Minutes 12-03-74MINU~ OF REGUI~ CITT COUNCIL MEETING OF THE CITY OF BOYNTON BEACH, FLORIDA, HELD AT CITY HALL, TUESDAY, DECEMBER 3, 1974. PRESENT Joe DeLeng, Mayor David RoBerts, Vice Mayor Forrest L. Wallace, Co~acilmam Edward F. Harme~ing, ¢omacilman Norman F. Strand, Councilman FramkKohl, City Manager Ernest Simom, City Attorney Callie Clayton, Acting City Clerk OPEE~iNGS Mayor DeLong welcomed everyone amd called the meeting to order at 7:35 P. M. He requested everyone to rise for the i~voca- tiom given by Mr. Frank Ko~l, City Ns_~ager, followed by the Pledge of Allegiance to the Flag led by councilman Edward Harmening. Anaoancements Mayor DeLong amnoumced that one of the members of the Board of Adjustment, FraRkLucas, passed on and he certainly served the City well. The City Manager wants the approval of the City Council to forward a certificate of appreciation to his ,widow. The Council members agreed a~d Mayor DeLong requested Mr~ Kohl to carry this out. Mayor DeLong anmoumced the presentation of service awards to City. Employees. Mr. Kohl announced that the following em- ployees ha~ given ten years of service. Edward P. Euacha~ - was hired on February 13, 1964 as a skilled laborer. He was promoted to Utility Serviceman on November I, 1966. Mr. Hmnchar appeared before the City Coumcil amd Mayor DeLong presented him with a service pin on behalf of the citizens of this City and City officials. He stated he was pleased to present this token for his esteemed loyal service. Ma~arie Alexander - was hired on August 17, 1964 as a Clerk I. She has served as clerk, billing machine operator, per- sonnel clerk and ok October 1, 1970, she was appointed Super- visor of the Utility Collection Divisiom. Ms. Alexander appeared before the City CoUncil and Mayor DeLong presented her with a service pin. He stated it gave him great pleasure as one of the elected officials to make this presentation. He has come in contact with her during the years and is very pleased with her loyalty a~d work. Please accept this token of appreciation from the City of Boynton Beach. Mr. Schneider appeared before the City Council and Mayor DeLong presented him with a service pin~ Ne stated it gave him great pleasure to make this presentation, even though he took the dogs that his wife wa~$ed. He was hired as a truck driver aud on August 26, 1970, he was promo%ed to Equipment Operator Iii, the position he now holds. Mr. Waters appeared before the City Council and a~d may you continue. John Harrington - was hired by the City on July 28, 1954 as a laborer. He was promoted to Equipment Operator I on Novem- ber 1, I~66 a~d again promoted to Equipment Operator II on December 31, 1970. Mr. Harrington appeared before the City Ellis McAroy - was hired by the City on August 16, I954 as a truck d~iver. He has served as laborer, refuse collector and Equipment Operator I. He was promoted to the position of Equipment Operator II on October 4, 1973. Mr. McAro~ appeared before the City Council and M~yor DeLong presented him with a service pdm and $25.00 savings bond. He stated he believed a day hasn,t passed when they haven,t met, e~cept when he did not work on Saturdays and Eundays. M. It is being spom- sored by ~he Ohamber of Commerce in the City of Boymtem Beach. This is going to be a gala event and the ~iggest parade im the history of tko City. Mayor DeLong asked if anyone in the audience wished to speak in favor of this ordinance and received ac response. Other Request Authorization to Sign Lease Between City of Boymton ~each and James Hopkins Mr. Simon read the above lease i~ its entirety. Mayor DeLong ~uestioned if he drafted this and Mr. Simon replied: yes, it is almost a duplicate of last yearexcept for the chamges of dates and amoumts. Mr. Harmening questioned the difference in amount and P~. Kohl informed him it was from $210.00 to $220.00 per momth. ~Lr. Wallace moved to authorize the sig~- ing of this lease betwee~ Boynton Beach and James Hopkims. Mr. Strnad seconded the motion. No discussion. Motiom car- ried 5-0. Mr. Kohl referred to a memo he issne~ to Ohief Huddleston informing