Mayor Jackson welcomed everyone and called the meeting to
order at 7:30 P. M. She requested everyone to please rise
for the invocation given .by Rev. Ernest Campbell, First
Bap%ist Church, followed by the Pledge of Allegiance to the
Flag led by Vice Mayor Ed ~s~mening.
Mayor Jackson referred to jlust tekfng seats at the last meet-
ing and ascertained that none of the Councilmen desired to
make a change.
AGENDA APPROVAL
~-~yor Jackson asked if there were any additions, deletions,
or corrections to the agenda. M~. Caldwell referred to about
30 days ago when the question was discussed regarding non-
conforming lots an~ construction on these and stated that the
30 day period was closely approaching and if there is a report
forthcoming, he would like to hear it this evening or if not,
move for continuation on the moratorium. Mayor Jackson re-
plied she believed there was some information and ~. Moore
added that he was prepared to discuss it. ~yor Jackson sug-
gested this report be- given under LEGAL and also requested
the City Attorney to give some information regarding the
friendly lawsuit with Delray Beach. ~.~. Harmening moved to
adopt the agenda with these additions, seconded by ~. DeMarco.

~yor Jackson announced that I~. Edgar E. Howell, our Build-
ing Official, has recently been appointed to the Building
Advisory Board and elected President of the Palm Beach County
Building Officials Association and she extended congratula-
tions.
~yor Jac?~on announced that she heard tonight that there is
a great shor'tage of blood and anyone wishing to donate blood
should get in touch with the Palm Beach County Blood Bank.
Y~yor Jackson announced that the Legislative Delegation will
hold a clinic in these Council Chambers on January 30 at
9:00 A. M.
M~yerJJackson announced if anyone wished to speak eh any item
on the agenda to please give the~ name to Mrs. Padgett.

When called upon by Mayor Jackson, the Councilmen replied
they had nothing, Mayor Jackson referred to Page 10 under
the City Mmnager and City Attorney and stated that it should
say the vote was for Mr. Frank Kohl and Mm. Gene Moore. She
referred to Page 11, u~uder Appointments to City Boards and
~0m~ttees~ and stated it should read: ~yor Jackson referred
o ~ne 197~ Council informall~ discussing these apoointments
last week, etc. She referred to Page 13, under Community
P~omotions Board, and stated it should read: She added that
places have been fou~ud for "some~of" these people on other
Boards, etc.
Mr. DeMarco moved to approve the first portion of the Minutes
of January 3, 1978, seconded by Nm. Caldwell. Motion carried
3-0 with M~. Roberts and F~. Ha~men_ng abstaining.
~m. Roberts made a motion that the second section of the M~n-
utes~of January 3, 1978, be adopted as corrected, seconded by
~. Harmening. Motion carried 5-0.
Special City Council Meeting - Je~auary 6~ 1978
When called upon by Mmyor Jackson, the Co~&ucilmen replied
they had nothing and Mr. Caldwell abstained. M~jor Jackson
referred to the first page, third from the bottom paragraph,
and made the addition in M~. Roberts, motion that the excess
two names should be held "for consideration' until such time,
etc.
~@o Harmening moved the adoption of the Minutes of the Special
Meeting of January 6, 1978, as corrected, seconded by Mm.
DeMarco. Motion carried 4-0 with ~. Caldwell abstaining.

Mayor Jackson asked if anyone in the audience wished to speak
on any item which was not on the agenda and received no re-
sponse.

One (I) Dory Row Boat
~m. Kohl read the attached memorandum from Mr. Charles C.
Frederick dated January 16, 1978. He requested the Council
to approve the purchase of this boat for $2,185 from Warren
Yachts.

Seacrest Boulev~_rd Utility Relation Pro~ect
~. Kohl requested this bid to be awarded to Barile Excavat-
ing & Pipeline Comp~m~y, Inc~in the amount of $31,930.20.
He explained how there would be change orders for the wet
taps and fire hydrants up to the $60,000 granted by EDA.
Mayor Jackson requested the bids to be read for the record.
Mx. Kohl stated that Barile Excavating & Pipeline Company,
Inc. bid the amo~ut of $31,930.20 with a completion time of
90 days and Webb General Contractors bid the amount of
$38,485.45.
M~. Roberts questioned the amount to be paid by the City and
M~. Kohl informed him it wouldbbe paid By the Fsderal Govern-
ment 100~.
~. Caldwel! moved the granting of the bid for the Seacrest
Boulevard Utility Relocation Project to Barile Excavating &
Pipeline Company, Inc., in the amo~ut of $31,930.20 with a
completion time of 90 days, seconded by Mr. Harmening. No
discussion. Motion carried 5-0.
Mr. Kohl added that he would ~ring back every one of the
change orders, so they can see what we are doing on the wet
taps.
N. E. 7th Street Drainage .& Road Construction
F~. Kohl read the base and alternate bids receivsd from
Cameroon Enterprises, Rubin Construction Company, and Webb~$eeMin. o£
General Contractors. He referred to being allotted $90,000 2/7/78
from EDA and told about M~. Clark making some changes in
order to gettthe base bid within $90,000. Based on the
ch~uges, Camero~uEnterpris~ submitted a bid of $84,012.81
and Rubin Construction Company submitted a bid of $88,E44.77.
The change~orders have been prepared and he told about ob-
taining EDA approval.
M~. Kohl referred to Camero~nEnterprises not having any
road building experience, hut explained that with Federal
grants, the low bid must be acceoted but the City will m~e
inspections to make sure the specifications are met.

M~. Roberts referred to a bond being posted and M~. Kohl in-
formed him that Rubin Construction Company signed an affidavi$,
but since CamerounEnterprises ia a minority group, he has a
letter from the County that they will produce the bid bond
from the Federal Government. M~. Kohl explained further
that ~e did not have a choice with the Federal law, but must
accept the lowest bidder. He is in favor of giving a new
company this opportunity, but the specifications must be met.
M~. Roberts clarified that there were safeguards with the
inspections. Mr. DeMarco asked what s~surance we have that
it will be finished in time and M~. Kohl explained that it
was up to us and we must be specific in what we expect. Me.
Harmening referred to this being paid for 100% by the Federal
Government and M~. Kohl agreed.

