Mayor Jackson weldomed everyone and called the meeting to order
at 7:30 P. M. She announced the Invocation will be given by
Mr. Frank Kohl~ City Manager, and the Pledge of Allegiance to
the Flag led by Vice Mayor Edward P. Harmening. She requested
everyone to please rise.
AGENDA APPROVAL
Mr. Kohl referred to the Housing Authority agreement and Mayor
Jackson explained that the agenda was printed before the meeting
last Thursday night when the Council voted to rescind the refer-
endum and this will be added under Old Business.
Mr. Kohl referred to Administrative and advised that he did
w~ite a letter to the County ComMissioners regarding N.E. !0th
Avenue as directed at the last meeting.
Mr. Roberts moved for adoption of the agenda as corrected,
seconded by Mr. DeMaroo. Motion carried 5-0.
ANNOUNCEMENTS
Mayor Jackson announced that City Hall will be closed on Thurs-
day and Friday, November 23rd and 24th, 1978, in observanoe of
Thanksgiving with November 24th taken in t~u of Veteran's Day.
Mayor Jackson announced that the next City Council meeting will
be held on Wednesday, December 6th, since the election is on
December 5th and the Charter calls for this action.
Mayor Jackson stated if anyone wished to speak on any item on
the agenda to please give their name to Mrs. Padgetto

PUBLIC AUDIENCE
Mr. John Jameson, 649 Las Palmas Park, came before the Couneit
and stated it was with great pleasure that as Chairman of the
Boynton Beach Community Improvement Forum he can report the
pancake and sausage breakfast was a success. He requested the
members present of the Community Improvement Forum to stand.
He referred to their efforts netting a profit in this civic
undertaking and presented a check for S225 payable to the City
of Boynton Beach to be used as their donation for the Library
Pund of our City. Mayor Jackson thanked him and suggested that
the City Manager send a letter th~ng them for their check.
BIDS
One (1) Backhoe (For Cemetery)
Mr. Kohl informed the Council that bids on the above were opened
on Tuesday~ November 14, 1978, at $:00 P. M. in the office of our
Purchasing Agent, Mr. William Sullivan. The Tabulation Committee
recommends acceptance of the bid from Trail Ford Tractor Company
of Lake Worth in the amount of $3,774.00. Engineering Machine
Company, Inc. of Delray Beach was the low bidder; however, they
did not meet specifications. A copy of the Tabulation Sheet,
Proposal and Affidavit signed by Mr. C. W. Smith, Vice President
of Trail Ford Tractor Company, have been submitted. Ail legal
requirements have been met. Funds for the above purchase are
available in the Cemetery Account No. 631-8~5-587-60.45. He
concurs with the ~ecommendations of the Tabulation Committee.
May he have Co~ncilTs wishes on this matter.
Mr. Ca~dwe!l questioned the major difference between the bids
because the price varied S300 and Mr. Kohl replied that Mr.
Sullivan was not present and he looked into this with the people
from the cemetery and the engineers. Mrs. Padgett explained
that the one bid did not provide the right bucket. Mayor
Jackson clarified that this money will come out of the Cemetery
Fund.
Mr. Caldwell moved the granting of the bid to Trail Ford Tractor
Company of Lake Worth in the amount of $3,774.00. Mr. Roberts
seconded the motion. No discussion. Motion carried 5-0.

Mr. Ca!dwell asked if this was going to be a permanent structure

Mayor Jackson referred to people havin§ the understanding that we
are going to do away with all dog licenses and clarified that this
is not true. We have had double taxation with dogs having to be
licensed in the City and County and this ordinance eliminates the
City requirement, but all dogs must have a County license.

OLD BHSINESS
Housing Authority Agreement
Mayor Jackson referred to voting at the Workshop Meeting last
Thursday to turn the agreement over to Mr.~ Moore to study to see
if the addendum could be included as part of the main agreement.
Mr. Moore informed the Council that he discussed this with Mr.
· Barry Seaman and in his opinion, it would not be part of the main
agreement unless incgrporated. He added that Mr. Seamanmentioned
under the rules and regulations of H~D~ a specific area cannot be
designated.
Mr. Mike Meha!ic, 327 N.E. 15th Avenue, appeared before the Coun-
cil and stated he didntt know how many were here last week, but
on this H/iD question, they want to be the kingfish on everything.
The City Council nor any of us would have anything to say what
they are going to do or where. Has the ~ousing Authority come
up with a special area? Mayor Jackson replied that they have not
and explained that an addendum was submitted signed by four mem-
bers of the Housing Authority but it is not part of the agreement.
Mr. Mehalic referred to the City Council bein9 elected by the
people and stated that they have voted against this and he would
like to hear the people back our City Council on this. We
don't want here in Florida what they have in Washington, Manhattan~
and New Jersey~and the City should be able to say what to do and
how to do it. He is not against anything and would like that
section to be straightened out, but he wants our offieia!s to say
how it is to be done. He came here because Florida is a good
place to live and we must protect where we live. He referred
to a fami!y in New York living in a b~g hotel several years ago
with the taxpayers paying for it. He is in favor of tearing
down the Dlaces~ but we should have somethin9 to say how they
are going to do it and what they are going to do. The City
Council should stick ~o their guns and the people will stay
with them.

