Minutes 05-16-79MINUTES OF THE REGULAR CITY COUNCIL MEETING HELD AT CITY HALL, BOYNTON BEACH, FLORIDA~ ~DNESDAY, MAY 16~ 1979 AT 7:30 ?. M. PRESENT Edward F. Harmening, Mayor Betty R/scoa, Vice Mayor David Roberts, Councilman Norman F. Strnad, Councilman Peter L. Cheney, City Manager Tereesa Padgett, City Clerk James W. Vance, City Attorney Mayor Harmening welcomed everyone and called the meeting To order au 7:30 P. M. He announced the Invocation tonight will be given by Father A1 Victor, St~ Mark's Catholic Church. He requested everyone to please rise and after the invocation, the Pledge of Allegiance to the Flag will be led by Honorable James.Vance, City Attorney. Mayom Harmening then introduced our new City Manager, Peter L. Cheney. AGENDA APPROVAL Mr. Vance requested the addition under Administrative, Item G-i, Application for Perm/t To Solicit - The Unification Church. Mr. Roberts stated he would like ro discuss some mail received from the Municipal League under Administrative, Item C. Mayor Harmening stated he would like ro make an announcement concerning the Motorola plant. Mr. Roberts moved the adoption of the agenda as corrected, seconded by Mrs. Riseoe. Motion carried 4-0. ANNOUNCEMENTS Mayor Harmening referred to articles in the newspaper regarding the possibility of a Motorola plant being located in Boynron Beach and stated he would like Eo set the record straight. There have been a considerable number of meetings with Motorola and Motorola has been surveying many sites in Palm Beach County. The plant they con, em- plate buildino is similar to the one in Plantation for the purpose of electronics assembly, research and development. Many cities in Florida would like to have this company. Motorola has not been interested in having any publicity regarding the site. They do nor desire To see the cost of real estate at the location they choose go sky rocketing. The prime consideration is they like To make the announcement themselves. Prom considerable past experi- ence, the personnel in their existing plants get very nervous th/nk- lng their plant will be phased out when hearing about s new site and this has presented many problems for them. He would say we have a good chance of having Motorola locate here and hopes some- thing will be worked our, but many cities are interested. Mayor Harmen/ng read a proclamation proclaiming May 20 thru 26, 1979 es National Public Works Week. MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLO~DA MAY 16., 1979 Mayor Harmening read a proclamation proclaiming the week of May 20 thru May 26, 1979, to be Home Health Agency Week. Mayor Hammening read a proclamation proclaiming the week of June 1 thru 10, 1979 as National Safe Boating Week. Mr. Cooper expressed the thanks of the local Coast Guard Auxiliary for this proclamation in conjunction with National Safe Boating Week. Mayor Harmening announced that City Hall will be closed on Monday~ May 28, 1979, in observance of Memorial Day. Mayor Harmening announced there will be a Special General Election held on Tuesday, May 29, 1979. The po~ls will be open from 7:00 A.M. to 7:00 P.M. MINUTES Regular City Council Meeting - May 1, 1979 Mr. Roberts moved to accept the minutes as recorded for May 1, seconded by Mrs. Riscoe. No discussion. Motion carried 4-0. PUBLIC AUDIENCE Mayor Harmening announced if anyone wishes to address the Council on any item not on the agenda~ they may do so aE this time. He added if there is any item on the agenda anyone wishes Eo address, please give your name to the City Clerk and when that item comes before the body~ they will be allowed To speak. BIDS Playground Equipment Mr. Cheney informed the Council this bid was for playground equip- ment for recreation~aE Galaxy School. Only one bid was received. The recommendation is uo accept the sole bid from Hunter Knepshield for g12,231.77. Only on~ bid was received because it is theme equipmenT. Mrs. Riscoe moved vo accept the bid from Hunter Knepshield in the amount of g12,231.77 for the playground equipment~at Galaxy Park, seconded by Mr. Strnad. Under discussion, Mr. Strnad commented that he certainly would like To see another bid since we have nothing To nompare the price of this bid to. Mr. Sullivan info,ed him the bid announcements and specifications were forwarded to everyone on the bid list~ about six firms. However, ~is item is a specialty item. Each firm manufactures one line and this particu- lar firm designs equipmenE with a space theme. Other firms manu- facture frontier equipment, etc. For this particular item, there is no comparable bid. Mavor Harmeninc clarified this is special- ized equipment and only one manufacturer specializes in it. -2- MINUTES - I~EGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 16, 1979 Mr. Strnad asked if we have purchased any equipment of this type in the past and Mr. Sullivan replied negatively as we do coy have any space equipmenT. Mr. Cheney added that it is always concern when only one bid is received and he asked these same questions and talked to the Recreation Director and Mr. Sullivan. From time to time this will happen when deciding to specialize in a theme situa- tion. The requests for bids were sent out to a large list of po- tential ~idders. Motion carried 4-0. One (1) Self-Contained High Powered Portable Field Telemetry Unit Mr. Cheney informed the Council that this unit is for the paramedic progmam. Again, only one bid was received. As far as the reason- ableness of this bid and technical questions, a member of the para- medics is present and he is prepared to answer any questions. Mr. Strnad asked if this is in the same category as the previous one and Mr. Cheney replied probebly, but he is not sure it is quite as limited production. Mr. Gene Kight, Peram~dics Officer, explained this equipment is basically what was purchased a few months ego and they are trying to equip two units with the same life support equip- ment. Mavor Harmening added that he saw one of these units today and he believes this