Minutes 08-15-78N-!NUTES OF THE REGULAR CITY COUNCIL MEETING HELD AT BOYNTON BEACH CITY HALL, BOYNTON BEACH, FLOILiDA, TUESDAY, AHGUHT 15, 1978 AT 7:30 P. M. PRESENT Emily M. Jackson, Mayor Edward F. Harmening~ Vice Mayor Richard D. Caldwell, Councilman Joseph DeMareo, Councilman David Roberts, Councilman Frank Kohl, City Manager Gene Moore, City Attorney Callie Clanton, Deputy City Clerk Mayor Jackson welcdmed everyone and called the meeting to omder at 7:30 P. M. She announced the invocation would be given this evening by City Manager Prank Kohl with the Pledge of Allegiance to the Flag led by City Attorney Gene Moore. AGENDA APPROVAL Mr. Roberts referred to the Housing Authority being immobilized due to the sudden death of a member and not having a quomum and requested at the end of the programaafter Administrative that the item to consider an appointment to the Housing Authority be added. Also, discussion of the recommendations ~om the Community Relations Board, which was late and missed the agenda. Mr. Caldwelt requested that Items 3 and 4 under B. Ordinances be moved to Items B and C under Public Hearing since these pertain to the adop- tion of the budget. Mr. Kohl requested that an application for permit to solicit from the First United Methodist Church for the purpose of museutar dystrophy research be added. He requested that Site Development Plan A be deleted, since the applicant requested this. He requested a budget transfer to be considered to cover the insurance policies for the police cars. Mayor Jackson referred to recommending an option for the 208 lead agency to the Area Planning Board and advised that Delray Beach rati- f-led the motion made at the last Board meeting and she th~ks it would be a good idea to discuss this at the end of the meeting. Also, a member of the Board of Adfustment has resigned and she suggests that an appointment be made to that Board so they have a quorum for their next meeting. Mr. Roberts questioned how many members there were on the Board of Adjustment and Mayor Jackson replied that there are eight, but vacation schedules must be considered. Mr. DeMareo moved to approve the agenda as corrected, seconded by Mr. Harmening. Motion carried 5-0. ANNOUNCEMENTS Mayor Jackson read a letter from the County Administrator confirming Mr. John JamesonTs ~ppointment to the Citizens Task Force representing the Palm Beach County Municipal League. She added that this is the first time we have had anybody from Boynton Beach appointed to that Board. MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 15, 1978 Mayor Jackson read a Proclamation proclaiming September 8, 1978, as National Cancer Day. Mayor Jackson announced that City Hall will be closed on Monday, Septem- ber 4, 1978, in observance of Labor Day. MINUTES Regular City Council Meeting - August 1, 1978 Mr. Harmening referred to Page 26, middle of page, Request from School Board, and clarified that the School Board will grant to the City an easement in exchange for the City installing the sidewalk on the pro- perty, f Mr. Caldwel! referred to Page 19, Reconsider Requests of Linda L. $ Charles L. Leemon, III, and clarified ~hat his phone has not stopped rin~ing and people were either asking us to change our vote or stand by our guns. Also, it appears there have been numerous misconceptions "overT~ what the rezoning entails. Mr. Harmening moved to approve the minutes of August 1 as corrected, seeonded by Mr. Caldwel!. Motion carried 5-0. PUBLIC AUDIENCE Mayor Jackson announced that Councilman Coldwell had requested to speak and then members of the audienoe may speak. Mr. Coldwell read the following statement: "I would like to take this opportunity to impos~ upon the people and clarify many half truthed statements regarding the sports complex being made by some hopeful candidates for the City Council elections coming up in November and Deeember. To begin~ this Council moved for and passed on a motion to take ithe sports eomplex to the people and have them decide, once and for ia!!~ what they wanted to do with this tract of land. We set ~eptem- iber 12 as the date for our referendum~ which is the County primary date and historically Boynton Beach has had a much higher voterturn- oUt for these elections. Since this time~ Mr. Kohl has been in con~aet with the Palm Beach iCounty Commmsslon and has presented to them this City's request for iapproximately $1~000~000 in a grant to aid us in the development of ithis park. To date~ we have received extremely positive responses to lout request. However~ the Commission'sBond Council has not giventhe iCommmsslon a definite yes or no. The result ms that the City doesn't iknow how~ nmeh we will ask the residents of our City to approve for bonds. -2- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLOP~DA AUGUST 15, 1978 Inasmuch as we need sixty days to prepare for the referendum to be placed on the ballot and inasmuch as it is still uncertain whether we will get the million dollars to aid us in this project, we will need to set another date for the referendum. This is the only reason the question of the bonds will not be on the September ballot. Unlike many of the leaders of the opposition who in the past fused to put the question to referendum~ this Council has unanimously gone on record for putting the sports complex issue before the people! These same people who are assaulting your intelligence with high platitudes as to why the complex should not be built felt 180 degrees differently only three years ago when they had the majority of the Coun- cil. Three years ago, they wanted to float $8657000 in bonds'and pledge your ad valorem taxes to pay them back on the following: 1. $3007000 for a seeond story ~or the poliee station which was to be used for our municipal courts and judges chambers! They knew months ahead of this that the courts were to be phased out soon! Yet they were still willing to waste our money for the project which has proven to be totally unnecessary. And they refused to put that to referendum! 