Mayor Roberts called the meeting to order at 7:30 P.M. and
asked all to rise for the invocation given by Frank Kohl, City
Manager, followed by the Pledge of Allegiance to the Flag,
led by Councilm~n Harmening.
,A~ouncements
The Mayor announced that the item concerningMr. James O'Meara,
Chairman of the Bicentennial Committee should be deleted as it
would appear on the next meeting's agenda.
Mayor Roberts then announced that CityCounciI!s Budget Workshop
Sessions are tentatively scheduled for July 16, 17 and 18, 1975
at 9:00 A.M. in Council Chambers. Mr. DeLong advised that he
would be present at the next City Council meeting of July 15th,
but would be leaving for Tallahassee on July 16th and would
remain there through July 18th.
Mayor Roberts announced that City Hall would be closed on Friday,
July4, 1975 in observance of Independence Day.
The Mayor asked all those w~shing to speak about items on the
agenda to give their names to the City Clerk so they could be
called at the appropriate time.

Mr~. Norman Strnad, Councilman of Boynton Beach, stepped d~wn
from the podium to speak under PUBLIC AUDIENCE regarding his
desire for all City business to be conducted ep~ly so ,that every-
one would kn~ what was going on. He refer~ed to a meeting that
was being conducted in the Mayor's office the preceding week
which had not been announced and the door ~a~ closed amd Mr.
Strnad asked for an explanation from the Mayor~ Mr.-Roberts
said he had discovered some construction that was going on in the~Ci~ty
illegally and he was asking the City Manager about it. The
City Manager eatled in Mr. the P~rchasing Agent and
Mrs. Jackson also happened to he there. He did not know ~who
closed the door. He said the matter was ~er investigation and
everyone would receive a report on it. Mr~ Strmad felt such
meetings were in violation iof the S~nshine~Law~and Mayor Roberts
said that Mr. Strnad could pursue the issue through the

Mr. Homer Rea of High Point Court spoke in regard to the closing
of S.W. 3rd Avenue at 23rd.~>He felt the street was c~ming along
well and hoped there would be a barricade put up to keep the
street closed to the general public.
Dorothy Geisler, 130 East Ocean Avenue, complained about various
traffic hazards she believed existed in the City, particularly at 5th
e,~ ~i~- Street and she requested the installation of 4-way
stop signs. She also commented about the minimal law enforcement
concerning bicycles and asked that lights on bikes be required
mn the interest of safety.
Mr. DeLong moved to have the-CityManager work in conjunction with
Lt. Gardner concerning the 4-way stop signs as requested and re-
garding the bicycles, the City Manager should contact the Chief
of Police and investigate thiematter. Mr. Strnad seconded. No
discussion. Motion carried 5-0.
Mrs. Jackson referred to a drive on bicycles that was conducted in
the City several years ago and she agreed that bike riders should
have more restrictions. ~ suggested that the City Manager look
into having another "Bike-O-Rama" during the s~mmer and Mr. DeLong
said this was all included in his motion.
Mr, PhilipG~ushaw, 184 S.E. 27th Way, presented a petition to
Council which was signed by approximately 900 people. He read

the Petition aloud, requesting a First Aid Station at the public
beach and an observation post for the life guards during inclement
weather. Mayor Roberts noted that Council had ~previously voted
in favor of this project, h~wever, the Town of Ocean Ridge denied
two attempts by the City of Boynton Beach to obtain a variance
and he asked for suggestions as to a way to proceed further.
Mr. DeLong noted that he learned Ocean Ridge's Towa Commission
did not take Boynton's request seriously because their City Council
was divided on this matter. Mr. DeLong moved to have the City
Attorney draft an appropriate Resolution to be passed by Council,
indicating its desire to have the First Aid Station at the Beach
by their unanimous vote. He felt the State of Florida was very
lax in not making it mandatory for every municipality to have an
up to date first aid station on the public beach. Mr. DeLong
felt the Resolution regarding the First Aid Station should he
sent to Ocean Ridge and if the request is denied and other pro-
posals are needed, he would have one ready. Mr. Strnad Seconded
the motion. There was some discussion between Mrs. Jackson and
Mr. DeLong about the dune line and the location of the First
Aid Statiou. It was decided that the City would not specify a
location and it would be left to the discretion of Ocean Ridge.
Mayor Roberts felt that plans st~uld be drawn so the Council may
examine them. Motion carried 5-0. It was felt the petition
presented by Mr. Goushaw was redundant.
Mr. Carroll of 340 High Point Court, questioned why Ocean Ridge
had jurisdiction over land which was owned by Boynton Beach and
it was explained that the City is a property owner in Ocean Ridge
and therefore, this property comes under all the zoning require-
ments of Ocean Ridge.

