Venue, City Attorney Mayor Harmening welcomed everyone end called the meeting to order at 7:30 P.M. ~e announced the Invocation tonight ~ill be by Rev. Ben Tidwell, Westside Baptist Chapel~ followed by the Pledge of Allegiance to the Flag led by Councilman Norman Strnad. He re- quested everyone to please rise. AGENDA APPROVAL Mayor Harmening requested the addition under Announcements of NO. 3 - South Central Regional Wastewater Treatment & Disposal Board Meeting and No. 4 - Presentation of the Elag by the Boynton/Lantana V.F.W. Post S335. Mr. Chancy suggested eliminating Item G under Administrative at the request of the Committee. Mr. Vance referred To Legal, Item A-i, and requested this to be tabled since we have not received the proper resolution from the County Commission agree- ing to the rezoning of this property. Mr. Roberts moved the adoption of the agenda as corrected, seconded by Mr. Trauger. Motion ~arried 4-0. ANNOUNCEMENTS Mayor Harmening announced the Fourth of July Festivities,=sponsored by the Chamber of Commerce and the City of Boynton Beach~ will be held at the Boat Ramp Park on North Federal Highway at 2 P. M. with the fireworks display at sunset. Mayor Harmening announced that City Hall will be closed on Wednesday, July 4th~ in observance of Independence Day. Mayor Harmening announced the South Central Regional Wastewater Treatment & Disposal Board will hold a Special Meeting on Thursday, June 21, at 7:00 P. M. a~ Delray Beach City Hall. The members of the BoyntonZLantana V.F.W. Post $335 marched forward and presented a flag to Mayor Harmenin% to be flown at the cemetezy every day. MINUTES Reyulam City Council Meeting - June 5, 1979 Mrs. Padgetr read the following correction left by Vice Mayor Betty Riseoe to be read into the reeo~: MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA gUNE 19, 1979 "I will be unable to be present at the Reomlar Meeting of June 19th due to scheduled surgery. However, I would appreciate the following statement be read into the record. On Page 16 of the June 5th minutes, on the motion as it pertained to Riscoe vs. City of Boynton Beach, the last line of the 4th paragraph should read: Motion carried by a majority of 3 votes with Councilman Walter Trauger abstaining. Mrs. Riscoe had stepped down from the dias at the beginning of this discussion as she stated she considered it a conflict of interest. Therefore, she was not present during the voting on this issue. The motion on this issue presently reads: Motion carried 3-2 with Mr. Trauger and Mrs. Riscoe abstaining? Mavor Harmening referred ro Page 16, first paragraph, and requested the desires of the ~'expressions" to be changed to desires of the "people". Mr. Strnad moved the adoption of the minutes of June 5 with the correetions as noted, seconded by Mr. Roberts. No diseussion. Motion carried 4-0. PUBLIC AUDIENCE Mayor Harmening announced that anyone who cares to address the Council on ~ny subject not on the agenda may do so at this time. He announced we do have with us tonight Honorable James L. Watt, Florida State Representative~ to tell us about some of the bills passed by the Legislature directly affecting municipalities. Representative Jmmes L. Watt came before the Council and advised the primary purpose for him coming tonight is in regards to a bill he introduced which provides an option in Palm Beach Couqty to the cities to establish a Code Enforcement Board. He explained this Board 2ould be established as an alternative to going to County Court to enforce local ordinances such as the fire code, building mode, sign code, etc. with the exception of traffic vio- lations. He referred to the problems encountered enforcing these type of ordinances through the County Courts and told about Palm Beach County hav~n~ a Code Enforcement Board for a couple years whieh has worked very well. The bill has an effective date of October 1 and he suggests if we are inclined to exercise this option, there is the time to set up the ordinance and make the appointments. The act provides for a five member Board consisting oi an architect, businessman~ engineer, general contractor and real- tor whenever possible, since these professions should understand the problems. He explained the procedure to be followed would be for the inspecEors to continue to inspect for violations, issue notices to make corrections and if not done, a hearing is sche- duled before the Board. The Board can levy up to a $500 fine and -2- MI~TES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JUNE 19, 1979 if the property owner does not eomply, a lien ean be filed against the property. He referred to the County having favorable experi- ence with this act and hopefully if this works as well for the cities, quite possibly it can be suggested next year that this be made statewide. He requests the Council to give this careful con- sideration and the Municipal League will be sending out a model ordinance which may help to have uniformity throughoo~t the County. Mr. Watt referred to the prevailing wage law having been repealed and referred to the cities and counties having spent millions of dollars to comply with this and explained the effect now should be having the savings passed onto the taxpayers or more loeal projects being initiated creating more jobs. Mr. Watt referred to the double tax situation and explained that the statute was amended to provide that all county revenue shall be spent to be beneficial to all residents of the county. Mr. Watt advised that the Financial