MINUTES OF THE REGULAR CITY COUNCIL MEETING HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, TUESDAY, DECEMBER 18, 1~79 AT 7:30 P. M. PRESENT Edward F. Narmening, Mayor David Roberts, Councilman Norman F. Strnad, Councilman Walter "Marty" Trauger, Councilman Peter L. Cheney, City Manager Tereesa Padgett, City Clerk James W. Vance, City Attorney Mayor Harmening welcomed everyone and called the meeting to order at 7:30 P. M. He announced the Invocation tonight will be given by Rev. Ben Tidwell, Westside Baptist Church, followed immediately by the Pledge of Allegiance to the Flag led by ,City Manager Peter L. Cheney. AGENDA APPROVAL Mr. Cheney referred to the second and third resolutions listed relative to the EPA projects and advised at that time, there should also be a motion approving supplemental agreement No. 8 with the second resolution and a motion approving supplemental agreement No. 9 with the third reso- lution. Mr~ Roberts moved to adopt the agenda as corrected, seconded by Mr. Trauger. Motion carried 4-0. ANNOUNCEMENTS Mayor Harmening announced that City Hall will be closed Monday and Tuesday, December 24 and 25, in observance of the Christmas Holiday, and on Tuesday, January 1, 1980, New Year's Day. Mayor Harmening announced the first meeting of the City Council in 1980 will be on Monday, January 7, 1980, the first Monday of the year in accord- ance with the City Charter. MINUTES. Regular City Council Meeting - December 5, 1979 Mr. Trauger moved the adoption of the minutes of the December 5th meeting as presented, seconded by Mr. Roberts. No discussion. Moti'on carried 4-0. PUBLIC AUDIENCE Mayor Harmen~ng asked if anyone in the audience ~wished to address the Council on anything not on the agenda. He added if anyone wished to address the Council on any item on the agenda to please give their name to the City Clerk and they will be called on when that item becomes the regular order of business. MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 18, 1979 Mr. John Johnston, 1621 N. E. 3rd Court, referred to being a past employee of the City for 22 years and stated he is retired and receiving pension now. He was asked today if he were nominated to the Civil Service Board as a citizen if he would serve and he responded affirmatively. However, since then, he has found out he cannot serve s'nce he is a past employee, or a retiree from the City of Boynton Beach. He thinks this is wrong since this is a non-paying position. He thinks this takes away from him as he has worked hard for 22 years to have a good town for all. He thinks this should be reconsidered, so he can serve in some capacity as a citizen. Mrs. William Brown, 431 S. W. 4th Avenue, stated this afternoon she was disturbed to see outside, directly in front of her living room window, a stop sign being installed. She was told by a neighbor that he called the Police Department yesterday and that fast the sign was installed. Not only does it take away from the appearance of her property, but there are a lot of trees and the stop sign cannot be seen. She told about two near accidents having occurred since the stop sign was installed. Before a stop sign is installed, shouldn't there be a feasibility study with the neighbors questioned as to the desirability of the sign? This has been made into a three way stop sign intersection. This is a residential street which goes straight through and she cannot see any reason for the sign and would like it to be removed as quickly as possrble. She went up and down the street tonight and with the exception of two, all were in favor of having the ~ign removed. She then presented a list of names in favor of having it removed. She would like the question answered how someone can call the Police Depart- ment one day and the next day, the sign is installed. Mayor Harmening re- plied that usually installations aren't made that quickly and he asked Mr. Cheney if he had any information on this. Mr. Cheney commented that very seldom do we get criticized for doing things too fast. There was a report written by an officer in the Traffic Division prior to the installation of this sign. This area has been under study in the past. This was not the result of a sudden decision, but an area the Police Department was aware of. Unfortunately stop signs are red] and big and don't look best. They are placed at intersections because that is where we want the people to stop. A sign is always a surprise to people when it is first installed. He has requested a copy of the police report and will review it to see if it is justifi'ed. Right now, t~conclusion of the Police Department is that it is justified, but he will take a look at it further. Mayor Harmening questioned the intersection where this was located and Mrs. Brown replied that it is at $. W. 3rd Street. She added that at the corner of her property, there is a large Areca Palm and it could have been installed there and seen; but was installed right in front of her house in a group of Black Olive Trees. If it must be there, please put it in an area where it won't detract from the cosmetic value of her home. It does devalue her home. Mr. Cheney informed her that we will