The next Regular City Council Meeting is scheduled for Tuesday, January 3, 1978. Filing for homestead exemptions will be held at Boynton Beach City Hall on January 3 and 4 from 9:00 A. M. to 4:30 P. Mr. Caldwell referred to Page 10, bottom paragraph, four lines down in the middle, and stated that where it says State, it should be County and this same correction applies on Page 11, six lines down. He then referred to Page 19, third paragraph from the bottom, five lines up, and corrected the word ~approaching- to ~encroachingWo ~s. Jackso~ stated she understood it was the State involved with the road construc- tion and not the County and Mr. Caldwell replied that this whole thing re~erred to construction on Woolbright Road and it is a County project ms he underst~uds it. W. 8th Court, appeared before the Council and stated the subject he desired to speak about has now been placed on the agenda in reference to non-conform- ing lots and building permits issue~ and M~yor Zack suggested that he speak at the appropriate time when this item is dis- cussed. BIDS One (1) Sweeper (Street Department) Mr. Kohl informed the Council that bids on the above were opened in the office of the Purchasing Agent on Tuesda~~, December 13, 1977, at 4:30 P. M. All legal requirements were met. The Tabulation Committeer~ecommends acceptance of the low bid from Rowland Truck Equipment Company in the amount of $34,960. The trade for the present Elgin Sweeper is not acceptable as being~too low ($1,600). Jackson moved to grant the bid as recommended by the Tabulation Comm~ttee to Rowland Truck Equipment Comoany in the amount of $34~960 and bids for the Elgin Sweepe~ will be D!s~ced again, seconded by ~. Caldwell. Under discussion, Mayor Zack asked if there would be any trouble selling this equipment and Mr.~ Kohl replied negatively and added that they Relieved they could get $4,000 to $5,.000 for it and have had people asking about it. M~. Strnad requested to have Federal Highway swept at least once a month. Motion carried 5-0. One (1) Dory Row.Boat ~. Kohl requested to go out for re-bid on this item. Mrs. Jackson moved to go out for re-bid, seconded by ~. DeMarcoo No discussion. Motion carried 5-0. One (1) New Golf Cart ~. Kohl informed the Council that ~ids for the above were opened in the office of the Purchasing Agent on Tuesday, December 13, 1977, at 3:00 P. M. All legal requirements have been met. The Tabulation Committee recommends accept- ance of the bid from Ross Products of Boca Raton in the amount of $1,582.50. Funds are available in Federal Revenue Sharing Account 320-621-560-04.81. The Tabulation sheet has been submitted for their review. He concurs with the recom- mendation of the Tabulation Committee. Mr. DeN~rco moved to accept the bid from Ross Products for one new golf cart in the amount of $1,582.50, seconded by Mr. ~aldwell. Under discussion, M~. Caldwell questioned how a golf cart could not meet specifications and Mr. Kohl replied that everything going out for bid does have specifi- cations and explained how the one bid did not include the head and tail light kit. He added that certain things ~e required, which is determined by the Purchasing Director. Motion carried 5-0. Other Consider Beautification Agreement Between the City and Florida East Coast Railwa~ CO. Mr. Kohl requested the Council to approve this Beautification Agreement and explained how it was not exactly what he wanted, but a hedge will be planted. Mrs. Jackson moved that this agreement be approved and signed by the proper persons, seconded by Mr. Caldwell. No discus- sion. Motion carried 5-0. City Attorney's Report - Re: Powers & Duties of the Mmyor as it Pertains to the Police & Fire Departments ~M. Moore referred to researching this matter mud stated he thinks the contents of the present Charter are clear on the issue whether the ~yor has power and duties under the City Manager form of government over the Police and Fire Depart- ments.Z He thinks the language is clear a~d the power is vested in the City Manager. Section ~9 was adopted to clarify and adopt the City Manager form of government. Mrs. Jackson clarified that the City Manager is the he~of the Police and Fire Departments and Mr. Moore replied that he is in charge of all employees of the City. Mayor Zack questioned the interpretation of the F~uyor enforcing the ordinances stud Mr. Moore replied that every Council member has the duty to see the ordinances s~e enforced. Once the Council has adopted the City Ma~uager form of government, this supersedes any powers of the Mayor or Council members. Adoption of Section 49 of the Charter clarifies the powers of the City Manager. '~s. Jackson stated that it has been clarified no~ and it is the City Manager's job and all the employees