R94-~/ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT BETWEEN THE CITY OF BOYNTON BEACH AND DLW PRODUCTIONS, INC.; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Boynton Beach, Florida has previously considered and authorized videotaping of its Police and Fire Departments by DLW Productions, Inc., and WHEREAS, said Agreement between the parties has now been reduced to Writing; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF'BOYNTON BEACH, FLORIDA, THAT: Section 1. DLW Productions, Inc., voluntarily and knowingly executes this release with the express intention of eliminating any liabilities on behalf of the City of Boyntou Beach that may arise during the production of the television series referred to as "Under Fire: South Florida's 911." 2. DLW Productions, Inc. shall have authorization to videotape the City of Boynton Beach's police and fire departments. 3. Further. DLW Productions, Inc., in consideration ofTen Dollars ($10.00), receipt of which is hereby acknowledged, agrees to release, defend, indemnify, and hold the City of Boynton Beach and its employees harmless for any suits or claims arising from injuries, both mental and physical, including death, that may be sustained by the production crew or anyone employed by DLW Productions, Inc., including its agents, contractors, and subcontractors, during the videotaping of"Under Fire: South Florida's 911" or any person claiming damage or injury as the result to the airing, of the production. It is further understood that this agreement applies to any heirs (including spouses), legal representatives or successors. 4. In addition, the City of Boynton Beach is hereby released from liability for any damage sustained to any equlpment ownad or leased by DLW Productions, Inc.,its employees or agents which is used in the production of "Under Fire: South Florida's 91 ].." 5. It is understood by all parties executing thi~ agreement that all videotaped material will be held by DLW Productions, Inc. and will be used solely for the production of the "Under Fire: South Florida's 911" television series. 6. As a courtesy to the City of Boynton Beach, DLW Productions, Inc. agrees to allow a representative of the department to review the final production prior to airing. Production material aired over the written objection shall constitute grounds for revocation of the consent to videotape hereby granted by the City of Boynton Beach to DLW Productions, Inc. '7. This Agreement constitutes the full and complete understanding between the pax'des hereto, and nO other oral representations have been made. No modifications or change to this Agreement shall be valid or binding upon the parties unless in writing executed by the parties to be bound thereby. 8. The City of Boyntou Beach by executing this document in no way intends expressly or implicitly to consent to videotaping on behalf of any third party. 9. During the filming and production, DLW Productions, Ine. shall malntain at its own expense public liability insurance coverage in the minimum amount of one million dollars single limit per occurrence and auto liability coverage in the amount of one hundred thousand per occurrence. The public liability insurance policy shall name the City of Boynton Beach as additional insured which shall be evidenced by the providing ora ceatificate ofinsurunce to the City of Boynton Beach. DLW Productions, Inc. 754 -4953 History of Under Fire: South Florida's 911 Last year, while pursuing a BA degree in communications at Florida Atlantic University and working as a production assistant at WPBF Channel 25, I submitted a query letter to a local magazine to write an article about the paramedic- police officers on the Palm Beach County Sheriff's Office Special Response Team. The article was accepted and published (a copy is attached). I then submitted a query to the Police Times and Chief of Police magazines proposing an article I wished to write to their police readership. This article would require extensive, long -term research - - which it did [six months from initiation to completion]. The article was approximately 3,500 words in length and was accepted for publication (in its entirety) by the American Federation of Police. During one of the training sessions (while conducting my research, interviews, etc.) members of the SRT were discussing a recent documentary they had seen on the Miami team a few evenings earlier. I told them that broadcast journalism was my field of study and that my goal was to work in the field of television producing /directing. With the article I was just completing, I already had a natural script to draw from. I was given the go ahead and DLW Productions, Inc. was formed - November 30, `93. I then began contracting within the community various people (with the , appropriate backgrounds) to work on this production. I soon discovered I had begun something that required a full -time commitment on my part and a monetary investment (insurance requirements, legal & accounting fees, licenses, taxes, etc.). Since I had already made the commitment to myself to work in the television/motion - picture industry I decided - - - as they say "no time like the present" and committed to a 13 week television series that would be broadcast on WTVX Channel 34 - Under Fire: South Florida's 911. Under Fire would introduce the viewers to the cities and agencies that serve them. In addition, it would include missing children alerts provided by the Adam Walsh Center and Voice of the Children Foundation. Further, fugitive alerts (provided by Crime Stoppers) would be included as bumpers preceding each break. These alerts are included in the show as PSA's and are produced and aired at no charge to the centers. Since airing began, February 13th, I have received many phone calls ... all of them favorable and supportive of my efforts. It's my sincere desire that everyone involved benefits from this project and the people within the viewing area will not only be entertained, but will be somewhat enlightened about their community in a positive way. It is not DLW Production's intention to interfere in any way with the responsibilities of public service personnel, or to intrude in the lives of the people within the communities they serve. Every possible consideration is given to each situation on an individual basis. Attached are copies of various articles regarding myself and Under Fire. Under Fire's BUDGET for 13 week series broadcast on WTVX 34 Under Fire is an independent production by DLW Productions, Inc. and its sole revenue is generated by sponsorship and advertisements for Under Fire. While at the meeting, I learned that the Fire Chief for Boynton Beach is retiring; therefore, I am directing this information to your attention as well as to training officer Bill Gulbrandsen for consideration. Under Fire will be a 30- minute weekly television series that will contain video footage of on -call emergency situations utilizing both police and fire departments in our local viewing area. Wescott, the producer of Under Fire: South Florida's 911, is a native of Palm Beach County, Florida. EDUCATION She earned her AA degree from Palm Beach Community College and will receive her BA degree in communications in the Spring of `94 at Florida Atlantic University. Major areas of study included music, news and feature writing, broadcast journalism (including film/video) and photography. Additional courses focusing on the criminal justice system and social sciences were completed. EXPERIENCE She served as a civilian employee for the Palm Beach County Sheriff's Office and the Palm Beach County Police Academy in the late 80's.