Mr. Lo~is Pinto came before the Council and stated he w~uld like
to talk about our friendly government. He has lived in the north-
west seetion 17 years. Itwas a r~ce q~iet neighborhood and then
the H. S. Government, our friend, came in and built the homes
along Seacrest Blvd. It was called low cost housing. The condi-
tion of these low cost homes today is that 1/4 are Boarded up and
60% he would not put his dog in. Now, HUD wants to come in and
rebeautify these homes and that is cur money they are spending.
He is disenheartened if the City Council goes along with this.
We do not need the U. S. Government telling us what we are going
to do. He hopes the Council will turn this down. We don~t need
them.
Mrs. Goodie Goldberg,~member of the Housing Authority, came before
the Couneil and stated she was not prepared to speak tonight~ but
told how she was so upset after hearing these statements. There
is a complete misunderstanding of what is taking place here.
The City Council decided 1~ years ago there was a need for a
Housing Authority. There is a need for good housing to get rid
of substandard housing in the northeast and northwest sections
of Boynton Beach. The Housing Authority has done a tremendous
amount of work and put in a lot of hours. She personally has'
nothing to gain. She has no ax to grind with anybody. There are
five members on the Housing Authority and they try to help people
who need some help. This help is for somebody who cannot help
themselves.and she explained how some people did not have the
same opportunities as others. A black person is handicapped by
their color and on top of that~ they are handicapped by where
they are living. She told about the cleanup project the Housing
Authoritywas involved in. She told about the demolition program
in effeet and how houses were needed for the people being relocated.
She clarified that the 2.2 million dollars from the Federal Govern-
ment is only for rehabilitation. It is to rehabilitate buildings
to be made into something habitable. Are they opposed to someone
going in and making these homes habitable?
Mayor Jackson referred to it being 8:00 P.M. and announeed that
it was time to hold the Public Hearing and advised that Mrs.
Goldberg would-be given the chance afterwards to ~inish.

Mr. Kohl informed the Council that the Planning g Zoning Board,
after conducting a Public Hearing at their regular meeting of
November 14: 1978, unanimously recommended that the rezoning
request submitted by James B. Day~ Tmustee, to rezone f-rom R-1AA
to C-S, the above 1.88 acres (more or less) be denied. The motion
to deny was made by Mr. Arena and seconded by Mm. Winter. A
sketch showing the location and excerpt from the Planning g Zoning
Board meeting minutes coverinc the above request have been sub-
mitted. May he have CoUncil's wishes on this matter please.
Mr. Hank Thompson, representing the partnership t~ust owning the
property~ came before the Council and showed aerial photos of the
area. He explained that th~s pamcel outlined was zoned C-1 in
its entirety in !971. In 19747 a new master plan was proposed
and a map prepared and hearings held. He appeared before the
Planning & Zoning Board at that time resisting this proposed
change and was told by Mr. Joe Ke!ly~ Chaimman of the Planning &
Zoning Board, that their recommendation to the Council was to
zone this parcel in its entirety C-3. They did now become aware
of the fact anything had happened to change the zoning of this
parcel until about 1~ months ago when this was sold in its
entirety to a la~ge department s~ore. They were advised this
little parcel was e×isting, apparently in error, as R-1AA. He
was told it was impossible to correct this error and an applica-
tion for rezoning had to be subr~tted. He feels an honest error
was made in 1975. He is asking for a correction since this was
zoned commercial in its entirety at one time. He did not meet
with a favorable response ~rom the Planning $ Zoning Board and
would like to advise they would be happy with C-1 zoning for
this little parcel. This parcel is needed for parking.
Mr. Caldwell clarified that the little parcel was originally
zoned C-1 and Mr. Thompson agreed. Mr. Caldwell asked if he
spoke before the Council at the time public hearings were held
on the rezoning and Mr. Thompson explained that he did not come
before the Council because after appearing before the Planning S
Zoning Boamd~ he was told they were in agreement and notification
would be sent regarding the outcome. He was advised verbally by
Mr. Joe Kellyand Mm. Bushnel!~ the Building 0ffiaial~ so he
did not pursue the matter further with the hearing before the
Council because they assumed the zoning would be intact with C-3.
Mr. DeMarco referred to Mayor Jackson being.~a member Wf the
Couneil at that time and asked whether she recalled this parcel
being rezoned inermor and Mayor Jaekson ~eplied she did not
realize it at the time it was changed. Mr. DeMar~o questioned
whether there was actually anerror and Mayor J~ckson replied
that she thinks a straight lin~ was just drawnaacross.