Enterprises for the s~id amount of $84,012.81, seconded by
~k~. Harmening. Under discussion, >~. Caldwell remarked that
it was nice to see construction firms in Boynton Beach bidding
on Boynton Beach work. Motion carried 5-0.

Mr. Roberts moved to take this proposed ordinance from the
table, seconded by Mr. DeMarco. Motion carried 5-0.
I~L~yor Jackson asked if there were any questions before a
motion was made and M~. DeMarco referred to the second page,
item 4, stating that the recreational vehicle, boat mud/or
boat trailer must be o~rned or used by the resident of the
premises and asked how this would affect someone visiting a
resident. Mayor Jackson agreed this was a little restrictive
and explained how a resident could have a &uest visiting and
such a vehicle would be their only trm~sportation.
Caldwell pointed out that it did not say fulltime resident
and could mean temporary resident. Mayor Jackson referred
to Page 3 requiring it to be registered and license~ in the
State of Florida. F~. Moore offered to read the ordinance
in full for clarification and Mayor Jackson replied that it
was almost time for the public hearing at 8:00 P. M. and
suggested proceeding to Item D and leaving this until after
the public hearing.

~. Moore referred to there being a reco~endation submitted
from Mr. Cessna and ?~. Kohl clarified that all funds would
come into the City and any repairs or renovations must be
expended from these payments. The City will not expend any
money whatsoever from our own funds for this plant. P~.
Harmening referred to there being any problem collecting
the water bills and M_~. Kohl replied there had not been any.
Mm. Caldwell referred to Section 3 of the agreement and ques-
tioned when it would be determ£zned there would be surplus
funds and ~. Kohl replied that there would not be any surplus

funds as all our operating expenses and repairs must be de-
ducted each month. ~. Caldwell clarified that it would be
t00% expenditures and Mx. Kohl replied that it must be done
each mud every month to keep the plant in good operation and
the County and State will work with us. Mx. DeMarco asked if
the intent was to hook to our lines and M~. Kohl replied that
he did not k~uow at this point. Mr. Harmening asked if we
could get the two lots the plant is on smd ~, Kohl replied
that the County bought them. ~. Harmening stated that we
should get the land the plant is on and ~. Kohl replied that
possibly the County may ~nter an agreement. Mr. Roberts
asked if we were paying rent mud ~. Kohl replied negatively.

Mayor Jackson asked if anyone wished to speak in favor of this
rezoning.
Mr. Charles J. Simon appeared before the City Council and in-
formed them that the lot in question for rezoning is on the
corner of Seacrest Blvd. and Gulfstream Blvd. on the south
edge of the boundaries of Boynton Beach. He has owned this
lot for several years and a lot of changes have taken place
during the years. He told about the traffic patterns in
this area and referred to the locations of the schools and
buildings nearbF. This lot is zoned RIA, but he doesn't
believe it would be reasonable for someone to build a house
on this corner with the heavy traffic from the school, etc.
He requests rezoning to Ct, Eo he can build a professional
building on this lot. He has submitted a petition from the
people living in that area in favor of this rezoning who
would like to see a nice professional building on this lot.
He then told about the Presbyterian Church having plans to
build a school just to the south and across the street. To
the south along Seacrest Boulevard, there is not one house on
the east side. He is requesting this rezoning and it is not
a request for strip zoning because it zs a strip i2~elf being

M~yor Jackson referred to the new Councilmen not having re-
Ceived a copy of the minutes from the Planning & Zoning
Bo~rd'e review of this application and requested N~. Ryder
to give additional information. Mr. Simon Ryder informed
the Gounciltthat the Plar~uing & Zoning Board recommended
denial. He advised that these same arguments were presented
to them, but the Board felt it would be spot zoning and pre-
ferential treatment and there is also a lot of area along
Seacrest Blvd. zoned C-1 which is vacant.
M~yor Jackson asked if anyone wished to speak in opposition
to this zoning change and received no ~esponse.
M~. Caldwelt pointed out that south S~crest Blvd. is rather
rapidly becoming a medical center serving Boynton Beach and
Delr~v Beach. With ail due respects to the Planning & Zoning
Board,s opinion, he feels a medical building in this area
wou~ not really be that detrimental or detrimental a~ all
Eo this particular ares. ~. Ryder informed them that an
application has been received for a professional medical
center just south of Bethesda Hospital with 22 units.
~. De~rco stated he has felt for years that Seacrest Blvd.
s~ould be commercial, it isggoing to be widened ~d he does

Mr Harmening states that it see~ed to him this area is
rapidly going professional. He isffamiliar with the site
and cannot see any objection to this rezoning. He does
not believe a professional office or medical building would

think it would be objectionable, but referred to there
being homes on Seacrest Blvd. ~d she does not agree all Seacrest Blvd.

De~rco. Under discussion, ~. Caldwel! stated he was in
complete harmony with the basic, premise about the beautiful
ho~e recently built$ however, there isaa hill in front of it
which is a natural barrier. This land is at the bottom of
this section and the zoning ordinance requires a physical
barrier to be placed between commercial e~d residential zones.
He thinks Boynton Beach should grab as much of the doctor
trade as possible. There is Bethesday Hospital and another
medical complex proposed. ~. Ryder clarified that he re-
ferred to this proposed complex to point out tner~ = is plenty

of undeveloped C-1 area on Seacrest Blvd. The trend is Pro-
fessional centers with a number of offices for doctors a~d
dentists.
~. DeMarco aeked hk~. Simon if he intended to build the build-
ing ~ad M~. Simon replied affirmatively, but advised that the
lot was probably large enough only to house himself ~ud his
associate. He is not saying there is not enough professional
property in Boynton Beach, but this property is not suitable
for a single family home which must be built. He would not
liwe in a house on that corner with that traffic pattern. He
bought the property seven to eight years ago and there is a
bi~ difference ~ow. M~. Roberts questioned the size of the
lot and ~. Simon informed him it was two lots approximately
150 x 140 ft.

