O97-45 ORDINANCE NO. 097-~--~' AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA AMENDING PART II, CHAPTER 2, ARTICLE IV OF BOYNTON BEACH CODE OF ORDINANCES TO AMEND SECTION 2-56 PROVIDING FOR INCREASE OF THE EXEMPTION AMOUNT FOR COMPETITIVE BIDDING TO $2,000.00 EXCEPT AS PROVIDED IN SECTION 2-56.1; AMENDING SECTION 2-56.1(b) PROVIDING FOR REVISION OF THE. CURRENT COMPETITIVE BIDDING EXEMPTION FOR PURCHASES IN EXCESS OF $1,000.00 AND LESS THAN $5,000.00 TO REVISE THE EXEMPTION TO PURCHASES BETWEEN $2,000.00 AND $10,000.00; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Boynton Beach,- Florida has deemed it to be in the best interests of efficiency, conducting business, and City purchasing policies to increase the bid threshOld amount to $10,000.00, thereby exempting purchases under $10,000.00 from the requirements of competitive bidding; and WHEREAS, the City Commission has determined that purchases of personal property involving amounts in excess of $2,000.00 and less than $10,000.00 are to be exempt from the requirements of competitive bidding; and WHEREAS, the City of Boynton Beach shall follow current city CODING: Words in~=~.~- ~=u=~ type are deletion from existing law; Words in underscored type are additions. Page 1 policy and procedure with respect to purchases involving amounts less than or equal to $2,000.00; and WHEREAS, based on the recommendations of City staff, the City Commission has determined increasing the bid threshold amount and authorizing the city manager to obtain three quotes with respect to requisitions for personal property involving amounts in excess of $2,000.00 and less than $10,000.00 increases the efficiency of government, while continuing to preserve the welfare and public interests of the citizens and residents of the City of Boynton Beach. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, ~FLORIDA, THAT: Section 1. Part II, Chapter 2, Article IV, Section 2-56 of the Code of Ordinances of the City of Boynton Beach, Florida is hereby amended to read as follows: Sec. 2-56 Purchasing Agent, selection, duties; competitive bidding. The city commission shall appoint an officer or employee of the city, other than a member of the city commission, as purchasing agent for the city who shall be responsible for the purchase, storage, and distribution of all supplies, materials, equipment and other articles used by an office, department or agency of the municipal government. Page 2 city commission and shall conform to such regulations as the city commission may from time to time prescribe. Except as provided in section 2-56.1 all purchases or sales involving amounts in excess of cna two thousand dollars ~ ~ $2, . (~,OO$.vv 000 00) shall be made only after the publishing of an advertisement of bids thereon in a newspaper of general circulation in the city at least one (1) time, not less than eight (8) days prior to the date set for reception of such bids, together with such other notice as the commission may direct. The city commission shall have the power~ Section 2. Part II, Chapter 2, Article IV, Section 2- 56.1(b) of the Code of Ordinances of the City of Boynton Beach, Florida is hereby amended to read as follows: (b) On any purchase of personal property involving amounts in excess of one thousand dollars ($1,000.00) and less than~v~~ ten thousand (~,~v~0.v~ $I0,000.00) the city manager shall obtain three (3) written quotes in connection with each requisition.. The written quotes shall be kept on file with the purchase order. Furthermore, the city manager is authorized to execute a purchase order or contract on behalf of the city for such purposes. Section 3. Each and every other provision of Part II, Chapter 2, Article IV not herein specifically amended shall remain in full force and effect as previously enacted. Section 4. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Should any section or provision of this ordinance or portion hereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect' the remainder of this ordinance.
