He contended it was not a good idea since non - profits do not pay taxes, even though the church had offered to pay the same amount to the City, in essence bribing the Commission. Mr. Taylor hoped the Commission would not accept the bribe. He urged the Commission to not allow the church into the Mall. Cliff Montross, 109 SW 18 Street, pointed out the purpose of the Community Redevelopment Agency (CRA) was to help people improve their properties and make life better for those individuals within the community. He complained the Boynton Beach CRA had an agenda for having a good time, not helping people. Mr. Montross urged the Commission to encourage the CRA to assist the property owners. No one else coming forward, Mayor Rodriguez closed public audience. He commented the CRA mission was to eliminate blight and slum and create an environment for redevelopment. More information would be provided to Mr. Montross. Commissioner Hay observed there would be a ground breaking for Ocean Breeze at 1 p.m. on Friday for the construction of 21 single - family homes, a CRA project. 5. ADMINISTRATIVE A. Vice Mayor Orlove seconded the motion for discussion. 5 Meeting Minutes Regular City Commission Boynton Beach, FL January 3, 2012 Vice Mayor Orlove noted one of the proposed honorary members was deceased. He was unsure of the precedent that may be established. Chuck Magazine, Board Representative, advised some of the honorary members were involved in the events sponsored by the Veterans Advisory Commission. Vice Mayor Orlove suggested the member be designated as "in memoriam ". Commissioner Hay amended his motion to include Ms. Milano's designation as "in memoriam" Vice Mayor Orlove seconded the amended motion. Vote The motion passed unanimously. Vice Mayor Orlove requested to return to Item 5.D for discussion purposes, since he was on the prevailing side of the vote. Motion Vice Mayor Orlove so moved. Commissioner Hay seconded the motion. Vote The motion passed unanimously. Vice Mayor Orlove understood there were a couple vacancies on the Financial Advisory Committee and not just one. The Chair of the Financial Advisory Committee was present and could relate the desire of the Committee. There is an alternate that would like to be moved to a regular position. Mayor Rodriguez confirmed the Clerk's office had processed the application received this date. Janet Prainito, City Clerk, agreed the past process was to hold any applications received after the agenda had been published for the next meeting. The applicant had been informed of that process and requested the application be distributed to the Commission. Commissioner Ross reported she had been informed of some urgency for the appointment that had been conveyed to the Interim City Manager by the Chair. Don Scantlan, Chair of the Financial Advisory Committee, related he had contacted the Interim City Manager and inquired why the alternate had not be moved up to a regular. Ms. Prainito advised Commissioner Ross had the regular appointment. Commissioner Ross wanted both regular appointments to be made with the two applicants. Mayor Rodriguez argued the Commission did not typically consider items submitted the day of the meeting. Mayor Rodriguez inquired if Commissioner Ross wanted to move Mr. Fisher up to a regular member and she did not. Vice Mayor Orlove recalled appointments had been made from information handed to the Commission. Ms. Prainito commented in the last six to eight months the Commission has not considered applications received after publication of the agenda. Commissioner Ross stated she had received a message from the Interim City Manager that the Financial Advisory Committee wanted to ask her to appoint Mr. Fisher. She was taken aback because it would normally be done from the dais and she had passed on the appointment at the last meeting. She was not sure if that was a common practice with other Commissioners. The staff liaison, Mr. Atwood, would normally be the one to approach the Commissioner and discuss the issue. Commissioner Ross was concerned with the process and wanted to be sure the advisory boards and committees were following proper procedure. No other Commissioners were being approached with the request. Mayor Rodriguez indicated he had been approached on numerous occasions by individuals who knew he had an appointment and wanted his endorsement. Commissioner Ross interjected the matter was discussed at the meeting specifically directed to Commissioner Ross. Attorney Cherof agreed with the remarks of the City Clerk and stressed the Commission sets the protocol for appointments. They are appointments of the City Commission even though the designations of the appointments are rotated. They are not individual Commissioner appointments. It would not be an appropriate role of a liaison to make recommendations to an individual Commissioner or the collective Commission. Ms. Prainito pointed out there were two regular