CALL TO ORDER Chair Hatch called the meeting to order at 6:05 p.m. 2. ATTENDANCE Secretary Prainito called the roll. The attendance is noted above. 3. AGENDA APPROVAL Motion Ms. Glinski moved to approve the agenda. Mr. Bone seconded the motion that carried unanimously. 4. APPROVAL OF MINUTES — September 8, 2011 Mato" Ms. Glinski moved to approve the minutes. Mr. Bone seconded the motion that carried unanimously. 5. RECEIPT OF REVENUE /EXPENSE SHEETS — September, October, November 2011 Motion Ms. Glinski moved to accept the reports. Ms. Prainito seconded the motion that carried unanimously. MEETING MINUTES CEMETERY BOARD BOYNTON BEACH, FLORIDA DECEMBER 8, 2011 6. RECEIPT OF SALES REPORTS — September, October, November 2011 Motion Ms. Glinski moved to accept the reports. Mr. Bone seconded the motion that carried unanimously. 7. UNFINISHED BUSINESS A. Parks Division Reports — September, October & November 2011 Mr. Balfe was not present to give the reports. Mausoleum Entombments 9 Ground Full Body Burials 19 Ground Cremains 3 Total Funerals 31 Disentombments & Disinterments 0 Disinurnments 1 Motion Ms. Glinski moved to approve the reports. Ms. Prainito seconded the motion that carried unanimously. B. Status Report on the Fountain Filtration There was no status report available as Mr. Balfe was not present. Motion Ms. Prainito moved to table this item until the next meeting. Ms. Glinski seconded the motion that carried unanimously. 8. NEW BUSINESS A. Discuss a request by a funeral director to place a marker between plots at Boynton Beach Memorial Park (Tabled on September 8, 2011) Motion Ms. Glinski moved to remove the item from the table. Mr. Bone seconded the motion that carried unanimously. 2 MEETING MINUTES CEMETERY BOARD BOYNTON BEACH, FLORIDA DECEMBER 8, 2011 Ms. Prainito advised a memo was provided to the Board after a discussion with staff. The major concern with this request was records management. The system currently in place would not allow the recording of a space between two plots. Motion Ms. Prainito moved to deny the request. Ms. Glinski seconded the motion that carried 4 -1. (Vice Chair Hohner abstaining). Vice Chair Hohner completed a voting conflict form that is attached to the minutes. B. Discuss cost of replacement vases for the Mausoleum Ms. Prainito explained there was a person who had called advising her vase had been stolen from the Mausoleum. The vases are plastic and it was unknown to staff if it was stolen or simply blew away with the high winds. She advised that it was the opinion of Mr. Balfe that based on the minute value of the vase, it was improbable it was stolen. The person who called about the vase raised a concern because she did not want to pay another $150 to replace the vase. Ms. Prainito suggested replacing the vase. Mr. Balfe was to present the fees for the replacements at this meeting and because of his absence; it was suggested to table the item until the next meeting. Motion Ms. Prainito moved to table the item until the next meeting. Mr. Bone seconded the motion that carried unanimously. 9. OTHER Ms. Glinski inquired if the gate issue could be brought up at the next meeting. She advised the frame was there and appeared complete, but it was rusted and the wood had not been installed on it. Ms. Prainito advised she would add it to the next agenda. 10. The original purchase price of a large vase for a crypt front is $150 and the small vase for the niche front is $125. These prices included the brass rings that attach to the fronts along with the cost of labor involved in removing the crypt /niche fronts to install the vases. These fees were recommended by the Cemetery Board and approved by the City Commission. Recently I received a telephone call from a woman claiming that her large vase was either stolen or lost and she was interested in purchasing another vase. Because the cost of a replacement vase insert was not established, Tom Balfe did some research and learned our cost for a vase would be $6.82 including shipping and handling. In January, the cost of shipping and handling will increase due to the increase in postage costs that are anticipated. With that in mind and the fact that these items will have to be stored and staff time of approximately 15 minutes minimum would be required during the sale of these vases, Tom Balfe and I have determined that a fee of $15 for a small vase and $20 for a large vase would be appropriate. Prainito City Clerk DATE: February 1, 2012 COPY: Tom Balfe, Christine Roberts SUBJECT: Items for Discussion at March 8, 2012 Cemetery Board Meeting During the Mausoleum lawsuit, the City Clerk's Office compiled a list of the names and contact information of people who requested selling back their crypts /niches. Since the lawsuit has been settled, those people are now asking to move forward with selling back their properties. We have also been compiling a list of people who are interested in buying crypts /niches at the Mausoleum. Although the City Attorney has given us the "green light" to buy back and sell crypts /niches, I believe a recommendation is needed from the board regarding a buy- back policy. Rule 1 -M of the Cemetery Rules & Regulations reads as follows: "1 -M Mausoleum Crypts or Niches - Prior to inurnment/entombment, an owner may transfer or resell the mausoleum crypt or niche provided the owner first obtains the written consent of the City of Boynton Beach Such consent shall be given automatically provided that the new purchaser's name, address and phone number are on file with the City Clerk and an administrative fee equal to the cost of re- lettering the mausoleum, crypt, or niche is paid in full to the City of Boynton Beach After inurnment/entombment, resale or transfer of ownership shall be allowed The City of Boynton Beach may purchase the crypt or niche at a cost of 50% of the original purchase price paid for the crypt or niche and provided that disinurnment /disentombment has occurred and implemented by the proper authorities America's Gateway to the Gulfstream The City of Boynton Beach No disinurnment /dlsentombment shall be allowed except by the consent of the Cemetery Board following written request by the owner or owners of the crypt /niche and in every case shall only be made by the proper authorities (NOTE Authorized disinurnment/disentombment and shipment of body or remains may be made only by a licensed funeral director licensed in Florida to another licensed funeral director at terminal point ) When a crypt or niche was originally sold, the City of Boynton Beach received 15% of the original sales price A transfer fee will be charged when a previously purchased crypt or niche is resold The transfer fee will be the difference between the 15% paid to the City at the time of original sale and 15% of the resale price based on fair market value the day of the resale " Paragraph #2 states that after inurnment /entombment, "The City of Boynton Beach may purchase the crypt or niche at a cost of 50% of the original purchase price paid..." However, the Rules do not address the percentage of original purchase price the City would offer to buy back an unused crypt or niche. In the case of in- ground plots, the City buys back at 80% of the original purchase price. I have placed a discussion /action item on the March 8 agenda regarding the buy -back price of a crypt or niche. In addition, the board had discussions in the past regarding the cost of Mausoleum inurnments and engraving of crypt /niche fronts. The cost of a Mausoleum inurnment has been set at $250 and engraving of any crypt /niche front (which includes the deceased's first name, last name, year of birth, year of death and a hyphen) has been set at $200 per person. Clarification is needed as follows: • Is the cost of Mausoleum Inurnment at $250 for each additional cremains over and above what was paid for at the time of original purchase? • Does the $200 fee for engraving of crypt /niche fronts apply for changes and /or re- etching? Because the lawsuit was ongoing, we were unable to seek approval of the Commission for the crypt and niche prices and other Mausoleum fees that were recommended by the board.
