K/ilgore, City Manager Gene Moore: City Attorney Mayor Effron called the meeting to order at 7:35 P. M, The Invocation was given by Col. Will/am Trauger, followed by the Flag Salute led by Vice Mayor Jackson. Mayor Effron introduced the new City Manager: Travis Kil!gore~ an asset to our community3 and also Mrs. Killgore. The Mayor announced that Dick Graco of Tsmpa~ President of the Plorida League of Cities~ has appointed John Are_hie To serve on the Committee on Municipal Public Relations for 1972, and was glad to hear he has accepted. He also sm, nounced that on Thursday, March 23~ at 2:00 P. M. the Planning Consultants, Candeub~ Fteissig and Assooiates~ will have a joint meeting with City Council and the Planning g Zoning Board~ and City Planner, to go over more phases of the Master MINUTES Regular Meeting - March 7:1972 Mrs. Jackson ~de a correction on Page £3 fourth paragraph from the bot- tom~ it was stated by Mr. Moore that Judge Pizzi was ba~0oozled. Mr. A~chie moved that the minutes of March 7 be accepted as corrected, seconded by Mr. Blanchette. Motion carried 5-0. Special Meeting - M~rch 9~ 1972 Mr. Arehie moved that the minutes of March 9 be approved as wmitten~ seconded by Mr. Blanchette. Motion carried 5-0. PUBLIC AUDIENCE Albert Wehrell stated that several weeks ago Mr. K!inck~ of Russell & Axon~ gave Council and the publ/c a long discourse on the necessity Of Boynton Beach agreeing to provide water and sewer to outside developers. We were told we had to do this or jeopardize federal funds. Approxi- mately ten requests were received for water and sewer with or without annexation. The total requests for sewer requiz~ment can well bring us close ~o the maxLmum capacity of the present sewer plant. MINUTES REGULAR CITY COUhNCIL MEETING MARCH 212 1972 PUBLIC AUDIENCe, cont'dm Col. Wehrell further stated that we should proceed with the utmost caution and be sure of any alternatives. This should be paid for by the developer at no cost to the citizens of Boynton Beach. Before we finalize any of these requests be Sure that any directives from the Area Planning Board are in writing and authentic. Eddie Mitchell stated that still nothing has been done on 10th Avenue concerning the water. It is a waste of money to have these pipes on 10th Avenue~ and it is not doinff the job that you thought it would do. We hope we can sell you this issue~ and get the water going out of there~ as it should. Patience is beginning to run out with some of the young people. He then brought up an issue with the City Engineer. Hopefully Council will get to some of the City employees who are working for the taxpayers, the ~axpayers are paying their salary. W~en a citizen app~-oaches a City employee with an intelligent question he should approach him with an intelligent answer. It is for him to give an intelligent answer without yelling. Atso~ the Police Department should be told how they should talk to citizens when they approach them in an intelligent way. These people don't realize they are being paid by the citizens of Boynton Beach. if they don:t get the ~word~ from this: he asked Council to get it to them. No,man Hands expressed thanks for the trash collection. He then asked if there is a City Ordinance for drinking on the s~reets. The Mayor stated ~yes~. Mr. Hands then stated that he has been calling in on this every week. Today two officers passed by two t~ucks in a ~'No Parking Zone~ and never even stopped. He then talked about breaking and enteming in the black section. He called to check the police record to see how many breaking and enterings in the bla~m seetion~ and how many arrests were made, in the past five years. He was never called back by the lieutenant. This is open season in the black section for breakin~ and entering. It has been said that the white police are afraid to c~me into the black section, but he thinks that they are not afraid~ they just don:t came. if they would approach people in an intelligent manner they would get different results. He asked Council to check and see if something can be done. O. T. McLean stated that he has had some very unusual experiences durin~ the past week; undesirable experiences. He was arrested by Sgt. Dixon~ and found Not Guilty by a jury in Palm Beach County. He then stated that Judge Kohl stated to the jury and the public that Boynton Beach has the ~worst Municipal Court he has ever known~. He further stated that he has had harassing~ obscene~ profane and threatening phone calls at his place of business. He found out who was n~ing these calls through the phone company. He then asked where are all or'the people whot were going to ~oin in a taxpayers' suit against the City of Boynton Beach, when it was known that Gene Moore was going to defend my suit against Judge Tomberg? And now the