appointments and one alternate appointment for the Financial Advisory Committee. The two regular appointments could be made at this time. Commissioner Hay mentioned even though there was a protocol the Commission could overrule the established process. Vice Mayor Orlove wanted to alter the minutes to show on page 21 that he did return to the dais to vote because the vote was 5 -0 and have the notation on page 25 removed that he had returned to the dais. 8 Meeting Minutes Regular City Commission Boynton Beach, FL January 17, 2012 Wally Majors, Director of Recreation and Parks, was proud to announce on January 21st at 11 a.m. there would be a ribbon cutting for the Barrier Free Park. There would be many activities for children and a wheel chair tennis exhibition featuring some of the top players in the country. A short video was displayed to better define the concept of "barrier free ". B. Request for a closed -door session on February 7, 2012 to discussion the case of Seymour Reiner versus the City of Boynton Beach and others. Attorney Cherof advised there was litigation pending against the City and other parties. The case was being handled by outside counsel and monitored by the Risk Manager. The case is Seymour vs. Comcast, Delcom, City of Boynton Beach, Palm Beach County and is pending in Circuit Court in Palm Beach County. There is a settlement proposal pending that has to be reviewed. He suggested 5:45 p.m. would be appropriate. 4. CONSENT AGENDA Matters in this section of the Agenda are proposed and recommended by the City Manager for "Consent Agenda" approval of the action indicated in each item, with all of the accompanying material to become a part of the Public Record and subject to staff comments. 5 Meeting Minutes Regular City Commission Boynton Beach, FL February 7, 2012 Brian Merriman, 22 Dogwood Circle, indicated visual and crime were two of the biggest aspects of Boynton Beach. Improved landscaping and lighting would be helpful along the main entrances to the City. There was a significant amount of police activity in his neighborhood and more lighting was needed to improve security and reduce crime in his development. Reducing crime and beautification of the streets would encourage more people to move to the area. Lori Wilkinson, 2458 SW Cranbrook Drive, Secretary of the Greater Boynton Beach Foundation, thanked the Commission for coming out and supporting the opening of the Barrier Free Park. She had been involved in the project for over eight years and was glad to see the vision some to fruition. Clarence Shahid Freeman, 7928 Piper Lane, Lake Worth, a Civil Rights Activist and President of the Democratic Club, had toured the City of Boynton Beach and spoke to many of the residents who related their concerns with the Police Department. Mr. Freeman discussed those concerns with various City officials and staff who agreed to address the issues. He was disappointed in the recent political events that had occurred in the City. Herb Suss, 1711 Woodfern Drive, wanted confirmation that the Police Department lobby was only open to the public on Wednesdays for a few hours. He understood there have been budget cuts, but access to the Police Department was a major safety concern. Mr. Suss complimented every department for taking the necessary budget cuts, but employee morale was very low. Vice Mayor Orlove suggested Mr. Suss discuss his concerns with the Police Chief. Edward Tedtmann, 869 NW 8 Avenue, complained there was not enough data in the agenda to make the public aware of the issues being discussed. Vice Mayor Orlove advised the agenda and all backup materials were available online. Ms. Prainito clarified there are hyperlinks to the backup materials for each item. Jack McVey, 1729 Banyan Creek Court, defended the City of Boynton Beach with its low crime rate, great parks, skilled fire fighters, champion athletic programs that the residents should be proud of and unite to support the City. Vice Mayor Orlove inquired if there was a time limit for making the appointment and Attorney Cherof replied the vacancy had to be filled within two meetings following the declaration. This year was the 55 opening day for the Boynton Little League. The teams were grateful for the support of the Commission and the City. The Fire Department Honor Guard also attended the opening event and sponsored a team called "The Blaze ". Brian Edwards, 629 NE 9 Avenue, complimented the Police Chief and Interim City Manager for standing up for what is right for the City. No one else coming forward, Mayor Hay closed public audience. 