2. ~300~000 for the purchase of land adjacent to our boat ramp facilities. Not only was a high commission to be paid to a then-member of the planning L ~ohing Board who worked for the realtor lf~andling the case~ but after this Council rescinded the bond validation, about six months--i~ter the same land was sold to a private developer for $240~000 - almost $60,000 ~ess than what we were going to get s~uck paying for with our taxes! Now you tell me if this is what you call honest fiscal re- sponsibility. In the last ten years land values have soared, not gone down. Why 'were we going to pay so much extra - with no referendum? Talk about sweetheart deals! 3. $250,000 for a mausoleum to be constmucted on City owned and bonded cemetery land. They wanted the City to get into private enter- prise, to boot! To this day~ there is a serious question as to whether the City can-~egally do this and maintain their tax exempt status~ These same !eaders~ who are telling you that the City cannot afford a sports complex which would be enjoyed by literally all the residents of our City, our children and the taxpayers~ have changed their spots overnight! Or have they? Their actions in the past tell us that they do one thing and say the opposite! You should question these people and the candidates they want to put up here. This Council and its members were elected on the premise that these matters should go to the people! -3- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH~ FLORIDA AUGHST 15, 1978 When the sports oomplex was first envisioned, it was to ~corporate a major league baseball franchise moving their winter home to Boynton Beach. The response was so favorable and time so shaft that we felt that-we had the consent of the vast majority of the people. When it was found that time would not allow us to validate the bonds in time to meet the oonstruation deadline, we felt we now had the time~ so let's go ahead and oomp!etely ~ulfill all of our promises. We voted 5-0 to go to referendum. Were we wrong? No~ I don~t think so. The telephone calls, letters and face-to-face conversations were all so overwhelmingly in favor of the entire projectthat, given the time and~cireumstanees, the Council would have been remiss in their duties not to make the same deofsions. However~ recent history has proven that these same obstructions who now claim to be champions of the public's purse~ when they had the time and the ability to go to the people, quite frankly eouldn't give a damn about our pockets then. What makes you so sure they would now if they got up here! Finally, you have read their quotes asking why don't we give the land back to the County and let the County pay for the whole thing. Can you imagine that. These same people in 1975 wanted to swap this land with the County and Ocean Ridge. They wanted Boynton Beach to give Ocean Ridge Boynton-owned land and the County would give us this same 55 acres! That's some deal! This City still owns the land in Ooean Ridge. But for $1.00, we also were able to buy the 55 acres and then received eight more acres free! That's what this Council has done to proteet your pockets! And we are going to referendum in December. In oonclusion~ we want the City~ the people and the children to have a well organized recreation faoility buil~ on this acreage. We are willing to ask you~ the people, to vote on this eomplex. Remem- ber, this Council o~fers you a choiee. The opposition did nor when they had the same chance. Now who do you believe? I am sorry, but this has been on my mind for a long time and I had to get it off my ohest.? Mayor Jackson announced that anyone wishing to speak on any item on the agenda to please come forward and give their name to the Deputy City Clerk. She then requested anyone wishing to speak on any item not on the agenda to please come ~orward and address the Council. Mr. Ed Mitchell, 329 N.W. 3rd Avenue, appeared before the Council and asked if Mm. Roberts had ineluded the Community Relations Board request and Mr. Roberts replied that the item he asked to add to the agenda was the appointment to the Housing Authority. Mr. Mitchell referred to the request from the Community Relations Board and Mr. Roberts replied that he requested the recommendations from the Con~nunity Relations Board be discussed. Mr. Mitchell asked what this ineluded and Mr. Roberts re- piled that it included the letter received from the Community Relations Board regarding problems~ poliee~ etc. -4- MI~/TES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 15, 1978 PRESENTATION OF CERTIFICATES TO CITY OF CHAMPION$S ~/TURE OLYMPIC AND PROFESSIONAL STARS Mayor Jackson realized she had skipped this item on the agenda and re- quested Mr. Kohl to make these presentations. Mr. Kohl stated that before asking Mayor Jackson and Mr. Charles Frederick, the Reereation Director, to present the certificates to these young boys and girls~ he wants the people ~h~were not present at the last meeting to know they missed the performance by these f~ture stars. He referred to the beautiful show given by these youngsters and stated that helis proud of everyone. He then requested them to stand and face theaudience. Mr. F~ederiek and Mayor Jackson then presented the certificates. PUBLIC AUDIENCE (Continued) M~. Dick Lambert~ 140 S.E. 27th Plaee, appeared before the Counei! and stated that he is a member of the Planning L Zoning Board, but is not present making a representation of the Board. The issue is the new site plan ordinance which became law three to four days ago. This ordinanee was started a few months ago when the Building 0ffieial sent a memo and indicated to the Council that he felt the site plan review system we were under may be illegal and unreasonable because of time delays. The City Planner felt the existing system was not illegal based on the eonditions being approved by the City Council. There was a con- flict between the two department heads. The Council turned it over to the Ptan~ing & Zoning Board and numerous meetings and hearings were held with the Technical Review Board and