MI2~0~TES OF REGUL~9 CITY COUNCIL ~EETING OF ~ CiTY OF BOYNT~hT BEACH, FLORIDA, ~ELD IN CITY HALL, T~iESDAY, JU~ 7, 1977 PRESENT Joseph F. Zack, Mayor ~.ml y ~. Jackson, V_ce Mayor R~chard D. Caldwell, Councilman Joseph DeMarco, Councilman Norman F. Strnad, Councilman Frank Kohl, City M~zuager Callie Cls~tou, Deputy City Clerk Gene Moore, City Attorzey Mayor Zack called the meeting to order at 7:30 P. M. and re- quested everyone to please rise at the sound of the gavel for the Invoc~tio~ given hy Mr. Frank Kohl, City Manager, followed by the Pledge of Allegiance to the Flag led by Councilman Joseph DeMarco. Announcements Mayor Zack announced a meeting of the Boynton Beach City Council Members and F~. John McDonald, South Area Superinten- dent, School Board of Palm Beach County, regarding a high school would be held on Tuesday, June t4, 1977, ~t 2:00 P.M. in the Boynton Beach City Hall Council Chambers. He added that those people interested in giving input to a high school were welcome ~o attend this meeting on June 14. Presentation of Trophies to Tennis Center,s Ladies "C" Team - ~n~er~ of County League Mr. Charles Frederick ~unounced it gave him a great deal of pleasure to recognize the Ladies "C" Tennis Tom.m, represent- zng Boynton Beach in the Palm Beach County Women's Tennis Association, for winning the championship defeating River's Edge of Jupiter in the Division Finals. The team's record was an impressive 84 wins and 14 losses in competition against 18 other teams throughout the County. This is quite a notable achievement m~ this is the first year Boynton Beach has played in the "C" Team League which he~ been in existence for many years with ma~j seasoned teams competing. He then introduced the team members consisting of: Debbie Bair, Captain~ Elaine McVickers. Jane:~ Homiak, Madeleine Hamilton, Gall Webster, CeleSte-?.~D$nou=h~o , Doris Hulbert, Barb Cavanagh, Ruth McCastlain, Barb B±gbie , Jan Lewis and Ks~en ~ arzaal. He added that Joan McKenna was not present. Mayor Zack then presented each member with their individmai trophy. M~. Frederick introduced the Tennis Pro and Assistamt Tennis Pro working with the ladies. Mayor Zack then presented the County Championship Traveling Trophy to Debbie Bair and M~. Frederick announced this would be on display at the Tennis Center. Mayor Zack announced that the reg~lar City Clerk, Mrs. Tereesa Padgett, was on vacation, but ~e ms sure she would have love0 to have been here to see her daughter, Debbie Bair, receive the trophies. He then presented a bouquet of flowers to Debbie Bair in behalf of her mother for doing the ~ wo_~ with these ladies. MINUTES - REGULAR CITY CO~CIL MEETING JUNE 7, 1977 ~ FLORIDA ~_VNTON BEACH, Debbie Bair then thanked them very much for the recognition and trophies on behalf of the team. ~esentation of Barrier Free Design Award to B~ ,dmng Dept Mayor Zack introduced I~. Bud Howell, the City Building Offi- cial, and told about the terrific strides he had made in the Building Department. He then presented the Barrier Free De- sign Award to ~. Howell. M~. Howell thanked him on behalf of the Building Department and added that he thought the local con~ractors needed a hand forhelping them enforce the code. Announcements Regarding Agenda Mayor Zack announced if there was slay item anyone in the aud- ience desired to speak on to please give their name to Mrs. Callie Clanton, the Deouty City Clerk, ~ud she will call upon them at the appropriat~ time. M~s. Jackson referred to the Water Treatment Plant discussion being tabled at the last meeting ~ud stated she believed it was left off the agenda inadvertently. Mayor Zack suggested this being listed as Part E under Old Business. ~rs. Jackson moved to adopt the amended agenda, seconded by M~. DeMarco. Motion carried 5-0. MIh~TES Special City Council Meetin~ - May 16~ t977 (Tabled) ~s. Jackson moved to t~ke this from the table, seconded by M~. Caldwell. Motion carried 5-Q. ~. DeMarco, P~. Strnad ~ud P~. Caldwell replied that they had nothing. Mms. Jackson referred to the second page, second paragraph, and M~. Seaman's statement that Urban Renewal comes under County Government and stated she always thought it was under HUD. She added that she listened to the tape, but it was not cles~. Mr. Moore informed her it was under HUD ~ud Caldwell added that it was administered through County agen- ~. Ca!dwetl moved to approve the minutes, seconded by ~. DeMarco. No discussion. Motion