5. Appointment to fill the District 11 Commission temporary vacancy Mayor Hay requested each of the five candidates for the vacancy, Anthony Barber, Buck Buchanan, Mack McCray, Brian Miller and Victor Norfus, stand and be recognized. Brian Miller was not present. Commissioner Ross understood Floyd Zonenstein was also a candidate. The City Clerk's office had not received any information on Mr. Zonenstein's interest Vice Mayor Orlove recalled an email that indicated his desire to be a candidate. Vice Mayor Orlove inquired of Attorney Cherof what would happen if the vacancy was not filled. Attorney Cherof replied the Commission would have to continue to seek to fill the vacancy. It is not a permanent vacancy and therefore an election was not possible since Mayor Hay could possibly return to the seat during its term. The practical application of the language of the Charter is that the Commission must continue to attempt to fill the vacancy. 5 Meeting Minutes Regular City Commission Boynton Beach, FL March 6, 2012 Mayor Hay contended the Commission should accept the name of Floyd Zonenstein for consideration. Vice Mayor Orlove and Commissioner Ross accepted the inclusion of Floyd Zonenstein. It was decided the names would be called in alphabetical order. There was no motion to appoint Anthony Barber. Motion Vice Mayor Orlove moved to appoint Buck Buchanan to fill the vacancy in District II. Mayor Hay passed the gavel and seconded the motion. Accept the status report and allow the Boynton Beach City Library to continue its Materials Recovery System agreement with Unique Management Services, Inc. 6 Meeting Minutes Regular City Commission Boynton Beach, FL March 20, 2012 classes to obtain job skills and positively impact their future and families. After 11 years of operation, expansion is necessary to meet the needs of the community. There have been negotiations and contracts to purchase the properties to the north and south of the current location for demolition and future development. The Women's Circle would be giving notice to the Historic Preservation Planner before demolition of the buildings. The present moratorium could prevent the Women's Circle from pulling permits. Sister Lorraine wanted assurances there would be no barriers when the funding is available for the expansion. Suki deJong, 2076 SW 14 Avenue, with Move to Amend, a national organization having an affiliate in Palm Beach County, pointed out there is a Citizens United Supreme Court ruling against the Federal Elections Commission lifting corporate limits on buying elections. This would have a corrupting influence in all elections across the country. Money should not be able to buy an election. In a true democracy, it should be the will of the people that vote who have the power to select their representatives. Her organization, Move to Amend, was seeking the Commission and City of Boynton Beach to support their cause. An amendment to the Constitution was being sought. Ms. deJong offered examples of appropriate language for a resolution. Commissioner Ross thanked Ms. deJong for bringing the issue to the attention of the people and the City. Gary Solomon, 9268 Cove Beach Circle, Boynton Beach from Sand Sifters invited everyone to participate in the "Gain' Bananas Beach Cleanup" to be held on April 7 from 8 a.m. to 10:30 a.m. at Oceanfront Park. The event would educate those participating on the reasons for the beach cleanup efforts. The event was done in conjunction with the Recreation and Parks Department and many co- sponsors including the Community Caring Center. A food drive for non - perishable items would be included in the event for the benefit of the Community Caring Center. Additional collection sites had been added throughout the City facilities for donations. Healthy smoothies would be available and of course, bananas. Activities for kids would be available and a discussion on sea turtle awareness given. Doug MacDonald, President of Quantum Limited Partners, Quantum Park Property Owners Association and Principal and President of 1325, 1275 Gateway, had negotiated a lease for a charter high school at 1275 Gateway, Lots 18 and 19 in Quantum Corporate Park. The site was approved in 2003 for a charter high school; however, the moratorium has prohibited the issuance of permits for renovations to the site. Mr. MacDonald requested the matter be placed on the agenda as quickly as possible so the school could be operational by the new school year beginning August 1, 2012. Angeline Rhine, 14711 Palmetto Palm Avenue, Miami Lakes, Regional Director for Accelerated Learning Solutions, which operates 14 charter high schools in Florida with eight more to open the next school year including the one in Boynton Beach was the 5 Meeting Minutes Regular City Commission Boynton Beach, FL March 20, 2012 tenant. There would be as many as 500 students, between the ages of 16 and 22, across three shifts, who have dropped out of school or are at high risk. Twenty professional job opportunities would be created. They are accredited and less than 20% of the charter schools in the State have achieved the goal. A majority of the students do go on to secondary schools or colleges. Charles Lubke, 737 Sunny South Avenue, thanked the City and staff for their quick resolution to a problem at 3500 