Harmening, Mayor Betty Riseoe, Vice Mayor David Roberts, Councilman Norman F. Strnad, Councilman Annette P. Tinker, Acting City Manager Tereesa Padgett~ City Clerk James W. Vance~ City Attorney Mayor Harmening welcomed everyone and called the meeting To order at 7:30 P. M. He announced the Invocation tonight will be given by Rev. James Roy, Pirst Methodist Church~ followed by the Pledge 6f Alle?iance to the Flag led by Councilman David Roberts. He requested everyone to please stand. AGENDA APPROVAL Mr. Roberts stated in deference vo Mr. Chancy, he would like to strike Item E under Section VIII. Mr. Roberts moved for adoption of the agenda as corrected, seconded by Mrs. Riscoe. Motion car- mied 4-0. ANNOUNCEMENTS Mayor Ha~mening announced the City Council of the City of Boynton Beach will conduct a phblic hearing on the proposed Boynvon Beach eomprehensive plan. The purpose of this hearing is to solicit input from the public prior To forwarding the plan to State and Regional planning agencies. The Public Hearing will be held on Wednesday, April 25, ~979, at 7:30 P. M. at City Hall. Mayor Harmening read a Proelamation proclaiming Monday, April 1979 through Friday, May 4, 1979 as Law Week U. S. A. MINUTES Regular City Council Meeting - April 3, 1979 Mr. Roberts referred to Page 6, second paragraph before the words Public Hearing~ and stated three words were omitted and corrected it to read: If we are not involved with administration "of the City~. Mrs. P/scoa moved for acceptance of the minutes as corrected~ seconded by Mr. Roberts. Motion carried 4-0. PUBLIC AUDIENCE Mavor Harmening ascertained that nobody in the audience wished to address the Council on any particular matter. He then announced if anyone in the 8udience wished to speak on any item on the agenda to please give their name Eo the City Clerk, Mrs. Padgett, and the Chair will recognize them when that item becomes the order of business. MINUTES - REGULAR CITY COUNCIL MEETING APP~IL 17, 1979 BIDS Clearing & Grubbing - Sara Sims Park Mrs. Tinker informed the Council that bids on the above were opeDed on Tuesday, April 10, i979, at 3:00 P. M. in the office of bur Purchasing Agent, Mr. William H. Sullivan. The Tabula- tioa Committee recommends acceptance of the low bid from Lot Service Company in the amount of $2,150.00. A copy of the Tabu- lat~on Sheet, Proposal and Affidavit signed by Mr. Hugh Byrd, Owner of Lot Service, are on file. Funds for this work are reim- bursed to the City through Account 001-000-115-87.00 - Palm Beach Coqnty Community Development Grant. Any questions on this bid should be directed to Mr. Sullivan~ our Purchasing Agent. How- eve~ Mr. S~llivan asked to be excused tonight on account of a family affamr. There do not seem to be any problems with the bid au all. Mr. Roberts referred to this bid being $2~!50 and the other one received being $7,500 and questioned if this was a reliable com- pany? Mr. Clark informed him this company has done one job for us and he understands they have done work all over the County and have done work for Community Development. Mr. Roberts moved to accept the bid as recommended by the Purchas- ing Agent and Tabulation Committee for the clearing and grubbing of Sara Sims Park in the amount of $27150. Mr. Strnad seconded the motion. No discussion. Motion carried 4-0. Sanitary Sewer Replacement Mrs. Tinker informed the Council that no bids were received for the sanitary sewer replacement. Mr. Sullivan and Mr. Law have requested permission from Council To have written proposals sub- mitted from some of the local utility contractors. If Council approves this recommendation, we will return with the proposals for their review before proceeding in any way. Mr. St~d moved to accept the recommendation of Mr. Sullivan and Mr. Law for the sanitary sewer replacement, seconded by Mrs. Riscoe. No discussion. Motion carried 4-0. PUBLIC HEAPING NONE SITE DEVELOPMENT PLANS Applicant: Location: Use: Joe Littell for First Financial Development N.E. 6th Court between Ocean Ave. & N.E. 2n~ Ave. 35 Unit Condominium Office Building -2- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 17, 1979 Mr. Joe Litte!l~ 1171 N.W. 15th Avenue, Boca Raton, came before the Council and referred to this plan having been submitted to the various competent people and Boards in the City and stated he is sure the recommendations have been forwarded to the Council. They proposed to build a four story office building east o£ First Bank & Trust between Ocean Avenue and 2nd Avenue. He showed a rendering of the proposed building. Mr. Strnad asked if compaction tests are available in the Build- ing Department for this particular piece of ground and