Mayor Harmening welcomed everyone and called the meeting to order at
7:30 P. M. He announced the Invocation tonight will be by Pastor Kelth A.
Dennis, Daughter of Zion S.D.A. Church, Delray Beach, followed immediately
by the Pledge of Allegiance to the Flag led by Vice Mayor Betty Riscoe.
He requested everyone to please rise.

AGENDA APPROVAL
Mr. Cheney announced that he has several addltions if the Council would
like to consider them. One would be to take action on the Regional Sewer
Treatment Plant budget this evening which was acted on last Thursday n~ght
with Delray Beach. Under Announcements, he would like to make a comment
on the 55 acre recreational area. Under Administrative, he would llke to
have a discussion and consider authorizing Russell & Axon to proceed with
some additional work relative to E.P.A. applications for the force maln
and sewer work on Congress Avenue north of N. W. 2nd Avenue. Under Legal,
there is a resolution on the cemetery abandonment. Under Announcements,
he would like to make a comment about the program being sponsored by the
Planning & Zoning Board for public informatlon.
Roberts moved adoption of the agenda as corrected, seconded by Mrs.
Riscoe. Motion carried 5-0.
ANNOUNCEMENTS
Report on Chlorine Leak at Water Treatment Plant, October 10, 1979
Mr. Cheney referred to there being four areas which he should report on
briefly relative to the chlorine gas leak and stated most have been
talked about in the press and throughout the community, but he will
comment and answer any questions relative to the gas situation which took
place on October 10. There is the general area of protection of the
public, the question of repair of the particular problem, the question
of the cause and the prevention of any re-occurrence, and the information
provided to the media.
In regards to protection of the public, he's pleased to comment on
because he feels it went very well. The test of any emergency program
was well done in this case with having no preparation in advance. The
emergency services of not only Boyntor Beach, but Delray Beach, the
County Sherlff~s Department and the State Highway Patrol all fitted
together very efficlencly to bring about complete warning and protection

repair the problem. /By 7:45 A.M., it was thought to be safe to allow the
people to go back about their normal business. The leak was first observed
at 2:10 A.M. The entire operation was secured at 7:45 A.M. After the teak
was discovered at 2:10 A.M., evacuation began at aoproximately 4:15 A.M.
During that time, the area was observed. The Fire Department was on the
scene at 3:30 A.M. Attempts were made to close off the leak and at 4:15 A.M.,
it was felt it was time to evacuate. He thinks it was done withi~ the

Mrs. Riscoe continued that she listened to the different reports given and
accompanied Mr. Cheney to the hospital to see our three employees. From
what she has heard from the public and from what she saw, the ~emarks were
all a plus. Hats off to ali the employees involved!
Mr. Trauger made a motion to instruct the City Manager to prepare the
appropriate letters of thanks and appreciation to Delray Beach, Ocean
Ridge, Sheriff's Department, and all those who cooperated with the City
'n this event. Mrs. Riscoe seconded the motion. Under discussion, Mr.
Strnad referred to sending a letter of thanks to the people who were
r'ght next to this cylinder and shut i~ off and Mr. Trauger agreed and
included this as an amendment to his motiom with a copy of the letter
to go into the employee~' personnel files. Mrs. Riscoe agreed and the
motion carried 5-0.
Comment on 55 Acre Recreational Area
Mr. Cheney reported that he and the Recreation & Parks Director had the
opportunity to meet with the Board of County Commissioners two tim~ in the
past week. During those two sessions, ~n essence they voted unanimously
to support an immediate expenditure of approximately $2,000,000 in one
tump sum to develop the 55 acres on Congress Avenue as a County Park in
accord with the development concept instead of over a three year aeriod.
In return for that commitment, we will transfer the 55 acres back to
County ownership, which we nave talked about in the past.
Comment Re: Public Information Program
Mr. Cheney announced the Planning & Zoning Board's preparino a regular
public information session as paFt of their regular Board me'tings. This
has been suggested by Mr. Grabeel and Mr. Annunziato and the Planning &
Zoning Board has given wholehearted support. During the first half hour
period of each meeting, there will be a special presentation by an out-
side person in regards to the planning process. The first presentation
wll! be about the environment of South Florida. This is planned so the
citizens of Boynton Beach can continue to get an unoerstanding of what
planning is all about in the City as we go about implementing the compre-
hensive plan. He hopes the citizens will remember these meetings and will
feel free to attend and participate.

