MINUTES OF THE CEMETERY BOARD MEETING HELD ON WEDNESDAY, SEPTEMBER 18, 2013 AT 3:30 P.M. IN COMMISSION CHAMBERS, CITY HALL 100 E. BOYNTON BEACH BLVD., BOYNTON BEACH, FLORIDA PRESENT: Karilyn Norem Hohner, Chair Tom Balfe, Parks Manager Janet Prainito, Secretary William Bone Bonnie Glinski Claudia Stine Marcos Boronat — Alternate 1. CALL TO ORDER Chair Hohner called the meeting to order at 3 p.m. 2. ATTENDANCE Secretary Prainito called the roll. A quorum was present. 3. AGENDA APPROVAL Chair Hohner added the following items to the agenda. Item I - Discuss generating more income to help improve the appearance and service at the cemetery; Item J — Discuss drafting a letter notifying funeral homes that Boynton Beach Mausoleum, Inc. and the City of Boynton Beach are not in a partnership. Motion Ms. Glinski moved to approve the agenda as modified. Ms. Prainito seconded the motion that unanimously passed. 4. APPROVAL OF THE MINUTES — March 14, 2013 Motion Ms. Glinski moved to approve the minutes Ms. Prainito seconded the motion that unanimously passed 1 MEETING MINUTES CEMETERY BOARD BOYNTON BEACH, FLORIDA September 18, 2013 5. RECEIPT OF REVENUE /EXPENSE SHEETS — March, April, May, June, July and August 2013. Motion Ms Glinski moved to accept the revenue /expense sheets. Ms. Prainito seconded the motion that unanimously passed. 6. RECEIPT OF SALES REPORTS — March, April, May, Jun, July and August 2013 Motion Ms. Glinski moved to accept the sales reports. Ms. Prainito seconded the motion that unanimously passed. 7. UNFINISHED BUSINESS A Parks Division Reports — March, April, May, June, July and August 2013 Tom Balfe, Parks Manager, announced for March, April and May, there were 11 Mausoleum entombments, six Mausoleum inurnments, 37 full -body burials, seven ground cremains and a total of 61 funerals. There were no disentombments /disinterments or disinurnments. At the end of the quarter for June, July and August, there were 13 Mausoleum entombments, five Mausoleum inurnments, 36 ground full -body burials and 11 ground cremains. There were a total of 65 funerals. There were no disentombments /disinterments or disurnments for those months. Motion Ms. Glinski moved to accept the Parks report. Mr. Bone seconded the motion that unanimously passed. 8. NEW BUSINESS A. Discuss Survey regarding Cemetery Board Role Christine Roberts, Assistant Public Works Director distributed a survey from the City Manager's Office to each of the Board members. The survey asks each member to give feedback on the Cemetery Board. There are currently 15 Advisory Boards and Committees providing input and recommendations to the City Commission. The Commission is considering reducing the number of advisory boards and exploring alternative methods of civic engagement. The survey will help to determine which 2 MEETING MINUTES CEMETERY BOARD BOYNTON BEACH, FLORIDA September 18, 2013 Advisory Boards may be considered for sunsetting or consolidation. The deadline to return the survey is October 1 The surveys will be considered by the City Manager and the Commission and there will be a presentation regarding results for all Boards. Jeffrey Livergood, Director of Public Works and Engineering, reported for the past three to four years the City has been evaluating how services are provided to the public. The budget has been difficult in recent years and the City is trying to find ways to efficiently and cost - effectively provide services in a timely manner. Mr. Livergood commented that there are a large number of refunds requiring Board approval before the refunds can be sent out. It was Mr. Livergood's opinion this is a staff function that could be done through the Finance Department. This is an example of how the City can provide better service Mr. Livergood continued that although the City would like to improve the appearance of its parks and cemeteries, the impact of the perpetual maintenance fund has to be considered as well. Some other issues to consider are; can the City afford to improve the appearance of the parks and cemeteries, what is the most cost - effective way of doing it and what are the goals? There are many capable people with the ability to look at the long term picture of what the cemetery is and how it will be maintained. The Finance Director is aware of the amount of money in the perpetual care fund so that expenses will not outlive the fund in the future Another reason for doing the survey is to look at the staff time that is involved. The City Clerk's Office oversees a large number of Boards and sometimes the turnaround time for minutes is longer than usual, but they do a great job in following up as quickly as