manufacturer is the leeder in the field in this particular electronic gear. Mr. Strnad commented that we have purchased something of this sort previously and have a basis to judge the bid. Mrs. Riscoe moved Eo accept the bid of $5,741.35 for the self-con- tained high powered portable field telemetry unit for the paramedic unit, seconded by Mr. Strnad. Under discussion, Mayor Harmening clarified th% recommendation was acceptance of the lone bid from Motorola for the sum of $4,990.00 (base bid)~ plus options for the sum of $751.75 for a total bid of $5~741.35. Motion carried 4-0. One (l) Portable Battery Operated Defibrillator, Cardiosoope & Recorder Mr. Cheney informed the Council this is also for the paramedic program. Two bids were submitted and the recommendation is to accept the low bid from Motorola for $5,950.00. Mr. Roberts moved to accept the low bid from Motorola for the Portable Battery Operated Defibrillator, Cardioscope and Recorder in the amount of $5~950.00. Mrs. Riscoe seconded the motion. No discus- sion. Motion carried 4-0. Muck for Sara Sims Park Mr. Cheney informed the Council this is for the purchase end delivery of muc~ for Sara Sims Park. Three bids were received and the recom- mendation is to accept the low bid from Lot Service for $9~500.00. Mrs. Riscoe moved to accept the low bid from Lot Service in the amount of $9~500,00~for muck for Sara Sims Park~ seconded by Mr. Roberts. No discussion. Motion carried 4-0. -3- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH~ FLORIDA MAY 16, 1979 PUBLIC HEARING - 8:00 P. M. Conditional Use Applicant: Location: Project Description: Gulfstream Lumber Company 1403-South Federal Highway Proposed Parking Lot Mr. Jim Terhorst, General Manager for Gulfstream Lumber Company, came before the Council and advised they have requested approval for a parking lot adjacent to the north end of their facility for two primary purposes. He explained one half would be used for employee parking and the other half for truck parking to relieve the present congested situation at rheim existing facility. They have submitted drawings to the engineering department and have made certain changes as far as landscaping of the facility, where from an appearance standpoint it will compliment the Total area with the addition of 27 trees and Two rows of shrubs. Mayer Harmening clarified they have accepted the recommendations of the Community Appearance Board and Mr. Terhorst meplied affirmatively. Mr. Vance asked if the applicant agrees with the commenus of the staff attached to the recommendation and Mr. Terhorst replied affirmatively, they are in ~omplete agreement. Mr. Vance added the zoning code requires if this is approved~ it must be in written form. He suggests the Council make a determination and if approved, direct his office to prepare the necessary instru- menus. Mavor Harmening asked if anyone in the audience wished to speak in favor of this conditional use. Mr. Matthew Romano~ 1321 S.E. 3rd Stree~ referred to living next to this property for the past six years and stated he has found the management of Gulfstream Lumber Company to be very responsive to the needs of the neighbor- hood and he explained. He is sure anything they plan to do not only will be funetional~ but a~Eractive as evidenced by what they have done. Mayor Harmening asked if anyone in the audience wished to speak in opposition and received no response. Mrs. RIscoe moved To approve the proposed parking lot for the con- ditional use for Gulfstream Lumber Company subject To staff recom- mendations and request the City Attorney to prepare the proper papers. Mr. Roberts seconded the motion. No discussion. As re- quested, Mrs. Padgett took a roll call vote on the motion as follows: Vice Mayor Riscoe - Aye Councilman Strnad - Aye Councilman Roberts - Aye Mayor Harmening - Aye Motion carried 4-0. -4- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH~ FLORIDA MAY 16, 1979 SITE DEVELOPMENT PLANS Applicant: Location: Project Description: Agent: Sun First National Bank of Palm Beach County S.W. 15th Avenue, East of Lindsley Lumber Commercial Bank Bill Vaughn Mr. Bill Vaughn, Architect and Agent for Sun First National Bank, stated they have been before the Site Plan Review Committee and the Planning & Zoning Board and agree to all stipulations they have re- quired. They have revised their plans to conform to those regula- tions. Mr. Vance referred to the Planning Department requiring an additional 7 ft. of right-of-way on Woolbright Road and asked if this involves an easement and Mr. Vaughn replied they have agreed and will furnish the easement. Mr. Annunziato clarified that it would be a right-of-way dedication. This additional 7 ft. will provide for~uf~l! 120 ft. section of Woolbright Road. Mayor Ha~mening asked if we are in receipt of the deed and Mr. Annunziato replied not tQ date and Mr. Vaughn added that it will be submitted before presenting plans for s permit. Mr. Roberts moved To accept this site plan subject to staff recom- mendations and the additional 7 ft. of right-of-way~ seconded by Mrs. Riseoe. No discussion. Motion carried 4-0. Applicant: Location: Project Description: Agent: B. R. Caskey, Jr. $ C. E. Waldner 2828 South Seacrest B~vd. Revised Site Plan Requesting Removal of Wall Bill Lhota - Seacrest P~ofessional Plaza Mr. Bill Lhota, contractor on the projeet~ and Mr. Robert B. Bratzel~ Attorney representing the applicants~ came before the Council. Mr. Bratzel stated this is a request for reconsideration of the previous site plan submitted. The site plan went through the various planning boards and was presented To the City Council some time a~o. About July 5 with the cooperation and planning of the BuildinglDepartment, the site plan was changed to eliminate the 6' concrete w~ll in the area between residential and commercial zones. The original ordi- nance called for this type of wall between these zoning areas. Be- tween the approval of the site plan and issuance of the final permit, this portion