Mayor Zack called the meeting to order at 7:30 P. Mo He re-
quested everyone to please rise at the sound of.the gavel for
the Invocation given by Pastor Walter Graves, Mi~_ister ef

17 and April 24, 1977 as Rid Litter Weeks and Saturday, April
30, 1977 as Rid Litter Day.

Mayor Zack called en the Council members for corrections.
Mr. De~mrco replied that he had none, except Page 11 was
missing. Mrs. Jac~on and Mr. Caldwell added that their
Page 11 was also missing. Mr. Kohl replied that this was
probably a mistake done by the collator. Mayor Zack re-
quested the City Attorney to read Page 11 and N~. ~ore
replied that this page mainly covered discussion on drug
abuse. Mr. Strnad stated he did ~ot see anything about d~mg
abuse on that particular page .and Mr. Moore noted that he
had referred to the March 18 Minutes. Mayor Zack informed
them that Page 11 referred to the widening of Seacrest Blvd.
and he then read this p~e.
Mr. ~trnad and Mr. Caldwell stated they had no corrections.
Mrs. Jackson referred to Pa~e 2, last paragraph, ~iEth line
up, after the wor~ "City", ~t 'should say: ~he asked hOW

Mrs. Jackson referred to Page 9, second paragraph, after the

Mrs. Jackson referred to Page 12, under Appointments to the
Civil Service Beard, it should say: "~here were no other

true in the next paragraph and it should say: "There were no
other nom~natioms and Mr. Weaver was elected 5-0."
Mrs. Jackson referred to Page 21, second paragraph, which

Mayor Zack referred to Page 4, second paragraph, second line,
and advised there were "five" items and not "nine" items.

discussion, second line, where it says 60%, it was 68.8%.
Mrs. Jackson moved to approve the minutes as corrected,
seconded by Mr. Caldwell. Motion carried 5-0.

Mr. Strnad and Mr. Caldwell replied they had nothing.
Mrs. Jac?~on referred to Page 6, next te last paragraph,
third line up, after wor~ "town", it should say: "being
subsidized in our City." Also, the word in the next line
should be: "debenture" instead of "venture',.
Mr. Caldwell moved to approve the minutes as corrected,
seconded by Mr. DeMarco. Motio~ carried 5-0.
PUBLIC AUDIENCE
Mayor Zack called on the people desiring to speak to the
Council.
Mr. Harold Werger stated his name and his address as 719
N. W. ?th Court, Laurel Hills. He presented a petition
signed by 102 property owners for the paving~f N. N. 7th
Ct., part of N. W. loth Avenue and part of N. W. 6th Ave.
in Laurel Hills at no cost to the property owners. He in-
formed them that all of these property owners live on these
dirt streets and the surrounding streets and are affected
by the dirt, traffic, and especially the winds of the past

Mr. Werger c~ntinued that outside City Hall, the Police,
Fire and Building Departments all have paved parking lots.
Even the lo~ for the maintsnance trucks is paved. Ne re-
ferred to the cost to Build ~ud maintain the par~ on Federal
Highway ~a~.d how this was not used. Even the dead are taken
care of W~th paved streets i~ the cemetery. A few weeks ago,
the Co~cil spent $8,700 for a drug abuse program for a hamd-
ful ofa~diots and he mnderstands this was wasted. The City
spent ~ey for a new tree trimming truck because the old o~e
neede~ re~airs. They question the timing of all this spend-
in~. Some things needed by the taxpayera are igaored or dis-
regarded while other things for just a few are taken care of.

Mrs. Jackson referred to checking into this and advised that
it was platted in 1951 and the street and sidewalk ordinamce
wa~ also passed in 1951, so this may be a legitimate gripe.
She feels they should definitely start in where there are
homes on'mnpaved streets. She thinks they sh~muld start a
list of streets which mast ~e brought up to standard.
Mr. I~uis Spano stated his name and his address as333 S. E.
23rd Avenme. He referred to approximately six m~nths ago
when he appeared before the Council reEarding the paving of
S. E. 3rd Street. He approved of the paving, .the same as
~hese people. He voiced his objections s~nee the aerial
photographs showed this street was iA. He'is. willing to pay
his fair share of the tax assessment levied him. If
the Council decides to pave someone ~oes
not assess them, he thin_ks the asse:

Mr. Oaldweli stated he thought it was a lit%le bit ridiculous
in 1977 for a City like Boynton Beach to have dirt roads.