him that whenever a citizen wanted to swear out a warrant amd there is a valid ordIr~uce om the ~ooks, there will be no $t0.00 court charge to the citizen unless it'm a domestic problem. Nr. Wallace stated he asked for clarifi- cation becamse people living in the City wanting to file a charge had to pay $10.00 and then appear in court. He did not feel a citizen should have to put up this $10.00 fee. Mr. Kohl stated he issued a letter clarifying this and Mr. ~allace replied that this is what he wanted. -6- MI~UTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA DECEMBER 3, 1974 OLD BUSINES- S Request of Ma~or Joe DeLon~ Mayer DeLong requested the City Manager in conjunction with the Fire Department, Bmilding Official a~d City Attorney, if necessary, to do something about developers putting up club houses with no provision for auxiliary lighting in case of Ee gave example of a hamard. It is just questionable ~bout: omitting things that are unconstitutional. The sec- t~ons that have been bracketed are all ~mco~stitutional. Section 16 refer~to Qualificatioms of Councilmen and he ~eelsthey shout~ b~na fide reside~t~ of the City of ~ynt~n Beach ~ ~--j..' _i~-'~.~Nayor DeLo~g ~ted he believed they did have to qualify and Mr. Roberts he,lied that he felt it should be a resident. Mayor DeLong ~geSted to prevail u~o~ the Council members in making a ~e~ie~, they should elzmimate some things which are outdated a~ omtmoded as there are other laws that have superseded. Mr. Roberts continued that the same applied to Section 52 ~a~d the~rack~ted ones should be removed a~d wording in- serted, ~/~/~ ~L~ ~ ~ ~ ~ ~ ~ /~. ~ Mr. Roberts then referred to Section 56 stating it was a ~i~tle different. There may be some additions the Gouncil members may like to add. In reference to special meetings, perhaps it might be to our advantage to include the time ~ive~ prior to a meeting and possibly inserting s~mething ~out telephoning. Mayer DeLong snggested conveying his thoughts to the City Attorney when he was drafting the ordi- ~ce. M~. Mr. Roberts questioned whether these same restrictions should apply to Board members. Mr. Simom~ pointed out they should be caref~t mot to exclude some people that may be good for Boards. Mayor DeLong meted there would be limitations te this amd sug- gested considering the background of the person applying for the Board positiom. Mr. Eribs, Finance Director approved. Mr. Eehl stated he these items, excluding all the bills from ~ did not have all his ~apers on Russell & Axon and would wait until the next agenda. ~. Kohl read a letter from John Schneider requesting eon- mideration of his application for Animal Warden from Jan- uary I, t975 to December 31, 1975 and an extension of his retirement. Mr. Kohl stated the Police Chief was in favor of this and he concurred. Mr. Nallace moved to accept the City Manager's recommendation. Mr. Strnad seconded. Under discussion, Mmyor DeLong read Ordinance 68-10, Section 5.3, pertaining to delayed retirement. Motion carried 5-0. ~ay~or DeLong added that he didn't think they could find a better man for this particular job. This man loves his job and the animals love him. Mr. Kohl read aa application requestinE a beverage license from the Trinity Building Association, Knights of Columbus, located at ~0~ Old Dixie Highway. He added that it had been approved hy the Building Department. Mr. Roberts moved for approval, seconded by Mr. W&llace. No discussion. Motion carried 5-0. Mr. Roberts referred to members on the City Boards. It is customary for the City Clerk to make up a list of the Boards and their present members. He mentioned previously that the City Council would, like to hear from people who wou]d like to serve on these Boards. He reminded everyone wishing to serve to please advise them and submit a resume. Mayor ~eLong agreed a/~d stated he believed the Council should es- ablish that a resume must be submitted. Mayor DeLong declared a recess at 8:25 P. M. until they re- ceived the election results. Mayor DeLong called the meet- lng back to order at 8:30 P. M. upon the arrival of Mrs. Padgett.