Mm. DeMarco questioned whether to amend Section 4 and

City Council that the Planning & Zoning Board considered
transients, but decided the main purpose is to take care of
~he residents. He explained how neighbors were u~uallF
olerant of visitors and they did not think trans!ents had
to be addressed. Mayor Jackson referred to the $500 fine
and stated she did not want a visitor to park in her yard
and be subject to the fine. She referred to many people
having recreational vehicles as their only means of trans-
portation and stated to have it parked in the yard for only
one minute would be a violation of the law,
Mso Roberts asked if the fine was rather steep and Mr.
DeMarco informed him it was the maximum. Mr. De~rco re-
ferred to not we~ting people from other cities park their
campers and stated he would like to see something for visi-
tors or relatives included. Ms~or Jackson suggested possi-
bly amending it to owned or used by the resident or visitors.
~. Moore then explained how the $500 was a me~imum fine and
if there were violations, it may not be enough. He then
explained how they also must consider the possibility of
people renting out their driveways. F~. Annunziato clari-
fied that loosely defined, he did not think resident would
exclude a ~_est at the home and Mr. Moore agreed a guest
would be in residence at the house. ~.~. Moore added that
the ordinance was in great shape now.
~yor Jackson referred to No. 5 stating must be currently
registered and license~ by State and Federal law and asked
if this meant any state and ~. Moore replied that it means
properly registered according to requirements. ~. Annunziato
added that it mainly meant that a vehicle kept here year-round
must be kept in good condition and be mobile.
~. De~rco stated that inasmuch as resident includes visitor,
he makes a motion to adopt Ordinance No. 78-2 on first reading,
seconded by ~. Caldwell. No discussion. Mrs. Padgett took a
roll call vote on the motion as follows:

Consider Establishment of a New Zoning Classification
Councilman Richard D. Caldwell
Mr. Caldwell referred to awhile back when man~- residents out-
side the corporate limits of Boynton Beach viewed their opi-
nions why they did not wish to be incorporated and one of the
points which sat heaviest in his mind was the fact they liked
the wide openness in the County, like to have limited control
over having horses on the property, etc. It occurred to him
that possibly this Council should create a speciat zoning
classification to entice and encourage people in the unincor-
porated areas to turn to the City. Possibly we should have
an estate type zoning with a minimum lot size of at least one
acre. He has been approached by people in the unincorporated
area asking about annexation, lhe County has been downgrading
zoning and decreasing dSmsTit~ and they do not like this. He
explained how they ~ere concerned with developers build%rig
adjacent areas with four to six units per acre. He thinks
the people should be offered an alternative to be able ~o
remain in the County and be subject to higher,density or the
City have a special zoning classification created for estate
type zoning with a minimum lot size of one acre. He thinks
it will entice the people in the unincorporated area to~ look
towards Boynton Beach rather than the County. It will also
aid in a more organized growth of the annexed reserve area.
It will discourage the unincorporated areas from going to the
County for all the problems they have now. He suggests having
the Planning & Zoning Board possibly look ~ into the feasi-
bility of establishing an ordinance and creating such a new
zoning classification.
~. Roberts questioned zoning land not in our annexation area
and ~. Caldwell informed him the land was in the County in
our reserve annexation area and he referred to the area of
Hypolu~o and Lawrence Roads as an example. N~. Roberts asked
how the City could zone land which we don't own and
Caldwell clarified that he was not as~king to nut zoning on
people, but to create a zoning classification-to entice these
people to incorporate into the City based on their main objec-
tive of liking the wld~ open spaces and our minimum_ lot size
is 9,000 sq. feet. He explained how a developer could build
and there would be protection for the estate type situation.
~. Roberts replied that there s~e restrictions by the State,
County and City as far as annexing. With the vast change in
times, he does not see any benefit. This seems to be a little
unnecessary. There will be many changes every year from the
County and State.
~. DeMarco asked if we had authority to do this and M~.
Caldwel! clarified that he was not asking for us to annex
anyone. He is not asking to impose a z~oning classification
on these lands. He is asking for the first steo in progress
to crea5e a zoning classification, so if the opportunity

arises with the people remaining in the County or being incor-
porated,into the City, they will decide to come into the City.
~yor Jackson clarified that he was asking to have this turned
over to the Planning & Zoning Board to cheok the feasibility.
~. John Johnson, 4354 Redding Road, appeared before the coun-
cil and referred to this same item coming up under a different
color every year. He suggests if the Council wants to do some-
thing about this, they should giwe input at the meetings held
by the County on zoning and planning. The City has taken areas
west of town and allowed dense situations. He explained how
the people in the uninEorporated areas were interested in what
the City could do for them. He told about his subdivision
being-built accordi~ug to regulations. Anything coming into
the City should be adjacent to it and the City should be able
to furnish sewers and water. He does not think this is a pro-
hlem o£ the City as~they have enough problems in the City
limits without worrying what they are going to do at Lawrence
and Hypolnxo Roads. When the~ start zoning something which
does not belong to the City, the real estate agents will be
all o~er. M~. Roberts replied that he was incline~d to agree.
The City can create any kind of zoning, but it does not hold
the developer to it. He is not in favor of this plan.
~Ar. Cald~vell clarified that he was not asking for the City to
incorporate anyone or mmpose zoning on a~¥body. He is just
asking this City to give some thought to creating a soecial
zoning classification which will be available to thes$ people
in these ~eas should they wish to be annexed under such zon-
ing instead of remaining in the County with the higher den-
sities, it would be a special classification created to meet
their likes. He is asking the Council to consider directing
the Planning & Zoning Board to look in~o the feasibility of
creating this classification so it is available and can be
offered to the people in the unincorporated areas for annexa-
tion purposes. He is not trying to sol~etheir problems. He
would not vote to annex anyone unless police, fire, water and
sewer can support the annexation. He is just asking to
create something so that somewhere down the road, people may
want toccome into the City of Boynton Beach because we have
a classification ~o protect their rights.
Mayor Jackson referred to the Chairman of the Planning &
Zoning Booed being present and requested that he discuss
this with the Board and make a recommendation to the Coun-
cil.
~. DeMarco referred to this being the same situation as Boca
Raton and ~. Caldwell replied that it was completely differ-
ent. We are mot trying to tell the developers how much or
we will not supply water.