Building Official. After these meetings, it was recommended to the Council that the site plan review pmoeedure was reasonable and it was only recommended to possibly take a look at alterations and additions as they may not require review by the Planning L Zoming Board and City Council. The Counei! turned it over to Mr. Moore~ C/ty Attorney, and he was instrueted to go over the minutes from all the hearings and try to come up with a compromise ordi- nanee to possibly fit the need. It was almost an impossible task to go over hundreds of pages of minutes and eome up with a compromise. The next step is that it went back to the City Council and the City Council proposed the ordinance whieh went into effect a few days ago. He sub- mits to the City Council that not only is the City Council totally not happy with the new ordinance since it was a 3-2 vote, but also the Build mng Offmcmal~ Czty Planner and Plannzng & Zohing Board and Technical Review Board are not happy with it. He referred to department heads noting recommendations in the corner of site plans and stated that with tI~s new ordinance, these requests cannot be enforced. The requirements ~ust be printed in the code book. These stipulations cannot be added now. It is illegal for them to be listed on a site plan i£ they are not in 'the code book. Possibly there should have been a six month implemen- tation period for this ordinance in order to bring the code book up to ~d~.t~_. Also~ he understands the Communmty Appearance Board review is [s~l!! continuing and since this is a recommending Board~ why is their ~view valid and not review by the Planning & Zoning Board and Teehnical Review Board~ Mayor Jaokson referred to the time being 8:00 and an ~unced they would have to proceed with the Public Hea~ing and requested Mr. Lambert to eontinue afte~ the Public Hearing. -5- MINUTES --REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLOP~DA AUGUST 15, 1978 PUBLIC HEARING - S:00 P, M. Considerationof the Proposed Budget to Operate the City During the 1978-1979 Fiscal Yeam Mr. Kohl read the confirmation of the notice published in the Palm Beaeh Post-Times on August 5, 1978. Mayor Jackson asked if anyone in the audience wished to speak in favor of the budget as presented and received no response. She asked if any- one wished to speak in opposition to the budget;as presented and received no response. She asked if therewere any comments on the budget. Rev. Ed Wollenweber, Minister of the Congregational Church, appeamed before the Couneil and advised that he resides at 345 S.W. 13th Avenue and owns this home. He is Vice President of the South Country Drug Abuse Founda- tion and in that ea~city would like to speak to the Council tonight. During Council workshop hearings~on the budget~ ;they had the opportunity to review a request from the South County Drug Abuse Foundation in the amount of $12,500. He referred to this City Counoil donating funds to their foundation and thanked them for theirsupport. He explained how they were originally restricted to providing individual and family coun- seling for drug related p~oblemsaadd then told about expansion into a new program called VERATOS which is a preventative educational program. He referred to other cities eontributing and then req!lested the COuncil to consider-~heir mequest for $12,500~ not for individualsT druge pmoblems but to pr?vide preventative education at Congres~Zddle School for stu- dents l{ving in our eommunity. He explained hOw~28 hours of in-school instmuctionwould be provided for students in the 6th grade area who have been identified by teachers as potential drug users. Also~ the program was criticized previously because of not being located .in the ~City and they have now rented offices on Federal Highway in Boynton Beachaand it is f~om that office this program is being operated. He requests this ~unding. Mr. Roberts referred to the mention of the United Fund in Delray Beach and Boca Raton donating funds and Rev. Wollenweber agreed and stated that contributions were also made by the communities and they were also told that the City of Boca Raton would contribute this year. Mayor Jackson referred to this being discussed at the budget workshop and stated at that time, she had an article about somebody back in the old days and what had happened with giving money. This article ex- plains her vote against this. She is in favor of the program, but does not feet tax money should be paid for this since it is affecting only ~a small portion of the people. She would like to have him see this article and is sure he would then appreciate her viewpoint. Rev. Wo!!enweber added that conservative estimates are 80% of school child- ren ~uae drugs. Mayor Jackson replied that she didnTt want to argue about this and in good conscience cannot vote for it as much as she would like to. -6- MINUTES - RE~I1LAR CITY COHNCZL MEETING BOYNTON BEACH, FLORIDA AUGUST 15, 1978 Mr. Caldwell referred to making statements at the workshop session and last year and stated he is in favor of partial ~unding of the South County Drug muse Foundation. He believes the future of America lies in its youth. He has two children and knows what drugs can do to people having lived in an era~ where drugs became popular and being near the *See situation. He knows drugs can destroy valuable human beings. He is sure Rev. Wotlenweber and the Police Department ean give mind boggling statistics. He is very mueh in favor of the f~,ndin? of this program. Last year we gave $6,000 and he is in favor of giving the same $6,000 this year. He believes it is pert of a muoicipality~s responsibility to take care of the health, safety and well being of their citizens. He thinks we need to invest more money in preventative methods. Mr. Roberts questioned the amounts contributed by the othem municipali- ties and Rev. Wol!enweber replied that he believes De!ray Beach gave $4,000 and a concert with United Fund to make a total gift of 812,000. The City of Boca Retort gave nothing~ but their request has been $12,400 this year. They