~yor DeLo~g called the meet~ug to order at 9:00 A. M. and
announced it was a called special meeting by the Mayor in
accordance with Section 56 of the City Charter of the City
of Boynton Beach to consider the following:
1. Comments and/or suggestions relative to the
adoption Of the proposed City budget for the
fiscal year 76s77 as submitted by the City
Manager in his capacity as Budget Officer.
2. Disposition of proposed agreement with Delray
Beach relative to supervision of construction
of new wastewater treatment regional plant.
3. Any other City business that may rightfully
come before the City Council.
Discussion of Proposed City Budget
Mayor DeLong announced they would deviate from the usual wej
these budget sessions have been handled in the past. He re-
ferred to listening to the recording of the sessions last
year and the impression he received. He will call on the
City ~.nager to present his reasons for arriving at the pro-
posed budget and he will then call on each individual Counc il
me~osr in alphabetical order for any comments or recommenda-
tions.
Mr. Kohl referred to a copy of the certification of millage
and taxable value from Mr. Reid. After .Mr. He~mening ~d M~.
Strnad advis~d~, that they did not have a copy, he obtained
one for each and proceeded. He referred to Item ~7 regarding
the comparison for tax millage for last year ~ud this year
and N~. Reid's certification that they can go to 7.58 not
including the sinking fund. ~yor DeLong clarified that he
was recommending a tax rate of 7.58. In last year's budget,
the ~ax millage was pegged at 7.6 and this year it?has been
reduced to 7.4. It will beiless than I/5 of a mill increase.
Had it not been reduced last year~ there would have been no
necessity to increase it this year. Mm. Kohl explained how
they had tried to reach the millage set by the tax appraiser.
Mayor DeLong then called on Mr. Harmening for his comments.
Mr. Harmening referred to Page 17 showing quite a little
jump, not counting other hidden jumps, in the attorney's

budget. He noted it was going from $26,250 and estimated
$27,500 in 1976 to $40,000. In addition, the City Attorney
has requested an increase in some of his other compensations.
They have not been paying for bond validations in the recent
past. Also, fees for special and unusual services. It is
difficult to anticipate the cost of this, In the past, they
have had a fixed fee. Mayor DeLong referred to having figures
which the City actually ps~d for attorney,s fees and Mr. Kohl
replied that he gave these to the Finance Director to check
with other cities and suggested coming back to this. Mayor
DeLong suggested going over this and referred to having a
backlog created in the past. They were paying legal fees
and getting nowhere. He asked ~fr. Kohl's opinion of ~.
Reed,s legal performances of duties and ¥~. Kohl replied
that he did e~joy working with Mr. Simon, but Mr. Ree~ has
given him answers immediately for everything he has asked
for. He has a direct line i~to his office. He realizes
Mr. Reed is working on m~uy things for the City, but they
~et immediate service on everything. M~. Reed is doing a
fine job. ~{ayor DeLong questioned if the amount of funds
was worth the service considering money they have paid for
past performances and Mr. Kohl replied: yes and explained
how they now had two attorneys work~ing on projects. He
also explained how they have quite a bit more work now. He
feels the firm of ~eed & Smodish is doing a tremendous job.
~yor DeLong requested that he supply the Council with the
costs since ~ 973 an~ compare costs with other municipalities.
~L~. Harmening continued and referred to Page 7 and court
clerk being listed. He thought they were going to phase
this out. He realizes they still have three months, but it
seems $2t,387 is quite a bit of money when considering for
the whole yee~ of 1976~ they spent $32,188o ¥~. Kohl re-
plied that they did keep the three salaries in there. These
salaries have to be carrie8 on further dur~ag the year.
The bailiff has been reduced because he is part time; how-
e~er, the other two positions will be carried forward.
~ayor DeLong clarified that he believed they had the right
of protection under Civil Service and M~. Kohl agreed.
!ir. Harmening then referred to the increase in the Building
]~aintenance Department. He realizes there is ~uite a bit of
work, but questioned increasing it by $18,000 {his year.
}ir. Kohl informe~ him they were transferring one part time
person from Recreation to Building Mainten~mce and they are
trying to get every person under Building ~intenance. Also,
the beach custodian was transferred to Building Maintenance.
It has grown and he has advocated this. He referred to the
different projects in the City taken care of by these people.
They are saving money, t~~. H~mening agreed that some of the
maintenance of City buildings was probably better than it
used to be, but it seems like they a_~e spending a lot of money.

