Mayor Roberts called the meeting to order at 7:30 P.M. He
welcomed the audience and asked all to rise for the invoca-
tion given by Mr~ Frank Kohl~ City Manager, followed by the
Pledge of Allegiance to the Flag~ led by Councilwoman Jackson.
Announcements
The Mayor read a Proclamation designating the week of Septem-
ber 17-23, 1975 as Constitution WeAk in Boynton Beach.
The Mayor then announced that there would be a meeting of the
South Central Regional Waste Water Treatment & Disposal Board
on Friday, September 12, 1975 at 7:00 P.M. in Delray Beach
City Hall.
Mayor Roberts asked all nhose wishing to speak about items
on the Agenda to come forward and give their names to the
City Clerk so they could be called at the appropriate time.
Mrs. Jackson request~ adding an item to the Agenda under
OTHER and there was no objection.
MINUTES
Special City Council Meeting - July 30, 1975 (TABLED)
Mr. Harmening moved to take this item from the table, seconded
by Mrs. Jackson. Motion carried 5-0.
Mrs. Jackson said since she has read the Minutes, she would
move no adopt them. Mr. Harmening seconded. No discussion.
Motion carried 4-0, with Mr. DeLong abstaining since he had
not been present. Mr. Strnad noted he also had not been present,
but he read and approved of the Minutes.
Regular City Council Meeting -August 19, 1975
Mrs. Jackson referred to the bottom of page 8 -- last paragraph
and corrected it to read, "Mrs. Jackson made a motion to repeal
the interim service fee Ordinance and not to appeal this case
and final judgment and to pay ~the court costs of $201.60." In

the last line, after the word "now" -- it should say, "After
much discussion, Mr. DeLong asked to have the motion repeated.
Mrs. Jackson moved that the City not appeal the case etc."
The reason she was bringing this up was that in the final
motion it did not say to repeal the interim service fee.
Mayor Roberns referred to page 2, paragraph 5, line 5, correct-
ing it to read --" remainder of this paragraph and the
remarks from two organizations composed of business people."
Mr. Harmening moved for the adoption of the Minutes of the
Regular City Cduncil Meeting of August 19, 1975 as corrected.
Mrs. Jackson seconded. No discussion. Motion carried 5-0.
PUBLIC AUDIENCE
Mr. Joe Cogen of North Miami, Florida identified himself as
a successful Florida builder with many years' experience and
he requested that some acreage he owned and wished to develoo
with single family residences at the corner of Golf and Congress
be annexed to the City He said he had met with the City
Manager and wished to know the correct procedure to follow.
Mr~ Cogen also offered~to donate an acre of land to the City
which he felt was valued an $20-25,000 to be used for the
erection of water towers. Mr. Cogen said the land he wished
to have annexed amounted to approximately 180 acres and if
the Council was not in favor of PUD development, he would like
to work something out which would be agreeable.
Mayor Roberts noted that this item was on the Agenda and the
Council has to express its feelings about annexing property.
It was felt that possibly there were so many PUD developments
that it might be advantageous to all concerned to annex on the
basis of a sub-division. There was some discussion about the
procedure to follow, including referral to the Planning &
Zoning Board for recommendation. Mr. Cogen said he would
refer the matter to his architect so that a formal application
could be submitted using the City's R-1 zoning.
BIDS
Proposed Maintenance Garage
Mr. Kohl advised that bids for the above were opened in the
office of the Purchasing Agent on August 21, 1975 at 3:30 P.M.
Ail requirements have been met. Before Council was a copy of
the tabulation sheet approved by those departments involved.
This project is to be financed from Federal Revenue Sharing
Fund account 20-820. Tabulation Committee recommends low bid
be awarded no Kozich & Kozich, Inc~ of Ft. Lauderdale in the
amount of S48,629.00 and Mr. Kohl concurred with their recom-
mendation. Mr. Kohl noted that the affidavi~ was being mailed
to Mr. Sullivan and a copy would be sent to Council later. Mr.
Kohl said the company was reliable.