Mr. Litte!l re~!ied that this site carries a permit which they have asked to be rescin4~d. He explained that other tests would be run and the site reworked. He also told about their experience. Mrs. P~iscoe moved to accept the site development plan for First Financial Development subject to staff recommendations and grant- ing the height exception subject to Section 4-F of the zoning code. Mr. Roberts seconded the motion. No discussion. Motion carried 4-0. Applicant: Location: Use: Jerry Aron for Ralph Biernbaum, High Ridge Country Club Hypoluxo Road East of the E-4 Canal Golf Course Mr. Jerry Aron, First National Bank Building, Palm Beach, advised this plan was before the Council for approval. This ~olf course will be located south of Nypoluxo Road and west of High P~idge Road. Ne showed a rendering of the proposed site. Approximately 176 acres will be used for the golf course with 150 acres being gmeen area and 26 acres for lakes. The area surrounding the golf course is not being pmesented at this time, but will be planned for future development. Also not included are three parcels in the golf course which eventually will be a club house, tennis hut and storage area. Mr. Roberts clarified that this is strictly a golf course and Mr. Aron agreed. Mr. Roberts commented that the acreage is ample. Mavor Harmening commented that it is rather unusual to have s presentation of a golf course by itself and it appears to be a first class installation and a welcome addition. Mr. Roberts moved for acceptance of this site plan, seconded by Mrs. Riscoe. No discussion. Motion carried 4-0. ~Cse Applicant: Location: Use: John Diehl for John Roth, L.J.R. Development, Inc. This application is for a eosmeEology lab, warehouse and offices at S. W. 30th Avenue and S. W. 14th Street. We did have an application for $ variance to the subdivision regu- lations which was approved with the provision the sewer facilities be Bonded and this is parr of this approval. The recommendation is to approve. Mr. Vance referred to the applicant not being present to express agreement Eo the staff recommendations and Mayor Harmening asked if he recommended tabling this application and Mr. Vance replied affirmatively. Mrs. Riscoe moved to table, seconded by Mr. Strnad. Mayor Har~ening added that we will come back to this if the appli- cant or representative arrives. Motion carried 4-0. LEGAL Ordinances - 2nd Reading - Public Hearin~ NONE Ordinances - 1st Reading NONE Resolutions Proposed Resolution No. 79-T - Re: Finding that a Prima Facie Case Sh~r~ing the Existence of a Nuisance, as Defined by Chapter 13 of the City Ordinances~ at the Ca~eway Square Shopping Center on S. W. 15th Avenue Mr. Vance read proposed Resolution No. 79-T by title. Mrs. Riscoe moved to accept Resolution No. 79-T as read, seconded by Mr. Roberts. No discussion. Proposed Resolution No. 79-U - ReT Appointment of Peter L. Cheney as City Manager Mr. Vance read proposed Resolution No. 79-U in its entirety. Mr. Vance explained that more time was needed to work out the retire- ment fund contribution with the Charter, but the amount has been added to the salary which the City will contribute td the retire- ment plan. -4- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 17, 1979 Mrs. R~scoe moved for the adoption of Resolution No. 79-U~ seconded by Mr. Strnad. Under discussion~ Mr. Strnad requested elarification of Section F pertaining to severance pay and Mr. Vance replied that it was his understanding from Mr. Cheney based upon discussions with the City Council, it was agreed if he was requested to resign or was discharged and had another job, he would not request severance pay. If he did not have a job available~ he would receive two months severance pay. Mrs. Padgett then took a roll call vote on the motion as follows: Councilman Roberts - Aye Councilman Strnad - Aye Vice Mayor Riscoe - Aye Mayor Harmening - Aye Motion carried 4-0. OLD BUSINESS 2onsider Amendment To Community Appearance Board Ordinance (Tabled) Mr. Roberts referred to not being prepared to discuss this and Mrs. Riscoe suggested striking it and having it wait for the new City Manager's review. Mr. Roberts moved to strike this particu- lar item, seconded by Mrs. Riscoe. Motion carried 4-0. Review and Discussion of Proposed Sign 0rdinancm (Tabled) Mr. Roberts moved to take this from the table, seconded by Mrs. Riseoe. Motion carried 4-0. Mr. Roberts asked if the additions or corrections had been made and Mr. Howell replied the only question he was aware of was the one by Councilman Strnad in reference to emortizin~ non-conform- ing signs. The reason this was not included in this sign ordi- nance was because it became