look at the sign, but there are standards regarding location. -2- MINUTES REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 18, 1979 Mrs. Dee Zibelli, representing the North Boynton Community Improvement Association, stated approximately six weeks ago, they were supposed to receive some kind of report on the drainage system on the north end and she wonders if this is forthcoming. Mayor Harmening replied that it is his understanding the City Street Department has been cleaning out drains in that area. Mr. Cheney agreed this was correct and added they are also making a City-wide survey of the drainage. Cost estimates are being done on the solutions to the drainage problems. Mr. Bob Riley, 342 S. W. 4th Avenue, stated in reference to the installa- tion of the stop sign at S. W. 4th Avenue and 3rd Street, this was the intersection which was paved over across the property line to make it slant. He told about the radius being changed to stop the traffic from cutting around. He referred to many~oung children living on this street and told about two near fatalities which occurred. He contacted the Police Department and an officer observed the corner and the recommenda- tion was made for the three way stop sign to see if it would divert some of the traffic. To solve the complaint made tonight, the neighbor directly east of the complaining party has authorized him to tell the City Council the stop sign can be installed on his property which possibly may save a child's life. BIDS One (1) Vibratory Plate Compactor (Street Department) Mr. Cheney informed the Council the amount of the award recommended is $1,175 which was the only bid received. Two other bidders could not meet the specifications. He recommends the bid be awarded to Griffin Equipment, Inc. Mr. Roberts moved to accept the recommendation of the Tabulation Committee and accept the bid from Griffin Equipment, Inc. in the amount of $1,175 for one vibratory plate compactor. Mr. Trauger seconded the motion. Under discussion, Mr. Roberts asked just what this is and Mr. Cheney explained that it is a compactor for filling holes in the street. Mr. Strnad asked when we go.out for a bid on a piece of equipment such as this, do we specify the name of the equipment or just the compactor and Mr. Cheney informed him that we indicate the specifications of a certain compactor and in some cases use the name of a manufacturer, but we always say or equivalent and indicate the specifications we are concerned about. Motion carried 4-0. One (1) Super Compact Vehicle, Station Wagon (Engineering) Mr.~Cheney referred to this bid and the following having to do with vehicles and advised the vehicle purchases were bid both local.ly and with the state bid. His experience has been that sometimes the local bid is lower and sometimes the state is lower. He assumes we should get the lowest bid to benefit all taxpayers. A number of bids were recei~ved and it is the conclu- sion that the state b-id for $5,697.83 is the low bid; therefore, we recommend we purchase this vehicle through the state bid. MINUTES - REGULAR CiTY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 18, 1979 Mr. Dick Nelson, representing Earl Wallace Ford~ came before the Council and stated he.would like to point out the difference between the state bid and their bid ;s $~9'15. ~Th~ir price was the lowest in the County and they are located in the County. If problems are incurred within the first 90 days, the vehicle must be taken back to the delivering dealer, which is located in Miami. They are local and have been here for 29 years. They run an open account with the City on parts and have serviced the City in the past. The bids are very close with the exception of the police cars and that spread is about $111. Ford is building a police car which is more than what the City asked for. They will be here, but it isn't known if the manufacturer of the car with the lowest bid is going to be here. Mayor Harmening referred to the state bid being for Chrysler products and stated we do take them to other dealers for warranty work. Mr. Nelson agreed this was correct with the exception of the first 90 days. He ex- plained that a local dealer who submitted a bid could not be expected to absorb warranty Work from another dealer. Mr. Sullivan stated that on the purchase of this station wagon, $80 must be added for rust proofing on the Earl Wallace bid. On the state bid, $95 can be deducted for each vehicle if they are picked up in Miami. He asked if we would have to take the cars to Miami for service during the first 90 days and was told we could have them serviced at the dealer in Delray Beach or Lake Worth. The warranty work can be done locally. He contacted the dealer in Delray Beach and they said they would honor the warranty. Mayor Harmening asked if the bid from Northside Plymouth included rust proofing and Mr. Cheney replied affirmatively. Mr. Trauger moved that the City accept the Northside Plymouth low bid of $5,697.83 for the compact station wagon as per the bid sheet, seconded by Mr. Strnad. No discussion. Motion carried 4-0. Four (4) Pursuit Cars for Police Department Mr, Cheney referred to receiving a number of bids and advised that they found the state price to be the low bid. The recommendation is to purchase the four pursuit cars at the state bid price of $6,383~59 each. Mr. Roberts moved to accept the bid as recommended, the Florida State contract bid, from Northside Plymouth at $6,383.59 per unit. Mr. Strnad seconded the motion. No discussion. Motion carried 4-0. Five (.5) Compact Vehicles (4 - Police Dep. t.