possible. Ms. Prainito commented that in most cases, people do wait a long time for refunds. The Board is polled, but the actual refund is not sent out until it is ratified. Exceptions are made, but generally refunds wait. Chair Hohner asked for a motion to approve B -H under New Business. Motion Ms. Glinski moved to approve B -H. Ms. Stine seconded the motion and it was unanimously passed. I Generating More Incoming for Cemetery Appearance and Services Chair Hohner stated that the cemetery's appearance and services are based on the City budget and trust funds. Chair Hohner suggested a few options to help put more money in the trust funds for perpetual care. One option would be to construct a new Mausoleum building. The sale of the crypts from the new building would generate more income and more space for people to choose from. Another option would be to expand into the nearby ballpark. The property that the ballpark sits on was originally set to be 3 MEETING MINUTES CEMETERY BOARD BOYNTON BEACH, FLORIDA September 18, 2013 cemetery property. Opening that area for ground burial would also generate more revenue for years to come. It would generate pre -need sales to help build up the trust funds now instead of waiting. The cemetery does not have that much space left. If there is no more space, there will be no more income. Ms. Glinski asked if the new Mausoleum building would be built where there is currently a mound of sand Mr. Balfe confirmed that was where the last building should have gone. Chair Hohner asked who would get the information the Board needs to look into building a new Mausoleum. Mr. Livergood suggested that research for this should start with City Staff to prepare a report for a future meeting. There should be consideration also as to how this will affect the perpetual care fund. The Mausoleum has its own perpetual care fund and the funds will have to be kept separate. The Public Works Department can do an analysis of where the building will go and what size it should be. Mr. Livergood also stated that the additional revenue would ultimately bring in sales, and part of those sales would increase the perpetual care fund. Most of that revenue will not go into the maintenance of the grounds The cost of burials may have to be considered as well. Chair Hohner commented that the option to expand into the ballpark should be considered. Mr. Livergood replied that this issue has been discussed many times over the years and has always been determined it is Little League property and the City Commission would have to decide on that Chair Hohner stated the ballpark is on cemetery property which can use some updating. There is an opportunity to build something for the Little League field and create a space for deceased citizens as well. The ballpark would not be taken away, but moved to another location. The report should also include information on other property the City owns which is not being used. Mr. Livergood asked where the money to fund the ballpark would come from. A loan would be necessary to construct a new ball field and then fees for interment to pay back the loan would have to be increased. Chair Hohner replied that perhaps cemetery trust fund money could be used to build the ballpark; and then the ballpark property could be used for graves as an option. Mr. Livergood commented that he was not sure if funds from the perpetual maintenance revenue can be used for expansion. The fund is very strict that money be used for maintenance and not construction. Ms Stine asked if the Little League field belongs to the cemetery. Ms. Prainito clarified for many years, it was the desire of the Cemetery Board to expand to 1 -95 and use all of that property but it does not belong to the cemetery; it is general City property. The Recreation and Parks Board should have input on this situation as well. There is not a lot of vacant land to relocate a ballpark. Chair Hohner again stated her concern about the cemetery running out of space. Mr. Livergood replied that this is a concern not only for Boynton Beach but a regional and national concern as well. These situations are not always planned for in advance and changes will have to be made. Perhaps we should 4 MEETING MINUTES CEMETERY BOARD BOYNTON BEACH, FLORIDA September 18, 2013 not only look at the role of the Board but the role of the Government in terms of burial opportunities for people, or should it be a private sector issue? Chair Hohner commented that she believes it is a City issue. Chair Hohner stated the Board's next step is to request a report for a new Mausoleum building. Mr. Livergood commented that there has never been a desire from