Mayor DeLong added that this department has grown the same as
other departments and the City has expanded. ~. Harmening
replied that he supposed it depended on whether all these pro-
jects are necessary and worthwhile. When they increase the
size of a department, they must look for something for them
to do and he referred to the panelling in the Council Chambers~
If they didn,t have such a large department and spend so much
money, he doesn't think it would be necessary. ~ayor DeLong
explained how he thought they were moving forward. M~. Zack
questioned whether all the men were necessary in this depart-
ment and M~. Kohl replied that theywe~for all the projects
they are doing right now. Mayor DeLong agreed with the City
Manager,s recommendation in this field and referred to his
being aware of the requirements.
M~. H~mening then asked how many major improvements were
contemplated this year other than the routine ~intenance
and M~. Kohl replied that he did not have the information
with him and Mayor DeLong added that it was a continuous
procedure. He referred to certain public facilities s~d
how this applied and Mr. Harmening agreed, but stated he was
trying to differentiate between routine mainten~ace versus
entirely new remodeling jobs. ~. Kohl informed him that he
would get a few of these jobs for hLm before the morning was
over. ~. Har~aening stated that the reason he asked these
questions is because they did a ~ew Jobs similar to this
which people viewed with mixedemotions ~ad he would like to
know if they are~contemplating more to justify the increase
in the budget or if the existing buildings require so much
additional~mainten~uce. ~r. Kohl referred to page 11 ~_ud
the esti~ated expenditures being about the s~e. He pointed
out that building repairs were also about the same. He
stated that there were a lot of things they don't know what
is going ~o happen ~ud he gave the example of a roof leaking.
They try to put enough money in.to keep Eoing on all the
jobs they are going to do.
~. Harmening referred to Page 20, City Clerk. He referred
to most of the departments having an increase and having
spent $~O9,O00 and are now proposing to drop to $86,000~in
this department. He asked if they were going to be able to
operate adequately with this decrease a~d M~. Kohl informed
him that last year, the receptionist was in the.City Clerk's
office and is now in the City M~nager,s office. There is an
increase in his office because of this being included. Also,
the Deputy City Clerk is no longer doing occupational licenses
and must replace someone. There is one girl retiring and he
believes she should take her place, but it is up to the City
Clerk. ~. Harmening referred to the transfer of the recep-
tionist and questioned if administration could replace her
during lunch breaks, vacation, etc. and M_~. Kohl informed
him that he has asked the City Clerk to back her uo for lunch

or break, but they have hired a part time girl to replace her
while she is on vacation, so they would not have to take a
girl out of the City Clerk's office. ~. Harmenir~ question-
ed if these positions reflected $22,000and ~. Kohl replied:
$20,000 plus. Mrs. Padgett asked how many girls she had left
and ~. Kohl replied that he did not think she should ask that
now as no other Department Heads are present and they can
ts~k about this later. F~$. Padgett remarked that she had
not seen the budget and ~yor DeLong ruled her out of order
and requested her to discuss these affairs with ~. Kohl.
R~. Harmening asked if the rest of the Department Heads had
a copy of the final budget ~ud M~. Kohl replied that none
did, no copies have been distributed to any person.
R~. Ha~mening proceeded to Page 24, Finance Department. He
referred to hiring more people here with reference to the
personnel services increase ~ud ~. Kohl replied that he had
not taken any out of another department. R~. Harmening re-
ferred to an increase from $103,000 to $111,000 and ~. Kohl
explained how this covered increases in wages. Also, he did
take one person out of Finance. ~. Harmening clarified that
it was just salary increases and Mr. Kohl agreed.
~. Harmening referred to the City Planner and stated that
when they add a new department, there are quite a few addi-
tional costs in addition to salary and space. ~yor DeLong
agreed that he would probably get busier and need a clerk.
~. Kohl informed them that he had placed CB girls in the
budget and uses them wherever they need them in the City.
He will give the City Planner part time help.
~. Harmening referred to Page 38, Parks Department, and
noted a largos increase. He referred to the department pro-
posing a major increase an.d noted that ~. Kohl had ~-muocked
it down somewhat. ~Ar. Kohl referred to the number of parks
and projects in the City and also the CET~& program. M~.
Harmening replied that he realized this and he likes to hire
~ETA people, but when they hire four and the program stops,
they have to create new positions for them.
~. Harmening referred to Page 39 ~d four maintenance men I
and asked if these were new positions replacing CETA people
and ~wh~. Kohl replied that it was zero, as he has knocked
this out. He added that he couldn't describe the new parks
and places they have to t~e care of ~d M~. Harmening agreed
they have increased the park facilities considerably.
~s. Jackson requested to comment at this time ~nd Mayor
DeLong informed her that they would go alphabetically. M~s.
Jackson stated she preferred to go through it from beginning