carried 5,0. Regular City Council Mgetin~ - May t7, 1977 ~. DeMarco, Mr. Strnad and ~. Caldwell replied that they had nothing. -2- 6/21/77 MIh~S - REGUL~P~ CITY CO~CIL ~ETING BOYNTO~ BEACH, FLORIDA JUNE 7, 1977 Mrs. Jackson referred to Page 19, last oaragraph, first line, and advised that the law she referred t~ was a Supreme Court Ruling. ghe referred to Page 20, next to last paragraph, top line, and clarified that she said this might be reported to the Humane Society. She referred to Page 21, auld stated the motion was to accept the resignation from Mr. Fasano ~with regret,,. She referred to Page 27, end of third paragraph, aud stated that she clarified that this applies to all trail- ers, "including boat trailers". She referred to Psge 29, last paragraph, first line~ and corrected it to "the late 1960's,,. She referred to Page 32, fourth lJ~ue up in third paragraph, and clarified that she asked to have a tranmeript made of this, but it was not done. She referred to Page 33, third paragraph, and stated she questions M~yor Zack's re- quest as a transcript was not made. She is sure this is not what was said, but could not hear it clearly in listening to the tape. Mr. C~dwell moved to accept the minutes as corrected, seconded by Mrs. Jackson. No discussion. Motion carried 5-0. ~BL IC AUDIENCE ~. Joseph Aranow stated his name and his address as 2520 N. E. 1st Court. He stated he was speaking primarily about the question of the fences e~ound the pools and the ordinance passed on first reading at the last meeting. He advised that he represents the unit o~ers at Village Royale on the Green and wants it to be made clear that they have no ax to grind in regards to this ordinance, if it passes~or not, it will not affect the unit owners at Village Royale on the Green. Fences have been installe~ aro~ud their two pools. However, he must repeat the position of the residents of Village Royale on the Green as stated at the last meeting that this ordin~uce, which is 16 or ~7 years old, is an ordinance which was passed for the health, safety and general welfare for all the citizens of Boynton Beach. They have no a~ to grind of any kind, but waut to bring out the fact that this ordinance was on the books for many years and nobody argued it and it is still on the books. He then read an article from the May 26 issue of the Boynton Beach ~ews Journal regarding the camper parking bar~. If his understanding of this arti- cle ~ad of the desires of the people of Village Royale on the Green are correct, as far as he is concerned if there are people with a personal request such as a fence not being necessary around a pool, there are administrative branches that will gr~t relief if they are entitled to it. They must also consider that the ordinances should be kept on the books if they are good ordinances. He referred to different opinions expressed p~eviously by different condominiums and stated that more important was the question of fixtures. -3- MINUTES - REGUL~ CiTY COUNCIZ ~ETING BOYNTON BEACH, FLORIDA JIf~YE 7, 1977 He suggests that the condominium owners face this problem of additional taxes in regards to additional fixtures or drains. He thin.ks they would be wise instead of fighting among them- selves to get together on this matter. He added that they were also interested in the people connected with motor vehicle homes and trust all the people can work with the Council for the betterment of Boynton Beach. ~k~. Jacob Katz, 2615 N. E. 3rd Court, appeared before the City Council and stated he would like to talk about the ambulance ser~eewhich Boynton Beach has. He told about ,~?iting a ~et~er to.Mayor Zack and receiving a reply advising that it s'imposszb~e to h~ve ambulance service go to Kennedy Hos~- tal because it is mn a different city. People must pay up to $55.00 to go to Kennedy Hospital and some people ars :nable to pay that. He understands there is an ordinance on the books stating the ambulances cm~unot go to another town. Such an ordinsmce should be reversed as people have doctors in Kennedy Hospital and they should be given the same benefit as the people having doctors in Bethesda Hospital. >~. ~k~le~chik~ a Missionary with the Unification Church in Tampa, appeared before the Council. He stated that the Unification Church received a permit on J~n~ary 24, t977, to solicit and proselytize. I~ine days later, a letter was re- ceived in the mail from I~. Kohl stating the permit was re- voked. The reasons