Emergencies Bill for local Government has been passed and rexplained how this would probably resnlt in good preventative type legislation. Mr. Watt informed the Council that the tax relief package was adopted on the last day of the extended session end stated the por- tion concerning him was the S% ceiling of revenue on local govern- ment. He referred to it stating that no city can generate more than S% than it did the previous year from ad valorum taxes with some minor exceptions and stated he argued against this and tried to amend it to at least 7%. He felt the S% was wrong and somewhat contradictory since the State's budget has increased 10% this year and 11% next year and he did not feel it was right to limit the local goverDment to ~%. Mayor Harmening informed him that we certainly approve of the Code Enforcement Bill as we have had many problems and our resolution of them has been slow and we even appointed a special prosecutor. Mr. Watt a~Freed that most cities are dissatisfied with the ~ounty court systems, but there doesn't seem to be any sentiment in the Legislature to put this question back on the ballot, but they have attempted to bring some of the jurisdiction back to the local gov- ernment with this bill. Mayor Harmening thanked him for attending and bringing us up to date on some of the bills passed by the Leg- islature directly affecting the cities. Mrs. L~ri Glauner, 106 Arthur Court, apologized to the Council for having to bring her personal problems before them again and stated that 2~ years ago~ she came before the Council and submitted the court records proving that she has legal right to the Two Georges property. She has been trying to make improvements to the restau- rant while her ex-husband has been trying to have it bulldozed down. -3- MINUTES - REGULAR 2ITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JUNE 19, 1979 Mrs. Glauner continued with telling about the Building Department allowing 1/3 of her building to be bulldozed down before she went to the 2ity and courts to have it stopped. Now, she has received a letter from the Building Department stat~dg she has to tear down the Two Georges Restaurant by July 13, which is not going to happe~. The Building Department was aware of the court order, but still is- sued a permit ro George Culver to build a fish marker. She read a portion of the court order and stated if the City starts tearin~ her building down, there is going to be a fight. Mr. Tanzy referred'to the courv order and advised the City was promised by the trustees that the entire building would be re- modelled within a two year period. Mrs. Glaun~r informed him when they made this promise, they did not have the authority. The three trustees have been removed since they have s~l!en $240,000 from her children. According to the court order, she has control of this building and when trying to comply with the Fire Department's requirements, the Building Department will not issue a permit. Mr. Tanzy advised that they are workinff to find a resolution to this matter. Mayor Harmening asked if Mr. Cheney was aware of this situation and Mr. Cheney replied that he is aware minimally of the existing problem and will work with the City Attorney and if appropriate, he will give a report. He gathers we are working towards a con- clusion. Mayor Harmening concluded that the City does not want to harm either parry and can understand the different departments having rules and regulations, but it is hard To make a determina- tion with just a little background information. Mr. Bill Cwynar~ 706 S.W. 27th Way, advised under Announcements~ one thing was forgotten. The City donates money for the 4th of July festivities and the Chamber of Commerce sponsors it, but the Jayeees set 6fl the fireworks. Mr. Cwynar then referred to the last Council meeting when a bid was presented in regards to the City's towing service and stated a few questions came to his mind after reading the newspapers the next day. it was reported that Boynton Wrecker Service made a contribution to Mr. Trauger and when he asked Mr. Trauger after the meeting why he voted in favor of a towing service where the citizens will have to pay $9.00 more for a t~, his reply was that he knows one of the owners and buys all his gas from him. He referred to Item 15 in the bid request stating the wrecker service could not provide body work or mechanical services, but Boynton Wrecker Service does and he read the statement on their invoice confirming this. This is in conflict with the specifica- tions. According to the minutes, Mrs. Riscoe made a motion to accept the Zuccala Wrecker Service, seconded by Mr. Strnad and the vote is reported to be 3-2. Then~ Mr. Roberts made a motion to award the contract to Boynton Wrecker Service~ seconded by Mr. Trauger and the same vote of ~-2 is reported. He questions these votes of 3-2. MINUTES - REGULAR CITY CQUNCIL MEETING BOYNTON BEACH, FLORIDA JUNE 19, 1979 Mr. Cwynar referred to three bidders originally submitt~bids and explained that one withdrew to remain a part of Boynton Wrecker Service and the other submitted his bid right before the bid open- ing after withdrawing from Boynton ~recker Service. Also, wasn't the reason for putting the towing service up to bid to do away with rotation and if that is the case, don~t we still have rotation ser- vice with BoMyton Wreeker Service? Also, Boynton Wrecker Service does not have a single wrecker in its name. Mr. Bob Riley, 542 S. W. 4th Avenue, presented a petition on behalff o£ 50 homeowners