M~ayor Eack welcomed everyone and called the meeting to order
at 7:30 P. M. He requested everyone to please rise at the
sound of the gavel for the Invocation given hy Mr. Fra~kKohl,
City Manager, followed by the Pledge of Allegiance to the Flag
led by Councilman Norma~F. Strnad.
Mayor Zack read a Proclamation proclaiming the week of April
17th through April 23rd, 1977, to be Boynton Beach Library
Week.
Mayor Zack read a Proclamation proclaiming Sunday, May 1,
1977, as Law Day U. S. A.
Mayor Zack read a Proc!sms.tion proclaiming the week of April
24 throug~ April 30, 1977, as Secretaries Week.
Mayor Zack welcomed the group of students present from the
Congress Community Middle School. Mrs. Vowe~Assistant
Principal of Congress Community M~ddle School, extended
appreciation to the City Council for their cooperation in
having the youth participate ~n government. She then intro-
duced Sand~rFirestone, Student Mayor° S&u~r Firestone thanked
the City Gouncil for being invited to attend the Council meet-
ing and being given the opportunity to run the City for ~ day.
He referred to the students studying government and stated
they were prepared to take over the requirements and do their
very best. He then introduced the Dean, Guidance Counsellor
and Teachers present. Mayor Zack thanked him ~or his very
nice speeah and then requested the City Clerk to swear in
the students for their duties tomorrow. Mrs. Padgett then
conducted the swearing in ceremonies.
Mayor Zack then announced if there was any item on the agenda
that anyone in the ~udience desired to speak on to please
give their name to Mrs. Padgett and the City Clerk will call
on them at the appropriate time.

Mayor Zack called on the Council members for comments and Mr.
DeMarco and ~. Strnad replied they had none.

Mrs. Jackson referred to Page 11, fourth paragraph down,
third line, and clarified that the street she lives on was
originally built in 1928 when the development was put in
and new asphalt was added in 1951 and 1962. She then re-
ferred to Page 17, fifth paragraph down, third line up,
which should say: Mrs. Jackson pointed out "accordi~ug to
the Code" an architect could be appointed if available.
She referred to ~age 25, third line do~n, ~d advised there
was a grammatical error and itsshould~he "his~ instead of
"their~'. She then referred to Page 32 and read the last
paragraph and first p~ragraph on Page.33 and stated thim
would not be clear in reading these minutes 15 years from
now and elarified that this was referr.ing to the building
of the boat dock and not possibly a rai~roa~ as it might

S~pecial City Council Meetin~ - April 8~ 1977
Mayor Zack called on the Council members for comments. Mr.
DeMarco referred to Page 2, third paragraph down, ~ud cor-
rected the third sentence to read: He believes that a "poor"
settlement is better than a "good~ law suit. Mr. Strnad re-
plied that he had nothing. ~s. Jackson referred to Page 1,
last paragraph, eighth line, ~md clarified that M~. Moore
made th~atement and Mr~ Kohl agreed. ~s. Jackson then
referred to Page 3, third paragraph, and advised it should
say: "almost" the first time etc. She then referred to
Page 4, ~ast paragraph, and advised that ~leave~ should be
"let"~
N~s, Jackson moved that the minutes be accepted as corrected,
seconded by Mr. DeMarco. Motion carried 4-0.
Special City Council Meetin~ - April 14~ 1977
M~yor Zack called on the Council members for comments and
they all replied they had nothing.

seconded by Mr. DeF~rco. Motion carried 4-0.
Agenda Additions and ~mendments
Mayor Zack announced tha ~ddition of Item 3 under VI. Legal,
C. Resolutions - Letter from Attorney Smod!sh in Regards to
Pratt Case.
Mayor Zack then requested a motion to table Item B, Rifle
Range, under VIII. New Business. ~. DeMarco so moved,
seconded by ~s. Jackson. Motion carried 4-0.

Mayor Zack announced they received word this evening request-
ing Item D under IX. Administrative to be tabled until May 3.
M~s. Jackson moved to table this item until May 3, seconded
by Mr. DeMarco. Motion carried g-O.
Mrs. Jackson requested the addition of Discussion of Community
Relations Board, which she believes should be under Legal.
This has been discussed previously and she would like to make
a statement. Mayor Zack agreed and annou~nced this would be
discussed as Item D. under VIII. New Business.
Mrs. Jackson moved to accept the Agenda as corrected, seconded
by Mr. Strnad. Under discussion, Mr. DeN~mrco asked about the
resolution regarding Boynton Inlet and F~ Moore replied that
it was prepared and he believes it was distributed on Monday.
Mayor Zack stated that any resolutions should be included in
their agenda books for review prior to the meeting~ Mr.
DeMarco referred to discussing this at the last meeting and
Mm. Eohl advised that he received it on Monday afternoon and
the agenda books are distributed to the Council members on
Friday. Motion carried 4-0.
Mayor Zack then suggested proceeding with Bids in view of
having only approximately six to seven minutes before 8:00
P. M. and they could have the Public Audience after the
Public Hearing.
BIDS
Sale~ of Obsolete and Used Equipment
Mr. Kohl informed the Council that bids for the above were
opened in the office of the Purchasing Agent on April 12,
$977, at 3:00 P. M. All legal requirements h~ve been met.
The Tabulation Eheets regarding this equipment have been
submitted; however, he does feel the bids were not adequate
for the type of equipment offered, particularly in the case
of the Addressograph equipment. He feels certain we can get
more money by having an auction. As they can see from the
tab sheets, we are getting "peanuts" for some very good desks,
tables, etc., as well as other office equipment. He, there-
fore, respectfully reqnes~that permission be granted for him
to conduct an auction for the equipment listed on the Tabula-
tion Sheets. If this request is approved, we will oroceed
with the necessary advertising~ and advise the date ~f the
auction.
Mrs. Jackson moved to accept the recommendation of the City
Manager and grant him permission to conduct an auction for
the sale of obsolete and u~ed equipment. Mr. DeMarco seconded
the motion. No discussion. Motion carried 4-0.

Mr. Kohl informed the Council that bids on the above were
opened on Wednesday, April 13, 1977, at 11:00 A. M. in the
office of the Purchasing Agent, Mr. William E~ Sullivan.
The Tabulation Committee recommends acceptance of the lo~
bid from Custom Business Machines, Inc. of Delray Beach in
the amount of $3,910.00. A copy of the ~abulation Sheet,
Proposal and Affidavit signed by F~o Hoodrow W. Taylor,
President of Custom Business ~chine~, Inc., are on file.
He has checked all other requirements and everything is in
order. Funds for the above purchase were Budgeted in Capi-
tal Outlay, Utilities Billing Account No. 030-902.~20 in the
amount of $4,600.00. He co,curs with %he recommendations o£
the Tabulation Committee.
Mr. De~rco moved to accept the low hid from Custom Business
M~chines, Inc. in the amount of $3,910.00. M~s~ Jackson
seconded the motion. Under discussion, M~yor Zack questioned
the difference Between the bid of $2,995.00 from Business
Machines, !nc. an8 the Bid of $3,910.00 from Custom Business
Machines, Inc. ~. Sullivan informed him that the delivery
time was considered, but also the bids from Business Machines,
inc. did not meet the specifications with giving individual
totals. Motion carried 4-0.