of the ordinance was eliminated no longer calling for a wall. The final site plan presented and upon which the permit was issued did not have the wall and the Building Department indicated this should be the 2ase. He was informed by Mr. ~owell that he would bring pictures of the site plan as it was submitted for the permit. The permit was issued on July 14. The building was com- menced in November and has been in constant 2onstruction. Durin~ the heavy rain recently, the stage of the parking was to the point where the parking area was in shale and ready for bls2ktop. -5- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 16~ 1979 Mm. Bratzet explained that the heavy rain caused some washing out of this area into the houses behind which has prevoked reconsidera- tion whether there should or should not be a wall. They feel there is no requirement for s wall. Other professional offices being built in the area at the same time have nov been required to con- struet a wall. They are only adiacent to residential area in the rear. He told about the catch basins and ~ain fields being in- creased to handle the water sufficiently. The property is graded properly for drainage, but they have agmeed to build a curb arrange- ment Eo funnel the water to the catch basins. Mayor Harmening referred to an 8?' curb being 2ontemplated and Mr. Gerald Church, Design Engineer~ explained that an 8T~ curb was planned adjacent to the property line on the east side which has been de- signed not Eo allow water to run off the property and the water will be reEained on the site. Mayor Hammening referred to the pos- sibility of havin~ another heavy rainfall and questioned if an 8" wall would contain it? Mr. Church stated in addition to the 8" wall, they have installed a storm drainage system according to the criteria of Boynton Beach which will essentially cover a one and three year storm. They do not expect the water to get up to 8T'. Also~ the water is contained on-site by the slope of the land. They feel a 6T high wall is not required to retain storm drainage. They feel an 8" curb is satisfactory. Mayor Hammening referred to the recommendation made by the Co~un- ity Appearance Board and Mr. Bratzet stated their recommendation was the planting of a 5~ hedge to give privacy and noise insulation to the neighbors and not s 6~ concrete wall. Mr. Strnad stated if we have an ordinance requiring a block wall between residential and commercial, how can we not observe the rules and Mayor Harmening replied the ordinance was changed after the permit was or~nally granted. Mr. Howell clarified the site plan was approved before the ordinance was passed. The Plannin~ & Zoning Board approved the plans with the wall. Before the issuance of the building permit, the ordinance was changed and C-1 zonin~ did not require a wall. The building permit was issued with the understanding the site plan would have to go back through the Boards since it was approved with a 6~ wall. Mr. Strnad stated he does not remember voting to eliminate the 6~ high wall in commercial and Mr. Annunziato informed him this action was taken in Spring, 1978. He explained that it resulted from the houses changing to doctors~ offices along S. E. 25rd Avenue and the residents noE being in favor of a wall with C-t zoning. He then stated he would like to clarify the recent action taken by the Planning $ Zoning Board. The application was forwarded with the recommendations from the sEaff to the Planning g Zoning Board that a 8" high retaining wall be expanded on the north and south sides to meet the existing grade. The issues of privacy and aesh~etics were noE addressed. The Planning $ Zoning Board re-affirmed their initial approval calling for a 6~ high concrete wall between the residential and commercial lands. The effect of this reeommendatlon was ro deny this application. -6- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH~ FLORIDA MAY 16, 1979 Mrs. Arthur Haley, 2881 S.E. 1st Place, stated she bought her pro- perry in 1957 and has never had any problem with waver or flooding until now. She told about, the flooding caused on her property by this parking lot during the heavy rains and how light storms wash shell rock into the back of her yard all the time. A little curb- ing is not going to stop the shell rock from oom/ng in. It is com- ing out from under the blacktop. The rain of April 25 filled her pool with shell rock~ clogged the pipes and damaged the vinyli~iner. It is drained and still waitin~ repairs. The contractor, Bill Lhota~ has promised to take care of the damage to the pool, but nothing has beem done yet. It will cost about $1,000 to fix the pool. She has had to shovel sand after every rain and the only solution is a 6' wall to hold the shell rock back. Curbing will not hel~. A wall will also be a solution to give back some of the privacy they en- joyed im the pasv. Mr. Roberts asked if the 8~' ~urb hod been in- stalled yet and Mrs. Haley replied negetively and the water runs right Off the building, down the hill onto her propervy. Mr. Strnad questioned the purpose for relaxing the requirement and Mayor Harmening explained how w/tH the situation on S. E. 25rd Ave., it was not felt s wall was necessary for everyone's benefit between C-1 and residential. Also~ a concrete wall by itself is not neces- sarily the most attractive thing. Mr. Strnad stated each case should have been considered individually and if it warranted being removed, a vote could have been taken~rather than blanket removal of the ord- inance. He clarified that these people are requesting a wall and the only ones objecting are the people involved in the cost of in- stalling the wall. Mrs. Loyal Rohrbaugh, 2857 S.E. !st Plaee~ stated since the subject of the parking lots to the medical offices on S.E. 2~rd Avenue ha~ come up~ she would like to point out the difference. These parking lots probably have maximum spaces for 2S ears; but for this one proposed, it will hold over 200 cars. There are eight residential homes