1. CALL TO ORDER
Vice Chair Hohner called the meeting to order at 3:30 p.m.
2. ATTENDANCE
Secretary Prainito called the roll. A quorum was present.
3. AGENDA APPROVAL
Ms. Glinski advised she wanted to add the appointment of a Chair under New Business
Motion
Ms Glinski moved to approve the agenda as amended Ms. Prainito seconded the motion
that unanimously passed.
4. APPROVAL OF MINUTES — December 13, 2012
Motion
Ms. Glinski moved to approve the minutes. Ms. Prainito seconded the motion that
unanimously passed.
5. RECEIPT OF REVENUE /EXPENSE SHEETS — December, 2012, January &
February 2013
Motion
Ms. Glinski moved to accept. Ms. Prainito seconded the motion that unanimously passed.

Ms. Glinski moved to accept. Ms. Prainito seconded the motion that unanimously passed.
7. UNFINISHED BUSINESS
A Parks Division Reports — December, 2012, January & February 2013
Tom Balfe, Parks Manager, announced there were 11 Mausoleum entombments, two
Mausoleum inurnments, 38 ground full -body burials, eight ground cremains, no
disentombment/disinurnments and one disinterment forthe months of December, January
and February.
Motion
Ms Glinski moved to accept the report. Mr. Bone seconded the motion that unanimously
passed
B Review draft of new language for Rule 1 -M Cemetery Rules and Regulations
Ms. Prainito included the language for review. It was the last paragraph of Rule 1 -M which
reads "When a crypt or a niche was originally sold, the City received 15% of the original
sales price. A transfer fee of $75 will be charged when a previously purchased crypt or
niche is resold." The next sentence was eliminated which reads "The transfer will be the
difference between......" and left in the last sentence which reads "The City will buy back
unused crypts or niches at 80% of the original contract price or 80% of the City's current
selling price, whichever was less." Ms. Prainito recommended removing the first sentence
of the paragraph since it was unnecessary.
There was discussion regarding the settlement agreement with Boca Raton Mausoleum.
According to the settlement agreement, the City is not permitted to charge Boca Raton
Mausoleum for any transfers requested by them. Ms. Prainito advised that a note would be
placed in the fee structure indicating that the transfer fee could not be charged on any new
sales by Boca Raton Mausoleum or on any requests for transfer from Boca Raton
Mausoleum to a new crypt or niche purchaser. This request to include a fee for transfers
will be applied to anyone other than Boca Raton Mausoleum
Discussion ensued regarding the opening and closing fees in the Mausoleum and it was
explained those fees no longer go into the Perpetual Care Fund. They are now going into
the General Fund.

Ms. Glinski moved to remove the sentence and bring to the Commission for approval. Ms.
Prainito seconded the motion that unanimously passed.
C. Status of purchase and installation of double -depth vaults
Mr. Balfe stated the 32 double -depth vaults were received and would be installed by the
end of the month by a contractor.
8. NEW BUSINESS
A. Approve the request of Vito O. Donno for a transfer of a Mausoleum
Certificate of Ownership for Crypt E -10, Section D. Sunset Building; to
Maredith Fazio Paduano (all paperwork is in order).
Motion
Ms. Glinski moved to approve the request Ms. Prainito seconded the motion that
unanimously passed.
B. Consider a revision to allow the overtime fee to be charged beginning at 2:00
p m. rather than 2:30 p.m. every day including holidays.
Mr. Balfe commented that if a service was scheduled at 2:15 p.m., there would still be
some overtime If it would be scheduled at 2 p.m., the service should be completed
and if not would only run into 15 or 30 minutes of overtime. The extra 30 minutes would be
a help The fee would not be changed, just the time. There were people that would
schedule a service at 2:15 p m. just to avoid the overtime charge

Ms. Glinski moved to approve the overtime change. Ms. Prainito seconded the motion that
unanimously passed
C Appointment of a Chairperson
Motion
Ms. Prainito moved to nominate Vice Chair Hohner as Chair. Ms. Glinski seconded the
motion that unanimously passed.