Mr. DeMarco referred to the fine group of students present
representing Congress Community Middle School and suggested
they introduce themselves. Mz~yor Zack agreed and requested
eaeh student to stand and give their name and the department
they will be re~resenting in City Hall tomorrow. The students
complied as requested. Mrs° Jackson referred to _~m. Caldwell
not being in town tomorrow and suggested that h~srepresenta-
rives join her. Mayor Zack then thanked them ali for coming
and announced they were welcome to stay or may leave at this
time.

M~. Kohl informed the Council that the Planning & Zoning Board
at their meeting of April 12, 1977, unanimously recommended
the rezoning application for Parcel #I be approved based on
the fact that the zoning was located in such a manner so as
to split a parcel of lmud used entirely for commercial pur-
poses. Motion to approve was made by F~. Winter and seconded
by ~Ar. Lambert. The Planning & Zoning Board recommended the
rezoning application for Parcel #2 be denied based on the in-
trusion of commercial zoning into a single family zone and
the possible uses permitted in the C-1 zone. Motion to deny
was made by Mr. Winter and seconded by Mrs. Schorr; approved
5-I withMr. Lmmbert voting in the negative.
Mayor Zack asked if anyone present wished to speak in favor
of this change in reference to Parcel #1.

Dr. M. N. Jacobs stated his name and his address as 715
2nd Aven~e. He informed the Council that he believes Parcel
#1 was inadvertently zoned R-lA and he thinks it was a hook-
keeping error~ It cuts righi through hislla~ ~uildi~g now.
Mayor Zack then asked if anyone else was i~ favor o£ this
rezo~iug of Parcel #1.
~ Dewey Doxtad appeared before the Council and stated that
he sold this property to Dr. Jacob~. He does mot k~ow where
the m~xup o¢cmr~do~ it. ~hy it is necessary to rezone it
again, he does not know~
Mayor Zack asked if there was anyone else in favor of this
rezonisg and received no response. He then a~ked if anyone
present opposed this particular parcel being rezo~d~ and
received ~o response.

Mayor Eack then asked if auyone was in favor of rezoning
Parcel #2.
Dr. M. ~ Jacobs appeared before the Council again and stated
he was in favor of rezoning this parcel to commercial C-1 for
several reasons. At one time, it was zoned commercial and
then changed to residential. Somebody promised ~. Doxtad
that it could be rezoned back to commercial. Also, he would
like to have this land on which to expand his dental facili-
ties ~ud explained how the City o~ Boynton Beach was very
short of dental specialists. He believes this is a good spot
for a dental office. Also, as far as attractiveness of the
land, he believes if a person examined the way his commercial
property looks this evening compared to residential property
in that area, ~ appearance of his property is just as good
as the residential and better than some residential areas.
It is true during the day people will he coming and going,
but there will not he children playing outside, dogs harking,
cars racing in andoout, etc~ During the evenings and o~
weekends when the people are at h~me in the residential area,
the dental office is completely closed and quiet~ ~nere will
be no electrical signs, loud noises, obnoxious fumes, etc.
For his own interest, the property will be kept in good ap-
pearance. He thinks it should he rezoned.
Mayor Zack asked if anyone else was in favor of this change.

Mr. Dewey Doxtad appeared before the Council again and
stated there was not~uch he could add to Dr. Jacobs'
statements. As the owner, he does want to sell the pro-
perty as it is a lot to take care of. It would be a shame
fo put homes back there with his trees.
Mayor Zack asked if anyone else was in favor of this change.
Mr. Steve Saranin stated his name and his address as 409
N.W. 7th Gourt. He i~formed~ the Council that. his property
was adjacen~ to Parcel #2. Re does not k~ow if the Council
has seen thisplot of land, hut he personally cannot see how
houses could be put in this grove. It would not hold enough
houses to make it economical for a builder to huilR~ He per-
so,ally feelm a dental complex would be much more in his
favor tham some of the people who live on the street. He
feels it will m~e the area a lot more attractive than it
is right now.
M~yor Zack asked if anyone else was ~n favor of this change
and received no response. He then asked if anyone present
opposed this change and received no response. Mrs. Jackson
stated she thought it should be noted that letters have been
received from ~. James Ashley and Mr. ~dams in opposition.
Mayor Zack adde~ that also several people spoke in opposi-
tion at the Planning & Zoning Bos~d meeting.
Mayor Zack then requested the City Planner to give input re-
garding this ground and whether it could be used for homes.
Mr. Amnunziato informed the Council that at his request, this
rezoning was split into two requests. One was to satisfy
the split in the parcel and the second parcel of 156 x 130 ft.
would constitute an intrusion into the R-lA zone to the east.
This parcel would be surrounded by residentiat~zoning. It
is very hard to recommend against rezoning to C-1, as it is
a very restrictive commercial zone. He evaluated this as to
the location and s~rrounding uses and at this point, he has
not been satisfied that this land could not be developed for
single family purposes. He has personally worked out a plan
where five houses could be built, which would require sub-
dividing. He referred to M~. Doxtad asking whether two homes
could be built without sewers and advised that he has checked
this and they could be built as they ~ould be beyond the 100
ft. distance to the sewer line. If this property could not
be developed for single family, he thinks strong arguments
could be made for rezoning.
M~. DeMarco asked if this property was zoned C-1 originally
and M~. ~ununziato replied that he had not been able to sub-
stantiate that. M~. DeMe~co added that he used to live in
this area and believes it was commercial ~nd Mr. ~nnunziato
replied that it possibly was changed in 1975. Mayor Zack