to end iD~tead of jumping all around. Mayor DeLong informed
her that they were not going to jump around, but he wanted to
get each member,s feelings and comments.
M~. Harmening continued with referring to Page 42, Equipment
Maintenance, and a large increase of $22,000 in personnel
services. Mr. Kohl pointed out that there were no new posi-
tionso All it covers are promotions and increases in salar-
ies. ~. Harmening referred to having seven people and ques-
tioned the $22,000 increase and M~. Kohl read the exact fig-
ures given on Page 43. Also, he did add one person.
~. Harmening referred to Sanitation and there being three
new positions and M~. Kohl informed him that he knocked these
out. He has told them that they can get by without it.
~. Harmening questioned the containers listed on Page 48
and ~. Kohl informed him these are the large containers for
the dumpsters. They seem to need more this year. He ex-
plained how they did try to weld them.
~. Harmening referred to the Streets Department on Page 50
and noted another increase in personnel services. He ques-
tioned if all this increase was just wage and Mr. Kohl re-
plied that it was wage and overtime.
M~. Harmening referred to street liEhting listed on Page 50
and questioned if the pri~.~nry cost was for energy? He does
not ~hir~k electricity has gone up and he doesn,t know of any
proposed increases. He noted it increased from $118,O00 to
$129,000. Mr. ~ohl informed him that he has received a tre-
mendous amount of requests for new lights.
~. Harmening referred to Page 5t, Street Improvements, and
M~. Kohl explained how he was trying to upgrade the equip-
ment. ~. Harmening clarified that he was proposing to take
care of the streets, ~hich in the past have been taken care
of by contract and ~'~. Kohl agreed. Mayer DeLong added that
in the past, they had a Street Department, but no equipment
and explained how they must have equipment for this depart-
ment to work. P~ Harmening agreed. ~. Kohl told about
their good experience with using the box spreader.
Harmening agreed that the City has been a little backwards
in the Street Department, but stressed that they must deve-
lop capacity and supervision to do their own work. They
~st continue~ doing the jobs and ~. Kohl referred to doing
a good Job on the alley behind the appliance store on 2nd
Avenue. ~yor DeLong added that they do have a man now who
has the ability and can supervise that department~ t ' and this
melees ~ difference. Mr. ~ohl told about the City doing the
driveway at the~-o~_± park and Mr. Harmening replied that if
this works out, he thinks it will be money well spen~.