PUBLIC AUDIENCE
Mayor Harmening announced if anyone n the audience wishes to address the
Council on any subject not on the agenda, they may do so at this time.
In regards to any item on the agenda, they may give their name to the City
Clerk and they will be allowed to speak at the appropriate time.
Mr. Joe DeLong commended the City employees, plant personnel, City Manager,
Public Utilities Director, Police and Fire Department for their outstanding
performance during the emergency evacuation which occurred at 4:30 A.M. on
O~tober 10. He did not wl,tness any confusion on the part of our residents.
He told about other departments cooperating and expressed gratitude to them
for their assistance. This emergency caused many residents to realize we
are fortunate to reside ~n a City where consideration for our welfare
remains par excellence.
Mr. Calvin Shorter, 702 S.W. 8th Place, stated he would like to comment
regarding the Bass Creek Development next to Leisureville. Mayor Harmening
informed him this's on the agenda, but he may continue if he prefers to
speak at this time. Mr. Shorter stated he wanted to b~iefly call the
Council's attention to it at this time. He told about this development
digging out a lake, building a few houses and pouring some foundations
and advised that everything just came to an end. He referred to stagnant
water attracting mosquitoes and told about notifying the Health Department
about this and their response being to ~ut minnows in the lake to take
care of the situation. This is not only a heal.th probtem, but is a public
nuisance. He asks what can be done about this. Mayor Harmening explained
that most developments are required to have lakes for drainage. As far as
the mosquitoes, we can ask the City Manager to contact Mosquito Control and
ask them to direct their attention to this particular body of water. Mr.
Shorter informed him the County feels the minnows will take care of it.
Mr. Strnad agreed these would help and told about his experience with
oolliwogs eating mosquito larvae.
Mrs. Riscoe referred to Mr. Shorter talking to her about this and advised
that she has spoken to Mr. Cheney about this and Mr. Cheney has apprised
her that he is going further on this. The problem is this property gas
not been used or developed properly. We do have a performance bond on this
property and if they are not doing What they are supposed to, she does not
see why we cannot fill in the take because they dredged it out without a
permit to be~in with.
Mr. Cheney advised that about two to three weeks ago, he was in contact
with the County relative to mosquito control. They are spraying 'n all
areas of the City and will continue to do so. The fish in the pond will
help. Also, we 'nsoected this area today and a fair amount of vegetation
has begun to grow which has all6vlated some of the sand problems. The
office building and models are secure. We do not know at the moment the
status of the development. We will continue to watch the area. If the
mosquitoes become a problem, let him know and he will contact the County
for addltional spraying.

Rezone from C-1 to R-3
Mr. Clyde Wor¢ell, 915 Palm Trail, Delray Beach, informed the Council
this parcel is owned by Christian Development Corporation who Blah to
continue the development they are in the process of completing on Parcel
K au Congress Avenue and 19th Avenue just north of Golf Road. This pro-
perty was presented previously in requesting-the best land use would be
R-3 instead of C-1. The Council voted to change this on the land use map
at a prior meeting. The Planning & Zoning Board concurred and recommended
this rezoning. He requests the Council to approve this.
Mayor Harmening advised the Planning & Zoning Board unanimously recom-
mended this rezoning request be approved in order to provide for the
continuation of construction of the '~Cedarwood Villas Development.
The Planning & Zoning Board specifically noted consistency of this re-
quest with the Comprehensive Plan. He then asked if anyone in the audi-
ence wished to speak in favor of this rezoning.
Mr. doe Maezes, 2207 Roma Way, stated he's inclined to agree with Mr.
Worrell, but he thinks we should have more specifics on this particular
~arcel. The R-3 zone consists of more items than ~ost of us know about.
He thinks there should be specific heights or a statement they will con-
tinu~ with the present construction. Mayor Harmenlng informed him that
if this is rezoned from C-1 to R-3, we cannot limit the usages as spelled
out in the zoning code. The owner can build anything allowed in R-3.
There is no way during the rezoning process the Councli can limit the
usage other than what is specified in the code.
Mr. Maezes referred to apartments being allowed in R-3 similar to what
has been built on Woolbright Road and stated he thinks there should be
some specifics. Mr. Vance informed him that in the rezoning process,
a oarcel is rezoned to a particular zone. We cannot get into specifics.
When the site development plans are submitted, your concerns can be
reviewed then. Mr. Maezes asked if a site plan had been presente~ and
Mr. Vance replied negatively as it's not requi.red for rezonlng since
rezoning relates to the use of the land. Any zone permits more than one
use. We cannot provide a different zone for every conceivable use.
The actual limitation of the use of the land cannot be addressed in
the rezonlng process, but the City ~oes have various other procedures
when the land is developed which will get to these questions.