1. TRUST NAME
THIS TRUST SHALL BE KNOWN AS THE OSVALDINA DONNO LIVING TRUST

II. TRUST AGREEMENT ll

HEREINAFTER REFERRED TO AS THE SETTLOR AND OSVALDINA DONNO, OF BOYNTON
BEACH, PALM BEACH COUNTY, STATE OF FLORIDA, HEREINAFTER REFERRED TO AS THE
TRUSTEE REFERENCE TO THE TRUSTEE SHALL ALSO INCLUDE THE SUCCESSOR
TRUSTEES OF OSVALDINA DONNO WHEN THEY ARE ACTING IN THE FIDUCIARY CAPACITY
DESCRIBED IN THIS TRUST AGREEMENT
THE SETTLOR DESIRES TO CREATE A REVOCABLE TRUST AND HEREBY TRANSFERS AND
DELIVERS TO THE TRUSTEE ALL OF THE PROPERTY DESCRIBED IN SCHEDULE A
ATTACHED TO AND MADE PART OF THIS INSTRUMENT AGREEMENT THE RECEIPT Of=
WHICH PROPERTY IS ACKNOWLEDGED BY THE TRUSTEE SUCH PROPERTY, TOGETHER
WITH ANY OTHER PROPERTY THAT MAY LATER BECOME SUBJECT TO THIS TRUST SHALL_
CONSTITUTE THE TRUST ESTATE. THE TRUST PROPERTY SHALL BE USED FOR THE
BENEFIT OF THE TRUST BENEFICIARIES AND SHALL BE ADMINISTERED AND
DISTRIBUTED BY THE TRUSTEE IN ACCORDANCE WITH THIS TRUST INSTRUMENT
III. TRUST PROPERTY
THE TRUST PROPERTY LISTED IN SCHEDULE A SHALL BE DESIGNATED AS PROPERTY
HELD BY OSVALDINA DONNO
AS LONG AS OSVALDINA DONNO SHALL LIVE, SHE MAY REVOKE THE TRUST IN WRITING,
AT ANY TIME, WITHOUT NOTIFYING ANY BENEFICIARY
AS LONG AS OSVALDINA DONNO SHALL LIVE, THE OSVALDINA DONNO LIVING TRUST MAY
BE ALTERED, AMENDED OR MODIFIED IN WRITING
IV. SUCCESSOR TRUSTEES
UPON THE DEATH OR INCAPACITY OF OSVALDINA DONNO, THE SUCCESSOR TRUSTEE
SHALL BE VITO O. DONNO AND IN HIS ABSENCE, CHIARA D. TORRES -AYALA
TRUSTEE SHALL HAVE THE RIGHT TO APPOINT, IN A WRITING WHICH SHALL BE
NOTARIZED, ADDITIONAL SUCCESSOR TRUSTEES TO SERVE, IN THE ORDER NOMINATED,
AS TRUSTEE, IF ALL THE SUCCESSOR TRUSTEES NAMED IN THIS TRUST INSTRUMENT
CEASE TO EXIST OR ARE UNABLE TO SERVE
NO TRUSTEE SHALL RECEIVE COMPENSATION NO BOND SHALL BE REQUIRED OF ANY
TRUSTEE
V. BENEFICIARIES
UNTIL HER DEATH, THE SETTLOR RETAINS ALL RIGHTS TO INCOME, PROFITS AND
CONTROL OF THE PROPERTY OF THE OSVALDINA DONNO LIVING TRUST.
UPON THE DEATH OF OSVALDINA DONNO, IF THE PROPERTY IS STILL PART OF THE
TRUST ESTATE, HER PROPERTY SHALL BE DISTRIBUTED AS FOLLOWS -
a My entire estate, rest and residue included, shall go to my two children, VITO O DONNO
and CHIARA D TORRES- AYALA, in equal shares
b In the event either of my children should predecease me, his or her share shall pass to
his or her surviving issue, and if no surviving issue, to my surviving child
c In the event any of my grandchildren should take under the provisions of this Trust
Agreement, the Successor Trustee named herein shall act as guardian of the property until said
grandchild attains the age of legal majority
VI. INCAPACITY
IF OSVALDINA DONNO BECOMES PHYSICALLY OR MENTALLY INCAPACITATED AS
CERTIFIED IN WRITING BY TWO LICENSED PHYSICIANS, THE SUCCESSOR TRUSTEE(S)
SHALL MANAGE THE TRUST AND SHALL APPLY FOR THE BENEFIT OF THE SETTLOR AN)
AMOUNT OF TRUST INCOME OR TRUST PRINCIPAL NECESSARY IN THE SUCCESSOR
TRUSTEE(S)' DISCRETION, FOR THE PROPER HEALTH CARE, SUPPORT, MAINTENANCE,
COMFORT AND WELFARE OF THE SETTLOR, IN ACCORDANCE WITH HER ACCUSTOMED
STANDARD OF LIVING, UNTIL A LICENSED PHYSICIAN CERTIFIES THAT THE SETTLOR IS
AGAIN ABLE TO MANAGE HER OWN AFFAIRS OR UNTIL HER DEATH
ANY INCOME IN EXCESS OF AMOUNTS APPLIED FOR THE BENEFIT OF THE SETTLOR
SHALL BE ACCUMULATED AND ADDED TO THE TRUST PROPERTY
VII. POWERS OF THE TRUSTEE
A. GENERAL POWERS
THE TRUSTEE SHALL HAVE THE POWER TO CARRY OUT THE PROVISIONS OF THIS
INSTRUMENT AND TO MANAGE THE TRUST PROPERTY THE TRUSTEE SHALL HAVE THE
AUTHORITY AND POWER ALLOWED OR CONFERRED UNDER FLORIDA LAW AND SUBJECT
TO THE TRUSTEES' FIDUCIARY DUTY TO THE SETTLOR AND THE BENEFICIARIES
ANY DEBTS OR DEATH TAXES OF OSVALDINA DONNO SHALL BE PAID BY THE TRUSTEE=
FROM THE RESIDUARY ESTATE IF THE RESIDUARY ESTATE IS INSUFFICIENT TO PAY THE:
DEBTS AND DEATH TAXES, THE TRUSTEE SHALL DETERMINE HOW SUCH DEBTS AND
DEATH TAXES SHALL BE PAID

