K~llgore, City Manager Mrs. Tereesa Padgett, City Clemk Gene MOore, City Attorney Mayor Effron Called the meeting to order at 7:32 P.M. The Invocation was given by Robert Watson, Ministerial Student, Pa/m Beach Atlantic College, followed by the Flag Salute led by Paul Vassatotti, '~Youth M~¥or~. Mr. Jim O'Meara of the Chamber of Commerce announced the Bi-centen- nial of the ~mel~ican Rovolution will celebrate 200 years of exis- tence in 1976. He told of the Liberty Boll that is being prepared, only 2400 bells will be produced. Our Rotary Club made a deposit of $100~ to assure getting one of the bells ~ The cost of a bell is $875. This is bmought to the attention of Council to get any, thoughts or ideas you might have. There will be a committee of 5 people to decide where to place the bell~ Library, Veterans Patak om School. Mr. O'Meara was sure he would not have any trouble financing the cost of the bell. City Hall was also a proposed site. Mayor Effron announced that National Library Week will be observed at the Boynton Beach City Library, April 16 to 29. The week wi11 be Fine Free. PRESENTATION OF CERTIFICATES - YOUTH IN GOVERNMENT PARTICIPANTS Paul Vassalotti, "youth Mayor': presented Council with a Book of Essays written by the students on Mouth In Government Day, he read the dedication. Mayor Effron presented certificates to the students that participa- ted in Youth in Government Day. He then recognized Mrs. Estes, their Civics Teacher. Mr. Blanchette moved that the minutes of April 6, 1972 be accepted as written. Seconded by Mr~ Archie. Motion carried 5-0. FdBLIC AUDIENCE John Ste.phen~,715 N. W. 4th Street is concerned about the zoning and asked when it is going to go through? Mayor Effron explained that Council has been havingworkshop meet- ings with the planning consultants regarding the comprehensive master plan. T~e Planning & Zoning Board has requested a meeting with Council and the City Planner to discuss some R-5 zones, which we intend to have. We will meet and coma to some decision as to what we are going to do with the map and regulations. Mr. Stephens invited Council members and the City Manager to the Community Relations Committee meeting on the second Wednesday of next month. The Committee has discussed the hiring of a black person in City Hall, housing authority. ~He also asked about the drainage on N. W. ~rd Street and 8th AvenueS the City Engineer seems to be going slow. Mr. Killgore stated he would call Mr. Stephens and attempt to clear up some of these matters. Eze!l Hester, representing the Socialites Club stated they have been keeping up wfth the Council and is beginning to wonder who is actually running the City, United Boynton Civic League? The B/ack Deople have been accused of being apathetic. He presented a project of the clubs to the Couneil~ it is with regard to Sara Sims Cemetery. In the first p/ace, it is located in the wrong place, in a business district. Requested Council to fence the cemetery, grass it and keep it~intained. The 15th Avenue cema- terM employees 2 people permanently. This is part of the City, why can't it be maintained. He stated they would help any way they can. He asked Council to please do s~ething about this cemetery. Killgore to handle administratively. Seconded by Mrs. Jackson. Motion carried 5-0. LouPreiditseh requested that Council make a decision of the funding Agreements. His wife filed an application on February 25, 1972 in accordance with Resolution 70-T. We have followed the ~esolution to the utmost detail. He would like either a yes or a no on the refunding agreement. Mayor Effron explained that we have the sewer expansion program which we agcepted bid fo~. We have an application for Federal Funds. ~he~we obtain Federal funds there are only certain lines that are available for funds. Anything we do prior to receiving this grant could be knocked out of the application: so we have to be careful on this issue. Eddie Mitchell asked the question of why ~here are No blacks em- ployed in the City Hall. We have had ladies come down that have had two years of business education and been very effective in typing. Mm. Sullivan has indicated to one black person that they like to hire people that are over 50 years old. As a member of the Civil Service Boa~d: we used to be able to sign some papers so w~ could look the tests over, but we have not been called on to per- from this task. If something is happeningwith these tests he ~uld like to have it corrected. Mr. Archie stated that the City Manager should conduct a full scale investigation into the 9iving of Civil Service exams especially where the black people are involved and return to the Council the findings of the investigation. If this Council is accepting ~ong marks, we want to know about it. If, on the other hand it is on the up and up, Mr. Mitchell and any other black person that asks about this will know. Mr. Archie moved that this ~e turned over to the City MaDmger and Mr. Sullivan for a complete investigation of Civil Service exams an~ bring it back to Council. Seconded by Mrs. Jackson. Seconded by Mrs. Jackson. Motion carried 5-0. Mr. Moore reported that a hearing was held on the existing condition of the M & R Harvest building. Judgement was entered in our favor. With regard to wrecker service, the suit against the City was dismissed. RESIGNATION OF