Mr. Maezes stated they understand the developer plans to continue the
same buildings as built on Congress Avenue and there's no opposition,
but there is suspicion it is being rezoned to ~e resold. Mayor Harmening
replied that it would probably be more valuable for resale as C-1 than
R-3.
Mr. Maezes asked if Mr. Worrel] would make the statement that they plan
to build the same as they are building on Congress Avenue and Mayor
Harmening replied that we can ask him tol but in reality, it has no
validity. He can understand the residents' concern, but it cannot be
addressed in the zoning process. Under site plan review, it can be
addressed.
Mr. Ken Koos, lll South Atlantic Drive West, referred to the name
being the Christian Development Corporation and asked if this property
was going to be non-taxable and Mr. Worrell replied they will be fee
simple sales and Mayor Harmening added that it will be on the tax
rolls. Mr~ Koos then questioned the difference between C-1 and R-3
and Mayor Harmenlng summarized that C-1 is the highest grade of commer-
cial ~roperty and R-3 is the lowest 'n residentlal districts.
Mayor Harmening ascertained there were no further comments from the
audience and opened the discussion to the members of the Council.
Mr. Roberts referred to the appllcation form stating the use after rezon-
lng would be: "Continuation of ;onstruction of multi-family dwellings
simiia- to existing units on Parcel K" and asked if this meant single
homes? Mr. Worrell explained they would be single family residences with
zero lot llne. Mr. Roberts questioned the number of units per acre and
Mr. Worrell replied: 10.8. Mr. Roberts asked if they planned to continue
the same type of building and Mr. Worrell replied affirmatively. Mr.
Roberts referred to R-2 not allowing enough units per acre and Mr.
Worrell agreed.
Mr. Roberts referred to the concern of the people and stated ne thinks
possibly the Council can control the type of development if it is not
compatible with the type of buildings. He can understand the residents
being in opposition to three or four stories, but the statements ~ade by
Mr. Worrell preclude that possibillty and Mr. Worrell agreed. Mr.
Roberts commented there is nothing to prevent the~ from changing their
minds, but he doesn't see how the City Council or Planning & Zoning Board
would approve it since it is not compatible to the area. Mayor Harmening
added that we do have certain stipulations in site plan approval and it
states adjacent development shall be compatible with adjacent usages.
Mr. Worrell stated this is Phase of the Cedarwood Villas project.
They did not apply for approval for the second parcel because rezoning
was required. They have obtained engineering approval for both parcels.
They have all the necessary materials to build both parcels and otan to
continue the present concept.

Mr. Trauger made a motion that the City Council approve this rezoning
request for rezoning from C-1 to R-3 for Mr. Clyde Worrell, Applicant
for Chrlstian Development Corporation, at the northeast corner of S.W.
19th Avenue and Congress Avenue, Parcel E of 10th Section, Palm Beach
Lelsureviile. Mr. Roberts seconded the motion. No discussion. As
requested, Mrs. Padgett took a roll call vote on the motion as follows:

PUBLIC AUDIENCE (Continued)
Mrs. Dee Zibelll, Spokeswoman for the North Boynton Civic Improvement
Association, thanked the City Council and City Manager for putting their
organizatio~ on the agenda so quickly. She referred to the attendance
of the audience having increased and received a resgonse from the people
when she asked if they had seen any difference in the appearance in North
Boynton.
Mrs. Zibelli referred to a park at Rolling Green School and introduced
the Principal, Dr. Camille Dorman. Dr. Dorma~ referred to the Nortk
Boynton Civic Improvement Association establishing a need for a play-
ground and park area and stated since 1975, the Rolling Green site has
been designated as a park. There are approximately 7½ acres of playground
on the site. The area was fenced last year with gates. The City and
School Plant Planning prepared drawings several years ago for improve-
ments to the site and both agreed. These plans are still available.
Even though very little has been done on this ~articular project, the
school is very interested in seeing this project renewed and having the
site developed. She pledges her full cooperation and offers her assis-
tance 'n any Dosslble way in helping to update these plans and will act
as a liaison between the City Council and school center and School Board
for any addltional planning. The community's children and adults need a
place near their homes for recreational actlvJtles. She hopes another
look can be taken at these plans and hel'D provided for this community.
Mayor Harmening stated since the City entered into the Community
School Agreement with the S'chooi Board ir 1973, which included this
school and Congress Middle School, the City has expended money towards
activities. We receive a re~ort from Mr. Brinker every month on the
activities. Since the City Council has taken the posture to aid the
School Board insofar as funds from developers, perhaps we can see if
they would be willing to reciprocate to spend some of their money to
upgrade their school.

