Minutes 08-15-12 MINUTES OF THE CODE COMPLIANCE BOARD MEETING HELD ON WEDNESDAY, AUGUST 15, 2012, AT 6:30 P.M., IN COMMISSION CHAMBERS CITY HALL, 100 E. Call to Order Chair Costantino called the meeting to order at 6:30 p.m. II. Approval of Agenda Vestiguerne Pierre, Senior Code Compliance Officer announced the following changes to the agenda: Case No. 08 -2511 should be tabled to November 21, 2012. Motion Mr. Foot moved that the aforementioned case be tabled until the Code Compliance Board meeting to be held on November 21, 2012. Ms. Carroll seconded the motion that unanimously passed. Case No. 12 -611 should be tabled to September 19, 2012. Motion Mr. Cole moved that the aforementioned case be tabled until the Code Compliance Board meeting to be held on September 19, 2012. Ms. Carroll seconded the motion that unanimously passed. Case No. 12 -1016 complied Case No. 12 -1034 was removed. Case No. 12 -1094 was closed. Case No. 12 -1162 complied. Meeting Minutes Code Compliance Board Boynton Beach, FL August 15, 2012 Case No. 12 -975 complied. Case No. 12 -1052 was removed. Case No. 12 -932 should be tabled to September 19, 2012. Motion Mr. Bucella moved that the aforementioned case be tabled until the Code Compliance Board meeting to be held on September 19, 2012. Ms. Carroll seconded the motion that unanimously passed. Motion Mr. Cole moved to approve the agenda as amended. Ms. Carroll seconded the motion that unanimously passed. Officer Pierre called the roll and determined who was present. III. Swearing in of Witnesses and Introduction Attorney Bridgeman explained the hearing procedures and administered an oath to all who intended to testify. IV. New Business Case No. 12 -1224 Andre J. Jean Property Address: 201 NE 16 Avenue Violation(s): CO CH 4 SEC 4 -32, 36, 37 Dogs must be secured on property, properly vaccinated, and have current tag. Liz Roehrich, Animal Cruelty Investigator, announced this case was a citizen complaint and entailed the leash law, County registration and rabies vaccinations. There had been numerous warnings and citations issued. Number of days given to comply was seven days. She advised currently there were no dogs on the property, but there had been multiple animals over the last year. The dogs run loose a lot and each time he was warned about the rabies tag and license tag, he would comply for the dogs previously on the property. She would like a permanent resolution and requested a cease and desist order. Patrick Jean, 201 NE 16 Avenue, is the son of the property owner. Mr. Jean pled guilty to the leash law and not guilty to the registration. Ms. Roehrich confirmed there were no dogs on the property at the present time. The previous violations were corrected and complied when noticed and the animals were taken to Palm Beach Animal Control and not reclaimed. 2 Meeting Minutes Code Compliance Board Boynton Beach, FL August 15, 2012 Motion Based on testimony and evidence presented in the aforementioned case, Vice Chair Foot moved that a Cease and Desist Order be issued giving Andre J. Jean until August 22, 2012 to bring the violations of the City of Boynton Beach Code sections as cited into compliance. The Board has considered the gravity the violations and the actions taken by the Respondent and any previous violations by the Respondent, hereby orders that a fine in the amount of $100 per occurrence for a violation thereafter shall be imposed upon the Respondent. The motion was seconded by Mr. Bucella with discussion by Chair Costantino. She commented she would like the fine increased to $250 as it was proven by testimony that this was a problem property with several visits. The motion was amended to increase the fine to $250. The motion passed unanimously. Case No. 12 -961 Eliahu Mizrahi Property Address: 201 NE 16 Avenue Violation(s): 261 N. Atlantic Drive CO CH10 SEC 10 -56 (A) BBA FBC '07 ED. 105.1 Property not to be occupied until violations are corrected. Fix roof and ceiling, repair windows and doors, repair front and rear screen windows and doors, repair Tight fixtures. Permit is required for new windows and pool fencing. Officer Pierre presented the case as contained in the notice of violation. The Respondent was present. Eliahu Mizrahi, 8291 Bermuda Sound Way, pled not guilty. He understood the property was cited for violations of Code. He advised the issue he had was that he fixed everything with licensed contractors. The person that was helping him with minor issues was staying in the house and he brought other people in. When all the violations were corrected, the City issued the approval to rent the property. The other request by Officer Lewis was to add an additional smoke detector and he added three. A short time later, he advised he decided to evict the person in the house. Officer Pierre distributed pictures to the Board members for review. He advised the property was boarded up and there was no access. His main concern was that the items needed to be repaired before it could be rented. 