However, in light of past experiences, he has to reserve his
judgement on how well this department will function. Mayor
DeLong replied that he should be proud of the fact that he has
been part of an administration which'.has upgraded and updated
since they have sat on the City Council. It is a positive
fact in walking around the City.
Mr. Harmening continued with giving no comments on the Police
Department. He then referred to doing most of the talking
and Mayor DeLong replied that everyone would be given time
to give comments or suggestions and he thinks this method
will expedite the business of the City.
M~. Harmening referred to Page 58, Fire Department, and noted
quite a cut in personnel from the Department,s recommendations.
M~. Kohl has changed eight new fire fighters to two. ~.
Kohl replied that he thought they could get by with that
and give adequate covsrage to the City. He has cut where he
thought it was necessary.
~. Harmening referred to Page 65, Building Department, and
questioned if the number of personnel was adequate or more
than adequate for the amount of building projected for the
ne~t fiscal year? M~. Kohl informed him that they did ask
for additional personnel which he knocked out also. They
should be able to do the job they have been doing and much
better.
~. Harmening referred to Page 65 and questioned whether
they had a Deputy Building Official and Mr. Kohl replied:
no, but they were trying to keeo that salary in there.
He explained how they were goin~ to put more work on the
people in this department and have kept the salary to cover
the work. M~. Harmsning asked if he was planning to promote
~-uyone and ~. Kohl re~i_ed, no and explained how they were
trying to have a man there to check the plans. M~. Harmening
referred to previous problems with plans passing in this
department and stated he thought they should tighten that.
M~. Kohl agreed.
~. Harmening referred to Page 68 and the transfer of licenses
from one department to another and the personnel services
going from $13,000 to $21,000. Mayor DeLong replied * ~

License Inspector is Mel Craig and Callie Clanton is being
paid and now is mn this budget. ~
~. Harmening asked if it
came out of the City Clerk's department and ~. Kohl replied:
yes and the salary is lower by about $4,000.
~. Harmening stated his only comment on the Recreation
Department is they certainly should have the finest Recrea-
tion Department in Palm Beach County with the amount of
money they spend. M~. Kohl pointed out that he did cut down

there and doesn,t believe they should have everything under
the sun. Mayor DeLong added that he believed in the past,
the Recreation Department was given as much consideration
as they could.
~. Harmening referred to Page 77 and questioned what tennis
courts were scheduled to be resurfaced and Mr. Kohl read the

would be resurfaced and the two new courts required color

Mr. Harmening then questioned Pence Park ball Field lighting
in the amount of $13,000 and Mr. Kohl replied that this field
receives heavier and more intensive use than any in the m~y.

remarked that their budget was almost double from what it

times larger. Y~. Kohl added that he thought they would have
to agree that the Library is a very fine institution. He
added that in the old building, they did not have the amount
of pers~onnel, but with the new building, there are more jobs
to be aone. M~r. Harmening stated he was just wondering
whether they were getting the maximum output from the amount
of Personnel employed and Mr. Kohl referred to knocking this
down. M~Jor DeLong added that he visits there at least once
a week and always sees the personnel busy in the back room.
~. Kohl added that they have also added children,s programs.
~. Harmening stated that he has always been a supporter of
the library, but questions whether or not they get the ,same
amount of work out of the people they D~ve employed.
~r. Harmening referred to Page 83, and noved tha~ the fixed
charges for the pension reserve certainly had jumped, ge
questioned the reason for Line 40 going over ~00% and Mr.
Kohl explained how the pension reserve was at one time under-
funded. Mr. Ha_men~ng then questioned the insurance reserve
and M~. Kohl informed him that he did talk to Men about this
and '~vill give him an answer, ge added that they must have so
much money in the insurance reserve.
~. Harmening referred to Page 84 and there being a whole new
section for the computer, ge sees it is expensive, but they
are taking it out of other places. This will cost about
$34,000 Der year for the rental and then add $52,000 and it
costs ~8~,000 to $87,000. How many people have they replaced
with this and M~. Kohl replied that they will replace two.

Mr. Earmening rema_~ked that they were oretty expensive people

trying to do things more efficiently and correctly.
Harmening referred to the amount of erro~ made by a computer
and pointed out that it was no better than the people who
operate it. A computer defini~tel.y has its place, hut he
questions it in smaller installatmons and Perhaps this one
is just a selling job. He thinks they did-just as well when
they had people and did it with less money. ~. Kohl explained
how they would be doing a lot oft~amngs' with this 'computer.

