I am Mrs. Kelley Kirton. I am a taxpayer, we reside at 2526 SW i3th Court° This is in the 2nd addition of Golfview Harbour Estates. I am here tonight w£th Kelley, I represent my- self and I am laboring under the premise that God (Truth) plus one, is a majority, I do not need to whip up the emotions of a lot of my ~ighbors and come before ~ou in anger. I have ~ : :--' '--' '~ intestinal fortitude to proceed in a dignified manner, exercise my right as a taxpayer and ~e a grateful American for the Freedom we have which is so precious. Mr. Mayor - May I please have the City Attorney verify if the xerox copy I purchased downstairs in City Hall is a duly executed legal d~cume~t. I vrant to be sure this has not been superceded, (If he says that it is, and-it does contain his signature, then I will proceed with my prepared statement.) For over two years, Kelley and I have lived in an area where there iS confusion and many rumors. We live among wonderful people who came to Boynton Be~ch to live in peace and harmony with their fellow n~ighbors. Many are quietly listing their homes for sale and want t6 leave, we have decided to exercise our right as taxpayers and since Kelley is or ~ras retired he keeps the office while I dig into and research the ~ublic records to ,bring the T1UJTH out in the open, ~ am appalled at what I have discovered. It has taken many, m~_ny lOr~ hours in research, much patience and tolerance. I very s~mply have a purpose in_coming here tonight~ That is to zero in on the S~ipulation and Agreement in Case %72C193 in the Palm Beach Co. As I understand it, this construction of a Clubhouse is si~i,'la~, to pay/rig alimony° It was ordered by the court, I am. wa~ting the deed recorded, so the Home 0wner. s o%.~.,what the court ordere~_~ I have been trying fo~ months to take a look at ~he deed for the Clubhouse and grounds, in view of the fact this facility has been in us~ lot quite a period of time. I am alleging, to my knowledge, it has not been recorded as Judge Hewitt requires in his order. I discussed this with the President of the G%~H~%, Inc. who~ in my opinion, is a fine person capable of leading if he is permitted to do so. I am informed by him this deed has a Clause which in ~y opinion is in conflict with the court order calling for a conveyance "in fee simple title". I also approached Mr, Michael, I had been informed this Clubhouse will revert back to him and his heirs if this organization fails to function. Kelley deposited $50.00 to open the account. Kelley is also interested in the children of GVH. We want to eventually retire in a neighborhood where there are cbitdren and this is why we started this civic project while we are still actively engaged r 'z -' in a National sales o ganx atzono There are no recreation facilities for children and this is not conducive to their best interests, in our opinion. We tried to help. Pressure was brought to bear on me to surrender my funds to the board which I refused to do. I had it in an account with another signature on it so no one, not even myself~ could draw out any funds, without someone else signing° I want to release these funds to the young mothers to buy whatever they want for their kiddies but I refuse to surrender my hard earned money for play- ground equipment so long as the deed to the Clubhouse and grounds has not complied with the Stipulation and Agreement aforementioned. One after another resigned on the Board° Many people have tried. This is tangled up like a plate of slin~y spaghetti. I decided to first exercise my right as a taxpayer and an indiVidU~at. Col. The essence of the con- versation was that as residents and taxpayers of Boynto~ Beach, they wanted the City to do whatever Was necessary so ~hat sewage did not bac~ up into their showers and toilets. I have reviewed correspondence on this subdivision as furnished by ~. Clark. I have also inspected the pumping station with ~ir. Mike!s and the pump station crew. Mr. John Johnston bas reviewed the distribution and collection systems. For the City to take over the water and sewer systems the following items must be done: Water Distribution System a. Six (6} valve boxes to be replaced. b. Locate four (4) vatves and install valve boxes if' they are missing. c. Raise two (2) fire hydrants. d. Provide legal easements for all water lines. e. Spot check by owner as to location of PVC water lines to determine if they must be relocated to prevent potential damage to buildings in case of break. There is at least one mnstance where this condition exists, and there may be others. The City requires a water line to be at least 10 ft. from ~ny and ail buildings. Sewage Collection System a. Install manholes in place of existing clean outs at high ends of all of the 8u lines. b. Raise one manhole top to gronnd elevation. c. Repair invert in one manhole. d. Install one (1) manhole near 061~ on ~xistin9 251 long 8" lateral connection. e. Furnish easements of 10' widths for all sewers. fto Sewage Pumping Station a. Replace existing wet well which 8' wet is 4' in diameter with Frank Kohl, City Manager M~rch 4, 1975 Sewage Pumping Station (Continued) b. Properly re-install Flygt Pumps with guides for removal and service, and gate valves on each pu~np. c. Re-work control system including hand, off, automatic so all of the equipment works.properly. d. Provide ladder and spa%t, hinged metal top which can be opened for easy access for cleaninq a/~d maintenance of the new wet well. e. Provide emergency electrical plug for using generator to operate station during power and./or electrical problems. f. Provide easement m~rom station to roa~ay where ~r~ck can pull in with emergency generating equipment. g. Provide water connection for wash d~nof static%~. h. Provide shop drawings and manuals of all equipment in the station. i. Provide emergency alarm (sound and light) to prevent back up of sewage into house.
