SUBJECT: 2009 Report of Minority and Physically Disabled Appointments
Section 760.80, Florida Statutes, requires statutorily created decision making and regulatory
boards, commissions, councils and committees of the state to submit a report to the Secretary of
State annually by December 1. This report discloses the number of appointments made during
the preceding year from each minority group and the number of non - minority appointments
made, expressed both in numerical terms and as a percentage of the total membership of the
board, commission, council, or committee. In addition, information must be included in the
report detailing the number of physically disabled persons appointed to the boards, commissions,
councils and committees in the previous calendar year. This form can be downloaded from the
Division's website at:

Commissioner Hay pointed out he was the Commissioner for District II and noted he would be
pleased to work with Ms. Lester. He currently worked with many Homeowners' Associations and
other organizations to assist concerned citizens.
No one else coming forward, Mayor Taylor closed the public audience.
V. ADMINISTRATIVE:
A. Accept the resignation of Canaan E. Himmelbaum, a regular member of the Code
Compliance Board.

Motion
Commissioner Ross appointed Donald Scantlan, Jr., to serve as an Alternate. Commissioner
Weiland seconded the motion. The motion passed unanimously.
Commissioner Hay inquired as to what could be done to encourage volunteers to serve on the
Boards. Mayor Taylor indicated all of the regular titWitil had been filled, other than the two
positions available on the Building Board of Adjustment and Appeals.
Mr. Bressner pointed out information regarding the City's boards had been provided via BBTV,
newsletters, newspaper articles and the City's Blog. Commissioner Ross inquired whether
Homeowners' Associations had been targeted. Mr. Bressner explained if the Presidents of the
Homeowners' Associations were interested in receiving mailings and information about the City,
they could subscribe through the City's website, but they would have to take the initiative.
Mayor Taylor, Commissioner Hay and Mr. Bressner noted they had often approached people to
ascertain whether they had an interest in serving on a City Board.

Commissioner Weiland requested clarification from Commissioner Ross regarding the lack of
notification of meetings. Commissioner Ross responded she understood there were several
meetings in District II on the Heart of Boynton project at various churches and she was not
invited. Vice Mayor Rodriguez offered his opinion perhaps the Commission was intentionally not
invited. Commissioner Ross could not accept the fact Commissioner Hay, in particular, would
not have known about meetings. Her basis for the Sunshine Law violation concern was that
Vice Mayor Rodriguez was expressing his opinion on an issue that had not been presented to
the Commission yet. She drew the conclusion the law of communication was similar for the
Heart of Boynton project and now, the City Hall /Police Department relocation to District IV.
Commissioner Weiland pointed out he was not invited to any meetings either. Commissioner
Hay stressed he was a Commissioner for the City of Boynton, not just District II. Common
courtesy dictates notification of visits into Districts other than their own, to work together as a
team. Vice Mayor Rodriguez announced he had not been to a meeting in District II without
Commissioner Hay's presence.

Warren Timm, 130 NE 26 Avenue, and an officer at Village on the Royale Green, discussed
the increase in the water rates. For this development, water was the second biggest expense
for the residents. An additional assessment may be necessary to cover the increase in water
costs. He hoped further study would reveal some economies in the Utilities Department in light
of the administrative costs of the Department to lessen the increase for private individuals.
DeMaris Oliver, 619 W. Ocean Avenue, expressed her concern and that of other parents in
the change to four ten -hour days and the impact on the child care and kids' activities at various
City facilities. She indicated she would be presenting a petition with many names requesting
that no change be made. Mayor Taylor clarified only the hours at City Hall would be cut.
Further, budget discussions may include other facilities. Taxes were reduced by a mandated
millage reduction and not only hours, but also many other legacy programs may be eliminated
as well as raising the water rates to balance the budget. He suggested she attend other budget
meetings and offer her input.
Don Scantlan, 13 Cedar Circle, presented to the Commission photos and missing details
regarding the Nautica /Meadows Park showing the non - natural scrub area with garbage, debris
and weeds. It was not a desirable area for any neighborhood. Mr. Scantlan handed out the
flyer and press release relative to the Workforce Alliance stimulus funds. He hoped it would be
an opportunity to employ the 18 to 24 year -old residents of the City. He thanked Mr. Livergood
and Commissioner Ross for the ongoing communication relating to the Hypoluxo bike trail
between Congress and I -95.

Mayor Taylor moved to appoint Sherrie Tenbergen as a Regular Member of the Arts Commission.
Commissioner Weiland seconded the motion that unanimously passed.
Commissioner Rodriguez inquired if the Alternate members were reflected on the information and
advised there was an existing Alternate waiting to be moved up to a Regular position. He inquired
if that person should be given first consideration. Mayor Taylor noted Ms. Tenbergen was
previously on the Board.
Judith Pyle, Deputy City Clerk, responded Alternates are not listed for the appointment unless they
ask to be moved up.