given were because of complaints amd harassment. The permit was revoke~ with no hearing, no evidence presented and no recourse for them. He told about going to see >~. Kohl about ten days ago to ask about the situation and find out whether there was a specific problem and M~. Kohl just referred to the letter he sent. In no .way are they trying to he above the law in fund raising or p~ose-,~ lytizing. They are not asking for something which would not be given to someone else. He assumes the problem is that Mr. Kohl received phone calls, In the past, many people who have called and complained are the ones with past preferences from the media, newspaper or personal opinions. That is why he asked if there was anything specific cited, but it was ~othir~ like that. Their permit was withdrawn arbitrarily mn response to phone calls. There was no hearing given to the cancellation. The law states the Council alone has the responsibility smd power to withdraw a permit. He requests that the permit be reinstated because there was no evidence or substantial proof for it to be withdrawn. Mayor Zack informed nmm there was a deadline for the agenda for the City Council meeting~ ~o~be completed by Wednesday, t2:00 noon and he believes tne_r letter was received on ~nurs- day. Therefore, this item was not put on the agenda. ~. ~m!enc~mnxormed him that the letter was mailed on May 31 and the post oz,_ce verified tha~ it e~rived on June 1. -4- MI~JTES - REGUL~3R CITY COLR~CIL ~EETING BOYNTON BEACH, FLORIDA JU~E 7, 1977 ~. Wilenchik added that there were no ill feelings on his part, but they did send the letter to comply with the agenda requirement. They request redress. M~yor Zack informed him that the Co~unci% would not take action u~less it was on the agenda and he suggested that he contact Mm. Kohl again. Mm. Wilenchik referred to re-applyinE and asked what standards they were going to be judged by2 ~-~. Kohl's ooinion? Mayor Zack replied that the Council makes the decision. Mr. Wilenchik asked if the Council approved the permit the last time and M~s. Jackson replied: yes mad added that she has also received some complaints~ Mr. DeMarco stated that if there was harassment, he would not be in favor. Mr. ~ilenchik stated they did not wa~ut to bother anyone and do have permits to fund raise t~roughout South Florida. M~. DeMarco suggested they get on the agenda for reconsideration. M~. Catdwell stated that regardless of the popularity of a p~ticular issue, he thinks we may have overlooked something important. He asked if the permit was legally issued to this group and Mr. Kohl replied that there was actually no permit because it was for a Unification church. A letter was sent giving permission to solicit. Mr. ~ilenchik stated they con- sidered the letter a permit. M~. Caldwell asked if the letter gives permission, can it be considered a permit and Mr. Moore informed him that the ordinance provides for the issuance of a permit with an application form completed. ~. Caldwell asked if the application form was completed by this group and Mr. Witenchik replied that he was not responsible in Jan- uary, but did receive a letter from Mm. Kohl giving permission for fund raising. Nine days later, they received a letter stating it was revoked. 3@. Caldwell stated there was a delin- eation between a letter and permit and Mr. Moore replied that he did not see any difference, but the ordinance sets forth particular criteria for charitable solicitation in town. M~. Caldwell asked if an application was filed ~ad came before this C? nc~l and M~. Kohl rep!~em, no, there was just a_scus- sion about the church. ~. Wilenchik stated that the Council did approve the letter. Mr. Catdweti stated that if the letter was issued and was a permit, it must come before heariD~g before it is revoked and ~. DeMarco disagreed ~ud stated it did not have to if harassment and complaints are received. Caldwe!i stated that it must come before the Council before being revoked according to the ordinance ~ud M~yor Zack re- plied that to his knowledge, no permit was issued. An appli- cation must be approved by the Council. ~. Witenchik re- ferred to the Council mentioning that permission was given by letter mad stated that it is not their responsibility to m~ke sure they are given the correct letter. M~vor Zack suggested drawing this to a conclusion ~ud requested Mm. Wilenchik to contact ~5~. Kohl and complete an application to be brought before the