Mr. Kohl advised the above item should actually be for sheers
and la,oratories at the Landfill and no bids were received for
this small building. Phone calls were made to several contractors
who had picked up specs but no bids were made. Therefore, Mr.
Kohl requested permission to rebid this item.
Mr. DeLong moved to grant permission to the City Manager to go
out for rebid on--the above. Mrs. Jackson seconded. No discussion.

Parking Lot Resurfacin~ Prelect at Civic Center

Mr. Kohl advised that bids on the Civic Center Parking Lot
res~rfacing project were opened on June 24, 1975 at 3:00 P.M.
in the office of the Purchasing Agent. The Tabulatien Committee
recommended acceptance of the low bid from Hardrives, Inc. of
Delray Beach in the amoumt of $8,856.74, which is for the parking
lot resurfaeimg enly; or the alternate bid in the amount of
$I7,537.22 which is for the parking lot res~rfacimg, plus the
resurfacing of various streets. This bid price is good for 90
days after date of acceptance. Before Council were the Tabulation
Sheet and Affidavit, signed by Mr. George T. E/more, President
of Hardrives, Inc. and Mr. Kohl said he checked all other re-
quirements and everything was in order. Mo~ies are available
for the financing o~ thi~,proj ect in the Streets Department -
Account No. Mr, Kohl cencurred with the recoz~enda-
tiens of the Tabulation COmm%ttee. Mr. Kohl added that he would
like to accept the bid of Hardrives at 97¢ per square yard so
he could do other streets with the amount of money he has ~
the budget~ There was some discussion clarifying that the !bid
for resurfacing o~ly was correct in the amount of $8,856.74. Mr.
DeLong noted that the nmxt bid was about twice as much as that
of Hardrives and he felt this would be questionable if the City
wasn't aware of Hardrives' good reputation.
Mr. DeLong mo~ed to accept the City Manager's recommendation
above and award the bid to Hardrives in the amount of $8,856.74.
It was clarified that the City Manager would have the privilege
of resnrfacing other City streets at 97¢ per square yard if so
desired and also that in checking further, Rubin Censtrnction
verified to the CityManager that this was a very good price.
Fir. Strnad seconded the motion. No discussion. Motion carried

first reading. It was noted that this was in conjunction with
the request of the Lake Worth Drainage District. Mr. DeLong moved

Harmening seconded. Mrs. Jackson asked who would decide about
the noise in regard to Sectiom 4A - 1.1 of the Ordinance. Mr.
Kohl said this could come under the decibel meter that the City
is anticipating having within the next month with three man
attending school. A study is being made concerning the decibel
meter and the noise ordinance. Discussion ensued about enforcing
a speed limit for boats amd it was decided to pass the Ordimance
and see~hat happens. If necessary, help could be requested
frem the Sheriff's Department concerning the waterways. Mrs.

