Mayor Riscoe welcomed everyone and called the meeting to order
at 7:30 P. M. She announced the invocation this evening will
be given by Mr. Larry Poe_ Minister of Music, First Baptist
Church, followed by the Pledge of Allegiance to the Flag led
by Councilman Joe deLong. She requested everyone to please
rise.
AGENDA APPROVAL
Mr. Trauger stated he would like to add Item K. under Administra-
tive - Request Report from City Manager concerning the bike
~aths and progress on the beach improvements. Mr. deLong re-
~.uested the addition under Item D, New Business - An Inquiry and
a Report, Mr. Cheney stated he would like two additional
announcements under E; he would like to delete under Bids~
Item F; and would like to add under Old Business. a Recommenda-
tion Relating to the Wilson Pool Project.
Mr. Trauger moved adoption of the agenda with the additions so
noted, seconded by Mr. Harmening. No discussion. Motion carried

ANNOUNCEMENTS
Mayor Riscoe announced the A.A.R.P. Voluntary Income Tax
Service will be available from February 1 to April 15, 1980,
on the second floor of City Hall on Monday~ Wednesday and
Friday from 9:00 A. M. to 4~30 P. M.
Mayor Riscoe announced the Palm Beach County Legislative
Delegation Public Hearing will be held on Friday, February 1,
1980 at 9:30 A. M. in the Council Chambers.
Mr. Cheney announced that Ms. Jackie Winchester, Supervisor
of Elections, will be the speaker during the public informa-
tion part of the Planning $ Zoning Board Meeting next Tuesday
night.
Mr. Cheney announced there will be an auction of City equip-
ment, trucks and old cars, on Saturday, January 19, at the
Public Works Depot at 9:00 A. M.

Mr. Harmening moved adoption of the minutes of the regular
meeting of January 7, !980, seconded by Mr. Trauger. No
discussion. Motion carried 5-0.
PUBLIC AUDIENCE
Mayor Riscoe announced if anyone cares to speak on anything
not on the agenda to please come forward and give their name
to the City Manager. If there is anyone who wants to speak
on anything on the agenda, please give your name to the City
Manager.
Mr. Carl Himpe!mann, 118 S.E. 6th Avenue, told about the
garbage men making a mess when collecting the garbage along
his street this morning and questioned the rush in which they
were working. Mr. Cheney replied that if their speed does
cause a mess, it would help to get a call immediately to
handle the complaint. Mr. Harmening added that he knoWs
quite regularly the men do spill portions of the garbage and
there is no major effort made to pick anything up. He
thinks the administration should ask the Sanitation Depart-
ment to be more careful. Mayor Riscoe added 'that she also
observed this morning how carelessly it was done and there
was garbage strewn along Chapel Hill Blvd. Mr. Cheney agreed
that the men do ~ick up a lot of garbage and do go fast, but
the supervisors check various areas. A study is being made
of the sanitation system to see how it can be improved.
Mayor Riscoe tbld about the City having the services of an
evaluation committee and advised that they are riding on the
trucks to get a breakdown to see where time and money is being
utilized. However. the quicker the City Manager is apprised
of the facts, the quicker they can be corrected,