Co%uucil. M~. Wilenchik added that he would possi- bly meet with ~. Moore since the ordinance is a charitable solicitation ordinance and religious organizations are not parties. Mayor Zack assured him that the attorney would check the Statutes. -5- MI~JES - REGUL~R CiTY COUNCIL ~ET!NG BOY}~ON BEACH, FLORIDA J~E 7, 1977 Mayor Zack announced that since it was now 8:00 P. M., they would proceed with the Public Hearing scheduled and return to the Public Audience period afterw~mds. Pb~L IC ~ 'ARING Traiiers~ Motor Trailers~ etc. }~or Zack announced that this hearing was exploratory re- garding this subject and he would give 15 minutes per side to give statements and then it would be turned over to the Planning & Zoning Board for recommendations to the Council. Mms. Jackson added that there would be this hearing held tonight, a public hearing before the Planning & Zoning Board, and then two hearings before the Council giving a total of four public hearings at which the public can be heard on this subject. ~. Charles Eaglewood, 211S. E. 11th Avenue, appeared before the Council and stated he was representing part of the people in ~he City of Boynton Beach in opposition to the ordinance banning the parking of trailers, campers, etc. They psj their taxes for the upkeep of the City and go along with City ordinemces to run the City in a neat respective manner. They would like this ordinance change~ so they could park recreation vehicles on their own property, so they will not have to worry about vandalism. They will be parked on private property so the view of traffic will not be obstructed a~ud they will be kept in neat condition. Mr. George Payne, ]34 S. E. 11th Avenue, presented a petition with 114 names. He would like to see the ordinance changed so they can keep their vehicles here. He has lived here 25 years. It was voted against once before with a public vote, hut the ora_nance was not stricken from the books but kept on the books for the protection of the City. He ~_uows people who have put their trai~ers in storage a:ed have had problems with vandalism. Also, he cannot afford to build a garage for a boat or trailer, but if he takes the boat off the trailer and has it on his property, it is legal. He would 1Lke to see it cha~uged. The City is noted for fine fishing and many people own boats. He told about the best fresh water fishing being in this emea. He was born here and hates to see some- thing like this happen because it wil~ drive a lot of people out of the City. He appreciates the time given to speak and definitely will be back at the next meeting. He then asked how many names were needed on a petition for a public vote and }~. Caldwell replied that he believed it was ]~?g of the registered voters and Mm. Moore stated that he believed it was 25%. -6- MINUTES - REGULAR CIT~ CO%~CIL METING BOYNTON BEACH ~ FLORIDA JUI~ 7, 1977 ~. Stephen Yost, 424 S. W. 7th Court, appeared before the Council s~ud requested that the reasons be given at the next public hearing why the original ordin~uce was passed and Mayor Zack replied that he imagined the Planning & Zoning Board would have this information at the next meeting. M~. D~ta Bernette, 604 N. W. 7th Court, appeared before the Council and advised that he was the President of the Laurel Hills, Glen Arbor and Gordon Park Homeowners Association. He read a letter opposing the enforcement of the current regula- tion banning the parking of recreation vehicles and gave reasons for same. This Homeowners Association believes this regulation should be repe~led. M~. Frsn~k Steele, 117 S. Eo 29th Avenue, appea~ed before the Council and stated he was in agreement with the previous speaker. He requested the Council to use wise discretion when considering this vote and to remember that the camper owners are family people, even though a minority, ~ud feel they have the right for good recreation for themselves and their families. He feels a headship should not be imposed on anyone and the ordinance should be repealed. ~&~. Bill Humphreys, 143 S. W. 24th Avenue, appeared before the Council and asked how many of the members from the Plan- ning & Zoning Board were present ~ud Msyor Zack replied that this was the public hearing before the City Council tonight. ~. Humphreys continued that the Homeowners Association pointed out most of the facts in their letter. Boynton Beach probably has close to 900 recreation vehicles and this must be considered when talking about storage, etc. It comes back to the question of who the people are who are objecting. The ordinance has been on the books since 1963 and d~ing the past three~years, there have only been 25 complaints. They must be fair to the owners of these vehicles and w~¥ consider the personal view of a few people.