~fferred to Mr. Doxtad having owned the property for nine
years and asked what it was zoned when he bought it and
Doxtad replied that when he bought it, it was R-1 and after
two to three years, it was zoned commercial and then a couple
years la.ter~, it was zoned back to R-I and he was told it would
be nothing to have it rezoned. Mr. Strnad added that he could
substantiate Mr. Doxtad's statement and told about Mr. Doxtad
complaining when it was rezoned to residential, but Mr. Jack
Barrett, the former Building Official, assured him it could
easily be changed back to C zoning which it had been. The
reason he knows this is because he was familiar with this
property quite a few years ago. Mr. DoXtad got in touch
with him regarding the rezoning. However, when Mr. Barrett
assured him there would be no problem in having it rezoned,
he did not pursue the matter any further. ~his property
had been C and he cannot understand ~hy it was changedto R,
because on the west side of this is the substation of Florida
Power & Light Co. To go a little further, before the last
$ouncil meeting when this was supposed to he on the agenda,
he looked at the properties of the people complaining about
this and if anyone looked at the rear of these properties,
they certainly would not want to live in back of them.
Mr. DeM~rco requested to see a map of the area and M~.
Ennunziato pointed out the location on the large zoning map
to the public and Council members. He also pointed out that
R-lA zoning was to the east, R-lA zoning to the north which
could probably not be developed~ R-2 zoning to the west, and
C-2 to the south.
Mr. DeMarco told about several people calling him from this
area stating they were in favor of this being rezoned to C-1.
He hates to go against the Planning & Zoning Board, but he is
in favor of C-1.
M~s. Jackson referred to the map indicating there would be a
landlocked area if this was rezoned and M~. Doxtad informed
her he would have access to the rear because his house is on
7th Court. He added that he had also offered th~ land to the
two people who objected behind their homes and it will be com-
plicated for him to get rideof the rest of it.
¥~. DeMarco asked if Florida Power & Light Co. was contem-
plating more building and M~. Annunziato replied that he did
not know for sure, but site development pl~ns~ust be sub-
mitted.
Mayor Zack stated he thought the main issues of concern by
the Planning & Zoning Board is what is ahead in C-I if this
land wase sold. Mr. DeN~arco asked Dr. Jac~ts how large a
building he contemplated building and Dr. Jacobs replied that
he did not _know exactly and plans must be approved by the

zoned C-1 which would have the same uses and not allow fac-
tories or stores. _~s. Jackson stated that she did not be-
lieve he could sell with having no access and Dr. Jacobs
replied that he could sell the whole thing, the G-2 plus
~. DeMarco made a motion to change Parcel #2 from R-IA to
C-1, as under the present circumstances,~ he does not think
we should create a hardship on these two individuals. Mss.
Jackson seconded the motion. Under discussion, Mrs. Jackson
remarked that she believed if an applieation was made to the
Board of Adjustment, a variance would be granted and she be-
lieves that the proper way to go would be to rezone it now~
Mr. Strnad added that he was glad to see the Council take
this action. He believes they must bend a little bit and
merit each thine in its own particular imstance. He Believes
it is wise to help these people out. Mrs. Padgett then took
a roll call vote on the motion as follows:

Proposed Resolution 77-V - Re: Urging Positive Action to
Initiate Mandatory Statewide Certification Program for
Construction Co~e En~orcemen~ Officials
Mr. Moore read proposed Resolution 77-V.
Mrs. Jack, on moved the adoption of Resolution 77-V, seconded
hy Mr. DeMarco. Under discussion, Mrs. Jackson suggested that
if this resolution is passed, perhaps it could be sent special
delivery to the Legislative Delegation ~ecause time is of th~
essence. ~irs. Padgett then took a roll call vote on the motion
as follows:

Letter from Attorney Smodish Re~ardin~ Pratt Case
Mr. Kohl read a letter from Attorney Michsel Smodish advising
that oral argument had been set for Tuesday, May ~0, on the

Pratt Case. Mr. Smodish stated he would be willing to handle
the oral argument for a fe~ of $60.00 per hour and would esti-
mate it would not exceed six to seven hours.
N~s. Jackson commented that the papers which came along with
this letter stated each side would be allotted 20 minutes to
present their oral arguments and she does not know how it
would take six to seven hours. She thinks it is unethical for
an attorney to solicit. Mayor Zack replied that the letter
did include the statement that Ms. Smodish would be willing
to twrn the files over to another atiorme~ and also they must
consider the time requ~wed to prepare this case. He asked
Ms. Moore if he estimated it would take six to seven hours
and ¥~s. Jackson replied that she did not think it was a fair
question for Mr. Moore.
F~. DeMarco referred to ~ureparation being done by Mr. Smodish
when he was the City Attormey and stated he agreed with Mrs.
Jackson that six to seven hours seems k~nd of high for a 20
minute brief since he is familiar with the case.
~. Strnad referred to when they disposed with the services
of M~. Ernest Simon and stated they engaged him to do numer-
ous cases he was assigned previously with no stipulated hours.
Mir. Simon,s amount was in the thousands of dollars for the
cases and this would only be approximately $400. M~s. Jackson
clarified that she referred to this because the time was
spelled out for 20 minutes. Mr. Kohl informed the Council
that when an attorney prepares a case, he must prepare docu-
ments and legal papers and there is also the time involved in
going to court and waiting in court. Mrs. Jmckson replied
that she just hoped it would not take six to seven hours.
Mr. Strnad moved to engage the firm of Reed & Smodish to
pursue this case, since tkey are familiar with it and have
all the data. Mrs. Jac?~on seconded the motion. Under dis-
cussion, ~ir. DeFmrco asked if they were going to set a time
limit and Mayor Zack replied it would be hard to do that.
Motion carried 4-0.
Ns. Moore referred to when he was appointed, he informed the
Council that this was one of his pending cases; however, he
has withdrawn from it and Mr. Pratt has obtained another
attorney.
PUBLIC AUD~NCE
Mr. Ron Johnson stated his name and address as 1205 N. W. 7th
Street. He inf'ormed the Council he was present to discuss a
slight complaint he has and which he believes some other people
have in reference to the firing of Mr. Kenneth Kribso He does
not know if Mr. Kribs was guilty or not guilty. It is not his

place to decide this nor the City Council's or City Attorney's
place. It is up to the Civil Service Board to decide. Accord-
ing to the newspaper, the City Council made a deal and he
thinks the action taken by the majority members of the City
Council i~ voting for this jeopardized their whole m~cipal
system. Be explained how the judicial system would be af-
fected if they used this sa~e system in reference to crimi-
nals. ~e basicDpart o£ the judicial system is to be tried
and heard. He definitely does not agree withthe action
taken by the majority of the Council members.
Mr. Johnson then continued that the checks and balances
system of the government has been destroyed by the action
taken by the Council members also. He told about where he
grew up in North Carolina and how that particular sm~ll area
had a checks and Balances ~ystem~ He ~ it difficult to
believe that a City with 40,000 people does not have a City
Fiuance Director. He is sure Mr. Kohl will agree he does not
have the capacity to be a City Finance Director. He thinks
they need a Gity Finance Director entirely separate from the
City ~R~nager.
Mr. Johnson stated there were three reasons he could thin~k of
why they decided not to take this case to court. First of all,
they probably don't have a case. He does not know if this is
the reason or if the person representing the City does not
have the ability to handle the case. The~third reason is
that somebody is wondering what the Civil Service Board will
find out. Do they have confidence in the Civil Service Board?
It was set up to protect the individual from ~eing hired snd
fired by politicians whenever they chose just because they
did not like someone. It was also set up to protect the City
so they cannot be cheated out of taxpayers' money. He thinks
Mr. ~ribs should have ~een heard, as any person should he
properly heard, so we would know what is right and wrong,
This is the heart of the whole system. If they do not follow
this, how can they lead the whole country? He is not ~aying
the whole world can ~e right, but thinks the Gity of Boynton
Beach with a little help and work can be right, but this is
definitely not the procedure to follow.
Mr. De~L~rco replied that he didn't think ~. Johnson should
compare Mr. Kribs to a criminal. Secondly, they do have a
good Civil Service Board. It was Mr. Kribs' attorney who
offered to settle. He explained how ~. Eribs could go to
Civil Court and demand a hearing, but the City could not and
the case could be prolonged for two to three years~and back
pay could be collected. He does not think itiis good busi-
ness when you can make a poor settlement which is better th~u
a good law suit.