in Mango Heights and Forest Park requesting a con- struction moratorium to be placed in effect in this area until the drai~e is corrected, sidewalks installed, clearance and maintenance of vacant properties is done, and thoroughfares marked with a double no passing line centered on the roadway. BIDS ~our Inch (4") Water Main - N. E. llth Avenue Mr. Cheney infommed the Council we received only one bid for this 1,580' of construction in the amount of $35,837.90. He knows of the concern about receiving only one bid and inquired to see if this bid is in line and why other bidders did not bid. The answer is the amount whiah is about $22.00 per foot is in line of what we would expect based on other projects. Secondly, this is a rather smell job and the contractors are busy. Small ~obs don't appeal to major contractors. He understands this is a small contractor who we are satisfied will do a good job and we will inspect the work. It is recommended this bid be granted by the Council. Mr. Roberts moved uo accept the bid from E. N. Murray, Inc. for $35~837.90 for this particular project, 4'~ water main on N. E. llth Avenue. Mr. Trauger seconded the motion. Under discussion, Mavor Harmening questioned how many feet there would be altogether and Mr. Cheney replied 1,580 feet. Motion carried 4-0. One (1) Underground Storage Tank (for Diesel Fuel) - General Services Department Mr. Cheney informed the Council that bids were opened on June 12 and two bids were received~ both from acceptable contractors. The ~ow bid was for $8~000 with 60 day installation and the other bid was for $9,275 with 45 day'installation. It is recommended the bid be awarded to Glasgow Equipment Service of West Palm Beach in the amount of $8,000 for this underground storage tank for diesel fuel. Mr. Trauger moved to accept the bid for the underground storage tank in the amount of $8,000 from Glasgow Equipment Service, seconded by Mr. Roberts. No discussion. Motion earried 4-0. MINUTES - REGHLLR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JUNE 19, 1979 PUBLIC HE~_~ING NONE SITE DEVELOPMENT PLKNS Applicant: Location: Legal Description: Project Description: Project Name: Perrin Mifsud, Inc. (Bob Mifsud, Agent) N. E. 7th Streets East of N. E. 7th Avenue Lots 18, 19, 20~ 21, Block 7, Lake Addition 8 Townhouses and 1 Apartment Pier 77 Mr. Robert Mifsud, 5000 N. W. 5th Terrane, Pompano Beach, came before the Council. Mr. Roberts referred To this being zoned R-5 and Mr. Annunziato agreed, Mr. Roberts referred to the heightoof the building being 43~6~T and asked if they would all be that high and Mr. Annunziato replied there are ~wo separaEe buildings and explained how one building varies from four stories on the south side to three stories on the north side. There is an additional three story building just west of the southernmost building with parking underneath. He has noted in his comments that a height exception of 2T would be required to be granted for a fire wall. This was also reviewed by the Health Department and D.E.R. and the applicant was mandated To preserve the mangroves to the easT. The land is proposed to be filled to approximately 4~' on the west and this is the basis for the request for the height exception. Mr. Roberts referred to the density and asked if there was any conflict and Mr. Annunziato informed him this is consistent with the Comprehensive Plan and the density is consistent with zoning. Mr. Trauger asked if all the exceptions noted on the drawing are acceptable to the applicant and Mr. Mifsud replied affirmatively. Mr. Vance questioned his capacity and Mr. Mifsud informed him that he is the president of the development corporation. Mr. Trauger made a motion To approve this site plan for Perrin Mifsud: Inc. on Lots 18~2i~ Blook 7, Lake Addition, on N. E. 7th Stree~ at N. E. 7th Avenue subject to all the stipulations noted by the staff departments and approving an exception of 2~ for the height of the fire wall. Mr. Strnad seconded the motion. Under discussion, Mr. Strnad questioned whether we are within legal limits to do this in view of the fact we are not conforming to our ordinance of 45~ and Mr. Vance replied there is a specific section of the building code permitting an exception to be granted by the Council and it has been done on several occasions. Mr. Annunziato added that it is included in Sec. ~ of the Zoning Code which allows the Council to grant a height exception for structural and non-structural matters. Motion carried 4-0. -6- MINUTES - REGULARCITY COUNCIL MEETING JUNE'lg, 1979 BOYNTON BEACH~ FLORIDA LEGAL Ordinances - 2nd Reading - Public Hearing Proposed Ordinance 79-17 - Re: Extending the Municipal Territorial Limits by Annexation of a Certain Unincorporated Tract of Land (Owner: Hugh Cutverhouse) Mr. Roberts moved to table this item, seconded by Mr. Strnad. Motion carried 4-0. Proposed Ordinance 79-18 - Re: Amending Chapter 50B of the Codified Ordinances as it pertains to the City's Utility Systems Mr. Vance referred to this being a revision of the water and sewer extension system of the City and read proposed Ordinance 79-18 by title. He then read the modifications made in the ordinance since first reading based upon the discussion at the previous meeting. Mayor Hammening asked if anyone in the audience wished to speak in opposition to this ordinance and received no response. He asked if anyone in the audience wished to speak in favor of this ordinance and received no response. Mr. Roberts moved the adoption of Ordinance 79-18 