Mr. Cheney added that we have encumbered $4,089 for development at this
school and have applied for $4,000 additional money from the County. He
is confident the $4,000 has been approved and is confident we will have
$8,000 tota~l to proceed with the development of some ball f~elds,
bleachers, etc. at this school. The Recreation Director would llke to
meet with the principal and others in the school plannlng process to get
concurrment.
Dr. Dorman stated the Board still maintains the agreement with the City
and community school effort. She sees no reason why they would not work
with this project. She did speak to Mr. Brlnker and he is very much
intarested to see something developed. Mr. McDonald, the South Area
Superintendent, is also in agreement. Mayor Harmening asked her to
remind Mr. McDonald that Boynton Beach does require the developers to
pay .4 of 1% for schools.
Mrs. Zibelii added that this is definitely needed in this area. If the
City can pay $183,000 for improvements to Wilson Pool, she certainly
feels something should be done in this area.
Mr. Henry Clark, 400 Ocean Parkway, referred to coaching a small fry
football team and told about not hawing an area in North Boynton to
practice but muse transport his 20 boys to Lake Worth.
Mrs. Zibelli added that Dr. Dorman has also ~roposed to have home [marove-
merit courses at the school for the people of North Boynton. She hopes
the City Counci) will cooperate with Dr. Dorman. f the budget does not
allow for Dark 'mDrovements, she is sure Mr. Frederick knows of block
grants or federal revenue money avai)able. Mayor Harmenlng replied
that there is very little available for parks and Mrs. Zibelli com-
mented that all she hears about is parks and nothing's coming their
way.
Mrs. Z)belli then referred to the drainage and sewage 'n this area and
showed oictures of the area with water at high level. Mrs. Marguerite
Morency, 2721N. E. 4th Street, told about the holding tanks filling up
along her street with the result being to have overflows 'n their back
yards or bathrooms. She told about calling the City and getting re-
sponse promptly and the problem is corrected temporarily but reoccurs
often. Mayor Harmening replied that he was not aware of this problem
and requested Mr. Cessna to explain. Mr. Cessna referred to this being
in the area of the old Field & Riley development and told about roots
getting into the lines ano plugging them and added there are more pro-
blems to be solved. Mayor Harmening requested him to get these prob)ems
alleviated shortly.
Mr. Joe DeLong stated it is'very encouraging to see these people taking
this interest in this neighborhood. This neighborhood, for the past few
years, has been a shambles. The City should ~mp in there and do their Dart.

Mr. DeLong continued that he made recommendatlons when he was sitting on
the City Council to beautify the median strips in this area with sprinkler
systems, sodding and.maintenance. Mayor Harmening added that about ten
years ago, Ocean Parkway was well maintained. Mrs. Zibelli added that the
sprinkler systems are still in the medians. Mr. DeLong stated that the
City is working in other areas and why is this particular neighborhood
neglected?
Mrs. Michelle Cost. itioo, 155 Flamingo Drive, showed pictures of the
drainage and told how no matter how little or how much rain, there is
always floodlng in this area. The drains in the pictures are overgrown
and fl]le~:~wlth trash. There are no drairs at the ~ntersections along
Seacrest Blvd. This causes the washing away of driveways, mosquito infes-
tatior, cars stalling, etc. She brought this to the attention of the City
Engineer, but his response was that he will see what he can do. Mayor
Harmenlng stated in 1970 or 1971, the people voted against spending money
for storm sewers. There's no way the City can afford to go in this area
and alleviate the majority of the flooding conditions or in any other area.
He explained there may be a few exceptions where it could be relatively
cheaply solved with diverting the flow of water. There are many places
in the City where flooding is a problem. There is no simple solutl, on for
this oroblem and it exists 'n most ~unicipalities in South Florida.
Mrs. Zibel]i referred to the trash and' garbage and asked if there ~s an
ordinance saying you cannot put out things llke a televls[o~, couches,
chalks, etc. until the day before pickuo and Mr. Cheney replied that he
doesn't know if there is, but there should be. He agrees the trash oro-
gram is a big problem ir this area and he told about people outting
things out the day after the collection, so the area looks terrible all
the time. People appear to put both yard trash and garbage out together.
Household garbage should be put into cans or bags to be picked up twice
a week. The trash's picked up by a mechanized method and if ;eople
would rake t~e swale areas after pickup, it would qelp. The procedure
is being studied. Mrs. Zibelli suggested it might be a good idea to have
such an ordinance and if people get c. ited once or twice, then they won't
out it out ahea~ of time.
Mayor Harmening commended Mrs. Zlbelll or the excellent job she has done
organizing this area and again explained how drainage has been a constant
Droblem. Mrs. Zlbe]ll stated she cannot see why anybody would not pay a
few more tax dollars per year to have thelr streets passable. Mayor
Harmening informed her that he did not have the exact figure now, but he
thinks it would cost in excess of $30,000,000 to storm drain the City.
Even at low interest rates, it would be a tremendous amount of money.
Mrs. Brenda Kelson, 2870 N. E. 4th Street, referred to the North Boynton
area being an eyesore with trash piled around. She told about being con-
cerned and suggest the people be monitored who throw trash out ahead of
time. She told about junk cars being parked and beer cans being piled up.