would have included $1,775 in the budget. This can be handled
with a transfer of $775 in the Utility Fund. He feels it is
valuable to have in order to avoid leasing a portable genera-
tor.
Mr. Harmening moved the granting of this bid to the low
bidder, George W. Fowler Company of West Palm Beaah, in the
amount of $1,775. Mr. deLong seconded the motion. No discus-
sion. Motion carried 5-0.
Long Term Lease of Four Vehicles
Mr. Cheney informed the Council that for sometime~ the City
has been leasing four vehicles, three for the Police Depart-
ment and one for his own use, and we have had a very low lease
rate for a long period of time from one local dealer but it
suddenly jumped for reasons the dealer felt were necessary.
We went to ~et bids on a month to month basis while preparing
the requests for bids. We originally hoped to have arrange-
menus to change cars every three or four months like we had
been doings which is particularly useful with the detectives,
but we can no longer find leasing with that turn-over basis.
We probabIy should be purchasing these four cars. but his
recommendation is to continue with the lease for three years
at $197 per month per car. The three ears in the detective
division can be alternated between the detectives. Since the
motor vehicle operation is being studied~ he hesitates to
recommend the purchasing of these four vehicles. Also~ we did
not budget money to purchase the four cars but did budget to
lease the four cars. We talked to many local dealers about
leasing and reviewed specifications and hoeed we would have a
large number willing to lease. However, we only received one
bid from Earl Wallace Motors for $197 per month. Based on a
month to month leasing arrangements he feels this is a fair
bid for a three year eeriod and feels we should accept it.
Mr. Harmening moved to accept the lease bid for four cars from
Earl Wallace Motors at $197 per month on a three year basis.
Mr. Trauger seconded the motion. Under discussion, Mr. Cheney
added that these are only Ford Fairmonts and not elaborate
vehicles. Motion carried 5-0.
One Industrial Type Rubber Tired Tractor with Front End Loader
and Three ?oint~Hydraulic Lift
Mr. Cheney referred to budgeting $!5,000 and advised a low bid
has been received from Case Power $ Equipment Company for the
sum of $1~,55~. He recommends this bid be approved from Case
Power $ Equipment Company. This is a tractor to be used in
trash collection.

Mr. Harmening moved to accept the low bid for the industrial
type rubber tired tractor from Case Power & Equipment Company
in the amount of $13,553. Mr. deLong seconded the motion. No
discussion. Motion carried 5-0.
One ~raetor and Flail Mower Implement (Recreation & Parks)
Mr. Cheney referred to $6,400 being budgeted for this and
advised a low bid was received for $6.136.87. This tractor
will be used in the Parks Maintenance Division. Five bids
were received with alternates. We recommend the low bid
from Palm Beach Turf Equipment in the amount of $6,136.87
for the tractor and flail mower implement be approved by the
City Council.
Mr. Trauger moved to accept the bid from Palm Beach Turf
Equipment in the amount of $6,136.87 for the tractor and
flail mower. Mr. Harmening seconded the motion. No discus-
sion. Motion carried 5-0.
Three Economy Pick.up Trucks (2 - Sewer Pump Station and 1 -
Buildings-Maintenance)
Mr. Cheney referred to receiving four bids and recommended
purchasing the vehicles for $4,877 each. We budgeted approxi-
mately $5,000 for each one. The low bid was received from
Datsun of Palm Beach, Inc. in the amount of $4,877 each.
These are similar to the small pickup trucks we have been
buying. He recommends this bid be approved.
Mr. Harmening moved to accept the City Manager's recommenda-
tion and award the bid for three economy pickup trucks to
Datsun of Palm Beach in the amount of $4,877 each. Mr.
deLong seconded the motion. No discussion. Motion carried
5-0.
One 2-Ton 4-Wheet Drive Truck (Water Department)
1. Budget Transfer Request
Mr. Cheney referred to receiving a bid from Rich Motors for
the sum of $13,839.96 and stated we only received this one
bid although four people indicated they could not supply.
He then explained that International Harvester is the only
company making a four wheel drive~ two ton vehicle. The two
ton truck is required because it will have attached to it a
crane, which we have already purchased, for use in pulling
pumps and doing work at the wells throughout the City. In
the past, we have had to lease equipment to do this work.
With increasing the number of wells, he feels it makes sense
to purchase this vehicle. He recommends approving this bid.

reputable company.