are under the City ~mnager's direction. OLD BUS I~qESS Consider the Acquisition of Two Parcels of Land for Lift Stations ~. Kohl informed the Council that tod~y, he received a phone call advising that Mr. Stroshein has bou~nt the pro- perty these lift stations are on. He has called the engi- neer and we must start to look for new property. We may as well forget the information submitted. -7- MINUTES - REGUL~R CiTY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 20, 1977 Mr. Moore asked if ths possibility had been checked into to look under the rise of the bridge and M~. Kohl reolied that there is the possibility of one lot and stated he-would look into both. Mr. Strnad questioned how much property was involved and Mr. Clark informed him that 150 x 150 ft. was needed. N~. Kohl added that this was determined by Russell & Axon and the Engineering Department. Mr. Strnad questioned the location and zoning and r~. Clark informed him it was zoned C-4 and is Parcel 26 of DeweF's Subdivision located behind the Kwik Chek and the site has been moved for the regional lift sta- tion a little further north and outside of the right-of-way, so D.O.T. can extend the right-of-way for construction of the bridge. The lot has b~en purchased by Mr. Strosheiu, which is about 2½ acres. There is the possibility we could pur- ahase Lot 25 just to the east and put the lift station there, but we have gotten the appraisals for Lot 26~ He thinks ~. Stroshein would like us to purchase it from somebody else, which would req~u&re another appraisal. It is just one lift station in question. We have a~praisals for another parcel north of 804 and west of Congress, but this one parcel re- cently changed hands. There was further discussion and then F~. DeMarco suggested possibly finding some way of getting the lift station in the right-of-way to save m~ney and Mr. Koht stated they would 10ok at all possibilities. Consider Proposed Ordinance Requiring House Numbers ~or All Residents (Ta~led) Mr. Caldwell moved ~o remove this from the table, seconded by ~DeMarco. Motion carried 5-0. ~. Caldwell referred to requesting an ordinance to require house numbers to be displayed and ~. Moore informed him that he had found nothing prohibiting this if the City Council desires to do so. M~. Caldwell mo~ed to instruct the City Attorney to draw up an ordin~ace requiring all residential homes and businesses within the City limits of Boynton Beach to clearly exhibit their mailing s~reet number addresses. ~L~yor Zack questioned the size and M~. Caldwell included the street number to be a minimum of 2" numbers. ~s. Jackson stated she would like to find out from ~. Howell how this would be enforced and she believes this would be a terrible burden for the Building Department. M~. Howell stated if the Council desires this, it could be written into the addendums to the Building Code and it would be required on residences before a C/0 is issued on new construction. M~. C&~dwell referred to existing homes and explained how he thought it was necessary for emergency vehicles. He added that he thought fines should be levied accordingly for not compl~i~g. Mms. Mr. DeM~rco asked if it could be en- forced and Mr. Howell explained how he thought existing resi- dences would be grandfathered. Mr. Moore agreed there would be a problem with existing residences and Mr. Howell added that he did not think he could enforce it on existing resi- dences. P~. Strnad asked if any investigation had been done to check with other cities to see if they have a similar ordinance and whether it is being enf~ced and if not, why? Mrs. Jackson agreed this was a good idea and moved to table this £or fur- ther input from M~. Kohl with a request that he get informa- tion from ether cities. Mr. Howell stated that the post office will not deliver mail without a number and Mr. Caldwell referred to this not being enforced and again explained how it was necessary for the Police and Fire Departments for expediency. He added that he thought 2" would be a good size for the minimum requirement and ~. DeMarco replied that he did not think 2" could be read from a ~ehicle going 20 to 30 mph. Mrs. Jackson told about an area in Delray Beach not having postal delivery and not wanting numbers on their houses. ~@. DeMarco suggested having a study made and then seconded M~s. Jackson,s motion. ~%r. Kohl stated he would like to ask the residents of the City of Boynton Beach and he thinks 99% would comply. He suggests that possibly a letter be sent with the utility bills requesting everyone to have a number. M~. De~iarco agreed this would be better instead of requiring b~ ordinsmce. Motion carried 5-0. Mr. Caldwell moved to adopt Mm. Kohl's suggestion to notify the residents ~f the City Council's