Miner Road. Mr. Boateng and Mr. Low were particularly helpful. Don Scantlan, 13 Cedar Circle, distributed papers relating to a case filed before the Florida Elections Commission and the findings of the Commission dated February 23, 2012. (Copy is available in the City Clerk's office) Mr. Scantlan had been a candidate for District IV Commissioner as was Commissioner Marlene Ross. Based on the findings of the Commission and assessment of a civil penalty against Commissioner Ross, Mr. Scantlan urged the Commission to act responsibly and take the necessary action to right a wrong, if appropriate. Victoria Castello, 406 South Seacrest Boulevard, spoke about the City giving away part of an eco park near the Parkside development. A lobbyist wrote the contract that the City approved which did not appear to be in the best interest of the City. Jeff King, 743 -8 NE 12 Terrace in Mariner's Village, President of the Inlet Cove Association (INCA) reported the theme for the organization was crime. Chief Immler and Phil Hawkins had done presentations for their meetings and provided invaluable information and insight. Anything the Commission can do to support the Police Department would be appreciated by the INCA neighborhoods. No one else coming forward, Mayor Hay closed public audience. Attorney Cherof pointed out for the benefit of the public that there was a moratorium in place, modified in part by the Commission. The study period ends in May and it would be returned to the Commission with proposed regulations for properties included in the study. PUBLIC AUDIENCE INDIVIDUAL SPEAKERS WILL BE LIMITED TO 3 MINUTE PRESENTATIONS (at the discretion of the Chair, this 3 minute allowance may need to be adjusted depending on the level of business coming before the City Commission) Mark Karageorge, 240A Main Boulevard, wanted to clarify the City has several economic development programs including rental assistance, signage assistance, facade grants, build out assistance, DIFA agreements and brownfield initiative funding. They have been in use for over three years and have attracted businesses from surrounding cities to relocate. The Development Department has incentives such as waiving impact fees, using payment plans on fees and having a ten -year plan to be more business friendly. Dr. Piotr Blass, 113 West Tara Lakes Drive, was delighted with the relationship being developed with Haiti. Dr. Blass indicated he hoped to have an estimate in writing to remove the asbestos from the Old High School and possible renovations of the site to include space for the University of Boynton. John McGovern, 2620 Spiceberry Lane, understood the new Attorney General would be reviewing cases to determine those that did not merit prosecution. He asked an investigation be conducted into a police report that refers to a Department of Children and Families (DCF) investigation being released to the public. In his view it was ethically questionable and procedurally incorrect and perhaps illegal. Neither the name of the child nor the name of the reporter can legally be divulged. He urged the Commission to initiate an investigation involving the release of a police report relating to Jose Rodriguez. No one else coming forward, Mayor Hay closed public audience. 5. Discuss the appointment of Richard Wise to the Community Relations Board as an alternate and possible appointment of Richard Wise to the Code Compliance Board Richard Wise was present and explained his belief that unless there were felony charges, an arrest did not have to be reflected on the application. He has been a member of the Community Relations Board as an alternate and was now applying to be a member of the Code Compliance Board. He is a licensed mortgage broker, insurance broker and was a licensed property manager. It was an oversight on his part to not mention a conviction he had in the 1980s in the State of Maryland. Attorney Cherof advised a conviction for a crime would not prohibit an individual from serving on a board. Mr. Wise could serve on the two boards. Ms. Prainito explained the information had come to light when James Brake pointed out there had been an argument or altercation between Mr. Wise and Mr. Yerzy who is currently a member of the Code Compliance Board. Michele Costantino provided more detail on the previous arrest history and background of Mr. Wise. Mr. Holzman concluded, based on the information given, that it was an honest error, but there may be issues with another member of the Code Compliance Board. He did not feel any action was necessary and Mr. Wise should remain on the Community Relations Board. Consensus Mayor Hay declared there was consensus to allow Mr. Wise to continue to serve on the Community Relations Board. 