Mr. Harmening moved to accept the recommendation of the City
Manager, Tabulation Committee and Purchasing Agent and purchase
this two ton, four wheel drive truck from Rich Motors mn the

SITE~DEVELOPMENT PLANS
~y Lake Subdivision, submitted by Hy~Lib, Inc., Final Plat
Mr. Norman Taplin, legal counsel for Hy-Lib, Inc.~ the deve-
loper of the property, came before the Council. He stated he
understands the matter before the Council is whether to permit
the recordation of the final plat for Phase 2. He has con-
ferred with the City Engineer, Mr. Tom Clark, and the City
Attorney, Mr. Jim Vance~ and at this point, he thinks the plan
ms ready for recordation subject to the bonding requirement and
agreement with the School Board.
Mr. Vance clarified that the matter before the Council is con-
ditional approval of the Sky Lake Subdivision~ Final Plat #1.
The approval, if Council gives it, would be conditional and
could not be recorded until the actual conditions are meT.
Mr. Taplin replied that he understood this and explained there
has been a delay preparing the agreement with the School Boards
but they have reached agreement through correspondence and the
agreement will be executed as soon as it ms prepared, Mr.
Vance stated that conditional approval would be based upon
Sky Lake enterin~ into a standard agreement with the School
Board and furnishing a copy to the City plus an additional
cheek of $167.92 for inspection and Mr. Taplin agreed. Mr.
Vance continued that also required is the posting of a per-
formance bond acceptable to the City and the posting of funds
with the City for the amount of the construction cost for the
street lighting system as determined by Florida Power & Light
Company. If the Council sees fit to appove this plat. it would
be subject to those conditions. He has gone over this with Mr.
Annunziato~ Mr. Clark and Mr, Taplin and it appears everythin~

OLD BUSINESS
Status of Municipal Golf Course Agreement
Mr. Cheney stated fol~wing our last Council meeting, at which
time he indicated this matter would be on the County Commis-
sioners' agenda on January 15, he discovered the matter was
scheduled the previous week before the Board of County Commis-
sioners. What they did at that meeting was to authorize the
County staff to proceed with one of the three alternatives
which they felt was more appropriate. The one they agreed to
proceed with was Alternate 3, which we concluded would be
acceptable to us. We have asked for the precise wording of
that and it is being prepared by the County. He would hope
we would receive it during this coming week and everybody
involved can approve the wording so it can be brought to the
Council at their meeting in two weeks for approval and hope-
fully, it will be on the County Commissioners" agenda for the
same morning. He hopes to have a recommendation two weeks
from tonight as to the direction we might go and suggest names
of a consultant to use in proceeding.

Hr. Nate Goldberg, 1317 S. W. 17th Street, asked Mr. Cheney if
he could give him an approximate figure of the study which
would be done as far as cost is concerned and Mr. Cheney replied
that he couldn't, no more than two weeks ago. Mr. Goldberg
referred to a dollar figure not being ineluded and Mr. Cheney
replied that probably in the first stage with the management
and financial analysis report, it would be less than $5,000.
Mr. Goldberg asked if this includes a complete report of getting
the bonds and Mr. Cheney informed him that it would include the
service of a management and financial consultant with expertise
to present a report addressing the financial feasibility of the
course. It would hopefully give the Council assurance whether
to go ahead with the architectural design. He would conclude
the consultant would work with us through the engineering and
architectural phase and continue to add to the report in order
to put together a prospectus for the bond issue.
Mr. Goldberg stated this would amount to a fairly considerable
figure that the City would have to come up with to get to this
point before setting up the bond issue or front end money and
Mr. Cheney agreed and if the golf course goes ahead_ this
would be part of the bond issue. If not, this would be the
price we would pay to find out whether the golf course can be
funded. Some people think it would be a waste of money if we
do not go ahead, but he does not agree as it would give us an
answer.
Mr. A1 Peiffer, Leisureville, told about his interest in golf-
ing and golf courses through the years. He referred to a num-
ber of opinions being given which are contrary to what we were
led to expect and stated he has spent much time and has come
up with a beginning plan. This plan will support 1,500 members
at $250 per year per membership, It will be a championship
size golf course. It will accommodate all those who want to
play with a minimum amount of waiting. It can be walked. It
will be approximately 5,600 yards in length and consists of
par 3, a and 5 holes. It is considered a championship course
by the U. S. Golf Association. It is a golf course that the
National Golf Foundation has approved for a municipal golf
course. The way to arrive ay this is to have 27 holes. With
18 holes, only 700 members can be supported. The cost of
building this type of golf course ms minimum and so is the
maznYenance. It will cost about 1.6 million dollars to build.
These figures are predicated on the National Foundation figures
consisting of an irrigation system, maintenance building'i
club house, etc. It will consist of three 9 hold golf courses.
He then read the expenses estimated for this type of golf course
totalling $480,000. He then explained the revenues anticipated.
Mr. Trauger suggested filing this report with the City'Manager
to be a guidance document for us to p~r~sue.