on second and final reading as amended, seconded by Mr. Trauger. Under discus- sion~ Mr. Strnad referred to Page 10~ the yellow outlines, and stated he would like i~ clarified how the owner should pay to the City the total cost of all labor and material prior to the City perfomming all the service unless theme is a definite table of charges and Mayor Harmening replied he thinks the customary way would be for the owner to agree to pay prior to receiving. Mr. Vance added that we do have a standardized amount of money which it costs us to install a tap and this is something definite to go by subject to being corrected by the engineers. Mr. Trauger referred to rates, labor and materials changing, and asked if theme charges are reviewed periodically and Mr. Vance explained these items would be covered by resolution so they can ~e reviewed periodically and the costs raised with the adoption of a new resolution. -7- MINUTES I REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JUNE 19, 1979 Ordinances -tst Reading Proposed Ordinance 79-19 -- Re: Amending Chapter 21 of the Codified Ordinances (Pensions) by Authorizing Participation by Employees in the City's Unclassified Service, in the Deferred Compensation Plan with the International City Management Association Retirement Corp. Mr. Vance read proposed Ordinance 79~!9 by title on first reading. Mr. Roberts referred to not being fa~liar with this ordinance and Mr. Vance referred to the City Manager's job expectancy normally no~ meeting the requirements for vesting in City pension plans and advised the International Association 6f City Managers does have a plan available and this ordinance would enable Mr. Cheney to parti- cipate along with any other unclassified department heads. Mr. Cheney added that i~ is a deferred compensation plan. It is simply the City agreeing to put in an amount of money which they have agmeed ~o give other employees in the City's e~sting pension plan. If approved on first reading, this will be sent vo the trustees of the plan for approval and w~ll then be brought back to the Council for second reading. OLD BUSINESS NONE NEW BUSINESS NONE ADMINISTRATIVE Consider Additional Personnel for Data Processing Operations Mr. Cheney referred to submitting memos basically pointing out that at the moment, we are leasing two data processing systems, one much advanced over the first one. We would like to get rid of the first one as soon as we can, but to do that will take time and re-program- ming work. He feels to adequately use the second system~ we should hire sn additional programmer. This would normally be a recommenda- tion for next yearTs budget, but it is suggested we do it now so we can proceed with improving the data processing and get rid of the old equipment approximately two months earlier than waiting for normal budget time. We want to release the system we are renting. The rental is $3,800 per month, so there would be a significant saving. Normailly, we should not make major personnel changes in mid-year unles!s there is an emergency which we cannot predict or there is a wax to save money, which he thinks this is the case. He would like iauthorization now and the position would have to be advertised andl the selection made and hopefully a new one could be hired within fbur to six weeks. Mr. Strnad moved to honor the City Manager's request for additional personnel for the data processing operations, seconded by Mr. Roberts. No discussion. Motion carried 4-0. -9- MINUTES - REGULAR CITY COUNCIL MEETING JUNE ~9, 1979 BOYNTON BEACH, FLORIDA Appearance of Lake Clark Shores Councilman Barry Kline to Discuss 4-County Crime Convnission Proposal ~r. Barry Kline referred to a four-county Crime Commission being considered and advised he was before the Council to see if they wou~d support such an idea on a regional basis. He told about the response from the various cities and clarified they are try- ing to get support just on the simple idea. When support is gathered from all the counties~ then a board of directors will be formed with the guidance of law enforcement and bylaws and programs will be prepared to be presented to all municipalities. He told about also contacting large industrial concerns and their response being favorable as long as it is on a regional basis. The result of this commission will be a deterrent of crime through a judici- ary watch. He referred to law enforcement doing a good job~ but explained how punishment is lax because of legal loopholes. He explained how the Comatission would gather data to submit to the Legislature ~o correct this situation. He explained how a budget and staff would be needed to serve this purpose. Mr. Kline advised that what he is asking tonight is approval of the Council on a conceptual basis whether they would go along with the idea to look into the possibility to see whether a tangible program can be arrived at. He is looking for participation in seed money, about $4,000 to $57000 which would be about $30 to $50 per Town average. Once the tangible product is submitted, they are looking for support of $1 per employee. They will also go to the County and private industry. Once half the proposed budget is ob- tained~ they employees would be hired and put to work. Mr. Roberts stated in the past any attempt to work with Broward and Dade Counties has proven unsuecessful~ but we are doing a good job with the counties to north. How do the law enforcement agencies feel about this? Mr. Kline told about their response being pretty good