Mr. Clyde MeElroy, !9 Velaire Drive, stated that he lives directly
across the street. He feels they have been sold out. Mr. Thompson
developed this area as a residential section. He referred to the
general rezoning in 1975 and stated he has hot been able to find
one personon Velaire Drive who was notified of this rezoning.
If the property goes as proposed~ will there be access off Hoadley
Road to the department store and Mayor Jackson replied that this
could be taken care of when the site plan is approved. She added
that she would be very mucin opposed to anything going out on
Hoadley Road and there should be a buffer wall. Mr. McElroy
added that there should be a buffer zone to protect the residents
from the parking lot of the store. Also, how can the roads
handle the traffic from a store of this magnitude, 16 acres?
Mayor Jackson referred to the mention of nobody bein§ notified
of the rezoning and clarified that nobody was notified individ-
ually but it was advertised and hearings were held for the whole
City. Mr. Harmening added that two days were set aside for public
hearings and a full house was in attendaneeeboth days. It was
advertised but individuals were not noti~f-~ed.
Mr. Herbert Cole, 1249 Gondola Court, stated at the Planning g
Zoning Board meeting, the Planning Engineer and Planning &
Zoning Board advised against this property beeoming commercial.
He thinks there is plenty of commercial property available
without rezohing this section at the expense of the residential
section bordering it. He would appreciate it very much, and is
sure the rest of the people living in that area Would, if the
Couneil would concur with the recommendation of the Planning &
Zoning Board, Engineering and Platting Department.
Mr. Caldwell questioned theeaeess read to this strip of land
and Mr. Annunziato replied that it is platted and deadends at
The Villager; the entire piece of property borders on Congress
Avenue, Old Boynton Road and Hoad!ey Road.
Mayor Jackson referred to buffering being required and Mr.
Annunziato clarified wheneommereiatlyzoned propertyabuts
directly against residential, a wall would be required; but
when it is across the street, it is not required.
Mr. Thompson clarified that this propertywas all zoned commer-
cial in 19YI and if anybody suf£ered, it was the owners in 1975
with the commercial zoning being taken~away. If it is an easier
path to follow, he will accept C-1. Mr. Caldwell replied that
he certainly would like to have C-1 or C-3~ but he questions
whether that little square of land is absolutely necessary.
in his 9pinion~ it looks llke it is cutting into an existing
residential neighborhood as it exists today whiehconeerns him.
An injustiee may have been done in 1975, but he is certain a
good deal of houses have been built in that three year period.

Mr. Thompson stated that five new houses were bbui~t in that
period of time within 400 feet. He added that there is also
a canal east of that propertyand the original right-of-way was
60 feet. They discussed further the houses in this area.
Mr. DeMarcoaasked if he would be in agreement not to use Hoadley
Road at all and Mr. Thompson replied that he did not think he
could speak for the people involved. Me does not think they
intend to use Moadley Road~ but would improve it if they do.
The main entranee will be off Congress Avenue. The purpose
for this parcel is for parking and it will be landscaped. Mr.
Harmening referred to the total parcel consisting of 16 acres
and Mr. Thompson.agreed and clarified that it is 17 acres in-
eluding this pareel and 15.2 without. The property has been
held intact bemause you can obtain better usage for a larger
parcel of property.
Mr. McElroM stated that the people on Velaire Drive do not feel
they can aceept Mr. Thompsonts assumption that Hoadley Road
will not be used. He lives directly across the street and
has lived there for 17 years and it was developed as residential.
He feels the City owes protection not to allow a thing like this
to happen.
Mr. Cole stated that the rezoning was for a department store
which they are naturally against and now, theyare talking about
putting a parking lot there. He does not think they realize
what a detriment that would be and he referred to the lighting,
noise, etc. The people have invested moneyin their homes know-
ing it was a niee residential area. He again requests the Coun-
cil to deny this change in zoning as eventually it will destroy
the whole area.
Mr, Harmening clarified that the main tract is presently~zoned
C-3 and while he realizes this additional 250 feet is sort of a
further intrusion, the main body of the tract is as close to
most of the homes. Mayor Jackson added that we cannot keep a
department store from building onthe main section as it is
zoned properly.
Mr. Roberts stated he doesnt,t think we are in a position to
encroach in that residential neighborhood because of an
which was supposed to have been made. He feels it should have
~been corrected at the hearing er shortly thereafter. His sug-
gestion is to develop this on its original basis and when the
time comes in the future when the neighborhood is more aecli-
mated~ there may be no harm in asking for additional parking.
He would be inclined to go along with the recommendation of the
Planning g Zoning Board at this time. Mayor Jackson stated that
if this is turned down to~r~ht~ theyeannot come back for
months and Mr. Roberts agreed and added that it may be completed
by that time and the neighbors may have a different attitude.