A separate memo for the Agenda by Mr. Kohl stated that the
two bids on the General Services Complex (proposed Maintenance
Garage and Vehicle Lifts) totals $54,018.10. He wished to point
out that the $100,000.00 that was allocated in revenue sharing
funds in his opinion should be sufficient to complete the plans
for this project. However, there still remains several items on
which the City has not as yet gone out for bid, i.e. landscaping;
asphalt parking areas; asphalt driveways and renovation of the
old building for storage. This was for informational purposes
only.
Mr. DeLong felt that the City Manager and Mr. Sullivan used
the right procedure because Kozich & Kozich had submitted a
brochure of recommendations and random selections were made
to check on these people. It was learned that they were
thought of highly. Mrs] Jackson noted that fifteen bids were
received on this project.
Mr. DeLong moved that the bid for the proposed Maintenance
Garage be awarded to Kozich & Kozich in the amount of S48,629.00
in accordance with the recommendation of nhe City Manager and
Tabulation Committee, with the inclusion that the City Manager
be instructed to have the Building Official make daily inspec-
tions on that particular building. He did not wish to have the
headaches the City has had with other projects in the oasn.
Mr Strnad seconded. No discussion. Motion carried 5=0.
Vehicle Lifts for Maintenance Garage
Mr. Kohl said bids for the above were opened in the office
of the Purchasing Agent on August 21, 1975 at 3:30 P.M. Ail

He added that this is a very fine company in this type of work.

noted there were only three bids received.
Mr. DeLong moved that the bid for the vehicle lifts for the
Maintenance Garage be awarded to Glasgow Equipment Company
in the amount of $5,389.10 in accordance with the recommendation
of the City Manager and the Tabulation Committee. Mr. Harmening
seconded. No discussion. Motion carried 5-0.

Proposed Ord. No. 75-25 Re: Adopting 1975-76 Budget
Mr. Simon read the above Ordinance on second reading by
caption only. Mayor Roberts asked if anyone in the audience
wished to speak in favor of or against this Ordinance. No
reply. Mrs. Jackson read a prepared statement, explaining
her reasons for voting against this ordinance, co~¥ of which
she asked to have attached to these Minutes (see attached).
Mr. DeLon~ moved for the adoption of Ordinance No. 75-25 on
second and final reading, seconded by Mr. Harmening. Under
discussion~ Mr. DeLong also wished to have the record reflect
excerpts of the Minutes of the Regular City Council Meeting
of August 5, 1975: regarding proposed Ordinances 75-25 and
75-26 (pages 4 and 5), indicating Mrs. Jackson's comments and
approval of same. (Excerpns attached). Mrs. Jackson said
she did not dispute it.
Mayor Roberts felt it might be well to look ahead and make a
few changes, but at the moment he didn't think there would
be too much effect in juggling from one pocket to another.
He felt nhere might be some merit in moving the Engineering
Department into the General Fund, however, he would go along
with the adoption of the budget. Mrs. Padgett called the

Nrs. Jackson referred to page i of the proposed Ordinance,
under Section l, 7th line up from the bottom of the page.
She felt this should read "... for a charge of $1.00 per year..."
Mr. Frederick thought this might be burdensome on t~e City
Clerk's office and it was decided to wait and see how the
system would work out.
Referring to N_r. Kohl~s insertion about the $ .25 fee, Mr.
DeLong felt there should be an inclusion stating "... by a
system to be devised by the Recreation Director and the City
Nanager ..." Mr. Kohl said this would be done and the hotels
and motels have already been contacted. There would be num-
bered passes given out and there would also be a system at the
Guard House. It was clarified that the motels in Ocean Ridge
would be treated the sam~.

