Minutes 05-30-78MINUTES OF SPECIAL MEETING OF THE BOYNTON BEACH CITY COUNCIL HELD AT CITY HALL, BOYNTON BEACH, FLORIDA~ TUESDAY, MAY 30, 1978 PP~SENT Edward F. Harmening, Viee Mayor Richard D. Ca!dwell, Councilman Joseph DeMarco, Councilman David Roberts, Councilman Tereesa Padgett, CityClerk Gene Moore, City Attorney Vioe Mayor Hammening oalled the meeting to order at 8:55 P. M, and announced it was a special meeting for the purpose of ratifying the actions of the South Central Regional Wastewater Treatment L Disposal Board. He stated that the primary cation taken at this'meeting was the termination of the Chief Executive Offioer, Mr. Anthony Jo Canon. Mr. Coldwell moved,~o ratify the actions taken the evening of May 30 for the terminatio~~ of Mr. Canon as Chief Executive Qfficer for the South Central Regional Wastewater Treatment S Disposal Board; subse- quent to that agreement, Mr. Canon wi!! receive three months salary as severance pay in lieu of a release f-rom the Board of all other obligations and responsibilities. Vice Mayor Harmening turned the gavel over to Mr, Robertsto second the motion. Mr. Roberts olarified .that it had been moved and seconded to ratify the action taken at the meeting of the South Central Regional Waste- water Treatment L Disposal Board in terminating the services of Mr. Canon with three months severance pay. Under discussion~ Mr. DeMaroo stated that inasmuoh as the Board agreed to this, he will go along with it but he still eontends it should be a mutual agreement of sepa- ration of service. Mr. Roberts stated that there were many items he could not bring up without getting into a big rhubarb. Disagreements stem back to 1973 when Detray Beach tried to grab money and there have been no changes. There have been a semi:es of events whieh he does not particularly care ~or the actions taken. He does not like the method in whieh this was done and what was accorded to a man stuck between two political bodies who got squeezed. He w~_ll continue to oppose. Mr. DeMarco added that rather than see this man terminated~ he would prefer to see a mutual agreement in effect. Mr. Coldwell stated that he tried to give the party in question ample opportunity to comply with the mutual consent concept; however, it is his understanding that he chose rather ~han tende~ his resignation that we terminate his service. He wanted Mm. Canon to agree to it so we could accord- ingly reconsider the motion to terminate, but he chose not to do that. Mr. Coldwell continued in answer to Mr. Robertst position, he eon appreciate his position and view in regard to the bandying book and forth between the two municipalities; however in lieu~ of certain events and certainly in regards to the need of a management study and stipulationthat i:f we agreed to a management study to be done, we would also abide by the decisions in that management agreement, it was his understanding that Mr. Canon played some role sitting on the Area Planning Boamd in an advisory capacity that was contrary to the will of either city and definitely contrary to his opinion. However, the capable man had di££erent views as to the scope of his responsibilities and authority. Based on that, he felt Mr. Canonts service needed to be terminated. Mr. DeMarco replied that there is a big difference between temm~nation and mutual agreement~of separation. He cannot see where the two are compatible. The man agreed to quiton the basis of a mutual agreement of separation. As requested~ Mrs. Padgett then took a moll call vote on the motion as follows: Councilman DeMarco - Aye Vice Mayor Harmening Aye Councilman Roberts - No Councilman Caldwel! Aye Motion carried 3-1. ADJOURNMENT Mr. Caldweli moved to adjourn, seconded by Mr. Roberts. Motion carried 4-0 and the meetin~ was properly adjourned at 9:05 P. M.