Mr. Simon read proposed Resolution No. 75-RR in its entirety. Mr.
Harmening moved for the adoption of Resolution No. 75-RR, seconded
by Mrs. Jackson. Mr. DeLoug appreciated the motion and requested
that a copy of the plan be sent to each individual C~anty Commissioner
for study. Council agreed. Mrs. Padgett called the roll as follows:

by Mr. Harmenimg. Mrs. Jackson hoped the City wouldn't be requested
to contribute any money towards another study on an interchange
and there was some discussion on this point. Mrs. Padgett called

OLD BUSINESS
Discuss Easements for 18C Lateral Sewer Lines (TABLED)
Mr. DeLong moved to take this item off the table, seconded by
Mr. Harmening. Motion carried 5-0.
Council discussed this matter at length and reviewed the comments
made at the last meeting. It was noted that the question of Mr.
Strnad's receiving any special consideration had been resolved
at the last meetimg and concern was now focused on the erection
of a chain link fence at Mr. Zill's property which had been
promised in lieu of some ,Melaleuca trees. Mr. DeLong felt~that
everyone who gave easements, particularly the Farmer inthe Dell,
where most of the sewer work was done sh6~Id~-have their laterals
installed by the City and- the~e should not be a double standard.
He felt Ordinance No. 30-B-32-2-C, Water and Sewer of Florida
No. 281must be amended immediately to read "... all other excep-
tions and/or agreements shall be approved by the City Council."
Mr. DeLong felt Mr. Zill should only be entitled to the free
hook-up and not the fence, as the Melaleuca trees were never
removed a~d that no agreements should have been made outside the
provisions of the Ordinance. Mr. Strnad agreed.
Mr. Marmeming said it wasn't unusual for this City and others
to obtain easements and make certain agreememts for this purpose.

He felt the Assistant City Engineer, Mr. Flushing acted in good
faith and the fence agreement was part of Mr. Zill's consideration
in granting the easement and the City should keep its commitment.
Re felt in ae~iring easements in the future, the Engineering
Department will seek further guidance and Con~cil can enact
legislation if necessary.
After some further comment, Mrs. Jackson moved to have the City
carry out its agreement with Mr. Zill and pass other legislation
in the future. IRt. Harmening seconded. Mr. Strnad said he is
also deprived of using the west five feet of his property and is

After some comment concerning Council's desire to give Mr.
Strnad ¢~asideration, FAr. DeLong wished to qualify his vote
in that ~e~ had nothi~ to do with the commitment that was made.
As am elected official he had not delegated anyone to make an
agreement beyond the provisions of the Ordinance and he does
not oondone agreements made by those without the authority to
do so. Therefore, he would not vote in favor of the motion.
A roll call v~te was requested, which Mrs. Padgett conducted
as follows:

It was noted that Mr. Strnad gave an easement to the City which
was registered a~d filed, but not used. There was a brief dis-
cussion about the procedure involved in returnimg the property
to Mr~ Strnad and abandoning the easement, followed by some
comaLents concerning whether or not Mr. Strnad should accept the
free hook-up. The Council discussed this matter at some length,
reviewing provisions of the applicable Ordinance with Mr. Simon.
Since there was some confusion about how this matter should be
resolved, Mrs. Jackson moved to table the discussion of 18C
lateral sewer lines in regard to Mr. Strnad for further study.
Mr. Harmening seconded. No discussion. Motion carried 5-0.
Consider Correspondence from Department of Transportation - Re:
Proposed Ramp at S. W. 23rd Avenue & S. W. 6th Street
Mr. Rudy Blank, 702 S.W. 25th Place, reviewed some of the actions
taken regarding this matter, including the help he sought from
Sen. Phil Lewis, whose efforts were helpful in getting DOT to
give its consideration. Mr. Blank advised that a letter has
been received from DOT, ad.Vising that the City's request would
be complied with, if the City would spend approximately $20,000
towards the project. Mr. Blank read fr~m the Resolution passed
on this item end appealed to Council to follow through, even
though there would be some cost to the City.
A gentleman ~ho identified himself as Chairman of the public
meeting that was held at the Jr. High School by the homeowners of
his com~nity, advised that more than 70 people had attended that
meeting and were in favor of the Resolution that had been passed.
He asked all who were present from his community to stand now.

