Mayor Jackson welcomed everyone and called the meeting to order at
7:30 P. M. She announced that the Invocation will be given by
Reverend Bond Bowman and the Flag S&lute will be led by Councilman
Joe DeMaroo. She requested everyone to please rise.
AGENDA APPROVAL
Mr. Moore requested the addition of the item to approve the plat of
Christian Villas and Mayor Jaekson informed him this was included
under Administrative.
Mr. Moore requested the Solicitation Ordinanee to remain on the
table. Mr. Caldwell referred to this being the third time it was
listed on the agenda and suggested possibly deleting it. Mayor
Jaekson informed him that West Palm Beach is just passing something
regarding this and she suggests it be left on the table until find-
ing out about that.
ANNOUNCEMENTS
Mayor Jackson read a Proclamation proclaiming September, 1978 as
National Guard Month.
MINUTES
Regular City Council Meeting - September 5, 1978
Mayor Jaekson referred to Page 8, second paragraph, when she asked
if anyone wished to speak in favor of the rezoning and Mr. Annunziato
appeared before the Council and clarified that he gave the background
of the whole thing. She referred to Page 14 and oorreeted the spell-
ing of "obsolete". She referred to Page 19 and corrected that all
plans 'should?~ be approved by the City within two months. She re-
ferred to Page 31, second paragraph under Housing Authority~ and
clarified that the names of two black men were submitted but they
were not submitted to the Council, but were submitted to Mr. DeMarco.
Mr. Caldwelt moved to approve the minutes as eorrected, seconded by
Mr. DeMarco. Motion carried 3-0.
PUBLIC AUDIENCE
Mayor Jackson announced if there was anyone in the audience wishing
to speak on any item on the agenda to please give their name to
Mrs. Padgett~ the City Clerk. She then requested anyone wishing to
speak under Public Audienee on an item not on the agenda to oome
before the Council.

Mrs. Dorian Tmauger, 702 S. W. 28th Avenue, appeared before the
Council and stated she was speaking in favor of our outstanding
Police Department. They have protected hereand she supports them.
She believes violators of the law should be pursued. She agrees
with the letter to the editor written by Mr. Bob Perrell published
in the Post Times entitled ~?Press Brutality~ and requests that it
be made a matter of reeord. She then submitted this article to the
City Manager.
Mr. Kohl announced that he didntt think we gave enough tribute to
our gentleman who gave the invocation. Dm. Bond Bowman has served
the ministry for 43 years and he thinks he deserves a round of
applause. Mayor Jaekson added thatshe thinks it is very nice to
have someone like this in our community.

Mayor Jackson questioned who is supposed to build High Ridge Road
to 22nd Avenue and Mr. Kohl informed her that the County is. Mayor
Jackson added that Sandhil! was supposed to build a portion also.

Mr. Kohl informed the Council that the Planning & Zoning Board at
their regular meeting of September 12~ 1978 unanimously recommended
the site development plans submitted by Norman Thompson for Boynton
Industrial Development to canstruot 317,000 sq. ft. of warehousing
on Congress Avenue approximately 600 feet north of LWDD Canal No. 29
adjacent to entrance road to City Sports Complex Park be approved
subject to the sta£f comments. The motion to approve was made by
Mr. Trauger and seconded by Mr. Jameson. A print showing the loca-
tion of the proposed construction has been submitted and the minutes
of the Planning & Zoning Board meeting have been distributed. May he
have Council's wishes on this matter please.

the 1978-1979 Fiscal Year
Mr. Moore informed the Council that this resolution incorporates and
adopts the proposed pay plan for the fiscal year 1978-79. Mr.

Service
Mr. Moore informed the Council that ~his proposed resolution pro-
vides for an amendment to the Civil Service Rules and Regulations
regarding the Police Department and the Workments Compensation Plan.
Mr. DeMareo moved the adoption of Resolution No. 78-SS, seconded by
Mr. Coldwell. Under discussion, Mr. Caldwett stated he did not
understand the purpose of Rule VIII, Section 12, Page 20, and asked
if we are amending the Civil Service Rules and Regulations while
adopting the pay plan and Mr. Kohl replied that it is a separate
item altogether. Mr. Moore clarified that two pages are attached

and stated that the developer was requested to see if the o!an

Kohl read a letter from P S R Budders advising that they revised

family homes in the northeast corner adjacent to the existing sin-

townhouses by a lake. The overall density has been l~ered from
4.Y to 4.5 units per acre.
Mr. Fernando Alonzo, representing F S R Builders, Inc., appeared
before the Council and stated that as described in the letter,

