Old Business, delete (B) Consideration of Plea for Royal Palm Village Clubhouse as he had no report on this as yet; bid by the D & E should not be listed. MOTION by Mr. Roberts to adopt the Agenda as amended, seconded by ~rs. Riscoe, carried 5-0. The~Mayorannour~ced_ a Proclamation of United States Marine Corps Week from November 4 through November 11, 1979, and asked ~rs. Riscoe to read the Proclamation because of her personal interest in the matter. The Mayor then presented a signed copy of the Proclamation to Sgt. Wentworth, son of ~s. Riseoe~ who accepted on behalf of the Marine Corps. They will be posted on the Bulletin Board and will also be broadcast by radio. Regular City Council Meeting - October 16, 1999. Mrs. Riscoe moved the meetiog of October 16, Trauger, carried 5-0. adoption of the minutes of the Council 1 979, as presented, seconded by PUBLIC AUDIENCE ~,~r. RaymondStack, representim~ Seagate of Gulfstream, 2000 South Federal Highway, Boynton Beach, stated that they had written requests to the City and to Tallahassee for over two years, with very little progress, regarding the tractor-trailers usLng the area for parking and blocking the view for some 400-500 cars in their condominium. He brings this plea to Council to come up with a.solution to alleviate conditions that exist on U.S. ~1, possibly by a temporary "No Parking" order, because conditions will become more dangerous wi~h the increase of traffic during the winter months. Mayor Harmening stated this matter had been discussed by Council no~ too long ago, and that the Dept. of Transportation has ~uris- diction over that road. He asked if there had been a final report from the DOT. ~. Cheney replied there was no final report. He had heard about three weeks mac that~the State had studied the matter for several months and have more survey work to do. The results should be ready in about two to three weeks. Mr. Strnad asked if input had been received from our own traffic department. bu~ ~. Cheney replied that the information had been supplied to the DOT. ~r. Strnad said it is incumbent on the Council to pursue this further, Y~. Stack stated that the prohibition of'NO U TURN' makes more problems by making cars and trucks enter the condominium to make a legal u-turn, onto U.S.#i. ~. Trauger suggested the City Manager write to the motels along U.S.#I and ask the motel owners to request their guests to park on their own lots or in the rear on side streets. ~ayor Harmening asked ~. Cheney to follow up on this with the ?DOT. I*~s. Zibelli, representing North Boynton CIA, asked if it was feasible to get a meter counter to monitor traffic on Seacrest Boulevard. There has been one bad accident where Seacresl narrows to one lane, and another accident was just barely avoided. She proceeded to discuss the problem of drainage in the North area. She rejected the suggestion that the residents of North Boynton could set up their own taxing district, stating that this seemed to be getting de-annexed from the City. ~rs. Zibelli also stated that the proposed Roll, on Building has no access road, all traffic will be going through Hypoluxo Road and Seacrest, creating a new bottleneck. - 2 - MINUT~ REGULAR CITY COUNCIL MEE_~IN~ BOYNTON BEACH, FLORIDA NOVE~,~BER 6. 1979 ~rs. Zibelli then asked if $500,000 was in the 'ball park' for alleviating the drair~e problem in North Boynton. The Mayor said he thought it would be less for that section but ~s. Zibelli said she was not referrir~ to only one section but the area from 22nd Avenue up to Nenton Road. The Mayor stated he felt this amount would not be auough ~ar. Strnad asked if the City Nanager could get a crew up there to clean out the drains. Nayor Harmening said this would need to be done after avery rainstorm. Mrs. Zibelli asked "Why don't we have a referendum" and Nrs. Riscoe said she had been waiting for someone to say that. ~ayor Harmening said he also would be i~ favor of a referendum. Mr. Bob Riley, ~42 S,W.4th Ave.Boynton Beach and on behalf of Mr. Robert Lieder, 419 S.W. 4th Ave., Boynton Beach, presented the City of Boynton Beach with a claim for damages, for property dama~e~, for ~mpropsr ~nstallat~on and maintenance of a d_a~nage retentzon pit located at S. W. 9rd Street and 6th Avenue, Boynton Beach. He stated notices had been made out to the city's carrier. Nfs. Warren Avery, 425 S. W. 4th Ave,, Boynton Beach, presented a similar claim for damages, Also stated last ~onday their sewage had backed up again. She requested some sort of signal be used to alert the sewer authority when the system ~s not working Properly, The Nayor asked ~. Cessna if we had any alarm system and ~r. Cessna said one was beimg worked on. Upon inquiry he stated it would be ninety to one hundred days before they would be in operation~ i~rs. Riscoe proposed that Council sit down and have a workshop megting to see if it is feasible to put some sort of drainage system to a referendum for our general election. Th~ Mayor asked the City Clerk if there was time to get this on the ballot for the General Election. ~. Cheney stated we would have to know some costs before starting, also the area. ~r, Roberts asked if this money was to alleviate the flooding throughout the city. Riscoe said the workshop would determine what sections had the highest priority. 5ir, Vance.said while t~e concep~ ~; of a drainage bon? ?~ue may belsomething the Council wants to do, the type of feas~b~l~ty and engineering on something like this to come up with a reasonably accurate figure, required in depth study. Mr. Strnad brought up the matter of city workers going up to the north end to clean out drains. ~. Cheney said we could do that although he had only six highway employees but a systematic approach should be developed as some may be so blocked up they cannot do any good. Priorities will have to be established but this will not be placed on the "back burner'. Mrs. Riscoe moved the Council have a workshop to discuss the entire drainage problem, seconded by ~r. Roberts. The date was set for Tuesday, November 13, 8:00, a.m, -3- ~iNUTES REGULAR CITY COUNCIL MEETING BOYNTON B~ACH, FLORIDA NOVEN~. 