Mayor Ha rmening referred to being under a handicap and explained how such
violations had to be processed through the County courts. He then told
about the recent law enacted allowing the mun'c'palities in Palm Beach
County to appoint their own Code Enforcement Boards. Thls Council recog-
nized this need and appointed this Board at the last meeting. The Codes
Enforcement Board will act as judge and ~ury and if there is a violation,
they can fine the people. He explained how in the past fines were usually
levied as li&ns against the 3roperty and were not collected until the pro-
perty was sold. He suggests that the Code Enforcement Board not only levy
a lien against a guilty party, but direct the City Attorney to foreclose
the lien on the property immediately. We wl]l get some action now, but
our hands have been tied in this area for three years.
Mrs. Kelson continued with telling about the trash problem in her neigh-
borhood as well as a migrant bus being uarked there. Mayor Harmening
told about the City issuing citations and Mr. Cheney added that about 80
are pending out of about 480 written citations. The City does care.
The citizens in the area are finally coming forth and he thinks that will
have a tremendous impact on the neighbors,.
Mr. Andrew "Jaekle" Bolden stated as a representative of the Communlty
Relations Board, at this time he would like to invite Mrs. Zlbelli to
attend their Board meetings held every second Wednesday. He feels she
can give input to needed improvements for that area.
Mr. Bolden then stated that he was also sDeaklng as a concerned citizen
of Boynton Beach. He feels it is time for the Council to stop bickering
and respect and adhere to some of the demands of the taxpayers of north-
east and northwest Boynton which have been presented over the years. He
then explained how the bridge on North Seacrest Blvd. was a main route
for the area with there being no alternate routes and the railroad cross-
ing causing delay possibly for access by emergency vehicles. The construc-
tion workers are not doing any construction at the bridge location. He
deems it necessary to re-open the bridge until the WOrK iS actually being
done. He stressed that this was necessary for the health and safety of
the residents. The bridge is vital to this area which is continually
neglected. Also, because of this, the bus route is bypassing completely

Mr. Trauger moved to accept the bid of 518,300 from John Niebel as stated
on the proposal submitted by the City Manager subject to a H.U.D. waiver
of the Bacon-Davis Act and also include the electrical work. Mrs. Riscoe
seconded the motion. Mayor Harmening clarified that it has been moved and
seconded to tentatively award the contract to John Niebel i.n the amount of

we chose will withstand any type of vandalism. Mr. Strnad clarified that

Wilson Park Ball Field Fencing
Mr. Cheney referred to one bld being received for this project and recom-
mended the acceptance of this bid from Bulldog Fence Company 'n the amount
of $4,541.10. He advised other fence companies were contacted and we
questioned why they did not bid. Frank English Fence Company is dissolving
the business, Bill Overton Fence Company does not do field work, and
Southern Fence Company has too many commitments at this time. We did
contact Frank English regarding this bid and ne stated the price sub-
mitted was in a very reasonable range. There is a great desire to get
this fence built and the alternate bid's recommended.
Mrs. Riscoe moved to award this bid as recommended, seconded by Mr. Strnad.
Under discussion, Mr. Strnad stated that it is bls understanding that
galvanize will outlast aluminum and questioned why we are going to alumi-
num? Mr. Flushing replied that it was his understanding that aiumlnum