~ 1 - Fire Dept.) Mr. Cbeney referred t6 receiving a number of bids and stated the state bid is the lowest. The recommendation is the bid be awarded to Northside Ply- mouth. -4- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 18, 1979 Mr. Roberts moved to accept the bid from Northside Plymouth with-~e unit price of $5,573.23. Mr. Trauger seconded the motion. No discussion. Motion carried 4-0. PUBLIC HEARING - 8:00 P. M. Motorola Request submitted by Jack Gesbocker 90 Acre'Tract at Southeast Corner of Congress & N. W. 22nd Avenue Rezone to ComprehensTve Development of Regional Impact from C-1 and R-3 to P.I.D. Mr. Annunz'iato explained the location and stated this request is to rezone from R-3 multi-family and C-1 office and professional commercial to Planned Industrial Development. He explained the legal procedures involved. He then explained the current utilization of the land and advised there are no significant environmental characteristics. The current zoning will permit the development of 743 multi-family units plus commercial and the proposed land use to develop this 90 acre tract would result in 825,000 square feet of floor area and he explained the use of each building. Also included are two drainage retention lakes, recreation areas and attendant parking areas. He explained the provisions for roads and utilities to serve the site. He then outlined some of the economical aspects. He explained the estimated construction dollars and how it would be spent. He read the amount of em- ployees and payroll anticipated for each phase. He also read the amount of taxes for each district anticipated. In regards to the staff comments and the recommendations of the Planning & Zoning Board, the City Manager will review the development order. Mr. Roberts asked if the plan shown was for the entire project and Mr. Annunziato replied affirmatively. Mr. Roberts referred to a lot of buffer- ing being shown and Mr. Annunziato agreed and explained that no building would be constructed within 400 feet of any residential units. He added this will be developed as a P.I.D. which provides for the proper landscaped buffers and proper planning. Mr. Dedulian, attorney representing Motorola, came before the Council and told about his experience with Motorola. He then introduced the represen- tatives present. He referred to a comprehensive ordinance being prepared incorporating as findings of fact some of the legal predicates contained in the State Statute concerning the adoption of a development of regional im- pact and he then reviewed in detail each page and paragraph. He requested the addition of a letter from Mr. Jack Gesbocker dated November 30, 1979, to be added in Paragraph 15, Page 6, and Section 4, Page 9. He also cor- rected a typographical error on Page 8, Paragraph 20, changing the word "expended" to"extended". He added that Motorola chose to go this DRI route, which is extremely complicated, rather than follow the method adopted in the past to develop piecemeal. He stated they appreciated the cooperation from the City Administration as well as from the City Officials, members of the community and Chamber of Commerce. -5- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 18, 1979 Mr. Trauger questioned the architectural motiff and height of the buildings and Mr. Gesbocker explained the design of the buildings has not been final- ized as they have been limiting their efforts to site design and configura- tion. He then referred to the portion of the building used for housing the automated computer roomb~ng, req~ed to be 60' high and advised a vari- ance was granted by the Board of Adjustment subject to this rezoning to allow that portion of the building to exceed the P.I.D. height. Mr. Roberts asked if the road situation has been resolved and Mayor Harmening replied that this is in the process. Mr. Roberts referred to lakes, etc. having to be approved with the site plan and Mr. Annunziato agreed there would be platting and site plan procedure yet. Mr. Strnad asked if there was any idea percentage-wise regarding the amount of people who might be hired from our City as workers and of the qualifica- tions they would have to have and Mr. DeJu]ian replied that when completed, it is estimated more than 5,400 people will be employed with an annual.pay- roll of $71,000,O00 with 80% of the employees projected to be available from the local labor pool. Mr. Annunziato added that the administrative people are recruited nationwide. Mayor Harmening asked if anyone in the audience wished to speak in opposition to this rezoning request and'development of regional impact. Mrs. Zibel]i asked what type of toxic waste there would be and how it was going to be disposed of and Mayor Harmening referred to this being covered at the Planning & Zoning Board meeting and explained that Motorola hires a licensed scavenger to pick up the waste and haul it to an approved disposal site, which is approved by the Department of En~i'ronmental Regulation. Mr. Edward Ott, 113 Arthur Court, referred to.being a former employee of the City Building Department and stated there have been problems with allowing buildings over 45' high. Other contractors will want to build as high. If this is granted to one, it will have to be given to all. Mayor Harmening informed him that an application was made to the Board of Adjustment for this one building, which is the materials storage building, and the vari- ance was granted in order to use more effective materials handl~ing equipment for a plant this size. It is not economically feasi'ble to use this equipment at a lesser height. Other appeals could be submitted to the Board of Adjust- ment. Mr. Cheney added that the record should make it clear that this 60' height allowance has been granted by the Board of Adjustment and in no way sets a precedent for any other building. In the presentation to the Board of Adjustment, it was made clear this 60' in the center is much less obvious from the road than if this same building was built near the road as this is set far back. There were some unique things applying to this and no prece- dent has been established. Mayor Harmening added there have been some other applications before the Board of Adjustment for various height variances which have been denied in the past. Mayor Harmening asked if anyone in the audience wished to speak in favor of this project. -6- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 18, 1979 Rev. Ed Wo]lenweber, President-Elect of the Chamber of Commerce, came before the Council and referred to living here for four years and stated he has consistent.ly heard about the need for greater economic diversity. We have been~too dependent on the retired community as a focus of this community. The quality of growth must be considered. He referred to the community building rapidly with many people moving in, but explained how the economy was not developing that much. He referred to this site being zoned for~743 multi-family units and stated these can be replaced with about 5,000 jobs and he hopes 80% of the jobs will be available for our young people. At a time when our nation is talking recession, this gives us the chance to talk opportunity. He then explained how the taxes gener- ated from~a company such as this have been demonstrated to be far greater than the services demanded. He stressed that this is an opportunity for economic diversification and the impact on our community will be positive. He urges the City to welcome these people into our community. Mayor Harmening ascertained there were no further speakers and declared the public hearing closed. Mr. Trauger made a motion that the City Council accept this rezoning request submitted by Motorola to rezone this 90 acre tract located at Congress and N. W. 22nd Avenues from C-1 and R-3 to P.I.D. Mr. Roberts seconded the motion. No discussion. Motion carried 4-0. SITE DEVELOPMENT PLANS Preliminary Plat of Lawson Industrial Park, Plat No. 1 (Tabled) Submitted by Mr. Malavasi, Agent Mr. Roberts moved to take this from the table, seconded by Mr. Trauger. Motion carried 4-0. Mayor Harmening referred to there being a question regarding the width of the road and asked if this has been reviewed and Mr. Annunziato re- plied that he and Mr. Clark met with the traffic engineer who submitted the revised traffic analysis. He explained that all the traffic was taken into consideration at all times and following the meetings, Mr. Clark forwarded a recommendation that 30th Avenue be four laned east to the north/south intersecting street and transition be provided. He then read the memo from Mr. Clark. He stated the staff recommendation is this preliminary plat be approved subject to the staff comments and the findings of this memo. Mr. Alan Ciklin, attorney representing the applicant, came before the Council and stated they are in agreement. Mr. Trauger moved acceptance of this preliminary plat' plan for Lawson Indus- tr'ia] Park with the staff comments as put out by the City Planner, seconded by Mr. Strnad. No discussion. Motion carried 4-0. m7- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 18, 1979 Preliminary Plat of Via Lago, Plat #1 Submitted by Tim Greene, Agent Mr. Annunziato referred to this prel~iminary plat being for the first phase of the Via Lago development and stated there will be 24 condominium units on approximately 3.37 acres. There are two issues to be resolved. The Planning & Zoning Board determined the value of the ]and per acre should be set at $96,028 based on a recent appraisal. The total recreation fee for the first phase is $17,285. The s~cond aspect concerns a memo from the Utility Department recommending additional valving in the water lines and appropriate sewer'easement outside of the plat area. The recommendation is this preliminary plat be approved subject to the Utility Department recom- mendations and subject to setting a value on the land. Mr. Tim Greene, agent for the developer, came