr. Foot was opposed to the idea. Vote The motion passed 4-1 (Mr. Foot dissenting.) Case No. 11-331 BankUnited 197 SE 27th Place Officer Roy presented the case. The notice of violation was February 7, 2011, for violations pertaining to registration of foreclosure property, mowing, trimming, removing trash and inoperable vehicles, and securing the building. The case was heard on March 16, 2011, and no one appeared. The Respondent was ordered to comply by March 26, 2011, or incur a fine of $250 per day.The violations were corrected on October 7, 2011. The accrued fine totaled $48,500. Eddie Arboleda, Remax Park Creek, 5481 Wyles Road, Suite 504, Coconut Creek, stated the property had the same problem as the previous case. He removed the car just after the property was cited. Motion Based on testimony and evidence presented in Case No. 11-331, and having been advised that the Respondent has complied with all lien reduction procedures set forth in 5 Meeting Minutes Code Compliance Board Boynton Beach, FL November 16, 2011 Section 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Mr. Foot moved that this Board reduce the fines instituted in the aforementioned case, by virtue of this Board’s Order of March 16, 2011, to an amount of $2,000, including administrative costs. Mr. Alexis seconded the motion that unanimously passed. Case No. 11-2569 George Hommel & Mary Ellis Property Address: 2151 NE 1st Street Violation(s): CO CH15 SEC 15-120(D) Inc. CO CH10 SEC 10-56(C) BBA FBC ’07 ED. 105.1 Secure pool. Repair fence and gate. Remove trash and debris from property and unpermitted structure in the rear yard. Fix gaps in the fence. Vestiguerne Pierre, Senior Code Compliance Officer, reviewed the above violations and stated the Respondents were present. George Hommel and Mary Ellis, 2151 NE 1st Street, pled no contest and showed photographs to Officer Pierre reflecting the violations were corrected. Officer Pierre advised the last time he inspected the premises, there were still outstanding violations remaining. In the past, there had been a near drowning with Mr. Hommel’s grandchild in their pool, and the Respondents were working with staff to correct the violations. The incident occurred because of an open gate, not the gap in the fence. Officer Pierre distributed photographs to the Board. Ms. Ellis commented they installed an alarm on the outside of the gate, and the gate is kept locked. Should the gate be opened, an alarm would sound. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Foot moved that this Board find that George Hommel and Mary Ellis are in violation of the City of Boynton Beach Code sections cited and moved to Order that the Respondents correct the violations on or before November 26, 2011. The Board has considered the gravity of the violations, the actions taken by the Respondents and any previous violations by the Respondents and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $500 per day for each day the violations continue past November 26, 2011, plus administrative costs shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Mr. Alexis seconded the motion that unanimously passed. 6 Meeting Minutes Code Compliance Board Boynton Beach, FL November 16, 2011 Case No. 11-2388 Frandieu Nazaire Property Address: 607 S. Seacrest Boulevard Violation(s): BBA FBC ’07 ED 105.1 Permit required for carport. Red tagged. Officer Roy presented the case and stated the initial inspection occurred on August 30, 2011, for the violation noted above. Written notice was sent on August 30, 2011, giving 30 days to correct the violations. Certified mail was sent October 18, 2011. The green card was signed between October 18 and 21, 2011. Staff recommended 30 days be given to comply. Frandieu Nazaire, 607 S. Seacrest Boulevard, pled no contest and requested more than 30 days to correct the violations. He purchased the property from the bank and learned of the violations. The carport was enclosed, but Mr. Nazaire had to obtain a permit, after the fact, and an architect to provide drawings or a contractor. He had hired a handyman. Officer Roy commented he spoke to the Respondent in August and explained what needed to be done. The property was red tagged in June, and Mr. Nazaire purchased the property in August. Mr. Nazaire stated he was not present when Officer Roy visited the premises and did not receive the information. He learned of the violation from the hearing notice, and had he known about the violations, he would not have purchased the property. He was trying to comply. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Foot moved that this Board find that Frandieu Nazaire is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent correct the violation on or before January 15, 2012. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $100 per day for each day the violation continues past January 15, 2012, plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Mr. Alexis seconded the motion that unanimously passed. Case No. 11-2769 Dacilas Louis Property Address: 145 SW 13th Avenue Violation(s): CO CH10-56 (A), (B) Remove blue tarp and repair roof. 7 Meeting Minutes Code Compliance Board Boynton Beach, FL November 16, 2011 Officer Roy presented the case, which arose from a citizen complaint. The initial inspection date was October 12, 2011, to remove the tarp and repair the roof. Written notice was sent October 14, 2011, giving 30 days to correct the violation. Certified mail was sent on October 27, 2011, and the notice was posted on the property on November 2, 2011. The Respondent was a repeat violator. Laura Besin, Esq, 1800 NW 49th Street, Suite 120, Ft. Lauderdale, attorney for the bank in the foreclosure action, pled no contest and requested 60 days. There was a motion for summary judgment occurring the next day. Attorney Besin pointed out registration of the property was not cited in her notice. Officer Roy explained the homeowner was cited. Attorney Besin acknowledged the property was severely dilapidated and may be demolished. Discussion followed the individual was a repeat violator; however, the bank was requesting the Board not impose a high fine because it would be taking over the property. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Foot moved that this Board find that Dacilas Louis is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent correct the violation on or before December 1, 2011. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $1,000 per day for each day the violation continues past December 1, 2011, plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Mr. Alexis seconded the motion that unanimously passed. Case No. 11-679 LaSalle National Bank Assoc. 1635 N. Seacrest Blvd. Courtney Cain, Code Compliance Officer, presented the case. The notice of violation was March 22, 2011, for violations of the Property Registration Ordinance and for trash and furniture on the property. The hearing was held on May 18, 2011, and no one appeared. The Respondent was ordered to comply by May 28, 2011, or incur a fine of $750 per day.The violations were corrected on July 20, 2011, having 52 days of non-compliance. Laura Besin, Esq, 1800 NW 49th Street, Suite 120, Ft. Lauderdale, attorney for the Bank in the foreclosure action, stated she attended a hearing in July, and she would encourage her client to register the property. The Bank did not yet have the title, and the home was occupied. She noted there was a tenant at the premises at the time of 8 Meeting Minutes Code Compliance Board Boynton Beach, FL November 16, 2011 service, and the violations were corrected. Discussion followed the Board could certify the fine, and the Respondent could apply for a lien reduction. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Alexis moved that this Board find that the Respondent has not complied with this Board's Order dated May 18, 2011, and having considered the gravity of the violation, the actions taken by the Respondent, that this Board impose and certify a fine in the amount of $750 per day, plus administrative costs which shall continue to accrue until the Respondent comes into compliance or until a judgment is entered based upon this certification of fine. Mr. Bucella seconded the motion. Further dialogue followed the lien was $39,000, but the home was valued at $31,000. Mr. Foot thought the fine was excessive, and it would inhibit the sale of the property. Attorney Bridgeman advised the Board could change the fine to a flat dollar amount, and the Respondent could apply for a lien reduction. Vote Mr. Alexis amended the fine to a flat dollar amount of $5,000. Mr. Bucella agreed to the amendment. A vote was taken and the motion unanimously passed. Case No. 11-2050 Barry & Bridget Gertz 615 NE 9th Avenue Officer Cain presented the case. The notice of violation was August 1, 2011, for a violation regarding a Business Tax Receipt. The hearing was held on September 21, 2011, and no one appeared. The Respondents were ordered to comply by October 1, 2011, or incur a fine of $100 per day.The violations still exist, having 45 days of non- compliance. Bridget Gertz, 514 NE 9th Avenue, explained she lost her job in April. She ran an ad indicating she would watch or walk dogs as Ocean Ridge Pet Service, but she did not receive any response. She also ran an ad at the movie theater and