Mr. Trauger referred to most of the people from the north end having
left and pointed out in the last three motions, we have voted to spend

Water Treatment Plant Modification
Mr. Cheney informed the Councll that bids were opened last Friday and he

"On October 12, 1979, at 11:00 A.M., pursuant to the published legal
advertisement, bids on the subject Raw Water Influent Piping at the Water
Treatment Plant were received in the office of the City Purchasing Agent.
There were three plan holders and bids were received from three contrac-
tors. Attached is a summary of the bids as verified by this office. You
will recall that approval for thls project was given by Council action on
July 17, 1979, followlng w~itten requests for this project by Mr. Colgin
and Mr. Law. Briefly this project reroutes the flow of incoming raw
water to permit the removal of the 17 year old aerators which are not
needed using the present treatment ~rocess. and should result in an
increase of raw water flow from the well fields. At that time, the esti-
mated construction cost of the work was quoted at $35,000. We hereby
recommend award of the contract to the low bidder, Webb General Contract-
ing, Inc., 30 S. W. Fifth Court, Pompano Beach, Florida, in the amount of
$28,678 with completion by November 30, 1979. There were no alternates
to the bid, and only Utility General funds are involved."
Mayor Harmening commented that this is considerably lower than the ori-
ginal estimate.

not possible, they would like to have this plan approved with the two
drives onto Woolbrlght Road.

Mr. Grover C. Herring, representing Hy-Lib, Inc., came before the Council
and stated the City Planner has submitted agenda material which he's
familiar with. He will be happy to answer any questions.
Mr. Trauger stated when thi.s came before the Planning & Zoning Board
several years ago, there was a short section of the street which appeared
to be missing on the larger plat. Mr. Cheney stated this review pertains
to Plat 1 and three sections have been under discussion. Mr. Vance
clarified that eventually there will be three separate phases of this
particular subdivlsion and the area to which Councilman Trauger is referr-
ing is probably in Phase II or I I, which is not before the Council at
this point.
Mr. Cheney informed the Council that two issues were not settled by the
Planning & Zoning Board. One was the recommendation regarding the school
impact fee and the other was a recommendation for the City Council to
grant a waiver for the width of the roads to be 50' instead of 60'. If
the applicant agrees to the school impact fee, which is required of
everyone, and the Council grants a waiver for 50' roads, this probably
takes care of all concerns. Mr. Herr'ng stated that his client is ~re-
pared to llve with the recommendations and the fee as required by the
School Board. Mr. Vance clarified that his client's agreeable with the
requests for the preliminary plat approvat to pay the road impact fee,
pay the School Board .4 of 1% of the sales price, and the other staff
recommendations and Mr. Herring replied affirmatively. Mr. Vance clari-
fied that they will comply and Mr. Herr'ng re~lied affirmatively, assum-
ing the approval 's on this basis. Mr. Vance added that there will also
be a variance involved at the final plat time which the Council should
think about.
Mr. Roberts referred to the road width and asked if it was based on
continuing a road and Mayor Harmening informed him that it is a com-
pletely new road. Mr. Roberts questioned why it was cut down to 50'
and Mr. Grabeel replied that in the original approval, 50' was required
and to change to 60' would require the redesign of the entire phase.
Mr. Vance added that the applicant has agreed in Phases II and Ill to
install curbs assuming Phase I is approved. Mr. Roberts asked if side-
walks are included and Mayor Harmening replied affirmatively as they
are required by ordinance.
Mr. Roberts asked if the two entrances shown would handle all the traffic
and Mr. Grabeel replied this was approved by the Technical Review Board.
Mr. Vance clarified there would only be one entrance to Phase I.