family area and will be buffered from the townhouses by a lake. The
overall density has been reduced from 4.7 to 4.5 units per acre with
a total of 1~g30 units instead of 17080.
Mayor Jackson referred to the question at the last meeting regard-
ing whether lakes are considered open recreation area and advised
that she asked this question at the Area Planning Board meeting and
was assured that lakes are considered as open space recreation area.
Mr. Alonzo then showed some aerial photographs of one of their pro-
jects in Dado County.
Mayor Jackson referred to the setbacks and Mr. Alonzo informed her
there would be 20 ft. separating the townhouses and 15 ft. between
the single homes. Mayor Jackson questioned the looation of the
single family houses and Mr. Alonzo pointed out the location on
the map and added that there would be no interconnection between
the towrahouses and single family area. Mr. Caldwell asked if they
were going to have the same homeowners association and Mr. Alonzo
replied negatively as the townhouses will have a homeowners asso-
ciation and the single family area will not. Mr. Ca!dwell explained
how it may be to the buyer~' advantage to have the deed tie them
into a homeowners association for future protection in the single
family area. Mr. Alonzo replied that one of their attorneys i~
present and will take the comments into consideration.

Mr. Alonzo informed the Council that this rezoning application covers
the southeast corner of the intersection at Hypoluxo Road and Congress
Avenue~ which is the northwest corner of their property. In master
planning this 240 acres, they felt there would be a need for the resi-
dents of their area and adjacent areas for a C-3 shopping area. They
feel it will be a heavily traveled intersection and would not lend
itself to residential development. They feel a C-$ development would
be the best use for these 12 acres.
Mr. Rick Rossi added that the proposed shopping center has access
internally from the project as it is intended to serve the project.
Mr. Caldwell referred to it serving this particular community and
asked if they felt C-3 zoning was necessary since C-2 is generally
neighborhood commercial. Mr. Alonzo replied that this intersection
will be heavily travel~4dand they feel C-3 is needed to serve more
than just 'this subdivision as it will attract people fmom other
areas. Mr. Caldwel! referred to buffering between residential and
commercial zones and Mr. Kohl requested comments from Mr. Howell.
M~. Howell clarified that this will be a 12 acre shopping center
'which would serve surrounding communities and requires C-3 zoning.
C-2 zoning is for neighborhood stores such as a 7-11. Mr. Ca!dwell
clarified that C-3 was being requested because of the size of the
parcel.
Mr. DeMarco moved that the request for rezoning 12 acres at the
corner of Mypoluxo Road and Congress Avenue be granted changing
the zoning from R-iAAA to C-3 for F & R Builders, seconded by Mr.
Ca!dwell. No discussion. Motion carried 3-0.
Resolutions (Com~inued)
Pmoposed Resolution No. YS-WW - Re: Requesting the Public Service
Commission to Deny Southern Bell?s Increased Rate Proposal
Mr. Mooreannounced that this is the resolution protesting the re-
quested Southern Bell Telephone rate boost as it pertains to Boynton
Beach. Mayor Jackson requested that the resolution be read and Mr.
Moore read proposed Resolution No. 78-W~ in its entirety. He also
read an article from the Post Times regarding this rate increase
noting that if approved, Boynton Beachwi!l pay the highest rates in
the County.
Mr. Bill Burson~ Southern Be!!~ appeared before the Council and
stated he would like to clarify one point which has come up in the
past. The local service telephone rate is determined by the number
of telephones you can contact on aloeal calling basis. It is a
plateau situation. When I85,000 telephones are reached~ the company
applies for an increase in the local service rate for that exchange.
Boynton Beach customers can contact over 200,000 telephones on a
local calling basis and they rqquested the rate increase on that
basis. They are not trying to discriminate nor single-out Boynton
Beach.

