OPENINGS
Mayor Roberts called the meeting to order at 7:30 P.M. He asked
all to rise for the invocation given by Pastor Roby Snider of
the BoymtomBaptist Temple, followed by the Pledge of Allegiance
to the Flag, led by Councilman Strnad.
Announcements
The Mayor announced that City Hall would be closed Monday, May
26, 1975 in observance of Memorial Day.
It was noted that an announcement by Councilman Strnad would be
moved do%rn to Pnblic Audience. -~
Mr. Kohl requested several changes to the Agenda as follows:
add under OTHER, "Recognition of Police"; "Soliciting for the
Disabled American Veterans, Post #19"; under LEGAL-Other, move
item No. 1 "Consider Amending Ord. 73-15 - RE: 10% Revenue
Sharing for Poor, Aged and Infirmed" should be moved to the
end of the Agenda under OT~ER. Council had no objections to
the above changes.

Mrs. Jackson referred to page 10{ paragraph 3- should read, "How-
eve~ at that time the City did not have an actual ambulance."
Mr. Harmening referred to page 13 at the top of the page, carrying
over from the preceding page, which should read "...should be for
the fiscal year 1975-76."
Mrs. Jackson moved for the adoption of the Minutes of May 6, 1975
as corrected, secomded by Mr. Harmening. No discussion. Motion
carried 5-0.

A~O~CE~:
It is our responsibility as Council members to listen 'to the
voice of the citizens of this city and not let personal animosity
obliterate our duty to the taxpayer.
We must endeavor to do things openly and honestly for the benefit
of all the people and not for just a few privileged individuals.
I mu~t~again reiterate that I want to see all the city business
conducted out in the open in front of the public and not conducted
over the telephone after the meetings are over. We must move
forward, nothing can be accomplished by bickering and long drawn
out discussions in order to ge~headline coverage in the newspapers.
These tactics may impress s~fae.,but the majority of people want to
see some hard work done and things accomplished~ Vicious and corrupt
political machines are spawned on a local level. Block voting is an
early warning sign.
There is no place in Boynton Beach City Government for machine
politics. The only machine we need in our City is a strong machine
of and for the people a~ which I shall continue to strive for.

Mrs. Jackson referred to page 11,
line down, which should read "...
next to last paragraph, 8th
this does cause a hardship."
She also referred to page 12, 9th paragraph down which should
read, "...Mrs. Padgett replied they shouldn't use tax rolls."
On page 13 in the next to last line, the word "comparable" should
beehanged to "compatible".
On page 16, every place where it says '~(r. Atom" should be changed
to "Mr. Arano~'. Mrs. Padgett advised this change had been made.
Mr. Strnad noted page 8, first paragraph, 4th line from the bottom,
which should read "... He continued that the rear setback was not
too bad, but the side setbackshould not be 20 feet on one side
where the rear yard i__saceessible."
Mayor Roberts asked for clarification of a portion of page 17
regarding the Board of Adjustment where it was decided to have
seven me~bers and two alternates. In the next to last paragraph
it was then questioned where four would make a decision as a
majority. Mr, Simon explained that he felt Council decided to
have seven members on the Board of Adjustment, requiring a
majority to grant an appeal which would he four, but a quorum
of five would be required in order to act on any matter. It
was further clarified that the majority was consistent with the
State law and the five required in attendance is an extension to
or more stringent than that required by,State_Statute. Mr. Simon
said this had been clarified before tonight as he and Mr. Barrett
had worked out the correct wording. The Mayor Wmought there was
another portion of the Mi~ates which needed clarification along
the same lines but he couldn't locate the exact place and it was
felt that it too was corrected.
Mr. Harmening moved for the adoption of theM inures of the Special

discussion. Motion carried 5-0.
Mayor Roberts asked all those wishing to speak about items on the
Agenda to give their names to the City Clerk to be called at the
appropriate time.

