Regular City Commission
Boynton Beach, FL. January 5, 2010
Charles Gaulkin, 8 Colonial Club Drive, protested the plan to move the Police
Department. The plan would have a negative impact on the development along the
coastal area and east side. He contended the proposed location was totally impractical.
There would be traffic congestion created in emergency situations and restaurant and
retail patrons would be intermingled with police and the associated criminal element.
The expenditure of $15 million in tough economic times was disturbing. Mr. Gaulkin
inquired about the status of the project at this time.
Mayor Taylor explained the issue would come back before the Commission January,
19. There would be further discussion at that time and the Mayor welcomed interested
parties to attend. Mr. Bressner added the responses from the contractors are available
in the City Clerk's office. Mr. Gaulkin felt more than publishing the agenda should be
done to notify the residents.
Cliff Montross, 109 SW 18 Street, surmised that the police facility issue would be
brought back before a Commission of only three members. He urged that the matter be
tabled. He contended the Commissioners running for office had to step down 10 days
before the election. Attorney Cherof advised there was no requirement that a
Commissioner step down to run for the positions that are vacant.

5. ADMINISTRATIVE
A. Appoint eligible members of the community to serve in vacant positions on City
advisory boards.
There was consensus to approve the collective appointments to each board, rather than
each appointment individually.

Commissioner Weiland appointed Dana Cook as a regular member.
Vice Mayor Hay re- appointed Halena Wolf as a regular member.
Commissioner Rodriguez re- appointed Donn Davenport as an alternate member
Commissioner Ross appointed Christine Moeller as an alternate member.
Commissioner Weiland commented he had appointed an alternate as a regular to give
the alternate an opportunity to participate as a regular member. It does result in a
regular member becoming an alternate member. Vice Mayor Hay contended if there
was no problem with the current regular members, they should not be displaced. Mayor
Taylor agreed with Vice Mayor Hay.

was happening and he hoped the Commission would continue to support the green
effort. It is a serious problem that can be corrected. Mayor Taylor repeated comments
that he had made referencing global warming as being cyclical and nature's way.
John McGovern, 2620 Spiceberry Lane, commended the City for up -to- the -date and
historical candidate information available to the public. He urged citizens to visit the
website to view history and current events. Mr. McGovern noted the agenda was
becoming more accessible to the public. He suggested the guide should include the
phrase, "open the PDF in a new window ". The file is very large. The subsections are a
very good solution.
Victoria Castello, 406 Seacrest Blvd, agreed there was progress with the agenda and
commended staff for dealing with the large amount of information in the agenda. Mayor
Taylor noted it was the Commission's responsibility to review all the information.

Herb Suss, 1711 Woodfern Drive, complimented the Fire Department on their response
to a medical emergency in his neighborhood. Mr. Suss requested documentation from
the inspections of the drywall at Renaissance Commons. In view of the monies invested
and health of the officers, proof of the inspections should be made available. Mayor
Taylor reiterated his previous remarks that the insurance carrier would resolve any
issues relating to the drywall. The dispute is between the private property owner and
the insurance company. Commissioner Rodriguez added City inspectors would be
involved before any Certificate of Occupancy would be issued.
Victor Norfus, 261 N. Palm Drive, announced the Heart of Boynton Heritage Fest on
February 19 and 20. A fund raising event would include a yard sale and barbeque on
February 13, and February 15 the Boynton Woman's Club would be discussing
Foundations of Faith, a report on the African American History of Boynton Beach. The
opening of the Heritage Fest would be at the Ezell Hester Center.

Lisa Bright, CRA Director, recalled in 2008, the City established a Green Task Force to
improve, promote and sustain the City's environmental sustainability. The Urban Land
Institute of Southeastern Florida had selected the Boynton Beach CRA to serve as a
sustainable community pilot area. The City was selected based on the governing
body's commitment to sustainability, creation of the Green Alliance and former Task
Force and the CRA's green incentives to be tested during the study period. The study
would address innovative ways for sustainability to serve as a template for other cities
throughout the United States. The Gulfstream Gardens project, Casa del Mar and
Walmart will be the three projects under consideration.
Mayor Taylor and Commissioner Ross congratulated the CRA for the achievement.
Herb Suss, 1711 Woodfern Drive, congratulated Commissioner Ross for the Galaxy
modernization proposal. Mr. Suss questioned if anyone had contact with Hunters Run
relating to additional reused water and if a deal had been made. He further questioned
if such a deal were made, how would it benefit the citizens of Boynton Beach. Mr.
Bressner responded the City had been requested by Hunters Run to give up the reuse
water because it would not be cost effective to have to install a reuse water irrigation
system. The South Florida Water Management had allocated 600,000 gallons per day
to Hunters Run. Possible reuse of the allocation to eastern Boynton Beach is being
investigated. Sterling Village is now using reuse water for all their irrigation.
Mr. Bressner disclosed he met with the Council of Presidents of Hunters Run, Mayor
Taylor had spoken with the President of Hunters Runs who complimented the City for
working with Hunters Run on the issue. Commissioner Weiland had also been
contacted.
Cliff Montross, thanked the Commission for tabling the police facility controversy. Mr.
Montross disagreed with campaign contributions being accepted from developers with
pending projects within the City. He hoped the new Commission would discontinue the
practice of allowing campaign contributions from developers.