cannot be sure of what Boca Raton's contrdbution will be~ but he told how the program~included a direct counsellor there. They are quite sure the contributionwill be approximately $6,000 to $1C,000. The Boca R~ton Ho/ted ~und will make up the difference of another $8,000 to $9,000. They have to approach Boynton Beach for a rather large amount because there is no active United FuKd in this area ~ey can appeal to. Also, 26% of the people at the center !iv~nin ynton Beach. One-half of the students enmOiled in the program live in the Bo~n~on Beach area and they are Congmess Middle School students. Mr. Roberts referred to our.revenue in the geheral fund being lees than in Delray Beach and Rev. Wollehweber replied that he doubts when.Mr. Roberts makes his offering at church, he cheeks to seewhat-the person next to him is giving. He added that he also wanted to stress that he is a property owner in the City and he is willing to pay taxes for this purpose. Mr. Harmening commented that he voted for this in the past, but is not sure of the outcome of the concept but perhaps we will get our monies~ worth. Mr. Ca~dwe!! made a motion that as part of our budget, we fund the South County Drug Abuse Foundation the amount of $6,000~ seconded by Mr. DeMareo. Motion carried 4-1 with Mayor Jackson dissenting. Mr. Kohl then read the Notice of Hearing for the 1978-79 Budge~as pub- lished. Mayor Jackson ascertained that nobody else wished to speak in reference to the budget. 9/s/Ts Minutes -7- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 15, 1978 Mayor Jackson announced that before having the ordinance read, she would like to make a statement. We have had two advertised public hearings for input, one was in the morning in conjunction with the budget workshop and the other hearing was at 8:00 P. M. at our last meeting. The time has come to vote on the decision how this money is to be spent. Mr. DeMarco clarified that-she was talking about the Federal Revenue Shar- ing Funds and Mayor Jackson agreed. Mr. DeMareo made a motion that the Federal Revenue. Sharing Funds be approved with $1767000 for the Cooperative Dispatch Center and for the Recreation Facility¢ seconded by Mr. Catdwell. Under di soussion, Mr. Ca!dwell stated that he is still going to go on record as being against the Cooperative Dispatch Center as anything which appreciates that much in cost, he doesnft like. He requests we pursue backing out of itand Mm. Marmening replied that the City Manager has been directed to look into this. Mr. Roberts agreed that it is out of line and the cost is tremendous~ but he thinks we should give it a tryout this year and see how it works. Motion carried 5-0. Proposed Ordinance No. 78-34 - Re: Adopting a Budget for the Fiscal Year Beginning October 1, 1978 and Ending September 307 1999 Mr. Hammening moved the adoption of Ordinance No. 78-34 on first reading, seconded by Mr. DeMarco. No discussion. Mrs. Clanton took a mol! call vote on the motion as follows: Councilman Caldwel! - Aye Councilman DeMareo - Aye Vice Mayor Harmening - Aye Mayor Jackson - Aye Councilman Roberts Aye Motion carried 5-0. Mayor Jackson then showed a notice published in the paper for Deerfie!d Beach telling the people they are going to increase the taxes 10%. She explained that the certified millage was given to Mr. Xohi ~rom Mr. David Reid. She referred to the City Manager of Deerfield Beach previ- ously being the City Manager here and advised in 1972-73, when he was the City Manager in Boynton Beach, our millage was 8.2 mills. She then read the millage rates for the years 1973 through 1978 and noted the Mayor inoffiee each year and summarized that the millage rate has been steadily decreasing since Mr. Kohl has been City Manager with the excep- tion of the two years Mayor DeLong was in office. She announced that this year the ordinance which is going to be read is proposing a mill- age of 6.091 which is down .746. Proposed Ordinance No. 78-35 - Re: Fixing a Tax Millage Rate Mr. Moore read proposed Ordinance No. 78-35 by caption on first reading. ~ . Caldwe!! moved the adoptmon of Ordinance No. 78-35 on first reading~ ~eeonded bY Mr. Harmening. Underdiscussion, Mayer Jackson clarified -8- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 15, 1978 that this will lower the millage, but we carmot guarantee the taxes will be lowered as it depends on the County. Mrs. Clanton then took a roll call vote on the morion as follows: Councilman DeMareo - Aye Vice Mayor Harmening - Aye Mayor Jackson - Aye Councilman Roberts Aye Counei!man Caldwel! - Aye Motion carried 5-0. PUBLIO AUDIENCE (Continued) Mr. Dick Lambert appeared before the Council again and referred again to theitems listed on the plans not being in the code books and stated that according to the new ordinance, these could not be required as it supposedly is not legal unless in the code books. Also, he questions how the site plan review process can continue by the Community Appear- raneeBoard. What makes their recommendations legal and not the reeom- mendaTionsof the Planning $ Zoning Board and Teehniea! Review Board? Who does the Community Appearance Board recommend to? Mayor Jackson repl/ed that the recommendations are made to the applicants. Mr. Moore added that this ordinance only applied to commercial structures over $100, g00. This also includes repairs, renovations, ere. He t~inks there are very few commercial buildings involving less than $100,000. The City oannot restrict the use of a personTs property unless speci- fically specified in an ordinanee. Many items have been imposed by the Planning & Zoning Board which were questionable. They were simply recommendations made and probably adhered to instead of filing suit against the City. He feels the recommendations were made in good faith for the City. He does not think some of the things imposed by the Planning & Zoning Board, Technical Review Board, or Community Appear- anee Board were legal unless speeified in an ordinance. Mr. Lambert stated that part of the reason for this ordinance was the time