request to properly num- ber each house ~ud ~. Kohl shall prepare a notice and attach to the utility bills. Mrs. Jackson seconded the motion. Mr. Kohl added that he would add ~hat this would be to their benefit for the Police and Fire Departments. Motion carried 5-0. Landscaping - Mayor Joseph F. Zack ~yor Zack referred to the City doing quite a bi~ of land- scaping, which he thinks is a move in the rmght direction and stated the Community Appearance Board has suggested looking into landscaping in the areas of the 1-95 entrances and he would like to know if this is possible. Mm. Kohl re- plied that he would be glad to check with Delray Beach and see what they have done. Mrs. Jackson agreed it was a fine idea and made a motion to follow through on looking into landscaping of the 1-95 areas, seconded by ~. DeMs~rco. NO discussion. Motion carried 5-0. -9- M/A~JTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEI~ER 20 , 1 977 NEW BUS LNESS Police Department - Mayor Joseph F. Zack Mayor Zack referred to the report submitted by Deputy Chief Hamilton and reviewed the statistics of Police Officers being killed. He then stated that the Police Department was con- cerned about having individual vests ~ud explained how this was understandable. He feels this is a hazardous job and thinks the men do need protection and thinks this is one of the ways we can safeguard their li~s. He told about local organizations ~eing interested in raising money for this, but had found omt the cost was too prokibitive. He requests the ~ouncil to consider this and if purchase~, it will he mandatory for the men to wear the vests. Mrs. Jackson asked where the.money would come from and M~. Kohl replied that it was avamlable in the Contingency Fund. Mm. DeMarco asked how m~uy more were needed and Mayor Zack informed him that 50 more were needed at an approximate cost of $5,000. M~. DeMarco moved to purchase the necessary vests for the Police Department, seconded by Mr. Caldwell. Mr. Kohl stated that it would be mandatory to wear the vests and Mayor Zack agreed. >~. DeMarco amended his motion that if all the vests are purchased, ~J~e wearing of the vests will be mandatory. M~. Caldwell accepted the amendment. No discussion. Motion carried 5-0. Receipt of Correspondence from City of Boca Raton M~. Kohl referred to a resolution being ~oBwarded from Boca Raton regarding the desires of their City Council in refer- ence to the feasibility of creating a new county. Mayor Zack clarified that it was just asking for a feasibility study and added that he thought it would be nice to get involved. ?~s. Jackson asked who would pay fort~his and Mayor Zack re- plied that the Mmyor would probably appoint someone to work on it from here. M~. DeMarco stated he did not see any ad- vantage; Palm Beach County is a big county and should remain that way. ~ayor Zack replied that he thought it Should be looked into ~nd t~ere would be no cost involved. Mr. Caldwell stated he agreed with both sides. From time to time, he has been concerned with the responsiveness from the County Commissioners to the City of Boynton Beach; however, to approach it from a sour grapes standpoint is not construc- tiwe. He referred to bigness not being good for all people necessarily and how Palm Beach County was diversified with different economic backgrounds, population densities, etc., and stated he thinks there ware certain valid arguments MINUTES - REGULAR CITF~ COUNCIL M~ETY~HG BOYNTON BEACH, FLORIDA DECE~ER 20, 1977 for looking into the feasibility of creating a south county. This issue has been bandied back and forth for several years; however, he does not know if a solid feasibility study has been done as far as the efficiency of operating government on a smaller basis, but thinks we should take a look at the fea- sibility of creating a separate county. We could either peti- tion the State to divide or if the facts are not in favor of the citizens of Boynton Beach for dividing into a separate county, we could vote it down~ He would like to take a look at it. ~. Caldwell moved in favor of a feasibility study, seconded By Mrs. Jackson. Under discussion, Mr. DeMarco stated that our relationship with Palm Beach County has been very good and they have cooperated with us. Mrs. Jac~mson stated she thin~ it will cost us more money to change it, but thinks it should be looked into. She thinks it should be put to rest once s=ud for all~ Mayor Zack stated he thinks a feasi- bility study should be made with no cost involved and we can drop it if not an advantage to us. Mr. Caldw~ll s~ated he could appreciate M~. DeM~rco's concern and respects his point of view. However, he does not think the people in the County are going to put us on the black list because we deoide