He referred ~o the mimutes from the May 18, 1976 minutes
and the statement of People not having paid for ~he paving
of streets. If this is true, he feels a precedent has been
set. He feels these streets should be paved without further
assessment to the individual home owners. ~hey do have a
budget and are trying to trim costs. He referred te the
people previously be.lng willing to pay $2~00 to $2.30 per
fre~t foot and the City's estimate being $7.50 per front
foot ~ possibly the City should consider

Mayor Mack noted that it was now 8:00 P. M. and ammo~mced
they would have to proceed to the Public Nearimg and would
then csme back to this.
ABANDONMENT - 20 Ft. Alley (Eorth & Mouth) Roberts Addm.
Applicants - Robert G. Beane, Lucien A. tamyn, Dorothy
Brinkmam, GilliamWinbourne, and Mike
Brinkmam.
Mr. Kohl informed the Council ~J~At'~the Planmimg & Zoning
Board, at their meeting of March 22, 1977, conducted a Public
Hearing on the above and recommended approval of the pro-
posed abandonment of the alley adjacent to Lots I, 2 amd 3,
Block 3; Lots ~, 2, and 3, Block 6 and that portion of the
alley adjacent to previously abandoned N. E. 4th Avenue. A
·rawing for their ~eview has been submitted. Im addition,
the Planning & Zonmng Board recommends that an easement for
the east ~2 feet of the subject alley be recorded for utility
purposes in favor of the City ~d in lieu of Florida Power &
Light,s request for same. All legal reqmimements have been
met and responses were received from the ~tility compamies
involved, all of whom had no objection except for Florida
Power & Light. A copy of theirlletter has ~een submitted
wherein they request execution of ~u easement. The origina~
of their letter as well as the three easements have ~een £or-
warded to Central File. He requests Co~ncil,s wishes om this
matter.
M~. DeMarco referred to attendimg the Planning & Zoning-
meeting and made a motion to recommend the abam~omment of
the alley as requested. Mr. Caldwell seconded the motion.
No discussion. Motion carried 5-0.
Mr. Moore referred to the ~2 ft. ~asement and asked if this
was the east or west 12 ft. easement and Mr. Kohl clarified
this was Lots 1 thru 6, Block 3 and Lots ~ thru 3, Block 6.
F~. Annunziat~ added that the ration~l behind the question of

Lots 4 thru 6 is that they are City owned and it would not
be correct to abandon those lots. Florida Power & Light Co.
requested an easement for power lines which would give ~he
City access for utility pmrposes. Mr. Moere asked if the 12
ft. was along the railroad track and Mr. Annunziate informed
him it was the east 12 ft. of the alley. Mr. Moere clarified
there would be the 20 ft. alley, the 12 ft. for the easement,
and then 8 ft. left which would revert to the property owners.
There was further discussion and then Mr. Annunziato added
Mayor Zack asked if anyone wished to speak in favor of this
abandonment and received no response. He then asked if anyone
wished to speak in opposition and received no response.
Mr. DeMarco made a motion to grant the easement as requested
for the City, seconded by M~r. Caldwell. Mrs. Padgett took a
roll call vote as follows:

Mr. Kohl informed the Council that the Pls-~ing & Zoning Beard
at their regular meeting of March 22, 1977 conducted a Public
Hearing on the above and unanimously recommended approval of
this amendment subject to the revision submitted. The motion
to approve was made By Mr. Lambert and seconded by ~. Winter.
Mayor Zack asked if anyone in the audience wished to speak in
favor of thi~ ordinance and received no response. He then
asked if anyene wished to speak in opposition and received
no response.
Mr. Moore read proposed Ordinance No. 77-9 ih its entirety.

Mr. Caldwell moved the adoption of Ordinance No. 77-9 on
first reading, seconded by Mrs. Jackson. Under discussion,
Mr. Caldwell asked if this proposal differed from the ori-
ginal one oresented at the end of Jammary and Mr. Annuaziato
replies that the only thing different was the revision of the
outline te fit into the Zoning Ordi~ance. Mrs. Jackson then
told about the Deerfield Beach Planned Industrial Development
Mr. DeMarco added that Mrs. Jackson, Mayor Zack and

At this time, Mayor Zack referred to the new zoning map in
the Council Chambers and thanked theCity Manager for it and
added that he was sure it would be helpful to the Planning
Zoning Board as well as the City Council.