Mayor Taylor noted updated membership lists are routinely provided.
Commissioner Ross noted she tried to address the issue months ago, and thought the information

was necessary. -
Dawn Osowsky, 1751 NE 6 Street, advised her fees had increased three times over the last
year. She discovered Cornerstone owned many of the townhomes and were renting the units,
but not paying the homeowner fees. The residents were being victimized with increased fees to
compensate for the developer's own non - payment of fees. Safety was an issue and youth from
adjacent properties were using the facilities and causing problems.
Mayor Taylor indicated the City would review the City's legal standing in the situation and
assistance that could be given.
Victor Norfus, 261 N. Palm Drive, thanked the Commission for denying the truck route
through Lake Boynton Estates. Access to the Sara Sims Park and churches in the area were
also a concern with the closure of the street on Martin Luther King Boulevard. An alternative
route should be sought to access Sara Sims Park from Martin Luther King Boulevard. Mayor
Taylor responded the community committee had recommended the street be closed.
Don Scantlan, 13 Cedar Circle, thanked the Commission for the Veteran's Day ceremony. Mr.
Scantlan gave an update on the Summer Youth Program with Workforce Alliance. Applications
were still being accepted. Employers were still needed.
Sonny Garcia, 1631 NW 3' Lane, advised a State inspector had visited the Figueroa house
and compiled a list of items that needed to be fixed by the City or the contractor. The items
were never corrected.

residents into foreclosure. If it were necessary to raise the maintenance costs, residents could be
charged more than $300 per month in a low- income housing community.
Kurt Bressner, City Manager, noted City staff had looked at the layout of the building and was
working with the plumbing contractor for the Crossings. He agreed sub - metering would be the
best way to assign accountability for the water usage. The buildings were originally constructed
with a single meter for each building. City staff was working with the community to resolve the
issue and as such, water service would not be discontinued.
John McGovern, 2620 Spiceberry Lane, provided a study funded by the Bill and Melinda Gates
Foundation, which highlighted the condition of the nation's schools. In 1995 -1996, fewer than
60% of students had graduated from high school. In 2005 -2006, a significant improvement had
been observed in the southern states, with the exception of Florida and Georgia. A 10 -year
review of the schools in the State of Florida revealed a decline in graduation rates. The website
for the School District of Palm Beach County indicated 72% of students had graduated from high
school. Mr. McGovern believed the statistics were more likely between 60% and 72 %. The study
was provided to the Commission for information and reflection. Mr. McGovern believed public
leaders should advocate for improved education.

Mayor Taylor interrupted that the Commission was well aware of Mr. Gottfried's remarks and
concluded the dispute did not involve the City and advised Mr. Gottfried to seek legal cousel.
Mr. Marabach apologized for the dispute and appreciated the Commission's understanding.
Sean Dykes, announced he was starting a non -profit organization, I Am My Brother's Keeper,
and his goal was to encourage young men in the area to make better choices. He felt
partnering with any and all organizations would be helpful in leading young men into successful
lifestyles. He wanted to serve the City of Boynton Beach and was committed to helping young
men by learning the needs of the Individuals and the City. The focus age group was 7 to 14,
but he would help whoever needed attention. Commissioner Rodriguez directed Mr. Dykes to
contact Stacey Robinson of the Youth Violence Prevention Program.
Herb Suss, 1711 Woodfem Drive, mentioned the success of The Links and the recent
designation as the Best Municipal Golf Course in Florida. Mr. Suss also commended the Water
Department for their quick response to his home to fix a water leak and stressed the workers
are unsung heroes of the City.

Advisory Board prioritized this project as number 9 of 9. The expenditure of $60,000 was also a
factor for consideration. Mayor Taylor indicated it would be reviewed at the next budget
hearing. Commissioner Weiland indicated he had received phone calls as had Commissioner
Ross and Vice Mayor Hay, regarding the park.
Sunny Garcia, 1631 NW 3r Lane, did not understand why action was not being taken in a
timely manner to help Ms. Figueroa while cleaning the canals got immediate attention.
Commissioner Weiland stressed that the northeast section of the City got much more attention
and funding than all of the three other quadrants of the City. It would be extremely hard to
determine if the problems in the home currently were a result of faulty workmanship four years
ago. Mayor Taylor emphasized there were no funds available in the budget to clean any of the
canals. Rehabilitation funds originate through SHIP funding and those funds have been
drastically cut also. Mr. Garcia repeated his suggestion that the liens placed against the home
be dropped so monies can be borrowed to repair the house.
Catherine Scantlan, 13 Cedar Circle, indicated she was offended by the comments of
Commissioner Ross regarding the faulty survey letter that had been sent out in the Meadows.
Ms. Scantlan reported at the suggestion of another resident, much of the verbiage in the letter
was deleted to avoid any bias relating to the project.
Don Scantlan, 13 Cedar Circle, the original author of the survey letter, reported the Board had
extensively edited the letter and would provide a copy. The architect would be able to
determine the extent of the improvements needed and the cost. Other parks in the area had
been built while the request for the Meadows Park had been delayed for over 20 years. Mr.
Bressner interjected the Knollwood Park was built at the expense of a developer and not the
taxpayers. Mr. Scantlan noted impact fees should have generated sufficient funding for the
park rather than taxpayer monies.
Mr. Scantlan further reported on the summer youth Workforce Alliance Program as he was the
new Director. The City had been a significant participant in the program and Mr. Scantlan
offered any assistance he could give to promote the youth and the program. Fifty businesses
had responded with 80 job slots. Approximately 60 of the positions had been filled.