6, 1979 Mr. Strnad moved that Council instruct the City Manager to send the necessary crews up to the North end to clean out the French drains, if possible, or if conditions are too bad to build new drains. Sale of Juauk Dumpst?rs - Bid received from Industrial Welding Inc. of Fort Lauderdale in amomut of $1,000.00 for Junk Dumpsters. City Manager recommended acceptance of this bid. ~. This hearing had been scheduled for 8:00 p.m. Location: Between NE 22nd Ave. and NE 26th Ave. and between FEC Railroad and 5rE 4th St. RE- QUEST FOR REZONING, from C-3 to PUD with LUI 5.0. Construction of 216 Duplex ~nits and Apartment ~nlts combined. ~. Annunziato, City Planner, presented the recommendation of the Pl~uning~and ZOning Board that this request be granted. 5ir. Trauger expressed concern that with 87 rental units we may be going to acquire another Chelsea Picket or 'instant slum' in two or three years. Mr. Felix Granados, son of the developer, spoke to the question, statirg that when you go out and borrow a million dollars to build you do not let it run down into a slum. Since they are retaining ownership and will rent the apartment units, it is to their benefit to maintain the development in proper mariner. He called on the Board to c~nsider the reputation of the family in past developments. Mr. Mayor recalled the question is on rezoning., Mr. Trauger moved the rezonzr~ requested b~ approved, Y~. Trauger restated his~ motion. ~ir: Harmening asked if anyone in the public audian!ce wished to speak ~n favor of this request. There were none. He then asked if there was anyone who wished to speak against this rezoning. There were none. ~r. The only ob- je~ction previously received, from Florida Power & Light Co., has been removed providing that the developer will grant a 12-fi. ease- me~t to F.P.&.L. After some discussion M~. Vance, City Attorney, s.u~gested this sub~ec~' ~ be tabled to the next Council mee~zng. ~yor asked if the approval was subject to the granting of the eaSement would both the City and FPL be covered. ~r. Vance said it could be tied in with the granting of the easement. After some discussion the Mayor called for any one in the public audience to speak in favor - none~ to speak against - none, Mr. Roberts moved th~ Council approve the request for Abandonmenz of the north 12~ft of the alley on the north side ~f Block 12, Boynton Ridge. ~r. Trauger seconded, carried ~hristian Development - Abandonment Request - ~r. Clyde Worrell, 9i~ Palm Trail, Delray Beach, Agent, Ere Worrell stated the reason for the request was that they are creating a residential com~muity and would not like to see commercial traffic going throuEh the property in future. Mr. Annunziato incorporated the comments of~ the department heads in that an easemen~ would be reouired along the east 12-ft of the proposed abandoned 30-ft for a City and Utility Companies future use. The Mayor asked if ~uyo~e in the p~bl~c audience w~shed to speak mn avor O~ ~hls abandonment. ~tlzam Mezsznger, 1391 S.W~ IV Ave., Boynton Beach, speaking in favor of abandonment said the com_mercial traffic through the residential property would be a hazard ~d unnecessary since there was complete throughway on S.W. 22nd Strret from S.W. 19th Ave. to S. W. iSth Ave,(Woolbright Road) ~ad it ~s only approximately 200 ft. east of the proposed ab~adorament. ~, Joe ~azies, 2207 Roma ~ay, Boynton Beach, also spoke in favor of abandomment, stating in addi- tion to the previous speaker's reasons, that if the road were open to traffic it would add to the surrounding area's problem of burglaries and hea~-y traffic. He also said he did not thi~k the commercial property owners statement that his property would be de- valued was realistic. He stated if they ~%sired they could make roadways through their own property. The mayor called for any opposed in the audience. None. M~. Vance's advice and employ the services of Attorney Wolf. Seconded by N r, Roberts. Notion carried 5~0. OLD BUSINESS. Golfvie~ Harbo? Fence Request., - The Golf View Harbor Home Owners Association had made a request for a fence to be con- structed on S.W.11th Street, just south of S.W.23rd Street, where it goes over the canal. They are concerned for the safety of the children who use this bridge daily to reach the school bus which stops at S. W. 11th Street and S. W. 24th Ave. The City Engineer, Mr. Tom Clark, investigated s_nd recommends the construction of such a fence, which would be a ~' chain link fence for an approximate length of 80' at $5.00 per foot for a total of $400.00 installed, He also recommended a 12' section of 4' fence for the southeast corner of this overpass at ~u estimated cost of ~60.00, maki~ a total of $460.00 for the complete installation. Some discussion was held as to the merits ~nd use of a four foot fence, which it was felt would at the very least discourage the children from climbing and the danger of falling into the canal be alleviated. Mr. Trauger moved that a fence be built as requested, at the total cost of ~460.00. ~r. Strnad seconded, Motion carried 5~0. S~v Lake Subdivision Request for Variance. NEW B~INESS Northern Pines Mobile Home Park~ requesting permit to conne~t.~he ~ark with the municipal sewage trsatment system, and also s~am~ng they are not requestir~ connection with the city water system. Mr. Cessna, Director of ~t_l~tzes recom~mends approval, subject to st~ni~ of a formal agreement, and escrowing of the necessary money to cover all phases of the installation. Mrs. Riscoe moved the request be approved~ seconded by Mr. Roberts.