~ The hardship will be put on many to store it or get rid of it. With the size of the lots and the zoning regulations, it does not allow storage on the side or rear of houses. It is difficult to shield a~d in most cases, the shield would be worse looking than the campers. He believes the ordinance is not proper. It has been ruled illegal to enforce an ordinance such as this. Also, there is no statistical information about the s~g~ent that the2parking of these vehicles reduce property values. He does not think the property value is reduced with a $25,000' or $30,000 vehicle parked in the driveway. Other problems have been created with the City zoning commercial right next to residential and allowing trucks, buses, etc. to be parked next to homes. ~yor Zack then asked _x anyone desired to speak for the Other side. -7- MINUTES - REGU~_~_R CIT~ CObI~CIL MEETING BOYNTON BEACH, FLORIDA JU~ 7, 1977 M~. George Huc~-~le, 656 Castilla Lane, appeared be£ore the Council ~id stated that he just wauted to point out to some people that there is another side. Some of the things stated are not entirely true. It is evident certain neighborhoods are not attractive with having boats, campers, etc. being parked. He referred to people being interested in the ap- pearance of their neighborhoods and the property valuation of their homes and believes they should be considered. He has two teen aged children and has a boat and would like to he3;e a recreation vehicle: but knows it could not fit into his garage and would not want to inconvenience his neighbors. ~. D. H. Ramsey, 146 S. E. 26th Avenue, appeared before the Council and stated he felt it would be taking a step back- wards to repeal a thing of this sort. it has been in effect since 1963 and it is a shame it has not been enforced. He referred to the condominium e~eas and how there were no pro- blems since it was enforced. There are hundreds of people living in condominiums with recreation vehicles, but they hawe an area for p~king ~ud they must pay a fee and they have no trouble. He thi~s it should be considered very seriously before deciding to do away with the ordinance° Mr. David Archer, 115 S. E. 29th Avenue, appeared before the Council and advised that he is a family oriented man and has lived here for 25 years. He can underst~ud where there would be a complaint about an unsightly vehicle which could be a junk car, camper, unsightly lawn, etc. However, recreation vehicles are used for transportation to work and to ma/~e a liv~ihood ~ad such an ordinance restricts a person's rights. This State is for tourism with camper si~a~3 and boat si~es~. If the location of these vehicles is restricted, where will they be put? People take pride in their recreation vehicles. He finds c~mpers and boat men to be courteous on the road and they must go home somewhere. Mayor Zack announced the discussion on this would be closed and this subject would be turned over to the Planning & Zoning Board and the next public hearing will be advertised. ~s. Jackson moved to turn this over to the Planning & Zoning Board for their recommendation, seconded by Mr. Caldwell. Motion carried 5-0. ~. DeMarco asked the date of the next public hearing and Mayor Zack replied that it would be advertised ~ud would be up to the Planning & Zoning Board. A man from the audience asked how it would be advertised and M~s. Jackson informed him it would be a_legal advertisement in the Boynton Beach News Journal. In view of the people exiting, Mayor Zack declared a recess. He called the meeting back to order at 8:30 P. M. -8- MI~JTES- P~EGUL~q CIi~f COUNCIL MEETING JUNE 7, t977 BO~TON BEACH, ~ ~ORIDA ~$BLIC AUDIENCE (Continued) Mr. Nate Goldberg, t317 $. W. 17th Street, appeared before the Council and stated he w~uuted to drop a few points in reference to the Unification Church in regards to proselytizing and soliciting funds. Possibly there was an error in giving a permit, but there is no reason not to rectify an error. The other name for the Unification Church is the "Moonies". The information he has received from the~mass media, which is the only source, is the fact that the "Moonies" do a terrific job