s problem in West Palm Beach and the city was defeated on it ~n court. He explained that West Palm Beach amortized it based on the cost of the sign and the actual worth of the sign was brought out in courT. He told about not being able to find a wa~ to do away with non-conform- ing signs as long as they are maintained satisfactorily. Mr. Vance added that he thinks perhaps the West Palm Beach decision was not that clear-cut on doing away with non-conforming signs and his suggestion is the Council has the choice To adopt this ordinance in its present form or give his office the opportunity to get with West Palm Beach and review this case. Mrs. Riscoe moved to put this on the table until Mr. Vance has a chanee to check this out~ seconded by Mr. Roberts. MOtion carried 4-0. -5- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL I7, 1979 Consider Proposed Tree and Shrub Ordinanc~ (Tabled) Mr. Roberts referred thethe material the Council has had to review and stated this proposed ordinance is rather lengthy and should be studied and he has not had the chance to catch up on it. He then moved to strike th/s from the agenda~ seconded by Mrs. R/scoe. No discussion. Motion carried 4-0. Consider Appointment of Alternave Member to the Board of ~djustment (Tabled) Mr. Roberts moved to take this from the table, seconded by Mrs. Rismoe. Motion carried 4-0. Mr. Roberts nom/nated Mr. Carl Zimmerman To be appointed as an alternate member of the Boar~ of Adjustment, seconded by Mrs. Riseoe. Mr. Strnad moved that nom/nations be 21osed, seconded by Mr. Roberts. Mayor Harmening called for a vote on the nondna- tion of Mr. Carl Zimmerman and the vote was 4-0 in favor. Consider Addendum To Original Agreement - Sara Sims Mayor Harmening read Mrs. Tinkerts letter advising that Mr. Doug Dawson of the Commun/ty Development Program called at 2:30 P. M. on Friday~ April 13, to advised that they have reprogrammed the funds and have submitted an amendment to the original agreement allowing us an additional $612000 for Sara Sims ~ark only. This will become part of the original agreement and all conditions remain the same. The total for the improvements to Sara Sims Park is now ~251,000. He further stated that this would not affect his recommendation regarding the restroom, where he recom- mended we not exceed $45.00 per square foot for negotiating a contract for the restroom structure~ which is still pending~ but that the City was to make additional improvements To the park only. Mrs. Tinker added that Mr. Frederick advised that this $61~000 is for Sara Sims Park~ but the ~251~000 movers Sara Sims Park, the 1-95 strip park and the Wilson field lighting. Mr. Roberts clarified that actually the agreemen~ is ~ m.atter of adding S61,000 and Mrs. Tinker replied affirmatively and every- thing else remains the same. We are being given more money to spend on Sara Sims. Mr. Roberts moved to accept the amendment agreemenv with Community Development for an additional ~61~000 for Sara Sims Park, seconded by Mrs. Riscoe. No discussion. Motion carried 4-0. NEW BUSINESS Receipt of Correspondence from CiEy of West Palm Beach - Charges for Use of the County Landfill Area Mrs. Tinker referred To submitting a notice of March 28~ 1979, received from Mr. R/chard G. Simmons, City Manager of West Palm -6- MINUTES - REGHLARCITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL !7, 1979 Beach, wherein he indicated he would like To meet with those cities who are now paying the Board of County Commissioners for the use of their landfill area. She attended this meeting with Robert Fe!tz and Freddie Patrick of our General Services Department~ and found it to be an informal as well as an informative meeting. It was pointed out that the charges for use of the County landfill area are extremely high~ and in addition a portion of these charges are used to support county-wide services such as mosquito control. Our eosts last year to the County were ~!!0,000. As indicated in his second letter dated April 9, ~979~ he would pre- fer that the County continue to operate the landfill on a not-for- profit basis, and that all users be charged equally. This is for informational purposes only as she feels certain that his plans are in the preliminary stages. She did not commit the City in any way as we have no idea as to the cost involved or the benefits we could derive from his proposal that the City of West Palm Beach operate a landfill facility on City-owned property north of the Regional Sewage Treatment Plant in West Palm Beach. At this point, Mr. Simmons is asking for confirmation from each of the cities as to whether or not they are interested in proceeding