Mr. William B. Kement, 1216 N.W. 8th Court, stated he is the owner of
the piece of property adjoining this property in Phases II and Ill.
The last time, he was left out in the woods. They never considered
N. W. 9th Street wh"ich is a dedicated street. The plans show the houses
with the backs to this street. It makes the street a back alley. The
Planning & Zoning Board was 'n sympathy with hlm Dreviously, but the
plans had ~roceeded too far. He is very glad ~he develooer did not post
bond and now has to abide by the new regulations. The new regulations
require the developer to consider the surrounding and dedicated streets.
He hopes the Council will be well aware of this when Phases II and Ill
come up. Also, he explained there are no utili, tles installed, so this
installation should be done properly,
Mr. Harold Werger, 719 N. W. 7th Court, told about when this development
was originally approved with only two access roads for 193 homes. He
thinks the Council should address the question of a third access road at
this time, as with the switching of two lots this can be accomollshed.
He explained how the present access would create excessive traffic
going through Laurel Hills past two City ~arks where children play.
This was brought to the developer's attention previously by Mr. Kohl
and his response was that it would cost thousands of dollars to make
the change for an additional access road; however, now there is no Plan.
The people of Laurel Hil~s want to go on record now that when Phases Il
and Illare built, a third access road should be included which is vital
to the welfare of Lauret Hills.
Mayor Harmening asked if Mr. Herring was familiar with ~hls and Mr.
Nerring replied affirmatively and advised that it will be addressed
at the tlme of Phases II and Ill. Mr. Trauger suggested that the
Planning & Zoning Board members be vigilant for this street when these
ptans come through. Mayor Harmening added that he thinks the City
Council will be sympathetic to this request when Phases II and Ill are
considered.
Mr. Strnad moved to accept the recommendation of the Planning & Zoning
Board to approve this preliminary plat for the Sky Lake Subdivision
subject to staff approval and recommendations, seconded by Mr. Trauger.

Mayor Harmenlng referred to a letter being distributed fror Mr. Vance

renovate or replace this structure if they so desire.
Mayor Harmening suggested proceeding with this,so construction can be
ready to proceed right after election.
Mr. Trauger referred to having an alternate site on the land to the
north but added that he doesn't believe we should hold up development
of the clubhouse waiting for that land to be developed. Mayor Harmening
agreed that possibly it could be located on that ground. Ne suggests we
authorize the City Manager to proceed with the plans and biddlng, then
if the other parcel shows a great deal of progress 'n the next six weeks
it might be possible to shift the location at that time if it is felt it
would be more advantageous.
Mr. Cheney referred to the bld for demolition and Mayor Harmening sugI
gested this be held in abeyance until after election. Mrs. Padgett
advised this polling place could be moved to the boat club. Mr. Cheney
commented there might be a time limlt on the demoiltion bid. Also, he

cost effective and accommodate the handicapped. Mrs. Riscoe referred to
possibly installing ceiling fans and Mayor Harmening replied the building
has always been reasonably cool since it has a number of windows and is 'n
an unobstructed location. Comments were made further regarding fans and
air conditi~onlng and Mayor Harmenlng suggested this be given further
thought for a final decision at the next meeting. Mayor Harmenlng referred
to the posslbility of having the students at the Vo-Tech School build this
clubhouse and requested Mr. Cheney to check ~nto that possibility.

Drainage Proposal
Mayor Narmening referred to a memo and arints being submitted from Mr.
Clark and stated the bid is open, so whomever bids may submit some alter-
natives. Mr. Cheney passed out additional technical speciflcatlans to be
included wlth the b~d documents.
Mavor Harmenlng questloned the proposed elevation of the intake on this
and Mr. Clark replied that it is about 13'. Ne explained the pump will
operate continuously until the level drops below 13½'. Mr. Trauger
questioned whether this was needed new and Mr. Clark replied that in
his opinion, the pump may not actually get ~ chance to perform its ser-
vice for many years and possibly periodically we will have to Put water
in that well to be sure everything is working all right. Discussion
ensued regarding the operation.
Mr. Strnad moved to have the City Manager oroceed with the bids for the
pump and plpe being installed to 1-95 based on the plans and speciflca-
tions submitted, seconded by Mr. Trauger. No dlscusslon. Motion carried

Conslderat~on of Flap Valve
Mayor Harmening explained that when the water in the sump reaches a
certain levet, the water flowing down the system surcharges the system
on 4th Avenue or goes the other direction. The estimated price for
this is approximately ~400. Mr. Clark clarified that $194 is for the
flap valve wlth adapters for installation and labor totalling about $400.
Mr. Strnad questioned why the cost was higher than what Mr. Riley esti-
mated and Mr. Riley advised that he was quoted by the Engineering Depart-
ment that it would 6e less than S100. He will still donate SlO0 towards
the cost.