of converting young people into a different belief than they have been born into. Most of us do not wa_ut to see yotuug people converted into this with deep programs against parents. He then told about the funds solicited turned into funds for the "Moonie~' on which they do not pay income tax,~L~He then asked if there was. a system to check the people soliciting and suggested they be fingerprinted s~d checked. ~. Herb Warren, 3019 Grove Road, appeared be£ore the Council and stated that he got caught in the sewer connection fee. A developer built the area where he lives and when about half the homes were built, the City decl~ed a moratorium. The people were forced to accept septic tanks: bu~ bought their homes with the idea they would be hooked up to the City sewer lines. He feels they arebbeing ~mproperly assessed, A neigh- boring home was hooked up ~nG not assessed and other homes were bought in the~same area at the same time. There is noth- ing in the ordina~ce regarding exclusions on this assessment charge and nothing covering us. He thinks there could be something waived or some amendment to cover the people caught in ~.~s bind ~yor Zack asked if the City ~nager had checked into this an~ ~ ~ ' , - ' - ~ · Kohl ~eplmed tha~ thms gentlem~m dmd come to see him yesterday and he requested that a letter be written with all the facts and he would check with the attorney. There is a legal opinion regarding sewer hookups, but he will re~?rve his regarding Grove Road. Mr. Warrem stated that the ora!nance is so written that there is no do'bt aoout the legal opinion, but exceptions allow nothing for taose caug~v in the morat$rium. Mayor Zack requested that he submit a letter 8md have the City Manager research it. ~. DeM~reo stated~that he agreed with Mr. W~ren ~nd this has happened, throughout the town. Ma~v h~3Je been assessed when they had a perfect work- ing sewer system. If a man builds a new home and does not have to buy a septic tank, he think~ the man should be charged; but he does not think it is fair in this instance and should be looked into. M~vor Zack requested that the lot numbers affected be Lucluded in the letter. P~. War~en added that it would cost him additional money to drain th~ septic tank, etc. M_~. Caldwell .asked if this Council could draft the proper exclusion based on extenuating circumstances to solve this problem and Mr. Kohl replied that he h~s tries to re- search this and has asked for letters from ~he individuals. Mayor Zack requested i~. Warren to proceed with the City Manager,s suggestion. -9- MINUTES - REGUI~&R CiTT COUNCIL MEETING BO~NTOAT BEACH, FLORIDA JUNE 7, 1977 PUBLIC HEARING (Continued) Proposed Ordinance No. 77-17 - Re: An Ordinance of the City of Boynton Beach, Florida, Amending Section 6(A) (1) of Appen- dix A - Zoning Regulations, of the Codified Ordinances of Said City, to Provide for establishment of Crematoriums under Zoning C-t as a Conditional Use; Providing for Authority to Codify,_ Savings Clause, Repealing Provisions, an ~zect~ve~ ~ Date and for other Purposes. Moore read proposed Ordinance No. 77-17 in its entirety. ~. Strnad asked if ~mybody was familiar with the exuding fumes from crematoriums and ~@. Kohl told about talking to a few people ~ud being informed there was no odor whatsoever. ~. Moore added that the Department of Health and Department of Environmental Regulations must be met. Mayor Zack asked if anyone desired to speak against this Ordinance No. 77-17 ~d received no response. He then asked if anyone desired to speak in favor of this ordinance and received no response. M~. DeMm~rco moved the adoption of Ordinance No. 77-17 on first reading, seconded by ~. Caldwell. No discussion. Mms. Jim Ashley, 329 N. W. 7th Court, appeared before the Comucil in opposition. He read a letter from the Eddie Bait family, 324 N. W. 7th Court, opposed to this commer- cial complex being built in this neighborhood. The letter referred to it decreasing the property values and ma~ng it unsafe for the children. The only people benefiting will be the ones selling mad buying. The letter also stated that this family did not own their house ~ud would not consider buying it if this property is rezoned. ~. Ashley then read a letter from the Mills Family, 306 N. W. 7th Court, in Opposition and advising that there is commer- cially zoned property available which the applicmat can ob- tain. Mr. Ashley ascertained the Council members had re- ceived a letter from