affected by this parking lot. She has lived in her house for 17 years and there is a parking lot with 180 cars to the north. She has bedrooms facing the parking Iot and she has the inconven- ience of lights shining into her home at all hours as a~ter the medical center etoses, the police patrol it. Also, there have been incidents of vandalism at least once a week with people hiding in her shrubs~ carport and utility room. In reference to an 8~ retain- ing wall~ S. E. 1st Place is at least 8~ below the level of Seacrest Blvd. where all this water is going to be running from. She wants a privacy wall. There is no guarantee it would have been approved initially if it did not show the 6' wall. There need!s to be a foot- ing. There is no way the shell rook will stay on the property with the land running to the east. She then told about~delbris being scattered from the dumpsters in these parking lots. They want the little privacy they have left. They have no objection to the medi- cal complex~ but don't destroy their neighborhood or downgrade it! -7- MINUTES- REGULAR CI~f COUNCIL MEETING BOYNTON BEACH~ FLORIDA MAY !8, 1979 Mrs. Betty Domigan, 2876 S.E. 1st Court, stated she lives at the southeast corner of this parking lot. She referred To her bedrooms and bathroom facing this parking lot and told how her privacy is affected. Also, her pool has to be cleaned daily with the dirt and dust. Also~ people cur through her yard continuously vo get to Seacresr Blvd. Mr. Loyal Rohrbaugh~ 2857 S.E. 1st Place, stated as far as shrubbery keepi~-~g out the light and noise, it does not do it. He has a medi- cal center on the north side of his propervy and put up a double fenee with flame vines and still is disturbed with lights shining through. He feels a cement wall should be put there. He then told about the debris from the dumpsters blowing onvo his propervy. Mr. Steve Frazier, 2865 S.E. 1st Plaee, stated he lives directly behind this parking lot. If they could raise his house 40', he would not narc what they put there. However, since it is quite a bit below~ he is requesting s 6' wall. Mayor Harmening clarified the request is for site plan approval for the revision of a previously approved site plan which included a 6' masonry wall and now the site plan includes a curb and plant- ing as recommended by the Community AppearancenBoamd. It is his feeling perhaps the change in the C-1 law oeassionally is nov ap- plicable in every ease. The Planning & Zoning Board denied the request by re-affirming approval of the original site plan. Mr. Roberts referred vo there being quite e bit of discussion ay the Board meetings according to the minutes and stated he noticed some talk about a compromise situation. Mr. Annunziato clarified his 2ompromise suggestion was to alleviate the wall where it will be adjacent to the C-! zoning. If the wall is consvrueted where this property abuts single family homes, it will accomplish the intent of the ordinance. The adjacent commercially zoned property will probably convert to commercial and he is nov sure s wall will be beneficial. He showed the site plan vo the Council and pointed out the location of the C-1 propervy and the residential property. Mr. Strnad stated although we do want to encourage businesses to come into town~ we cannot turn our backs on the residents who have been living here many years. He would suggest we take a good look at the ordinance and get it cor~ecved so we can vote vo not have the wall if there is good reason. It would be better that way rather than have people complaining they are not properly screened from commercial property. He told about having a problem with waver running onto his property from the adjacent development. Mr, Strnad moved to deny this request~ seconded by Mrs. Riscoe. Under discussion, Mr. Roberts referred to the compromise to con- struct the wall only adjacent to the residential area and Mr. Rohrbaugh replied that he didn't think there should be a compro- mise. There Should be a 6: concrete wall. Mr. Bratzel referred -8- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH~ FLORIDA MAY !6~ 1979 to the abutting C-1 properEy and stated the only residence affected is that of Mrs. Mook. He read a letter submitted by Mrs. Mook questing that a wall not be constructed but a hedge planted as ap- proved by the Community Appearance Board. With a wall adjacent to her property~ it would cause flooding in her yard. He explained how a wall would create a water problem in Mrs, Mook's yard since the property slopes into the south corner. On the other side is another medical building and Dr, Shepard has indicated he is not in favor of having a wall between the buildings. Mr. Strnad stated he did not really see any nee?ssity of having a wall between two commer- cial properties un~it would affect the type of business conducted. He still maintains there should be some protection ~etween residen- tial and commercial. Mr, Strnad stated he would like to revise his motion Eo state he does not believe it is neeessary to have a 6~ masonry wall between commercially zoned properties~ but between commercial and residen- tial there should be a protection wall. Mrs. Riscoe stated a vote should be taken on the denial. Mr. Vance stated he thinks the Council has latitude. The compromise Mr. Annunziato referred to involved the actual construction of the wall adjacenE to all the property owners who have spoken tonight. However, in the area joining the commercial properties, it is recommended by Mr. Annun- ziato that the hedge approach be used. The effect of th~sapproach would be those who live in this area in residential would get a 6~ h/eh concrete wall. The commercial areas adjacent would have a he~ge between. If the Council des/res to consider this approach, he would like to have the contractor or agent agreed To the approach with the stated points where the wall would be built and where it would not be built. Mr. Roberts referred to the 8" curbing and Mayor Harmening informed him that would