to look into the possib&lity. He thin~ it is our right as a municipality to keep options open at all times. He is not saying we w~ut to secede from Palm Beach County, but just saying to take the realistic ap~roach and look at the possibilities s~d make a decision whether it is to an advantage to mo~e in a secession movement from Palm Beach County. The chan~es are we probably would not want to secede, but he does not think it will hurt to look at it. M~. DeM~rco added that they should bear in mind that Boca Raton has not been getting along with Palm Beach Count~. Caldwe!l referred to someone requesting to speak from the audience in regard to what is going on in the City with regard to building on non-conforming lots. He stated that when he first looked into this matter, he thought it was an isolated situation but found this is not true. There are 50 ft. lots the citizens are concerned about and the R-lA zone requires 60 ft. frontage. He would like to hear from some of the people who called him and requested him to add this to the agenda. -11- MINUTES - REGUL~R CITY COUNCIL MEETING EOYNTON BEACH, FLORIDA DECEMBER 20, 1977 Mr. Arnold Thompson, 1307 N. W. 8th Court, appeared before the Council and stated he has petitions with signatures of 597 people to submit and read the petition requesting rescis- sion of Section 11.1-C and ~s~nce of building permits for homes on 50 ft. lots to be stopped. He requested to have access to these petitions even though turning them into the Cit~. Mr. Caldwell mo~ed to accept the petitions, seconded by Mrs. Jackson. No discussion. Motion c~ried 5-0. M~. Thompson continued withreading a statement £rom the Homeowners Association o~ Lamrel Hills, Glen ~_rbor, and Gordon Park requesting the Com~cil to take immediate action to stop permitting houses to be built on 50 £t. lots and to place a moratorium on the ~urther issuance of bailding per- mits for non-conforming lots. He told about the peoples' concern and requested Section 11ol-C to be rewritten so it applies only to actual and true hardship cases. Mr. Thompson then read a statement from Mr. Wayne Prindiville, 714 N. W. 8th Court, telling about his experience of having to obtain a variance to make an addition to his home located on a 60 x 115 ft. let, but builders are allowed to build on 50 ft. lots without a variance. Mrs. Jackson referred to the legality of a moratorium regard- ing 50 ft. lots and stated she thought there has been some kind of ruling about not being able to keep a man from using his property and Ne. Moore replied that he believed it was State law that we cannot deny an owner from using a platted lot. He believes the ordinance adopted last year reflects the status of this State law. Mro Howell informed them that in the caseoof Mr. Prindiville's addition, there was a 6 ft. side setback and a variance was r~quired to build the addition. Even though homes are built on 50 ~t. lots, they must meet the setbacks. He knows Boca Raton, West Palm Beach, Lake Worth, etc. have tried to rezone existiug platted areas and change them from 50 to 60 ft. lots, etc. and he has given the City Manager three or four court cases where they were beat on this and couSd not do it. M~yor Zack questioned the number of 50 ft. lots in the City and ~. Howell replied that he did not have any idea and most of the older platted areas are 50 ft. lots. ~. Strna~ stated he believed the intention of the amendment to the zoning code was to allow people who own 50 ft. lots without being able to purchase additional land, the oppor- tunity to ~uild without a variance. The zoning was prepared to upgrade the City and by going back to 50 ft. lots, it is downgrading. In Laurel Hills, the reference is to contiguous land. This is a different case altogether and he thinks we must look into this and see that it does not happen anywhere else and if i~possible to discontinue this, he would like to do so. MINUTES - REGUI~&R CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 20, 1977 Mayor Zack clarified that he was referring to three 50 ft. lots and dividing them into two 75 ft. lots. ¥8. Strnad told about attending a Board of Adjustment meeting about two years ago and stated the gentleman who sold these 50 ft. lots was the main objector to having three homes built on three lots and two were built. He does not understand why this particular gentleman protested about the three homes when he sold his own 50 ft. lots. Mss. Jackson stated even though homes are built on 50 ft. lots, they must meet the square footage and setback require- ments of the zoning and Mr. Howell agreed and explained. Mr. Strnad referred to the lots in question and asked if the houses would be built with the side facing the street and Mr. Howell explained that it was the