Mr. John F. Houston, 4735B Starkwood Lane, referred to being
attracted to this area by the golf and stated he would like to
make a few remarks. He referred to the population increasing
and outlined the number of courses in Palm Beach and stated
that Boynton Beach has ~ery reason to feel it is going to be
one of the real golf meccas in the State of Florida. He thinks
there is every reason to believe that a golf course should be
fully supportive and minor revenue doubts should be tabled
because the mncome which wilt be derived from a quality golf
course in this area is absolutely beyond questioln. There is
every reason to be optimistic about an attractiwe and popular
golf course. He' sincerely ho~es this will get off the graund
and the City can be justly and proudly acclaimed for its muni-
cipal golf course.
Recommendation Relating to the Wilson Pool Project
Mr. Cheney referred to presenting an engineering report to the
City Council regarding Wilson Pool sometime ago and stated at
that time, we had the report~ but did not find the funding
soIution. He explained how There were two basic extremes of
funding with cha~ging the entire filter system and doing some
improvements in the ~rainage area or changing the filter system
and Changing to a stainless steel gutter system. They have
been loo~ing at potential funds for this project and have been
talking with the County and Community Development to see if it
can be funded. A final decision has not been reached~ but there
is going to be a meeting on January 17 and he understands the
Community Development staff ms going to recommend approval and
hopefully will convince HUD to make a program change regardin~
funding.
Mr. Cheney stated at this t$~e~ he would like to discuss the
possibility of proceeding with the engineering at our own cost
which we included in the budget of $t0,000 for pool work. He
explained the reason for making this recommendation to put in
this good faith money. He r~uests to be authorized to proceed
with signing the contract wi~ the engineer for at least the
design work on the whole filter system. He explained how this
would possibly save some money by proceeding with this and

$200,000 from Community Development if we can get it.
Mr. Trauger moved to acce~t the recommendation of the City
Manager for the concept to redesign the filter system of Wilson
Pool and negotiate to the most favorable advantage either on a
fixed fee or hourly basis for the contract for this work. Mr.
Harmening seconded the motion. No discussion. Motion carried

Mayor Riscoe clarified that $10~000 has been appropriated in our
budget towards this project and Mr. Cheney agreed.
NEW BUSINESS
Urban Forestry Plan (Budget Transfer ReQuest)
Mr. Cheney informed the Council the idea here is to take advan-
tage of a newly funded State program to provide Urban Foresters
to some of the municipalities throughout the State. Some of
the municipalities in this area have taken advantage of this,
particularly Boca Raton. We can participate because Boca Raton
has moved beyond and now has their own staff, but it isn't sug-
gesting that we will get to that point. This is to provide
some professionals in the field, take a look at the community,
work with us, work with the Chamber of Commerce, work with the
Community Appearance Board, work with improvements to City
facilities and parks, work with the Parks Division to advise
and help, establish a nursery, etc. The cost is $3,000 plus
office space, telephone and secretarial services. It is a one
year program to start with which can be extended or cancelled.
We get a full time person for $3,000 and all other expenses are
paid by the State, such as travels fringe benefits, etc.
Mr. Strnad stated he thinks this is a terrific opportunity for
the City to take advantage of with someone of this caliber for
the price it is being offered to us. In 1977, he advocated.
getting a forester to implement our Community Appearance Board
ordinance more thoroughly and genuinely. We do not have anyone
who has expertise mn horticulture to determine which trees
should remain. He would recommend we take advantage of this
in view of the fact if we don't like it, we can always cancel
it. It is a tremendous opportunity.
Mr. deLong referred to the City providing office space and
asked if office space was available and Mr. Cheney replied
affirmatively as there is extra room in the Planning Dept.
Mr. Cheney added that in connection with this, he recommends
to fund the $3,000 that a transfer be made from Contingencies
to handle the cost. He added the representatives are present
in the audience to answer any questions.