be eliminated. Mrs. Riscoe referred ~o attending the Planning L Zoning Board meet- lng and stated she thinks the people understand about the water but that predominantly was not the basis of the complaint~ but they wane privacy, The ordinance has been changed~ but this is an iso- lated case. She will not rescind her second as she feels a 6~ masonry wall should be built. Mavor Harmenin~ announced that the Chair accepts the original mo- tion with the second. Mr. Roberts questioned what theoriginal motion was and Mayor Harmening informed him it was to disapprov~ the resubmitted site plan with the 8" curb, which puts into effect the site plan approved with the 6~ masonby wall. Motion carried ~-1 with Mr. Roberts dissenting. Mr. Bratzel questioned where the wall is to be built and Mayor Harmening replied it is to be built where it was originally shown on the original site plan. Mr. Bratzel stated the original site plan had none shown. Mrs. Riscoe stated the Council just re-af- firmed the original site plan following the recommendation from the Planning g Zoning Board. Mr. Annunziato clarified the original -9- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH~ FLORIDA MAY 16, 1979 site plan required a wall adjacent ~o C-1. This would require a wall alon~ the south and east boundaries. The applicant has entered the information that the individual adjacent on the south does not want the wall. Mr. B. R. Caskey, Jr. stated the people want e wall abutting the residential zoned property; but with the motion made by the Council, it means a wall all around the building. The two C-1 owners abut- ting the property do not want a wall. They will constr~r one where it abuts residential. Mr. Strnad agreed and stated he was trying to imply that and agrees a wall is not needed between com- mereial properties. Mr. Strnad moved to reeonsider the previous motion, seconded by Mr. Roberts. Motion carried 4-0. Mr. Vance requested Mr. Annunziato to fully define the plan and Mr. Annunziato did in disnussion with the residents. Mrs. Riscoe made the original motion to have a wall constructed as submitted on the original plan even abutting the C-1 zoning. Mayor Harmenin~ ascertained the motion died for lack of a second. Mr. Strnad referred to having a problem with water being retained on Mrs. Mook's property and suggested the engineers research it and possibly a culvert can be put in so the water will not be re- tained on Mrs. MookTs property. Mr. Strnad made a motion that any commereial property abutting resi- dential property should have a 6? masonry wall dividing the property~ but not including between the commercial properties because no doubt there will be construction on the adjoining land. When the next commercial property is developed~ they will be required to build a wall. If there is a flood being created in the corner, the engi- neering department should make a decision on how to dispose of the water. Mayor Harmening added that in this ease~ part of the pro- blem lies in the configuration of some of the adjoining properties. Mr. Roberts seconded the motion. Mayor Harmening clarified that it has been moved and seconded to require a masonry wall where it abuts residential property. Mr. Vance added that a hedge type approach would be permitted between the eommercial areas and Mayor Harmening replied this was correct. He then added that it seems When the other commercial property is developed under the existing C-1 code, there will not be the requirement of a 6T masonry wall. Mr. 2heney clarified that a wall will be required between the commer- cial and residential zone~ but asked if a 8" retaining curb and hedge would be required between the eommereial zones and Mr. Roberts replied the 8'~ retaining curb is not needed. Mr. Strnad added the Building Department should look into havinc a footer where there is the possibility of shell rock washing-out underrate blacktop. Mr. Vance clarified that the particular ordinance lang- uage does not eliminate a concrete decorative wall between commer- cial and residential and just says there may be a ~ubstitution. -10- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH~ FLORIDA MAY 16, 1979 It is a~ the Boardts prerogative that a concrete well can be re- quired. He requests the Planning Director to confirm this point. Motion carried 5-1 with Mrs. Riscoe dissenting. He explained that as of January 1~ 1979, we got on a regular progmam. The first ordinance adopted a flood plan map and we now need an ordinance To get into the regular program. This ordinance was sent from Atlanta as a model ordinance and it was suggested we adopt it because it is the only way To be enforced. Basically the ordinance lets the City Code Department enforee the minimum heichts for floors, sEreets: etc. Also, it does not allow a developer Go deviate the flood waters where it would cause flood problems for existing developments. Mr. Roberts stated it won't affect those with insurance under the old plan and Mr. Howell replied that it will make the insurance better. Mr. Roberts asked if the County comes under this particular omdinance and Mr. Howell informed him the County has a flood map and is in the process of preparing an ordinance. He does not know if they are on a regular program. Mr. Vance added that any governmental entity wishing to provide federal flood insurance To citizens must adopt this ordinance. His offiee~ the Engineering Department, Planning Department, and the Consulting Engineers concur the exist- ing ordinance relating to connection charges and eapitaI facilities charges is in need of revision. One of the primary things ~® to accomplish is To establish a connection eharge for new customers to pay to the facilities which already exists and he explained. OLD BUSINESS Report from City Engineer~ Mr. Thomas Cls~k - Re: Drainage & Road Repaving, S. W. 3rd, 4th and 5th Avenues Mr. Clark referred To this being the Mango Heights Subdivision built in 1972 and stated cost estimates were submitted consistent with the