Er. DeLong moved for the adoption of Resolution No. 75-ZZ,
seconded by Mr. Strnad. Under discussion, Y~. Harmening
was strongly opposed to the fees which he felt were exhorbitant.
In reply to questioning by Mayor Roberts, Mr. Frederick said
that studies were made of surrounding areas and Boynton's proposed
fees were comparable. He felt the extra charges would enable
Boynton to have quality service on its courts. Nfs. Jackson
said she agreed in theory with Mr.Harmening, but felt something
would have to be done to keep outsiders from using the City's
court~ After some further discussion, it was noted that
the Resolution could always be changed if it didn't work out.

question of orders belng, issu~d in writing or orally. Mr.
Kohl felt that where an mtem znvolved hundreds of dollars,
it should be in writing. Requests involving small amounts

Proposed Res. No. 75-HHH - Re: Ratification of Police Union
Contract
Nr. Simon read the above proposed Resolution in its entirety.
Nr. DeLong referred to the communication received from the
City Manager regarding recommendation of the acceptance of
the contract. He recommended reading into the record the
recommendations of the negotiations that transpired as com-
municated to Council by the Cit7 Manager. Mr. Kohl read
his memo for the Agenda dated September 2, 1975 (see copy
attached). Mr. Kohl requested that Council ratify the Police
Union Contract and referred to two errors made in the contract --
page 9, a~ticle 20, section (d) should be deleted and the new
sick leave policy that's being acted upon tonight should be
inserted~ article 22, section (a), page 9 should read, "The
City of Boynton Beach agrees to give members of the bargaining
unit a pay raise consistent with the City of Boynton Beach's
across the board increase." (No department will take advantage
of another department.)

OLD BUSINESS
Discuss Section 56 of the Charter - Re: Special and Regular
Neetings of the City Council ... Vice Mayor DeLon~
Mr. DeLong quoted from the applicable part of the Charter upon
which he wished to comment, which he believed to be in violation
of State Law, particularly the Sunshine Law. Mayor Roberts
referred to Ordinance No. 75-11 which was passed in Y~rch, 1975,
eliminating this violation. The Charter is in the process of
being updated.
Discuss Methods of Interviewing Applicants for Position of
Executive Director for "Regional WasteWater Treatment & Disposal
Plant ... Nayor Roberts
~ayor Roberts wished to hesitate in getting this Council
involved, noting that at the May 19th meeting of the Regional
Board, it was agreed that the applications would be reviewed
by both Utilities Directors who would make recommendations, with
the Board having the final say. Mayor Roberts referred to the
last Board meeting at which Mayor Scheifley said the City Manager
would do the interviewing. Mayor Roberts wished to counteract
this with Mr. Startzman who drew up the functions and duties

of these particular officers. Mayor Roberts was against any
outsiders coming into the Beard's selection. Y~. DeLong
said this was for Council's information and was not intended
to be on the agenda.
Mrs. Jackson noted that the position should be filled by
one who is not only an engineer but an administrator. Mr.
DeLong felt that the system for selection he had submitted
would be the best one to follow.
Rescind Interim Service Fee Ordinances - Nos. ?3-36, 74-19 &
75-12 ... Councilwoman Jackson
Mrs. Jackson moved to repeal the interim service fee ordinances,
Nos. 73-36, 74-19 and 75-12. Mr. DeLong seconded. Council
requested the City Attorney to have this drawn up for the next
meeting. Notion carried 5-0. Mr. Simon said he had anticipated
Council's wishes and had the Ordinance ready now.
Proposed Ordinance No. 75-33 - Re: Repealing Interim Service
Fee - 1st Readin~
Mr. Simon read proposed Ordinance No. 75-33 on first reading in
its entirety. Mrs. Jackson moved for the adoption of Ordinance
No. 75-33 on first reading, seconded by Mr. Harmeni~. No dis-

Mrs. Jackson moved to take this item from the table, seconded
by Mr. Harmening. Motion carried 5-0.
Since this matter has been dragging on, Mrs. Jackson moved to
delete the item from the agenda, seconded by Mr. DeLong, Mr.
Kohl noted that the Court date is set for September 19th.