Mr. O'Meara stressed the need for communication regarding the

to Mrs. Kathy M~am~hm~ Vice Chairman of the Bicentennial Committee.
He wished to return later with a request to City Council.

reported at length on the progress and activities of the Committee.
It was stressed that each co....~nity follow the national program
and embrace three elements, "Heritage ' 76" co~emoratiug the
past and historical sites; "Festival U.S.A.", using the areas
of art, education, athletics, hospitality, travel, exhibits,
fairs and festivals with on interchange and inter-
action; all areas that will+~-mke a better
life for the community, there is another
area --"lasting reminders" and the Committee is in the process
of trying to secure funds to make a movie abont the history of
Boynton Beach, With the fDlm Being made available to organizations,

Mr. O'Meara appealed to Council for a contribution of $6,000
towards the film which would be a matching sum to what the State

would give as a grant. The entire cost of the film would be
$16,235.00, with $4,058.00 in donated labor, and the Bicentennial
Committee would have to raise the rest.
In view of the upcoming public hearing at 8 P.M. and the_fact
that Mr. O'Mearaand the Committee had to leave the meeting,
Mr. DeLong moved to take Mr. O'Meara's request under advisement.
Mr. Strnad seconded. No discussion. Motion carried 5-0.
BIDS
None.
PUBLIC HEARING - 8 P.M.
Parcel #1 - Applicant: Ann L. Sciarto, 170 N. E. 27th Court,
.Request: Conditional Use to Allow Child Care Center
Mr. Barrett advised that at their last meeting the Planning
Zoning Board tabled this request until their next hearing, so
there could be no action tonight.
Mrs. Jackson moved to table this item, seconded by Mr. DeLong.
No discussion. Motion carried 5-0. It was noted that this item
must be re-advertised.
PUBLIC AUDIENCE (tout'd)
Council returned to the discussion of Mr. O'Meara's request for
$6,000.
Mr. Warnke came forward and explained there was a June 1st dead-
line as the State was then having a meeting at which time it would
give away $810,000 in grants to communities throughout the State
who have received matching funds. There is a stipulation that at
least 25% of a project's cost would be in kind (labor) and that
the City or organization put up at least half the cost. ~erefore,
a commitment from the City is needed so that a grant could be
applied for in the amount of $6,000.
Discussion resumed regarding the source of the funds to be donated
by the City and Mr. Kohl reported that he had contacted several
neighboring municipalities to see what they were contributing. It
was found that the amounts were substantially less than was requested
for Boynton Beach. Council felt that a compromise would be more
in erder, such as $3,000. Mr. Simon pointed out that the possibility
of complying with a Charter provision might come up in that the

City Manager is permitted to negotiate up to $5,000, but must go
out for bid beyond that.
After further discussion about m fair donation and some comments
on personal contributions, Mr. DeLong moved to have the City
donate $3,000 towards the efforts of the Bicenternnial Committee.
Mrs. Jackson seconded. It was noted that the Committee would
have to attempt to raise the balance of the funds needed, and
Mr. Kohl ~ould advise Council at the next meeting which account
would be used for the City's donation. Mr. Simon advised that
there were certain procedures to be followed regarding the purchase
of the fill and it was clarified that this donationwas made to
the Bicentennial Committee to use as seem fit. The Mayor felt
that Mr. Eeht may wish to comfer with Mr. Simon regarding this
matter if the Council votes in favor. It was decided to make a
part of the motion that Mr. Kohl follow the usual procedure in
handling this matter. A roll call votewas requested by,ir. DeLong
which the City Clerk conducted as follows:

Announcement by C~uncilman Norman F. Strnad
Mr. Strnad stepped down from the dais to speak under Public Audi-
enc~regardingwhat he felt to be inaccurate newspaper reports.
He wished to have his ~ritten statement regarding the activities
of City Councilmombers read into and made part of the record
(attached hereto), and asked that each Councilmember think
carefully before making any statements to the newspapers. It
was stated that the statements Mr. StEad felt to be erroneous
would be made known to the Council at a later date.
Mr. Sidney Schwartz, 1006 S.W. 18th Street, referred to his May
6th appearance before Council to present a plan he felt would be
beneficial to the youth of the City and he challenged comments
he had read which were made by the Mayor regarding youth and the
elderly. He referred to various crime statistics and co~aented
on the efforts of the City's Police Department.
Mayor Roberts complimented the work of the Police Department and
said ~hat he and Mr.:Kohl had looked in the matters that Mr.

Schwartz had brought up at the last meeting. He felt that the
comments he made reflected his feelings tBmt everything in the
City wasunder control.
Mr. R. B. Vastine, President of the United Boynton Civic League,
c~mplimented the work of the Planning & Zoning Board over the
past 2-3 years, specifically in the preparation of the new Zoning
Ordinance an4 Zoning Map. He especially noted the contributions
made by Mr. Jack Barrett, Building Official and .complimanted the
City Council for its efforts as well.