Mr. Johnson stated that the whole essence is what is right
and fair to the individual public. He referred to speaking
previously in reference to the Rinker case andstated they
must consider what is fair and right for the people. Mr.
DeMarco replied that from a legal standpoint, Mr. Moore was
correct regarding the Risker case, but the Council voted to
reject his proposal and went with the wishes of the people.
I4m. Johnson stated that the people were not present when the
decision was made regarding Mr. Kribs. Mr. DeMarco continued
that they could still lose the case with Rinker and
Johnson disagreed and stated he thought they have a better
case ~ow. Mr. DeMarco referred to establishing a precedent
by losing the Lehigh Portland case and Mr. Johason replied
that he did not feel this had set a precedent.
~. Johnson then stated that in place of a City Pimance
Director, they are supposed to have a City Auditor not under
Civil Service who could be hired or fired at random. What
happens if somebody decides they don't like Mr. Kohl or Mr.
Moore and want to get rid of them$ Is this right or fair?
He thinks the people should be heard. F~. DeMarco replied
that this could be done hy a majority vote oE the Council.
Mayor Zack then ascertaiRed that nobody else desired to spe~
during the Public Audience period.

Request Authorization to Execute Traffic Control Agreement -
Intersection of S.E./$.W. 23rd Avenue & Seacrest Blvd.
Mr. Kohl referred to the City Council r~questing him to ask
the County to assume the responsibility for the above traffic
light, which was accomplished by letter on January 25, 1977.
The agreement submitted is the result of that request.
Mrs. Jackson moved to authorize the proper officials to exe-
cute the agreement, seconded by M~. DeMarco. No discussion.

Consider Transferrin~ Snack Bar Lease A~reement
Mr. Kohl referred to receiving correspondence from Dave
Centola with his proposed agreement for the lease on the
Municipal Beach Snack Bar as well as a copy of the present
agreement we have. For the Council's assistance in making a
decision on this matter, we submit below information surveyed
from other cities. As indicated, we have learned there are
not too many municipal snack bars in Palm Beach County.

Boca Raton - No longer has a snack bar. Property was sold to
private individual.
Lake Worth -
Rented to private individual who presently has a
10 year lease with the City of Lake Worth. They
operate on a 2.5% of the gross income from the
restaurant (they also have a bait and tackle
shop), or they must receive at least $3,000 per
year from this operation.
Riviera Beach - Rents the Ocean Mall which includes several
stores to a private individual. Their fees
include the snack bar as well as the other
stores, such as surfboard rental, canopy rental,
bai~, tackle, etc.,and therefore were unable to
give us a breakdown.
He requests the Council's wishes on this please.
Mr. David D. Centola appeared before the Council and stated
he was present to ~nswer any questions the City Council may
have. He added that a new lease was submitted because his
clients intend to invest a substantial amount of money and
need several years to recover this amount mf money. He
thought it was necessary to extend it for at least a five
year period.
Mrs. Jackson stated that she obtained a list of the payments
which have been made since August, 1970, a~ud doesn't think we
have been getting enough money. She feels if the tenant wishes
to finish out the two years at this rate, it is one thing; but
if he wishes to renegotiats, she would only want to do it on
an annual basis. She does not think it should be on a percent-
age basis again. In looking at the figures, she believes the
City has not been getting enough money. Mayor Zac~kaadded that
the payments amounted to: 1970 - $92~23; 1971 - $419.06;
t972 - $489.89; t973 - $415.00; 1974 - $613.61; 1975 - $778.37;
and 1976 - $655.48. Mrs. Jackson clarified that the 1970
figure was only for five months. She continued that the most
we ever made in any one month was $106 in March, t975. We
have made as little as $16 to $17. She just feels we are not
getting the money we should.
~. Centola referred to the rental agreements for the other
cities and stated he believed the concession areas in those
other cities are much larger than what we have here and the
Beach areas are also mmch larger.
Mr. DeMarco asked if his client would be willing to re~ego-
tiate on a higher figure and Mr. Centola replied that he be-
lieved he would and added they could have saved time if this
objectio~ had been made known and it could have been nego-
tiated with himself, the City Manager and City Attorney.

Mrs. Jackson referred to the present lease not expiring
until February, 1979 and Mr. Centola informed her that the
amount of money his client iatends to invest would not allow
him to recover the amount of the investment in a 21 month
period.
Mayor Zack stated he personally did not like the percentage
basis and would like a flat rate and believes they would both
be better satisfied. Mr. Centola replied that if the City
~ouncil will present a rate, he will present it tc his client.
He is sure things could be worked out.~
Mr. De~Marco referre~ to Lantana having a monthly rental of
$135.00 and stated he believes the two cities are very much
alike. Mayor Zack replied that they must remember not to
make a profit as this snack bar is there for the convenience
of the beach goers, but they also must be concerned about the
upkeep of the area.
Mr. DeMmrco asked if this was put out for bid originally and
Mrs. Jackson replied that she didn't thi~k so. Mr. DeMarco
remarked that maybe someone else would be interested. Mmyor
Zack replied he did not see where they would gai~ from bids.
The man is doing satisfactory work and everything is in line
and they know what they have, but not what they would get.
~. DeMarco asked if it was beyond the realm of possibility
to go out for bids or renegotiate and Mrs, JaCkson replied
that there were still t~o more years to go on~ the present
lease. Mm. De~rco referred to the request to transfer the
lease and Mr. Cemtola stated he would prefer to re~egotiate
to extend the ~present lease to five years. He added that he
r~presents the prospective purchasers. Mrs. Jackson replied
that this put a different light on it and she feels the new
people should come to the City to renegotiate. Mr. Centola
clarified that he submitted the lease on behalf of the pro-
posed purchasers.
Mrs. Jackson stated she thought they should definitely have
a flat rate. Mayor Zack stated he felt $135 would be kind
of high and suggested $100 maximum. Mr. Strnad suggested
negotiating with the people before they take over the lease.
Mr. Centola stated that the City Council could come up with
a guideline and it could result in the proposal being re-
jected and this going on i~defi~itely.
~. DeMarco stated he was concerned with extending the lease
for five years and stated he would like this to go out for
bids to be fair to everyone. Mrs. Jackson stated she felt
there should be a flat monthly rate or annual rate. She
does not think it should be a five year lease but t~at~it.should

She thinks it would also apply to this. Times have changed
since 1970. Mr. Centola replied that he had no objections,
~ut wanted guidelines.
Mr. Moore clarif, ied that a sale was involved here. M~.