further. However, Mr. Simmons is of the opinion that when the County learns some action is being taken by the seven cities involved, the County will "bend'~ under pressure and this pro- posal will never materialize. Mavor Harmening stated it is the Chair's feeling we have been getting overcharged without question for using the County land- fill, especially in regard to the uncompaeted trash. However, in one sense, he thinks we should support this proposal to more or less sustain our objection to this overcharge. However as far as the City of West Palm Beac? using their landfill area that far north, it would be uneconom/eal from the standpoint of hauling that far. In order to haul that distance, we probably would have to put on at least two more trucks and~ivers. Mrs. Tinker replied that this was discussed and the possibility of having a transfer station at our landfill -area if the City went into it, but she really doesn't think we will have To go that far. She added that it would be twice the distance to travel to the West Palm Beach site. It was also pointed out that the County has no scales, but are just looking au the load and determining the price. She then told about reading an arti- cle in tonight, s paper stating Commissioner Kaehlert question~dg why scales were not used. She thinks the County should have scales so we can be reasonably charged. Mayor Harmening stated the County did buy scales a couple years ago, but they were never used. Mr. Roberts questioned how many cities had shown an interest in this and Mrs. Tinker replied that all seven cities had represen- tation at the meeting. -7- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLOP~IDA APRIL 17, 1979 Mayor Harmening suggested that we go on record supporting this idea as with the ~onstruction of a transfer station, it might be economically feasible. Mrs. Tinker agreed the Council should indicate their interest. She does not know what it would cost the City or whether it would be worthwhile, but will bring it to Mr. Cheney~s attention when he comes on board. Mr. Roberts suggested having the Acting City Manager send s letter advising that we are interested and requesting that wi be kept posted on any progress being made. Mr. Vance suggested also noting that the Council feels they are bein~ overcharged by the County. Mayor Harmening agreed there was no-question about being overcharged. He explained how they consider the size of the ~ruek and not how it is compacted. Mr. Roberts moved to send a letter per his suggestion including Mr. Vance?s suggestion, seconded by Mrs. Riscoe. No discussion. Motion carried 4-0. Consider Abandonment of Royal Palm Clubhouse - 554 N. E. 22nd Av~. Mayor Hammening referred to this clubhouse being in pretty bad shape and questioned the Council's pleasure on this. Mr. Strnad replied before deciding on anything, he thinks it should be thought over carefully. There are many elderly people in this particular section and he believes this structure has been there for 20 to 25 years. There are not many recreation facilities available at that end of the City. By being able to use that for their card games, Bingo, eve., they are, in effect, not using our other recreation facilities. He thinks if this bbuilding is in such deplorable condition that it must be torn down that we should think about replacing it with something for these people. If there is a possibility of repairing it, he thinks it should be done; but it should be thought over carefully. Mayor Harmening replied that Mr. Strnad's remarks are somewhat parallel to his, but he has gone a step further. He believes the best course would be for the Council to direct the City Manager to have the Building Department and Purchasing Agent check on the price, not go out for bids, for the existing structure to be demolished and contract for construction of a new building very similar in size, perhaps slightly larger, and come back to the Council in the very near future with some approzimate figures of cost and time involved. Mrs. Tinker stated this was discussed with Mr. Howell and he is of the opinion, in addition to the $9,000 to take care of the cosmetic appearance, it would cost approximately ~25,000 wiry the City doing the work to bring it up to standard. Mayor Harmening remarked that this would seem like throwing good money after bad as with renovating the old shell, it still would not have a great life expectancy. He believes the best course of action would be to demolish it and construct a new building. He is not speaking of drawing plans, but we could gev some ball park guestimates. With time being of the essence, s penalty clause should be in- eluded as part of the contract. To