Mr. Cheney then introduced the representatives, Mr. Tansburg
and Mr. Slaymaker, and they responded they will be happy to
work with Boynton Beach. Mr. Trauger questioned when this
would start and Mr. Cheney replied February 1 and added that
these representatives are the supervmsors of the person placed
here.
Granting of Easements to Florida Power & Light Company,
Overhead Transmission Lines, New and Old Bovnton Roads
Mr. Cheney referred to Florida Power & Light Company being in
the process of designing and building some new transmission
lines and advised they will go out New Boynton and Old Boynton
Roads from the substation to serve the western part of the
City, Most of what they have are overhead lines and most will
be over a public right-of-way. They are requesting easements
authorizing them to put overhead lines and possibly a pole on
our property. He then told about plans by FPL to amend some
underground easements. He recommends granting permission for
these two pieces of property which the City owns. He has maps
showing the location.
Mr. Harmening moved to grant Florida Power & Light Company
the two requested easements, seconded by Mr. Trauger. Under
discussion, Mr. Harmening stated he feels the lines over the
lift station could pose a problem to the City at some future
time. There is a possibility the work may require cranes
and any time they have to work near something like this, it
poses several problems. He has no objection to granting the
easement, but somewhere there will be a problem with needing
some heavy work done and one or more cranes will be necessary
and Florida Power & Light Co. will have to shut the power off.
He would suggest including a statement that at such time it
becomes necessary for the operation of a crane or any type of
extended boom mnstrument that Florida Power & Light Company
agrees to shut down this transmission line, Mr. Vance stated
it would be no problem to put this provision in the easements
to handle this particular situation. Mr. Cheney suggested
tabling this until the language is worked out. Mr. Vance
concurred and suggested discussing with Florida Power & Light
Company first.

Mr. Harmening withdrew his motion and made a motion to table
this, seconded by Mr. deLong, Motion carried 5-0.
Revised Permit Fees - Building Department
Mr, Cheney referred to a memo being submitted recommendine
changes in the building, electric, mechanical and plumbing
permit fees and stated the memo identifies why we want to do
this. First~ the services provided should be self-supporting
and in looking how we stand with other cities throughout the
area, he feels it is legitimate to raise the fees which have
not been adjusted since 1977. Direction is requested whether
the Council concurs. Also, Mr. Howell is present if addi-
tional input is wanted. He thinks these fees are in line
with what the Contractors' Association of Palm Beach County
finds to be acceptable.
Mayor Riscoe commented that she feels if we are out of line
with neighboring communities, we should get in line, esDec-
ia!!y if our line is lower. Mr. Cheney pointed out that
tables and charts have been provided indicating where we do
stand. In the caste of electrical fees~ we are recommending
a reduction.
Mr. deLong moved to approve the recommendation of the Building
Official and City Manager regarding permit fees and new schedul-
ing, Mr, Strnad seconded the motion. Under discussion, Mr.
deLong added that this was studied by the Building Official.

Discuss Pedestrian Overpass, N. W. 2nd Avenue at Galaxy School
(Councilman Joe deLong)
Mr. deLong stated the Transportation Committee of the local
Chamber of Commerce is interested in having erected an over-
pass at Galaxy School because of the hazardous conditions
which exist there insofar as the youngsters going to and from
school. They have contacted the Department of Transportation
and it is his understanding that the D.O.T. requires a resolu-
tion from the City. This overpass would be erected between
N. W. 4th Street and the sehoo!. His prime concern and inter-
est is to have the City Manager make a study of it and come
back to the City Council insofar as to who is going to bear
the expense. It would appear to him this would be a School
Board matter. He would like to move that the City Manager be
instructed to give us a thorough report on this. Mr. Harmening
seconded the motion. Mr. deLong included in the motion that
the Chamber of Commerce Committee be included in this study
with the School Board and County. Mr. Harmening added that the
principal at Galaxy School initiated this.