The Mayor recalled that he had brought this matter up for repeal,
however, it left a void in the City Charter. Therefore, he felt
it could be re-~ritten~o theMe-~buld~ereference to the State
Statute. Mr. Simon said the only difference between this version
and the one previously presented to Council was in the addition
of a '~Whereas" paragraph at the top of the Ordinance and the
reference is to Chapter 74-130 of Florida law, however, it has
not yet bee~ codified into the State Statute so it cannot be
referred to as a permanent section which would be desirable in
Boynton~s Code. He suggested when this is sent up for codification,

a request be made for an Editor's note with reference to the
appropriate section. He suggested delaying the passing of this

was ready for final approval due to a misunderstanding in procedure.

Consider Amending Board of Adjustment Ordinance - Re:
for Granted Variance
Time Limit
Hr. Kohl said a meeting was held early this week with the Building
Official, Mr. Jack Barrett, and the City Attorney, Mr. Simon
regarding this matter. As a result of this meeting, it was
determined that the Board of Adjustment should set a time limit
for a granted variance. Hr. Kohl recommended approval of this
request.
Mayor Roberts asked if this had to be redrafted in the Ordinance
which was read and Mr. Simon said this matter concerned whether
or not the Board of Adjustment could grant variance with a time
limit. It would be more preferable to say it could rather than
should and he ~ead from the State Statute, Chapter 163. The
language in the State Statute could be incorporated in the City's
Code. Hrs. Jackson moved to accept the City Manager's recommenda-
tion above. Hr. DeLong seconded. No discussion. Motion carried
5-0, Hr. Simon explained that the provision is in the proposed

Code already. It was further clarified that no action was re-
quired at this time. Discussion ensued as to what a reasonable
guideline would be as to time limits. It was noted that the
Building Official or a member of his staff would be at all Board
of Adjustment meetings and that time l~m~ts would be left to
the discretion of the Board upon receipt of all pertinent informa-
tion.
Clarify Proposed Zoning Ordinanc.e - Councilwom~ Emily Jackson:

Mrs. Jackmonnoted that ~n the old Building C~de, nursery schools
were not permitted in a residential are~and she felt this was
not the place for them. Hr. Barrett expIained that they are not
permitted until theyr~, an~-2 with no c~ditional use.
Regarding hotels, motels, etc., it was clarified that S.W. 15th
was not zoned as there was nu allowable use fur them and this was
taken into consideration.
Mrs. Jackson questioned the portion of the Zoning Ordinance
in regard to cormer~:lots and the 30-foot side lot allowance
and Mr. Barrett said it ~ould have to be corrected, indicating
some setback ~u the street side, and he would revise this the
next morning. Mrs. Jackson also questioned the provision regarding
40% lot coverage and felt it should perhaps be larger, but she
accepted the provision after some c~ment from Mr. Barrett.
OLD BUSINESS
Consider Abatement of Lien - Mr. Arnold Stroshein
Mr. Kohl advised that this matter has been pending since January
and the entire file was before Council for consideration upon
the advice of the City Attorney. Mr. Kohl said that Mr. Stroshein
is the only one on the street who has not paid for his assessment.
Mrs. Jackson brought other information to the attention of Council
and quoted from the Minutes of February 2, 1970, July 20, 1971
and December 19, 1972, etc. She noted there were hearings on this
matter and everyone else has paid their assessment and considering
what has transpired according to the Minutes, Mrs. Jackson did
not feel Mr. Stroshein was entitled to any abatement.
Mr. DeLong said he has read the relative Minutes and Ordinances
and moved that the request for abatement of lianbyMr. Stroshein