6. He meets many senior citizens that cannot hear and pointed out there is a web application individuals can obtain for the telephone that can convert a voice message to text. Charles Gaulkin, 8 Colonial Club Drive, had a question about the Commission's procedures. There was a speaker who wanted to speak earlier about the high school, but was advised it was not the appropriate time for comment. It was clarified Public Audience was for items not on the agenda. Since the item was on the agenda, he could speak to that item at that time. Herb Suss, 1711 Woodfern Drive, relayed he and his wife are volunteers at Galaxy Elementary School, and the principal was very appreciative of the good relationship the School has with the City. He noted former Commissioner Bob Ensler initiated the Boundless Park and thought there should be some commemoration of his efforts at the Park such as a plaque or bench. Additionally, he noted business coming into the City was up 35% to 40 %. He expressed his gratitude to all City departments for working hard under a tough budget. He thought there should be some recognition by the City's residents of the employees' work as it should not be taken for granted. He did not support outsourcing any City function. Paul Dalton, Teacher at Forest Park Elementary School, was present with Safety Patrol Captains Carine Silvan and Marcio Baris. Ms. Silvan thanked all who donated to the Safety Patrol's Washington D.C. trip. Mr. Dalton added the entire school was appreciative of the donations to allow the students to participate in the trip. Vice Mayor McCray commented he represented the Poinciana School Safety Patrol years ago and it was a joy. He commented the students were in for the experience of a lifetime and he acknowledged the students had to be excellent students to be on the Patrol. He commented the City was proud of them. He was scared because some of his friends had died with no explanation. Mr. Johnson was considering taking his concerns to the media to get answers. He specifically complained about Sgt. Hawkins not providing him with a complaint form in a timely manner. Vice Mayor McCray stressed the walk to Bury the Violence was circumvented by the intimidation by the police officers. He had a copy of the Code of Ethics for police and would remind them of their fiduciary responsibility to the citizens. Vice Mayor McCray had encouraged Mr. Johnson to come forward and address his concerns to the City leadership to deal with the issue. She thanked the Commission for the announcement and for all those who participated. Don Scantlan, 13 Cedar Circle, advised the Library does not have an agreement with Workforce Alliance. Mr. Scantlan works as a volunteer to help people find jobs. He has had as few as two participants and as many as nine people for an eight -hour session. Thomas Jones, 808 NW 8 Avenue, commented on the financial status of the Police Department that it would benefit the City and citizens to do an outside independent audit of where the monies were being spent. He surmised several million in savings could be found. Many things were mismanaged in the Department and improvements could be made to gain dollars for improvements. Susan Mandell, Room 101, Marina Village on Ocean Avenue, announced she was helping to create a healthier City of Boynton Beach. She would be opening next week and invited everyone to visit her spinning facility to empower, create, and nuture the younger generations through a healthier adult world. She also had spinning equipment available at Oceanfront Park from sunrise to sunset to accommodate all working schedules. Brian Miller, 2515 NE 2 Court, spoke on behalf of the football coach for Boynton Beach High School. The football program needs the entire community's support. New helmets were needed for a total cost of $10,500 or $200 per helmet to satisfy a new safety standard set by the State. The Sponsor -A -Tiger program involves a $200 donation to purchase a helmet in return for 3 or 4 season tickets provided to the donor. No one else coming forward, Mayor Hay closed public audience. 5. Suspended Mayor Rodriguez's letter advising he believed he had been lobbied was included in the materials submitted by Mr. Katz. Nothing was found in the records per a public records request that had been submitted by Mr. Katz. He urged the Interim City Manager to admit she was pressured by the suspended Mayor into having him investigated because he did not want Mr. Katz on the Charter Review Committee. Mark Karageorge, 240A Main Boulevard, announced Pathway to Prosperity would be having another meeting entitled, "A Village at Work" on June 26 at the R.M. Lee Center. He indicated the Boynton Community Choir had been in existence for two months and was growing at a rapid rate. It unites people from different faiths and they had an opportunity to perform with Grammy winning artists at the Father's Day celebration at St. John Baptist Church. All were welcome to join the choir. Dr. Piotr Blass, 113 West Tara Lakes Drive, offered condolences to Commissioner Ross and her family for their recent loss. He hoped Commissioner Ross's idea for an education