Consider Annexation of Propem~y on Congress Avenue (Request of

It was noted that Mr. Cogen had left and that he would submit
his application as discussed earlier. Mr. Harmenlng moved to

Request of Community Action Migrant Program ... (TABLED)
Mrs. Jackson moved to take this item from the table, seconded
by Mr. DeLong.~ Mr. DeLong asked the City Manager if he received
the material from the Community Action people. Mr. Kohl said
he and Marvin Glover have been in contact, however, it was
noted that Mr. Glover had been transferred. Motion carried

Discuss Purchase of Property from Delray Beach for "Regional"
Plant
Mr. DeLong felt it would be premature to buy the land until
the status of the Federal Grant is known. He had read an
opinion in the newspaper that either an outright purchase or
an instalment plan was being considered. He therefore felt
that the ~ayor again be designated by the Council to negotiate
the purchase if necessary.
Hayor Roberts said he has learned that there are rights of way
both north and south of the property. He also ascertained that
no payment would be necessary for at leas£ 60 days after the
sales agreement is signed which will not be done until some
other matters are cleared up. He felt Council should be pre-
pared to discuss the City's taking of title for the land. He
noted that Boynton and Delray were not the only two municipalities
to be involved as there are many satellite areas which will be
tied in to the facility. He felt the City should be entitled~_
to a return with no transfer to the Board under any circumstances.
Hr. DeLong moved to have this matter turned over to the City
Attorney to work in c~njunction with the City Hanager and
come back with a workable, suitable plan for purchase. Mayor
Roberts said there was also a question of money to be discussed.
He asked Mr. Simon if there were any problems of having a
transfer on an undivided basis so that each City would have an
interest in the land so no one would be denied and there would
be some chance of compensation. Hr. Simon said the City may
buy half of what Delray owns in number of acres, i.e. the North
half, or simply an undivided half interest in the whole. Hayor
Roberts felt if each City maintains ownership, there would be
some claim to the investment. He did not feel it should be
turned over to the Board. After some further comment, Hr. Strnad
seconded the motion. Mr. Simon said he couldn't do much until
the City decided to make an offer to Delray, in which case he
c~uld draft a contract. Mayor Roberts said there was no need
to rush this. Council would make some of its wishes known at
the next Board meeting. Delray would have to transfer the
land to Boymton as in any other transaction, which puts the
burden of the title on Delray. He hoped Council would agree
in his feelings that Boynton not h~a to assume any of that
responsibility as it was about a $1,200.00 item. Mr. Simon
said the Dept. of Revenue ruled an exemption regarding stamps
in such a transaction.

Mr. DeLong asked ~ the Councilmembers if they were in agreement
about the payment being in cash, with a refund if everything
fell through. It was felt this should be in the contract. It
was noted that the agreement hinged upon the grant from the
Federal Government in the amount of $8,400,000. After some
further comment, mmtion carried 5-0.
ADMINISTRATIVE
Discuss Employees Pension Plan: a) Consider Amending Section
20(f) of the Charter; b) Cunsider Amending Sec. 21-45 of the
Code; c) Consider Recommendations Submitted by Retirement Plans,
Mayor Roberts noted at the last meeting of the Pension Board,
it was noted by the Actuary that there was an amount of $7~,000
in the Budget and with a little updated payments and additionaI
money, the entire plan was being updated. This must be done
through amending the Charter and the recommended changes were
before Council. It was noted that this could be amended under
Home Rule by Ordinance. Mr. Simon said the~on!y problem he
saw was regardim~ the rights of municipal employees, however,
Mr. DeLong felt since something was being done to upgrade the
situation, there should be no problem. After some further
comment, Mr. DeLong moved to have the City Attorney look into
this matter with the City Manager and come up with an amendment
to the two above Sections of the Charter and also adopt the
recommendations submitted by Retirement Plans, Inc. Nfs. Jackson
seconded. No discussion. Motion carried 5-0.
Consider Appointment of Alternate to BQard of Adjustment
Mr. Harmening nominated Mr. Carl Zimmerman for the above
position. Mr.~ DeLong moved that nominations be closed.