put up a properly planned shell will not take long. -8- MI~dTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH~ FLORIDA APRIL 17, 1979 Mr. Roberts stated that under these conditions~ perhaps this should be tabled until getting more infommation. Mr. Howell came before the Council and stated he is concerned about people being in this building. He referred to it being used for the election next month and told about the buitding~s deterioration. He ~ecommends if it is going to be used for the election that it be reinforeed with some suppor~. Mayor Harmening referred to the Buildin~ Service Department doing tb/s and ques- tioned the cost for such a temporary repair and if it would cost a couple hundred dollars and Mr. Howell replied affirmatively. Mayor Harmening suggested that after the election that it be shut down with Mrs. Tinker being requested to instruct the Building Department and Purehasing Department to expedite this matter and report at the next meeting. Mrs. RIscoe moved to instruct the Acting City Manager to tell Mr. Alters to go ahead and get this building in shape for the forthcomin~ election and get guestimates fo~ a shell type situa- tion for a new building at 554 N. E. 22nd Avenue. Mr. Roberts seconded the motion. No discussion. Motion carried 4-0. ADMINISTRATIVE Consider Draft Ordinance Presented by City Attorney as it Pertains to Trees Affected by Diseases and the PrOperty Owner's Responsibi- lity for Removal of Same Mr. Vance informed the Council he reviewed the existing ordinances of Delray Beach and Lake Worth and has !~ft a couple blanks in this proposed ordinance. He referred to the blank at the end of the first page and advised that Lake Worth and Delray Beach have ten days. For the blank in Paragmaph D, Page 2~ third line, Lake Worth and Delray Beach have ten days. For the blank for the in- terest rate in Paragraph B, Page 2, Lake Worth has 6% and Delray Beach has 8%. Mr. Roberts referred to ten days being short notice and Mrs. Riscoe and Mayor Harmening agreed. Mayor Harmem/ng suggested that ~0 days would be more appropriate. Mr. Roberts suggested D0 days in both places. He added that 6~ interest is k/nd of out-dated and he th/nks it should be 8%. Mr. Roberts referred to this being discussed previously and suggested mak/ng the insertions of ~0 days in Section ~, Para- g~ap~ (a) and (d); and 8% in Section 5, Paragraph (b). Mayor Harmening clarified that this would give an owner a total of 70 days. Mr. Vance clarified that he w/ll fill in the blanks with 30 days, 30 days, 10 days, and 8%. Mayor Harmening agreed and announeed it will be brought back to the Council for first reading at the next meeting with these insertions. Proposed Comprehensive Plan Mr. Annunziato stated he is pleased to forward to the City Council the Compf~ehensive Plan since the Local Planning Agency has com- pleted their review. Several dates have been refermed to in his memo. One is the April 25th Public Hearing the Council will hold. The second issue we should address is the issue of an extension. He points out in h/s memo that it is entirely possi- ble to eomp!ete the plan and have it reviewed by the State and Regional Agencies by July 1; however~ it is his feeling the State is going ro be the recipient of a plan crunch. He suggests that an extension of 60 days be requested which he feels is reasonable for State and regional review. Mr. Annunziato continued that after the public hearing~ this should come up again at the next Council meeting, hopefully with recom- mendations from the Council to transm/t the plan. At that time, we will have to indicate the date, time and place of the adoption hearing. He programmed this into the future and suggests this be done at the seeond meeting in August. Mayor Ha~mening suggested the best action would be a directive from the Counei! to the City Manager to apply for a 60 day exten- sion. Mr. Annunziato agreed and stated this should be an offi- cial request when the plan is transmitted. Mr. Roberts questioned if there were any problems locally and Mr. Annunziato replied negatively and told about the Treasure Coast Regional Planning Council work/ng cooperatively with us. Mrs. Riscoe moved to direct the City Manager to direct Mr. Annunziato to get in touch with the proper people regarding an extension, seconded by Mr. Roberts. No discussion. Motion carried 4-0. Consider Resolution for Demolition of Structure and Clearing of Land in Conjunction with Community Development Proiect Mrs. Tinker requested the City Attorney to be directed to prepare the appropriate document to demolish the following structures and clear the land. This is in aeeordanee with Chapter !4-A of our Code of