~. Harmening referred to Page 102, Utility ~ater Treatment
Plant~ and questioned Mr. Cessna's justification for hiring
a new mechanic and F~. KohZ informed him they were trying to
do the things they should be doing and are trying to make it
one of the finest. Mr. Harmening questioned the job descrip-
tion for this man and Mr. Eohl replier that there would be a
job description and he will be repairing pumps, etc. There
is a lot of work he can do himself rather then calling some-

o~y. M~. Harmening stated that unless they get a good man,
who knows what he is doing, he can create more havoc than
good. He referred to the water plant being fully operational
to a large extent. Mr. EohZ informed him they send the men
out to different plants to do maintenance work and ~. Cessna
thinks a mechanic isa necessary thing and the water pl~Lut is
tremendous. Yr. Harmening referred to so much of the con-
trolled equipment being difficult to repair and he feels they
may be creating problems with the hiring of this man. Mayor
DeLong stated he thonght this should be considered by the
Department Head. He suggested that he discusss~his with
~. Cessna and get a copy o~ the job description. ~.
Eohl referred to also ha~ing work with the wells. Mr.
Har~ening replied that he could not vismalime enough work.

~rs. Jack, on explained how budgets had dif£erent meanings to
differsn~ people. Mayor DeLo~g replied that he thinks she
would have to admit it was foolhardy to reduce the ~llage
I/5 mill. They were not permitted any cushion whatsoever.

Mayor DeLong continued with referring to the City expanding
with increases in commodities, increments, cost Of living,
etc. If they increase this millage less than 1/5 mill, he
thinks it is tremendous. When ~. Harmening and himself
came aboard in ~973, the ~illagewas 8.6. ~oday w~th al~
the improvements, etc., they ~e still under 7.6. They are
still recommending a millage rate of what is below what it
was one year ago and the pe;ople responsible should be com-
mended. ~rs. Jackson replied that she did not intend to be
talking about last yea?s budget.
~s. Jac~on then referred to Page 4 and questioned the
allowance for promotion. She added that she did not see
any need for an administrative aid~. She asked if this was
an increment?and what was the difference in the job classi-
fication? ~. Kohl r~plied that this was aoproximateiy the
same thing, but they try to award people do~g a much better
job. ~ ~

Department. ~s. Jackson remarked that they always hope to
get into this, but it has never been done and ~. Kohl re-
plied that they hope to get into more m~cro-filmin

his job, he.is worth the increase. ~s. Jackson questioned
the percentage of the raise ~ud Mr. Harmening replied it was
about ~2%. ~myor DeLong stated it was easy enough to con-
demn something if you want to figure it by percentage, but
they must consider what the job actually pays and what it is
worth. The percentaEe could be way off. This probably
should have been adjusted way before now. To figure percent-
age wise, they should use the reverse and say the man was re-
ceiving 12% less when he went to work. ~s. Ja6kson stated
that she thought ~r. Kohl ~e~ked~ the City Department Heads
on percentage. ~. Zack referred to his experience in the
past and when you hire the head of a City like this, you do
not consider percentage. Also, when a man is responsible for
this amount of people, he should get more than department
heads with less. Mrs. Padgett then took a roll call vote on
the motion as follows:

~. Zack continued that he was still concerned about travel
expenses for these people and questioned what these people
did for travel expenses? Mrs. Jackson remarked that they
are not suD~osed to be paying to go from and to work. ~.
Zack referred to the monthly amount allowed for the Recrea-
tion Director and Engineer and asked if it was possible to
have a little pickuo~ truck for them.' ~ Mayor DeLong asked
what was his recommendation and ~r. Zack replied that he was
asking the City Manager ~at could be done to cut ~ ~

ME. Zack then referred to the cost for the computer and ex-
plained how the initial cost was terrific and compared it to
a ca.r~ The computer should have a greater outout and ~.
Kohl agreed. Mr. Zack continued that definiteiy the com-
puter is a time saver. He also feels every new job they plan
there should have a job d '
escr!ption.
i~. Zack referred to the Administrative Aideand explained how
he agreed it was necessary. From his own experience, he be-
lieves in an Administrative Aidaand microfilm.
~s. Jackson attempted to add something, but Mayor DeLong
advised that she had her tmrn. There was some discussion
about their right to speak and Mayor DeLong stated he ,would
not cutoff anyone and referred to the time clock M~s. Jackson
previously used.
~yor DeLong stated that he thinks the budget is a splendid
budget. He referred to the condition of the times and only
increasing the millage by 1/5 mill e=ud still covering incre-
ments and cost of living increases. This is a tremendous
job. He b~l_eves time was spent on this that proved to be
valuable, To dondemn it~is irresponsible. He referred to
the improvements made in the City during the past three
years and how it was fantastic to still be under what the
millage was three years ago. He does not think ithhas been
equalled. He ~uounced a motion was in order to ~dept the
proposed budget.
~. Zack stated he wanted to commend the City Manager for
keeping the ta~ figure down and cutting costs. He has had
experience and has checked this budget t ~ '
horougnly.
Mr. Zack made a motion to accept the proposed budget as sub-
mitred by the City Manager, seconded by M~. Strnad. Under