Council has voted for the City of Boynton Beach to reimburse Gene Moore and Judge Tomberg for all expenses involved. He also commented on how Vice Mayor, ~V~s. Jackson~ was disgracefully disgraced in Circuit Cou~t by Attorney Gene Moore. Har~y Lefort, 2152 N. E. 1st Way, introduced himself as representing Village Royale and member of the Iknited Boynton Civic League. LEGAL Ordinance No. 72-5 - P~oviding Procedure for Removal of City Manager Mr. Moore read Ord. ~72-5 by title only. Mrs. Jackson moved that Ord. ~72-5 be passed on second and final reading, seconded by Mr. Arehie. Motion carried 5-0. Ordinance No. 73-6 - Rezoning Lots 7 & 8~ Block 2, PaL Beach Country CtubEstates C-1 to Mr. Moore read Ord. ~72-6 by title only. Mr. Archie moved to pass Ord. Recommendation of Russell & Axon - Expansion of Water Facilities (On the table) Remained on the table. Confirm membership of Central Business District Development Board Mrs. Jackson nominated Howard Austin to fill vacancy of Bruce Thompson. At the workshop meeting on March 9th five names were submitted for this Board. Mr. Wilde asked that Alex Hogg semve in his place. Mr. Bruce Thompson will not be able to serve. The membership should be officially appointed at this meeting. Mr. A~ahie moved that these five be appointed to the Central Business District DevelopmentBoard.' Robert Beane~ Walter Dutch, John Howell, Howard Austin and Alex Hogg: seconded by Mr. Blanchette. Motion car- ried 5-0. Recommendation of Planning $ Zoning Board re Palm Beach Coun~yZoning Moratorium The Planning and Zoning Board recommends that any development which is for the betterment of Boynton Beach should be considered for annexa- tion. The Board also recommends that we cooperate with the County as much as possibles and that Mr. Largent meet with them. Mr. Archie asked for a clarification of the recommendation. Mr. Kos~ner~ Planning & Zoning Board~ explained that the request was for a moratorium of one year on all zoning. The Board decided it was not in favor of this request because it would tie the City of any type of zoning or work in this area. However, the Board did feel we should cooperate with the County as to what was going on. However, the Board felt the City should reserve the right to determine future zoning for the City and also for proposed area outside of City, but within their jurisdiction. Mr. Archie thought the recommendation of the Planning & Zoning Board was good. Mr. Archie moved to accept the recommendation of the Planning & Zoning Board and inform Mr. McIntyre of the decision, seconded by Mr. Blan- chette. Motion carried 5-0. Request for Change in C-asszfzcatmons (On the table) Remained on the table for the City Manager to make further study. -4- MINUTES REGULAR CITY COU~CIL MEETING MARCH 21~ 1972 Nq~W BUSINESS Request for Certificate of Zoning - Beer License, 500 S. E, tSth Ave. Mrs. Padgett stated that the Building Department states it is zoned C-1. Mr. Archie moved that the request be 9ranted~ seconded by Mrs. Jackson. Motion carried 4-0. Mr. Bianehette abstained. D. DMINISTRATIVE School Crossing Guards Mr. Kiltgore stated that back in May Boynton Beach made a request fo~ =he County to re/mburse the City for the cost of School Crossing Guards. They have said they will reimbumse only 90% of the requested cost of each City. Mr. Killgore recommends sending a letter to County Co~mission that we expect 100% or up to what the County pays. It is a small amount of revenue~ but it is the principle involved. Mrs. Jackson stated that the Palm Beach County League recommends we put in a request for 'uniforms. Mr. Killgore Stated that it was in the last request. Council a~eed to proceed with the letter asking £or 10~ reimbursement. ~ogress Report by City Manager on Requests for Sewer and Water Mr. Killgore reported that there has been considerable discussion con- cerning the requests for water and sewer. Yesterday he was present at the West Palm Beach meeting where the Air~ Water and Pollution Control Board met to decide on who would be responsible for all water and sewer systems in Palm Beach County. At this meeting it was decided that the Area Planning Board be appointed as an adjunct to the State Water Pollu- tion Control Board to control everything that happens in our county. It seems that a different view is being taken on furnishing sewer and water throughout the county. We must conform to this plan for the sake 0£ all~ for pollution control. He also stated that he met with the engineers in trying to look at every possible approach in order to plan the-future development of the City, and consider what is going on outside the City. All we need to take care of tP~s growth inside and outside o~ the City is an orderly plan that can be phased in so that no one will get penalized. List of Payments made in February Mrs. Jackson moved that the list o~ pap~ents made in February be accepted, seco~ed by Mr. Archie. Jackson. Motion carried 5-0. Mrs. Jackson asked if it is possible to bill Drexel and Hypotuxo for the $~06.227 Mayor Effron stated that Drexel agreed to pay all the costs including engineering. However, he does not think this can be billed to D~exel until and agreement is reached. The City Manager stated that if an agreement is reached it could be incor- porated in the agreement. Mr. Artz stated that the bills for t2A are not ready to be approved. Mr. Archie moved to pay the first four bills of Russell g Axon: in the amounts of $685.