3 Meeting Minutes Code Compliance Board Boynton Beach, FL August 15, 2012 Mr. Mizrahi commented the pictures depict the damages caused by the hoarders after being notified of eviction. The police were called to the property several times. The damage was caused after the City issued the license to rent. The property was totally demolished which made it uninhabitable. The house was boarded up for protection from any further incidents. The pool had been closed and sealed. Mr. Mizrahi indicated he was not going to do anything further to it. He further advised that he did not feel he owned the property. The ex -wife owned the property and was the one paying the mortgage on the property. She stopped paying and his understanding was that it was in foreclosure. After some discussion, it was determined Mr. Mizrahi was the property owner through a Quit Claim Deed and was responsible for maintaining the property. Chair Costantino inquired how long Mr. Mizrahi felt it would take to bring the property into compliance. Mr. Mizrahi advised he was not allowed on the property due the bank having a management property taking over the property. Officer Pierre noted when he was cited, the property was not in foreclosure and there was no lis pendens on the property. After further discussion, it was suggested to table the case to the upcoming Lien Reduction meeting to allow Mr. Mizrahi to submit documentation from the Bank. Motion Mr. Bucella moved to table the case to the Lien Reduction meeting on August 20, 2012 for Mr. Mizrahi to prove he was not allowed on the property due to the bank taking it over. The motion was seconded by Ms. Carroll and unanimously passed. Case No. 12 -1131 Wayne Peterson Property Address: 201 NE 16 Avenue Violation(s): 2671 N. Seacrest Boulevard CO CH10 SEC 10 -56 (A)(D) Repair driveway and install minimum 4" size house numbers on structure to be visible from street. Officer Pierre presented the case as contained in the Notice of Violation. The Respondent was present Wayne Peterson, 2671 N. Seacrest Boulevard pled no contest He advised he was working on the driveway but it was taking time because he was doing it by himself. He requested a month to complete the repairs. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Cole moved that this Board find that Wayne Peterson is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent correct the violation 4 Meeting Minutes Code Compliance Board Boynton Beach, FL August 15, 2012 on or before September 29, 2012. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $150 per day for each day the violation continues past September 29, 2012, plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Ms. Yerzy seconded the motion that unanimously passed. Case No. 12 -1158 Ferdinand and Jean Mayernik Property Address: 206 Live Oak Lane Violation(s). CO CH13 SEC 13 -16 Renting without Business Tax Receipt Courtney Cain, Code Compliance Officer, presented the case as contained in the notice of violation. This was a multi - family property. The Respondent was present. Joan Fradella, daughter of the Respondents was present. She pled no contest. The paperwork was completed and she was informed the Business Tax Receipt would be at the Code meeting. Officer Cain advised he had been to the property twice and no one was at home. He suggested making arrangements with the tenant so that he could have entry to the property for inspection. Motion Based on the testimony and evidence presented in the aforementioned case, Ms. Carroll moved that this Board find that Ferdinand & Jeanne Mayernik are in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondents correct the violation on or before September 14, 2012. The Board has considered the gravity of the violation, the actions taken by the Respondents and any previous violations by the Respondents and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $150 per day for each day the violation continues past September 14, 2012, plus administrative costs shall be imposed The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Mr. Foot seconded the amendment motion that unanimously passed. Case No.12 -651 Robert Domenick Property Address: 2316 SW 23 Cranbrook Drive Violation(s): BBA FBC '07 ED. 105.1 Permit expired. Obtain new permit. 