Minutes 10-16-13 MINUTES OF THE CODE COMPLIANCE BOARD MEETING HELD ON WEDNESDAY, OCTOBER 16, 2013, AT6:30 P.M., IN CITY HALL CHAMBERS, 100 E. BOYNTON BEACH BOULEVARD, BOYNTON BEACH, FLORIDA PRESENT: Michele Costantino, Chair Diane Springer, Code Compliance Coordinator Gary Cole, 1 St Vice Chair Shana Bridgeman City Attorney RoseMarie Yerzy, Interim 2 " Vice Chair Kathleen Carroll William Cwynar ABSENT: Alan Borrelli I. Call to Order Chair Costantino called the meeting to order at 6:34 p m. II. Approval of the August 21, 2013 Code Board Minutes Chair Costantino announced there were some corrections to the August 21, 2013. Case No 13 -364 — The compliance date should read November 19, 2013 the first time it is mentioned in the motion paragraph Case No 13 -986 — The amount of the fine that was certified should be $300.00 instead of $350.00 Motion Ms Carroll moved to approve the August 21, 2013 minutes as corrected. Vice Chair Cole seconded the motion that unanimously passed III. Approval of the Agenda Officer Pierre announced the following changes to the agenda: Case No 13 -1121 was tabled until November 20, 2013 Case No 13 -467 was tabled until November 20, 2013 1 MEETING MINUTES CODE COMPLIANCE BOARD BOYNTON BEACH, FLORIDAD OCTOBER 16, 2013 Motion Ms. Yerzy moved the aforementioned cases be tabled until November 20, 2013. Ms Carroll seconded the motion that unanimously passed. Vice Chair Cole asked Officer Pierre the status of case no. 13 -467. Officer Roy replied they were still working with the Building Department about a discrepancy on a permit for a prior lien. Case No. 13 -1410 had complied and Case No 13 -1966 was removed. Officer Pierre stated those were the only changes to the agenda Motion Ms. Yerzy moved to accept the changes Ms. Carroll seconded the motion that unanimously passed. IV. Swearing in of Witnesses and Introduction Attorney Bridgeman explained the hearing procedures and administered an oath to all who intended to testify Officer Pierre called the roll and determined who was present. V. New Business a. Cases to be heard — Tabled Case No. 13 -1754 Cosimo and Stella Falzone 2010 S. Federal Hwy #209 CO CH15 Sec. 15 -120 (D) INC CO CH10 Sec. 10 -56 (D) CO CH 13 Sec. 13 -16 CO CH10 Sec 10 -52 Mow overgrown yard, remove trash and debris. Cease all auto repairs in R -C Zone (multifamily zone). Remove all materials stored outside. All windows must have screens, repair broken soffit Apply for and pass inspection for the business tax receipt (License) for rental property Pat Hart, Code Compliance Officer, presented the case as in the notice of violation on initial inspection dated August 07, 2013 A written notice of 10 days to comply was 2 MEETING MINUTES CODE COMPLIANCE BOARD BOYNTON BEACH, FLORIDAD OCTOBER 16, 2013 card was dated September 11, 2013 Officers were called by the Water Department for theft of utilities and upon arrival noticed violations still existed. Since inspection, no action has been taken to repair the violations Officer Hart showed the Board pictures of the property Salvador Falzone, 335 SE 23 Avenue, was present and pled guilty with an explanation. Officer Hart showed Mr Falzone the pictures of his property some of which were taken on October 16, 2013 Officer Hart explained the property was a triplex, two of which had a water meter and the meter for the third unit had been removed. The property owner had a hose going around the back of the house and back -feeds water into the other unit Officer Hart stated he had spoken to Mr. Falzone on three separate occasions about this issue which is not acceptable. Officer Hart requested a cease and desist order on the item of the water Chair Costantino asked Officer Hart if the owner has business tax receipts (BTRs) on all of the rentals. Officer Hart responded none of the units have BTRs and none have been applied for. Mr Cwynar asked if all windows need to have screens. Officer Hart said it helps keep bugs out which can become a health issue. Chair Costantino asked Mr Falzone for his explanation on these violations Mr. Falzone responded the property is owned by his mother and father His father passed away last year and his mother has been sick and in and out of the hospital Mr Falzone stated the property became his responsibility. There are tenants who live there who are not paying rent and are responsible for some of the current violations. Chair Costantino asked Mr Falzone how long his family