ience, seconded by Mrs. Jackson. Motion carried 5-0.
PUBLIC AUD~NCE (Continued)
Mr. Bill Burson, District Manager for Southern Bell, appeared
before the Council and advised that he felt obligated to
speak about Resolution 77-0 passed at the last meeting. He
f~eels they should know about or be familiar with the situation
they had in 1971 when they went to extended scope dialing in
West Palm Beach. In ~he late 1960's, they had a group of
people approach the~ about toll free dialing into West Palm
Beach. Several studies were made and the majority responded
affirmatively. In a situation like this, ~hey must add cable,
switching centers, etc. to handle the increased load. In
197~, they cut ever to extended scope dialing in Boynton
Beach to West Palm Beach and of course, the customers, bills
increased. The local service rate is figured on the number
of calls you can contact on a local basis. He was transferred
here in 1971. If the study was taken the month it was cut
over, they would never ha~e cut it over. He personally re-
eei~ed 200 complaints regarding the increase an~ the people
wanted to go back to what they had before and were not in-
terested in calling ~est Palm Beach. Because of this serious
situation beth here and other exchs~ug~s, the company toek the
positien that customers who want extended areas should pay for
that service. He has reviewed the toils for the customers in

Boynton Beach calling Boca Raton and the toll calls are made
by approximately 5% of the Boynton Beach customers and 1%
make the majority of those calls. From going from pamt ex-
perience and looking at the calls, he believes the majority
do not want extended scope dialing mainly Because it will

~ they don't want their bills to increase~ He felt ob-

Mrs. Jackson aske~ if there was any way to work it out for
the people to have limited calls if they want te and Mr.
Burson replied that there were several plans under consid-
eration. He explained how a few telephome companies were
using budget type service.~ He also explained msage~ sensi-
tive service with the local service going towards calling
credits. This will be given a trial. He knows what they
ran into dm 197~ an~ is afraid of what they would r~ into
no~ in going i~to a system like the City asked for. Ne
honestly feels if they took a poll of the telephone users,
they would find the majority do not wans this.
Mrs. Jackso~ asked if there was any w~y to ask their cum-
tomers this question and Mr. Burson replied that it costs
money. He continued that the toll ~ate Erom Boynton Beach
to Boca Raton right now is 11¢ for the first mimute and 9¢
for each additional mimute from 8:00 Ao M. to 5:0~ P. M. If
the interest was there, they would have a large number of
toll calls, but they do not have that volume. The volume
they have is made by a small percentage of the customers.

there would Be noqquestiom. He knows ef nothing to indicate
the need is there.
Mr. DeMarco q~estioned the additional rate and Mr. B~rson re-
plied it was a hard thing to figure an~ ~he rate is normally
~igured on the number of phones you can contact on a local
calling ~asis. Also, the Boca Rat~n poin~ of i~terest is
mot calling north, ~ut in calling Deerfield Beach, Pompano
Beach and south. They must consider whether Boca Raton
wants this and if they should share the expense and if not,
should Boynton Beach handle the whole expense. He might say
it could run as much of an increase of $8.00 per month.
~Mr. De,arco referred to Dade and Broward Counties beimg able
to call the whole county free and Palm Beach County is a
growing Co~ty. He does not know how the rates are figured,

but does know in calling from Lake Worth to Bom Raton, he
cannot get under 50¢. Mr. Burson replied that he did not
have the rates from Lake Worth.
Mr. DeMarco asked if there was the possibility as the popu-
lation increases this may come about a~d Mr. Burson replied
there was a good possibility. He added that if they go to
usage service, it may solve the problems. However, many
people like the flat rate service to make as many calla if
they want for as long as they want. Im going to the other
service, you are om a message rate service. It is a matter
of what the majority wants at a given time. He feels~ure
there will be changes made to satisfy the majority.
Mr. DeMarco stated if they decided to take the service out
from West Palm Beach to the Boyntom Beach customers, there
would be a fight and Mr. Bursom agreed there may, hut when
it was done, there were ma~y complaimts~. He personally re-
viewed approximately 200 and he does mot know how ms_uy the
other r~presentatives handled. He is just pointing out that
they feel the majority do mot want their bills to increase
and the majority do not have interest in calling Boca Raton.
M~. DeMarco asked if there was a possibilityoof gettimg a
survey and Ns. Burson replied that it costs money and they
have researched the number of toll calls. Ns. DeMarco re-
ferred to his statement of it costing momey and stated that
they run full page ads~. Mr. Burson replied that they are in
business to make money. He added that he didn't know how
many people were aware that the rates from Boynton Beach to
Boca Raton drop from 11¢ to 9¢ for the first minute and from
9¢ to 7¢ for each additional minute after 5:00 P. M. The
more revenue brought in, the lower the rate will be. They
are trying to educate people to use the system during mom-
busy hours through advertising. The advertising costs are
mot in their ~ate base. Mr+ De¥~rco asked who was paying
for it and Mr. Burson replied the telephone company itself.
Mr. DeMarc~ stated he would like to see getting phone service
through and referred again to the situation in Dado and Bro-
ward Counties. ¥~. Burson replied that this was not the way
to accomplish it. There will be changes made. They will
come up with systems the people will be satisfied with. He
doesn,t think they should saddle everyone with a cha~ge now
they may mo~ want.
Mr. Caldwell thank~ Ms. Burson for coming and added that he
personally appreciated his explanation. He ~oes urge them to
discuss this with other area manager~ to review the rate
systems throughout the companies.~ He does know there are
systems with a flat rate for certain services and then a
message umit rate for going outside of that area. He £eel~
they should give this serious consideration. Mr. Burson re-
plied that with the usage sensitive service, he thinks this
may be a plan they may want.