~7~ $178.42~ $3,587.49 and $406.22~ seconded by Mr. Bian- chette. Motion carried 5-0. Request of M~. Artz - NCR Equipment Mr. Killgore stated Mr. Artz~s recommendation. We are in the process of getting a better set of equipment for the Accounting Department. He recommends a purchase basis rather than a lease basis. F~. Eillgore con- curs with this idea. He cannot see any real advantage in a 5-yea~ lease when we could upgrade the equipment. Mr. Archie brought out that we would have to take it out o~ unappropri- ated surplus~ which is drawing interest. He also stated that when you are leasing the equipment the maintenance is cost free in the contract. WoUld this create a problem with extensive repaint. Mr. Artz stated there is about 3 days out of a year that these machines break down. They stand up quite well. Request of Mr. Artz - NCR Equipment, contTd. Mr. Archie stated, you talk about saving $8~000 but when you consider the interest on unappropriated surplus over a 5 year period. Then we would have to pay for maintenance. This should be looked into. Mr. Artz stated that the machine was delivered on a lease agreement basis and NCR is looking for payment on this at the present time. Mr. Killgore recommends purchase rather than a lease basis. Mrs. Jackson moved to accept the City Manager's recommendation, and purchase the NC~ at $23:614 ~rom unappropriated surplus~ seconded by Mr. Blanchette ...... ~ Motion carried 5-0. Keport on Police Department - Mr. Killgore Mr. Kiltgore reported that we have almost 15% decrease in crime in 1971. He is very pleased to see such a report. It does indicate that the Police Department is doing a good job in the City. Mr. Kil!gore further stated that he intends to verify any accusations concerning the Police Depart- ment. Clarification of Pay Increases Mr. Kitlgore stated that action was taken at the last meeting for pay in- crease~ he would ~ike to have the unclassified positions included. Funds are available~ and he would recon~nend they be included. Mrs. Jackson moved to accept the recommendation of the City Manager on the cost of living raise, seconded by Mr. Blanchette. Motion carried 5-0. Fire Training Area Chief Wright explained that they are not going to build any struct~es at this point. Only interested in Phase I~ which is a road into the area, fire pit and hydrant. We had 5 phases, and have cut it down to 2 phases, due to the possibility of a sub station in the area in the future. The volunteers and the staff would like to have authoriuy to proceed with this with the Couneil~s backing. Mayor Effron asked what the land is zoned? The Chief stated it is zoned Agriculture. The l~yor then asked if this would require a new zone, and would it fall under this one year moratorium of the County? The Chief stated that he would check into it with the County. Mayor Eff~on asked if there is any cost estimate for Phase i? The Chief stated they would spend $2,000, and then the volunteers would do some of the work. This is in the budget. Municipal Court System Mr. Arehie stated that in view of the fact that last Tuesday at the polls the voters overwhelmingly decided against the Municipal Courts he feels this should be turned over to the Charter ReviSion Cc~mittee, and be one of the first communities to go along with this !aw. We have one of the most outstanding courts in the county led by Judge Tomberg. The people felt they were saving money, that is why they voted the way they did. Mr. Arehie moved that this he tnrned over to the Charter I~evision Commit- tee to he turned over to the County to abolish Municipal Court by January lst: seconded by Mrs. Jackson. Motion carried 5-0. Mr. Preiditsch, regarding Refunding Agreements, asked if they have the right to run a line internally? He was referred to the Engineer. FROCLAMATION The request from the Governor is that the entire Council sign this Pro- clamation. Mrs. Padgett read the Arrive Alive Proclamation. ~'h~. Beyrer stated that there seems to be some con~usion in City Hall on registration and voting. We have not been informed to follow Court ru!- inq. We should get final ruling on it from the County.