did not obtain any clients. Accordingly, she abandoned the idea of running a pet service. Ms. Gertz stated she was not aware she needed a Business Tax Receipt, but had researched if she needed a dog-walking license. She had called the City repeatedly and was told that as long as she was not performing the service, she would not be fined. The business had failed. Officer Cain stated the case arose from a citizen complaint. Ms. Gertz opined her business card was turned in from the movie theater because the movie theater 9 Meeting Minutes Code Compliance Board Boynton Beach, FL November 16, 2011 displayed her ad. No revenues were received. Officer Cain had photographs of her website and distributed them to the members. Ms. Gertz printed the form for a Business Tax Receipt and was told, by the City, it was the wrong form. Chair Costantino reviewed the form and advised it was the correct form. Ms. Gertz expressed frustration that she was getting the runaround when she was trying to do the right thing. After discussion about how to handle the case, Attorney Bridgeman advised two motions could address the issue. One motion would be to reconsider the Order the Board imposed on September 21, 2011. The second motion would be to enter an Order, based on the original violation, or certify the fine at zero dollars. The motion would be to end the business by December 1, 2011. If this motion was used, the Respondent would be in compliance by that date. Motion Mr. Foot moved to reconsider the Order of September 21, 2011. Mr. Cole seconded the motion that unanimously passed. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Foot moved that this Board find that Barry & Bridget Gertz are in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondents correct the violation on or before December 1, 2011. The Board has considered the gravity of the violation, the actions taken by the Respondents and any previous violations by the Respondents and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $25 per day for each day the violation continues past December 1, 2011, plus administrative costs shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Mr. Cole seconded the motion that unanimously passed. Case No. 10-3661 Martin Velasquez & Mary E. Sauceda 390 Miner Rd. Skip Lewis, Senior Code Compliance Officer, presented the case. The notice of violation was December 30, 2010, for violations pertaining to having unlicensed/inoperable vehicles, tires, and auto parts on the property. The case was heard and the Respondents appeared. The Respondents were ordered to comply with a Cease and Desist Order by May 11, 2011, or incur a fine of $500 per day per occurrence for the vehicles. The other violations were corrected. There were four dates 10 Meeting Minutes Code Compliance Board Boynton Beach, FL November 16, 2011 of non-compliance, which were October 13, 2011; October 14, 2011; October 25, 2011; and October 27, 2011. The case originated from a case handled by Officer Guillaume. Officer Lewis had received a complaint and spoke to “Mary.” Martin Velasquez and Elvira Gonzales, 390 Miner Road was present. Ms. Gonzales stated “Mary” does not live at the property. The Board noted she was still registered as an owner on the property appraiser’s website. Officer Lewis stated the property was gated and could not be accessed. He tried to make contact with the owner because many of the vehicles were backed up against a fence, and he could not see the tags. Officer Lewis was assured, by the Respondents, the vehicles were compliant. He was able to obtain a picture of one of the vehicles, and when he ran the information, there was no record found. Officer Lewis commented those were the four occurrences he documented. The Respondents contacted him when they received the notice of hearing, and he was advised the vehicle had a current tag and registration. Officer Lewis stated it was not affixed to the vehicle, but after the last date, it was. Mr. Velasquez, when asked why the plates were not on the car, responded they moved to the home in May, and the vehicle was up for renewal on its insurance. Sometimes the Motor Vehicle Office issues a new tag. There were five vehicles at the premises. One of the vehicles belonged to his mother, who was in Texas. Mr. Velasquez asserted all of the vehicles were operable and had current paperwork. Officer Lewis explained the tag in the photograph was not the correct tag. The Respondents had the valid plate with them, as well as the registration. There was lengthy discussion about the mix-up with the tags. Officer Lewis stated Ms. Gonzalez came into the office about the tag and why it was not on the vehicle. She