builder's decision. Mr. Harold Werger, 719 N. W. 7th Court, appeared before the Council and stated for M~. Strnad's information, he owned the lots and sold them in a block form. He had no jurisdiction over how the man was going to build. There was a 30 day clause and the man went to City Hall and clarified what type of house he could build. He did not tell him that he could build on 50 ft. lots. The buyer went to the Building Depart- ment, arranged the dividing of the lots, presented plane, and permits were issued. M~. Strnad asked if he knew these lots were platted as 50 ft. lots and Mr. Werger replied affir- mativelyand added that everyone was aware of that. He told about questioning Mr. Howell at a Board of Adjustment meeting and being informed that buildi~ng was allowed on 50 ft. lots. He just sold his property and didn't tell the man how or what size to build. Mr. Strnad asked if he didn't think it would have been in his best interest to have had these lots replatted into conforming lots to make his property more valuable after the road was paved and ~. Werger replied that he didn,t think he should go to this additional expense for somebody else,s benefit. Mayor Zack asked if it was possible to put a moratorium on 50 ft. lots~and F~. Caldwell replied that if we do not and allow these homes to continue to be built on non-conforming lots, it will open the avenues in all areas. He thinks it would put us in a bad light and be doing a~ injustice to the people. Secondly, he does not think it is the seller's re- sponsibility to go through the expense of replatting land W~en selling a parcel. Al! he was trying to do was sell in a favorable market situation. Mrs. Jackson suggested obtaining some legal input and Mr. Caldwell agreed the City Attorney should be given time to investigate this and an extendable 60 day moratorium should be put into effect to allow the City to look into the possi- bilities of changing the ~on-conforming lot situation in the City. He thinks they may be running into serious danger by putting a moratorium on this situation. He asked if they meant Mr. Howell should put red tags on this construction and Mr. Cald- well clarified that he was referring to new permits only. ~ohs u~uder construction should be allowed to continue. How- ever, he thinks if we can put a temporary halt on the issuance of new permits for construction on non-conforming lots, it would give the City time to meke an indepth study to look into the cases before West Palm Beach, Lake Worth, etc. We need some time to protect our own interest. He clarified that we should not issue any more permits for non-conforming lots in Bo~ton Beach and start an indeDth study to see what £aats were presented before other m~nicipalitiss and how they pertain to cur situation and Whether th~is ~lternative or different approach. Mr. DeMarco asked how many permits had been issued and ~. Howel~ replied that 15 permits were issued in that area. Mr. DeMarco asked if any were contemplated ~ud ~. Howell replied he thought possibly three or four in Mango Heights and he is anticipating more~ M~s. Jackson told about a lot being sold recently on her street and stated she was not anxious to have this built on since most of the homes are on 100 to 150 ft. lots, but she does not think it is fair to penalize someone who has made a purchase in good faith. Mr~ Strnad clarified that he was speaking about contig- uous property and ~s. Jackson replied that there was land a~ailahle on both sides of the lot she referred to. Mr. Thompson told about their Homeowners Association having contacted some attorneys and advised that they are under the im~oression that they do have a good case. They firmly believe these permits were issued without conforming to the zoning~ Also, if the homes have not been started, he would like them not to be allowed and does not see ~ny case against the City if the permits were revoked. Mr o Caldwell suggested that this apply to situations where there are contiguous lots of two or more owned by the same person. ~. Moore agreed it should apply to several lots and explained how the City would have to offer to purchase one lot if they would not allow the owner to use it. ~. Caldwell agreed that a hardship should not be imposed on a single 50 ft. lot. ~s. Jackson referred to the suggestion to have the moratorium for 60 days and asked if there was any possibility of making it 30 days because it might be causing a hardship. F~. DeMarco agreed he would rather have it for 30 days. It was suggested to give C-2 in the rear which per- mits parking. The City Planner checked into this and it is allowed. ~s. Jackson replied that there will be ingress and egress on the rear lots and it is not being used as they said. Mr. Strnad stated