Mayor Zack announced they would now continue with the dis-
cmssion of 7th Co~rt. Mr. Caldwell asked Mr. Moore if there
were a~y ordinances enforced omtlining the methods hy which
the C~z~y charges for paving streets and Mr. Moore explained
how it was covered in the Charter. The City has the right
te assess the property owners at any rate. The procedure has
Been if 50% of the people came in with a petition, the City
would· undertake the project ~h~ make assessments for 1/2 or
~r~i-~'of'~ the cost. Mr. Caldwell clarified that it was left to
-t~ discretion of the Council and Mr. Moore replied that the
experience i~ most instances if it is strictly a private
street, the citizens haveppaid the paving costs.
Mayor Zack then read the requirements for streets and side-
walks.
Mrs. Jack, on then asked if a developer does not put in all
the streets in a subdivision like in ~951, isn't it some-
thing which could be corrected by the present C~euncil and
Mr. Moore replied that he believed Mr. Har~ was dead.
He added that if the City accepted the plat, he does mot
believe there were subdivision laws i~ effect then. Mrs.
Jackson replied that this subdivisiomwas platted in 1951,
the same year the ordinance on streets, etc. was passed.
Mrs. Jackson then stated that there would be 40 residents
paying for this. Im reference to Mr. Spame's s~reet, it is
not nearly as well populated as this street. She does feel
they should make a priority of streets which have been ac-
cepted. She thinks it is wrong to have streets which are
not pave~ and aceepted by the City with homes on them. She
does ~ot see why they cannot do a few~streets at a time.
She feels it is wrong to haveppeople !iv~ing on streets which
areaa mess. Mayor Zack replied that He ~id~not thi~-k the
question should ~e th? number of people on the street. If
a road needs pavmng, it should be done. The~ mush consider
the past precedent though. Are they ~oinE to return money

to do all streets without charge? He ~ feels if it
is his street, he is willing to pay He kmows

Mayor Zack referred back to the situation on Mr. Spamo's
street and stated he recalled this street being full of
holes and he mentioned this to the City Manager and it was
filled with shell reck, He does not think they should favor
one group against the other group.
Mr. Werger stated it was not a question of sett~ug a prece-
dent for not pa~ing for the paving as a lot of streets were
pa~e~ and the people did not have to pa~. Mayor Zack asked
the City Manager to ~er~fy this and Mr. Kohl stated that
since he has been the City Manager, it has not been done.
Ne does not know about the past. They have assessed every
person since he has been here.
Mr. DeMarco questioned the difference of $7,50 to $2.32 per
front ft. and Mr. Kekl explaimed that the lower price was
without amy elevations, gro~md work, shell reck work, drain-
Aage, etc. He added that Rubin Construction Co. and Dixie
sphait Co. had 9uoted a price of $1.36 per square ya{.d for
resurfacing. Mr. Werger stated there were no drains in

people there. He added that the street should be paved like

Mr. DeMarco stated he did not know of where streets were of 4/19/
paved free and Mr. Strnad stated that he did not either and
would like to know where these streets are. MrS. Jackson

has beem on the Council. Mayer Zack disagreed. Mrs.
Jackson stated that old streets were paved and she does not
think the people in Rolling Green paid for them.
Mr. Strnad asked Mr. Kohl if he thought this was the proper
course to follow to start in something like this and
Kohl replied that he would hate to see this. He thinks a
class action suit could he brought against the City. M~y
people, like Mr. Sp~_no, have had to pay. He knows what these
people are facing. He thinks it is wrong, but the Council
must make the decision and he will carry out their wishes.
Mr. Moore stated that he thought thet~rmineleg~, called these
special assessments because the area involved is specifically
benefited and should pay their portion. The particul8m seg-
ment of the municipality is specifically benefited.