Mr. Caldwe!l stated he agreed with Mr. Roberts. This piece does
jut into the residential. He is sure the proposed tenant could
possibly afford to sea!e down the overall size. He does not
know if it would drastical!yaffect the overall plan.
Mr. Roberts made a motion to go along with the recommendation of
the Planning $ Zoning Board to leave the zoning as is, as it was
rezoned in 1975. Mr. Caldwell seconded the motion. Mayor Jackson
clarified it was moved and seconded to reject this application.

Mr. Kohl informed the Council that this is a new rezoning request
per the CouncilTs request ~or the developer to go back to the
planning department. A new information sheet has been submitted
showing the changes and sketch of the area and also includin~ the
LUI, net and gross densities. The old density was for 509
garden apartments, 51 townhouses, and 80 villas; it has now been
changed to 22 single family homes, 101 villas, 20 townhouses and
307 garden apartments. Mayor Jackson clarified that it was a
reduction of 190 units. Mr. DeMarco asked if the maximum would
be two stories and Mr. Kohl informed him that it would be three

Mr. Harry Kirsner, representing the appticant~ referred to the
origina~ plan having 640 u~its and four stories and stated they
have compromised to three stories and cut the density from 20
to !5 units for the garden apartments. When annexed, the County
gave 6 units per acre and the City gave 7.1 and they have now cut
down to 4.25 um/ts per acre and because of the size of the lake~
they needed that configuration. He explained that the donation
to the City would be 4.14 acres~ 3/4 acres more than required.
He then explained the modifications made to the plan. He added
that Woolbright Road would be dedicated to the City and explained
that they would not have frontage on it. He explained that they
were still making the traffic improvements required although not
required with the changes to the plan according to their traffic
engineer.
Mr. Ca!dwell questioned the aet density and Mr. Kohl replied
that it is 7.5 now and the gross is 4.25.
Mayor Jackson ascertained that nobody wished to speak in favor
or opposition to tlmis request.
Mr. DeMarco asked if the one story buildings would be compatible
to the surrounding areas and Mr. Kirsner replied that they would
be even nicer. Mr. DeMarco asked if the two story units would
be around the lake and Mr. Kirsner clarified that the garden
apartments will be around the lake and they have buffered
Cranbrook Estates with single family homes and villas. Mr.
Roberts referred to the setback along Congmess Avenue and Mr.
Kirsner explained that tleebui!dings will be along the lake with
the parking area on Congress Avenue buffered with landscaping.
Mayor Jackson questioned the units per acre allowed if this were
to be developed as a PUD in single family homes and Mr. Annunziato
replied the~ probably would be able to build 3 to 3~ unitspper
acre on the dry land; approximately 180 units if all single family.
A gentleman in the audience asked if this was the first develop-
ment permitting three story units west of Congress Avenue and
Mr. Annunziato replied that the Meadows and C g H will probably
build four stories as they are allowed by ordinance in the PUD.
Mr. Roberts stated that this development like some of the others
has reduced to a reasonable density and the rights-of-way and
other lands have been given. He believes an agreement was made
with the School Beaird. He does not see any reason to h~ld it up.
Mr. Roberts moved to accept this rezoning request for 105 acres
for Faber & Kirsner for Frederick Zeiger, Trustee, seconded by
Mr. DeMaroo. Under discu, ssion, Mr. Caldwell stated he is con-
cemned about Golfview Harbour having new two story townhouses

with a landscaped buffer and believes this should have the proper
landscaping and parking areas and Mr. Kirsner informed him that

Kohl informed him that it must comply with the PUD ordinance.
Mr. Moore added that we needed the 15 ft. easement to tie into
the sewer plant and these people gave it to the City and it is

