Dear Ms. Springer:
In connection with the above referenced 3 code cases, please note that our office
represents Fannie Mae (Federal National Mortgage Association). Fannie Mae has
authorized me to offer $11,400 ( which is 10 %) to the City of Boynton Beach ( the
"City ") for releases of the above 3 code enforcement liens (they only request a partial
release of the real property as to Case 08 -3712 and allow the City to maintain the right to
pursue an action individually against the Sosnowski's). I will go into further detail
below, but Fannie Mae respectfully requests that the City agrees to settle the code liens
on a property that has been a major loss for Fannie Mae. Although we have good legal
arguments as to why the first two code liens are not enforceable on this property, we do
acknowledge that Fannie Mae does not have a good argument against enforcement of the
last lien in the amount of $38,834.12 and no good excuse for taking too long to bring the
violations into compliance and look to the leniency of the City to settle the matter if
possible.
In all, the three code liens have a payoff in the amount of $113,902.35. The
Property Appraiser values the property at $62,388. It is listed for sale at $34,900 (20% of
the face value of the foreclosure judgment!), with no Buyer yet, and based on the that
price, Fannie Mae has lost money on the initial loan even before a code lien settlement is
taken into account as the Final Judgment of Foreclosure was for $179,322.70 on April 20,
2010, and Fannie Mae spent approximately $27,000.00 to fix /improve the property.
As for the legal argument on the first code lien for Case 08 -3712 recorded against
Bradley and Amanda Sosnowski in Official Records Book 23136 page 33, the code lien
is foreclosed by law and is barred under Florida Statute Section 48.23 (1)(d)(Lis Pendens
Statute) as stated in Florida Attorney General Advisory Legal Opinion AGO 93 -77. I
have included a copy of this Legal Opinion and a timeline of the bank's foreclosure and
the recorded code liens. The foreclosed mortgage was recorded August 23, 2006 in ORB
20767 page 650; Lis Pendens recorded January 8, 2009 in ORB 23025 page 1571; 1st
Code Lien recorded March 20, 2009 in ORB 23136 page 33; Final Judgment recorded
July 21, 2010 in ORB 23958 page 1285; 2 Code Lien recorded July 6, 2010 in ORB
23934 page 1205; and Certificate of Title recorded September 29, 2010, in ORB 24108
page 578. The City of Boynton Beach did not intervene in the foreclosure action so this
code lien is barred and the fines are not enforceable against this property. See also the
bank's Final Judgment, Paragraphs 2 and 6. Fannie Mae only requests a partial release of
this code lien for the real property which would allow the City as to Case 08 -3712 to
maintain the right to pursue an action individually against the Sosnowski's as the code
lien cross - attached to any and all other property they own.
As for the 2 Code Lien, it was against HSBC Mortgage Co. ( "HSBC ") who was
the Plaintiff in the Fannie Mae mortgage foreclosure. As you can see from paragraph 3 of
the bank's Complaint, HSBC was the servicer of the loan owned by Fannie Mae.
However, the 2 " Code Lien was a violation of the City's Ordinance 09 -040 for failure to
register a vacant property in foreclosure. While I believe this lien is also barred by the
same argument above for the 1 Code Lien, it is also not enforceable for the simple
reason that it fails to comply with Florida Statutes Section 162.09 (3) and the City's Muni
Code Article V Sec. 2 -79C in that it fails to identify the property subject to the violation.
It has no legal description, no street address and no Parcel Control Number so it does not
even show up on a title search of the real property. Therefore, it cannot be a "lien against
the land which the violation exists ".
As for the 3` Code Lien, it was against Fannie Mae after the issued Certificate of
Title and Fannie Mae took too long to bring the property into compliance and now faces a
final fine in the amount of $38,834.12 which is over half the current value of the property
per the Property Appraiser.
I have enclosed copies of the mortgage, code liens, lis pendens, final judgment,
certificate of title, and the property appraiser's printout of the property, cited cases and
statues etc. for your convenience. Our client hopes the City will entertain and accept its
settlement offer.