Consider Request of Palm Beach County Municipal League
Mayer Roberts noted this was in regard to closing of bar rooms
and there were feelings expressed that some of the public
wanted them to remain ope~ and others wished to have them
close earlier. C~uncil d~scussed the problems in surrounding
municipalities and it was decided that the League's questionnaire
regarding a unifor~n closing time required i~ Palm Beach County's
unincorporated ar~a would be answered, stating a 3 A.M. closing
time is preferred. Regarding the se6$nd question in paragraph
~ of the questionnaire about changln~ the City's closing time,
mt was decided to answer %'No .expression", as Council did not
wish to change the current policy.

I am going to read a prepared statement, and make this a part of
the minuteS-
At the last meeting I went on record as opposing the raise in expense
money for the Council. We all ran for office, k~owing what the pay
and expense money waS.
We natUrally tour the City to see how projects ~re going,~ attend
meetings ~ and have expenses for other City business. ~We. have. a ~

If any raises are ever voted, it should not go in~O effect until a

Since our last Council meeting I have been giving much thought to
our budget having the entire Engineering Department cha~ged to
utilities.
This can in no way be justified. If it were 50% from the Water and
Sewer Fund I might agree with this; though I feel even tha~ is a
high percentage. This was discussed during budget workshops, and
the more I think about it the more I realime it should be charged,
the most part, to the General Fund, since Engineering on Water and
Sewer is a minor portion of that Department's work.

Our Sewer and Watez Fund is a very exclusive fund, in that it is not
only for a very special purpose, but also because it has many legal
ramifications,
Does it make sense to raise the water and sewer rates to the users,
then take money from the Utility Fund and spend it for General Fund
purposes?
The bonding agreements set aside a sinking fund for repairs replacement,
additions, etc. - but it is mever enough; and as a result we are
frequently floating new bonds for water mad sewers. My feeling is that
even though it is legal to transfer money To the General Fund and use
the money for general administration, it is unfair to the~ax?ayers to
do this, and then have to go back later and ask for another raise in rates.
We know we are going to, of necessity, float more bonds in the future,
but doesnTt it make sense to keep our water and sewer funds intact as
much as possible, so that we get a higher rating when that time comes?
This was one of the main reasons we had such a high rating in o~r last
Bond Zssue - Water a~ Sewer Funds used for Water and Sewer. ~/ ~ ~
If the time ever comes that we have s surplus in this fund it certainly
should not go into t~e General Fund. It should go right back where it
came from - to thatchers in the To~Jn of lower rates.z At present it
doesn't seem this time will ever come.

.Proposed Ordinance No. 7~-25 - Re: 1975-1976 Budget
Mrs. Jackson stated she would like to make a statement before
the Ordinance of budget was read. They went through the whole
budget and there is one thing she does not agree with. She
does not believe it is necessary to raise the expenses for
the City Council members. She stated this at the budget
workshops and would like to go on record now as being opposed
to the raise and expenses for the Council. ~
Mayor Roberts questioned the number of readings and Mr. Simon
informed him that he believed according to the charter, there
would be three readings. Mayor Roberts then referred to his
request to have an abbreviated version of the budget available
for members of the audience and Mr. Kohl informed him that
this had been done and they would also be available at the
next meeting.
Mr. Simon read proposed Ordinance No. 75-25 on first reading
in its entirety. Mr. Harmening moved for the adoption of
proposed Ordinance No. 75-25 on first reading, seconded by
~s. Jackson.
Under discussion, ~s. Jackson commended the City Manager
for having done a good job in helping the taxpayers with
having the budget down to the bare bones. Mayor Roberts