factor involved and it must be considered that the Co~mmnity Appear- ance Board only meets every two weeks. He has spent many hours on this and thinks there are problems with this new ordinance. Mr. Moore replied that he does not think in this isolated area that the Community Appear- ance Board has any in=olvement. Mr. Caldwell asked Mr. Howell if he felt there was any problem in the o~dinanee or in the implementationof the ordinance as it reads and Mr. Howell replied that he needs interpretation as to the Community IAppearance Board. If the Community Appearance Board is to make recom- mendations to the developer, it is in conflict with the ordinance be- cause that states their recommendation is made to the City Council. Mr. Coldwell asked Mr. Annunziato if he saw any particular problems in this new ordinance and Mr. Annunziato replied that he thinks Mr. Lambert and Mr. Moore pointed out the most important thing. Also, if it is meant to reduee time, the Commur~ty Appearance Board must recommend to the City Council and there is still a time period to cop9 with. Mayor Jackson suggested this be tabled and Mr. Moore ean meet with Mr. Howell. Mr. Moore replied that the ordinance is clear in his opinion. It states that anything under S100~000 is to be processed administra- tively. Mr. Howell referred to there being some question whether the Community Appearanee Board would be involved in plans under $100~000. Mr. Caldwel! moved that immediately a six month moratorium be installed on the implementation of this ordinance so we can put into ordinance fomm those standard requirements recommended by the Planning $ Zoning Board and Community Appearance Board~ so they will become law and Mr. Howell aah do his job better and implement it better. Mayor Jackson clarified that he wanted it spelled out that what ~the Comnmnity Appear- ande Board does is law and not recommending and Mr. Ca!dwell agreed. Mr. Lambert stated that the implementation period is the key. All the reco~nmendations should be stated in the code, those made by the Commun- ity Appearance Board~ Technical Review Board and Planning & Zoning Board. Mayor Jackson suggested tabling this so Mr. Moore pan get together with Mr. Howell and work it out. Mr. Roberts referred to the intent of this ordinanee including alterations and additions and questioned old con- struction and Mr. Moore replied that a permit is required to do anything and this is related only to commercial. Onl~ eommereial is involved with additions~ alterations~ and new construetion over $100,000. Mr. Roberts questioned the Community Appearance Board's involvement and Mr. Moore replied that it was an interpretation by the Planning $ Zoning Board that they felt the Community Appearanee Board had involve- ment. This ordinanee was prepared to streamline the review process to see if it would work. Mr. Lambert stated that if it is supposedly an unreasonable time delay and illegal to have a site review process under ~100,000~ what makes it legal for over S100,0007 Mr. Moore replied that he has never said it was legal. He has always questioned the requirements foreed on deve- lopers. Mayor Jackson added that she voted against the ordinance following Mr. Moore's recommendation. Mr. Lambert stated that it seems to him this ordinance opens more of a ean of worms than the other one. If the other one was illegal, this has to be with setting the $100,000. Mr. Ca!dwel! moved to install a six month moratorium on the implementa- tion of this ordinance so we can study it. J. Mayor Jackson informed her that all the employees are entitled to the eSee same. Mr. Kohl did not get a raise and m~Sk%mployees got 5%. She has 8/5/78 a list of the C/ty Managers and their pay and there is only one City Minutes Manager in the County getting less than ours. They all have a pension and attend conventions regu!a~ly, but Mr. Kohl does not. Mr. Kohl feels and we feel that he is needed in the City. Mrs. Riscoe stated that she spoke to a ~ormer City Manager in Da~e County and he got his vacation pay, but not his accmued sick leave. Mayor Jackson informed her that this was allowed by the Civil Service regulations. Mr. Robert Riscoe~ 3113 Chapel Hill Blvd., appeared before the Council and stated that he has one objection to the wording of this ordinance. It says dise~arge~ but does not give any reason for discharging. There could be embezz!ing~ malfeasance, eta. involved and the City Manager would still get tbmee months severance pay. Mayor Jackson replied that the Council did not have to have any reason for diseharging the City Manager. Mr. Risaoe asked that if he is discharged for a certain reason~ would they still wane to give him tbmee months severance pay? He would like to see the ordinance clarified so if the man is disehamged for other than honorable duty that he does not receive the severance pay. Mr. Moore informed him that the City Manager can be released without cause. Mr. Risooe stated that he could also be released for embezzling and Mr. Moore questioned why he was referring to embezzling? He asked if he had read the ordinance in its entirety because this is just an addition to Chapter 2. There is a lengthy procedure included for the discharge of the City Manager. Mr. Riseoe stated that this ordinance changes the whole artie!e and Mayor Jackson meplied that this is an addition to what is in the book. Mr. kiseoe clarified that according to this ordinance~ if the City Manager is discharged for reasons other than bonorable~ he still gets severance pay. Possibly this could be amended that in the event of criminal pmosecution, the City Manager not be given these benefits, but either the eourrs must acquit or find him guilty of a eriminal act. However~ it is a long process with the person being charged and found guilty. A City Manager man be discharged without cause. Mayor Jackson referred to the balance of the o~dinance ealling for a hearing and Mr. Moore replied that it includes the right to a hearing, but he does no, think any technieal charges have to be made. The City Manager