Status Report onMr. Ben Johnston's Radio Tower
Mr. Kohl advised that Mr. Johnston is making good progress toward
cleaning up this site and making every effort to comply with
requirements. Court case has been postponed until May 30, 1975.
This was verified by the Building Official, Mr. Barrett. Mrs.
Jackson referred to the complaint of dumping dirt at night and
Mr. Barrett said this has been cleaned up. He said Mr. Johnston
rents there at the present time, however, he owns approx-'mmately
30 acres out in the County where he is trying to build now.
Mr. Strnad said he would like to see a copy of the FCC license
granted to Mr. Johnston for the to~er on the property so that
he could see if it is approved before he votes on the matter.
Mr. DeLong verified withMr. Barrett that Mr. Johnston still has
to answer for the violation of erecting the tower without a
building permit. It was noted there would be no action taken
until such time as Mr. Barrett shows Counail ~he~C permit
which he verified.
Proposed Resolution - Re: Co--ending Planning & Zoning Board
and Acting City Planner, Mr. Jack Barrett - Councilwoman Jackson
Mrs. Jackson read a portion of the Minutes of February 27, 1973
regarding an errene~us timetable on the Zoning Ordinance and Map
whichwas presented by a former City employee, Mr. Largent. Mrs.
Jackson complimented the efforts of the Planning & Zoning Board
for the years 1973-74-75 and she requested that Mr. Simon draw up
a Resolution commending these people. She then moved that this
Resolution be read, seconded by Mr. DeLong. Mrs. Jackson requested
some before the reading to say ~Boards~' in the second
and in the last line and in Section t, say ~'The Planning
&.Zoning Boards of 1973~ 1974 and 1975 ..." Mr. DeLong said he
didn't feel the new zonmng and map actually got off the ground
until 1973 when some changes were made, including the termination
of the ~ity Planner at that time. Mrs. Jackson added that the

work accomplished was done by the citizens themselves in the
form of the Planning & Zoning Board as a voluntary effort with
the help of Mr. Barrett. Some reference was made to a letter
of resignation received from one of the Board members and it was
hoped he would reconsider, After further coaa~ent by Mr. DeLong
concerning the commendable ~fforts of everyone involved, the

Mr. Harmening asked for reconsideration of this matter as
after reviewing ali the information, he felt he did not vote in
the best interest of the citizens of the City. He felt the Police
Report on this matter refutes the earlier feelings that this
location was a safety hazard and he read a portion of the Report.
Mr. Harmening moved to reconsider the action taken at the last
meeting. After some discussion about the motion, the motion
carried 5-0.
Mr. Harmening felt if the triangle was removed in accordance
with the wishes of the petitioner, anyone could cut through
the lot the same as before. He questioned why the lo~ would be
beautified after the removal of the triangle when no attempt
had been made to do so before and added the triangle was created
by the Department of Transportation; therefore, it should be
removed by DOT. He could not agree to spending $1,000 in this

area in that he felt only one or two people would benefit and
there were other ways to spend this money where more people
would benefit. Me also felt to,abandon this property to the
owner of the adjacent property might be considered as adding
insult to injury. Mr. Harmeming moved to instruct the City
Manager to leave the triangle in its existing state without any
further work. Mrs. Jackson seconded for discussion purposes.
Mr. said that his information was that all the people
near the were opposed to it and no one wished for it
to r~m~in, he would try to help anyone with a reasonable
request and felt the hazards in the urea~ere definitelypotential.
Mrs. Jackson said she voted for this on the grounds that Lt.
Gardmer~ said it was a traffic hazard. She referred to traffic
conditions on ~th and 8th Streets and the use of cement stops or
buttons which were used to prevent cars from driving in a
particular area. Also, at the triangle in q~estion, large stones
were pla~ed there so no one could ~rive there. Mr. DeLomg felt
that L~, Gardner's report was very vague. Mayor Roberts said
he spoke to several people in the area. He felt a hedge could
not be put. there because it w~uldobstruct the view coming out
of the street and possibly there b~ a ¢ompromis~with the
hard dug up, some put in with a~¢ouple of
a c~nclusioneouldbe reached. Mr. DeLong

Discuss Request of Cemetez7 Board - Councilman Strnad
~Ir. Strnad wished to know the status of the proposed mausoleum
which hasbeenunder consideration for some time. It was noted
that Mr. Kohl had given Council a letter on this matter about a
year ago and the Cemetery Board wishes to borrow ~ome money.