Mr. John Adams, 317 N. W. 7th Court. He then read a letter from ~. DougL3~aughan, 334 7. W. 7th Court, expressing strong opposition to rezoning this oroperty to commercial. The letter stated they were intereste~ in -making sure,he qualities of the neighborhood remain intact and requested that businesses be kept in business districts. He thenpDresented the letters to the Council. Mr. Ashley continued that. along with these letters, he does have some things he would like to point out. He hopes each individual Council member has made themselves familiar with the property in question. The neighboring houses are on 75 x 70 ft. lots. According to the Planning ~ud Zoning Board, a 6 ft. high masonry wall is required. In considering the aesthetic value of l~udscaping, they will never see the l~udscaping if a wall is constructed. He then referred to an individual being allowed to spee_k in favor of this at a previous meeting and advised that this individual was not directly affected by this chs_nge in that they are further down the street and would not see or be affected by this change. One of the reasons given for chang- ing this was there wouldbe a hardship against the property owner ~d against Dr. Jacobs and he can partially understand this, but cannot see how this would add up. There is C-1 property available immediately east of Dr. Jacobs' property. This would be immediately available and would not require any rezoning. In reference to the hs~dship against the land owner, who he has nothing against, it must be considered that this commercial zoning would be in his backyard. About the property being landlocked, the individuals who own the pro- perty chose to have the property landlocked~by selling the adjacent property. It was also brought out that the property owners could do nothing else with this land, but the Plan- ning & Zoning Board surveyed the situation ~ud came up with possible ideas for using it. There are other things which can be done with this prot~rty. In reference to it being an attractive office, they could not see it with the required block wall being installed. He then told about two of the adjacenv property owners being retired and stated they would be affected by the noise. Also, he aud his wife a~e school teachers and will be there all sun, er and also come in before the normal close of business hours ~d would be affected by the traffic and noise. When he moved to Bo~ton Beach less than a year ago, he was excited about moving from Miami to a quiet location, it is a nice residential location, but will not be with commercial in his back yard. There is pre- sently before the Zoning Board other requests to ch~ge other property to commercial directly east of his property possibl~ based on this request. Where does it stop? At the present time, they do not have strip or spot commercial zoning inathe residential areas ~ud he requeststthat it be kept that way. Let the neighborhood remain a neighborhood and not a businesshood and keep the commercial properties wh~re they are. He requests the Council to reverse their previous decision and deny the applicant in this case. ~s. Barbara Ashley, 329 N. I.~. Caldwell stated that he believed the Planning & Zoning Board did turn this down ~ad he wasaabsent from the previous City Council meeting when this was passed on first reading. Even if it was passed on first reading, it csm still be denied on second reading. With having the second readiD~, it gives the public a chance to voice their opinions. Mayor Zack ascertained there were no further speakers in opposition and called on Dr. Jacobs. Dr. Jacobs advised that the one property owner, M~s. White, abutting this property was in favor of the rezoning. In reference to the wall being constructed, he doesn't care if it is provided as long as the neighbors will keep their yards as attractive as he keeps his property and will keep their dogs on their own property. He spends at least $50 per month keeping his pro- perty looking nice. As far as it being unsafe for children, an office is safer because traffic is not going in and out when the children are there in the evenings and weekends. In the evenings you will find: cars ir. their neighborhood, but not in the area of his office. The point was mentioned that ma individual sooke in favor and it is true this individ- ual,s property does ~ot touch the property in question, but the person did receive a legal notice and is within the area notified. Also, there