5 Meeting Minutes Code Compliance Board Boynton Beach, FL August 15, 2012 Luney Guillaume, Code Compliance Officer presented the case as contained in the notice of violation. This was a red tag from the Building Department. The Respondent was present. Laura Beason, 1800 NW 49 Street, Suite 120, Ft. Lauderdale, FL 33309 was the attorney representing Washington Mutual, the mortgagee foreclosing on the property. She pled no contest. She advised that her client does not own the property. It would be going to summary judgment on August 21 At that time, it would go to sale and once the Bank took title, the violation would be corrected. There was discussion on whether this was a valid case and possibly recommend it go back to the Building Department as ownership of the property was in question. The other alternative would be to table to the next meeting. Motion Ms. Carroll moved to table the case to September 19, 2012. The motion was seconded by Ms. Yerzy and unanimously passed. Case No. 12 -1059 Lansdowne Mortgage LLC Property Address: 1154 SW 27 Avenue Violation(s): CO CH 10 SEC 10 -51.5 INC Property must be registered. Repair or replace wood fence and gates, remove all trash and debris, mow overgrown yard areas throughout the property, repair all broken windows, clean pool, replace screening on pool enclosure as pool is unsecured. Office Guillaume presented the case as contained in the Notice of Violation. The Code Compliance Board hearing date was July 18, 2012 and Dale Dishon appeared. The compliance date set by the Board was July 28, 2012 or $1,000 per day. The violation still existed. The Respondent was present. Dale Dishon, 6251 NW 99 Lane, Hialeah, FL was an employee appearing on behalf of the company. He advised that he hoped there was compliance on the violations. He presented pictures for the Board to review. He mentioned one of the issues was the pool and was told by the Code Office that the pool enclosure could be rescreened or a fence could be erected where it was missing on the east side of the home. The fence was erected along with the required gate and lock. There was no access to the pool or the back yard. There was an RV behind the fence on the property, but until a sheriffs' writ could be secured once the property was titled, it could not be removed. The owners of the property were both deceased and once in a while the daughter and son show up and remove things. Pete Roy, Chief Code Compliance Officer indicated he performed an inspection the day before and verified the chain Zink fence was fixed. On the east side, there was a wooden fence with a lock that did not close. The pool remained unsecure. Diane Springer, Code Compliance Coordinator, advised the screen enclosure would be in violation as is and she commented she would not have told them it could be either the screen or a fence and gate. Both issues had to be addressed. Vice Chair Foot suggested to either certify the lien and the lien continues or the case could be tabled for reconsideration in a month. In the meantime the fine would continue at $1,000 a day. In either situation, there would be motivation to get this matter closed and would be in favor of tabling the case. There was a brief discussion on options for the property. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Cole moved that this Board find that the Respondent has not complied with this Board's Order dated July 18, 2012, and having considered the gravity of the violations, the actions taken by the Respondent, that this Board impose and certify a fine in the amount of $1,000 per day plus administrative costs which shall continue to accrue until the Respondent comes into compliance or until a judgment is entered based upon this certification of fine. Ms. Yerzy seconded the motion that passed 6 -1 (Vice Chair Foot dissenting). Case No. 12 -890 Jane Lindros/William Richard Zigmont Jr. Property Address: 1001 NE 7 Street Violation(s): CO CH10 SEC 10 -56 (A)(B) CO CH 15 SEC 15 -120 (D) INC Mow, weed and trim overgrowth. Remove inoperable vehicles and outside storage. Officer Roy presented the case as contained in the notice of violation. This case came before the Board on June 20, 2012 and Jane Lindros appeared. Compliance date was set by the Board for July 20, 2012 or a fine of $200 per day. The property was still in violation for a total of 25 days of non - compliance. The Respondent was present. Jane Lindros, 1001 NE 7 Street, advised the truck had been registered. The property was regularly mowed, edged and maintained. She was continually working to keep the property maintained. 7 Meeting Minutes Code Compliance Board Boynton Beach, FL August 15, 2012 Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Bucella moved that this Board find that the Respondent has not complied with this Board's Order dated June 20, 2012, and having considered the gravity of the violations, the actions taken by the Respondent, that this Board impose and certify a fine in the amount of $200 per day plus administrative costs which shall continue to accrue until the Respondent comes into compliance or until a judgment is entered based upon this certification of fine. Ms. Carroll seconded the motion with discussion by Officer Roy. He suggested tabling the case and possibly walk the property with the owner and make sure there was an understanding of the whole violation. Mr. Bucella amended the motion. Motion Mr. Bucella moved to table the aforementioned case to September 19, 2012. The motion was seconded by Ms. Carroll and unanimously passed. Chair Costantino reminded the Respondent that the fine would continue to run on the property. There was discussion and explanation of the lien on the property to make the Respondent understand the fine. Case