Mrs. Goldbemg returned before the Council and referred to being
upset from hearing the statements made and clarified that the
funds being asked for are for rehabilitation only. On what

moral ethical grounds can these people be denied the opportunity
to upgrade their living conditions which have been labeled sub-
standard housing by our Building Department? She asksd the
Council to search their souls as well as their minds in making
a decision tonight. She is interested in making Boynton Beach
a better place for everyone~ ~or all citizens. Before condemn-
ing the goverr~nent's financial help, think if Boynton Beach
could survive without money for edueation~ health and welfare,
sewage and water systems, parks, beach and recreation facilities,
etc. Why pick on the rehabilitation of 100 homes to let people
live and enjoy life as all of us do?
Mr. Meh&lic asked wh~re she lived and if she attended the meeting
last week and Mrs. Goldberg replied that she lives in Leisure-
vil!e and did attend the meeting last week. Mr. Mehalic asked
how long has she been working on this job and Mrs. Goldberg
replied that she has been part of the Housing Authority since
July 1977. Mr. Meha!ic clarified that none of the people are
against rehabilitation, but he would like tc know why the people
can't be taught to take care of their property.
Mr. Pinto referred to Mrs. Goldberg being emotional and told how
he became emotional because of his property value being decreased
because of the neighborhood. If they want to build these homes,
let the government buy acres of land and build them all in one
complex. They should not come in and destroy another neighbor-
hood and that is what they are doing.
Mayor Jackson stated that the Housing Authority states this is
going to be in a certain amea, but the agreement does not specify
that and Mr. Pinto agreed and stated that they can go anywhere.
Mayor Jackson clarified that they are not going to build homes.
Mr. Caldwell asked Mr. Pinto if he felt the present conditions
in this particular section are adversely affecting the price of
his home and Mr. Pinto replied that they definitely are.and told
about the reaction of people seeing the boarded up homes. Mr.
Caldwe!! asked if he felt improvement to these homes is necessary
and Mr. Pinto explained how he thought people should buy the
homes with investing their own money and not just pay a low
rental while he pays for the upkeep.
Mr. Barry Seaman, Executive Director of the Palm Beach County
Housing Authority, came before the Council and stated he would
like to clarify a few points. In reference to the homes in the
northwest section, the Federal Government did not build-these
homes for low income housing. These homes were buil~by private
developers with FHA financing. The private people bought the
homes and put their money into it and look what you have! This
was created by the private sector. They are talking about bring-
ing it back to what it should be. In referring to the other
cities, the majority of housing in ghetto areas is owned by
private individuals and not the Federal Government.

Mayor Jackson referred to this agreement applying to any place in
the City and Mm. Seaman agreed. Mayor Jackson questioned who de-
aided what is blighted and Mr. Seaman replied that they work with
the Building Department and local Housing Authority to create
decent housing. They do not make the decisions on their own.
They follow the City master plan. It is ridieulous to say they
are going to Chapel Hill, eta. They are coming in to help the
City and the residents of the City.
Mr. Caldwe!l referred to Page 1, Section 1, Paragraph D, and
asked if he would be willing to strike the word "morals'~ and
Mr. Seaman replied affirmatively. Mr. Caldwell added that
what one personts morals is cannot be determined by the Housing
AuthoriTy or Legislature and Mr. Seaman agreed and advised this
was copied From the federal guidelines.
Mr. Caldwell read Section 4, Subparagraph A, and questioned what
services and facilities specifically will be provided and Mr.
Seaman informed him that they are asking for any other serviees
supplied to any other citizen such as water and sewage and they
pay full cost. Mr. Ca!dwell stated that extra parks would not
h~e to be built and Mr. Seaman replied negatively.
Mr. Caldwell stated that once the 2.2 million dollars has been
spent on renovation~ there is no more money at the present time
and Mr. Seaman clarified that there is 3.7 million dollars for
100 units. This money is to acquire and rehabilitate the units.
They have a pegular budget for maintenance for 40 years from the
Federal Government. Mr. Caldwell asked what happened at the end
of this time and Mr. Seaman replied that it can be extended by
the Federal Goverr~ent. Mr. Caldwell clarified that the monies
are guaranteed to come to the Housing Authorityand it is guaran-
teed they will be maintained on a regular basis and Mr. Se~an
agreed and added that they have maintenanee crews, trucks and
equipment. Mr. Harmening referred to 3.7 million dollars for
100 up/ts being $37,000 per house for rehabilitation and Mr.
Seaman agreed and added if they cost more, he would have to cut
down the number of units to stay within the cost factor. Mr.
Harmening stated if the cost and expenses are kept down and the
units are not in too deplorable shape, there would be money left
and Mr. Seaman replied negatively, that it would stay in the
Federal budget but also to be included are attorney~ fees:
reloeation, etc. in addition to rehabilitation.
Mr. DeMarco referred to the !0%ppayment to the City and Mr.
Seaman explained that under Florida law, the Housing Authority
is non-profit and all taxes are supposed to be alleviated~ but
the Federal Government requires a payment in lieu of taxes to
be paid to the City. He explained how the sheltered rent was
calculated and advised that 10% of this comes to the City.