C. PROPOSED RESOLUTION NO. R10 -025 -- Approve a lease agreement with
Clear Wireless, LLC ( "Clearwire" or "Tenant ") to allow for ground equipment
and co- location on the existing telecommunications tower at Hester Park (1901
North Seacrest Boulevard).
D. Approve the monthly report on the major projects being completed by the
Recreation and Parks Department.

gang membership. The program needs both participants and mentors.
Victor Norfus, 26 N. Palm Drive, praised the Heritage Celebration and the many
participants. There was a need expressed for more activities to be held on Martin
Luther King Boulevard and perhaps the Ocean Concert series could be held there.
Willie Aikens, 726 NE 1 Street, gave greetings from the Heart of Boynton and gave
praise for the Heritage Celebration. He thanked the Commission and CRA members
for their support. He praised Mary DeGraffenreidt and all the City staff who assisted.
Herb Suss, 1711 Woodfern Drive, indicated the Preserve development, that was
partially funded by the Community Redevelopment Agency, had also been determined
to have defective drywall. He was concerned for the residents and hoped some
resolution could be found. He question if perhaps the Promenade also had defective
drywall.
Mayor Taylor remarked the matter would be between the developer and the
investigating agency. The City would have no responsibility. Lisa Bright, Executive
Director of the CRA, clarified the CRA was not a financial partner in the Preserve
project. The CRA had assisted with home subsidy programs. The Board is aware of
the allegation, but there was no confirmation that it was Chinese drywall. It would not
be a Community Redevelopment Agency Board issue.

than two boards. He was awaiting staff's input.

Commissioner Orlove commented there had been discussion about filling the vacant

Commissioner Orlove questioned if individuals who had businesses within the City, but
did not reside within the City were being considered. Mr. Bressner pointed out the Code
would have to be changed. Many boards require residency within the City. He
suggested the boards be reviewed and their duties and functions outlined to make an
informed decision whether or not to modify the Code to expand eligibility to proper
business owners who are not residents.

Vice Mayor Hay had been advised of the pattern that was developing. Mr. Norfus
remarked the Animal Control Department was understaffed and proper staffing was
essential. On behalf of the Community Relations Board, he thanked the Commission
for their support.
Commissioner Ross recognized Officer Liz Roehrich, who worked as an Animal Control
Officer.
Cliff Montross, congratulated the Mayor and asked that the citizens give the Mayor a
chance to lead the City and take the City in the right direction.

Commissioner Orlove moved to appoint Sharon Grcevic as a Regular Member of the
Planning and Development Board. Commissioner Ross seconded the motion. The
motion passed unanimously.
Mayor Rodriguez inquired if the Commission would allow appointments to be made
immediately to replace any vacancies on the boards. Vice Mayor Hay wanted to open
the process up for other applications to be reviewed and afford everyone an equal
opportunity.
There was consensus to make appointments immediately upon acceptance of a
resignation. Vice Mayor Hay cautioned that some applicants request status as only a
regular or only as an alternate.

Commissioner Ross moved to table the rest of the appointments. Vice Mayor Hay
seconded the motion. The motion passed unanimously.
C. PROPOSED RESOLUTION NO. R10 -033 -- Appoint a City Commission
representative and alternate to the Metropolitan Planning Organization.
Mayor Rodriguez had been the representative and would continue to do so, unless
there were others interested.

Commissioner Orlove moved to keep the appointment the same. Vice Mayor Hay
seconded the motion. The motion passed unanimously.
Commissioner Ross noted she had served as the representative and the Organization
addressed very important issues such as transportation.
There was agreement to allow all the Commissioners to act as alternates.
D. PROPOSED RESOLUTION NO. R10 -034 -- Re: Appointing a City
Commission representative and alternate to the Countywide Intergovernmental
Coordination Program.
Mr. Bressner noted the Assistant City Manager currently served as the representative.
The preference was to have an elected official participate in the program.
Commissioner Orlove expressed an interest in serving. Ms. LaVerriere, Assistant City
Manager, explained the program addressed multi - jurisdictional boundaries and issues.