with their interest being to enlarge public programs. He told about crime watch programs and how they had proven to be successful. He explained how it would be advisable for information from the counties to be transmitted to each other. Mayor Harmening questioned the reaction in Dade and Broward Coun- ties and Mr. Klim replied the five people doing this in Broward County are getting better responses, but he told how it was a slow gradual process in Palm Beach County with him being the only one directly going to the towns and others writing and calling. Mr. Roberts referred to state and federal funds and Mr. Kline replied that he talked to the representative who distributes LEA money and some of the Police Chiefs and they have advised to pro- teed without these funds if possible. Mr. Roberts commented that he did not remembers this coming to a <~yvote by the Municipal League and Mr. Kline informed him that it did in April. -10- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JUNE 19, 1979 Mr. Strnad referred to being opposed to the method of voting used by the Municipal League and suaued h~ thinks a municipality should have a roue on anything that takes place there depending upon their population. There are many small municipalities and they have the same voue as we do, plus Their representatives are on the Board of Directors. Mr. Kline clarified that the Municipal League did ap- prove this on a conceptual basis, but they are going to each and every mown for their support and want the full support of everyone. When they undertake somethin~ like this, they make an effort to attend meetings no matter how small or large the city is. If they donTt get 90% To 95%, they wonTt get off the ground. They are ask- ing for support from every municipality and town before taking the next step. This also applies in Broward and Dade Counties. Mayor Hammeninc questioned where this concept for this type of information gathering body originated from and Mr. Kline told about attending a seminar on crime comm/ssions in Maimi and how they have been successful in various cities in the United States for years. Mr. Trauger questioned when this would start and Mr. Klineeex- plained it would take a couple months and they want ideas from the County also. Mr. Roberts stated he didn'T want the people to think the Munici- pal League is a waste of time because people are in office from smaller communities, but their time is valuable and many bills in the Legislature have originated from the Municipal League. The representatives To the Municipal League give their time and have knowledge of the government~ no maurer what size city they are reBresenting. Mr. Strnad clarified that he was saying most of the people directing the Municipal League are from smaller municipali- ties with less than 10,000 population. He h~s never seen anybody from the City of Boynton Beach in any capacity on the Municipal League. Mr. Roberts suggested that we take this under consideration and possibly meach a decision au the next meeting and can let the Municipal League know of our feelings. He then moved to table this for further consideration~ seconded by Mr. Strnad. Motion carried 4-0. Reporu on Municipal Beach Mr. Cheney referred to this addressing two issues, one brought up by Councilman Strnad relative to controlling parking for the residents with a standard parking permit giving them priority on the upper level and the e{her addresses the excessive number of parking permits ouustanding and suggesus some changes in the cur- rent ordinance. He suggesus we re-issue permits and go to an annual system, so we don~t have permits outstanding which, he believes~ are a problem at the beach. Also~ the motel charge should be considered and possibly raised from 25¢ to 50~. -11- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JUNE 19, 1979 Mr. Cheney continued with referring to Mr. Frederick havin~ some doubts about being able to enforce parking on s reserved b~sis on the upper level and advised that Mr. Frederick is present to cogent. Mr. Strnad stated any new venture which you undertake always has a little difficulty involved with it. If an additional guard is needed, hire one. Mr. Trauger moved acceptance of the City Manager's report and im- plementation of the beach decal system as recommended by the Direc- tor of Recreation, parking on the upper level proposal as recom- mended by Councilman Strnad and carried through in this plan, and the motel charge to be increased from 25d to SOc. Also, to imple- ment this plan on a trial basis, another staff man can be added at the parking area at the discretion of the Recreation Department. Mr. Strnad seconded the motion. Under discussion, Mayor Harmening referred to the beach guards leaving at 4:30 P. Mr. Trauger replied that his recommendation To add another guard at the discre- tion of the Recreation DeparTment would cover this with them to make the decision whether to extend the guardTs time when it gets dark or at a time of heavy traffic. Mr. Cheney referred to these being two issues of how to eontrol the entrance and how to treat people who do not pay. If a guard is to be there until 7:00 P. M. during the busy times, this should be in the form of a Council statement. He suspects many people want to sit by the ocean during the supper time and that is when we do hOE have any control. Mr. Frederick informed them the 4:30 P. are not im a totally discri~/natory residents an opportunity to come vo M. time limit was set so we position and give the non- the