Mr. Harmening referred to payments to~ the School Board and County
and Mr. Seaman replied that how the taxes are proportioned is up
to the City. Mr. Harmening asked if there was a requirement to
pay the County and School taxes and Mr. Seaman replied that he
did not know and his requirement is to make the payment to the
City, Mm. Harmening asked where we stand in relation to the
other taxing bodies and Mr. Moore replied that he believes any
taxing authority WOuld have a prorata share. Mr. Harmening
asked if it would be incumbent to split up the taxes and Mr.
Moore replied that i t probably would in proportion to the mill-
age set. Mr. Hammeo/ng elarifiad that instead of getting 10%,
we would get ~ of 10%,
Mr. Seaman stated in reference to teaehinq people how to live~
there is an ongoing program of outside services teaching home
ownership~ etc. They not only try to provide housing~ but up-
grade the standard of li=ing including education.
Mayor Jackson referred to houses on Seaerest Blvd. being con-
sidered blighted and Mr. Seaman agreed. Mayor Jackson referred
to a petition being received and Mr. Kohl read a petition from
the residents of Pine Point Villas in opposition to loweost
subsidized housing in the City of Boynton Beach signed with
approximately 220 names. Mr. ~oberts asked if there were homes
in this particular area considered to be blighted and Mr.
Seaman explained that they musthave the City?s approval
before making a survey. Mr. Roberts referred to this being at
the north end of the City and Mr. Seaman replied there was no
reason to go that far down.
Mr. Roberts stated that this has been k/eked around and he
thinks we should take a stand. This should have been given
some consideration when the Housing Authority was formed,
Mayor Jackson replied that the Housing Authority was appointed
in July 1977 and the members of the Council did it because they
were assured it would be under the County and they did not know
it required City Council approval. Mr. Roberts referred to not
doing anything about housing and asked if there was some way to
get out and Mr. Harmening replied that he didnTt believe there
was such a possibility. Mr. Roberts continued that he knows the
area has been destroyed and it cannot get much worse. About 100
units were referred to which would limit the activities of the
Housing Authority and he sees ao objection to that. Mr. Seaman
clarified that he was not saying Boynton Beach is getting !00
units~ but the 100 units are County-wide. Mayor Jackson referred
to a specific distmict and Mr. Seaman replied that a certain area
was specified~ but it cannot be included in writing in the coop-
eration agreement. Mr. Roberts clarified that it could be less
than 100 units and Mr. Seaman agreed it eould be a lot less. Mr.
Roberts commented that he was sure the City could control this.

Mr. Roberts suggested that education of the people be given some
consideration to see how it works out. If the Council approves
this~ he thinks drastic action could be taken so it doesnft ~et
out of line. He is in favor of the agreement.
Mr. HarmeD/hq referred to the target area bounded by the canal,
U. S. 1~ 1-95, and ~h Avenue on the south and stated he rea-
lizes many homes are substandard and he would like to see them
have a better place to live. However as much as he would like
to help those people, he feels when he sits here he represents
all the people and not just one area. This agreement is not
lind ted and emphasizes the entire City and many people do not
care for the Federal Govermment or County Government coming in
and operating shelters in their immediate area and he cannot see
how he can vote for this.
Mayor Jackson agreed and added that she feels there are many
places that need help and told about an elderly gentleman need-
ing help. Mr. Seaman clarified when the funds are available for
units for the elderly they will be considered, but these funds
are specified for family-units. Mayor Jackson continued that it
is not limited in the agreement with stating the target area and
Mr. Seaman replied that this would be discrimination. Mayor
Jackson stated that it was the same with stating family units
and Mr. Seaman disagreed and stated this is where the help is
needed. Mayor Jackson~referred to the Housing Authority dis-
criminating and Mr. Seaman replied that the City is discriminat-
ing by saying the~ want a certain area designated.
Mr. Roberts stated outside of the two items he mentioned, the
100 units acting as a limit and control by the City~ is there
anything in the agreement that is objectionable and Mr. Moore
replied that this was strictly a legislative decision of the
Council. He would like it clarified that according to Seotion
4A~ there is no free service of utilities and Mr. Seaman agreed
this was correct.
Mr. Harmening referred to the target area and clarified that
this area is of prime importance because there are more rundown
or di!lapidated houses in this area~ but he is sure there are
other places in the City meriting equal attention. Mr. Seaman
informed him that they had to take the greatest need first.
Mr. DeMarco questioned the time to be considered and Mr. Seaman
informed him that if this agreement is approved, it will take
him at least six to seven months to prepare a development pack-
age and ke explained. It would be close to a year before any
rehabilitation is started. Mr. DeMareo questioned the particular
area he planned to start on and Mr. Seaman replied it would be
the target area and he clarified that th~se 100 units must be
spread around the County and not just in Boynton Beach. They
look for the greatest need and what they can do with ~unds
available. Mr. DeMarco stated he would like the area in Boynton