Under discussion, Mr. Trauger asked if there is a problem that
the school guard is not adequately working at the present time
or was there consideration given to a light standard or walk
sign? He has been watching this crossing in the morning going
to work and it seems to be pretty good. Mr deLong replied
that the school guard may be doing his wprk, but it is the
feeling of the transportation committee ~ha~ this problem
deserves more than a school guard to handle it. Mr. Trauger
replied that he was unaware there was an unusual ~roblem.

Mr. deLong stated he would like to know the status of the

a very inexpensive operation and invited the City Manager to

Mr. deLong replied that in view of her feelings on this~ it is
the feeling of everyone on the Council to get this organized in
a fashion everyone would want to desire. Certainly it is a
worthwhile service, but there are certain prohibitions neces-
sary, particularly he doesn't think members of thls committee
should be privileged to ride with the policemen on duty. He
thinks that ~ractice should be eliminated. He feels we have
the proper patrols. He believes it would be advisable to have
the City Manager contact other cities with Boards of this same
nature and get guidelines and then have a workshop meeting.
This is long overdue and the Board does need to be organized.
Mayor Riscoe stated she gets the feeling that we are all con-
curring with the situation that it does definitelly need to be
revamped to a degree. She instructs the City Man.ager to go to
other communities and get some gUidelines similar to this Board
and get back with us and we will hold a workshop ~ith the
Community Relations Board and hopefully will go farward.

Water $ Sewer Connection for Gulfstream Professional Center (Tabled)
Mr. Trauger moved to take this from the table, seconded by Mr.
deLong. Motion carried 5-0.
Mr. Trauger stated in looking over what was put into the
record and visiting the site, this appears to be contiguous
to the City limits. He realizes that water is provided under
various agreements, but does not find in the reco~d how vigor-
ously they want to be annexed. He thinks we should take a good
look at this. Mr. Vance suggested perhaps this item might be
tabled pending a further determination of whether they defi-
nitely do or do not desire to be annexed.
Mr, Cessna referred to submitting a memo relative to the acti-
vities of t~is developer mn the past and advised they have been
asked about annexation and their indication is they are not
looking at it at this moment. Mr. Harmening suggested asking
the City Manager and City Attorney to discuss this with these
people and table until they can give us an indepth review of
this subject.

Mr. deLong commented that insofar as attempting to prevail
upon them to annex into the City after the services are ren-
dered would be whistling in the dark. We have missed the boat
in the past with various developments. If they want our ser-
vices, and unless we are compelled to give service, we must
make an attempt to bring them into the confines of the City
limits. Mr. Harmening replied this was the purpose of his
motion.
Mr. Trauger auestioned how strong our position is to holding
out for annexation when land lying contiguous to the City re-
quests services and Mr. Harmening replied that was his purpose
to table this for study.
Mr. Strnad questioned why they objected to being annexed into
the City? He added that possibly they may build a structure
not conforming to our ordinances and after it is built~ they
may then want to be annexed. Mayor Riscoe replied that it
was the purpose of tabling to find out all this information.
Mr. Harmening moved to table~ seconded by Mr. Trauger.