Mr. Edward D HurfDrd, Chairman of the Cemetery Board, spoke at
length on the merits of having a mausoleum in view of the increasing
scarcity of space. The desired place for the mausoleum would be
om the west side of the cemetery, next to the ball park. He
explained there is approximately $197~000 in the Cemetery Trust
Fund which is to be used for the maintenance of the cemetery=
Mr. Hu~f~ said he became-~saem~er~f the Board while hewas in
the life insurance business and has been a m~mher longer than
anyone in the City -- 18 years. Mr. M~'s overall estimate
of the mausoleum, including the nursery work, etc. would be
$259,000 an~ it was =equested that the City land the Cemetery
Board this sum for the construction of the mauso!eumas the
Trust Fund was presemtly tied up in Certificates of Deposit.
Various ways in wb/ch the money could be
repaid ~ ~as felt by council that Mr. Kohl could look into
the matter further to determine~h~e the'Oitywould get the
funds and also~iscuss the procedure wit]~ the City Attorney. It
was clarified that the $197,000 would be used as collateral for
the loan. Fir. Harmening noted that a fe~Qfthe ~D's %rill come
due shortly and perhaps they could be cashe~ in at a small loss
to help defray a portion of the cost so the City wouldn't have
to come up ~ith as m~ch money.
Council discussed the handling of the Certificates of Deposit
at length. Mr. DeLong felt this sit~ationwould have to be
considered among other priorities, although the cemetery will
make money for the City. Mr. Harmening felt the Council should
express its willingness to cooperate in this endeavor and as
rapidly as possible if the mechanics and finances can be worked
out. Mrs. Jackson moved that the City Manager and City Attorney
look into this and consult Mr. H~mfo~d if necessary and come back
to Council with a report. Mr. Harmening seconded. No discussion.

Mr. Strnad suggested moving on to the last item under OLD BUSINESS
as some people had waited a long time for this to come ~p. It was
decided to just rearrange the last and next to last items (F and C)
accordingly.

Mr. Strnad said he has investigated this matter quite thoroughly
and he felt it would be appropriate for Council to consider this
request without any hesitation because of the amount of people
going d~ to the drug abuse center from Boynton Beach.

Dr. Carl Carter came forward and referred to the letter which
Council received from Mr. Fr~k L. Carey, Jr., President of
the S~uth County Drug Abuse Fonndation, Inc. dated April 16, 1975
and requestimg an emergency appropriation of $1,000 to see the
Foundation through this difficult time. A request was also made
for consideration of e~atinuing financial assistance for~the
75-76 fiscal year in the amount of $6,000. Dr. Carter noted
that the Foumdatien is mo longer known as the Delray Beach Drug
Abuse Foundatiom and he gave a brief history of the organization,
referring to material that he had passed out to Council. He
netedthat the FO~ndationwas funde~ 70%by the Federal Govern-
memt, however~ the present financial problamwas due to no
l~nger heinga recipient of fu~s fr~m the Delray Bea¢~ Community
C~est, which the is ~rying to regain. Dr. Garter
noted thai 20-40% of those they treat come from
Boynton Beach. It was Clarified that the Foundation is. a non-
p~fit orgamizatien, run hyanindependem~Board of Directors
a~d it is not a per se -- no funds Come from
the County, but is 7.s~bsidi~ed from a ~I~Agrant.
Mr. DeLong recalled that an appeal was made for funds along
these lines either in 1973 or 1974 andthe City was even going
to attempt to rent some quarters for tham, although it. was a
different organization. Me felt that Delray was heing~ of great
help in having the Foundation located there and Mr. DeLong
prevailed upon the Council to give this matter a good deal of
consideration. Mr. DeLong moved to grant the amergenc~ request
of $1,000, seconded by Mr. Strmad. Mr. DeLong. requested further
imformatien on the $6,000 request. Motion carried 5-0.
Discuss Traffic Si~lizat~n imLeisureville - Councilman Strnad
Mr. Strnad said in requesting a Resolution several Council meetings
ago to be sent to the County to continue S.W. 15th Avenue, he was
remiss in not asking at that time for consideration in sending a
Resolution for traffic signalization at S.W. 15th Avenue end 18th
Street which will be two main arteries in Leisureville w~en 15th
Avenue is completed. Mrs. Jackson questioned whether it might
be considered to try and get the developer to do this and she
asked whether this was ever considered when Leisureville was first
platted back in 1969. The Mayor suggested having the City Manager
look into this matter and contact those who would be concerned
in Leisureville.
Mr. Zack, one of the Directors from Leisureville,~ said he contacted
the Ci~yMenager about 8 months ago about signalization on 804 and
and Leisureville Boulevard and other intersections. He felt that