Mr. Caldwell moved to direct the Planning & Zoning Board to
consider the creation of such a special zoning classification
for future use. Mayor Jackson ascertained the motion died
for lack of a second.
Friendly Lawsuit with Delr~y Beach
~. Moore told about having a full day of depositions at
Delray Beach City Hall last Friday. He advised that a draft
of the Operation and ~intenancs Manual prepared by Russell &
Axon was interjected and in the original grant from the Fed-
eral Government part of the obligations was to abide by the
Operation and ~intenance Manual prepared by Russell & Axon
approved by the Board and EPA. He thinks this will allow us
to pin down the manner in which Delray ~each will be required
to operate the plant. It will tie down they will operate the
plant in strict accordance with this man~al and the Board will
set the number of persons that would be allocated to carry
out the functions and the cost of hiring those people and
psJing them for the operation of the plant would be set by
the Board. Ee advised they would be meeting tomorrow and
will attempt to come up with a draft agreement which he
thinks is a major break-through. He told about Mr. Startzman
giving some strong testimony. The court hearing ~omorrow has
been cancelled and he thinks there will be something~workable
subject to the Board approving this manual along with EPA.
Mr. Roberts referred to there being some talk about the Inter-
local Agreement not being filed and Mm. ~oore replied that
we have a certificate from the Consumer Affairs Department
that it is not there and if that certificate is true, it
should be filed to correct that situation.
Mr. DeMarco commended the City Attorney and M~. Startzman
on their work. He added that the Board should work this out
and he thinks we have a good agreement now and he is looking
forward to progressing in harmony with Delray Beach. Mayor
Jackson suggested that the City Manager write a letter to ~.
$tartzman thank~r~ him and M~. Kohl replied that he would.
Non-Conforming Lets
~s. Padgett advised that several people had requested to
speak on this item. Mmyor Jackson requested Mr. Moore to
give his input first. Mr. Moore referred to this being a
controversial issue and it having been mentioned that there
is another attorney,s opinion and stated if such an opinion
exists, he would like it presented for his consideration.
He explained how the Building Department applied 50 ft. lots
to Section ~.1 of the Boynton Beach Code of Ordinances and
stated this was passed by the City Council after thorough
research and done in accord with the Palm Beach County Ordi-
nance. He referred to this situation being an old problem

A~ told about the laws allowing 50 ft. lot owners to utilize
their property all over Florida. He explained how one owner
o£ several lots could convey the ownership to other members
o~ his family in order to avoid meeting the minimum lot front-
age. The courts will uphold the landowner's right to build
on 50 ft. lots. He knows of no way of totally solving this
problem. He referred to this situation work~ug itself out in
time and added that he believed it was the intent of an owner
of 50 ft. lots in Lake Boynton Estates to ret,mm the land to
acreage and re-subdivide. He has no formula that would solve
the problem which has been complained about that would with-
stand the judicial test.
Mayor Jackson told about being asked why we could not replat
at the same time we rezoned and she replied that platting is
all registered in the County Court House. ~. Moore informed
her that the City has no right to replat a person's property.
The City can rezone it, but cannot replat it. ~aere is a pro-
cedure for ~acating and abandoning any plait which must go
before this Council. He explained how an owner could replat
in accordance with re~lations. It cannot be change~ without
the concurrence of the owner.
~@. Caldwell stated he could appreciate Mr. Moore's thorough-
ness and appreciate his apprehensions in regard to drafting
a new ordinance which may end up in a loss for the City, but
he feels it is this Council,s responsibility to protect the
existing residents of this City to help protect the ~alue of
their homes and to protsct the continuity of their existing
neighborhoods. It is on this premise that he is in favor of
moving for the drafting of an ordinance which would allow
non-conforming lots to be built upon only when they are iso-
lated by already developed homes. When there is a tract of
land which is owned hy one developer and he plans on develop-
ing this tract of lan~, he thinks it would be mn the best
interest of the residents of that area and the City to estab-
lish continuity in that particular area. He thinks the City
must stick its neck out to protect the residents of this City,
the people who live here, work here and retired here. He
withdrew his motion until the people have had an opportunity
to spe~.
Rev. R~!ph Hughes, ~110 N. W. 8th Court, appeared before the
Council and read a letter from the Homeowners Association of
Laurel Hills, Glen Arbor and Gordon Park referring to the
building on 50 ft. lots and requesting that Section ~t.1 be
rescinded and also requesting the moratorium to be extended
an additional 60 days to give the Council sufficient time to
research this issue thoroughly. Rev. Hughes then referred
to this developer building on continuous 50 ft. lots and
stated he could no~ understand the hardship involved. He
referred to the City talking about upgrading zoning for years
and stated that something should be done about this crowded

situation. They feel something can be done and if there is
anything that can be done, he thinks the Council owes it to
them to doit. They are not happy about this situation and
are willing to obtain au attorney to protect them. They
voted for the Council members and hoped changes would be
made. He then submitted pictures of how it was before the
changes were started. ~. DeM~rco asked if their attorney
had any proof which would give us something to go on, as
according to our City Attorney, we would be in violation
and be subject to suit. Does their attorney have anything
concrete to offer arid Rev. Hughes replied that unfortunately,
he did not talk to the attorney. Mr. DeMarco requested the
people to call M~. Moore with any information.
Rev. Hughes stated he was of the impression that ~eordinance
was passed that 60 ft. would he the minimam frontage and Mr.
DeMarco replied that the 50 ft. lots are grandfathered.
Mayor Jackson added that this area was platted in 50 ft.
lots.
M~. Roberts asked how some of these problems could be eliminated
and referred to an owner having a 50 ft. lot? between two build-
ings and M~. Moore informed him that this had been ackuowledged
as one of the exceptions, Mr. Roberts asked how they would
justify the one lot to remain and make two or three comply and
M~. Moore replied that he was not trying to impose his will
to what these people are suggesting. This Council is being
asked to make a political decision. His function is to give
legal advice. Any kind of Ordinance can be passed that the
Council wants and it may stand up. He just gave his legal
opinion after researching the matter. The courts are very
reluctan~tto deny a man the use of his proPerty if designated
on a platted basis.
Rev. Hughes stated he could understand if a person had a 50 ft.
lot and wanted to build a house, but cannot understand how a
man with contiguous lots can build on them all. ~. Moore
referred to the possibility of having nine o~ners with n~ne
contiguous lots and Rev. Hughes replied they would have to
consider the individual hardshio. ~. Harmening stated there
were too many subterfuges which~could be used by the owners
or developers. Rev. Hughes referred to when application was
made for permits for five to six houses and Mr. Harmening re-
plied that case would be flagrant. He added that if the
City,s attempt to upgrade zoning was considered to have 60 ft.
lots instead of 50 ft. lots~and this is done, it would be
flouting our attempt to upgrade zoning.
~yor Jackson stated that the ~&ze of the building must meet
zoning requirements and Rev. Hughes replied that minimum lots
are downgrading abutting property. M~yor jackson told about
most people wanting a larger lot if the property was available,
but stated she did not see how we could push something on the
people.