owned these apartments Mr. Falzone responded his family has owned this property for 24 years and this is the first time there have been problems with Code Enforcement. Mr Falzone explained he had applied for a loan that was approved Mr. Falzone asked the Board to give him an extension so he can straighten out these violations. Chair Costantino asked if his family ever got a business tax receipt for these rentals over the past 24 years to which Mr Falzone answered yes Mr. Falzone explained that he was not aware the business tax was not paid. Chair Costantino asked Officer Hart if there was anything in the paperwork that showed this property ever had a BTR over the past 24 years. Officer Hart stated he was not aware of any information in that regard. Ms Brenner commented many of the violations could be resolved easily Mr Falzone agreed He also wanted to bring to the Boards attention the property is currently listed with Century 21 and there are a few investors who possibly plan on tearing the property down and rebuilding to make the area look better. However, Mr. Falzone also commented he plans on going ahead with the repairs whether the property is sold or not. Chair Costantino asked Mr. Falzone if there were still tenants living in the property. He is staying in one of the other units and there is family in the third unit. After seeing the pictures of the property, Chair Costantino was concerned the repairs were going to cost more than anticipated. She added there will probably be additional violations the Code Officer will find. Mr. Cwynar asked Mr. Falzone if he thought 60 days would be enough time to fix the violations. Chair Costantino asked Officer Hart what he wanted the cease and desist order on and Officer Hart replied the water hose going to one of the units. The hose sits outside and the water sits inside the hose which can cause a health issue. Ms. Brenner replied she did not disagree with 60 days; however, there should be a stipulation that Mr. Falzone will at least apply for the BTR before 60 days. Chair Costantino replied there is no reason there cannot be multiple orders and have different time limits for each. Officer Hart stated Mr. Falzone has already had more than 60 days and nothing has been done. Ms. Brenner expressed concern the property be taken care of whether it is sold or not so it does not attract vagrants and continue to make the area look bad. Chair Costantino commented the unsanitary pool was also a concern. Mr. Falzone agreed to comply with the water restriction to the unit, clean up the property and fix the pool within two weeks. The pool has been empty to make these repairs and the green water is rain water which accumulated at the bottom. Chair Costantino asked Mr. Falzone if the cars were still on the property and he replied all cars were being taken off the property. Vice Chair Cole suggested instead of breaking up the violations with separate time limits, narrow it down to 30 days because the list of violations is long and Mr. Falzone has already had a long time to make these repairs. Chair Costantino commented most of the repairs can be done within the 30 days without a major cash flow. Most of the violations can be done with physical work. Chair Costantino agreed to give the City a Cease and Desist Order for the water hose and 30 days on all other violations. Motion Based on the testimony and evidence presented in the aforementioned case, Vice Chair Cole moved that this Board finds that a Cease and Desist Order to Cosimo and Stella Falzone be issued until October 23, 2013 to bring the water violations into compliance. The Board has considered the gravity of the violations, the actions taken by the Respondents and any previous violations by the Respondents and hereby orders a fine in the amount of $500 per reoccurrence of the violation thereafter shall be imposed on the Respondents. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Ms. Brenner seconded the motion that unanimously passed. 