He also presented to Council a letter with signatures of those
citizens not presemt who wished Council to agree to DOT~s offer.
}Is advised that the citizems of his community were not critical
of the City's expenditures towards recreation, but felt they
should be in proper perspective and that Council should give
consideration towards spending money in their area for safety.
Mr. Anthony Cevasco, 2638 S.W. 6th Street, referred to newspaper
reports he had read concerruing comments made by the I~ay~r and
Mrs. Jackson about this matter a~d the costs of relecating the
access road. Mr. Cevasco spoke of the problems on 6th Street
and urged Council to give consideration to the expenditure towards
this project.
Mr. Fletcher of 6th Street said he had spoken to Representative
James in Tallahassee several times on this m~tter and Mr. James
was helpful in working with the Department of Transportation. Mr.
Fletcher hoped the Conncilmembers would not change their minds
about going ahead with this project.
Mr. DeL~ng felt that Council had made a commitment to these resi-
dents in the form of a Resolution. In regard to the money spent
for recreation, he noted that everyone in a city must contribute
towards all facilities, even though the facilities are not used
by all the people. He felt there should be no complaint in expend-
ing money to eliminate a traffic hazard and he reviewed the status
of various portions of the budget, indicating there was enough
money to cover the costs that might be incurred.
Mr. Strnad moved to accept the agreement of the DOT, however, Mayor
Roberts asked to speak before any motion was made and seconded. He
commented to the effect that newspaper reports were not always
timely or accurate and he noted the many phone calls he has received
pro and con various traffic conditions. He said the Department of
Transportation requested approximately $23,000 plus or minus, plus a
right of way of which the cost was unknown. Me felt the ramp in
question might not be such a hazard as people thought, since it
hasn't been tried yet. ThefMayor wished to give further though-~
and consideration to spending taxpayers' money in this area, es-
pecially because people would use the streets if they so desired
and also due to the fact that Seacrest would soon be four-lamed
with traffic lights. He felt once this was done, no one would use
the other streets %~nless they lived there and this re-routing would
be just a stop-gap.
Mrs. Jackson remarked about statements made previously by Mr. Hughes
of DOT and she asked Mr. Kohl abent the availability of a map,
indicating where the ramp would be. Discussion ensued, during

which Mr. Kohl advised that a letter from DOT had been received
just prior to the last meeting but it could not be put on the
agenda because there wasn't enough time to notify the citizens
who would be most concerned wi~h this subject.
Mrs. Jackson moved to place this item on the table so that as much
information as possible could be obtained, especially from DOT.
Mr. Blm~k said he was told how difficult it would be to work with
the Department.of Trsnsportatien, but i~ bashaw been shown that
co~peratione~=ldbe obtained. Mr, DeLon~ felt Council should
move with its previous commitment, go along with the
the other problems work themselves out. Mrs.
Jackson noted there was a deadline of October 1st and she also
wished to kn~ what the cost of the right of -way would be. Mr.
DeLong felt it was possible for someone to deed a right of way.
Mr. Blank said most of the residents are concerned with getting
onto 23rd Avenue safely, adding that many of the drivers are overly
cautious because of their age. Discussion ensued about the safety
hazards involved here. Mr. Blank quoted from another newspaper
report concerning co,~,,~ents by Mayor Roberts about the costs, and-
the Mayor repeated that he wished to give the matter further con-
sideration, particularly in view of the right of way which DOT
requested the City to obtain for the relocated access road radius.
After f~/rther discussion, Mrs. Jackson repeated her motion to table
this item until the next meeting so that more information could be
obtained. Since none of the Councilmembers seconded, Mayor Roberts
handed his gavel over to the Vice Mayor and then seconded the
motion. I~r. DeI~ng felt that tabling the motion would kill the
whole idea because there wouldn't be enough time te do anything
by the time this comes up again. Motion carried 3-2 against tabling
this item, with Mrs. Jackson and Mayor Roberts in the minority.