Rev. Hughes stated that if it creates a hardship, he can
understand it, but cannot understand a hardship with a man
making money and Msyor Jackson replied that a man could not
be penalized for m~ng money.
Mm. Roberts referred to being asked whether this Council or
the City Attorney could come up with an idea and asked if
there was any way to prevent three to five lots from being
used without replatting and Mm. Moore replied that the point
is where to draw the line. If there are two 50 ft. lots be-
tween buildings, what should be done? Rev. Hughes stated
that individual hardship should be considered and M~. Moore
referred to the possibility of three separate owners owning
three lots. Rev. Hughes stated it was obvious when it was
done for development purposes.
~. Harmening moved to impose an additional moratorium on
construction on 50 ft. lots for 50 more days and direct the
City Attorney to use all of his skill mud knowledge to pre-
pare an ordinance where we can direct this type of situation
back to the Board of Adjustment. He added that the Board of
Adjustment has done well in the past in many cases determining
where a hardship is imposed. If there is a genuine hardship,
it should be established before the Board of Adjustment. ~.
Caldwell seconded the motion. Under discussion, M~. Roberts
clarified that at this particular time, they do not have to
~ob~fore the Board of Adjustment to build on 50 ft. lots and
the motion is to have an ordinance forcing them to go to the
Board of Adjustment and let the Bos~d of Adjustment decide
whether there is a hardship. ~. Harmening stated that the
Board of Adjustment has resolved this in the past and it can-
not be resolved to everyone,s satisfaction. M_~s. Padgett
advised that four other people had requested to speak and
~. Harmening withdrew his motion.
M~. A1 Clemens, 899 N. W. 8th Avenue, appeared before the
Council and asked if a parcel of land was platted to a 50 ft.
lot mud is purchased by a developer, ~oes he inherit the
50 ft. plat and M~. Harmening replied affirmatively.
~. Robinson appeared before the Council and asked if this
moratorium applied to 66 ft. lots and Mayor Jackson replied
that it only applied to 50 ft. lots. M~. Robinson ques-
tioned the minimum conforming lot and M~. Harmening informed
him it was 60 ft. Mm. Moore added that it depended on the
zoning classification. Mm. Harmening clarified that under
the City Zoning Code, the lowest residential zone allows a
60 ft. lots ~. Robinson stated he bought 66 ft. lots in
Mmngo Heights and applied for permits which were denied.
~. Howell checked the zoning map and advised that this was
zoned R1A and 60 ft. lots are the minimum required.

M~. Jo-hn Albritton, 815 N. W. 13th Avenue, appeared before
the Council and referred to the grandfather and hardship
situation on 50 ft. lots and stated it seemed when one ori-
ginal land owner purchases a lot in a platted area and the
zoning requirements are changed, he would fall under the
grandfather clause and be allowed to build. However, if
that same land owner sells ten lots to a single individual
for development purposes, that next owner would not fall
under the grandfather clause and that land owner would have
to subdivide or develop the land according to the zoning
regulations. If the original land owner sold lots, one lot
at a time to separate individuals, then each individual would
fall under the grandfather clause. He believes if it is re-
searched, they will find it would probably hold. He thinks
M~. Moore has researched this thoroughly, but is going strictly
by the situations which have gone to court under specific
guidelines~ Building should be allowed on one lot if there
is no additional land available. He explained how a hard-
ship should not be granted to the owner of two tots wanting
to build on each lot.
Mr. Roberts referred to p~ssibly having a solution and referred
to some years ago when Mr. McLean was running a gas station
and had to adhere to the new zoning. It seems we might be
able to state ife~anyone has more than one lot, over two or
three lots, the purchaser should be made to conform to the
new zoning. He thinks this particular section could be
amended. Mayor Jackson replied that she thought this was a
legal question. ~. Caldwell replied that this was the direc-
tion he favored.
Mr. Harold Werger, 719 N. W. 7th Court, appeared before the
Council and requested to set the record straight on a few
things. He referred to there being about seven houses built
on 50 ft. lots years ago and told how he had verified this
ruling regarding 50 ft. lots nine months ago and advised the
~embers of the Laurel Hills Homeowners Association about this
~ituation. Last October, he listed his lots with a real es-
tate agent for sale and the only condition in the sales agree-
ment was that the buyer could get a building permit and the
lots were clear. He made no specifications whatccould be
built on the lots. The lots were purchased and building per-
mits secured, but he had nothing to do with it. He told about
being criticized for doing this and also Mr. Strnad stated at
the ~ecember 6 Council meeting that he should have had the
lots resurveyed. He could have had them plotted in 1OO ft.
lots, but it would have made no difference. The law allows
building on 50 ft. lots. The design of a house makes a
difference in the value and not the 50 ft. lot. if the
house is designed properly, no matter what size the lot is,
it has more bearing on the price of the house. If they want
to uphold property values in this City, the properties should