He must know how much rent he must pay before getting into
it. He is making sn investment and is entitled to have a rear
sortable period of time to recoup the investment.
Mr. Strnad stated he did not think the City was in s~ck a
bad position with getting 2.5% of the gross income and not
the net income. He asked what this worked out to approxi-
mately each month and Mr. DeMarco replied about $50 per month
and Mrs. Jackson added that she didn't believe it was that
high. Mr. Strnad stated that the Council should agree on an
amount and propose a contract. They discussed the monthly
rsntal amo~mt f~ther.
Mr. Strnad stated he thought it depended on how much money
the people are going to invest in the place and they must be
assured of getting back their investment.. N~o Centola in-
forme~ him that the people are purchasing this for $18,000
and if the income is as low as indicated, it will take more
than five years to recover their initial investment. He
does not think a year to year leas~ would be appropriate on
these conditions.
~. Moore suggested an ~unual percentage increase ~ud ~s.
Jackson suggested $100 per month with a certain percentage
increase. She added that they could have a flat rate plus
a certain percentage if the gross was o~r£ a certain ~ount.
M~yor Zack referred to the lease stating 4% and this would
be close to $100 per month and Nr. Centola agreed this was
correct for the balance of the three years.
~. DeMarco asked if there was a guaranteed minimum and ~s.
Jackson replied: no, but she thinks there should be. M~
DeMarco stated he still thought it should go out for bids.
Mayor Zack suggested possibly checking into whether any
people were interested.

Civil Service Appeals Board - Mayor Joseph F. Zack
Mayor Zack stated he had been informed he made statements
regarding Don Shelhamer's attendance at meetings. He clari-
fied that Mr. Shelhamer has attended seven meetings and re-
quested the City Manager to convey to the Secretary of the
Civil Service Appeals Board that he was sorry he made a mis-
take previously regarding ~. Shelhamer's attendance record.
Mrs. Jackson replied that the mistake was corrected immedi-
ately.
Discuss 55 Acre Tract of Lan~ - Mayor Joseph F. Zack
~yor Zack suggested that letters be written regarding this
55 acre tract of land and added that the City ~nager has a
complete layout of what is to be provided on this property.
It should be c~nsidered that they could obtain a long term
lease. It possibly could come from the $50,000,000 bond
issue. This financing was suggested by one of the Co~s-
sioners. Mrs. Jackson asked if he was referring to this to
be a County park or to be given to the City and Mayor Zack
replied that he would like to have it donated to the City.
~rs. Jackson clarified that we would have to develop it and
Mayor Zack agreed.
Mr. DeMarco stated that he had been inbtouch with the County
Commissioners and believes the City cam get it. He believes
it can be deeded to the City with no strings attached. M~yor ~See Mi~
Zack added that he talked to two County Commissioners and ~/~/77
with three new ones, he thin~ it would be wise to send a
letter indicating our requsst and plans. Mrs. Jackson stated
that it should be developed ~radually and Mayor Zack re-
plied they could not move tha~ £ast,~but the point is to first
get the ground. Mr. DeMarco added that he also talked to
Commissioner Medlen and was assured the County would deed
the Little League Park to the City.
M~s. Jackson moved to instruct the City Manager to send a
letter to the County Commissioners asking they d~ed the 55

· ~Mayor Zack told about his research indicating this is a County
road and read all the correspondence and i~formatio~ pertain-
ing to this. He suggests that the Council apprise the County
of this and request that updated cost~estimates Be started.
He explained how this road has been a bottleneck. He took all
this information to County Commissioner Bill Medlen and he
will follow through on it. He thinks the ne~ County Commis-

Mrs. Jackson stated that the City has $50,000 encm~oered~ hut

Mr. DeMarco asked if the County agreed to fix it at one time
and Mrs. Jackson replied: yes, in 1973.
Mayor Zack suggested sen~ing a letter advising the City is con-
cerned with the widening of this road and requesting it to be
put in the fiscal budget this year. Also, he thi~-their
biggest concern will be relocating a couple families, but this
should Be taken care of by the County since they made the ap-
praisals.
Mr. DeM~co made a motion recommending that the City Manager
contact the County Commission regarding this road and explain-
ing the road is in deplorable conditio~ in need of repairs and

Discuss Telephone Service from City to Boca Raton - Councilman
Norman F. Str~ad
~. Strnad stated that at the last Council meeting whe~ we
aske~ for a resolutio~ to have our telephone to~l charge
eliminated from the Boynton Beach area to the Boca Raton
area~ he had been in favor of it. However, when Mr. Burson
informed this Council this was not going to be a free ride,
this changed his mind. Since the~, he has spoken to quite a
few people who also believed this woul~ be a free ride.
Quite a few years ago, he was glad to call West Palm Beach as
a free call even though he called West Palm Beach rarely, and
his telephone bill did increase, but he did not attach the
significa~~ce that the service was extended. He believes a
lot of people are under the impression that this will be a
free ride. According to the records from ~. Burson, there
are 5% who call Boca Raton with 1% being the constant callers
and this is goimg to put a burden on the res~oof the people
in the area. If he could do it over, he would have rather
left his phone bill as it was and pay for the calls he:~'~akes
to West Palm Beacho He would like to leave it as it is now
~nd pay for his toll calls to BOca Raton~ He wa~uts it pub-
licized that the people will have to pay for this service~
He requests the Council to reconsider the resolution passed
to the telephone company.

M~s. Jackson stated that before anything is done, this will
have to go before the Public Service Commission and they
must hold hearings. She does not think a.nything will be
done at all until it goes before the ~blic Service Commis-
sion.
~r. DeMarco stated that he fathered this resolution and has
been receiving letters from the Boynton Beach Democratic
Club, Kings Point, etc. in favor. He still says a survey
~hould be m~.de to check the feasibility of this service since
Dado and Broward Counties do have it. He believes their bills
were only increased $1 ~35 for the service to West Palm Beach.
Mayor Zack referred to Mr. Burson,s statement that if Boca
Raton is not interested, the rates could increase $8.00 per
month. He thiMms this would be a wrong move. He believes
a User Sensitive Service or Unit R~te Service should be con-
sidered.
M~. Burson appeared before the Council and explained that if
it was based on the number of telephones you cam rs. ach o~ a
local calling basis, that is the way you are billed on the
local service. To call Boca Raton, the bills wou~d have to
increase. They did receive a number of complaints about the
$1.35 increase ~or service to West Palm Beach. He knows the
people in Boca Raton are not interested in calling West Palm
Beach and does not think it is fair to penalize them. The
majority will have to pay for what the minority want. The
rates could raise as much as $8.00 per line to call Boca
Raton because the Boynton Beach people want this mad must
cowry the load. He explained how the facilities would have
to be increased and explained how the people would be re-
quired to take the service whether they could afford it or
not. Even though the people don't want it, they must take
it and it would mean they probably would use it and it
would mean a[ditional facilities and investment. If the
telephone company invests money, they must get money back.
They do not think it is fair to charge the majority for
what the few in comparison want.
Mrs. Jackson clarified that nothing was changed because of
the resolution passed and ~. Burson agreed and stated the
resolution did go to every municipality in the County, Mr.
DeMarco remarked that he was present at every city to speak
on the resolution and M~. Burson agreed mud stated he was
present to point out their side and statistics. He felt it
was_fair to visit the other municipalities to give the infor-
mation they have on hand. Mrs. Jackson clsrified that they
must still wait to see what the other cities say and M~.
Burson agreed. M~s. Jackson clarified that the resolution
would not have to be rescinded if the majority do not pass
it and Mr. Burson agreed..