Motion
Consider Application Form for 701 Comprehensive Planning Program
Mr. Cheney referred to submitting a letter from the State
relative to 701 funds being available and the creation of a
priority list for obtaining 701 planning assistance funds in
the future if we want to and stated as he interprets this
State letter, they are saying we may want to get 701 funds and
should submit our interest now and they will decide where the
priorities are. He interprets the letter that there is no
commitment being made at this time for a s~ecific activity or
specific local matching funds. If we don't do something at
this time, we may pre-empt ourselves from being on the priority
list.
Mr. Harmening moved to pursue the 70! planning facilities grant
eligibility to maintain our eligibility in the future, seconded
by Mr, deLong. Mr, Cheney suggested including the adoption of
the resolution and Mr. Harmening amended his motion to include
the reading of the resolution.
Mr. Vance read proposed Resolution No. 80-B by title. Mr.
Harmening moved the adoption of Resolution No. 80-B, seconded
by Mr. Trauger. No discussion. Mrs. Padgett took a ro!l call
vote on the motion as follows:

Consider Policy on Use of Council Chambers
Mr. Cheney referred to submitting a request for use of the
council chambers from A.A.R.P. Chapter #2841 and stated that
he and the City Clerk looked over the past history of the use
of the chambers and sometimes the requests have been submitted
for CounCil approval and some have been granted eer the guide-
lines. The Council may want to make a decision regarding this
now at the beginning of the year.
Mr. Strnad stated he thinks the citizens of our City and
taxpayers should be entitled to use this facility for public
meetings or such meetings as are reauired for religious pur-
poses, eliminating any political meetings. He is opposed to
the $25 fee for the use of this room because the people using
it are the taxpayers of this City. He doesn't believe there
is any more cleaning up required after such a meeting as there
would be after a Council meeting. It is specified that no food
or refreshments are to be served. There is an adjournment
deadline. He does not feel the people should pay $25 to use
their own facility.
Mr. Harmening referred to having a few requests in the past,
some which we turned down and some which created a mess, but
perhaps with the outline set forth in the City Manager's
memo, he would have the opportunity to answer any requests
before bringing them all to the Council. Mr. deLong asked
if he wanted to go along with the policy of the east and Mr.
Harmening replied it should be formalized so Mr. Cheney can
gzve an answer if there is a request.
Mr. deLong stated we must have control. He believes the fee
was set because if there was none, people would be lining up
to use the chambers. Mr Strnad explained how he felt the
City Manager and City Clerk do have control. He would like
to see the $25 fee eliminated. It is not going to change the
condition of the place by paying $25. He doesn't think it
costs $25 to sweep out the place. M~ayor Riscoe added that
any organization he has belonged to has charged a fee for the
use of their facilities. Cleanup is required afterwards.
She would like our people to come in afterwards to clean it
so we know it will be presentable when we open the doors for
our pnb!ic meetings. She agrees the $25 should be charged.

Mr. deLong commented that with letting the ~amriers down in

present time, a police officer is required to be on duty. Mr.
Cheney informed him that this was not necessary for every
organization.

Consider Policy on Use of City Mailing Lists
Mr. C~eney referred to having a City mailing list used for
water and sewer billing and stated during the last few years,
there has been concern about the use of the mailing lists.

Association and the Volunteer Firemen s Organization. It is
obviously used for 'the purpose of rai~ing money and gaining
support for those organizations. We have pending now a re-
quest fro~ the Volunteer Firemen?s Association relative to
tickets for their annual firemen's ball. They pay the cost
of printing the mailing labels. It is a policy question for
the Council.
Mr. Harmening moved to grant the Volunteer Firemen's Associa-
tion request to have access to the mailing list, seconded by
Mr. deLong. Mr. Harmening added that if there are any other
requests, they should be brought to the City Council. No dis-
cussion. Motion carried 5-0.
Consider Request for Renewal of Permi~ for Two Trailers