15th Avenue was also discussed, however, it was not actually now
in Lei~areville but would effect the traffic situation there
eventually. Amy action the Council takes in this behalf would
be appreciated. He said on April 7th a letter was received from
DOT, advising that a traffic light wasn't feasible om 804 amd
Leisureville Boulevard but this and other sections would be
reconsidered at a later date. Mr. Zacq~ said there were also
discussions with the City Manager concerning lighting, with an
additional light on Leisureville Boulevard and four lights on
18th Street, alth~agh there is a problem*~gettimg easements from
the residents; also some street lights are needed on Congress
and Golf Lane.
It was decided that Mr. Kohl would l~ok into the situation re-
garding S.W. 15th Avenue and 18th Street. Mr. Strnad said he
would like to have a Resolution sent to the proper authorities
in.reg~ard to~i~g 15th Street finished and it was stated that
this has already>~been done. Also, plans are already underway
regarding 15th Avenue east to U.S. 1. Mr. Strmad moved to have
a Resolution dra~m up reqnestimg a traffic light on the corner
of S.W. 15th Avenne and 18th Street. Mrs. Jackson seconded.

NEW BUSINESS
Discuss Zomin~ Moratorium - Councilwoman Jackson
Due to past experience, Mrs. Jackson moved that the City Attorney
have an Ordinance drawn up for the next meeting that at the time
the new Zoning Ordinance goes into effect June 13th, there be a
moratorium fer 90 days before any changes be applied for. This
would allow for an opportunity to see hew the map is working out.
It was clarified that the moratori~ was still on and this was a
request that it not be lifted for 90 days. Mr. DeLong felt the
City should be able to use its discretion as to when to lift the
moratorium. Mrs. Jackson suggested having a building moratorium
temporarily until the zoning map goes into effect, so no one could
come in-under the present zoning map. Mr. Barrett said he doesn't
have a great deal of applications now, but when it is learned that
the new zoning map is going into- effect there may possibly be
many applicatiens for building under the old zoning map. He felt

Consider Feasibility and Need of a Youth Center
Mayor Roberts referred to the discussion earlier this evening
on this subject. He said he based his remarks on not needing a
youth center on a visit he had with Mr. Kohl and he wonldabide
by said deciszon. Mrs. Jackson moved to strike this item from
the agenda, seconded by Mr. Harmening. Motion carried 4-0 as
Mr. DeLong was temporarily absent.
Consider Beautification of Royal Palm Village Clubhouse Area
F~. Kohl advised he has previously discussed this matter ~ith
City Council and he asked for permission to proceed with this
project, as well as C~cilWs wishes in regard to seeding or
sodding the area. He compared the cost of e~chof thes~ processe~
amo~mtimgte $2,050 - seeding and $3,300 sodding. If Council
approves, funds are?available in Account No. 851.64. The plans
are in the City Manager's office for review or can be seen
at this evening's meeting.
Mr. Harmening moved to approve the City Manager's recommendation
and proceed with this project. M_rs. Jackson seconded with the
amendment that Mr. Kohl proceed with the seeding. Mr. Kohl
suggested that sodding was the better method and Mr. Strnad
agreed. Mrs. Jackson spoke about her success with a particular
typ_e of seeding. The Mayor agreed that sodding was best. Mr.
Strnad moved to accept the City Manager's recommendation and
proceed en this project using sod end the other specified plants.
Mr. DeLong seconded. Mr. Strmad asked if it would be Argentine
Bahia and Mr. Kohl said he ~ould try to get this. He also
stated that a sprinkling system was already in. Motion carried
5-0.
Mr. DeLong was advised that the item on the feasibility of a
Youth Center was st~nkem from the Agenda. Me advised Mr. Kohl
to consult Chapter 959, Youth Services of the State Statute if
necessary in the future.