JAMES M_AHONEY - CHARTER REVISION COMMITTEE Mr. Archie stated that Mr. Mahoney resigned from the Charter Re- vision Committee. Mr. A~ehte moved to aeeept Mro Mahoney~s resig- nation and appoint Mrso Judy Sanders to the Committee. Seconded by Mrs. Jackson. Motion carried 5-0. OLD BUSINESS REFUNDING AGREEMENTS (on the table) Mr. Killgore reported that there are considerable problems, our present thinking is st-ill to discontinue the refunding agreement provided we can find adequate financing on water and sewer. He will be qivfng a report on this. M~. A~chie stated that Mr. Preiditsch asked for a yes or a no on this and advised him that a motion was made at a p~evious meeting to grant the refunding agreement and there was no second. This should tell you that Council is not going along with the refunding agree- ment in this case. Mayor Effron stated that as Fir. Killqore pointed out t~%at these are involved and is still in the process of analyzing this. He Personally is not in favor of the refunding agreement, he feels that ~he City has been very .~ in the past about it. The~e has been no uniformity. It should be uniform or it should not be done at all. We will wait until the City Manager has completed his study then the Council will make a decision. CONSIDER FINAL PAYMENT FOR S~N WAH RESTAURANT Mr. Killgore reported that the amount agreed upon was $1,900.00. However, only '.$t~400.00 was refunded~ He recommended that the total figure of $1,900.00 be refur~ed unless there is reason why it should not be paid. Mayor Effron stated that there was some doubt as to whether it was $1,900. or $1,400. It was recommended that $1,400~00 be paid and a review be made. M~. Killgore then recommended that the other $500.00 be paid. Mr. Blanchette moved that the City Manager's recommendation be accepted. Seconded by Mrs. Jackson. Motion carried 4-1. Mr. ~rchie abstained. REQUEST OF SAM TICK FOR DNNEXATION (on the table.) Mr. Archie moved it be removed from the table. Seconded by Mr. Btanchette. Motion carried 5-0. Mr. Killgore reported that all departments have checkedit out and the Planning & Zoning Board recommends annexation to the City. Mr. Roberts mentioned that this is similar to High Point, single story. Mr. Roberts moved to 9~ant annexation. Seconded by Mrs. Jackson. Motion carried 5-0. Mr. Moore read Ordinance No. 7~-t0. Mr. ~mchie moved that O~din- ante No. 72-10 be passed on 1st reading. Seconded by Mr. Blanchette. Motion carried 5~0. Said Ordinance stated declaration of intent to annex parcel. REQUEST OF ELLIS CHtNGOS FOR ~NNEXATION. Mr. Killgore ~eported that this is a request for annexation of a 10 ac~e commercial property for a shopping center complex. RECE,IPT OF PETITION - OFF-SITE DR~Lk~GE N.W. 10TH CT.-LEISLLREVILLE. M~. Killgo~e reported that a petition has been received with 44 signatures on the drainage condition in Leisu~eville. Fir. Ward Sturges read the petition so that it is a matter of record. He also read the attached letter f~om Richard B. Vastine, darted April 17, 1972. Lad Demous, a new resident of Leisurevitle since December 20th, asked that something be done about the drainage to prevent the flooding that has been happening. He also stated that it has been indicated that this is a health problem. He would appreciate Council looking into the matter. Mr. D~ehie asked that the City Manager conduct an investigation on this. M~. Archiet s feelings is that if we a/low a subdivision to com~ into the community, they must follow specifications that we set forth. The drainage should be accordin~ to specifications. If it is not a problem of the City,. if it is private, then there will have to be some means for drainage. We tried to put in a drain- age system, but that was voted down~ so we cannot just go putting in drainage. Mr. Archiemoved that the City Ma~ger conduct an investigation of the situation and come back to Coun6il. Seconded by Mrs. Jackson. It was also inetuded in the motion to have Mr. E~11gore check on Paragraph 2 of the petition. Motion carried 5-0. REQHEST OF ST. ANDREWS CORP. FOR ~NNEXATION. M~. Killgore reported that this request was reviewed by the depart- ments and the Planning S Zoning Board recommends annexation. This is across the Int~acoastal and ofcourse all will be paid for by the developers. There already is an area across the Intracoastal south of Ocean Ridge that is in the City li~itSo Mrs. Jackson stated that this will eventually mean police protec- tion and havinq to go through two municipalities which does not seem logical. Mr. Moore read Ordinance No. 72-12. M~. Amahie moved to pass Ord- inance No. 72-12 on 1st reading. Seconded by Mr. Blanchette. Subject Ordinance states Declaration of Intent to Annex. We need more developments s/mi/aG to this in as much as the bu/ldings will be in the ~5.