before the Council. Mr. Vance asked -i~ h~was familiar with the staff comments regarding this prelim- inary plat and Mr. Greene replied affirmatively. Mr. Vance asked if he agrees to comply on behalf of his client and Mr. Greene replied affirma- tively. Mr. Roberts moved to approve this preliminary plat for Via Lago, Plat #1, as recommended by the Planning & Zoning Board with staff recommendations. Mr. Trauger seconded the motion. No discussion. Motion carried 4-0. Hunter's Run Golf and Racquet Club, Tract B-1 of Summit Plat #1 Submitted by Paul Hykel, Agent Construction of 140 multi-family units, 16.7 acres Mr. Annunziato informed the Council this site plan represents development of one-half of Tract B which, is located in the southwest corner of the overall development. ~his proposal is to construct approximately 140 multi-family units on 16.709 acres. The overall density is consistent with the approved master plan. He read ~he following staff comments: Planning Dept. Fire Dept. Utility Dept. Police Dept. - Consistent with master plan as adopted and approved by the City Council. - Fire hydrants not more than 500 ft. apart. - Water line sizes should be designated on the site plan and water should be looped in this phase a~d he explained. - Subject to traffic control signs. Mr. Annunziato stated the recommendation is to approve subject to comments. Mr. Roberts referred to 280 parking spaces being required and the proposed noted as 253 plus 35 in the future. Mr. Annunziato informed him that at the time of zoning to PUD, the applicant requested to develop this with 1.75 parking spaces ped unit instead of 2 and if found necessary, then provide the additional parking at a later date. These areas are shown if needed. Mr. Roberts asked if they are within a reasonable distance of the -8- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 18, 1979 buildings and Mr. Annunziato replied affirmatively and pointed out that they are right at the end of each parking bay so they can be extended. Mr. Roberts clarified that the eventual total will be 288 and Mr. Annun- ziato replied affirmatively, if required and stated when the master plan was approved, it was agreed the parking did not have to be constructed but if there is a problem, then the City Council can mandate the additional parking. The opportunity is there and this is provided for on the site plan. Mr. Roberts referred to there being several developments in the past where a few corners were cut which resulted in problems and stated he cannot understand why this development cannot put in the two required per unit. Also in some cases, additional parking spaces have been allocated, but they are located a great distance away. Mr. Annunziato explained that it was mentioned at the master plan approval that from the applicant's past exp6r?ence, most residents are seasonal and the additional parking spaces are not needed. That is the reason this request for variation was submitted. The applicant will provide the space for additiona] parking when it is deter- mined there is a need by the City Council. Mayor Harmening asked when the cutoff dat.e would be for determining the need and Mr. Annunziato replied that it was whenever t~need arises. Mr. Trauger commented that it was possible the need would only arise in one. area. Mr. Vance referred to this being approved before he became City Attorney and suggested the developer be required to post a bond in regard to the construction of this phase and it might be possible to Js~ve a portion of that bond adequate to pay for construction of those parking spaces in force for an indefinite period of time. Mr. Roberts stated the requirement is for two parking spaces for each unit and from experience, he does not go along with anything less. Mr. Charles Gilbert, Architect, pointed out that it was designated on the site plan where the additional parking spaces would be built, so there would not be a problem in the future. Since the parking spaces are not needed, they think it is desirable to have landscaped area rather than an asphalt area. Mr. Cheney referred to not being here when this was originally approved and stated he envisions a problem with getting additional parking in the future and there may be a difficulty arguing whether there is a need. Also, there is the possibility of people living year round at Hunter's Run based on the current trend. He believes two spaces are not excessive. The price level of these houses suggests there w~ll be no problem for the people to buy a second car and he expects they will have visitors. A bond is for pub]lc improvements and to cover private, it would be separate. He thinks this should be reconsidered. Mr, Vance agreed the bonding ar- rangements would be complicated. Mr. Gl]bert questioned how the parking requirement reads in the ordinance and Mr. Annunziato replied that he believes the City Council reserved the right to require additional parking sometime in the future if found to be a problem. -9- MINUTES REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 18, 1979 Mayor Harmening suggested possibly tabling this so the representatives and staff can come up with a solution to this