beach during the non-peak hours. When going there after 4:30 P. M., you do not have the situation of nov being able to find a park/rig spot. To make sure a resident pets a spot after 4:30 P. M., the only way to do it is to hire someone to patrol the upper level and not charge the $2 fee, but he is not sure this is necessary. Mr. Strnad replied that it was ~/sinterpreted what he wanted to have done. He did not specify after 4:30 P. M. He knows parking space is available after 4:30 P.M. He is talking about during the day, during the tourist season. Mr. Frederick suggested trying this system on a trial basis during the summer without hiring additional personnel and see what problems occur on the upper level. Mr. Strnad sug- gested that signs be posted on the upper level designating this area for cars with resident stickers and inform the people paying that they must park in another area. Mr. Frederick replied they will do both these items if this is approved. Motion carried 4-0. Mr. Cheney requested the City Attorney to please have an ordinance for this ready for first reading at the next meeting. -12- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH~ FLORIDA JUNE ~9, 1979 Preliminary Drainage Report for Vicinity of S. W. 3rd Street and S. W. 6th Avenue (Mango Heights) Mavor Harmening referred to four alternates having been submitted in the report for consideration and asked for comments. Mr. Roberts referred to the report concluding that Alternate D is the most viable alternate and suggested possibly accepting it. Mayor Harmening clarified this alternate was to purchase additional lots and use them for a park area. Mr. Trauger referred to the price being about $12,000 per lot and questioned how many would be purchased and Mr. Clark informed him there are four available. Mr. Trauger clarified this alternate would cost $48,000 plus. Mr. Trauger stated Alternate B would cost $65,000 with the pumping system and referred to this being cheaper in the long run. Mayor Harmening asked if there was any surplus pipe in the Utilities Department which could be used and Mr. Strnad replied that it was sold for scrap two years ago. Mr. Roberts stated he thinks Alternate D is a better idea and Mr. Strnad replied that Alternate D is not an iron clad guarantee to solve the problem; however, if the water is pumpe~ away from the existing condition~ this would be a positive way of preventing anything which has happened in the past. It would be a gamble with Alterdate D with no assurance it will alleviate the problem. Mayor Harmening replied there was no absolute guarantee against anything because the pumps could fail; however, he does prefer Alternate B. Mr. Trauger asked if Alternate B had been discussed with the people in Mango Heights who initiated the complaints about this and Mr. Clark replied that he discussed these alternates with D.O.T. be- cause their approval is required. He explained there would be no question of pumping everything into 1-95 if the pumps are working. After further discussion of the operation, Mr. Trau~er asked again if Alternate B had been discussed with the people i~ the area and Mr. Clark replied negatively,and added that it will just be a little building with a little pumphouse which will have to be maintained. Mr. Cheney stated he knows this doesn't make people living in this area very comfortable, but he feels it is necessary to point out when spending $65,000, we are spending it in response to one un- usual storm. Mayor Harmening replied this is a good sized area with a considerable number of people involved. Mr. Bob Riley clarified that the City Manager is stating to spend $65,000 is a !or of money for one occurence; but at the same time in December 1977~ he did not hear any argument when the City spent in excess of $90,000 for drainage on N. E. 7th Street because a certain person lived there. Mayor Harmening informed him that an EDA grant paid for this and Mr. Riley suggested getting a grant for this project. The kids in this area must walk in the middle of the street touching school buses or fsll into a pool there. Also, companies want to come into this City, but if they are made aware of the position the City takes as far as spend- ing $55~000 for drainage, they may change their mind where they put their people. Mr. Strnad moved to consider Alternate B, seconded by Mr. Trauger. Under discussion, Mr. Trauger questioned where the funding would come from? He added he would be inclined to include this in the next budget or have it atlocsted instead of adjusting the current budget since a survey must be made, etc. Mr. Cheney recommended having this designed and going out for bids and advised this would bring us close to the budget adoption time. Mayor Harmening agreed and also suggested other cities be eontacted to see if there is some second hand pipe available. Mr. Trauger stated we should know the exact cost and Mayor Harmening replied if we vote in the affir- mative~ we are actually only approving this in concept subject to re-approval at such time as we have the total financial background. Mayor Harmening added that the City Manager should also be requested to check to see if the present area could be made more presentable around the existing pond in terms of the fence being more secure and the general appearance of the area being improved. Mr. Cheney agreed and added that this will also be put on the regular maintenance schedule. Motion carried 4-0. Report and Recommendations - Re: Paramedic Program Mr. Cheney