Mr. Cheney informed the Council the Codes Enforcement Board had an organl-
zational meeting and selected a Chairman, Mr. George Davis. Mr. Vance nas
~roceeded with preparing some documents regarding ~rocedure, etc.
Report on Bike Paths
Mr. Cheney referred to funding for the ~ending bike paths and advised it
is bls understanding that County funded projects will be on the agenda for
November 15. He doesn't see any problems.
Mr. Cheney then referred to the signs necessary and explained that a street
to street survey would have to be taken and about 300 signs will ~robably
be needed. He would like to identify all the signs we need and see if we
can buy them all built instead of making ourselves. Mayor Harmening sug-
gested DOsslbly checking with the County sign shop.
NEW BUSINESS
Consideration of Regional Sewer Treatment Plant Budget
Mr. Cheney referred to the Council as members of the Board approving the
budget for the coming year for the Regional Sewer Treatment Plant at a
meeting ~ast week and suggested this approval be confirmed. Mayor
Harmening asked if the Delray Beach C~ty Council had ratified this
action and Mr. Cheney replied that he did not <now.
Mr. Roberts referred to there being two parts to the budget, one for the
Board and one for the plant and stated he finds no problems with the Board
budget. After discussion of the various amounts, Mr. Trauger moved to
accept the budget for the South Centrei Regional Wastewater Treatment &
Disposal Board as presented on their statement for the Board budget with
a sub-total of $29,070, outfal] payments of $31,720, engineering and
contingency of $52,010. Mrs. ~iscoe seconded the motion. After discus-
sion clarifying the amounts, the motion carried 5-0.

Consideration of Regional Sewer Treatment Plant Budget (Continued)
Mr. Cheney corrected the total of this budget to $649,300 for totat
expenditures. He explained the $39,000 should be $39,300 and this was
not added into the $610,000. He assumes the motions made will cover
this as corrected. Mr. Vance referred to the amount of money and sug-
gested a motion be made to reconsider. After discussion, Mr. Roberts
moved to reconsider our action on the approval of the Board budget,
seconded by Mrs. Riscoe. Motion carried 5-0.

Mr. Cheney referred to submitting the report and stated in his memo, he
suggested that it might make sense to establish a workshop at the pool
with the engineer to discuss the report and recommendations. Mayor
Harmening suggested that a representative from our Engineering Department
and Building Department meet with the engineer. Mr. Cheney replied that
he thinks it would be helpful if the Council is there also and Mayor
Narmening replied if it is scheduled in the evening, he will attend.
Mr. Cheney stated that he will try to schedule one within the next few
weeks.
Mr. Trauger moved to table the Wilson Municipal Pool study, seconded by
Mrs. Riscoe. Motion carried 5-0.
City Manager's Attendance at I.C.M.A.
Mr. Cheney announced that he will be away next week at the City Managers'

Mr. Cheney advised that in researching No. 16, he found at one time, the
C~ty Council did in the minutes agree to a payment of $23,622 and at that
time, there was a memo submitted relative to an additional $3,058. There
is an extra 139 feet of 16" pipe at $22 per ft. He does not <now what
the 139 feet is for. It may be the Council may want to approve this ite~
in the amount of only $23,622 until we can confirm the additional $3,000.
Mr. Swan informed them this 139 feet was not needed in connection with
Cranbrook Lake Estates, but was needed to get across Golf Road and go
northward. The Woolbright Plaza will 0ick it UD from that point.
Mrs. Riscoe moved to pay our bills, seconded by Mr. Trauger. No discus-
sion. Motion carried 5-0.
Consider Authorizing Russell & Axon to Proceed with Some Addltional Work
Relative to E.P.A. Applications for the Force Main and Sewer Work on
Congress Avenue North of N. W. 2nd Avenue
Mr. Cheney read a letter from Russell & Axon co~;erning the f~ling of
aDalicatlons with D.E.R. and E.P.A. for funding wastewater projects.
He explalned the target date in submitting the two applications is December
1, 1979. He showed the application required and clarified that the re-
quest is to approve three separate forms for this work at a cost of $4,000
for each application. Mr. Swan added that the $4,000 was figurec on a
cost basis and there will be a savings if possible. With preparing three
at one time, a savings may be possible. If approved, they will be back on
November 6 with three different resolutions. Resolutions must be passed
saying the City wants this grant.
Mr. Strnad moved to authorize the signing of three separate authorizations
as define0 in the letter for a cost of $4,000 each. Mr. Trauger seconded
the motion. Mayor Harmening clarified that it has been moved and seconded
to authorize Russell & Axon to pre;are three studies with the outside cost
not exceeding $4,0OO each. No discussion. Motion carried 5-0.