engineering of this project. She especially wanted to know the
location of the ramp in question. Mr. DeLong said the City
Manager was well aware of the sit=ation and added that this matter
had to be expedited to meet with the requirements of the DOT by
October 1st. Mr. Kohl said he would get a ~ap of the area.
The Mayor called a brief recess at 9:35 to allow several people
in the audience to leave. He recalled the meeting to order at
9:40 P.M.
Discuss Curb ~ts - Vice Mayor Joe DeLo~g
Before proceeding, Mr. DeLomg requested a change in the order of
the Agenda nnder OLD BUSINESS, moving Item "E" up one place so
he could discuss the purchase of land by the City after he finished
with this item. Council agreed.
Regarding curb cuts, Mr. DeLong felt jurisduction should be placed
with the Site Review Co~,~ttee, which he confirmed with Mr. Kohl
was still in existence. He did not think enough consideration
was given to traffic control. He noted the provisions allowed
for McDonald's as one instance wh-ere too many cuts were allowed
into a highway with heavy traffic and specified other locations
where there were also too many curb cuts, thereby causing a safety
hazard. He believed the Ordinance designating certain duties to
the Site Review Com~ttee sh~,~Id be emended to include the review
of curb cuts in order to el~nate traffic hazards. Mr. DeLong
said DOT will grant the permit of an individual who is going to
develop if the Oity does not object. He said the Site Review
Co~ittee Sh~Uld~ ce~c~rmL'i~s~lf.~with traffic patterns and curb
cuts aside from just getting in and out and he wished to see the
Ordinance ~a~ended whereby the Co~m~ittee would have complete juris-
diction. After the ordinance is amended he felt the State Highway
Department should be petitioned not to issue any curb cuts unless
they receive the approval from the City of Boynton Beach. Mr.
DeLong moved to amend the ,appropriate Ordinance to include juris-
diction of the Site Revie~ Co~ittee over curb cuts to control
t~affic. Mrs. Jackson seconded. No discussion. Motion carried
Purchase of Land by City for Wastewater Regional Plant from the
City of Delray Beach
Mr. DeLong felt the City should certainly negotiate, with Delray
Beach on the property they own in regard to the Regional Plant,
however, not-in line with today's assessed valuation. He felt
that Delray should not expect to make a profit from Boy,ton, es-
pecially in view of Boynton's tax money which was used by the County

towards the restoration of Delray's beach end to acquire parking
area for beach parking. He felt it was not normal procedure for
one governmental agency to make a profit on enother.
Mayor Roberts agreed with Mr. DeLong and felt that Delray should
try to sell hmlf of the land (17 acres) to someone else at the
appraised value of $20,000 per acre. He refe~ed to Section 7
of the Agreement, noting that the ownership 'of the Regional Waste-
water Treatment Facility shall be vested proportionately with Delray
and Boynton, which would not be the case if the Land cost was so
high. M~yor Roberts believed that Delray was entitled to some compen-
sation, possibly in the form of i~terest of approximately 6%. He
also did not feel the City should have to pay towards the $90,000
in plans empended by Delray. Discussion ensued in regard to trying
to work out a c~mpromise. F~r. DoLing felt it should be determined
whether Delray had purchased this land ~rith a mortgage or outright
as that should be taken into consideration with regard to any
interest to be paid by Boynton.
Council discussed the importence of having a counter-offer ready
in time for the next joint meeting on July 10th. Mr. Hermening
clarified that he never meant to suggest that Boynton should accept
Delray's $20,000 per acre appraisal. Boynton should also get an
appraisal, however, he could understand the hesitation Ln selling
land below its ~ current appraised value, especially in view of the
fact that Delray has held the land through no fault of their own
for approximately three years. He did not recall any comments at
the last joint meeting wherein Delray said they were trying to re-
coup the lost $90,000 for plans they bought which were worthless.
Council observed that it was mentioned.
Mayor Roberts said the door should not be closed on these negotia-
tions, however, he felt that any amount the City does arrive at
should be considered wit~ a provision that if everything falls
through, Delray would re-purchase the lend at the same price paid
by Boynton. After some discussion about whether or not to hold a
special meeting before July 10th, Council unanimously agreed that
a counter-offer be made by Mayor Roberts in the amount of $300,000
as a limit and also that the Regional Plant be treated as a joint
venture with regard to the land as well as the facility, its
menagement, ere.

