Minutes 03-21-12 MINUTES OF THE CODE COMPLIANCE BOARD MEETING HELD ON WEDNESDAY, MARCH 21, 2012, AT 6:30 P.M., IN COMMISSION CHAMBERS CITY HALL, 100 E. Call to Order Chair Costantino called the meeting to order at 6:31 p.m. II. Approval of Minutes of February 15, 2012 The following changes were made: Page 1, Case #03 -2123 " ...had been will be tabled to January 15, 2013." Page 2, Case No. 09 -3194, fourth line should read "The date the Notice of Violation was sent regular mail was October 2, 2009." Same case, fifth line should read: "The date the Notice of Hearing was sent certified mail was December 28, 2011, and the signed green card was dated January 4, 2012." Page 7, Case No. 10 -3153, fourth paragraph should read: " ... advised the building on 41 -7445 417/445 Federal . . ." Page 17, Case No. 11 -3162, the names in the motion paragraph were changed to: " .. . moved that this Board find that = - - - - - _ - _ A : - • • - - ■ _ _ Kaiser Shekha & Robert Giles are in violation of the . . ." Page 35, the first of the first two motions should read: "Mr. Colo Vice Chair Yerzy moved to retain Michele Costantino as Chair. ", and the second motion should read, "The motion was seconded by Mr. Oele Foot and unanimously passed." Motion Vice Chair Yerzy moved to approve the minutes as amended. Mr. Foot seconded the motion that unanimously passed. III. Approval of Agenda Vestiguerne Pierre, Senior Code Compliance Officer, announced the following changes to the agenda: Case No 08 -2511 was requested to be tabled to June 20, 2012. Motion Mr. Foot moved that the aforementioned case be tabled until the Code Compliance Board meeting to be held on June 20, 2012. Ms. Yerzy seconded the motion that unanimously passed. Case No. 12 -150 was requested to be tabled to April 18, 2012. Motion Ms. Yerzy moved that the aforementioned case be tabled until the Code Compliance Board meeting to be held on April 18, 2012. The motion was duly seconded and unanimously passed. Case Nos.: 11 -3161, 11 -3366, 11 -3372, and 12 -102 had complied. Case Nos.: 11 -3334 and 11 -3342 were removed. Case No. 11 -3448 was requested to be tabled to April 18, 2012. Motion Ms. Yerzy moved that the aforementioned case be tabled until the Code Compliance Board meeting to be held on April 18, 2012. Mr. Foot seconded the motion that unanimously passed. 2 Meeting Minutes Code Compliance Board Boynton Beach, FL March 21, 2012 Motion Vice Chair Yerzy moved to accept the agenda. Ms. Yerzy seconded the motion that unanimously passed. IV. Swearing in of Witnesses and Introduction Attorney Bridgeman explained the hearing procedures and administered the oath to all who intended to testify. V. New Business Officer Pierre called the roll and determined who was present. Case No. 12 -145 Annette Harrell Property Address: 391 NE 28th Court Violation(s): CO CH15 SEC 15- 120(D) INC CO CH10 SEC 10 -52 LDR CH3 ART IV SEC 3 (C) and D) Remove inoperable vehicles, auto parts, tires, engines, tool boxes, appliances and trash and debris from the exterior yard areas. Remove trash and debris from the swale area and east side. Cease and desist unpermitted auto repair at this location. Skip Lewis, Senior Code Compliance Officer, presented the case, which arose from a citizen complaint. The initial inspection date was January 30, 2012, for the violations noted above. Officer Lewis requested a Cease and Desist Order for outdoor storage of inoperable vehicles, appliances, tires, auto parts, and unpermitted auto repair. It was noted the Respondent was a repeat offender. Staff recommended 10 days be given to comply. Annette Harrell, 391 NE 28th Court, Boynton Beach, pled no contest and indicated the property was in compliance at this time. Officer Lewis had been unable to inspect it earlier and explained that was why he requested 10 days. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Foot moved that a Cease and Desist Order be issued giving Annette Harrell until March 31, 2012, to bring the violations of City of Boynton Beach Code sections as cited into compliance. The Board has considered the gravity of the violations, the actions taken by the Respondent, and any previous violations by the Respondent, and hereby orders that 3 Meeting Minutes Code Compliance Board Boynton Beach, FL March 21, 2012 a fine in the amount of $250 per recurrence of the violation thereafter shall be imposed upon the Respondent. Vice Chair Yerzy seconded the motion that passed unanimously. Case No. 12 -55 Lucina Guerra Property Address: 204 NW 3rd Court Violation(s) CO CH15 SEC 15- 120(D) INC. Remove inoperable /unregistered vehicle from your property. Officer Pierre presented the case as noted above. Staff recommended 10 days be given to correct the violation. Aletario Martinez, 204 NW 3rd Court, was present with his mother, Lucina Guerra, the Respondent. Ms. Guerra spoke very little English so Mr. Martinez confirmed she resided at the premises. She pled no contest. He requested 30 days be given to correct the violation and explained the vehicle belonged to him. His license was suspended and he took the tag off. He spoke with legal counsel about how long it would take to resolve the matter. The vehicle was presently covered and under the carport. Officer Pierre inspected the property and testified the car was not covered. It was not considered enclosed if in a carport. Motion Based on the testimony and evidence presented in the aforementioned case, Vice Chair Yerzy moved that this Board find that Lucina Guerra is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent correct the violation on or before April 20, 2012. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $100 per day for each day the violation continues past April 20, 2012, plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Ms. Yerzy seconded the motion that unanimously passed. Case No. 12 -75 Niva Simplice Property Address: 1470 NW 3rd Street Violation(s): CO CH 15 SEC 15- 120(D) INC. Mow yard. Remove unregistered /inoperable vehicles. Officer Pierre presented the case. He noted the yard was mowed but the vehicle violation remained outstanding. The Respondent was present. 