Comsider Request of Community Appearance Board
Mr. Barrett said this is the first time the CAB has not recom-
mended approval of a project to City Council. Mr. Barrett
wished to know if Council approved of the CAB's recommendation
in denying this request concerning Florida-Bahamas Seafood in
the repair of their building. Council discussed this matter
at length as to whether the GAB!s reco,..,endation should be
approved or not concerming theaesthetics of the building in
question. ~r. Simon reviewed the provisions of the Ordinance
involved and said Council would have to ask itself certain
questions -- do~ the submitted plans and specifications meet
the various criteria required by the Coum~u~ity Appearance Board
and secondly whether or not Council should approve the application.
This is done after review bY the CAB which is signified by the
signature of the Chairman or Vice Chairman. Council then approves
or disapproves the application; not the recommendation of the
CAB.
Mrs. Kitty Deneen of the Co~w~unityAppearance Board came forward
and explained the Board's objections in this case. She said
the applicant did not submit a full set of plans which the Board
had requeste~. Mr. DeLong referred to the Minutes of the CAB
dated April 7, 1975~ which indicated that the sketches presented
did not meet with the aesthetics required. It was clarified
that this was phase one of the work to be done as there are other
changes to be made later. Fir. Barrett explained .that he required
the owner to repair the building and putting the facing up is
of the owner's own volition and this is what the CAB did not
approve.
Mr. DeLong moved to uphold the actions of the Community Appearance
Board which _would hold up the issuance of any building permit
and give the Building Official a reason to withhold same. Dis-
cussiou ensued as to litigation in which the o~aer is involved
with the telephone company which may continue for years. It
was clarified that the Building Official cenld issue a permit
to fix the cracks, but not to reface the building end also, the
business would not close down because of this delay. Mr. DeLong's
motion was changed to deny a building permit for the refacing
until the owner complies with the wishes of the CAB and submits
a complete set of plans and specifications. Mr. Strnad seconded.
Motion carried 5-0.

Consider Request of Mr. Sherwood A, Jones- Application of Licens..e.
A copy of the original application for li=anse was before Council,
along with a copy of a letter from Mr. Jones. Mr. Kohl's letter
for the Agenda advised that Mr. Jones has previously been licensed
and is now in business in the City selling mini-buses. He would
like to expand in~used car and truck sales as well as m~nor
mechanical repairs. A voluminous file concerning Mr. Jones is
in the City Manager's office which can be reviewed by the Council.
Mr. Jones appeared before Council and offered to answer any
questions the Councilmembers might have. Mrs. JacksOn referred
to some phot~swhich were taken in September 1974 of Mr. Jones
previous place of business in Delray, however, his lease there
expired the preceding June and he no longer occupied the pre_m{ ses.
Mrs. Jackson then referred to Minutes of one of the meetings
at which Mr. Jones had made application and his request was turned
down because it %msn't under cover, but she noted that approval
was granted two weeks later to McCoy Motors which is not under
cover. Mr. DeLong felt this was not so, however, he was the one
who specified having all such businesses under cover. He felt
no additions should be made to a honky tonk atmosphere which
already existed. Mrs. Jackson said the approval to McCoy Motors
was in the Minutes. She asked Mr. Jones if he would comply with
the wishes that were specified by the Community Appearance, Board
in line with landscaping etc. and he said he would. Mrs. Jackson
said she lived ~mear-t~he area in question and she asked Mr. Jones
if' he had spoken to any of his neighbors about his plans. Mr.
Jones said Council had copies of letters from his neighbors who
would be concerned. Mrs. Jackson felt if one place was allowed
to operate, another should be also. She therefore moved that
Mr. Jones' request be granted. She asked Mr. Simon if a license
could be granted with conditions and he advised that a conditional
permit could be granted. Mrs. Jackson repeated her motion that

approval be granted for a license to Mr. Sherwood Jones of

certain offenses in October 1974 and again in Feb~aary 1975
and Mr. Jones said yes.
The Mayor felt Coumeil might want to look into the matter of
Mr. Jones' applicative a little f~tther. After some discussion,

Mr. Kohl referred the Co~cil to his letter on this subject,

Ordinance 73-15 - re: Revenue Sharing
Mr. Kohl did not know the exact amount but asked to have it placed
in the General Fund inasmuch as the Government gives a couple of
years to spend this money. Mr. DeLomgmoved that the Ordinance
No. 73-15 he amended to enable the City to transfer the f~nds
that accumulate, when necessary. Mrs. Jackson seconded. Mr.
DeLong clarified that ~'when necessary" would mean when it is felt
that the f~nds have accumulated to the extent that they become
idle. The motion was amended to include the phrase, "subject to
Council's approvaL£n the majority." Motion carried 5-0.