initiative would promote a University of Boynton Beach. Dr. Blass divulged his love for the City of Boynton Beach and his admiration for the Police Department. He would prefer the City Police Department remain and contract with the Sheriff's office for additional assistance. It is important for the City to have its own, independent Police Department. Herb Suss, 1711 Woodfern Drive, contended the search for a City Manager has caused the City embarrassment across the State and Nation and was not cost effective. The Interim City Manager, in his opinion, was the best candidate and the Commission should recognize her abilities and work together to unite the City. Mr. Suss urged the citizens to volunteer at Galaxy Elementary as it was a rewarding experience. Cliff Montross, 109 SW 18 Street, spoke about a vacant lot on Seacrest Boulevard where men were loitering. He suggested a solution would be to create a pocket park for these men to utilize. Mr. Montross felt other ideas from the citizens should be considered rather than a decision made by a Board. A recent article in the newspaper had conveyed a bad element was occupying the space that did not improve the image of the area. 5. ADMINISTRATIVE A. Mr. Katz mentioned the suspended Mayor now has his boat for sale. Mr. Katz had attended the July 4 fireworks that were patriotic and very enjoyable. He speculated that Mr. Suss's not attending the next fireworks display would be appreciated by many others. Herb Suss, 1711 Woodfern Drive, complimented the Commission and staff for their budget presentations. Many good points and recommendations were offered. Mr. Suss urged the Commission to continue to support the 7.8 millage rate to build up a residual to cover future capital improvements. He reiterated the $50,000 spent on the fireworks display could have gone into the Heart of Boynton and should be closely monitored for next year. Review procedures for filling vacancy on Commission. Mayor Hay noted the Commission had recently gone through a similar process and wanted to declare the Commission District 1 position as vacant. The Charter requires the position be filled by two Commission meetings thereafter. Mayor Hay contended the position should be open to the public and let those interested submit their qualifications to the City Clerk's office to be reviewed at the first and second meeting in August to fill the position. The positive momentum created is appreciated by the Chamber of Commerce and supports the efforts. Mr. Porges made a public appeal that the Commission appoint Ms. LaVerriere as the City Manager of Boynton Beach. She has proven to be more than qualified. Her actions continue to demonstrate her administration is good for business in Boynton Beach and good for the community. Mayor Hay was thankful for the comments. He was glad to see the City, Chamber and Community Redevelopment Agency working together as a team. Commissioner Ross inquired if an Executive Director had been appointed for the Chamber of Commerce. Mr. Porges reported a rebranding was underway and after completed, the search for a new Director would be done. Vice Mayor McCray thanked the Chamber for their comments and thought. He thanked the citizens for their support. He did not understand why the elected and appointed officials in the City could not come together and recognize the Interim City Manager for her excellent work by appointing her the City Manager. Commissioner Ross questioned if all the appointments had been made. She understood there was another application and resignation. Janet Prainito, City Clerk, advised there had been a resignation from the Financial Advisory Committee, David Katz, who submitted an application to serve on the Planning and Development Board. The agenda was being published when the papers were received so they were emailed to the Commission. Both would appear on the next agenda. B. District I Vacancy - Discussion of Letters of Interest Mayor Hay felt public input was important to receive first. Then the names would be submitted alphabetically for a vote on each one. Charles Kanter, 2905 S. Greenleaf Circle, spoke on behalf of Jack McVey. He had worked with Mr. McVey on the Recreation and Parks Board and it would be a privilege to have a young man like him on the Commission. Phil Torano, 4789 Dolphin Drive, Lake Worth, FI, spoke on behalf of Jack McVey. He had worked with the Little League for the past six years. He was on the board and a coach. He had played on the field as a youngster. Mr. McVey expends a great deal of time and energy for the Little League and the City. He is always there and supports his friends. He would be a great candidate for the position. Dr. Piotr Blass, 113 Tara Lakes Drive, wanted to explain why he was seeking the position. He wanted Boynton Beach to make the quantum leap to be a university town. He had been working on it for several years. There are currently 30 students and faculty and