and Mr. B~rson replied that they were ta~g about going from
one end of the County to the other~ Mr~ DeMarco clarified
that he meant along the coast. Ma~or Zack referred to Dade
and Broward Counties being covered entirely. Mr. DeMarco
re.ferred to Mr. Burson's statement that the people are not
using the phone and adEised that they are not because it
costs too muc~money, Ee knows what the rates are. He has
had people approaching him in regards to oetitions~ Ne
would like a study made to see if it is p~ssib!e~
Mr. BUrson informed them that the Public Service Commission
has indicated recently that there possibly is a type of
service rather than a flat rate service which wou]~ be more
advantageous to the majority of telephone s~bscribers. This
is the Usage Sensitive Service.. Pessibly within the next
few months, there may be a service which will fit into what
they are asking for. At that time, it will be presented to
the Public Service Comm~ ssion and people for approval. Mr.
DeMarco replied that he knows the people are interested and
hopes there is a possible way to work out an agreement. He
clarified that he was not condemning the phone company and
M~. Burson replied that he understood that and is just point-
ing out their side.
Mrs. Padgett informed the Council that Mr. Johnson had re-
quested to speak on this subject.
Mr. Strnad stated he believed they stirred up a hornet's
nest with sending out the resolution and not having the
prooer information along with the resolution stating this
is not going to be a free ride. Naturally people will be
in favor of it if they don't have to pay for it. He does
not want to be paying for people calling from Lake Worth to
Boca Raton.
Mr. DeMarco clarified that he merely suggested that a study
be made. The rates are set by the Public Service Commission.
He still thin_ks a good feasibility study should be made.
Mr. Strnad stated he was concerned that the people who don't
want to call these particular areas will have to pay for ~ne
people who do want to call.
~. Ron'Johnson stated his name and his address as 1205 N.W.
7th Street. He told about his positio~ working for Southern
Bell and told about the amount of static received from the
public previously when the rates were raised. He is like
anyone else and likes to get something, but nothing is free.
In reference to Mrs. Jackson's statement that the Public
Service Commission would have to hold public hearings and
make a decision, if all the cities send in resolutions in
favor of this and in view of the City Councils being elected

by the people, they might get the impression that the people
want this. When the rates were increased previously, it was
a~ increase of $2.00 per month, but with inflation and con-

is a tremendous increase for 94% who never use it.
Mr. Etrnad made a motion to reconsider this resolution,
seconded by Mayor Eack after he a~certained that nobody elze
would second the motion. Under discussion, Mro Strnad stated
it was fine to let it stay as is, but he thinks letters should
be sent with an iuformati~e sheet to all the places which hay e
received thereselutio~informing them this is not going to be
a free ride a~d the majority of the people wiilbd~ave to pay
for the minority who will use the phones~ Mrs. Jackso~
stated this was brought out in one town and they decided to

Discuss Renovations - Councilm~ Norman F. Strnad
Mr. Strnad told about Mr. Werger contacting him in reference
totthe paving of his s~ree~. He now questions why all thi~
renovation goes on in City Hall and a street cannot be paved?
He referred ~o Mr. Werger mentioning things which were al-
ready completed, but last week another large job was started
in City Halt in the City Manager's secretaries' office. He
could no~ answer M~. Werger about this latest renovation and
requests M~o Kohl to give the information.
Mr. Kohl informed them that the renovation~ taking place i~
to move the secretaries from one office to another office and
the removing of a paztitiono He asked if he was talking about
the cost or what and Mr.. Strnad replied that he believed that
was what M~. ~erger was referring to. Mr. Kohl continued
that renovation is done every day in the City. There is a
crew of people for this purpose. Zf the Council does not
want him to do anything without their approval, he will come
to the Council for every item whether $10 or $100.
Mrs. Jackson asked if there was any great expense involved
and ~. Kohl explained that a couple of his own men did the
work.
Mr. Strnad then asked if Mr. Werger was satisfied with this
answer. ~. Werger appeared before the Council and referred
to the cost of government in this day and age getting so
high, ta~es increasing, etc. and the peopl~ant to know why

they don't get something for their tax dollars. If they
would get input from the people, a lot of things done in
City Hall would not be approved by the people. The people
are paying taxes and should have first say.~ The people in
Laurel Hills have been paying taxes for 23 years and nothing
has been done for the people there. He referred to the park-
ing lots being paved, new se~ts, new drapes, etc. and stated
that the old seats were sat±sfactory and their street could
have been paved i~tead. They should close their street off
to thrm~a~$i~ to~cBoat ramp or pave it. He thi~s the
people sho~ ~e considered. The taxes keep going ~p an~ they
g~t nothing en their street. They ride o~ their street every
day, ~ut do not come to City Hall every day. Mayor Zack in-
formed him that the pav~ of the street would be discussed
la~er and they were now discussing the renovations at City
Hall.
Mayor Zack stated that he does not know how much authority
the City Manager has in making renovations, but thinks he is
trying to use wise judgement. The cost is a big factor and
the City Manager must decide. However, there are a couple
rooms vacant on the second floor of City Hall and maybe one
of these could be a conference room. Mr. Kohl informed him
that he planned to make a second conference room on the
second floor. Mayor Zack continued that he knew there was
some concern about the renovations. ~rs. Jackson added that
she thinks there~ic ~u~h ~ thing ~ making things more con-
venient and also adding more rooms which s~e not needed.

~. DeMarco questioned the objections and asked if it w~ the

Mayor Zack stated that his experience has been that the fur-
ther the girls get from their boss, the worse it is. Three
girls are cramped together now and he questions if it is
good efficiency to have the three girls in one office. Is
this good m~uagement? He can hear every word they say and
knows what is going on. ~. Strnad told about where he works
with the secretaries and bookkeepers each having a separate
room so they can do their work more efficiently without
hearing each other on the phone, typing, etc.
Report on Resurfacing Street in Laurel Hills
Mr. Kohl told about Rubin Construction Co. inspecting the
street twice. They have submitted the price of about $7.00
a front foot for doing a complete rebuilding job. They
will not put 1" of asphalt on that type street anywhere in
Palm Beach County. This street needs reworking, additional
shellrock ~_ud drainage. The cheapest it could be d~ne would
be $5.25 per foot and it would not be done right. Mr. DeMarco
asked if this would be $7.00 per front foot for each side and
Mr. Xohl replied: yes, as it is $14.00 per lineal foot.

