THIS MATTER was presented to the City Commission of the City of Boynton Beach, Florida on
the date of hearing stated above. The City Commission having considered the approval sought by the
applicant and heard testimony from the applicant, members of city administrative staff and the public finds as
follows.

Land Development Regulations
Chapter 3, Article IV, Sec.4. Conditional Uses
EXHIBIT "C"
A. Applicability. Where zoning district regulations indicate that a use is allowed as a conditional
use, the procedures, requirements, and standards set out in Chapter 2, Article II Section 2. C and
this section shall apply.
B. Definition. See Chapter 1, Article II, Definitions
C. Standards for Evaluation Conditional Uses. In evaluating an application for conditional use, the
Board and Commission shalt consider the effect of the proposed use on the general health,
safety, and welfare of the community and make written findings certifying that satisfactory
provisions has been made concerning all of the following standards, where applicable:
1. Ingress and egress to the subject property and proposed structures thereon, with particular
reference to automobile and pedestrian safety and convenience, traffic flow and control, and
access in case of fire or catastrophe;
Response: All requirements have been met with the original structure.
2. Off- street parking and loading areas where required with particular attention to the items in
subsection C.1. above the economic, glare, noise, and odor effects the conditional use will have
on adjacent and nearby properties, and the city as a whole;
Response: Ample space is provided for parking, loading and unloading. No hindrances to traffic flow is
foreseen even in case of a fire or catastrophe. Parents will be provided a detailed document explaining
the pick -up and drop -off procedures for all children in care. This location will be in the parking lot ONLY,
causing no disturbance to any residents and or businesses in the surrounding areas. There will also be an
individual assigned to assist during pick -up and drop -off
3. Refuse and service areas, with particular reference to the items in subsection C.1. and C.2.
above;
Response: Refuse & Service areas has been approved by the Health Department.
4. Utilities, with reference to locations, availability, and compatibility;
Response: All have been accessed and approved.
7. Required setbacks and other open spaces,

S. Screening, buffering, and landscaping with reference to type, dimensions, and character;
Response: Upon receiving approval from the City Commissioners of Boynton Beach we will plant Coco
Plum hedge 260' feet along fence line east side of building and 100' feet along fence line south side of
building for buffering.
6 Signs, and proposed exterior lighting, with reference to glare, traffic safety, economic effect, and
compatibility and harmony with adjacent and nearby properties;
Response: The facility currently has an exterior sign, which is attached to the front of the building. That
signage is the ONLY signage that will be utilized. No additional signage will be added.
Response: N /A; used to be within an existing building with no building additions as part of this request.
8. General compatibility with adjacent properties, and other property in the zoning district;
Response: Parking will be monitored by a particular individual assigned. Pick up and drop off will take
place in the parking lot area ONLY, therefore the surrounding properties will not disturbed or
inconvenienced with the noise, traffic, parking or the like.
9. Height of buildings and structures with reference to compatibility and harmony to adjacent and
nearby properties, and the city as a whole;
Response: Landscaping will buffer the surrounding neighborhoods.
10. Economic effects on adjacent and nearby propertied, and the city as a whole;
Response: We plan to offer the community (2) Part -time & (6) full -time positions, which will assist with
the employment opportunities available within the City of Boynton Beach. Providing individuals a
chance to gain employment provide for his /her family and obtain knowledge while serving the children
& families within the city.
11. Where applicable, the proposed use furthers the purpose and intent of a corresponding mixed
use zoning district or redevelopment plan;
Response: The site in not located within a redevelopment area or mixed use zoning.

12. Compliance with and abatement of nuisances and hazards accordance with the operational
performance standards as indicated in Chapter 3, Article IV, Section 1 and the Noise Control
Ordinance, and City Code of Ordinances Part II, Chapter 15, Section 15 -8 and

establishments shall include the following analysis performed by a certified acoustic engineer;

We will adhere to the City of Boynton Beach ordinances/restrictions that there will not be any playground
equipment placed in the Storm Retention Area at any time.