No one else coming forward, Mayor Rodriguez closed public audience. Commissioner
Hay commented there needed to be consistency and comments allowed from the
Commissioners as well as the Mayor on issues brought before the Commission during
Public Audience.
Commissioner Orlove mentioned there was legislation going through Tallahassee
relating to pain clinics. A proposed bill in the House and one in the Senate did not
totally address the concerns. It was a State regulatory issue with many elements from
police involvement, doctor's input, medical needs and prosecutorial aspects.
Chief Immler agreed that the pending legislation did not fully regulate the issues,
especially the mass distribution of narcotics. The type of cases being taken to the State
Attorney's office are very difficult to prove and requires extensive investigation and
warrants. The task force established through the Sheriffs office was created to address
those issues. He advised the ultimate remedy would need to come from the Health
Department and more stringent regulations on mass distribution of narcotics from pain
clinics.
Mr. Bressner advised the House Bill had been pulled from second reading pending the
Senate Bill coming out of committee. The Senate version was more a regulatory
process.
Chief Immler added all internal investigations within the Department are conducted
according to the Statute that delineates the procedure. Each complaint is taken through
the entire process and once a decision has been made, the complainant would receive
notification of the result and invited to review the file.

Although Commissioner Holzman did not have an applicant to appoint, he did feel an
appointment to fill the vacancy was appropriate. City Clerk Prainito explained the four
original applicants that had not been appointed were contacted. Two continued to have
an interest in being appointed, one was undecided and one did not respond.
Commissioner Orlove felt another member would be beneficial, but more time was
needed to review the applications. Vice Mayor Ross noted of the two applicants still
interested, only one was a resident of the City of Boynton Beach.
Barbara Ready, member of the Historic Preservation Ad Hoc Committee, commented
all interested parties were welcome to participate and attend the meetings. She
suggested tabling the appointment would be appropriate to investigate the applicants
further. At this point, Ms. Ready did not feel another member was necessary.

Memorandum of Understanding between the City of Boynton Beach and the
Florida Department of Agriculture and Consumer Services for the South
Seacrest Streetscape project, if awarded.
D. Accept the monthly report on the major projects being completed by the
Recreation and Parks Department.
E. Accept the written report to the Commission for purchases over $10,000 for the
month of March 2010.
Mayor Rodriguez had pulled this item for discussion. He questioned the necessity to
spend $21,000 for more shelving when millions had just been spent for the new Library.

Commissioner Orlove inquired of the City Attorney if any individual could file a complaint
with the Division of Elections. Attorney Cherof advised this type of issue would not be
filed with the State. The CRA Board itself would have to institute an investigation and

Mr. Bressner reviewed a spreadsheet that indicated if the applicants were eligible and if
they would be for a general or specialized appointment. The Ordinance indicated five
members had to have business expertise, be a resident of the City or an officer of a
company registered in the City of Boynton Beach. The four remaining members would
be general members as residents of the City without any specific business expertise.
Commissioner Hay noted there are not sufficient qualified applicants to fill the Board.
Attorney Cherof advised the Board would not be formed until the full Board was
appointed including the two alternates. Of the eligible applicants, only two were active
business owners and four would be general residents.
Commissioner Hay inquired about the possible cost of forming a new board. Mr.
Bressner noted there would be general staff time, minute taking and other
administrative costs. They would be subject to Sunshine Laws. The Board itself could
incur some costs.

Vice Mayor Ross had pulled this item for discussion. She wanted to highlight some of
the projects such as Jaycee Park slated for completion in October and the boardwalk at
Oceanfront Park. Wally Majors, Director of Recreation and Parks, reported the
Oceanfront Park project was moving along ahead of schedule. The south end of the
boardwalk and a railing had been installed. A ribbon cutting ceremony may be able to
be scheduled in October or November. Debby Coles - Dobay, Public Art Administrator,
reported the Jaycee Park interpretive markers should be completed in October. Vice
Mayor Ross pointed out the retrofit at Hester Park was part of the Climate Action Plan.

Ron Washum, 127 S. Atlantic Drive West, echoed Mr. Edward's remarks and noted
civility and kindness were the leadership qualities that got the Commission elected. He
described the meeting of the CRA as deplorable and stressed the conflicts should not
be personal, but issue - oriented and return to respect and civility. He expressed hope
the Board could move forward.
Herb Suss, 1711 Woodfern Drive, offered his congratulations to Janet Prainito for being
profiled in the Boynton Forum and commended her and the staff of the City Clerk's
office. In addition to the many recommendations of the Climate Action Plan, Mr. Suss
suggested bicycle racks should be in all shopping centers to improve transportation. He
also expressed appreciation to all the veterans of the Korean War.