Mayor Zack stated that he made surveys and checked the assess-
ments made. If we do this job at no cost to these property
owners, what about the people who have paid $89,000 during the
past four to five years~ Some are still paying the assess-
ments. He feels these people should pay their share, the
same as a~yone else. He added that the people were supposed
to give some input.
Mr~ Strnad remarked that the only unfortunate part about this
is that it will hurt Mr. Werger because he ow~s 12 lots.~ Mr.

that it probably was, but he would like to check with the

Mr. Moore advised that he talked to Mr. Fronrath and was
informed the owner is asking for an indication from the
Council that they have interest in this property and are
going forward to determine from the taxpayers whether they
would want to buy it~ It would require some planning to
make a~ intelligent presentation~
Mrs. Jackson asked if it would be possible for the owner to
hold this until a feasibility study ia made? She would like
this turned over th the Planning & Zoning Board, City Planner,
City Attorney, City Engineer, Recreatio~ Director aud Utili-
ties Director for study.
Mr. Charles Fronrath appe~ed before the Council and stated
that he talked to Ns. Melear and his attorney and they would
be willing to grant the City a 90 day free option to come up
with an answer.~ They just want to k~ow if the City is inter-
ested or not. Mrs° Jackson asked if they meant a referendum
had to be held in 90 days and ~. Fronrath replied that they
could possibly extend it longer than 90 days, but would not
sit on it indefinitely~ He added that Mr. Melear wants to
know if the City is interested or not~
Mr. Strnad stated that he thought this would b~ putting an
imposition on N~. Melear and if he has a prospective buyer,
why should we hold him up? If he has a chance to sell the
property, why should the City interfere?
Mayor Zack referred to this land being out of the City's
reserve area and Mr. Fronrath clarified that this land was
j~st ½ mile west of it. Mr. Fronrath continued that Mr.
Melear is an old time reeident of Boynton Beach and would like
to see a City parktthere. Even with giving additional time,
he will have no problem selling the property. He wants to
give the City the opportunity to have this for some munici-
pal purpose. There wilt never h~ another opportunity re-
garding a piece of land like this. It is a golden oppor-
tunity.
Mayor Zack stated that the land was 360 acres at $~,000 per
acre ~nd this would be a total of $1,800,000 and with the
interest at 6% on a 20 year bond, over $3,000,000 would be
invested before touching anything. It could possibly take
$2,000,000 more to complete the ground. This is completely
too much area for a golf course. He thinks the Council must
decide what is to go in there and then have a feasibility
study made. Even though it is 18 Et. above sea level, does
this mean that muck? M~. Fronrath informed him it was sand
land with ponds for the water ~nd no water lies on the land.
Mayor Zack stated that the water elevation must be checked
for a golf course and Mr. Fronrath replied there was no pro-
Blem with drainage. An engineer has looked at it and it has
excellent drainage.

¥~. Strnad stated that in the words of Mrs. Jackson, they
must consider whether it is feasible, do we need it and
we afford it. Mayor Zack added that he thought one of the
first things which should he decided is what are the needs
of this City, present needs first and then f~ure needs.
In looking through the information, before a municipal golf
course is built, they must consider how mauy are self-sup-
porting. They must pay taxes for them and then pay to play.
Mr. Fronrath stated he would just like to have the ar~wer
yes or no whether the COuncil is going to give the citizens
of Boynton Beach this oppor~unity~ He thinks they shoul~
think of 20 to 25 years from today.
Mrs. Jackson stated that she thought a bond of 40 years would
be more appropriate and Mayor Zack stated he never heard of
one for 40 years. Mr. Noore informed them that a bond~could
r~u as long as they want. Mayor Zack remarked that the longer
it was, the more dnterest we will pay.
~. Strnad asked if we do have a feasibility study,~ how much
is it going to cost? Mayor Zack replied that possibly the
Department Heads could handle it as suggested by Mrs. Jackson.
Mrs. Jackson moved to instruct the City Manager to have his
Department Heads m~We a preliminary study on this land. Mr.
DeMarco seconded the motion. Under discussion, Mr. DeMarco
remarked that they may need some future land fill in this
area. ~. Moore added that this should be predicated on the
fact that M~. Melear will extend the 90 day period.
Mr. Ron Johnson appeared before the Council and stated this
was of interest to him since he is a taxpayer. He thinks
when considering the purchase of property, they should think
about where the middle of town is going to be located. He
believes the 30 acres for sale at Old Boynton Road and North
Boynton Road should be checked into. The location they are
considering is almost to 441 and there is no way the middle
of~the City wilI be this far west of town. This must be con-
sidered mainly.
Mr. Johnson continued with referr&~gto Mr. Fronrath,s state-
ment that the drainage is excellent and told about working
on this land and finding the ground very wet with water
coming in over his high rubber boots. They discussed fur-
ther the drainage and location of this land. Mr. DeMarco
asked how many miles from 441 the property was located and
Mr. Johnson replied that it was approximately two miles from
441. ~. ReMarco stated that it was only one mile west of
~litary Trai2. M~. Moore asked if Mr. Johnmon had bee~ on
this property and M~r. Johnson replied: yes, he k~ows the
area they arettalking about.

Report on Baseball Fields
Mr. Kohl stated that at Council's request, he contacted the
Board of County Commissioners in obtaining the property ad-
jacent to Galaxy Elementary School. It is his mnderstanding
that a letter is forthcoming from the Board of County Commis-
sioners, which he has not received as yet, wherein we will be
advised it is their intent to give us the land. He f~ther
contacted M~. Donna Phillips of the Congress Middle School
who advised we are welcome to use the two b~llfields located
there two nights a week after 3~30 P.M. ~ud three nights a
week after 4:30 P.M., and ca~ schedule as~ma~vball games ~
we would like at any time o~er the weekenus.~Mrs, jackson
asked ~oout the land in back of Galaxy School and Mo. KohlZ
informed her they are using it now.

Adequate Housin~ - Mayor Joseph F. Zack
Mayor Zack referred to this being kicked around for the past
five to six months and has been put into the hands,of the
Community Relations Board, which he think~ does not have any-
thing to d~with housing. The appointment of the Community
Relations Board was made per Resolutions 63-FF and66-B.
The City Council must face the reality of adequate ~using
and a study must be made. At the present time, it is a
minor problem, but they must move on it. To start the pro-
gram, he suggests having am Advisory Board investigate the
conditions as they are to d~and m~ke recommendations to
the Council. They must start and see what the outcome will
he. They must also look into Section 8 as there is nothing
pertaining to relocation.
Mrs. Jackson clarified that he was talking about an Advisory
Board and asked why couldn't the Community Relations Board
do this? The people from the Housing Board have been ap-
podnted to the Comm~uity Relations Board. It is a good
group and sub-coati,tees could be formed. Some of the people
have done preliminary research. M&yor Zack agreed, providing
the resolution is changed. He clarified that his recommenda-
tion was for an Advisory Committee. Mrs. Jackson agreed the
presen~ resolution should be changed, but suggests that the
Community Relations Board have a meeting and elect officers
and form the group and in the meantime, a resolution could
be drawn up changing the original resolution. ~. DeMarco
agreed this was a pretty good sized Board and they could have
sub-comittees.
Mayor Zack stated he thought the City Clerk was concerned
about sending out the appointment letters as they must have
guidelines for this Board. Mrs. Jackson replied that they
could still meet and organize. Mr. DeMarco re£erred to