trailers eliminated, etc. JAS Builders are building a
house on a 50 ft. lot there and the selling price is $45,000
and that is a top prmce which is not running property values
down. If these houses are properly designed, he does not
think they will hurt property values.
Ma. Roberts asked if that particular section could be re-
established that when a property is sold, they lose that
particular plat and must replat and Mayor Jackson asked if
this would be legal. ~. Moore informed them that they could
not interfere with a platted lot.
Ma. De~co asked M~. Robinson if he would reconsider utiliz-
ing 60 ft. lots instead o~f 50 ft. lots ~ud Mr. Werger replied
that the houses are already built. M~. DeMarco questioned how
many more lots there were and Mr. Robinson replied there were
none. He clarified that he bought eight lots from ~. Werger
based on the fact he could build on 50 ft. lots. The roof
structures are up. He told about the design of the house
fitting on the lots since they were 148 ft. deep ~d all have
an 1~ ft. setback on each side. Mr. De~arco asked if there
were more contiguous lots in Laurel Hills and received an
affirmative response from the audience. M~. Caldwell stated
that we cannot impede Ma. Robinson,s construction underway,
but the problem to be solved is to deal with the remaining
undeveloped contiguous 50 ft. lots in the City. With all
~us respect to Mm. Werger and all the residents in the Laurel
Hills area, this whole thing may have been brought forward
by the Laurel Hills Homeowners Association, but he personally
is not just concerned with the Laurel Hills area as there are
other areas in the City facing this same problem. We are not
trying to solve a particular problem in a particular are~,
but are trying to solve ~ Citywide problem now and in the
future.
~. Harmening stated that his motion was to continue the
existing moratorium on two or more contiguous 50 ft. lots
for 50 days, specifically exempting single 50 ft. lots, and
direct the City Attorney to prepare the necessary ordinance
~o accomplish the intent of this. The intent is to maintain
and upgrade the zoning wherever possible. ~. Caldwell
seconded the motion. Under discussion, ~. Roberts clarified
that he did not mean the zoning and M~. Harmening replied
there would be no ch~uage in zoning. ~. Roberts stated he
was in agreement to make everyone go before the Board of
~djustment for two lots or more. M~. Harmening clarified
that the whole intent is where there are contiguous lots, he
thinks they should be redivided to come up with something in
excess of 60 ft. We are talking about all present 50 ft.
lots where there is contiguous undeveloped property. M~.
Caldwell asked if he was also tsd<ing into consideration the
unity of title and ~. Harmening replied that was a hard
thing to get around. However, in the past, before Section
11.1C came into existence, any smd every 50 ft, lot had to go

before the Board of Adjustment and it was a hard situation
for the Board of Adjustment to determine what kind of hard-
ship existed, but they considered many and ca,ne up with good
solutions in most cases. If we could revert back to that
even though possibly imposing a hardship on the Board of Ad-
justment~ nevertheless, it will have the effect of upgrading
zoning from 59 ft. to 60 ft. lots which is the premium resi-
dential lot size. Mr. DeMarco agreed if it was within-%he
legal means.
M~yor Jackson stated she also questioned the legality and
told about the area where she lives being platted in 50 ft.
lots and when appearing before the Board~of Adjustment,
people stated they could not buy additional property.
Harmening replied that he didn't think anyone would question
the legality of putting on an additional 50 day moratorium
to explore the details and come un with a solution.
~Sr. Moore asked if it was the intent to repeal Section 11.1
which now provides an exception for. platted lots not meeting
the minimum frontage and M~r. Harmening replied that he thought
this would probably be the mostllogical way; however, if he
can come up with a better solution, he would be for it. ~w.
Moore asked if they wished to differentiate to a single lot
and ex~lalned how there could be the possibility of having
two lots with two owners unwilling to sell. ~. Harmening
stated they could not deny a man the use of his property.
Mr. Moore a~ked if they wanted to make this an exception
and M~. Harmening replied that they probably should. Mr.
Moore clarified that the exception would be an isolated 50 ft.
lot by ownership. ~. Caldwel! stated that if there were ten
people owning a string of 50 ft. lots and all e_~e sold to one
owner, he would become a common owner and would have to sub-
divide. ~. Harmening added that if an owner owned two lots,
he should have to use both lots for the one house.

in futility. In analyming the cost of a new county, he
thinks they would be overwhelmed. M~. Roberts replied that
he thinD~ the vote was to go along with a feasibility study.
Mayor Jack~on stated that as she looks at this, she has never
known a feasibility study to be free and she is beginning to
get suspicious of it.
~. Caldwell clarified that they were asking for a feasibility
study to be done and indicated it would be at no cost to the
City and based on those two premises, he sees no reason for
not looking into it. It has been bandied around for several
years. At one point we were all oart of Dade County ~ud it
was s~bdivided into Broward and P~lm Beach Counties.
Mayor Jackson referred to having had a good working relation
wit~ our County Co~missioners and stated we have been ask~g
for the 55 acres at the south end of the City and she is won-
dering if we would be causing some doubts in their minds
would they use that to withhold ths land? M~. Caldwell re-
plied that he coul~ appreciate her concern, but he was not
saying they are doing a lousy job but it might be feasible
for a smaller county situation to occur. All we are saying
is let's look into it. We are not saying we will go one way
or the other. If it will be expensive, obviously he would
not support it. All we are trying to establish is whether
we should look into it.

having ~. Kohl write a letter advising we have had a change
in our Council and advising that she will serve on a tem,
porary basis until the Governor appoints someone. She does
not want to be a permanent member until an appointment is
made.
M~. DeMarco suggested recommending ~yor Emily M. Jackson
and ~. Kohl replied that the Governor always liked to ap-
point Mayors. He advised that he would write a letter to
Commissioner Lake Lytal advising that Mayor Jackson has been
appointed by this Council. M~yor Jackson also requested a
letter to be sent to the Governor.

Mayor Jackson told about the Chamber of Commerce calling her
asking if we are going ~o continue on this. She thought Mr.
Caldwell was going to continue and thought Mr. DeMarco said
he wanted to be on it. She will gladly relinquish and let
him take it.
H~. Roberts ~uestioned what this was all about and Mr. Caldwell
explained about the concern in the City to have a high school
located in the City limits of Boynton Beach or directly west
of Boynton Beach. He also told about the Task Force meetings.
Mayor Jackson clarified that she was only asking if Mm. DeMarco
we~nted to serve on this and ~. DeMarco replied that he volun-
teered previously. Mayor Jackson asked if the Council wanted
go accept Mm. DeMarco.
Mm. Roberts moved that ~. DeMarco be chosen, seconded by Mm.

