Minutes 09-21-01MINUTES OF THE CO MMUNITY REDEVELOPMENT AGENCY SPECIAL MEETING HELD I N CONFERENCE ROOM C, WEST WING, CITY HALL BOYNTON BEACH, FLORIDA ON FRIDAY, SEPTEMBER 21, 2001 AT 5:00 P.M. Present Larry Finkelstein, Chairman Jos6 Aguila Alexander DeMarco Don Fenton Nancy Byrne, Assistant Development Director Lindsey Payne, Assistant City Attorney Absent Jeanne Heavilin, Vice Chair Michelle Hoyland Henderson Tillman I. Call to Order Chairman Finkelstein called the meeting to order at 5:00 p.m. II. Roll Call The Recording Secretary called the roll and declared a quorum was present1 III. Property Acquisition Discussion (907 N. Federal Hwy.) Chairman Fin kelstein requested that the public notices for the Community Redevelopment Agency not be so specific in order to permit discussion of other items. Mr. Aguila ~nquired if it would be permissible to have a base price for the purchase of properties written down by the Chairperson and then passed around for members to view before discussion. The figure could then be sealed in an envelope. Members could vote on the base price either up or down, Attorney Payne stated this procedure was not permissible. Mr. Aguila felt that stating the price the Board was willing to pay for property places the Board at a disadvantaqe an unfair "'" .... +""~ Attorney Payne stated that this would bm permissible only when purchasing property through written negotiations. Attorney Payne pointed out that the Board is bidding for property at public auction and written negotiations are not permissible. Chairman Finkelstein noted that the Board previously agreed on a price for bidding on this particular property. He suggested that next time the Board voted Meeting Minutes Community Redevelopment Agency Boynton Beach, Florida September 21, 2001 to bid on property, that no specific timeframe be set, and that the Board agree to negotiate for the purchase of the property, if possible. Attorney Payne responded that this procedure would be permissible. Chairman Finkelstein also reported that he had obtained a title binder for the property, which is on hold. Motion Mr. Aguila moved to proceed as outlined by Chairman Finkelstein. Motion seconded by Mr. Fenton and unanimously carried. Mr. Aguila requested that Attorney Payne further research his ~nqulry. Chairman Finkelstein will coordinate with Ms. Byrne on obtaining the necessary certified checks. iV. Public Audience None V.