.Bus at the Beach - Gouncilw~m~- F~,~17 M. Jsn~-~o~
Mrs. Jackson read her statement in favor of providing bus service
to the beach in accordance with the suggested turn around at the
beach suggested by FAr. Cleary in his map presented to Council at
the last meeting. She felt there could he a sign marked "Bus
Entrance Only" to avoid use by other vehicles and after a definite
place has been settled on, it would be safer to let people off and
on the bus on the east side of the road so they wouldn't have to
walk across traffic. Mrs. Jackson moved that the City Engineer,
Recreation Director and whoever else would be involved work with
the Cit7 Manager towards the feasibility of having a bus turn-
around. ~M.r. DeLong said nothing.could be done without the officials
of Ocean Ridge and Mrs. Jackson included anyone necessary in her
motion. Mr. Harmening seconded. Mayor Roberts agTeed that it
wouldn't hurt to explore every item, particularly in view of the
rising gas costs. P~r. DeLong felt a traffic hazard would be re-
established and there were not enough people riding the bus to
take this step at the present time.
Discussion ensued about use of the bus system and Mr. Cleary re-
Viewed the bus route and Problems involved. Mrs. Jackson felt
there would be no traffic hazard created by the buses turning
around at the beach a couple of times per hour. Mr. Cleary sug-
gested involving the County and Mr. Kohl advised that Messrs.
Pippin and Hyman had looked into this matter. Mr. Kohl said he
asked for a report in writing and he would present it to Council
as soon as it is received. Council decided to await receipt of
this report and Mr. DeLong moved to table thi, item, seconded by
Mr. Strnad. No discussion. Motion carried 5-0.

Mayor Roberts referred to section B of Mr. Kohl's report concerning
Annual Permits for residents not within the corporate l{m~ts of
the City and discussion ensued about the shortage of parking~
spaces at the beach. Reference was made te newspaper reports
wh~ein Arty Gen. Robert Shevin said that cities cannot discriminate
~a!nst n~n-residents ~en charging admission to municipal beaches.
After s~e further cc~ment, }Irs. Jackson moved to accept the
revised regulations for beach decals as outli~ed in M~. Kohl's
memo dated June 17~ 1975, omitting Section B - Annual Permit on
page 2. Mr. Strnad seconded. Fir. Simon advised that he and his
associate were in the process of researching this subject and he
requested additional time for completion ef his study before any
final action~,ras taken. Fir. Harmening moved to table this item,
pending the findings and recommendations-of the City Attorney.

Report on Poticies Established by Other Cities on Utility Deposits
Mr. Kohl read the memo from Mr. Kribs, the Finance Director, which
included a schedule outlining utility meter deposit policies of
other cities in this area. Mr. Eribs said he could fimd no reference
regarding utility meter deposits in the City's bond resolutions or
offmcial statements. TAe w~ter meter deposit is stipulated in the
water Resolution No. ~5-W a~d the sewer deposit requirement is con-
rained in Section 23A-6 of the City Code. Me noted that the interest
earned by the City on the utility meter deposits is classified as
interest income of the City'~ water amd sewer revenues. As such,
they become part of the City's average annual met revenues pertaining
to the 125% and 140% rate covenants. Thus, any interest paid en
these accounts would reduce ~he necessary coverage and would have
to be offset by other revenues.
Mr. Marmening said Mr. Kribs' comments were in line with his o~n
feelings and the Mayor noted that no interest was paid, excep~ in
one case where there were stipulations. After some brief dis-
cussion, Mrs, Jackson moved to comtinue with the present policy
in regard to utility deposits. Mr. Rarmening seconded. Mr. DeLong
agreed un~il such time as the citizens object en m~sse. Motion

Mrs. Jacks~ said she noted from the Minutes of varies Board
meetings that several members were absent~ h~ever, she did not
see where they were excused. In s~,eral instances, people have
just forgotten and she felt the Chairma~ or Secretary of each
Board should make some phone calls as a reminder or send agendas
out. It was decided to handle this matter administratively.

