Mr. Kohl read a note from ~ Tom C!~rk ~d~ising thmt he discussed the
doc~u~ents ~th Mr. Pete Kelly: the County representative, and explained
that ~ne deed ~s a fo_~w~ty for ~ll romds and the City's rights ~re
not changed as for as utilities are concerned. Mr. Moore explained ho~
a clause could be included giving them the rights~of-~, but reserv~_ug
the right to m~int~_u the utf.~ties.
~r. PL~rmening moved that we authorize the proper pa~ties to execute the
deed with the Dep~uont of Transportation, State of Florida, for Se~-
crest B~le~rd~ however: the signing is contingent upon the attorney
including ~ clause that we reserve the right to opermte~ inst~ll, main-

Repor~ Regarding Qus~lifications for Police
~o ~ohl informed the Couucii thmt at the February T th City Co~uucil
meetmng~ he recommended the upgrmd~.ng of sd_l the oFx~icers in the Police
Department based on the recommend~tmon of the Chief. This ~*as done to
abolish the position of Corporal. All of the men a~fected would have a
title cha~ge, however, their duties and pay will remain the s~me. In
amending tkis resolution, ex--were ~ived but time in gr~de w~s not.
As ~ result of this, fo~r of the fifteen officers w~ld have been demoted
to Pmt~elman and Lieutenant. There are three Co~pormls who hmve not
served three consecutiveyears required to be eligible Far Sergeant.

them that a resolution was passed ~ith the stipulation that the men must
meet the qusSS_eications or it ~ould be eliminated.
~. C~ld~ell referred to readim~ through the Civil Service Rules and
stated he is ~ga&ust .limiting the time and a~y other qualifications. The
whole premise for elongation of Corporal to Sergeant was to upgrade the
Depsmtment. Orig~ he thomght this was the basic reascu. We needed
~ore Sergeants With 'their ~ssigned ~ties to hm~udle ro~d t~trols, shifts,
etc. ~e agio needed ~o~e Lieutens~ts. However, he finds that we have a
pro!i~ermtion of Captadns, A couple of .men h~ve qusdi£ted and lm%ssed
the Sergeeat's ex~m~ h~ever, there were no openings. AccordJm. g to the
Civil Service Eules~ Page 20, Section !2, ~agrmphs D~ E, F, and G, the
qu~li~*ications ~re laid out other thsa the exam. He would like to point
out that it ta~wes two years to go from Sergeant to Lieutenant according
~o o~ ~!es, but f~r some reason, it takes three years to go from Corporal
to Sergeant. if anything, the order shc~uld be reversed. For those men
not qued/fled to become Sergeaats, perhaps we should chauge the Civil
Sera-ice Rules so they make m little more sense. He referred to meeting
other specific ~les before te.~g the 0Aptain~s exam a~d he read the
section pertaining to candidates for the promotion ~o Captain. Ee ex-
plained how the time should be e~.~ified ~nd this section reused aloug
~,rlth these other upgrs~ings. ~. Boberts clarified that he was ~gainst

To: Mayor and City Council
At the February 7th City Council meeting I recommended the
grading of all the officers in the Police Department based on
the recommendation of the Chief. This was done to a~olish the
position of Corporal. All of the men affected would have a
title change, however~ tAeir duties and pay will remain the same.
In amending this resolution exams were waived but time in grade was
not. As a result of this four of the fifteen officers would have
been demoted to Patrolman and Lieutenant. There are three corporals
who have not served three consecutive years required to be eligible
for Sergeant. There was one Lieutenant that has served four and a
half years in that capacity but has no college credits~ (see attached
civil service rule and list of employees and length of service in
position).
If the Council will waive the time in grade as they can (see
Rule and Charter) I will process the paper work.

Sec. 22. Meetings, generally.
The Council shall hold; its meeting as often as twice each
month, or it may hold more ~han two regular meetings each

Sec. 23. Authority to create and abolish offices.
The Councit shall have the power, and is bereb~r author-
ized and empowered to create such offices, and the ap-
pointment of all such additional officers and employees as
may in their judgment be necessary for the government o~
said city. The Council shall have the power to abolish at any
time any office created by it; but it shall not abolish ar~

Sec. 24. Passage of ordinances and resolntions~Comgulsion of
quorum.
The majority of the members of the City Council shall con-
s~itute a quorum, but a less number may adjourn from day to
day and compel the a~tendance of absent members in such
manner and under such penalties as shall be prod by
ordinance. The affirmative vote of the majority of a quorum
present shall be necessary to enact any ordinance or adopt any
resolution other than an emergency ordinance. On final pass-
age, the vo~e of each member of the City Council voting shalI
be entered on the official record of the meeting. Any proposed
ordinance or resolution shall be introduced in written or print-
ed form. No ordinance, except an emergency ordinance, shall
be passed until it shall have been read at hvo meetings not less
than ten days apart, and the second reading of any regular
ordinance may be by captien only. An emergency ordinance
may be passed upon reading at one meeting to ~ake effect
immediately or at such time as shall be designated in the ordi-

C. Candidates must be free from any bod/ly defects, deformity, or
disease and must be certified as fit for sea, ice by a licensed
Florida physician at the candidate's expense. Candidates will
also be required to pa%s a physical agility test, w~itten test,

considered eligible for promotion to Police Chief and even
these candidates will not be declared eligible u~less they
meet the following time-in-grade requirements= m/n/mum of
two (2) years as Deputy Chief of Police on the local foz~e.
Candidates must also present proof of po/ice practices
and other related abilities and skills gained tk~ugh compte=
tion of a 120-hour bachelor's degree in PoliceA~nist~ation
or a related field at a recognized and accredite~college o~
university.
The appointing authority may, however, select~ and appoint a
Police Chief from outside the city service provided the
cand/date meets all stated requ/z~m~nts except that his
service is not locally attained, if in the authority~s
opinion~ such selection is in the best interest of the City
of Boynton Beach, and holds a cer~rified certificate of
required number of hours trainingbythe State of Flor~da.

FIRE PROMOTIONS: P~omotions in the Fire Department shall be From