questioned whether this was the time to refer to the pension
fund and Mr. Kohl informed him that he met with the Finance
Director this morning and discussed this. They will give
Mayor Roberts an answer and everything will Be taken care of.
Mayor Roberts asked if they also discussed disability insur-
ance and Mr. Kohl replied that this was just a suggestion and
was net discussed. Mayor Roberts remarked that this did not
affect the budget. Mrs. Jackson added that she seconded the
motion as her objection to the raise in the expense money did
also not make any difference in the Budget. Mr. DeLong re-
ferred Go being absent from the budget sessions and stated he
was not ~for or against any specific items, but is aware the
State law requires adoption.

Mr. Simon read proposed Ordinance No. 75-26 on first reading
in its entirety. F~s. Jackson moved for adoption of proposed
Ordinance No. 75-26 on first reading, seconded by Mr. Earmening.
Under discussion, Mr. DeLong stated he would like to discuss
the millage rate, although he will vote for the same reason
as for the previous ordinance. Although reducing it ~/lO's,
he would be pleased if it was held to be able to make an addi-
tion on the Police Department. He explained how they had
come a long way since 1973 and he would not want to see them
bogged down now as there are still some things essential in
the City. He is sorry it was not left as it was. Mayor
RoBerts replied that it was pretty hard to make an allowance
f~r the second story on the Police Department, since it was
not proposed by the Police Department. He thinks they are
holding the line with giving a slight reduction. ~hen the
results are in from the other communities, he thd~W~ they will
agree they have done a good job. Mr. DeLong continued that
he thought the second story was long over-due with the Police
Department being over-crowded and additional men being put on.
~. Harmening state~ he was happy to see they ~ere able to
reduce the millage for the coming year. He thinks it is an
opportunity that seldom comes along in this day and age,
Mr. DeLong agreed in that this Council as a whole has done a

RE: Ratification of the Police
Union Contract
We attach hereto the Police Union Contract for your perusal. I am
sure that each of you will have your own opinions as to what should
be allowed or disallowed. However, it is the City Manager's responsi-
bility to negotiate to the best of his ability but it is your right
to decide to ratify or not.
Our Personnel Director, Mr. Bill Sullivan and I have prepared our-
selves well, in my opinion, in attending PERC schools. Probably
more then any other city manager or personnel director in the County.
I would like to have you give particular attention to the decisions
of De!ray Beach and Boca Raton whereby they have spent thousands of
dollars to hire out of town law firms to negotiate with their unions.
I feel the City of Boynton Beach will fare as well as any other city
by negotiating the contract ourselves without spending thousands of
dollars of the taxpayer's money for a legal firm.
Further, I also feel that inasmuch as I am chief administrator that
dealing with the union problems that the State Legislators imposed
upon us (which in my opinion in future years they will regret their
.actions), it is certainly to our advantage that Mr. Sullivan and I
negotiate this contract since we are closer to the situation and
certainly much more aware of the problems that may or may not exist.
We also feel that the morale of our employees will be much higher in
our dealing with them directly°

In negotiating there is a "give and take" situation and in all of our
meetings we have been fair but firm. In fairness to all employees
as well as our t~u~payers, we had to be certain that fairness and firm-
ness prevailed at all times since we were always cognizant of the fact
that other people are involved.
Many hours of work have gone into the negotiation of this contract
with the Police Department as we conducted 8 meetings to date. In
addition many hours were spent by Mr. Sullivan and myself in prepar-
ing ourselves for these meetings. Also, prior to discussing this
contract# we constantly advised the Chief of Police of our intentions.
Though Mr. Sullivan was present with me at every meeting, and we dis-
cussed between ourselves as to what would be fair for the department
as well as the City, I take full responsibility for all actions, t
therefore respectfully request that you ratify the Police Union Contract.
