Diane,
Not sure if you listened to my voice message. I hope you can imply I must have been in compliance soon after
we took control of property, because of the release of lien (REL). The very short time frame between the sheriff
eviction and the completed and recorded REL; plus the lack of both owner and tenant code compliance
interaction, strongly suggests code was informed, but somehow the case was not marked as in compliance.
I'd like to stay mum on the whole topic, and I don't care if any procedures were overlooked. I'm not interested
in pointing fingers, just illustrating our quick response to the situation.
If the board is unhappy with it taking 3 months to comply, then I'll have to mention the lien release as an
explanation. I hope you can help so I don't have to mention the matter.
Here's the timeline
April 26th, 2013 Purchase date at County Auction.
June 12th 2013 Code records a lien on property for Auto Repair shop (1 occurrence only, an old 2010 code
case). Tenant is still in property.
June 17th 2013 Sheriff executes Writ of Possession (Eviction). We have been filing orders in court several times for
eviction.
June 18th 2013 I notify code via phone for the 1st time.
June 19th 2013 I call code back via phone, I'm told all is OK.
July 22nd 2013 Release of lien is executed by the Mayor.
I cannot imagine why the Release of Lien was executed? It had to have been my calls. The tenants were out, and
the owner never responded to any code or court issues. It seems reasonable that I confused the officer I spoke with
as to which compliance case of the two cases I was talking about. In fact, I was unaware of the 2nd case filed on
June 12th, until a few days ago.
I'm sure this is the mix -up.