was the oral assurance of commercial rezoning pro~mised. Boynton Beach needs more dentists in specialiias~ Since the first reading of the ordinauce, two specialtists in dentistyy have been looking for offices in Boynton Beach. He also understands there are offices in the County being built, but he feels it is better to have tke offices in Boynton Beach for the convenience of the people. Mayor Zack asked ~. DeMarco added that there was also no reference to the possibility of future water wells in this area and he understan~ds that this area has the best water. ~s. Jackson stated she would like to know whether the owner would be willing to hold this and have it voted on at the December election. She does not want a special election during the summer and thinks the people should have a choice. ~. Strnad replied that they were told in no uncertain ter~ that this property would be held only a short period of time. The opportunity has been extended to the City, but ~. Melear has a purchaser. Mm. In considering roughly $5,000,000, it is a lot of money. He explained how it would require over $1 ~000,000 befgre touch~_ng anything. M~o DeM~rco replace that he thoughn it was up to the people to decide. Mayor Zack stated that he thinks the costs must be considered and also that i~ is four miles west of Congress Avenue. Mr. Fronrath clarified that it is approximately I ,300 feet west of the s~nexed area. ~s~ Jackson stated that the only reason she considere8 this is because some people have mentioned they would like a muni- cipal golf course. She had questioned whether a golf course pays for itself and had hoped it would be in the feasibility study. Mayor Zack asked how many acres were needed for a golf course ~d ~. DeMarco replied: ~50 to 160 acres. May~r Zack clarified that 170 to 180 acres would do the job for a golf course and ball pe~k. ~s. Jackson stated she did not like to hold anyone up on the sale of property and if it can ~e developed as a nice develop- ment, she would have no objections. Caldwell asked if the members of the Council felt it was economically feasible to handle a project of this size and ~. DeMarco replied they were putting it before the people for a vote. Jackson referred to the matter of ~mdatory retirement and stated she believed the age of 65 was unreasonable. She exolained how she thought the City Ma~uager should have a say re~arding the recommendation of the department head subject to an examination by a doctor. The Supreme Court has ruled there should be no discrimination because of age. This should be left up entirely to the City Manager ~ud ~epart- ment head. Many people are more valuable at 65 because they have more ~mowledge. She thin9~ this should be left up to the City Manager. Mayor Zack asked what made her say the City Manager is not h~udling it and ~,~s. Jackson replied that the City Manager must come to th~ Council for permis- sion. Also, she does not think there should be a mandatory age. Possibly the City Attorney can reword the rules so there is not a m~udatory retirement age, but the requirement of a yearly physical checkup beginning at the age of 65. She is not seJLug a person cannot retire at 65. She thinks the City Memager should have this right along with the de- partment head to make the decision if the employee is doing good work. The City Ma~uager ~ows the person's capability ~ud gets a recormmendation from the department head. Mayor Zack stated he felt a person should be replaced if there is a good backup doing a ~ood job. ~s. Jack, on replied that many people look forward to retiring. N~yor Zack stated he still contended that a person should be replaced if there is a backup employee. N~. Etrnad referred to the possibility of having a new City Manager &nd a good employee could be fired without cor~ing before the Council. M~.'DeMarco replied that the employee still could be fired by the City Manager and ~. Strnad replied that there wa~ the opportunity of appeal to the Civil Service Board. _M~yor Zack referred to the City M~uager working on some changes in the Civil Service with the Personnel Director and suggested that this point be researched and the Council members expressed their agreement to this suggestion. Let us continue "not to forget" the Birth of our Nation. Promotion money for the Fourth of July celebration will be approximately $1,200.O0. This will be for signs, entertainment, games and prizes for both child- ren and adults.