Beach defined and Mr. Seaman replied that they will look into the
target area under the Housing Assistanee Plan with Community
Development. Mr. Moore added that it is basically stated in the
addendum submitted by the Housing Authority and Mr. Seaman agreed
it was basically.
Mr. Roberts moved to sign this agreement with the Housing Authority
as outlined and subjeet to elarification of Section 4 and deletiQn
of "morals'T in Section !o Mr. Caldwelt seconded the motion.
Under discussion, Mr. Caldwell stated that someone, somewhere,
somehow has to do something about this housing. It goes against
his basic conservative grain to have Federal Funds constantly
pouring around indiscriminately. He referred to the condition
of that neighborhood and stated only time will tell whether
someone will benefit. Mayor Jackson referred to the area not
being designated in writing and stated she feels any agreement

Consider Petition to Environmental Protection Agency to Make the
Biscayne Aquifer the Sole Source of Potable Water Supply for South
Florida
Mr. Kohl referred to submitting a memo from Mr. Paul Startzman .and
Mr. Perry Cessna and read the last paragraph: "It is the unqualified
recommendation of the undersigned that a resolution supporting the
petition to the E.P.A. be prepared and distributed to all concerned,
supporting the petition to make the Biscayne Aquifer the sole source
of potable water supply for Southeastern Florida."
Mayor Jackson referred to a resolution having to be to the E.P.A. by
December 7 and asked if there was any way to vote On a resolution now
and Mr. Moore explained that the resolution could be drafted and be
ratified later.
Mr. Caldwel! moved to pass the resolution to the E.P.A. supporting
the petition to Fake the Biscayne Aquifer the sole source of potable
water supply for Southeastern Florida with this to be sent to the
E.P.A., Area Planning Board, League of Municipalities, and other
cities. Mr. Roberts seconded the motion. No discussion. Motion
carried 4-0 (Mr. DeMarco ?Lad left the room.)
Consider Recommendation for Meeting Requirement of Catwalk at Water
Treatment Plant
Mr. Kohl read the attached memorandum dated November 13, 1978, from
Mr. Perry Cessna and clarified that OSHA is the Safety Division of
the Federal Government. He referred to OSHA changing the rules and
regulations, but stated we have to eomp!y according to Federal Law.
Mr. Catdwell moved to approve Mr. Cessnafs recommendation per his
memo dated November 13, 1978, for Tomfs Welding~ seconded by Mr.
Roberts. Under discussion~ Mr. Harmening commented that anything
required by OSHA, he will vote against. Motion carried 4-1 with Mr.
Harmening dissenting.
Consider the Extension of Water & Sewer Lines on Military Trail
Mr. Kohl referred to the memo submitted from Mr. Cessna dated Novem-
ber 13, 1978, regarding the extension of lines up Military Trail
with participation by the developers and explained how this calls
for R g A to extraet figures and we have a credit of approximately
$11,000 and we could have them start on this and start using this
credit.

Mr. Cessna explained that we are required to supply water and sewer
in our service area and the property owners pay the cost. This is
a request to obtain an estimate so we can col!eot the money to
furnish the services.
Mr. DeMarco made a motion to authorize the proper authorities to
proceed with this~ seconded by Mm. Roberts. Mayor Jackson clari-
fied it had been moved and seconded to follow Mr. Cessn~'s reeom~

Receipt of Correspondence from Mr. Alfred C. Shepard
Mr. Kohl read the attached letter dated November 6, 1978, from Mr.
Alfred C. Shepard for the record. Me added that he talked to the
Reereation Director and this parcel is not usable for parks and
would be a burden on the City forees to take eare of it. No taxes
can be collected and if we put equipment on it, it would have to be
removed when sold.
Mr. Caldwell moved to instruct the City Manager to address a letter
to Mr[ Shepard respectfully rejecting his offer, seconded by Mr.