Mr. Kohl referre~ to the highlights of his report for the agenda
(copy attached) and felt that s~ch a program was importamt in
the development and grOWth of the City. Mr. DeLomg cemme~ded
Mr. Kohl amd Mr. Fredericks for preparing such a well-reunded
plan and if everyone had reviewed the plan, he wished to move
for the acceptance of the City~ager's reco~mendatiou. The
Mayor verified withMr. Kohl that this was in keeping with what
was done in other cities. C~tmcit concurred with the plan and
Mr. DeLong moved to accept same, seconded by Mr. Strnad. Mr.

Mr. Kohl advised that the Shuffleboard Club has requested the
structi~n of a C.B.S. addition to the Senior Citizen Center for storage
purposes. The existing storage structure is a pre-fab metal building
which is old, rusty and leaky. The storage area is also extremely
over-crowded. Mr. Kohl requested authority to extend the storage
area at an estimated cost of $1,000. He plans te obta/n an out-
side c~ntractor to do the c~ncrete block work, after which all other
work will be accomplished by City crews and the appropriate City
Department ~rill prepare construetion~.~plans for the Building Main-
tenanee Division. If approves, a transfer of funds ~1I be

verified by the department heads involved; checked amd aFproved

Mr. Kohl requested Council's approval to paint all the fire hydrants

Mr. Simon noted that $58,458.41 has been collected as interim service
fees and this sum is being held in the General Fund and must be
placed in a separate escrow account so the City may draw interest.
Mr. Simon said he would have an-4~ffidavit prepared for Mr. Kohl
to sign the folloe~ing day indicating that the.money was transferred.
Mr. DeLong moved to place these monies in a separate escrow account
to earn interest end to be held available in the event the City
wishes to refund at some future date, either as a result of a court
case or if the City itself decides to make said re_~nds at its own
discretion. After some discussion between Council and Mr. Simon
about a perticutar court case, l~rs. Jackson seconded and the motion
carried 5-0.

VI. Tennis Center Facility
A proper facility is mandatory if this sy~cem is to operate
effectively. .An on-the-site building is ~ecessary to provide
visual control of the courts, provide for financial trans-
actions, court assignments and reservations, and storage.
While the existing scout hut is an ideal lm~i!ding for such
a facility, scout use would conflict on s~veral occasions
with tennis center operations. If the scouts could be
relocated to another area, the facility%~atd be perfect,
however, at this time no other known facility is available.
Rather than construct a separate facility, it is recommended
that one room be added to the east wall of the scout hut.
This location would provide for perfect co%Lrt control and
also provide for access to restrooms when the building is not
being used by the scouts.
VII. Hours of Operation and Staffing
VIII.
Tennis center operations have an obligatio~ of providing
quality service to t~ir members as they ~re paying additional
money to use public recreation facilities.
Court hours would run from 8 AM to 10 P~ seven days a week
including holidays. We currently have a recreation specialist
who serves as our tennis pro, and one cour~ attendant~ To
provide total court coverage for the hours of operation, one
part time court attendant will be necessa.ry and is included in
the 1975-76 budget recommendations.
Estimated Revenue
Based on the play and attendance ~-hich o~ Courts receive, and
evaluations of other tennis center revenue receipts, it is
estimated that between $15,000 and $21,0OO will be collected
in the first year of operation.

As tennis court lighting is expensive to install, maintain,
and operate, it ms recommended that a ~1oO0 p e r court/per hour
fee~be charged regardless of menfoe~ship status. This is
standard procedure at tennis centers wit~ payment made through
the use of coin meters or an attendant on duty.
Membership Registration System
Memberships shall be valid for one lrear running from
October 1 of the current year to S.epte~ber 30 of the
following year.
B. Memberships must be renewed each year'with October 31 as
the deadline for payment.

Memberships will be pro-rated on a six month basis.
Memberships issued between April 1 and September 30 shall
be half the yearly fee.
Residency shall be established throug~ proper means of
identification (i".e., Voter's registration, car regis-
tration, utility bills, etc.).
Membership cards shall be issued each year to verify
memberships for tennis court attendants.
Application and payment of membership fees shall be made
at the tennis center only.
V. Fee Collection System
A. All financial transactions shall be ma~e at the tennis

The tennis pro shall be responsible for proper control
monies and submission to the Recreation Administrative