if this particular piece of property is zoned for that use, why should there be az%v objection and why should they put what she wants there? He never heard anything about a car wash, hut kuows it was rezoned in the back to use in conjunction with the front lots. Mrs. Jackson clarified that the rear lots were not going to be used for parking, but for ingress and egress. Mr. Strnad questioned the difference and ~rs. Jackson replied that it w~s a lot to her because the people did not want it to hate ingress and egress. Mr. Strnad asked how the people knew about it and Mrs. Jackson replied that she feels we ma~e a mistake a~ud she would like to know how we can rectify it. Mayor Zack read the Basic discussion in reference to this from the Planning & Zoning Board minutes. Mr. Caldwell stated one of the things which concerns him with this particular land situation is the fact that it is close to 2nd Avenue and a lot of kids walk to and from school in this area. A car wash by its very nat~are will attract more vehicular traffic. He never wishes to hamper ar~ man's desire to better himself and do business, but with that particular land abutting residential as it is, it is very uneasy with him. Mayor Zack stated it was too bad we made the change to C-2, but this should have been given thought at that time. M~s. Jackson asked if there was any way we could turn this back to the Planning & Zoning Board? Mr. Strnad asked if there could be any redress against the City if this Council pro- hibits the la~ud from being used for something covered in the ordinance and Mr. Moore replied that he did not know what the C-2 zone is being used for. Parking is all right. However, if it is being used as part of a drive-thru to get into the C-4, there could be a question. ~V~s. Jackson suggested tabling this until more input is ob- tained as she believes the C-2 lots are part of the car wash. t~s. Padgett informed the ~ouncil that Mr. Eob Reed had re- quested to speak on this item. Mm. Bob Reed, 640 East Ocean Avenue, appeared before the Council and advised that he repre- sents Mr. David Matson, the present owner of the property who purchased it in October of this year. He referred to M~. Annnnziato passing out site plans to the Council members and stated he thought they would assist in providing some input into the questions raised this evening. The Council members then studied the plan. -16- MI~JTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 20, 1977 M~. Reed then stated that previously this property was owned by Mx. C. A. Ostrum, who applied to the Planning & Zoning Board in August to have the north two lots, each 25 ft. in width, rezoned from R-2 to C-4. The front three lots facing 2nd Avenue are and have been for some time zoned C-4. At that time in August, the Planning ~ Zoning Board denied ME. Ostrum's request to rezone the back two lots from R-2 to C-4. On September 6, Mr. Ostrum brought his request to the City Council a~d after discussion, the City Council decided to alter Mr. Os~tru~'s request to have it read to rezone the hack two lots ~-2 rather than C-4. He referred to discus- sions in the City gou~cit minutes of September 6 and pointed out that Mr. Ostr~m did inform the Council at that time that he intended to use the back two lots for drivew~ and parking p~rpo~es. He thinks the site plan indicates the hack two tots will be used for driveway and ingress and egress. The Dro~osed manner of traffic flow is from ls~ Street through the car wash facility on the front three lots, which is spec- ifically permitted in C~4, and the cars proceed through the facility and exmt o~to 2nd Street. This has been ~pproved by the ~echnicaL Re~iew Board. The ~lanning & Zoning Board tabled the site plan at their meeting in early November re- questing bhe City Planner to study the question whether the Planning & Zoning Board had the authority to reject the site plan~ased on the Dossibte flowing o~er of the C-4 use on the ~a~ two lots. At the most recent meeting of the Planning & Zoning Board, the City Planner indicated that based om his stu~, he was recommending to the Board the use of the back two lots for C-2 purposes, parking lot and driveway which certainly implies ingress and egress, which did not alter the use of t~e lots and there was no valid ~asis for the Planning & Zoning Board to reject the site plan. After discussion, the Planning & Zoning Board moved to recommend the site plan to the Council. At the SeDtember 6 City Coun- cil meeting, when the City Council unanimously on a 5-0 vote approved the rezoning of the back two lots to C~2, it was discussed that the property was to be used as parking and driveway to be used in conjunction with whatever C-4 use was on the front three lots. He does not know if