Update on Atlantic High School Swimming Pool
Mr. Kohl advised that Dr. Carter told him to mention that they thought
the swimming pool would be around S800,000 and they have this amount
inasmuch as the County was going to provide it, but the bids came in
at ~900,000 so the pool is not being constructed at this time.

NOVEMBER 22, 1978
Request from Riteco Development Corporation .and Staff Recommenda-
tions
Mr. Howard Post appeared before the Council and referred to his
letter dated November 9, 1978 requesting an extension to the
approvals given Riteeo Development Corporation for the rezoning
and submit~rga final plat. He explained that a six month exten-
sion was requested to give time to assess the money market trends,
housing market, etc. They do not want to develop and put on the
market 250 dwelling ur~ts next summer and find they cannot sell
them because mortgage money is not available. They do plan to
proeeed exactly as planned, but are requesting their time to be
extended. However, he understands Mr. Cessna has raised a ques-
tion regarding the utilities.
Mr. Kohl read Mr. Cessna~s memo dated November 13, 1978: T~I have
no objections to the proposal Mr. Post has made in his letter~
providing that the time for installation of the water lines is
from the date of the original approval and is not moved backward
six to eight months by'action of the Council if they decide to
grant this request.T~ Mr. Cessna added that in the original
setup, we agreed only the minor line would be brought in there
and within 42 months or 42 Ur~ts~ they would put the major line
in. He does not think this request basically affects it but
it gives three years instead of 3~ years to get the line in.
Mr. Post replied that if this is all that is involved, there
would be no problem.
Mr. Post clarified that they were requesting two ehan~es: to
extend the zoning by six months and extend approval of the first
plat to the same period. He does not see any advantage
having a separate time frame for the zoning and plat. The plat
1 approval expires December 6 and he does not see anything the
City gains by having the plat approval expire prior to zoning.
He would like the plat approved for the life of the zoning.
They have no plans to ohange the plat or anything about it, but
simply would like to extend the deadlines for both six months.
The point raised by Mr. Cessna ean remain unchanged.
Mr. Caldwell moved to grant the six month extension with the
exception of the request as laid out by Mr. Cessna regarding
the water lines, seconded by Mr. DeMareo. No discussion.
Motion carried 5-0.
ADJOURNMENT
Mr. Caldwelt moved to adjourn, seconded by Mr. DeMarco. Motion
carried 5-0 and the meeting was properly adjourned at 9:50 P. M.

Since the original design of the Water ~reatment Plant, it has come
to our attention thru OS~A that we will require an elevated catwalk
around the vacuum filters at the plant.
A design was drawn up by R&A and submitted to.Intercounty for a price.
Their quote to Mr. Swan is for $5,343.00. At this point, I requestsd
Bill Murray, Chief Inspector for R&k, to contact Tom's Weldin~ in Del-
ray Beach, to see what they would charge. Tom's Welding gave us a
price quote of $4,2¢0.00o If this is done thru Int~county, it would
be a change order; and they would add their normal overhead, etc.,
and probably come up with the price quoted by them.
If we contract directly from Tom's Welding, we will be saving approXi-
mately $I,100.00, but will have to pay it from the funds that our pay-
ing Intercounty and'would therefore eliminate Intercounty's overhead.
It is recommended that we receive Council approval 'for this. If it
is approved, we should then issue an order to Tom's Welding Service
to do this job and have it paid for out of the same funds which the
Water Plant construction are-being paid from.
For your information, I am attaching copies of both Intercounty's and
Tom's Welding Service's quote.

As you may know, my two sisters and I have owned for a number of
years the above 2-1/2 acres. We have no plans for selling it
in the foreseeable future. Should we get an offer 'be cam't
refuse", I believe we could get along with delivery of the
property on a two-years'-notice basis. Therefore, I am wondering
if there is any interest on the part of the City to take possession
of the property and use it for open space or park purposes with
the understanding that we would have the right to terminate the
City's use on an eighteen-months' or two-years'-notice basis.
As yon know, the City wants us to keep the place clean by "mowing
vacant areas". If the City would take care of this, and if the
property could get off the tax rolls for the period the City
used it, we would probably be willing to enter into an agreement
along these lines.
t would appreciate it if you would let me know what you think the
possibilities are in this matter and whether or not the Manager
and City Council would be interested in such an arrangement.
We will be in touch with you later on this week regarding the
Water and Sewer Bond validation hearing and our work on the
Official Statement.