referred to submitting a report whioh summarizes a number of issues which have been pending and stated he has recom- mended the things necessary for the program to proceed. One is the employment of a Medioa! Director which he has discussed with Dm. Vo!!rath and the City of De!ray Beaoh. He recommends an agreement being signed with Boynton Beach and Delray Beach shar- ing the cost of Dr. Vollrathts services for a total cost to Boynton Beach of $2~000 per year. He then explained the other costs to be sharedjjointly with the City of Delray Beach and added that he submitted a oopy o£~e contract Dr. Vollrath signed with Delray Beach. Mr. Roberts referred to the main concern being malpractice insur- ance and Mr. Chenry informed him that we have finally found a solu- tion. He explained how malpractice insurance could be obtained covering the A. A. employees. Mr. Trauger moved to accept the report of the City Manager for the paramedic program with the amendment concerning the medioal director, malpractice insurance and ambulance, and authorize the City Manager to implement this based upon the recommendation. Mr. Strnad seconded the motion. No discussion. Motion carried 4-0. -14- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JUNE 19, 19Y9 Report on County Commissioner's Meeting - June 12, 1979 - Re: Library Task Force Mayor Harmening commented the only thing he can see from this report is perhaps creating a little hardship on quite a number of people using the City library. Without partial reimbursement for useage o~ the City's library by County residents, the City library probably will not continue to allow them to check out books. Conceivably if the people become aware of this, the County Commission may change their posture. Mr. Trauger commented that he does not understand what is behind the County in withdrawing $26,000 from our fine library. Mayor Harmening informed him there was considerable dissention between the County Library Board and the County Task Force recommendation and the vote was 3-2. However, he does not know if this decision will be reconsidered or not. Mayor Harmening summarized that it probably does not cost as much as we have been receiving to allow County residents to use the library, but it does cost something in the way of staff operation and maintenance. Mr. Trauger asked if we could legally exclude a County person and Mayor Harmening replied affirmatively Mr. Vance added that County residents could be charged anextra fee. Also, this won't be effective until the fiscal year and possibly the Mayor's comment about possible re-evaluation may have some merit. Mr. Trauger questioned the impact upon the library and Mr. Cheney replied that it is a loss of $26,000. However, he doesn't think the employees will be reduced, but the wear and tear on the books may be reduced. Possibly we should try to get the decision changed. Mr. Vance suggested accepting the report and keeping this in mind at budget time. Mr. Cheney advised that he put this on the agenda so everyone is aware of what is going on. Mayor Harmening suggested possibly sending a resolution to the Board of County Commissioners decrying this lack of compassion for County residents may be advisable. Mr. Vance replied that various city library groups are continuing to confer and possibly direction may come from them. Mr. Trauger recommended accepting the report of the City Manager concerning the library and instructing the City Manager to prepare a letter to the County Commissioners requesting a review and stating our attitude that Boynton Beach is in favor of the County Library System. Mayor Harmening added that we are in favor of the existing financial arrangement and existing system. Mr. Cheney replied that he would be glad to prepare such a ~etter and will bring back for the Council's review at the next meeting as we may have some additional information by then. Mayor Harmening re- ferred to having time on this and requested Mr. Cheney to draft a letter on this for the Council?s approval at a later date~ -15- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, PLOP~IDA Report - Municipal Golf Course Advisory Committee J~NE 19, 1979 Mayor Harmening referred to this being deleted and added that he believes the Committee wants to consider recommendations before bringing this to the Council. Budget Transfer Requests - City Manager?s Expenses Mr. Cheney stated as a followup of earlier discussions, he is requesting the Council to authorize these budget transfers. The first request is Dasieally for his moving expenses from New Hampshire to here. Also ineluded is a couple hundred dollars to cover additional expenses for other candidates for the City ManagerTs position. He is also requesting a transfer to eover his memberships and attendance at the I.C.M.A. eonfereneeo These three items were discussed previously. The fourth item requested is consideration for the transfer of funds so he can obtain some dictating equipment for his offiee since there is none. He would like something in the office as well as to take home whieh will be more convenient. Mr. Roberts refereed to having three secretaries in the City Manager's offiee at the present time and asked if the use of t~e dietating equipment would give them the chance to work in other departments? Mr. Cheney replied affirmatively, if there is time~ but he ~s not sure yet the allocation of people needed Mm. Roberts referred to the use of a machine enabling the seere- taries to have more free time and suggested they be used