were ready to take the next step. The education initiative is very consistent with his goal. The leaders of the Haitian community had endorsed Dr. Blass. If appointed he would do everything possible to help the City. He would donate his entire salary to the City. He has a PhD. from Harvard and was a veteran, ready to move the City to the next level. Ron Washam, 127 S. Atlantic Drive West, asked the Commission to make a progressive move and appoint Jerry Taylor to the interim position. He had known Mr. Taylor for twenty years and actually ran against him for office. They had agreed and disagreed to build a better City. His leadership had moved many things forward. He comes with constituents who come to Boynton because he is an official. Critical leadership is needed and Mr. Taylor should be the only candidate considered. Nothing has been proven to be true. Neither the Boynton Beach Police Department nor the State Attorney's office found anything to even interview Mr. Katz. Commissioner Holzman inquired if the Mayor planned on attending and he confirmed he would. Commissioner Holzman felt it made sense to appoint the Mayor as the City's voting member. Motion Commissioner Holzman so moved. Vice Mayor McCray seconded the motion. Commissioner Holzman inquired if any other Commissioners would be attending. He would be attending to mingle, but not register. Vote The motion passed unanimously. B. Vice Mayor McCray seconded the motion. 5 Meeting Minutes Regular City Commission Boynton Beach, FL August 21, 2012 Commissioner Holzman asked if there was an outstanding fine owed to the City of Boynton Beach by Mr. Katz in regard to the lobbying registration. Attorney Cherof advised there was an outstanding fine. Mr. Katz's response to the finding has been verbalized by him. Commissioner Holzman was not in a position to appoint anyone to a board who has an outstanding fine for violating the City's lobbying ordinance. The decision was made and he felt Mr. Katz should play by the rules. Vice Mayor McCray pointed out Mr. Katz was serving on the Financial Advisory Board when the fine was assessed. The argument was redundant at this time. Vote The motion failed 2 -2 (Commissioners Holzman and Ross dissenting). Motion Mayor Hay moved to appoint Ryan Wheeler as a regular member of the Planning and Development Board. Commissioner Holzman seconded the motion. Vote The motion passed 3 -1 (Vice Mayor McCray dissenting). C. District I Vacancy - Discussion of Letters of Interest Mayor Hay declared the five interested individuals would be recognized, public input would be heard and then discussion and vote by the Commission. Michael Bessell, Dr. Piotr Blass, Jack McVey, Cliff Montross and Jerry Taylor were identified. Steve Anton, 234 SE 2nd Avenue, inquired how the Charter could be changed. He contended the individual who had gotten the second highest votes in the previous election should be appointed, if willing to serve. The process could be eliminated since the residents had already voted. Mayor Hay appreciated the suggestion but it would not affect the current situation. Mr. Anton stressed he was attempting to save $30,000. Don Scantlan, 13 Cedar Circle, did not support any one candidate but thought either of the top two candidates pointed out two weeks ago would make fine Commissioners. There is not necessarily a wrong choice, but it would be wrong to conclude the meeting without filling the vacant seat on the Commission. If the four Commissioners cannot fulfill their obligation to fill the seat and an election is required, it would be a failure of all four elected officials. Ron Washam, 127 South Atlantic Drive West, repeated the burden of leadership falls on the Commission and why the residents voted for the officials. Bickering and playing political football was not the goal. Good leadership was available. It is now a character 6 Meeting Minutes Regular City Commission Boynton Beach, FL September 4, 2012 David Katz, 67 Midwood Lane, speculated that Atlantic Avenue in Delray Beach had become the new Roswell, New Mexico due to four independent and confirmed sightings before the last Commission meeting, of Commissioner Ross with the suspended Mayor who is facing decades of imprisonment. Yet, Commissioner Ross has limited contact with the Interim City Manager. There are parallel investigations into connections between a Palm Beach Gardens promotional speaker, the suspended Mayor and current elected officials. Examination by other investigative agencies includes the illegal recording of CRA staff members during one -on -one meetings. There are governmental, as well as independent investigations into the transmittal of messages and pictures between elected officials and convicted felons. Mr. Katz commented as a citizen and taxpayer of Boynton Beach, he did not understand why Commissioners from Districts 3 and 4 would not vote to confirm and allow Jerry Taylor to serve as the District 1 Commissioner