Consider Request to Provide Water and Sewer to Pine Tree Golf
Club Clubhouse Only
Mr. Harmening moved to grant permission to Pine Tree Clubhouse
subject to signing an agreement with the City, providing the
lines to connect to the P.T.V. system and the pumping station
are privately owned and maintained by the Pine Tree Golf Clubs
pay cost of meter and meter pit (to City specifications) if
larger than 2" size, and all appropriate fees in effect at the
time of application for connection are paid, Mr. Trauger
seconded the motion. Under discussion~ Mr. deLong commented
that it may appear to people we are inconsistent with our
moves with in one instances we want the people to annex and
in the other just go ahead and grant servmce. This instance
is quite different in that it is an established township or
village and ~he other was undeveloped property. In view of
the fact they are in the servmce area and developed, there is
not a chance to prevail upon them to annex into the City.
Mr. deLong then stated that he thinks we are too lenient with
the amount of surcharge for servicing people outside the City
and Mr. Trauger informed him that it was just raised. Mr.
deLong questioned the amount of the increase and Mayor Riscoe
replied that it was raised across the board and Mr, Cheney
added that we raised the capital connection charge and have
some understanding how the developers Will pay for the cost
of lines to serve them. Also, the water rate is 125% for cus-
tomers outside the City.
Mr. deLong asked if this area has their own sewage plant and
Mr. Cessna replied that he thinks they have a small sewage
plant. Mr. deLong referred to the homes having septic tanks
and asked'if these would be outlawed in the future and Mr.
Cheney replied affirmatively.
Mr. Harmening added that this also differs from the last re-
quest because this is not contiguous to the City and Mr. Vance
added that under State law, we cannot annex somebody which is
not contiguous. Mr. deLong added that when the land is deve-
loped, the people can petition to be annexed into the City,
but it is different when the land is not developed.

Mr. Harmening moved to grant this request, seconded by Mr.
Trauger. No discussion, Motion carried
t980 City Board Appointments
Mr. Cheney informed the Council that after the last Council
meeting, the City Clerk reviewed the appointments made and in
two cases, there seems to be a auestion. In reference to the
Cemetery Board, the membership of 1979 was re-appointed plus
one new member. Section 6-17 of the Code indicates that we
should have only five members plus the City Clerk.
Mr. TraUger moved to take the last appointee and hold that posi-
tion as the person eligible to serve on that Board in the event
there is a vacancy. Mr. deLong seconded the motion. Under
discussion, Mr. deLong asked if the Cemetery Board is exempt
from alternates and Mr. Cheney replied that alternates are not
addressed. Usually alternates are Used to fill in for a member
with a conflict of interest and he doesn't know how much con-
flict of interest there would be on the Cemetery Board. Mr.
deLong suggested mossibly appointing this person as an alternate
and Mr, Trauger replied the ordinance would have to be changed
to accomplish that.
Mr. Trauger clarified that his motion was to hold the last
appointee as the next available person in the event of a vacancy.
Mr. Vance informed them there should be a motion to reconsider
the nomination of that particular individual,
Mr. Harmening moved to reconsider the appointment of Mr., Don
Sloan to the Cemetery Board, seconded by Mr deLong. No dis-
cussion. Motion carried 5-0.
Mr. Harmening questioned whether the City Attorney should be
asked to amend the ordinance to include six members or whatever
the best number is? He added that he does not think there will
be conflict of interest on this Board.
Mr. Harmening withdrew his nomination of Mr. Don Sloan to the
Cemetery Board. seconded by Mr. Trauger. Motion carried 5-0.
Mr. Harmening moved to direct the City Attorney to amend the
ordinance governing the Cemetery BOard to provide for one alter-
nate, seconded by Mr. deLong. Motion carried

Mr. Cheney referred to having the same problem on the Community
Appearance Board. Mr Strnad asked if there was an architect
on the Board Presently and Mrs. Padgett replied that Mr. Harold
Blanchette is a member of t~e Board.
Mayor Riscoe clarified the ~n!y way to keep the same people
proposed would be to amend the ordinance as we did with the
last one. Mr. Strnad so moved~ seconded by Mr Trauger.
Mayor Riscoe clarified that it was moved and seconded to amend
the Community Appearance Board ordinance to have an additional
alternate member. No discussion. Motion carried 5-0.
Mr. Cheney referred to submitting a list of the appointments
made to all the Boards and stated if there are any errors to
please notify the City Clerk.

Buck to the Community Appearance Board, seconded by Mr.
Harmening. Motion carried 5-0.