Consider Request from the Owners' League of Village Royale on
the Green
~yor Jackson announced this was in reference to a resolution
passed by the Owners' League of Village Royale on the Green.
She feels ~est Palm Beach and Palm Beach County have been hurt
by the planes having low cost flights going to Miami and Fort
Lauderdale. She feels Palm Beach County has lost a great deal
of the tourist trade and thinks this is a good idea. However~
instead of just asking for this to New York City, she thinks
it should apply on any kind of special rate to amj place in
the Unite~ States. ~. Roberts clarified that to any place
to or from ~est Palm Beach. ~yor Jackson continued with
suggesting to send a copy to every city, She added that she
suggested this to the Municipal League and they agreed.
M~. Harmening moved to instruct the City Attorney to draft a
resolution including this resolution a~ud also include all
cities and any airlines offering disco~unt fares in and out of
Miami and Fort Lauderdale also include ~'~est Palm Beach in the
sa~e package. Mayor Jackson suggested pointing out that we
are losing much of the tourist trade to points south. ~.

lution to be sent to the neighboring towns, Chamber of Com-

M~. Kohl referred to submitting for the Council's review a
copy of correspondence and an enclosure from Mr. Gregory
Fischer, Aetna Insurance Company, regarding deferred compen-
sation. This item was brought up and discussed last year.
He respectfully requests approval of the Council so that any
City employee who wishes to participate in this plan maydo
so. As state~ in ~. F±scher,s letter, there is no cost to
the City. May he have ~ouncil's wishes on this matter please.
Mr. Caldwell announced he would abstain from this and left
his seat.
M~. Roberts stated that this deferred compensation plan is
competing with the individual retirement account which they
use for people who have no regular retirement plans. This
~ives people $1,500 worth of ta~ exempt income, but after
collecting, they must pay the tax on it which could be higher.
The !.R.S. allows this if people are not under a retirement
plan. He would request the City M~nager that before going
ahead with this to get an answer from I.R.S. if this can be
allowed to defer this income since all the employees in City
Hall are under the regular retirement plan. ~. Kohl replied
that he has researched this and it has nothing to do with the
pension plan in the City. Ap~y amount can be deferred from an
employee,s pay and it has nothing to d~vwith I.R.A., the Keo
Plan or anything else. This is an addition to what ~hey have
in the City. It is stated what you can do in the State of
Florida. M~. Roberts asked if I.R.S. had approved and M~.
Kohl replied that it has been aoproved by I.R.S. M~ayor
Jacksgn added that it was researched last year. She feels
this ms a good thing and will not cost the City anything and
it is voluntary.
~. Roberts clarified that there would be some bookkeeping
involved by the City and ~. Kohl agreed. ~. Roberts asked
if there was a~&- such thing as to giving it to one company
and Mr. Mohl replie~ affirmatively. ~. Roberts asked if
the employees w~ted it ~ud M~. Eohl replied affirmatively

~. Roberts remarked that he thought it was foolish if one or
two were interested and Mr. Kohl informed him ~hat it would be
available to every employee; there are at least 20 people who
want it. ?~. Roberts questioned how Aetna figures - because
they asked first and Mr. DeMarco replied that a survey was
made. Mr. Kohl added that Aetna is the biggest, best and
the leader in this field. M~yor Jackson clarified that ~.
Kohl met with different employees last year on his own time
and discussed how the employees felt, but it was thrown aside
because ~. Caldwell worked for Aetna. This was their choice
of plan.
~. DeMarco made a motion to accept this plan to be made
m~ailabie to the employees of Boynton Beach on a voluntary
basis, seconded by M~. Harmening. No discussion. Motion
carried 4-0 with Mr. Caldwell abstaining..
Plan Review
~. Kohl stated that as the Council is aware, Section 2-41
of our Ordinances outlines the proper duties of the Planning
and Zoning Board; however, it seems that on Page
(Section 31-2), Paragraph 7, is in conflict. This portion
of our Ordinance, setting up "Planning & Zoning Generally",
states entirely different duties. Basically, it states that
Planning & Zoning should review all buildings other than
single-family and duplex residences and report to City Cohn-
cil their recommendations for approval o~ disapproval. He is
entirely in disagreement with this; he would much prefer to
revert back to the way Planning & Zoning is outlined in
Section 2-41. He is asking Council to have the Ordinance
changed back so the Planning & Zoning Board could operate
as originally outlined in Section 2-4t, based on the follow-
ing facts:
The Technical Review Committee consists of every
Department Head who would ever ham~ anything to
do with, or have any interest in the site plans.
This Technical Review Committee is required to re-
view site plans for all buildings other th~u single-
family and duplex residences, and make recommenda-
tions in the form of provisos.

When their recommendations have been incorporated
into the plans~ it is his opinion that these plans
should be submitted ~o the Building Department for
a building permit.
Being on the Technical Review Board, the City Pl~uner cer-
tainly could make the Planning & Zoning Board aware of any
changes in the Zoning Ordinances that he thought should be
considered. He feels that our businessmen, developers or
builders should not be inconvenienced to the extreme of any
undue del~v and hardship.

Roberts clarified that he wanted the Technical Review Board
to look at the plans and then turn them over to the Building
De~tment and M~. Kohl agreed~and added that this is the way
it use~ to be done. Mr~ Roberts questioned the reason and
referred to bypassing the Planning & Zoning Board and ~.
Kohl replied that this is the plan review followed previously
with the Technical Review Board and then the Building Offi-
cial issued a permit. N~. Roberts asked what happened to
the Planning & Zoning Board?
~. Simon Ryder appeared before the Council and stated he
was thoroughly dismayed by this suggestion or recommendation
because the Planning & Zoning Board was not consulted. If
they have reviewed the Board's minutes, it is apparent that
the matter of site plan review is dominant. There are not
many applications for change in zoning. By reviewing the
site plans, it gives the Board the chance to be in touch
with the development of the City. The Board has~nmade recom-
mendations of their own. The Council formulated a Board for
this coming year and right away, they want to tsd~e away the
Board's gusto. ~e ~oes not see where it is in the interest
of the City ~o do this. Mr. ~ ~ _
Koh_ clarified that he was not
trying to take this from the Planning & Zoning Board, but
we used to operate this way. M~. Ryder replied that that
did not msdme it valid today. He added that he could not
speak for the Board as they do not even lcaow about this.
Mayor Jackson referred vo reading the minutes of the Plan-
ning & Zoning Board and Community Appearance Board meetings
and being aware that the City Council must approve the same
site plans and stated she realizes we have held people up
for many weeks. Mm. Ryder replied that he did not k_uow
where it resulted in delay and Mayor Jackson replied that
the plans must go through the Boards. ~. Ryder stated
that if they didn't have site plans to review, they would
have tbs matter of zoning changes. He referred to the
Council's action tonight requesting an estate zoning cate-
gory and then downgrading a residential area to commercial.
There are r~any recent instances where the Board's decisions
have been overturned. He thinks it is regrettable because
the members put in a great deal of time ~ud effort on a vol-
untary basis. If the Council goes through with reducing the
Board's effectiveness, there may not be reason to have meet-
ings twice a month which would cause a lack of interest. It
would be detrimental to the Planning & Zoning Board and the
City and he strongly advocates leaving things as they are.
~. Roberts stated that while we have Denartment Heads,
possibly they are not as well qualified ~s the Planning &
Zoning Board~members. He feels there would be some concern
about bypassing the Planning & Zoning Board.