Mayor Zack suggested leaving the City Manager get some bids

was going to take care of the maintenance and operation of

Co~ty is going to study it and they will take care of the
maintenance i£ one is installed. Mr. DeMarco stated that

Mr. Kohl referred to a message submitted by Mr. Moore and to
having some problems with this. Mayor Eack clarified that
it was a question of interpretation. He referred to Part (b)
on the second page stating ~' only one way and he called this
to the attention of the Building Official eight to ten months
ago. Mrs. Jackson replied that she thought 4" both ways
would be too small. Mayor Zack stated that he personally
felt this meant a cyclone or wooden fence, but a fence has
been installed like a hand railing which he does not thi~k
serves the purpose. He believes it should s~ate 4" hori~
tal amdwertical. ¥~. Caldwell stated he interpretted it to
include every way with stating"a~y dimension". He think~
this is clear. They discussed the interpretation and a
railing type fence, Mr. Moore added that there have been a
lot of problems and Mr. Kohl added that it must be enforced

Mrs. Jackson referred to rm. Spielberg sending ia his resig-
nation, but suggested since they have voted to have the Com-
munity Relations Board investigate what the Housing Authority
was going to do, she would like to askMr. Spielberg to re-
consider his resignation since they need legal advice on this.
Mayor Zack replied that he believed the Civil Service Board
would be the best Board for Mr. Spielberg.
Mayor Zack referred to an architect, Mr. Sandberg, sending
in his resume and Mrs. Jackson replied that the resume was
not sent in by Mr. Sandherg but by someone el~e. Also, he
wants to be on the Community Appearance Board which is al-
ready completed and she does not think this should be con-
sidered. Mayor Zack referred to the Community Appearance
Board requesting an architect and Mrs. Jackson pointed our

people on the Housing Authority appointed this year did send

maY not want to. He explained how there was the possibility
a particular use in C'3 would not be advantageous at that
location. He would like the use reviewed before the restric-
tion is removed.
Mr. DeMarco asked if this would be creating a hardshi~ for
the applicsnt and Mr. A~nunziato replied not necessarily as
they ca~ agree to remove the restriction for amy reasonable
use. Mr. Caldwell clarified that wholesale relief would be

accepted. ~ are all aware that the City Gode needs upgrad-
ing and he would appreciate Council's approval in securing
this Corporation to accomplish this work. He does concur
with this program.

Mr. DeNarco stated they were very fortunate to have Boynton
Inlet in their area and referred to Palm Beach County passLug
a 50 million dollar bond issue'to buy water front property.

before the Coumty Com~ssion and persmaded them to bmy this
propertyt There was a proposal to build a 12 story condominium
on this land, but after convincing the County Oomm~ ssion this
was terrific recreation area, they decided to acquire this
property. However, in the meantime, the company plamming to
build the condominium went bamkrupt and it was in litigation.
A 50 million dollar bond issue was fouled up. This area was
presen~d to him when they took the beach walk and it could
~e a beautifully planned park. A resolution has alread~y been
sent, but he believes another reselm~ionl at this time would
get them acting on it. Mr. De.Marco added that he has been
in contact with several Commissioners and they are in favor
of this and would like us to back it. He is sure the 50
million dollar bond issue will be validated and he cannot
tb~k of a better area than Boynton Iulet.
Mayor Zack asked if it was legally permissable to de-a~uex
when not conti~eus to the property and Mr. Moore replied
that this wa~ part of the town now, but he thinks the Legis-
lature could de-annex it. Mr. Strnad informed them that the
north side of the Boynton Inlet and ~he driveway side of the
south part of the Inlet belong to the South Lake ~orth Drain-
age District. The rest of the property is now in the hands
of the receivers and is a separate ~iece of property. Mrs.
Jackson stated that even though it b~longs to the South Lake
Worth Drainage District, it is still in the Town of Ocea~
Ridge.