has the .opportunity to present to the City Council reasons why he should not be discharged. Mr. Ca!dwell added that if the City Manager is not charged with anything then he should be given his money. If the man is charged with a criminal ae~ and found gu~lty~ then the money should not be paid to him because he has done the City wrong and should not be rewarded. If there is no ca~e for the discharge~ he does not think the man should he penalized and should receive the sev- erance pay as laid out in Ordinance No. 78-33. A gentleman from the audience suggested instead of going through all this action that it just be stated honorable discharge and Mr. Caldwe!! re- plied that this could not be done in politics. Mr. Alvin Boettz, Jr., appeared before the Council and questioned what this omdinanee eovered in price to the City taxpayers? Is this ordi- nance in conjunction to paying the current City Manager a pension? Pension and sick leave was mentioned and when the City Manager leaves, does he get paid sick leave~ Mr. Moore informed him that every classi- fied employee has the same rights proposed for the City Manager. Sick leave accrues and he is entitled to 50% cash equivalent, ~acation pay, and ttreee months severance pay. Mr. Kutlin asked if there was any- thing included if the City Manager resigns voluntarily and Mr. Moore replied that if the City Council accepts the City Manager's resigna- tion~ they can apply the same procedures. It is not mandatory in a voluntary resignaYrion that he gets anything. The attempt behind this is to try to give some semblanee of arbitrary discharge. A new CityCouncil can fire any unclassified employee which is the City Manager and bimsel£. Mr. Kutlin suggested inoluding something about voluntary resignation. Mayor Jaekson added that two City Managers resigned and both were taken care of with severance pay and she does not think it is neeessamy to include this. Mr. Ralph Marehese~ 1901 Roma Way, appeamed before the Council and questioned who monitors the City Manager's attendance and are records maintained for the pub!lc showing sick time, vacation time, etc. Mayor Jackson informed him that the Council monitors his attendance and the full records are on file in the Personnel Office. Mr. Marchese questioned why they were resorting to this type of instmument to pay the City Manager for good service rendered? Why does he have to obtain his benefits by subterfuge? Mayor Jackson replied that it is not sub- terfuge, but something late in coming. Mr. Mamehese continued that he thinks this is setting a precedent. Mayor Jackson informed him that this would be like the coverages for all City Managers. Mm. Marchese stated that if we want the City Manager to do a job, we should pay him for the ~ob he does and pay him well so he does not go to greener pas- tures and not have a ~ie in the sky in ease somebody dumps him out so he will get somethir~. Mayor Jackson replied that one City Manager was dumped. In comparison with other City Managers~ Mm. Kohl is not making as much money or getting bemefits. Mr. Marchese mla~fied that this is not his argument and all future City Managers should be we~l protected. Mr. Coldwell explained how most public employees are under Civil Service and are guaranteed their tenure and must have a reason for being dis- oharged. He :explained how~these systems encouraged the employees to use tk~ r sick and vacation time which means they are away from their job causing less productivity and efficiency drops. We are trying to encourage our City Manager to be at has job and he will not be penal- ized f~r not using his sick leave or vacation leave. He does not think it is subterfuge, especially when certain members of t?~ public have stated if they get into office, Mr. Kohl is gone. OLD BUSINESS Referendum on Complex (Councilman Richard D. Ca!dwell) Mr. Caldwell referred to originally moving for a referendum to be held regarding the sports complex on September 12 and stated obviously we cannot meet that deadline. He moves to draft another resolution to hold a referendum on Tuesday, December 5, simultaneously with our municipal elections. Mr. DeMareo seconded the motion. Under diseus- sion, Mr. Roberts questioned if this referendem would be just to indi- cate whether we are in favor with no dollar amount and Mayor Jackson replied that she thinks we have to have a dollar amount. Mr. Moore added that he thinks there should be something in the proposition re- garding extended funding and how it is going to be funded. Mr. Roberts clarified that the referendum bill include a dollar amount and Mr. Moore replied that it must, but hopefully the County will speak before then. We will have to have a final determination of the final scope of the project. Mayor Jackson clarified that at this time we are not deciding on the wording, but are just setting the date for the referendum. Mr. Caldwell clarified that he understood the referendum was set for September 12. The 2ouncil concurred we would go to bonds and definitely go to a referendum for this 1.5 million dollar proposal. In the interim, we have gotten Federal Reve- nue Sharing Funds for the gymnasium. Hopefully we will get money from the County which will reduce the amount we will have to borrow. We must decide how we are going to word it once we find out from the County. If we put off indefinitely when to hold the referendum, it will just linger on. Mayor Jackson commented that to hold a referen- dum in December, we would have to know by the ~ddle of next month and Mr. Moore clarified that we have a four month period and if a decision is made in two months, we will have ampl~ time. Mayor Jackson clarified that this was just setting the date now and we can check into the funding further. Mr. Caldwell added that this is the only thing we can do until we find out from the County. Motion carried 5-0. MIk~JTES - REGULAR CITY COUNCIL MEETING AUGUST 15, 1978 BOYNTON BEACH, FLOP~IDA NEW BUSINESS Discuss Political Signs and Handbills (Mayor Emily M. Jackson) Mayor Jaekson referred to submitting