Ordinances and in eonjunction with our Community Develop- ment ProjecE. This list was submitted to her office by our Building Official, Mr. Edgar E. Motion carried 4-0. Mayor Harmen/ng announced that he received a note advising that the representative for the L.J.R. Development Site Plan had ar- rived and suggested reverting back to this item on the agenda regarding site plan review. Mr. John Diehl came before the Council and stated he was in agree- ment with the staff eommenEs made on the site plan. Mr. Roberts asked if this is one building and Mr. Diehl explained that it is a 30,000 square ft. warehouse building with a 37000 square ft. office attached to it. It will primarily be warehouses with about 5~000 square feet used for cosmetic manufacturing. Mr. Roberts referred to the staff recommendations and Mr. Diehl replied that he was in agreemen~ with them. Mrs. R/seoe moved to accept the site development plans for John Diehl for John Roth, L. J. Mrs. Tinker advised that she has To make a change in her reeom- mendation. It was requested that the funds to cover this salary come from the I% of eonstruction cost for subdivision improve- menus collected from developers; however, in talking to our Acting Finance Director, she pointed out we could not use these funds as they are in the General Fund and engineering should be paid from the Utilities Fund. She anticipates no problem as additional sewer revenue will cover this, Mayor Hammening re- plied that he hates to take exception to the Acting Finance Direetor~s opinion, but engineering work is generating funds for the General Fund and this is the most appropriate place to take the funds from. Mrs.~inker stated that the auditor will not stand for co-m~ngling of the two funds and Mayor Harmening re- plied in the past, we have funded the Engineering Department on a pro-rata basis depending on the workload and part of the work- load is attributable to utilities and part is attributable to other activities according to Section 64FF of the bonds. He would like a copy of the auditor's response to this. He added that perhaps it would be in order to authorize the hiring of this additional help and come back at a later date with the f~nding arrangements. Mrs. Riscoe moved to go ahead and hire an Engineering Inspector, seconded by Mr. Roberts. Under discussion, Mr. Roberts stated in the past, we have taken money from the General Fund when engineers have worked outside of the utilities and Mavor Harmening agreed and added that there would be no co-~ingting of funds if the Finance Department keeps track of them in the proper manner. We did mention at the beginning of this year if theme are extenuating circumstances, this should be con- sidered and she believes we should allow Mr. Lou Prezioso to remain in membership. Mrs. Padgett added that Mr. Prezioso did attend the meeting last night. Mayor Harmening added that he is certain Mr. Prezioso will make an excellent ~ontribution to the Community Appearance Board and agrees with the Vice Mayorts feeling on this matter. Mr. Vance referred ro there being a question regarding the appro- priate letter of credit and advised that the letter of credit has been received and is in acceptable form. Consider Replacement of Supervisor of Sewage Treatment Plant Mrs. Tinker referred to Mr. Matthew Filipowics having suffered a stroke some time back and advised that Mr. Gomdon Burkhart, who is an "~ Certified Operator, has been placed in this posi- tion as Acting Supervisor of the Sewage Treatment Plant. She has submitted Mark Lawts recommendation regarding Mr. BurkharE. However, in duseussing this with Mr. William Sullivan our Per- sonnel Director, he advised her that Mr. Melvin Colgin, Super- visor of the Water Treatment Plant, also holds the "W' Certifi- cate in waste water and she asked that he approach Mr. Colgin as to whether or not he felt he could handle both positions. -13- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH~ FLOP~IDA APP~IL 17, 1979 Mrs. Tinker continued that s memorandum from Mr. Sullivan was submitted indicating that Mr. Colgin will accept this position. Also Mr. Sullivan recommends that he be reimbursed the sum of $50.00 per week extra for assuming the additional responsibili- ties of the sewer plant. She concurs with the recommendation of Mr. Sullivan and requests CouncitTs approval. Mr. Roberts clarified that Mr. Colg~n will be takin~ on additional duty and there will be no need Eo hire anyone and M~s. Tinker agreed that Mr. Colg~n will take care of both plants until the sewage treatment is phased out. MOtion carried 4-0. Budget Transfer Requests Fund Balance/Various Departments Mrs. Tinker referred to these being