baokbone plan whi2h was turned down aT the referendum. There were plans to require the developer ~o extend the storm sewer from that development to State Road 804. Costs were deter- mined and the developer was not willing to size pipes in order to size all the properties along the way plus additional properties draining into thffs sysuem and the City was requested To participate mn the cost. At that time, the estimated cost was ~52~000 and there was an arrangement we would work with the contractor and he would pay 50% of the materials and rent the City equipment. The cost to the City would have been at least ~15,000 and the City elected not to partioipate in that construction. These days it would cost about $100~000 and there would be no guarantee there would not be problems during heavy rainfall. He proposes we clean out that area and maintain it properly. In the other low areas at Ocean Avenue, 1st Avenue, eno. where water accumulates~ if the City does not elect to spend money for storm sewers to accommodate these areas: they could put in extensive french drains which would accommodate the problem ~or 99% of the time. They would have to be designed to be maintained properly. -!4- MINUTES - REGULAR CITY COUNCIL MEETING B©YNTON BEACH, FLORIDA MAY 1~, 1979 Mr. Roberts referred to the catch basin built at the bottom of the hill and Mr. Clark continued that in lieu of the City participating in the storm sewer~ the alternative was for the developer to give a lot to the City to accommodate water for the whole area, which it does do. Mayor Harmening asked if there was any record of how close this pond has come To overflowing and Mr. Clark replied that he has not been told that it overflowed in the last six years. Mr. Reilly added that during the last 2~ years, it has not overflowed, but it has filled up to Il of overflowing. However, the side of the pit is eroded which has left an opening in the fence and kids could fall into it. Mr. Clark agreed that it needs To be cleaned and grassed. Mr. Cheney added that he looked at this with Mr. Clark and it certainly needs to be cleaned up. Mayor Harmening asked if any cost study was ever done on a positive small lift station on this site set with an extremely high level such as a 3 or a" pump leading to the nearest natural runoff. After discussion, Mr. Clark agreed this was something which could be considered, but he is not sure if it is cost effective. Mr. Clark clarified that if thi~ pond is maintained properly~ he does not anticipate it filling up again. Mr. Strnad asked if a regular system could be set up To cheek this particular area to make sure the silt is out and there are no weeds. Mr. Roberts questioned whose responsibility this was to keep it clean and Mr. Clark replied that he has mentioned this and actually the ~eneral Services Department maintains the storm sewers in the streets. Mr. Cheney stated this must be identified and addressed. If the Council is interested, he will look au the drainage in this ares further and put together some general costs. Also, other streets which donTt flow into this vacant lot also have problems. He will come back with suggestions for the whole area for further discussion. Mayor Ha~mening agreed and requested him to come back with a cost effective recommendation. Status Report - Re: Meeting w/Representative of Municipal Code .Corporation and Anticipated Date of Completion - Vice Mayor Riscoe Mrs. Riscoe mequested a reply concerning this from the City Attor- ney or Mrs. Padgett and Mr. Cheney advised that he called the Muni- cipal Code Corporation to find out where we stand and verify a letter received. The material was sent for type setting in April. Eighteen months is required to 2omplete th~s profect and the begin- nin~ date was lasE November and December, which is the date the material was received by them. ~e then explained the schedule required for vype setting~ proof reading and final ~rinting. Mrs. Riscoe clarified this would mean about the middle of 1980 and Mr. Cheney agreed and added that he will write to the gentle- man he talked Eo requesting a confirmation of their conversation including the dates. Request for Land Donation Mayor ~armening referred to a letter being submitted from Mr. Cheney and staff comments from Mr. Frederick and asked if the Council members had any comments. Mr. Roberts referred to the last paragraph of Mr. CheneyTs letter and stated in the memo from the Recreation Director, he has listed all available land and he is in agreement with paragraph 3 to not recommend reducing the size of either of the lar~er tracts as they are :ritical to our future recreational and general municipal pur- pose needs. He has been trying to get the City moving on the 55 acres for a long time and is against doing anything with the funds earmarked for this section. Possibly it should be looked into if 3 or A is available. Mayor Harmening replied that he didn't think either site would be de~med desirable by the Y.M.C.A. Mr. Chancy stated as a general rule, there may be some question when requiring people Eo dedicate land to us or money and turn around and g/ye away land we already own unless there is some un- usable or we have an over-abundance of land in that area. We might be putting this land in jeopardy. Establish Position of Secretary I for Recreation Department Mr. Cheney stated if there are any questions, he suggests the Council ask Mr. Frederick to comment since he was involved in earlier discussions. (Councilman David Roberts) Mr. Roberts referred ro needing someone some time ago uo represent Boynton Beach in the Metropolitan Planning Organization and stated he is interested because they handle the roads. He has just been informed the Executive D/rector of the Mun/cipal League has gone to Tallahassee to get money to improve the roads for Palm Beach County. He was asked to serve in this organization but referred to his other duties and Mr. Strnad was then appointed and Mrs. Riscoe said she would go if Mr. Strnad could