previously having guidelines and Mrs. Padgett agreed, but
stated a new resolution was requested giving new guidelines.
Mrs. Jack. on suggested that Mayor Zack meet with the Community
Relations Board and advise that guidelines will be forthcoming
and get them organized. Mayor Zack agree~.
Mr. Moore read Resolution No. 77-~ prepared in reference to
the creation and guidelines for the Commmnity LRelaf~bnS~-
Board. Mr. DeMarco stated this would cover the Community
Relations Board and ?~yor Zaek added that he believed this
¢,overed everything, hut they should have a chance to review
it. He ~dded that Resolutions 6~i-FF aad 661-B must be re-
scinded. Yr. Moore clarified that this was prepared to ~over
the new Board~ the Community ~z~L~%'ibn~~ Board. M33. Kohl
then distributed copies of the~resolution. ~. Strnad noted
it was stamped as being received today and he believes they
should have t~me to read it over.
Mayor Zack asked who would serve on this Board and
Jackson ~uformed him that they voted at the previous meeting
to have members from the Housing Board and Community Rela-
tions Board. Mayor Zack clarified that there would be about
~4 members. He added that they would not need another reso-
lution as this will take care of this Board.
Mrs. Jackson moved to rescind Resolutions 66-B and 6~$-FF.

Mayor Zack told about there being a great deal of interest
in self-insurance by various Palm Beach County cities. He
advised that an information~meeting was held on March 24
and all the cities are in the same category with rates going

cords and Mr. Kohl reDlied not at this time, but he met with

he has heard that other cities give dinners every six mon~h~
and he requested Mr. Kohl to report back when the study is
completed.

Discuss Cooperative ~archasing Arrangements with Other Govern-
mental A~encies
Mm. Kohl informed the Council that he transmitted to M~. Moore
the County Ordinance 73-7 for his review regarding bid items
which can be incorporated by Governmental agencies in an effort
to secure better prices. He would appreciate the City Attor-
ney's legal opinion at this time as to the feasibility of pur-
suing this coursecof action. He explained how the County
went out for bids similar to the City aud they could be in-
clnded through the County. ~. Moore informed them that the
County must adopt a resolution including us.
Mrs. Jackson moved to accept the City Manager's recommendation
and request to be included in the County plan. Mr. DeMarco
seconded the motion. Motion carried 3-0.
Consider Request for Crematory
Mr. Kohl read the attached letter dated March 28,
Mr. L. Don Combs.

Mayor Zack asked if this fell in line with the ordinance and
~s. Jackson replied that it was prohibited by ordinance.
Mms. Jackson then stated she would like to ask M~. Combs a
question and referred to questions raised at.one time regard-
ing odors, pollution, etc. and asked if there was anything
like this in the way it is done now? Mr. Combs replied: no,
the modern units are a foolproof system.
M~. Combs then informed the Council that he would like to
get their authorization by motion to bring in engineers'
reports and pollution experts to verify his opinion and
statements. Mayor Zack suggested a motion authorizing him
to go ~head. M~. Moore clarified that this is an extensive
and expensive involvement and regulations are covered by the
State Board of Health, but right now, it is prohibited in the
City. He thinks M~. Combs needs some indication and he would

Mr. Kohl informed the Council that the Planning & Zoning Board,
at their Regular Meeting of April 12, 1977, unanimously recom-
mended the approval of the final plat for the townhouses of
Golfview Harbour mubject to ingress, egress and utility ease-
ments be~E provided on the private streets and the provisions
of stop signs by the developer. ~lso noted was the fact that
the plat conformed to the site development plans approved by
Council for Tract 1. All utility and engineering requirements
including bonding of the public streets and utilities have
been completed in conjunction with the approved site develop-
ment plans and the plating of the thir~ Section of Golfview
Harbour. The motion te approve was ma~e By Col. Trauger and
seconded by M~. Lambert.

plans for a doctor's office located at the intersection of

plans being submitted saud the construction of a buffer wall.

told about the Community Appearance Board's review of the
plans at their meeting last night and advised that this

particular location, he thick, Mr. A~kins has a reasonable
~rgument to not install a wall, but he must apply for a var-

Board at their Regular Meeting of April 12, 1977, by Mr.
Reginald Harris. The Planning & Zoning Board unanimously

Mount Zion Baptist Church subject to staff recommendations
e~cepting that the chef,ch be lighted during the hours of
darkness only ~ud that the height exception be permitted

Discuss Municipal Animal Control
Mr. Kohl announced he respectfully requests the Council's
consideration in transferring the control of the Animal
Warden from the Police Department to the Genersll Services
Division. This request would include the two Animal~ardens,
the responsibility of ~ne Municipal pound and all related
budgetary monies. He lists below his justifications for
this request. The advent of the South County Cooperative
Dispatch Center will exclude animal control from any normal
usage of radio frequency, t£ animal control were under
General Services, communications could be maintained by the
present municipal system. The centralization of our court
systems has in all respects rendered 2he enforcement (police)
powers of the Animal Warden absolutelyuseless, if this re-
commendation is approved, he ~O~ld like to'assign BoM
Eichorst, our present Health Officer, the additional duties
of being in charge of the employees as-well as responsibility
for the maintenange of ~he doE~ pound. He has 'discussed this
proposed change with both Chieff Huddles~on, and Mr. Robert
Feltz and they are i~ completeagreement~with his proposal.
If Council concurs, he respec$£ully requests approval of the
~[s_usfer of funds submitted, removing the monies from ~he
Police Department smd t~a_usfer~ing them to General Services
Administration Department to cover the costs of this opera-
tion for the bal~_uce of this fiscal year.

~. Kohl statedtthat as the Council members are aware,
earlier in the year they approved his recommendation to
transfer the Codes and Licenses Department under the juris-
diction of the Building Official, which was accomplished by
Resolution. Subrmitted is a request for a budget transfer, so
that the balance ~of the funds now remaining in the Codes and
Licenses Deps~tment can be transferred to the Building De-
partment to complete the fiscal year. He added that this
was similar to the pre~ious request and a department cannot
be rmu without a transfer of funds to be legal.

Dear Frank:
There has been a marked increase in the interest in cremation in
the last Jew years, Many funeral homes in Florida have installed
a crematory unit in a' warehouse or garage space at their exlsflng
funeral home. The ease of operation is much greater when this
operation is at a funeral home.
I would llke the City Cc~uncll to consider an amendment to an or-
dinance which would permit me to establish a crematory on the
premises of my funeral home,