Big Bass Canal and Lazy Lake were owned by the City. A decision was made that any
new developments would have to maintain the canals created during construction. At a
public meeting, maps were displayed of canals owned by the City and others where the
homeowners owned to the middle of the canal or their property side of canal or to the
other side of the canal.
Mr. Bressner advised in many instances the plat indicates "the public" owns the canal.
The definition of "the public" is not clear. There has been nothing found dedicating any
of the canals to the City of Boynton Beach. Mr. Mathews offered his opinion that the
City of Boynton Beach would be the representative of the people, if an actual owner was
not the designated owner. He alleged the confusion was deteriorating the value of his
home.

A. Approve the Minutes from the City Commission meeting held on September 14,
2009.
B. PROPOSED RESOLUTION NO. R09 -140 - Approve a "piggyback" to the City
of Pompano's contract with Nalco approved on January 13, 2009 (1- 13 -09) via
Bid H -45 -08 with the same terms, conditions, specifications and pricing. This
contract will be used to purchase anti - scalant (PC- 1850T) and control its
dosage for the removal of solids at the West Water Treatment Plant (WWTP).
The annual expenditure is estimated at $98,000. The City of Pompano Beach

Anthony and Stacy Cavo, 1000 Coral Court, complained about the elimination of
spraying and maintaining the canals in the City. The waterway behind her home is
completely covered with vegetation and includes more snakes and alligators. Many of
the residents from the Treasure Lake community were present. Ms. Cavo had received
information that research was being done on the ownership of the canals and requested
an update. Mr. Cavo added he had bought the house because of the 146 feet of
waterfront. The increased vegetation is an ideal environment for alligators and snakes
that creates a safety risk for children and pets. Their backyard is not accessible for any
reason The vegetation will need to be completely removed.
Mayor Taylor understood the situation and agreed it could be a safety hazard. The
issue had been discussed with the City Manager. Commissioner Weiland had also
been attempting to address the issue. It was anticipated to be discussed at the next
Commission meeting.
Drew Zuccala, 1032 Coral Court, contended risk was a major issue and indicated a
group of individuals were present who would be willing to meet with the City to resolve
the issue. The properties in Venetian Isles were landlocked and need assistance
Allen Hendricks, 122 SE 4 Avenue, gave a progress report on the pending plan to be
presented by the Save the Old High School group The plan would be presented as
soon as possible and would include only a fraction of the overall cost to be borne by the
City of Boynton Beach. He stressed the Save the Old High School group had an
attitude of cooperation and assistance. Their ultimate goal was for a building that was
vibrant and full of life, teaming with people on a daily basis, for all citizens to enjoy. It
would involve renovation, restoration and recycling. He anticipated making the
presentation in two weeks.
No one else coming forward Mayor Taylor closed the public audience.
5. ADMINISTRATIVE
A. Accept the resignation of Jay Allard, a regular member of the Recreation
and Parks Advisory Board.
Motion
Commissioner Rodriguez moved to accept the resignation. Commissioner Weiland
seconded the motion. The motion passed unanimously
B. Appoint eligible members of the community to serve in vacant positrons on
City advisory boards.

Commissioner Weiland moved to appoint Barbara Erlichman as a regular member of
the Library Board. Commissioner Ross seconded the motion. The motion passed
unanimously.

Mayor Taylor moved to appointed Susan indilicato as a regular member of the Golf
Advisory Committee. He felt it was important to have a woman on the Committee.
Commissioner Ross seconded the motion. The motion passed unanimously.

Commissioner Ross moved to table all remaining I. Commissioner
Weiland seconded the motion. The motion passed unanimously.
6. CONSENT AGENDA
Matters in this section of the Agenda are proposed and recommended by the
City Manager for "Consent Agenda" approval of the action indicated in each
item, with all of the accompanying material to become a part of the Public
Record and subject to staff comments.

responsible bidders who meet all specifications with an estimated annual
expenditure of $38,000 00.

D PROPOSED RESOLUTION NO. R09 -116 -- Approve piggyback the
Jacksonville Electric Authority (JEA) contract #82768 Cured in Place Pipe
(CIPP) Unit Price Construction with Insituform Technologies of
Jacksonville Florida to rehabilitate the City's wastewater gravity main lines
for a project cost of $2,11 3,795.97 with a 10% contingency of $211,379.60
for a total project cost of $2,325,175 57. (Tabled to November 3, 2009)