not. However, he understands nobody has attended. If they do not want to partici- pate, he would be glad to serve out the rest of the year. He thinks Boynton Beach should be represented. Mr. Strnad replied that he cannot serve at this particular time as it is impossible for him to go at 3:30 P. M. Section 1, Part A, Lift Station Wastewater Facilities for Regional Pollution Control Mayor Harmening stated a letter has been submitted from Russell $ Axon explaining the nature of this change order. Mr. Roberts stated the additional amount i~ $42~622 and Mayor Harmening added this is 75% EPA reimbursable. Mrs. Riscoe moved to grant the request for the change order for the lift station for the wastewater facilities for regional pollution control, seconded by Mr. Roberts. No discussion. Mr. Roberts asked if we are contemplating appointing an Administra- tive Director for the South Central Regional Wastewater Treatment Disposal Board and after discussion, it was agreed that this would probably be discussed at the next Board meeting. -18- MINUTES - REGULAR CITY COUNCIL MEETING MAY 16, 1979 BOYNTON BEACH, PLORIDA Request for Council Approval on Application for City/County Recrea- tional Development Program Mr. Cheney refermed to submitting a proposal by the Recreation Director to carry out ~11,000 of additional development work at Pioneer Cabal Park on a 50/50 funding basis with Palm Beach County and stated this project hopefully~ will be funded by Palm Beach County in the next fiscal year. The request being made is for the City Council to make a 2omm/tment for its 50% share of this project which if done, would be included in the City's 1979-80 budget. He added Mr. Frederick has pointed out that he does not know for sure the County will have this money~ but they have had a program in the past and he hopes it will continue. This proposal will eon- elude the work to be done in this park. Mayor Harmening suggested the Council could direct the City Manager in the preparation of the next budget to include the City's matching share in the sum of $5~500 so the City will be prepared if the funds are available to complete this project. Mr. Strnad stated in relation to this particular area, he wonders if we could fence the place in and keep the vandals out of the place at night. He referred to locks and doors being broken and benches being ripped apart and supgested putting up a fence, lights and signs. Mr. Frederick agreed there were some rather severe problems approximately six weeks ago concentrated in the rest room facility, but advised he contacted the homeowners' association and Police Department and between the two groups the vahdalism has been reduced. During the past three weeks, we have had no problems. The people in the area are helping now. fence is very unattractive in a park area. Mr. Strnad asked if more illumination could be installed and Mr. Frederick informed him a night light was installed at the fishing pier and spot lights were installed on the sides of the rest rooms. Mr. Cheney added if the neighbors will observe this area and g/ve us a call, this is good protection. Mr. Strnad moved to direct the City Manager To incorporate in the next fiscal year's budget the City's mat~hin~ funds for the comple- tion of this particular park area in the sum of $5,500. Unification Church Mr. Vance informed the Council this application has been modi£ied slightly with the addition of the dates of solicitation from May 16 thru May 50, 1979. He then read a letter from the Secretary of State~ State of Florida, advising the Unifieat~9n Church is a bonafide reli~-ious institution and exempt fromregistration in this State. Mr. Roberts stated the fact the dates have been included makes it more palatable~ but most of this Council knows a permit was granted a few years ago and it caused a great many complaints To come into the City and as a result, the permit was cancelled. He thinks these complaints should be taken into eonsidemation. These soli- citations are done in person with going house to house and he does not know how aggresive these solicitations will be. We have con- dominium developments with signs posted not allow/no solicitations s/nee it is private property. Many people are retired and are en- titled to the quiet enjoyment of their homes. It is the responsi- bility of the Council to act on any complaints. Mrs. P~iscoe added she would also like to know how many people are anticipated during this two week period to influx our City? Mr. Chris West~sR1 referred to this concern being valid and stated he believes the privacy and protection of the citizens is very important. Two years ago, their permit was revoked because of complaints. However, he never SaW any of those complaints. He has done considerable research during the past Ewo weeks on news- paper articles. He is sure complaints will be received as many people do not like their organization or religious beliefs. They will leave when requested and there will be no problem. If they cause physical harm To people, there are laws ro protect that. If their members get out of I/ne, they are liable to the penal laws. After reading the newspaper articles, he thinks much of it was disagmeement with their religious organization. If a member does not te~ve when asked~ the resident can swear out a warrant and make a complaint. If one of their members does gee oun of line, that is no reason to keep out the whole organization. He sincerely believes none of their members will cause any physical harm to any people in the community. -20- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MAY 16, 1979 Mr. Roberts referred to soliciting in the private developments and Mavor Harmening added that many of these developments have private sEreets and nov public streets. The ad,scent property owners own the land vo the middle of the street and there is no public right- of-way. To approach any of the homes in certain areas, they have vo encroach upon private property. Mr. West~_~t replied if it is not