Mr. Strnad questioned the p~rpose of de-annexing with the
County taking it over and referred to the County having the
beach in Ocean Ridge which is not de-a~nexed. Mr. Moore
informed them Rat the Legislative Delegation is the only
one whieh can amend the charter for Ocean Ridge to exclude
that land from the town limits. Mayor Zack suggested that
the resolution be passed and sent to the County Commissioners
~or them to proceed. Mrs. Jackson remarked that the Legisla-
tive Delegation could net take this up this year~

Consider Resolution in Fulfilling the Requirements of the
Local Government Comprehensive Plannin~ Act
Mr. Kohl referred to forwarding the complete file on the
above to the Council members for their review and advised
that the Plan~ing & Zoning Board at their meeting of March
22, ~977, mna~imously recommended that the City Council pass
a resolution to jointly comply with Palm Beach County in ful-
filling the reqmirements of the Local Government Comprehen-
sive Planning Act within the reserve annexation area. The
motion to approve was made by Col. Trauger and seconded by
Mr. Arena.
Mayor Zack then requested the City Pla~ner to give iaput.
Mr. Annunziate informed the ~ouncil that the City is required
to comply with the Local Government Comprehensive Planning
Act. For those municipalities that have reserve annexation
area, verbiage was put into the State act to permit joint
pls~tng if there w~s action taken by the legislative bodies
and if both agree, joint implementation procedures are pro-
vided. This wo~ld give ms planning i~ the reserve annexation
a~ea. The Plan~ing& Zoning Board expressed the feeling to
join in this planning at the last meeting when the County
presented the plan for our annexation area. The plan cuts
the number of units by a couple thousan~ in the reserve
~ea. Mayor Zack referred to Mr. King mentioning 75% and
. A~unziato replied tha~ the reserve ~nnexation area is
limited to ~ mile from Military Trail and west of there,
~.~have mo~essi~le jurisdiction. Mr. Caldwell asked if

meeting and how he felt we were being slighted. He felt he
should look into it further and met with Mr. Ray Libertti
and was given facts and figures. This is strictly a tempor-

police stations, schools, etc. It is not for us to say we
want such a dens%ty. He then read the figures estimated for

Board at their regular meeting of March 22, 1977, unanimously

Mrs. Jackson stated that before making a motion, she would
like to ask how ma~y on this Council would like to have their
next ~oor neighbor have~nly exit through their driveway?
She does not see how they cam ask somebody te have a~ exit om
somebody else's driveway. ~he thinks this is absolutely u~-
called for and~does not think her neighbor should have to use
her driveway.
Mr. Dan O'Brien, Agent for Bo~za Sirloin Pit, appeared be-
feretthe Council. Mr. DeMarco referred to ~. O'Brien going
to try to o~tain permission to use the driveway and ~. O'Brien
replied that the owner of Boynton Beach Mall is in the aud-
ience an~ he believes he ~ against it. Mrs. Jackson stated
she thought it was wremg for somebody te have to use somebody
else's driveway and Mr. DeMarco agreed.
Mr. Robert Kipp appeared before .the Council and stated even
if he fe~t it was ~ll right, he ms not legally able to do
this. He has leases wit~ w~nm-Dixie and Eckerd with cove-
nants which absolutely prohibit a~y access to amy other pro-
perty. They were aware that. he owned this property and was
in the process ef selling it. He would have to go to Winn-
Dixie to get approval. He is not able to give approval ~o
allow them to ~se the entrance and create extra traffic, etc,
Mr. DeMarco asked what the alternate piam would ~e and Mr.
Kipp replied that he did not think the Coumty was going
object to the curb cut on Gulfstream Bl~d.
Mrs. Jmck~on referred to there being a little hedge between
the parking lot ~nd Bonanza and asked if there could ~e a
driveway along that hedge and Mr. Annunziato replied that it
could be where it is proposed, but the argument is that
there would be no access into the parking lot. The plan did
show access to the parking lot to the north and they believed
this was indication of an agreement with Wins-Dixie. They
alway~ recommend elimination of curb cu~s where possible.
This request was reasonable.. There is a driveway not 90 ft.
west of the proposed ~riveway.. Arrangements could be made
to increase the width of the driveway to 30 ~t. and provide
access to this site from the west. This is not an unusual
arrangement andooccmrs time and agaim im shopping centers
with restaurants. From a safety viewpoint, this recommenda-
tion makes good sense. If it can't be dome, it should be
shown that it canmot be done. They should jo~ driveways
and share curb cuts if possible~ This si~e plan would fit
that type of descriptien~. Mrs. Jackson disagreed. Mr.
O'~rien added that they must also consider maintenance,
insurance, etc.