MAUSOLEUM
1 -M. Mausoleum Crypts or Niches - Prior to inurnment/entombment, an owner may transfer or resell the
mausoleum crypt or niche provided the owner first obtains the written consent of the City of Boynton
Beach. Such consent shall be given automatically provided that the new purchaser's name, address
and phone number are on file with the City Clerk and an administrative fee equal to the cost of
relettering the mausoleum, crypt, or niche is paid in full to the City of Boynton Beach.
After inurnment /entombment, resale or transfer of ownership shall be allowed. The City of Boynton
Beach may purchase the crypt or niche at a cost of 50% of the original purchase price paid for the
crypt or niche and provided that disinurnment /disentombment has occurred and implemented by the
proper authorities.
No disinurnment /disentombment shall be allowed except by the consent of the Cemetery Board
following written request by the owner or owners of the crypt /niche and in every case shall only be
made by the proper authorities.
(NOTE: Authorized disinurnment /disentombment and shipment of body or remains may be made only
by a licensed funeral director licensed in Florida to another licensed funeral director at terminal point.)
When a crypt or niche was originally sold, the City of Boynton Beach received 15% of the original
sales price. A transfer fee of 75 will be charged when a previously purchased crypt or niche is
resold.

The City will buy -back
unused crypts or niches at 80% of the original contract price or 80% of the City's current selling
price, whichever was less."
2 -M. The City reserves to itself the right to approve any erection, enclosure, monument, inscription, tree or
shrub.
3 -M. All identification information including letters and emblems on crypts and niches shall be inscribed by
engraving. The cost of new crypt or niche inscription fees shall be paid at time of interment.
Existing bronze letters shall be replaced with inscription by the City. Replacement inscription shall be
done at no cost to the owner of the crypt or niche, but shall be paid from the Perpetual Care Fund. If
existing bronze emblems are damaged, replacement of an existing bronze emblem with a sandblasted
emblem shall be done at the owner's expense."
4 -M. All flowers must be placed in an approved vase Approved vases include crypt -front vases or bronze
vases previously approved by the City. Fresh flowers can remain for a maximum period of three (3)
days. No artificial flowers, except silk flowers, are permitted in or around Mausoleum buildings. One
(1) vase per crypt /niche will be allowed. Employees will, for maintenance purposes, move and replace
these items with care, but the City does not accept responsibility for replacing broken items unless
there is a clear negligence on the part of the City employees. After the third day, or in the case of silk
flowers, when the Cemetery Sexton determines that the flowers have become unsightly, said flowers
shall be removed and disposed of.
"No potted plants containing soil, perlite, or other loose materials are permitted in chapels or
walkways in the Mausoleum. (City employees may remove any item placed on a crypt /niche site that