No. 11 -593 Grove Plaza D LLC Property Address: 3924 Hypoluxo Road Violation(s): LDR CH 21 SEC. 3 INC LDR CH 21 SEC. 3 (R) Remove all unpermitted signs and banners including signs placed on top of vehicles. Keep property free of unpermitted signs and banners. Officer Cain presented the case as contained in the notice of violation. The Code compliance date was April 20, 2011 and Jim Woods appeared. Compliance date and proposed fine set by Board was to Cease and Desist by April 21, 2011 or $250 per occurrence. Date of the one occurrence was July 10, 2012. The Respondent was present. Jim Woods, 901 N. Point Parkway, Suite 200, West Palm Beach, FL, was the property manager and agent for Grove Plaza D LLC. He advised the tenants were in compliance on the property and claimed the sign was not on his property but on County owned property. In reviewing the facts, Officer Cain noted the citation was issued to the property owner, Grove Plaza and the property the sign was on was Lake Worth Water Management District. 8 Meeting Minutes Code Compliance Board Boynton Beach, FL August 15, 2012 There was discussion regarding if the property was in the City or County and if it was the property owner responsible for his tenant placing a sign on County property. Officer Cain explained there had been problems in the past of signs being placed in the right -of -way. It was not known when the pictures were taken and cited that it was not City property. After a letter was sent and the card returned, it was investigated and found that it belonged to Lake Worth Drainage District. Officer Cain advised due to the circumstances, the City could not move forward with the case. Motion Vice Chair Foot moved to remove the aforementioned case. The motion was seconded by Ms. Carroll and unanimously passed. Case No. 11 -2568 Phillip and Hattie Denaro Property Address: 64 Baytree Lane Violation(s): CO CH10 SEC 10 -52 CO CH 15 SEC 15 -120 (D) Remove inoperable and unregistered vehicles from the property. Officer Cain, presented the case as contained in the notice of violation. The Code Compliance Board hearing date was November 16, 2011 and Phillip Denaro appeared. The compliance date and proposed fine was a Cease and Desist order by November 27, 2011 or $500 per occurrence. Date of occurrence was from July 17, 2012 to August 15, 2012 for 29 occurrences. Paulette Abbott, 10834 Madison Drive, advised she had a notarized letter from the Respondent's son stating he was sick and she was authorized to appear on his behalf. The Respondent, Phillip Denaro, passed away on July 1, 2012. The property was quit claimed in 2008. Due to Mr. Denaro's death, the primary concern was taken off the property. At the present time, the vehicles and boats had been removed and the van would be towed. The Respondent received a permit from the City to put a third driveway in, but after doing the initial work, Baytree informed him he could not do that. He then replaced everything. Everything else was being taken care of. Chair Costantino reminded Ms. Abbott that a Cease and Desist Order was issued on November 17, 2011 and that there would be a $500 fine for each occurrence of violation. There could be a possible lien on the property. She explained to Ms. Abbott what needed to be done to ensure there would not be further violations. Discussion ensued as to why there were unregistered vehicles parked for one month after the Cease and Desist Order was issued. Ms. Abbott could not offer many answers as she was not totally familiar with the situation. 9 Meeting Minutes Code Compliance Board Boynton Beach, FL August 15, 2012 Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Cole moved that this Board find that the Respondents have not complied with this Board's Order dated November 16, 2011, and having considered the gravity of the violations, the actions taken by the Respondents, that this Board impose and certify a fine in the amount of $500 per occurrence plus administrative costs which shall continue to accrue until the Respondents come into compliance or until a judgment is entered based upon this certification of fine. Mr. Bucella seconded the motion that unanimously passed. Case No. 12 -1225 Sonia Etienne Property Address: 1633 NE 1 Street Violation(s): CO CH4 SEC 4 -18 Poultry prohibited. Unlawful to keep and maintain fowl within City limits. Ms. Roehrich presented the case as contained in the notice of violation. She advised the City was asking for a Cease and Desist Order. This had been an ongoing problem through the years. Motion Based on the testimony and evidence presented in the aforementioned case, Ms. Carroll moved that a Cease and Desist Order be issued giving Sonia Etienne until August 25, 2012 to bring the violation of the City of Boynton Beach Code sections as cited into compliance. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $250 per occurrence of the violation thereafter shall be imposed upon the Respondent. Mr. Cole seconded the motion that unanimously passed. Mr. Foot left the meeting. Case No. 12 -1053 Bank of New York Mellon Property Address: 113 Seacrest Court Violation(s): CO CH10 SEC 10 -51.5 INC Mow grass and weeds, fix fence, secure property. Officer Pierre presented the case as contained in the notice of violation. The City recommended 10 days to correct the violations for a compliance date of August 25, 2012. 10 Meeting Minutes Code Compliance Board Boynton Beach, FL August 15, 2012 Motion Based on the testimony and evidence presented in the aforementioned case, Ms. Carroll moved that this Board find that Bank of New York Mellon is in violation of the City of Boynton Beach Code sections cited and moved to Order that the Respondent correct the violations on or before August 25, 2012. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $500 per day for each day the violations continue past August 25, 2012 plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Officer Pierre presented the case as contained in the notice of violation. Staff recommended 10 days be given to correct the violation for a compliance date of August 25, 2012. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Cole moved that this Board find that Kristine Flynn is in violation of the City of Boynton Beach Code section cited and moved to order that the Respondent correct the violation on or before August 25, 2012. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $250 per day for each day the violation continues past August 25, 2012, plus administrative costs shall be imposed. Staff recommended 10 days be given to correct the violations for a compliance date of August 25, 2012. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Bucella moved that this Board find that Ellington G. and Shirlebe Beckles are in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondents correct the violations on or before August 25, 2012. The Board has considered the gravity of the violations, the actions taken by the Respondents and any previous violations by the Respondents and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $500 per day for each day the violations continue past August 25, 2012, plus administrative costs shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Case No. 12 -1089 Sebastian and Lorraine Brusca Property Address: 1004 NW 7 Street Violation(s): CO CH10 SEC 10 -56(C) (D)(G) CO CH15 SEC 15- 120(D) INC Mow, weed and trim property. Secure Secure pool and bring back to sanitary condition. Repair broken screen. Remove all outside storage. Officer Herring presented the case as contained in the notice of violation. He noted the pool was in an unsafe condition and presented a health and safety hazard. The City recommended 10 days to correct the violations for a compliance date of August 25, 2012. Motion Based on the testimony and evidence presented in the aforementioned case, Ms. Carroll moved that this Board find that Sebastian and Lorraine Brusca are in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondents correct the violations on or before August 25, 2012. The Board has considered the gravity of the violations, the actions taken by the Respondents and any previous violations by the Respondents and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $1000 per day for each day the violations continue past August 25, 2012, plus administrative costs shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Officer Herring presented the case as contained in the notice of violation. Staff recommended 10 days be given to correct the violations for a compliance date of August 25, 2012. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Bucella moved that this Board find that Federal National Mortgage Assoc. is in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondent correct the violations on or before August 25, 2012. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $300 per day for each day the violations continue past August 25, 2012, plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Ms. Carroll seconded the motion that unanimously passed. Case No. 12 -993 Marwan and Suhair Gali Property Address: 1005 N. Seacrest Boulevard Violation(s): CH 2.5 -3 and 2.5 -7 SEC 10 -51.5 INC Tenant must obtain new alarm permit. Officer Herring presented the case as contained in the notice of violation. Staff recommended 10 days be given to correct the violation for a compliance date of August 25, 2012. Motion Based on the testimony and evidence presented in the aforementioned case, Mr. Bucella moved that this Board find that Marwan and Suhair Gali are in violation of the City of Boynton Beach Code section cited and moved to Order that the Respondents correct the violation on or before August 25, 2012. The Board has considered the gravity of the violation, the actions taken by the Respondents and any previous violations by the Respondents and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $50 per day for each day the violation continues past August 25, 2012, plus administrative costs shall be imposed.