and approximately 3630 feet on the main Boynton Canal. Mr.
Fronrath is offering this parcel at $5,000 per acre. There
is also a map available of this area for your review. May I

Mr. DeMarco stated he was familiar with this tract of land
and realizes it is not in the area of Boynton Beach proper
right now, hut would li~e to see some group make a study and

as a motion. Under discussion, Mayor Zack asked if this
property could beheld and Mr. DeMarco replied that i~ the
interest of being civic minded, he thinks they may contact
them. He noted that Mr. Frenrath was present and called on
him.
Mr. Charles Fronrath stated his name and his address as 2424
North Federal Highway. He informed the Coancil that this
property i~ 360 acres lying one mile west of Military Trail
oa Boynton Road with 4000 feet on West Boynton Road and
3630 feet on the main Boymton Canal. The property is owned
by Mr. Melear who just took the property back after selling
it about five years ago, He is willing to sell it for what
is outstanding on the mortgage. Ne explained the advantages
of the land. Developers have beem i~terest~, but Mr~ Metear
wanted to offer it to the Cit~. In reference to holding the
property, they would have to discuss this with Mr. Melear
and see what he would agree to. He k~ows he won't ~it back
and wait a period of time.
Mr~ Caldwell asked if a recent engineering survey had bee~
done as to the quality of the land and Mr. DeMarco informed
him that it is 18 ft. above sea level and has good drainage.
Mr. Caldwell referred to this being located out of the re-
serve area and Mr. Fronrath agreed it was ½ mile west of the
reserve area. N~. Moore informed them that the ~ity is
authorized to buy park property outside of the reserve areas
and they coul~ consider taking tax free m~taicipal bonds. M~o
Fronrath adde~ that he thought they could possibly work some-
thing out if the City has interest. Mr. DeMarce stated he
would like to serve on a committee to make the study.

Consider Request for Temporary Trailer - Applicant: Mr.
.~mos Hudson
Mr. Kohl referred to correspondence from Mr. Amos Hudson of
Semp~ll,s Realty, Inc., requesting a temporary permit for a
trailer for a period of one year, to be used as temporary
quarters for a real estate office. He referred to Section
30-3, page 408 of the "black book" where it is indicated that
Coumcil mu~t make the decision on this request. Zoning does
allow the use of a trailer at the location indicated dm his
letter.
Mr. DeMarco quemtioned the object of the trailer and Mayor
Zack informed him it was to be used for a real estate office.
~. DeMarco asked if Mr. Hudson was planning on building and
Mr. Howell clarified that the zoning allows the use of this
business, but a trailer is not a permitted use in this area.
Mr. Hudson moved i~to the trailer before apply~_ng for his
license. It is his understanding that Mr. Hudson is going
to buy the building adjacent to the trailer and is going to
make it into a real estate office. Mrs. Jackson stated that
this was originally Amos Hudson's Tr~%'ler Sales and Mr. Howell
informed her that no permit was issued on the trailer. F~yer
Zack added that he did not think there was anything in the
ordinance against it and N~. DeMarco stated he recommended it.
Mr. Howell stated he agreed i~u this case for one year.

the Environmental Protection Agency's additional offer of in-
crease of $~,628. dated Ms, ch 28, ~977 to E.P.A.~ Project No.
C-120406010 which includes cost to cover the solids phase of
the regional treatment pla~tand ratify the execution of the
acceptance forms by the ChiefE~xecutive Officer of the South

Mr. Kohl stated that the bills described have been approved
and verified by the department heads involved; checked and
approved for payment by the Finance Department; funds are

Mayor Zack referred to No. 11 and asked if these were the
Chamber of Commerce maps and Mr. Kohl replied: yes.
Mr. Caldwell asked what Item No. 15 entailed and M~. Kohl
informed him that they have beem paying this for approxi-
mately two years at the orders of Council subject to the
Community Relations Board approving it. They have had trou-
ble on the Community R&lations Board ~ecause they have not
been able to get the Board together. Mr. Caldwell asked if
this was ~or working parents amd Mr. Kohl replied: yes. Mr.
De~rco asked if it was for both white and blackcand Mr.