a page from our Sign Ordinance and pointed out that it prohibits temporary political signs. However, everyone puts up political signs and we are aware the County has changed their rules, she suggests we should ehange our laws to the same as the County. The County allows signs to be put up upon obtaining permission and the payment, of a small fee which allows them to go up 60 days before an election and S0 days after. A small fee would pay for the City to take down the signs if someone does not. Also, she feels the prohibi- tion of eireulams, throwaways and handbills is unfair because it means someone runninc- for office cannot hand out eampaign matemial. She would like to find out the feelings of the rest of the Council. Are they mn agreement to have Mr. Moore look into the County law on the signs? Mr. Harmening moved to have the City Attorney cheek into the new County ordinanee. He suggests thatcopies of the ordinanee be 6brained, so we eau see what direetion it goes in and perhaps we can liberalize our ordinance to some extent. Mr. Caldwell seeonded the motion. Motion carried 5-0. ~onsider Request from Boynton Beach Housing Authority (Councilman Roberts) Mr. Roberts referred to the City Council having the function to appoint the members to the Housing Authority and stated they are an autonomous body and do not take any orders from the City Council or the City. He has recently learned that other city Housing Authorities do not meet in city hall, but meet in their own office and are funded by the County. Actually it looks like we are subsidizing the entire project and we should not allow taxpayers' money to be spent for this. When he saw the request submitted for a file eabinet: he decided that he wants e!arifieation of why the City should spend money for this partieular Housing Authority when we are not even involved except to cooperate in some degree. He read an excerpt from the Housing Authority~s minutes covering the cleanup program they have in progress being funded by the County. He does not think the City should fund this Housing Authority because they are being funded by the County and Federal Government. He does not think we should supply any secretarial service or fileceabinet, Mr. DeMarco stated that last year we discussed two ways of organmzing the Housing Authority and we decided to go with the County. He cannot understand since tkey are autonomous that they keep coming back to the City Council. Possibly we should meet witb Mr. Barry Seaman again. Mayor Jackson added that ~ we let them know they are on their own~ possibly they could get CETA help. Mr. Roberts suggested that the City Manager contaet Mr. Seamanand find out where we stand. The other Housing Authorities meet in their own office and have their own secretary and don't even come near City Hall. Mr. Sam Wright informed the Couneil that he is employed with the County and worked in the City of Delray Beach and attended every Housing Auth- ority meeting held at City Hall in Delray Beach. The Citywas very cooperative with the Housing Authority in Delray Beaeh. The Housing Authority has Stewart Arms and had an office on Atlantie Avenue, but they.still meet at 2ityHall. John Green worked closely with them and was fundamental in getting theI Housing Authority in Riviera Beach. He is sure,the City of Riviera Beach is working very cooperatively with thc% Housing kuthority, tt is surprising and shoeking to hear our City Council and elected officials not supportive for what the Housing Authority is going to do. They will receive federal monies, but are just asking for the Cityfs support. It is very fortunate that the Housing Authority is able to meet in City Hall. Mayor Jaekson informed b/m that the Housing Authority is now asking for some other service. The budget has been pared way down.and if the Housing Authority is autonomous, this is where th~v belong. The City is ready to cooperate, but they must realize they a~e autonomous. Mr. Roberts stated that he just wanted e!a~ifieation. He doesnTt think the City objects to them using the conference room, but he doesnTt think we should fund a secretary and cabinets if We are the only City doing it. Mr. Wright referred to the Community Relations Board submitting a pro- posal to the Council which they did not support and explained that the Housing Authority is able to app!y'~or CETA manies availab~e~ but must be sanctioned by the City. Mayor Jackson replied that tL~e City would be glad to approve any ~ETA help they can get and do not object to that. Mr. Wright stated he just wanted e!arification since Mr. Roberts men- tioned utilizing the facilities and Mayor Jaekson replied that the request submitted was for file cabinets. Every year~ we have more call for file cabinets and do, not have the room. She thinks it should be limited to City functions. Mr. Wright stated he thinks Mr. Kohl eould work somethinc- out where they could be easily accommodated. W. 12th and 13th Avenues. He referred to the City priding itself in keeping the City ~!ean and stated that many ~properties in this area have curbs, but you are not able to find them because they'are not cleaned. He is making an appeal to the City Council to assist them in keeping the streets e_lean by using a street sweeper. They are trying to make the properties clean. There is poor lighting in this area and it is a little bit of a crime area. The only,time they have decent lighting is when the ball park is open. Some of the lights are so antiquated that you can hardly see the street. He is making an appeal to the City Council to get improvements on the lights for that neighb~hood. They have maintenance men cleaning the immediate properzyo It is raked constantly to keep it clean, In refer- ence to the violations, the Building Department is very efficient and ~urnisked them with a copy of the codes on each individual violation. The Building Department is efficient with notifying the owner~ but the occupantis never notified and without the cooperation of the. oceupant~ it is a lost cause. The landlord tries to