in other departments and Mr. Cheney replied that at any time a department needs help, employees will be moved about as required. Mm. Trauger moved the budgetary transfers for the City Manager's expenses as stated in the agenda item dated June 19, 1979, be approved~ seconded by Mr. Strnad. No discussion. Motion car- ried 4-0. At this time~ Mayor Harmening declared a five minutes recess. He reeonvened the meeting at 10:05 P. M Report on Y.M.C.A. Land Transfer Matter Mayor Harmening referred to receiving the City Manager's recommen- dation and stated basically iT is that we do not have any land at the present time which is surplus Also, there are potential problems outlined in the memo from Mr. Vance regarding the trans- fer or sale of such land. There is also a charter prohibition which calls for an appraisal and selling at the market value of any excess City owned land. Mr. Roberts suggested the City Manager send the necessary reply and Mr. Cheney replied he did discuss this with the rDpresentative of the Y.M.C.A. and will confirm it in writing. Trailer Request in Accordance with Chapter 30 of the Code - ~rankG. Mendoza - Seaway Villas Mr. Roberts moved to grant Mr. Mendoza permission for a trailer as he requested~ seconded by Mr. Strnad. No discussion. Motion earried 4-0. Appointment of an Alternate Member to the Board of Adjustment Mr. Trauger nominated Mrs. Marilyn Czufin as he believes she has the necessary qualifications and would accept if appointed. Mr. Strnad nominated Mr. Hy Rosenthal, since he has made a request to him. Mr. Strnad moved that nominations be closed, seeonded by Mr. Trauger. Motion carried 4-0. Mayor Harmening called for a vote of all those in favor of ap- pointing Mrs. Marilyn Czufin to the Board of Adjustment as an alternate member and the response was three in favor. Consider Request for Refund an Cemetery Lots - Wilbert and Bessie Maalin Mr. Roberts moved to grant Wilbert and Bessie Maslin a refund on their cemetery lots, seconded by Mr. Strnad. Under discussion, Mr. Strnad asked if it is required to give a reason for wanting to dispose of these lots and Mrs. Padgett replied that normally there is a reason stated why they want to sell them, but she does not think it is aetually required. Mr. Trauger commented that the purchaser gets 80% back and actually real estate has been escalating and Mayor Harmening informed him the difference is the City has maintained this pzeperty for the benefit of the owner and this has cost a considerable amount of money. Mr. Trauger asked if the cemetery lot prices had increased and Mrs. Padgett replied they were increased slightly not too long ago. -17- MINUTES - REGULAK CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JUNE 19, 1979 Mrs. Padgett added that with maintenance, fertilizing, watering, etc., it is felt something should be paid rather than the full amount being refunded. Mr. Strnad commented that the grass must be cut anyway and it is only a small area. Motion carried 4-0. Application for Permit to Solicit - Palm Beach Group Treatment Home Mr. Roberts referred to having an application previously from a religious group which was denisd because of the dates of solici- tation and stated it is included on this, but it is do~r to door ticket sales They should be instructed not to go in any areas posted not allowing solicitation. Also, the date of solicitation noted to begin is ~une 20 which is filled in by pen and Mr. Cheney ir~ormed him that he thinks this was done because they were not sume when this wound be on the agenda. He added that if there are some areas where solicitation is not allowed, then it should be denied. Mr. Roberts stated these are nice youngsters, but they should be controlled. He would vote in favor of it if the City Manager is instructed to infomm these people to honor these par- ticular requests. Mr. Roberts moved to grant permission to solicit with explicit instructions to honor requests where it says ?'No Solicitations". Mr. Trauger seconded the motion. Under discussion, Mm. Strnad commented he was pleased to see they noted the percentage which will be coming baek to the City of Boynton Beach. Motion carried 4-0. Mr. Vance referred To the time taken by the Counei! to review these requests and the lateness of the hour and advised that the granting of permits to solicit is handled at the administrative level in many cities. If the Council desired this approach, it would be relatively simply to amend the existing ordinance. Mr. Roberts replied that he did not see any particular benefit to bypass the Council. Mr. Vance stated the City Manager is in a better position than the individual Council members to inquire into the background of these organizations and it does shorten the meetings. Mr. Roberts replied that some of the members of the Council would have better knowledge of some of these groups. Mr. Va.nee clarified that he was not advocating this particular approach, but it seemed an appropriate time to mention this alternate approach is used by other cities. In the utility f~nd in this particular year, we do nor have a contingency to transfer ~rom, but possibly'within a month we can recommend to balance out the accounts. He recommends paying these bills because we are obligated to do so~ Mr. Roberts stated with no money~ how do we pay the bills? Mr. Cheney informed him that we have money in the account, but have just overdrawn that line. Mr. Roberts suggested waiting another month and Mr. Cheney replied this would not be fair to the com- pany.