stated that he thinks this year has been a good year as fs~
as the City Attorney. They have not had the frustrations
an~ waiting period like previously. He thinks any increase
in salary going to the two attorneys is well deserved.
M~yor DeLong agreed that they have two o tstanalng, sha~,~,
and very competent attorneys and have the se~¢ices of both.
They have performed well and have attemo%ed to do their best
to eliminate the existing backlog since-t973o To get two
attorneys of this type for the small amount of money they are
paying is money well spent. M~s. Padgett then took a roll

.~iscussion of t~oposed Agreement with Delr~y Beach
Mayor DeLong stated that he feels as though they have given
Delray Beach every opportunity to come up with something to
consider Boynton Beach as a partner in the management of
the regional plant, but evidently they cannot see it that way
and are thinking in terms of what they originally wanted.
He then requested comments from the Council members.
~. Zack stated he thought they should stick to Section 10
of the Interlocal Agreement. Delray Beach injected some
things in Section 4, but he thinks they should sticktto
Section 10.
I~yor DeLong stated that when they filed the joint applica-
tion, it was understood it was joint management and joint
ownership. They are joint owners, but Delray Beach is trying
to avoid joint management. The only ws~ to be recognized is
through the C.E.O. of the Board. He then requested the mem-
bers to ~' ~ '
con~nue~w~th their commen~s.
~. Strnad stated that there seemed to be some dispute between
the attorneys as to how this sewer plant is supposed to be
set up. He questioned if it was possible to get an inter~ure-
tation fromm.~these two attorneys and ~yor DeLong remarked that
when you get more th~u one attorney, you will hays problen~.
Mayor DeLong asked if the Council was united in the fact that
they are going to demand recognition as joint managers. They
are in there as a joint manager. They must put this point
over. They must recognize the City of Boynton Beach as being
involved in joint management. He thinks they must demand it.
M~. Strnad agreed that everything must be 50-50.
P~s. Jackson stated with a time delay, they were not going
to be hurt and explained how they were in the~r~ver,s' seat.
Boynton Beach is set~ but Delray Beach has a moratorium.
They must state they are not going to give in. They must
stick to the Interlocal Agreement. They must say this is it.

l~yor DeLong announced a motion was in order to notify the
City of Delray Beach that the City Council of Boynton Beach
in special session agreed that unless Delray Beach comes up
with an agreement specifically stating the City of Boynton
~each_is, a joint manager~ they will not ac~e~*
~ o~acn suggesting a workshop
within ten days with the three attorneys. 5~. Harmening
stated that this i~ no way changes his feeling and referred
to there being a certain considerable amount of ambiguities
in the Interlocal Agreement which was probably agreed upon
to get the ball rolling. They probably knew eventnatly this
would have to be settled. It has always been his intention
that the City of Boynton Beach is an equal partner. Ee does
not think Delray Beach deserves the additional edge. Ee
explained that avert though Delr~j Beach had made it known
they wanted to go it alone, it did not have any bearing what-
soever. Mayor DeLong added that they signed the agreement
and Federal funds are involved and Boynton Beach has every
right to seek recourse from E.P.A. Mrs. Jack. on referred to
a csnversation sheooverheard ~u that ~r. Mariott did not
agree ~d she third~ they should stand fast. Mayor DeLong
requested the City ~ager to notify the Board of these pro-
cee~ings. M~. Harmening added that probably whenever they
do reach an agreement, they should incorporate an amendment
into the Interlocal Agreement and M~or DeLong a~reed that
this should be one of the f~st orders of bus~ne~s. Mrs.