the elected officials to move into the ball fields. There are thousands of youth that use those fields and to relocate them at this time would be very difficult financially A better option is to see if there is other property that can be acquired for cemetery operations. Mr. Livergood suggested that the Board set long term and short term goals The building of a new Mausoleum and improving the appearance of the cemetery are very good short term goals. The long term goals can be suggested to the Commission but the City has many other long term goals they are considering right now. Ms. Stine suggested that since there is a cemetery in the east, why not look for land to the west? The ball fields have fields on the east and the west. Perhaps this is a long term goal that can be considered. Ms. Glinski replied that there is also a cemetery to the north, but there are never any sales there Chair Hohner asked why people prefer Boynton Beach Memorial Park over Sara Sims Memorial Gardens. Ms. Prainito suggested that many people like to be buried in or close to the neighborhood they lived in. However; there are no requests to go to Sara Sims. Mr. Livergood said that the long term goal should not be to expand into the ballpark, but to identify and acquire a new location. Chair Hohner stated there is a requirement of a minimum number of acres to start a new cemetery rather than expand on an old one. If there is no vacant property that meets the acreage requirement, there would be no choice but to expand into the ballpark. Mr. Livergood stated this would be an option that would be discussed by the Commission. Ms Glinski wanted to continue the discussion about the appearance of the cemetery with the issue of the gate that has not been closed. Mr. Balfe replied staff is supposed to close it every night and he would look into it. Ms. Glinski also stated this is not only unsightly, but a possible liability for the City as well because children play on the mound of dirt. Staff will prepare an analysis for the Board. Motion Ms. Glinski moved to table the discussion of expanding the cemetery. Ms. Stine seconded the motion that unanimously passed. J Letter to Funeral Homes regarding Boynton Beach Mausoleum Inc., and the City of Boynton Beach. 5 MEETING MINUTES CEMETERY BOARD BOYNTON BEACH, FLORIDA September 18, 2013 City of Boynton Beach. Ms Prainito explained Boca Raton Mausoleum owns the crypts and niches Chair Hohner reported they are using the name of Boynton Beach Mausoleum, Inc., when selling crypts and niches. Chair Hohner explained Boynton Beach Mausoleum, Inc. is a company selling niches and crypts owned by Boca Raton Mausoleum which may be a conflict. Chair Hohner is concerned the public is misunderstanding who exactly they are buying from Ms. Roberts commented that the Board can ask for a determination on the request from the City Attorney's Office Chair Hohner stated there should be some kind of clarification not only for the funeral homes, but people as well. Chair Hohner was approached by someone from the Boynton Beach Mausoleum Inc. and their business card has the name of Boynton Beach Mausoleum, Inc. which is misleading. It looks as if they are representing the City. Ms. Roberts replied that she will ask for clarification from the City Attorney's Office and will provide the information to Ms Prainito before the next meeting. Ms. Prainito in turn would notify the Board members. 9. ADJOURNMENT There being no further business to discuss, Mr. Bone moved to adjourn. Ms. Stine seconded the motion that unanimously passed. ARTICLE V DISPOSITION OF THE RESIDUE TO THE GERALD CORIN AND HELEN CORIN REVOCABLE TRUST AGREEMENT All the rest, residue and remainder of the property which I may own at the time of my death, of whatsoever nature and wheresoever situate, including all property which I may acquire or become entitled to after the execution of this Will, I give to that person who, upon my death, is to serve as the Trustee of the GERALD CORIN and HELEN CORIN REVOCABLE TRUST AGREEMENT, dated April 17, 1986, created by GERALD CORIN and HELEN CORIN as Grantors, and GERALD CORIN and HELEN CORIN as Co- Trustees; as it now exists or may be amended in the future, which property shall be added to the trust estate. The receipt of said Trustee under said Trust Agreement shall be a full discharge of my Personal Representative for the property so distributed to it. Upon H.C. -2- distribution to the Trustee, the administration of my estate shall cease with respect to the assets passing to the Trustee, and the Trustee shall not be required to account to nor be subject to the control of the Court in which my Will is probated.
