Mayor Effron called the Special Meeting to order at 7:32 P. M.
Review of Applications for City Manager
The Mayor requested that Council review the 24 applications and decide
which ones they want to interview. Many of these applicants are still
employed, and the Mayor requested that the Press be careful not to create
a hardship on these people. Some of the applicants have asked that theil-
applications remain confidential.
Mrs. Jackson stated that any applications are public records, this was
stated by Mr. Shevin. If they want to remain confidential then they
should not be considered.
Mrs. Jackson moved that any applicants that requested their applications
remain confidential not be considered at this time, seconded by Mr. Arc/lie
Motion carried 5-0.
Mayor Effron agreed that applications are open to the publics he is only
requesting that the P~ess please use discretion not to jeopardize these
men and their jobs.
Mayor Effron asked for an answer from each n~mber of Council as to whether
all are in agreement that we are looking for a City Manager with a muni-
cipal background, who knows Florida and the problems that exist in Florida.
Mrs. Jackson stated that there are people qualified to serve as City Man-
ager who have never had experienced but could be a very fine City Manager,
ar~ there are some City Managers she would not even consider.
Mr. Archie stated any candidate should have experience in Florida, not
necessarily Southeastern~ but anywhere in Florida, and not necessarily
managerial experience~ but administrative experience in municipal govern-
me_ut. He said he would not vote to bring a person down from New York To
interview; that our problems are different from theirs.
Mr. Roberts went along with the idea of sea, one familiar with Florida.
Mr. Blanchette stated that a City Manager should know municipal government
and have experience, and should also know the laws of the State of Florida~
There were 4 out of the 24 applicants who requested their applications re-
main cor~idential. F~. Sullivan was instructed to contac~ these four, and
tell them of Council's decision, and ask if they would like to be consid-
ered.

It was agreed if any of the four that Mr. Sullivan contacts want to be
interviewed: Council would interview them also.
Mr. Archie questioned the purpose of a Court Reporter and an Attorney be-
ing in attendance. Fir. Roberts said he understood the service station
matter would be discussed.

present and wanted to discuss action concerning his service station.
Archie stated the City Attorney was not present, and he did not wish
discuss it at this t/me.
Mr. Arehie moved to table the item until the next regular meeting that
Mr, Moore, the City Attorney~ is in attendance~ seconded by Mr. Blanchette
Motion carried 4-1.
Mrs. Jackson stated that when someone pays an Attorney to represent h/m
and feels he is in a C-2 zone perhaps we have overlooked something.
Mr. Arehie stated the Attorney should have contacted the City Attorney and
he would have been here,

Mr. Arehie stated that to his knowledge the City Attorney would not be
at the next Regular Meeting.
There was more discussion. Mrs. Jackson moved to have a Special Meeting
on Friday, January 28th, at 5:00 P. M., seconded by Mr. Archie. Motion
carried 5-0.
At this time Mr. Calloway~ Attorney~ presented the Council with a memo to
take what§vet action the Council sees fit.
Mayor Effron read the memo~ it concerned 114 N. Seacrest. The memo stated
that this property is presently being used as a dwelling and the City has
failed to collect rent. It is requested that the City of Boynton Beach
collect rent and carry insurance. It was signed by Richard B. Vastine.
Mayor Effron stated :that there was someone livin9 on the property at the
t/me last year's Council bought it, and the agreement was that there would
be no charge for rent for a period of time.
Mr. Archie explained the Boedecker Property. Mrs. Boedecker is allowed to
live there the rest of her life without paying any rent. It was appraised
at a higher amount than we paid for it, and we gave her a life estate,
and there will be no heirs. He thought perhaps this parcel could be the
same way.
Mrs. Padgett stated that the deed gave the grantors the right to retain
possession for two years.
Mr. Callow~y stated that it is believed that the person utilizing the
house is not the person to whom the reservation runs in the deed.
Council agreed to check into it and handle it administratively.
Mr, Archie left the meeting at this time.
Pending Suit of Milnor Corporation
The ~ummons was delivered to Council on January 14th.
Mrs. Jackson moved to answer the summons within 20 days after it was de-
livered~ seconded by Mr. Roberts.
Mayor Effron stated that since P~. Roberts was not on the Council and was
not involved as far as the Public Hearings of the Planning g Zoning Board
and the Council: he had requested the Acting City Manager to give Mr.
Roberts the entire file of the zoning request by Milnor Corporation to
review~ so that he would be fully aware of what is involved in this, for
t~i~Council meeting. The Mayor then asked Mr. Roberts if he had formed
an opinion after reviewing the file?
Mr. Roberts stated that the summons should be acknowledged~ and it should
not be let go by default.

Discussion followed,
Mrs. Jackson stated that the City Attorney has pointed out that when some-
one abstains~ it is the same as going with the majority.' Mr. Archie
should have disqualified himself - not abstained.
Mrs. Jackson feels this was the feeling of the majority of the people who
lived there first - our first duty is to these people.
Mayor Effron stated that pumsuing the suit is against his personal convic-
tions. He feels that the City will lose~ and will have spent 6 to 8 thou-
sand dollars of the taxpayers' mDney. He said he will not be a party to
a default action~ he wants to let the court decide.
It was asked i~ the motion is to "defend the suit?" Mrs. Jackson Stated
that her motion is only to answer the summons within 20 days.
The motion carried 4-0.
Mayor Effron read a letter from Mr. Moore stating he would not be able to
defend the City on this suit.
Mrs. Padgett was requested to check with the City Attorney to see if he
would answer the summons.
If we defend the suit~ the Mayor asked~ are there any objections to the
City Prosecutor~ Prod Hill: defending the City?
~rsz Jackson moved to appoint Fred Hill as the interim Atto=ney~ if he
agrees, seconded by Ms. Btanchette. Motion carried 4-0.