Mark Karageorge, 240A Main Boulevard, spoke on behalf of Brain Miller of the
Community Relations Board and High School Athletic Director and Head Football
Coach, Rick Swain. For the past two years the Commissioners had bought season
tickets to support the Boynton Beach High School football program. Athletic programs
get no funds from the school district or the City and are self- funded. The price is $25 for
five home games. Last year was the first time that Boynton Beach High School made
the playoffs. The academic standard of the football team had risen from an average
grade point of 1.6 to 3.0 in two years. Mr. Karageorge commended Commissioner Hay
for being the team Chaplain and being an inspiration to the players and the coaching
staff. Mr. Karageorge was also pleased with the opening of Li'l Caesars as a positive
impact on the City.
John Caparosa, 2424 N. Federal Highway, Condo President of the Inlet Harbor Club,
made the Commission aware of the danger created by No U -turn signs on Federal
Highway north of Gateway. The vehicles coming out of the gas station and heading
north have been turning into the Condo driveway and making the turn to go south.
Accidents will occur and he sought assistance from the City. Mayor Rodriguez directed
Mr. Caparosa to Jeff Livergood, Director of Engineering and Public Works. He also
noted Federal Highway is a State road.
Commissioner Hay interjected that Mr. Livergood should review the traffic flow in and
around St. John Missionary Baptist Church on Seacrest Boulevard due to the ongoing
construction project.
Jennifer Wink- Casey, representing the Community of Cedar Ridge, had spoke to Mr.
Livergood earlier and commended the City for its prompt response to a serious traffic
situation in their area. She added that traffic flow problems with the new charter school
in unincorporated Palm Beach County had created problems with the industrial area just
south of Miner Road. The businesses have been affected by traffic delays of as much
as 45 minutes. The school buses cannot even get through. Her entire community and
the commercial properties along High Ridge Road are directly impacted by the traffic
jams in the morning and afternoons. Child safety issues were a major factor. She
requested the City encourage Palm Beach County to remedy the situation.

better. If she had the honor of being elected, she would work with the Commission and
listen to any concerns. Ms. Brown recognized the importance of Galaxy Elementary
School to the City and she would strive to keep the project on track. She had the
passion for quality education, commitment to children and believed in her skills.
Allan Hendricks, 122 SE 4 Avenue, thanked the Commission for the new temporary
roof on the Old High School. The RFQ was well written and targeted the information
needed to move forward. The Commission's support would be key to investors and
developers to come forward.
John McGovern, 2620 Spiceberry Lane, underscored the fact 2,000 people had under -
voted in the election and voter turn out was low in some areas. He expressed a
particular concern with the voting in Hunters Run. His message continued to be local
control of education and the rise and fall of achievement levels as they progress through
the grade levels. He would continue to work with the candidates moving forward to
understand the plight of the school system.
Sunny Garcia, 1631 NW 13 spoke in support of saving the dog pound that has
existed in the City of Boynton Beach for a long time.

then we need to go to the Neighborhood Post and flood that one too. Please pass the
word and get lots of your friends to speak up too. I believe we need a huge public
outcry against Bright and we will need lots of folks to attend the next City Commission
meeting as well because I believe the fur is going to fly. I don't know about you, but I
voted for Jose and Steven to get stuff done around here and getting rid of Bright is a
step in that direction. The Commission needs to hear from lots of people. All they ever
hear is from Bright's toadies who think she is wonderful and Jose is a bully and nothing
could be further from the truth. Bright must go. It's not fair to Jose Rodriguez and
Steve Holzman that they and we all worked so hard to get them elected and now their

Cliff Montross, 109 SW 18 Street, advised he was impressed by the Former Mayor.
The Commission had thoroughly reviewed the issue and gave everybody an opportunity
to speak. He suggested, in light of all the investigations, that the Commission would be
unable to appoint a new seven - member board to take over the fiasco that had been
created. Mr. Montross opined the center of Boynton Beach resembled a farm with the
vacant land and nothing happening in the last several years.

comment that Mr. Edwards was a regular at the dais and challenged many items.
Mayor Rodriguez invited Mr. Edwards to call him or arrange to meet with him to discuss
any issues, rather than hiding behind the podium. Mayor Rodriguez indicated Mr.
Edwards's comments were based on incorrect information and assumptions.
Commissioner Hay stated every citizen in Boynton Beach had the right to express their
thoughts and opinions that should not be taken personally by the leaders of the
community.

Carisse LeJeune, Assistant to the City Manager, showcased the award the City had
received on October 29 at the 2 Annual Southeast Florida Regional Climate
Leadership Summit in Miami. The City of Boynton Beach had achieved the first three
milestones of the climate mitigation milestones.

and inquired about the status of the solar panel initiative at the Links golf course. Mayor
Rodriguez responded there were several challenges that had to be overcome. Mr.
Bressner added staff had discussions with Florida Power and Light in regard to
changing the regulations in the State for solar power.
Don Scantlan, 13 Cedar Circle, requested the Commission's assistance with
requesting the Palm Beach School District close school on Veterans Day so all veterans
can participate in the observance.