Mr. Ostr~m was aware then that his client was planning a car wash facility, but he submits that he has ~ery right to use it as a car wash. The City Council unanimously approved the C-2 rezoning and knew it could be used in conjunction with the front three lots. Howe~er, ME. Moore didssuggest that ~ unity of title be submitted and this was incorporated into the motion and his client felt he would be safe in proceeding to group the one property and use a car wash on the C-4 lots and have parking and driveway on the back two lots in conjunction with the front three lots. After investigating, he has found that apparently ME. Ostrum has not signed a unity of title agreement, but he does have one signed by his client. -17- MI~TES - REGU ~LAR CITY COUNCIL ~ETING BOYNTON BEACH, FLORIDA DECEMBER 20, 1977 Mr. Reed continued that since his client purchased the pro- perty, he felt all five lots were to be treated as one parcel of land. Ey rezoning the back two lots as C-2, it meant not building a car wash on the back two lots. Nm. Caldwell referred to the discussion of using the back two lots as a parking let and stated he realizes in order to get into a parking lot, a vehicle must be driven but he definitely delineates a difference between a driveway and parking lot. It was his impression it was to be used as a parking lot to support customers com~ug into the business located in the front lots. A driveway is for consts~ut flow of traffic, but a parking lot is not. Mr. Reed pointed out that the minutes from September 6 do reflect the fact upon being questioned about the use of the back two lots~ Mr. Ostrum stated they were to be used as a driveway and parking lot. Mrs. Jackson asked if the entrance would be on 1st Street and Mr. Annunziato explained how there would be two entrances, one on 1st Street arid one on 2nd Street. Mrs. Jackson referred to there bei~ more parking spaces on 2nd Avenue rather than on the back two lots and Mm. Annunziato informed her that it was his recommendation to put the entrance on the back two lots instead of being closer to 2nd Avenue. He added that cars would have been stacking onto 2nd Avenue. Mm. Caldwell pointed out that driveway was only mentioned in the minutes one time and parking was mentioned several times, so it was his impression that it was to be used as a parking lot and not a dri=e-thru driveway... Mayor Zack stated his interpretation was different, but he got the intent as stated in the minutes to be for driveway and parking. Mr. Strnad referred to the statements recorded in the minutes and asked if they had to abide by the statements made and motion made and ~. Moore replied that the statements could not be changed. He added that the applicant is entitled to whatever uses are allowed in the C-2 zone. After looking at the site plan, he does not feel it would be advisable to go against the recommendation of the Planning & Zoning Board. The primary facility is located on the C-4 lots. Mr. Clark informed the Council that a final pay estimate has been deter- mined based on field measurements. There was an over-run of quantities in which the final pay estimate comes now higher than the original proposal. He had made a recommendation concerning the change made in the field which was felt would benefit the area during construction. One additional manhole ~as authorized. It was discussed prior to construction and was suDposed to be around $1,200. The contractor has pro- posed a different change order not consistent with the con- tract documents. Howe~er, realizing there was additional depth on that sewer additioralconstruction might have been considered, he has made what he considers an appropriate allowance for the additional restoration. He presumes the contractor may or may not accept this. He recommends the Council approve the change order as proposed by the Engineer- ing Department ~nd the final estimate proposed. Mr. Kohl aadded that the total would be $1,776.08, Change Order #1. U~. DeMarco clarified that it was the recommendation to prove and Mr. Clark informed him the recommendation was to approve the change order and final payment as recommended. Strnad requested Mr. Kohl to get in touch with the Depart- merit of Transportation to improve the length of the stacking lane going north on Federal Highway approaching 15th Avenue. He referred to the stacking lane being outdated and explained how it held up traffic. He then told about a problem with turning north on U. S. 1 from Gulfstream Blv~o and how it was almost impossible to see the little island. He suggested that a reflective pole be installed or the island be marked with a little extension of the median strip. ~s. Jackson added that the island at Ocean Avenue and Route 1 was also continuously run over.