indicated the tag was in another part of the State and it was not in her possession until after Officer Lewis took the most recent picture. Officer Lewis reiterated at least one vehicle did not have the correct tag and he could not confirm if the other vehicles had valid tags because they were up against the fence. Those factors were what predicated his belief there were inoperable vehicles at the premises, aside from the fact there was a complaint. Mr. Velasquez had taken all the tags off the vehicles to show them to Officer Guillaume in May so he could verify the tag went with the registrations. Chair Costantino suggested, if staff had no objections, certifying two occurrences. Officer Lewis was amenable to the suggestion. The Board could also certify four occurrences and then have the Respondent apply for a lien reduction. 11 Meeting Minutes Code Compliance Board Boynton Beach, FL November 16, 2011 Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Alexis moved that this Board find that the Respondents, on April 20, 2011, did not comply with this Board's Cease and Desist Order dated May 5, 2011, and having considered the gravity of the violation and the actions taken by the Respondents, that this Board impose and certify a fine in the amount of $500 per occurrence for four occurrences, which were October 13, 2011; October 14, 2011; October 25, 2011; and October 27, 2011, plus administrative costs. Mr. Foot seconded the motion that unanimously passed. Chair Costantino explained the lien was on the property and the Respondents could apply for a lien reduction. Case No. 11 -2568 Philip & Hattie Denaro Property Address: 64 Baytree Lane Violation(s): CO CH15 SEC 15- 120(D) INC CO CH 10 SEC 10 -52 Remove inoperable and unregistered vehicles from the property. Attorney Bridgeman administered the oath to the Respondents. Philip Denaro, 64 Baytree Lane, 10834 Madison Drive, pled no contest. Officer Cain presented the case as contained in the notice of violation. The case arose from a citizen complaint. The initial inspection date was September 19, 2011, to remove inoperable vehicles. Written notice was sent giving 14 days to correct the violations. The notice was posted at City Hall on November 3, 2011. Staff recommended a Cease and Desist Order be issued as the violation had been ongoing for a few years. Mr. Denaro testified all the vehicles were registered, except one, which he was waiting for the title. He had a current temporary tag on the van. The other vehicles were registered and insured to him with the proper tags and were operable. Mr. Denaro had photographs, which the members viewed. Officer Cain also had photographs he had taken, which he distributed to the members. The Respondent was a car dealer, with a dealership pin Acworth Georgia. He had complied in the past, only to have the issue arise again a few months later. The Respondent would obtain temporary tags and put them on the cars. Officer Pierre also testified he also had this problem with the Respondent a few months ago and there was agreement a Cease and Desist Order would be appropriate. 12 Meeting Minutes Code Compliance Board Boynton Beach, FL November 16, 2011 tag without having the physical title. He applied for the title three weeks ago. He agreed to move the van to a garage until he received the title and tag. Officer Cain commented the Respondent was originally cited on September 19, 2011. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Cole moved that a Cease and Desist Order be issued giving Philip and Hattie Denaro until November 17, 2011, to bring the violations of City of Boynton Beach Code sections as cited into compliance. The Board has considered the gravity of the violations, the actions taken by the Respondents, and any previous violations by the Respondents, and hereby orders that a fine in the amount of $500 per recurrence of the violation thereafter shall be imposed upon the Respondents. Mr. Bucella seconded the motion that passed unanimously. Mr. Foot left the meeting at 8:16 p.m. Case No11-2376 Zheng Yang & Tang Shuyi . Property Address: 303 Meadows Circle Violation(s): CO CH13 SEC 13-16 CO CH10 SEC. 10-56(B) Business Tax Receipt required to rent unit. Licensed mold inspector required to remove mold. Officer Pierre presented the case as contained in the notice of violation. Staff recommended 30 days be given to correct the violations. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Alexis moved that this Board find that Zheng Yang & Tang Shuyi are in violation of the City of Boynton Beach Code sections cited and moved to Order that the Respondents correct the violations on or before December 16, 2011.