4 Meeting Minutes Code Compliance Board Boynton Beach, FL March 21, 2012 Niva Simplice, 1470 NW 3rd Street, pled not guilty. Officer Pierre had photographs he provided to the Respondent and the Board. The license plate was inside the house and she testified the vehicle was insured and registered. Ms. Simplice commented she does not drive the car as she did not have the money to repair it. She was unaware the tag had to be affixed to the vehicle. Motion Based on the testimony and evidence presented in the aforementioned case, Vice Chair Yerzy moved that this Board find that Niva Simplice is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent correct the violation on or before March 31, 2012. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $150 per day for each day the violation continues past March 31, 2012, plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Mr. Bucella seconded the motion that unanimously passed Case No. 11 -3036 Anita Winston Property Address: 1633 NE 4th Street Violation(s): CO CH10 SEC 10 -56(B) CO CH 10 SEC 10 -58(D) BBA FBC '07 ED 105.1 Secure all required permits from Building Department, restore exterior property area to sanitary condition. Remove all outdoor stored materials, trash and debris. Attorney Bridgeman administered the oath to the representative. Officer Lewis presented the case and stated it was a City referral. The initial inspection date occurred on November 8, 2011, for the violations noted above. Parts of the violations were corrected, but the ones regarding the permits were outstanding and outdoor storage items needed to be removed. The permit for the sewage line was obtained and repaired. Jonathan Steinberg, son of the Respondent, Anita Winston, who also resided at the residence, was present and pled not guilty. Officer Lewis explained the property was red - tagged by the Building Department. He had photographs of the outdoor storage. Mr. Steinberg had advised him he was working on the permits, but had not obtained the electrical permits and still had to remove the outdoor items. 5 Meeting Minutes Code Compliance Board Boynton Beach, FL March 21, 2012 Mr. Steinberg explained this project started out as correcting a Code violation pertaining to an electric conductor for the air conditioner and kitchen. He did not obtain a permit. The property was a mess but 99% of it was now cleared. The main violation was a cracked sewer line, which was also 99% completed. The issue with completing that was he planned to move the laundry room inside because external laundry rooms were not permitted. He learned the existing laundry room was previously enclosed. During Hurricane Charlie and /or Wilma, the enclosure was destroyed which created a violation. His goal was to enclose the existing laundry room using the existing slab. He renovated all of the plumbing through Fox Plumbing. He had to complete the electrical alterations and he submitted plans, but they had to be redone because enclosing the room changed everything. The entire house no longer needed to be revamped, electrically. He admitted he had two illegal sheds, but explained it was the only place he had to keep his tools safe. He was burglarized four times since he started the project, and was recently mugged. He had to do the work by himself, because each time he hired someone, they were either thieves or meanderers. Mr. Steinberg thought a month would be sufficient, except for the demolition of the sheds. It was not a prime neighborhood. Mr. Steinberg agreed to focus on the electrical. He thought he could obtain the carpentry permit in a week and have the work done within two weeks. Two weeks thereafter, he should be able to complete the electrical. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Foot moved that this Board find that Anita Winston is in violation of the City of Boynton Beach Code sections cited and moved to Order that the Respondent correct the violations on or before May 5, 2012. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $250 per day for each day the violations continue past May 5, 2012, plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Case No. 12 -52 U.S. Bank National Tr. (1530 Rialto Dr.) Property Address: 1530 Rialto Drive Violation(s): CO CH10 SEC 10- 56(B),(C),(D) 6 Meeting Minutes Code Compliance Board Boynton Beach, FL March 21, 2012 Restore pool to sanitary condition and properly secure. Replace missing gate on fence and secure all open windows. Remove all outside storage, remove trash and debris, and repair or replace all torn screens on windows. John Herring, Code Compliance Officer, presented the case as noted in the staff report. The violation was a health and safety hazard. The pool was not clean and the gate to the back fence was missing. Staff recommended 10 days be given to correct the violations. Motion Based on the testimony and evidence presented in the aforementioned case, Vice Chair Yerzy moved that this Board find that U.S. Bank National Tr. is in violation of the City of Boynton Beach Code sections cited and moved to Order that the Respondent correct the violations on or before March 31, 2012. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $1,000 per day for each day the violations continue past March 31, 2012, plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Ms. Yerzy seconded the motion that unanimously passed. Case No. 11 -3046 Congress Ave Financial Assoc. — Joseph D. Gretzula, D.O. Property Address: 555 N. Congress Avenue, Unit 201 Violation(s): CO CH2.5 SEC. 2.5- 123 +13 Excess false alarms & service fee. Deanna Richardson, Administrative Associate, presented the case as noted above. Staff recommended 10 days be given to correct the violation. Gretzula, D.O. is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent correct the violation on or before March 31, 2012. There was a discrepancy regarding the address. Officer Cain explained the complaints are submitted by the Homeowners' Associations. They report who lives in the units and this Homeowners' Association reported the unit was a rental. Mr. Foot seconded the motion that unanimously passed.