posted and the members go to the area and are asked to leave, there is no problem. If it is posted, they will not go there. It is their national policy not go ~o where they are nov wanted if it is posted or an individual asks them to leave. The City has laws proteetin~ the residents. Mr. Roberts svated he feels if any great number of complaints come into City Hall and they appear ro be valid, he would hope the City Manager and the rest of the 2ouncil concur the per~it would be pulled. Mr. West~.ll replied if they are valid, they will cross that road then. He does not feel there will be any valid com- plaints. Mr. West~l referred vo the question asked of how many people and stated to begin with~ there would be ~ or 4 and 7 at the most. They will not be here two weeks straight~ but maybe only s day or vwo. They will not put 50 people in the community. Mrs. Riscoe asked if they intended Eo hand out literature at shop- ping centers and Mr. West~l replied they will have literature to hand out; but if asked to leave the shopping center, they will. Mayor Harmening added that we have an omdinance against littering and Mr. West-~l replied they will ask the people if they want the literature. He added that people were impressed in New York City after a mass campaign how they picked up after themselves. Mr. Strnad asked Mrs. Pad~ett if there are eny other religious denominations which solicit from door to door for monevary pur- poses and Mrs. Padgett replied there have been some permits for local churches, but local churches are exempv from solicitation ordinances. Mr. Strnad referred to some of the solicitation requests noting part of the money will be spent in the City where collected and asked if there is any intention of having any of these monies spent in this City and Mrs. PadgevE replied they are required to report back vo us the amoun~ collected and expenditures. Mr. Strnad asked if the ~goal" blank had Eo be completed on the form and Mrs. Padgett replied it is part of the form, but she does not know if it is absolutely necessary to have it filled Mr. Cheney asked Mr. West~.&~t! if he would be willing to prepare a letter which he would give to all the canvassers telling them not to persist~ leave when asked and respect private signs? He has found in the past the people soliciting do not know about these things. Mayor Hammenin~ asked where their established church was located and Mr. West~b~l in- formed him it is at 4906 Radiance Avenue, Tampa. He added they do have workshops in Miami, visit campuses and have rallies thmoughout the area. In the past, they have had a church in Miami. They foresee having a church in every commur~ty in the future. As with any organization~ it takes time to develop. Most of their work is restricted To mission work. Mayor Harmen/ng asked Mr. Vance if there is any criteria whereby we need To grant a permit for any specific period of time and Mr. Vance replied if a specific time period i~ requested, then the permit is granted for that particular time period. Mayor Harmening referred to many requests coming before this Council o~ which many are honored, many are turned down and many are modified and asked if this Council has the ability or authority to place any specific time limits on an application To solicit and Mr. Vance replied he would have to review the ordinance on that point. ~r. Roberts referred to his previous statements and stated it is the Council's responsibility To allow people to quietly and peacefully enjoy their homes and he thinks this Council has the authority to set time periods so it does nov become a nuisance. He doesn't see anything preventing this Council from making these applications conform to $ time period. Mrs. Riscoe stated she has received many calls also requesting this permit be denied for fear of ramifications of past experi- ences. We are working in a circle of things which have been bad in the past. Mr. West~?~l replied that it has been almost 1~ years since their organization has been here. He read many things which were said in the minutes and newspapers why people did not want their church ~o solicit funds in this community and he finds it was caused by religious prejudice on the part of the former City Manager. It has been almost two years and there is no reason to keep out their whole organization. There are local laws which can be enforced if the members get out of line. They have had some court eases in reference To this, but there will be no pro- blems. Mrs. Padgett advised that Mr. Frank Kohl had requested to speak on this item. Mr. Frank Kohl~ 94~ Isle Road, stated about 1~ years ago~ he did tell Mr. West~l he did not want him in City Hall and he would not allow him to solicit in this City through the City Manager's authority. He brought this to the Council and they agreed not to grant the permit. This Council should not be pussy footing around and should deny this request and fight it to the Supreme Court. This is not the proper k~nd of thin~ we want here in Boynton Beach. As a taxpayer, he will fight this church. He sees no reason to prohibit their organization. There have been many legal battles~ but it is not their desire to fight anyone in courv. He thinks the law is well established on their right to raise money. Mr. Vance stated in respect to the question regarding a time per- iod~ the permit is valid for 90 days and any shorter pebiod is the time listed by the applicant and in tb/s case~ it is two weeks. Mr. Roberts moved to allow the Unification Church to solicit, but he is not particularly happy with the length of time. However~ under the circumstances, he is willing to make a test case and see what happens. If any complaints come in~ he would hesitate to give any permit. Mr. Vance informed him the permit may be can- celled under the ordinance at any time. Mayor Harmening then turned the gavel over to the Vice Mayor to second the motion. Mr. Roberts clarified the permit would be for the period estab- lished in the application of two weeks.