for capital outlays approved by the Council at the April 3 meeting. She added that these are not all the items as we have not obtained prices for the dumpsters and ambulance and equipment. Deputy Chief Hamilton added that new ones just went into service which went out for bid quite awhile ego. Fund Balance/Workmen's Comp & Contractual Dump~ Mrs. Tinker informed the Council this transfer is to cover addi- tional Workmen?s Comp per audit adjustment and to re-imburse con- tractual dumping for funds used to pay for garbage packer. This will now leave a total of $513,236 in the Fund Balance Account. Mrs. Tinker added that we did write to the County to install traf- fic lights at the two fire stations and that is not to exceed $21,000, so the Fund Balance will be $492,236. Mavor Harmening clarified that will be the balance when the budget'transfer is made. -15- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA APRIL 17, 1979 Mr. Tom Clark told about Mr. Walker contacting him and possibly not being in ag-~eement with the ~21,000 price as they might have to get contractors to do this work. The $21,000 price may not be firm. He requested the County to send a letter regarding the cost. Mrs. Tinker stated she thought we had a letter stating ~21~000 and they would do the work. Mr. Clark replied that he does not know if the price was written~ but he did get the information ovem the phone that it would cost 421,000. When Mm. Walker received the letter from Mrs. Tinker requesting this work not to exceed $21,000, that is when he received the call from Mr. Walker. They may go out for bid because of not having the staff to do this work and the price might be more. He requested Mr. Walker to send a letter to Mrs. Tinker advising what he thinks the cost might be. Mayor Harmening asked if we have given authorization for the County to proceed with these lights and Mrs. Tinker replied affirmatively with the cost not to exceed 421,000. Mrs. Tinker questioned the amount we are talking about now and Mr. Clark replied that he doesn't think Mr. Walker knows, but he does not want to obligate the County to a max/mum amount of $21,000. Mrs. Tinker stated since she has just been told about this, when ~he receives the letter~ she will bring it back to the Council for a determination. Mavor Harmening stated it is the ChairTs recommendation that since we have been getting along without these and the traffic is decreasing at this time, possibly let the County sched~&~ these installations at their pleasure and have the County do it. Mr. Clark agreed this was probably a good solution and he would talk to Mr. Walker about this. Mr. Roberts referred to the County going out for bid on these and questioned the advantage and Mr. Clark referred 5o a news- paper article complaining about the County takin~ work away from private companies and he does not know if this is related, but possibly the County has backed off and is allowing private contractors to do the work. Mayor Harmening referred to both these locations being on state roads and stated the primary responsibility resides in the County Engineering Department. Mr. Strnad stated it was his understanding when lights are stalled that we get a better price from the County than if we had gone out for bid ourselves and Mavor Harmening agreed this was correct. Mr. Clark added that the County offers this ser- vice. Mr. Strnad suggested possibly going out for bids on the lights ourselves and Mrs. Tinker replied she will bring the letter back to the Couneil when received and a decision can be made. She thought $781 was high, but they have submitted a break- down and that is what it comes to for their assistance in finding a ~inance Director. Mayor Harmening stated we employ a Personnel Director to handle these matters. Rather.than get them involved to the extent where any monies are due, especially in the sum of $78!7 it would have been a simpler matter to see if they knew someone to recommend and we could have solicited those individuals. Mrs. Tinker agmeed and seated she and Mr. Sullivan discussed this and did not realize we were going to get 2harged to this extent. Mayor Harmening stated it appears the City ManagerTs office has made a commitment to Carpenter, May L Bremer and he believes it is in- cumbent upon the City to pay the bill. Mrs. Riscoe moved to pay Carpenter, May & Bremer the emoun~ of $78!. Mrs. Tinker clarified that she did not make a commitment, but this was between Mr. Sullivan and Mr. Hutchfnson. We did not realize we were getting charged these hourly rates for them to come down to interview. They asked to review the applications. It was a question of being helpful in the matter.