- $50,000.00 range. There is a tmemendous green area, golf course, club area, terunis courts. Could not be a better situation from a tax base standpoint. It is not contiguous, but it is no further than to the north o~ south ends of the City. Additional revenue through utility tax and cigarette tax. We can supply all services and will be a benefit to Boynton Beach. Mr. Archie asked if after we annex, can we still force them to pay for water and sewer? Mr. Killgore answered that should not be a part of the annexation procedure. Developers should pay their way regardless of where they are. Any outside developer should pay the way. Mr. Hopkins stated that the City would not provide garbage service; this would be done by the County. Mr. Roberts st~i this is Zone C-i, we a~e annexing on the basis of these plans; he could change his plans. Mr, Blanchette stated that this property is too valuable to spoil. They will be doing th/s and more rather than making it high density because they would not get the money for it. Mr. KostneG of the Plann/ng & Zoning Board stated that when this was discussed, it was the Board's serious concern of the question raised by Mr. Roberts. It was thought that the City might share in the expense of running this sewer 1/ne under the waterway. Mr. Killgore stated he does not like to see conditional zoning and also the City has no agreement that it will pay the cost of any facilities under the water~ay. Motion carried 4-1. Mrs. Jackson voted PRESENTATION OF CONCEPT OF ~dSINESS DISTRICT DEVELOPMENT Mayor Effron questioned the urgency of this in view of the long range of the concept. It seems we would have to abolish our ordinance on 45' heighth and the moratorium on rezoning. Arnold Stroshein stated that he is the largest neighbor of the Archdiocese senior citizens community. He has no object/on to the 225 units d/rectly adjacent to his project. His only real concern is that there is plenty ingress and egress to the development. It will be an asset to the community. It will be one of the things that will put us on the map. He could possibly see one large building of 5 or 7 stories. M~s. Jackson stated that Boca has a downtown area which is only one sto~y. Mr. Archie stated that he brought up the other day, with Mr. Dutch, that the Board is recommending that Council move the building of the Archdiocese from where it is p~oposed now t'o the north to a~ R-2 zo~ where we would have to rezone it. The Archdiocese own that property and when he asked Mr. Dutch if they wanted to sell it, he answered that he did not know. Mr. Largent explained some of the concept and what the Board had in mind. Council had asked the Board to look into the situation of the downtown area. ~ile doing this, the Board discovered this building of the Church right in the n~ddle of the proposed loca- tion of the downtown. Mayor Effron stated-tha~ he cannot see how the Council can consider moving a building that it objects to being built. If we lose our case then is when we should look at this concept then go accord- ingly. As long as we are in court we are hurting ourselves by discussing tb/s as far as the court case. Mr. Beyrer represented Sterling Vil/age and the Ur~ted Boynton Civic Leagae, stated that the people of this town are opposed to high rises. He also stated that when an individual or people go before the A~chdioeese and more or less give up the case, it is not in the best interest of the City. Council agreed this should not be discussed until a decision is made by the court. ADMINISTRATIVE STAndS REPORT ON CU/ARENT WATER & S~$ER PROJECTS. Mr. Kitlgore reported that we had requested a Federal Grant for the total sewer expansion program within the next fiscal year or hopefully this year. We might have to reduce the scope of the project. With regard to water project, it is now under study and will give further report. ~ayor Effnon stated that he has pointed out this is part of the Capital Improvemen~ Plan and we should take steps now rather than wait until we are faced v~th it. MINUTES REGULAR CITY COUNCIL MEETING APP~IL 18, 1972 RE~ORT ON BEACH PARKING Mr. Killgore reported that Mr. Frederick has done considerable research. We have approximately three different proposals. He recommends a trial per~od to evaluate the system before going into a permanent situation. Council's desire is to insure residents of finding a parking place at the beach. Mr. Killgore feels that the best way to start this prog-z~m would be the ~Manned Station Control Parking System'~. The other two systems submitted are the Mechanical Control Park- ing System 8~nd the Ticket Control Parking System. Mr. Killgore reviewed the 'q~anned Station Control System'~ including estimated cost involved. Mr. Archie suggested that Mr. Killgore and Mr. Frederick continue with the p~og~am and don' t push too fast and get into operation toward the summer. Mr. Killgore stated from p~esent observation, the system will have to be quite flexible. REPORT ON ST~AWdS OF PAVING A ~ORTION OF S. E. 2ND AVEkWdE. Mr. K~llgore noted that the control of speed of trains and the opening of crossings will be removed from the municipality and given to the Department of Transportation, effective July 1st. Council determined to open a crossing at 2nd Avenue across the F.E.C. tracks. We did determine we had received in 1927, a right-of-way to 9'o across the tracks. F.E.C. has taken the position that the right-of-way is no longer valid. The paving con- tract with Hardrives has been held up until such time this is resolved. Mr. ~chie suggested a conference by the City Attorney and the City Manager, with St. Augustine to see how strong their feelings are. If we wait until July 1st, we will run into some red tape. Appoint a Committee to contact Mr. Thornton in St. Augustine and attempt to work out some sort of plan and move out as soon as possible, or we will do whatever is necessary.