do his job, but the occupant does not do his job. As far as any violations are concerned, it is the responsibility of the property owner to eorrect them and he will do it to keep the property here in the City of Boynton Beach. Mar. Kohl referred to the condition of these places and stated he would not keep his dog in some of the places on this street. It is the respon- sibility of the owner to make sure the housing eode is taken care of. That is the law and we abide by the law. Mayor Jackson stated she did not quite understand what the street light- ing and street sweeper has to do with the condition of the structure and Mr. Lay replied that it helps with the occupants. Mrs. Blanche Girtman~ 912 N. W. 3rd Street~ appeared before the Counoil and stated she thinks she knows what Mr. Lay is talking about. If you had to live in these p!aoes~ you could not stay there. The Building Official and City Manager have jobs to do and these structures should be to~n down. All those shot gun apartments need tearing down. When they were built in the 1950~s, they were not approved by the black oommunity. The occupants of rental property of that kind leave it just like they found it. People living in decent p!aees take pride. Every one of the shot gun apartments in Cherry Hill need to be to~n down. They are rat infested, etc. There is no reason to save them. The City has put lights there and Community Development has put in sidewalks, but those shot gun houses have to come down. After talking to the Building Offioial~ they feel this action may take a day or two~ but won't know until getting into. We are not p~osecuting these oases and the oourts are not proseouting. He stressed the importanoe of proteoting our City and not let people get awaywith violating the laws. Mr. Roberts referred to this being a problem in many munioipa!ities~ith the courts not having the time for City cases. Mr. Caldwel! clarified that the request was to appoint Mr. Moore to prose- cute these cases and this is assuming we get the cases into court and Mr. Moore informed him that if they designate a municipal prosecutor solely to proseouTe our municipal ordinances, that name is registered with the court and the Clerk of the County Court is to issue process in the same manner as prescribed for misdemeanors by Rule 3.130. Prooedurally he assumes they would allocate us a certain period of court time. Mr. Caldwell asked if there is a State Statute allowing us to appoint our own board to levy'fines and liens on properties and Mr. Moore olari- f~ that he was talking about criminal violations. Mayor Jaoksonremarked that what good is it to have ordinances and have people ignoring them. Mr. Kohl agreed that inspeotors are being sent out and nobody is listening to them. Mr. Caldwe!l stated that he has read or heard that there is a statute on the books allowing munidi palities to hear cases such as this. The board is duly authorized by the City Counoil and the violator Mst answer to that board. After purchasing the property~ he was told the zoning did not comply and applied for a zoning change and variance, but they were not approved. He then filed a suit for $2007000 based on erroneous information being given to him. He told about there being a jury trial and then the ease being withdrawn and the case was dismissed with prejudice. However~ appmoximately $1,200 was incurred in out-of-pocket expenses. Mr. Ca!dwell asked Mrs. Girtman if she wanted to sit on the Housing Authority and Mrs. Girtman replied that she will ac- eept it and will. serve if they cannot find another black person to serve, but there are many more qualified. Mm. DeMareo then moved to table this until the next meeting, seconded by Mr. Harmening. Motion carried 5-0. Communieation from the Community Relations Board Clarified in 9/5/78 Min. Mr. Roberts referred to a memo being submitted From the Conmmn~ty Rela- tions Board and suggested that it be answered. He referred to the memo mentioning the attitude of the police officers, requesting that some black men be recmuited to join the police force~ requesting that the police not show force~ and a request that the black community be tmeated fairly. He suggests that Items 2 and 3 in this memo be acted on immedi- ately. To his knowledge~ there has always been a great number of people taking the exam for the Police Department including black men and they have had some difficulty in passing. Eighty'people took the last exam and there were several blacks, but apparently they did not pass. We have contacted the ameaaleaders and notified the black eommunity when the exams wilt be given and they are even made aware of some of the items they will be asked a3Dout. He does not think items 2aand 3 are proper. ~ayor Jackson stated after receiving this memo, she ehecked into the nfommation. In reference to recruiting some b!aeks for the Police Department, on December 9, notices were posted on every bulletin board, CETA office, newspapers, advertised, eta. and three blacks took the exam and they did not pass. On March 10~ notices were posted in vari- ous places again and only one blaek took the exam and did not pass. On July 21~ again two blacks took the exam and did not pass. We certainly do not want to have anybodytreated differently than anybody else. -When they take the tests, their names are not stated and there is no discrimination. We cannot go out and drag black men in. Mayor Jackson continued that she found out today in going over this with the Police Department that there is an investigation going on regarding the incident mentioned and she thinks the Council should keep their hands off at the present time. Mr. Roberts requested Mr. Kohl to prepare a letter in response advising that we have made attempts to ree~u~t black men for the Police Dept. and the other item is under investigation. Mr. Kohl agreed and added that the investigation was being made by the State Attorney. ADJOUP/YMENT Mr. Roberts moved to adjourn, seconded by Mr~ Harmening. Motion earried 5-0 and the meeting was properly adjourned at 10:40 P.