~efore recommending this. Mr. Kohl replied that it was not
his prerogative to go to any Boards. He goes to his Council
and makes reco~nn, endations. He does not go to the Chairmen or
Boards. Mr. Ryder stated if he wa~ not present, they would
not even have gotten the input from him and he questions
whether they would have a basis for deciding. He requests
that they not minimize and reduce the effectiveness of the
P~anning & Zoning Board. He requests they don't bri~ it to
the point where they get a deterrent or loss of interest.
Mayor ~ackson requested comments from the Councilmen.
Mr. DeMarco clarified that the City is trying to speed up
hermits and there is the matter of saving time with the plans
4aving to go from one Board to another. M~. Ryder stated
that it was not a matter of time, but a matter of keeping the
Planning & Zoning Board informed regarding the development in
the City as they must work on the Comprehensive Plan and hold
public hearings. Mayor Jackson informed him that the Planning
and Zoning Board was expected to do planr~ng and zoning and
the Technical Review Board decides the ingress and egress,
utilities, etc. She requested to hear from the rest of the
Council.
5~. Roberts stated that since we have a City Planner, there
is nothing to prevent him from consulting with the Heads of
Departments. He thinks it would not hurt to have the City
Planner go through this and take it up with the Planning &
Zoning Board and eliminate any action except by the City
Planner. He does not think they have the experience in all
these things. M~. Ryder clarified that he was not minimizing
the input from the Technical Review Board and the City Planner
does get into the picture with the Building Official and other
Department Heads prior to the Planning & Zoning Bos_~d.
Mr. Harmening asked !~. Kohl what the time frame is now from
the time a man walks in with a small project until such time
as a permit would be issued mud Mr. Kohl requested M~. Howell
to reply. ~. Howell informed him it was approximately 30
days. He told about the Building Departmen~ having two men
chec!ming plans, but it takes a good week before getting
through the Building Department. M~. Kohl asked how long
it takes to go through all the Boards and M~. Howell ex-
plained that the technical review was hmadled by the City
Planner, then it is listed on the Planning & Zoning Board

comes to the Council, but it still takes a month. Mr. Ryder

Zoning Board, how much time would be saved and ~. Howell
replied three weeks. NE. Ryder questioned this and Mr.
Howell replied bhat if a man brings in a plan, he must go
through the Board and it is possible he could come in two
weeks before the Board meets and then~as to go to the Coun-
cil. Mr. Ryder stated that this may happen on occasion, but
there is only one week from the Planning & Zoning Board re-
view to the Council.
Mayor Jackson referred to the Council reviewing a site ~lan
tonight and asked how many members felt it was so important
that the Council had to vote on it. ~. DeM~rco agreed this
applicant had ~een delayed quite awhile on this and Mr.
Kohl agreed that it had baken a couple months due to the
re-organization of the Boards. Mr. Ryder stated that this
applicant was not delayed because he has practical~_~- finished
building. ~¥or Jackson referred to the site plans coming
before the Council and stated that the Council members have
read the Board minutes and glance at it and pass on it. She
does not see any point in having the Council approve it.
¥~. Ryder explained that the Planning & Zoning Board held
open meetings with the public having the opportunity to be-
co~ familiar with the projects. ~. Caldwell asked just
what the Planning & Zoning Board does and ~. Ryder replied
that they sometimes add stipulations. ~lso, they have been
designated as the Local Pla~n~ing Agency and must know about
the developments. They should know about the activity. If
they are going to be aware of the overall planning picture,
they must review the plans. They do contribute in making
reco?mmendations in addition to what the Technical Review
Board may recommend. M~. Roberts replied that the City
Planner c~ contact these people quite rapidly and he thinks
it would have the same ~ffect.
I'~~. Harmening suggested possibly striking a happy medium
and referred to the value of the permits and suggested eli-
minating the smaller ones so there would be no heldup. NE.
Ryder informed him that he did not think the Board held any-
one up. The plans they approve and submit to the Council
are not the completed working plans and an architect is still
working on the final plans. A permit is not applied for until
the completed plans are submitted.

prints and this is the technical part of the whole process.

RE: Dory Rowboat for Lifeguard Operations
~ have contacted Warren Yachts in Fort Myers,
Schock Dory Boats. They have indicated that their
of $2,185 is firm and does include shipping. This
which is preferred by our Lifeguard Captain and staff.
Currently $2~000 is budgeted for this equipment. The
additional $185 can be transferred from Capital Outlay (Federal
Re~enua Sharing) - Lifeguard Stands. We have already completed
this project under the $300 allocated budget by a change in
design plans.
Departments throughout Florida are quickly recognizing the
value of surf boats for guard and rescue operations. Such boats
have been standard equipment on California and New Jersey beaches
for years. Currently, Miami, Ft. Lauderdale, Pompano, and Palm
Beach County are utliizing them with other area beaches making
definite plans for purchases.
They are of extreme advantage in making multiple rescues,
distance rescues for surfers or capsized boats, shark victim
rescues and shark alert situations, and outside limit bather
control during the large crowd period of a given day.

In accordance with the requirements of the Interlocal
Agreement, certain actions of the SCRWTD Board are required
also to be APPROVED by a majority vote of each City Council.
Therefore, would you place before your next City Council
meeting the following actions taken by the SCRWTD Board at
their January 5, 1978 meeting for APPROVAL of your Council:
Voted "authorize an increase in the "201" Facility
Plan as recommended by the Chief Executive Officer
in the ~mount of $16,320."
A partial copy of SCRWTD Board's minutes of their meeting'of
January 5, i978 is attached.
Please provide me a certified copy of your Councils action on