problem. Mr. Gilbert questioned what the problem was and Mayor Harmening informed hi~m that it appears there may be some question as to whether 1.75 spaces per unit is adequate. Mr. Strnad referred to it being a greater problem to install the parking spaces at a later date and stated he did not think meeting the parking requirements would affect the landscaping that much. Mr. Trauger also agreed with the two spaces and asked if the applicant wanted this tabled for consideration by the developer or accept the two spaces. Mr. Gilbert replied that with smaller cars, there, will be the tendency to have less blacktop and Mr. Trauger replied that even with smaller cars, larger spaces were desirable. Mr. Roberts stated that he feels two spaces are actually necessary and Mayor Harmening added that this is only about 35 additional spaces. Mr. Gilbert stated that he will discuss this with the developer. Mr. Roberts moved to table this, seconded by Mr. Trauger. Motion carried LEGAL Ordinances - 2nd Reading - Public Hearing NONE Ordinances - 1st Reading Proposed Ordinance No. 79-36 Re: Rezone Motorola Property to P.I.D. and to Grant D.R.I. Development Order Mr. Vance read proposed Ordinance No. 79-36 by title on first reading. He added that it will be read in its entirety on .second and final reading. Mr. Trauger moved the adoption of Ordinance No. 79-36 on first reading, seconded by Mr. Strnad. No discussion. Under discussion, Mr. Trauger advised that he had this resolution submitted to keep the City of Boynton Beach in agreement with the state, county and nation to show we are interested in conserving energy. This resolution puts us on record favoring this in all authority. Mrs. Padgett then took a roll call vote on the motion as follows: Councilman Trauger - Aye Councilman Roberts - Aye Councilman Strnad - Aye Mayor Harmening - Aye Motion carried 4-0. Proposed Resolution No. 79-VV Re: Authorizing City Manager to make applica- tion for Step 'Il Grant - EPA Proiect No. C-120496070 Mr. Vance read proposed Resolution No. 79-VV by title. Mr. Cheney advised that this resolution and the next one are applications to EPA for design funds for the next phase of the water collection program. Mr. Trauger moved the adoption of Resolution No. 79-VV, seconded by Mr. Roberts. No discussion. Appointment of Member to M..P.O. Mr. Ned Brooke, Executive Secretary of the Metropolitan Planning Organization, informed the Council that the Governor's letter designated the Office of Mayor as the representative. However, there is some degree of difference of what was said in that letter and what was in the legislation. He recommends going along with the Governor's recommendation and at the first opportunity, a replacement be exercised by local option. Mayor Harmening referred to his term as Mayor expiring on January 7 and Mr. Vance informed him if there is a meeting before then, the Mayor must attend. Mr. Brooke added that there will be an organizational meeting which has been set for December 28. He advi.sed that an interpretation has been received from the federal agencies that we must be constituted by January 1 and must have an organizational meeting prior to then. The Mayor should attend that meeting and the next meeting will not be held until February. Mr. Vance added that the resolution designates the Mayor. Mayor Harmening asked if we exercise our local option at a later date, would the Mayor be required and Mr. Brooke replied that he thinks the statute reads differently and someone can be nominated. Mr, Vance advised that he will read the statute and he thinks we can make a substitute if the Council desires. Mr~ Brooke added that one of the concerns with the original M.P.O. was the governor designated all the members with no options for local govern- ments and the legislature's intent was to give back to local units of govern- ment the opportunity to put their people in. At this time, Mayor Harmening declared a five minute recess. He reconvened the meeting at 9:35 P.M. He announced the Vice Mayor is absent tonight due to being sick. County~to receive $50,000 from the County with the City matching $50,000. Approval of Encumbrances for 1978-79 Budget Mr. Cheney stated that annually we come to the point Of closing the books for the previous year and there are some projects held for future expendi- tures. Mayor Harmening read that amounts were encumbered for bicycle paths, lOth Avenue widening, Police pension,, Firemen's pension, Employer's F.I.C.A., regional comprehensive plan, Civil Defense, recreation facilities, and ambu- lance equipment. Mr. Trauger questioned the reserve for Civil Defense and Mr. Cheney replied that it has been there for several years and each year is re-encumbered. Mayor Harmening added that it was set~ up in case of hurricane and there may be a great deal of cleaning up, repairr work, etc. Mr. Trauger moved the encumbrances be transferred as listed in the attached nine documents, seconded by Mr. Roberts. No discussion. Motion carried 4-0. Application for Permit to Solicit - International Society for Krishna Consciousness Mr. Cheney stated the reason this is on the agenda is because about a week ago, he noted two Santa