Mayor Jackson clarified that actually this is penalizing us for grow
lng and Mr. Burson replied that the more telephones you can contact~
the greater the rate wi!! be. With.the number of telephones increas-
ing, the mates will continue to go up.
Mr. Catdwell asked when the last time was when Southern Bell was
given approval fora rate increase and Mr. Burson replied that an
overall rate increase was granted approximately one year ago. Mr.
Caldwell asked if Southern Bellfs profitability had been damaged
recently because of addqtiona! phones being installed and Mr.
Burson replied that he had not said that. He referred to Southern
B~ll operating by tariff and stated that their plateau rate strum-
ture has been approved by the Public Service Commission. Southern
Bell is not t~ying to take advantage of the eustomers in Boynton
Beaeh but theyhave reached that plateau. Mm. Caldwell clarified
that 'we are being penalized for rapid growth. He ne~e~ liked their
present ~ate system and he tends to believe with as many developments
that we have coming into this small geographic area~ he cannot see
an increase in the rates justified. If a ten story building is
bui!t~ it will not cost Southern Bell one penny more than if it is
spread out over a broader geographie area. We cannot swallow this
plateau system. They were just given a rate increase last year.
Heiis still paying a fortuneefor every public phone he uses. Their
profitability has not been damaged. Why should the users be penal-
ized? It does not make sense to ask for more money f~om the people
on this basis. Look at their profits, bonds and stocks and you ean
see they do not need the additional revenue. Y~. Burson replied
that he did not want to arguer but wanted to point out their posi-
tion.
Mayor Jackson stated that for over a year, we have been asking for
toll free numbers: but instead we got socked with this. ~r. Burson
referred to informing them previously how the local service rate is
figured and they can just imagine what it would cost if Boynton
Beach was able to call all the phones in Palm Beach County on a
local ea!ling basis. He just wanted to e!arify this one point.
Mr. DeMareo asked if he was saying that now Boynton Beach has more
telephone service and reaches more subscribers than West Palm Beach
and Mr. Burson replied that he could not say for sure, but he be-
]/eves possibly the information in the newspaper article is incorrect.
[~r. DeMarco read that the one party rate in West Palm Beach is ~10.65
and in Boynton Beach it will be $11.05. Mr. Burson stated that he
did not realize this item was an the agenda and he is not prepared to
go into details. He will be glad to check and report back. Mr.
DeMarco stated that we stillwould like to have the toll free ser-
vice throughout the County. He recommends that we send this resolu-
tion to the Public Service Commission hoping the rates will not be
raised.

ing today and requested a brief report from Mr. Jameson. Mr.
Jameson stated that this is a very voluminous problem which will
require a lot of study. The Task Force requested the County Commis-
sion to extend a 90 day period to s~udy it which was granted. In
addition, they were requested to study any and all alternative
methods to secure revenue for the construction and building roads
in Palm Beach County. Alternative methods were discussedat the
meeting this afternoon, but no definitive was made nor one particu-
lar method was adopted, The 15 member board was divided into two
sub-committees and they will meet on a weekly basis to study, analyze~
investigate= and come up with a proposal for the County Commissioners
by December 19. He will have nothing to report for quite some time.
He does not thin-kit would De appropriate to report on the de!ibera-
tions until a final statement is accepted by the entire Task Force.
NEW BUSINESS
Discuss Civil Servise and Uni~s- Mayor Emily M. Jackson
Mayor Jackson referred to hearing about cities having Civil Service
and a union and suggested that Mr. Kohl be given permission to cheek
on this with other oities where they have Civil Service and a union
as possibly we may want to put something for referendum in the City
election.
Mr. DeMarco made a motion that Mm. Kohl make a study of this and
report back to the Council with recommendations. Mayor Jackson
added that she has heard Fort Lauderda!e has this in the works.
Mr. Ca!dwell e!arified that she was saying the employees of the City
will have the option of being eovered under the Civil Service
or not being covered under the Civil Service Rules but being covered
by a union contraet. Mayor Jackson clarified that it would be put
to referendum for the people to decide whether we want to do it this
way. She feels Mr. Kohl should look into the steps necessary and the
res~s, then a date is set for referendum with a vote taken. Mr.
Coldwell stated that he has reservations on this~ but seeonded the
motion. Motion carried 3-0.

Consider Approval of Christian Villas, Plat No. 1
Mr. Kohl informed the Council that the Christian Villas Site Develop-
ment/master plan (Plat No. ~ a replat-of Parcel K, Tenth Section of
Palm Beach Leisureville, Plat Book 30, Pages 129-141, located at
S. W. 19th Avenue and Congress Avenue) was approved by Council on
August 2, 1977 as reoommended by the Planning and ~oning Board.
Construction is underway and the applicant desires to record a
Plat of the unit:locations for purposes of fee simple sales.
Copies of memos from the City P!ar~%er and City Engineer recommending
the Plat be approved as submitted have been forwarded to the Council
members. He has the blueprint for their review. May he have
Council's wishes on ~his matter please. Mayor Jackson added that
there is no problem and this is just a fommality.
Mr. Moore informed the Council that an ordinance was prepared to
implement this matter. He then.read proposed Ordinanoe No. 78-47.
Mr. DeMarco moved the adoption of Ordinance No. 78-47, seeonded by
Mr. Caldwell. No discussion. Mrs. Padgett took a roll call vote
on the motion as follows:

Consider Recommendation for the Purchase of a Xerox Machine for the
Building, Engineering & Planning Departments
Mr. Kohl referred to submitting a proposal from Xerox Corporation
covering the purchase of the 3107 Xerox machine presently !ooated
mn the Building Department (new building) and stated that based on
the recommendation from the City Engineer, City Planner, Building
Official and the City Accounrant~ we recommend the purchase of the
3107 for the total cost of $8~233.8Q, to be paid over a 60-month
period at the rate of ~137.23 per month. No down payment is neces-
sary. This figure includes maintenance. May he have Council's
wishes on this matter please. He added that this is just like a
rental program but we will own it in the end.
Mr. DeMarco moved to accept the recommendation and purchase the
Xerox machine for the BuildingDepartment, seconded by Mr. Caldwell.
Under discussion, Mayor Jackson stated that if we are getting suoh
a good buy on this~ why not do it for all,he Xerox machines and
Mr. Kohl replied that we did buy the Xerox machine in the City
Clerk's office and he is looking into one for the Utility Dept.
He added that he is sure by buying this on the monthly program, it
is not in opposition to the Charter .and Mr. Moore replied~at ~is

Consider Approval of Budget Transfer Requests:
From Contingency to Drug Abuse for Fiscal Year 1978-1999
Mr. Kohl referred to submitting a budget transfer request effeetive
October 1~ 1978 from Contingeneies~ Account No. 001~195-519-90-11,
to Drug Abuse~ Account No. 001-195-519-40-5B~ in the amount 'of
gS~ 000 fora donation totthe South County Drug Abuse Foundation as
approved by the Council at the meeting of August 15~ 1978.
Mayor Jackson referred to reading in the paper that if we don't
give an additional $6~ 5007 they would not be able to continue this
program and stated she would like to have this item tabled. During
budget time7 we talked about giving $37000 to the Drug Abuse Founda-
tion and $3~ 000 to the Visiting Nurses Association. This will leave
us with nothing. Possibly we should listen to that portion of the
tape. Mr. DeMareo agreed that there was $67000 and he would like
the tape checked. Mr. Caldwe!l objected and stated that this dona-
tion was passed by a 4-1 vote of the Council to fund $6~000 to the
South County Drug Abuse Foundation for programs for the eradication
of drug problems in this area. It was not predicated on the opening
of an office in Boynton Beach and we will be remiss in the duty of
protecting the bec!thick, we!fare of our population by not funding
the South County Dmug Abuse Foundation. Mayor Jaekson replied that
we made a promise to the Visiting Nurses and we are straining our
Contingency Fund now. A letter has been received from the Drug
Abuse Foundation stating they need $6~500 more to operate. She
thinks we should get more information whether they a~e going to
continue after getting the $6:000 donation.
Mm. DeMareo moved to table this item. Mayor Jackson laid aside the
gavel to second the motion. Motion carried 3-0.
To Conform with State Mandated Uniform Accounting System for
Fiscal Year 1978-Y9
Mr. Kohl referred to submitting a copy of the memorandum presented to
the Counei! at the last meeting on September 5, 1978 explaining the
above and also an excerpt from that meeting indicating Council's
actions. He has in his office 19 pages of transfers pertainin~ to
the newly adopted aeoounting system add has these with him for~
their review. The budges transfers will take effect on October
1978 along with our i978-1979 budget. He explained how each
count had to be taken one by one to meet State requirements.
Mayor Jackson referred to not doing it and Mr. Kohl replied that we
have to do it. He added that it is not asking for more money, but
making a uniform accounting system so every city in the State will be
the same.

Mr.. Kohl referred to one of our polieemen leaving and stated that 'a
letter has been received from the Sheriff of Okeeehobee County offer-
ing to purchase ?'Prince?? for the amount of $2~818.00, including all
equipment Officer Guenst now uses with him, such as col!ar~ leashes,
etc. If we keep this dog~ it will cost $1, 500 to train a new man.
Mayor Jackson questioned how much we paid for the dog in the first
place and Mm. Kohl replied: $3~479.
Mr. DeMameo moved to accept the p~oposal from the Sheriff of Okeechobee
County and se/1 t~ dog to Okeechobee County for the sumof
seconded by Mm. Caldwell. Under ~iscuss±on, Mr. Caldwell asked how
many officers had left the department since Oetober and Mr. Kohl re-
plied about five or six. Mr. DeMareo mefermed to the ear still being
uti!iz~dand Mr. KOhl meplied that it could easily be renovated.
Mayor Jackson clarified that we still have three dogs and Mr. Kohl