asked if they were still in operation, if the Councilwanted
him to pay this bill? Mayor Zack clarified that the ques-
tion was whether they were or were not eperatimg. He asked
if this money was contributed, would they operate u~til June
17 Mrs. JaCkson stated she was going to vote no because there
is a State law stating you cannot use your tax money for a
small segment of the population. Mr. Moore stated he sub-
mitted resumes to the ~ou~cil regarding a serious question
in the law whether expenditures for charitable purposes are
for public purposes. Mr. DeMarco remarked that they have
donated before.
Mr. Caldwell asked if they were going to renege on this
group if they are still in operation and if $8,721 is going
to get them through to June? He thinks they should let them
keep their doors open as long as possible.
Mr. Catdwell then made a motion to pay the amount o£ $8,721.
Mr. DeMarco asked if he was going to request to check to see
if they are still in operation and Mr. Caldwell replied that
the answer may be if they don't get it, they will close and
if they do, they will stay open until June 1. Also, they
are negotiating with the County. Mrs. Jackson added that
they also get money from the Delray Beach Parade and pledges
have beem made, but they don't know if they were received.
Mr. Caldwell explained how it was theirrresponsibitity and
their kids were involved. Mr. DeMarco stated they agreed
to give the money, but if they are not operating, why throwg
away the money? They should check whether they are going
to continue. Mr. Caldwell agreed and requested that his
motion be amended mud clarified that if the $8,721 would
keep them open, Mr. Kohl will contact them and make the
payment. ~. DeMarco stated that he wanted to know the
status . Mr. Caldwell asked if he meant prior to approval
and Mr. DeMarco replied: yes. M~. Caldwell clarified that if
i£ will keep them in operation to June 1, we should pay,
but if they are going to be closed regardless whether they
receive our money, then we shouldn,t pay. Mr. DeMarco_

this would eventually be a saving to the City and Mr. Kohl

Ball Fields
Mr. DeMarco told about attending the opening of the Little
League 8_ud how he was told it was a beautiful place, bu~
was asked how they could have 30 teams practice in the two
ball fields. He is wondering if there is some way or some-
how they can makessome sand lot ball fields, just practice
areas. He thi~ they are fortunate to have 30 teams with
450 boys. Traiming the boys is important. Also, many people
attended. The City dogs own 20 acres on Old Boynton Road,
which was for the F%re Department, and could possibly make
two or three ball fields there. There is also the 55 acres
with the Coumty and 20 acres at Charter World. He does not
mean they should spend a large amount of money, ~ut should
have some practice fields. Mayor Sack suggested having the
City Manager look into this.
Mrs. Jackson asked about the area at the pistol range and
Mayor Zack replied that the City Attorney is working on an
agreemsnt for that. He explaf-ed that the recommendation

would pro~ably be a request for the City to enclose the out-
side roof and floor and the re~t would be left up to the
Police Department. There is a terrific layout for a park
there. Mr. Kohl added there was a layout for a practice
field there.
Mrs. Jackson asked if it was possible to use the school
playgrounds and Mr. Kohl informed her he had just written
to the County Commission to take over the ball field on
2nd Avenue. Also, there are acres and acres north of the
Galaxy School, which could be u~ed for four ball parks.
Mayor, Zaok suggested that they request the ~all field on
2nd Avenue be donated to the City to make a respectable
looking Dlaceo Mr. Caldwell added ~hat there were also two
ball fields behind Congress Middle School. Mr. DeNarco
asked if these could be ~sed and Mr. Kohl replied that he
~ould t~y to obtaim permission. Nayor Zack requested the
ity Manager to look into these s~ggestiona.

Mr. Caldwell an-ounced that he would not he able to attend
the next City Council meeting as he will be in Hartford,
Connecticut, on ~usiness.

Prisoner Detention
Dear Sir:
Attached hereto is an Agreement Proposal from the County for
detention of our Municipal prisoners. This is the standard agree-
ment for the entire Palm Beach County, calIing for a ten ($10.00)
dollar per day charge.
Upon comprehensive study of the Agreement by my Staff as well
as myself, I have found the Agreement very acceptable to my Depart-
ment. I could not meet the cost by housing Municipal prisoners in
our Municipal Jail. The travel time for our Officers alone would
surpass the $10.00 daily cost.
I would recommend the City ~nter into Agreement with the Palm
Beach County Sheriff's Office to incarcerate our Municipal prisoners.

On Wednesday, March R I spo~e to the City Attorney con-
cerning the above mentioned parcel of land. In our agreement
with Charter World, Parcel 22 was to be developed for hotel
or motel use only. Subsequently, th~s parcel was zoned C-3
to permit this use.
I have no objection to removing this restriction on the
land use, but I recommend that the developer be made to com-
ply w~h.sitelplanapproval procedures before we remove the
restrictions on the land. This will give the City the ability
to determine if the proposed'land use is acceptable.