4 MEETING MINUTES CODE COMPLIANCE BOARD BOYNTON BEACH, FLORIDAD OCTOBER 16, 2013 Motion Based on the testimony and evidence presented in the aforementioned case, Ms Carroll moved that this Board find that the Cosimo and Stella Falzone are in violation of the City of Boynton Beach Code as cited and moved to order that the Respondents correct the violations on or before November 15, 2013. The Board has considered the gravity of the violations, the action taken by the Respondents and any previous violations by the Respondents and hereby orders that if the Respondents do not comply with this order, a fine in the amount of $150 per day for each day the violations continue past November 15, 2013, plus administrative costs shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Vice Chair Cole seconded the motion that unanimously passed. Skip Lewis, Senior Code Compliance Officer presented the next case Case 13 -1851 John and Jennifer Davis Property Address: 3184 Ocean Parkway Violation(s): CO CH 10 Sec. 10 -56(A) CO CH10 Sec. 10 -58 (E) CO CH 15 Sec. 15 -120 (D) INC CO CH 13 Sec 13 -16 Water service is required to occupy residence. Mow and trim overgrown property. Remove trash, debris and tires from the property Apply for and pass inspection for the Business Tax Receipt for rental property Officer Lewis stated this was a complaint from the Police Department and multiple complaints from neighbors. Initial inspection was on August 22, 2013. Service was obtained by posting Staff recommended 15 days to October 31, 2013 Officer Lewis identified a lawyer in the audience who represents the Bank James Ferraro, Attorney, representing Deutsche Bank National Trust Company who is currently pursuing foreclosure of the property was present The sale is scheduled to take place November 02, 2013 after which the Bank will take the property back. The company servicing the loan is Ocwen Loan who is aware of the situation with the property Mr Ferraro mentioned two violations which he did not think were applicable. However, with respect to the trash and debris removal, mowing the lawn and the exterior, violations will be resolved no later than October 25, 2013 and no sooner than October 29, 2013. Officer Lewis offered pictures of the property. Mr. Ferraro advised the bank would take care of the violations by next week. Mr. Cwynar asked if the property is currently occupied and Officer Lewis did not believe it was occupied. The 5 MEETING MINUTES CODE COMPLIANCE BOARD BOYNTON BEACH, FLORIDAD OCTOBER 16, 2013 Police Department got a complaint from a neighbor who asked the house be cleared because of noise she heard. Officer Lewis stated when he went there he saw no power and no water. Chair Costantino commented it may be inhabited in the evening by vagrants that would not require power or water. Mr. Cwynar asked if the Bank has the title and Mr Ferraro responded the Bank does not. Mr. Ferraro also wanted to make the Board aware the attorney assigned to this case and the point person from Ocwen will take care of the violations, but his concern is there are children going into the property At the very least, the locks should be changed and the windows boarded to prevent that from happening. Mr Ferraro also wanted to ask about the two other violations and whether or not they are applicable The first violation is the issue of the water being on if the property is not occupied and the second issue was registering for a BTR (Business Tax Receipt) on a rental property However, Deutsch Bank does not consider this a rental property Vice Chair Cole responded since the property is vacant the violations for the water and the Business Tax Receipt will be dropped Chair Costantino clarified the motion would only include the mowing of the property and removal of the tires Office Lewis stated there is also a vehicle on the property Motion Based on testimony and evidence presented in the aforementioned case, Ms. Carroll moved that this Board find John and Jennifer Davis are in violation of the City of Boynton Beach Code section as cited and move to order that the Respondents correct the violations on or before October 31, 2013. The Board has considered the gravity of the violations the actions taken by the Respondents and any previous violations by the Respondents and hereby orders that if the Respondents do not comply with this order, a fine in the amount of $200 per day for each day the violation continues past October 31, 2013 plus administrative cost shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this order Ms Yerzy seconded the motion that passed unanimously Mr Cwynar asked for clarification if this is to the owners and not the Bank. Chair Costantino replied it was cited in the owner's name so it has to be said in the owner's name but the Bank is clearly the owner Mr. Ferraro said it would not affect their willingness to fix these issues.