Clauses solicitingl at South Federal and 15th Avenue. The Police Department talked to them and ordered them to stop soliciting since no permi~t was obtained. Mr. Trauger asked if this was the sam~. organization which applied previously and Mr. Cheney replied that the Mooni~s applied previously. This organization is similar in background and motivation, but they are separate groups. Mr. Roberts referred to the application not being complete and asked if this would benefit the City of Boynton Beach? Mr. Cheney agreed the application was not complete and suggested possibily more information be obtained. Mr. Roberts stated that he noticed the people involved are out on the highway soliciting and he would turn that down because of the danger involved. Mr. Vance clarified that the application submitted is obviously incomplete. He suggested that it be referred back to the City Manager to see if he can in due course obtai, n the necessary information to complete the application. Mrs. Padgett advised that two people had requested to speak on this subject. Mrs. Dee Zibelli car~e before the Council and stated the North Boynton Com- munity Improvement ~ssociation ~trong,]¥ opposes t~is request, as they do not feel it would bt advantageous to the City. Mr. Fred Davenport, 12 Swinton Circle, stated he is opposed to the granting of this permit beca~se he has seen this group in operation. He referred to being a comm. issione( federal-law enfoFcement officer in 1976 and told about the method of solicitation used by this group at that time in a federal area. -15- MINUTES REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 18, 1979 Mr. Davenport continued with assuring the Council that this group's method of operation will be the same in Boynton Beach if a permit is granted. He stressed that their method is to hassle people and tell untruths in order to get money. Certainly Boynton Beach has enough charitable organizations now without bringing in outsiders! Mr. Strnad referred to having to go t~rough this every time an organization like this applies and suggested leaving it to the discretion of the City Manager to take care.of these things. It would take a burden off the Coun- cil with having these discussions, etc. Mr. Roberts replied that he ~s sure the City Manager can speak for himself, but the City Council will have to set policy and each case must be taken i~dividually. He is against this particu- lar group and a research has been done showing the methods which they use. Mr. Trauger made a motion to have the City Manager secure the proper appli- cation, seconded by Mr. Strnad. No discussion. Motion carried 4-0. Mr. Strnad questioned if this would have to again come back before the Council if the City Manager uses his discretion and Mr. Cheney replied the ordinance would have to be amended, iHe explained that it is done both ways in different communities. Mr. Strnad suggested changing the ordinance so this could be handled by the City Manager and Mr. Roberts suggested that an ordinance be drafted for the CounCil's review. Mr. Trauger stated that he thinks we are serving as a Councill to protect the City and we should re- view these applications. After further discussion, Mayor Harmening requested everyone to think about whether the ordinance should be changed and it can be put on the agenda for a future meeting. Provision for Street Lights in New Subdivisions Mayor Harmening referred to three options having been submitted and Mr. Cheney recommended what he has indicated in his memo and he added that FlOrida Power & Light Co. ~s acceptable to this arrangement. He explained the requirements and stated i.f we don~'t make an agreement, then we have the obligation of replacing the poles. Mr. Trauger moved to accept the provi~sions for street lights in new subdivi- sions as outlined in the agenda memo of December 18, seconded by Mr. Strnad. No discussion. Motion carried 4-0. Consideration of City/County Agreemenjt on Golf Course Land Utilization Mr. Trauger referred to submitting a memo and stated as a result of a meet- ing with Commissioner Gregory attende'd by Mr. Cheney, Mr. deLong and himself, we have taken the position we wanted ~he membership ratio changed at the end of five years to 65/35% rather than as proposed in Commissioner Gregory's letter of 60/40%. We felt more comfortable with this with the City develop- ing this and the bonding situation. Also, Commissioner Gregory mentioned a five member advisory committee and we arelrecommending the advisory committee should be in the same approximate ra~io of City and County members as the ratio for membershi.p. The purpose i! in the interest of funding and con- struction which the citizens of Boyn~on Beach are going to be responsib]e~r through the bond and they, as members, are the ones going to be participating. He requests approval of his memo. as presented. Mr. Cheney added there will be a workshop meeting of the County Commissioners on Thursday morning and we would like to take this position to them~ If this is approved at the workshop sesqion, the document could be prepared for the Council's approval on January 7 and the County Commission's approval on January 8.