so the residents of the district have full representation. Mr. Katz opined Mr. Taylor was the most successful Mayor the City has ever had and the benchmark for gauging and measuring all others who serve. Mr. Taylor is a man of great faith and served his country and community with honor. Whatever outside pressure has been exerted on the two Commissioners or resulting consequences if they vote in favor of his appointment would pale in significance as the ones that would come otherwise. Dr. Piotr Blass, 113 West Tara Lakes, had the highest respect for Commissioner Ross as a person with tremendous honesty and he was deeply offended by any comments to the contrary. Dr. Blass thanked Commissioners Ross and Holzman for utilizing his statement that democracy has no price. Even if an election cost $25,000 it would be worth it. He was continuing to organize the University of Boynton but without additional high tech the budget woes would remain. The city needs additional income and high tech and a university would be the channel to pursue. Cliff Montross, 109 SW 18 Street, in District 1, urged the Commission to fill the position as soon as possible. There are 13,000 residents in the district with no representation on the Commission. It was unacceptable. The Charter dictates the Commission should have a Mayor and four Commissioners. It uses the word "shall' and does not give the Commission any options other than to fill the position. Leaving the vacancy for eight or nine months without representation for 13,000 residents was not right in his opinion. He questioned if the residents did not have representation, could they withhold their tax dollars. The Commission has an obligation to fill the seat even if it has to be drawn from a hat containing the names of the applicant. No one else coming forward, Mayor Hay closed public audience. 5. Vice Mayor McCray seconded the motion. Commissioner Holzman noted this would be the fourth member of the Committee that would constitute a quorum. It was his recommendation that the Committee be held steady until one more member is appointed to maintain a quorum. Vice Mayor McCray was not in favor of holding the Committee hostage. There is a quorum now and the Committee needs to do business as usual. Mayor Hay was sure if a problem arose the Commission could be advised and act accordingly. Approve the Bid Award for "ANNUAL SUPPLY OF BRASS FITTINGS AND ACCESSORIES" Bid # 063 - 1412- 12 /MFD to the following seven (7) companies: Ferguson, Fortiline Waterworks, HD Supply, Lehman Pipe, Mariflow, Municipal Waterworks and Sunstate Metering on an overall basis, to the lowest, most responsive, responsible bidders who met all specifications for an estimated annual amount of $52,000 and will be purchased on an "As Needed Basis ". C. Approve the updated Library Long Range Plan for 2012 -2015. Vice Mayor McCray had pulled the item to hear a brief snapshot of the long range plans. Mr. Clark advised the document was required to be submitted for State aid. It is used to outline the services and objectives to measure their goals. The AmeriCorps program has been added with a tutor for the GED and ESOL issues which are two of the major programs. Without the documentation, the grant funding could not be obtained. 18 Meeting Minutes Regular City Commission Boynton Beach, FL October 2, 2012 Commissioner Holzman surmised the proper approach would be to consider the issue on a case -by -case basis. Attorney Cherof inquired if the intent to research and draft was associated with all boards or specifically the Education and Youth Advisory Board. Mayor Hay felt it should be structured for all boards. Ms. LaVerriere reminded the Commission that each advisory board was enacted by an ordinance and they would all require modification if it was embraced as an overall concept. It could be handled on a case -by -case basis. The change could be specific to the Education and Youth Advisory Board. Commissioner Holzman summarized the issue would be handled on a case -by -case basis, but as it relates to the Education and Youth Advisory Board the decision should be made by the Board rather than the Chair. The building he was in was abandoned and known for drug dealing and she hoped it could be stopped. She hoped 258 NE 7 Avenue would not become a drug exchange duplex. Mayor Hay directed Ms. Morgano to Chief Immler and his staff. Ray Whitely, 7353 Palmdale Drive, had grown up in Boynton Beach, but did not know he could come to City Hall and speak his mind for three minutes. When he discovered it was possible his world got a little bit bigger. He wanted to thank all the government agencies who had been supporting the business mentorship program that Boynton United was spearheading. It gives children an opportunity to connect with City government. He had grown up on 27 Court and for 20 years of his life his world was as big as the canal and he had no knowledge of what went on at City Hall. Mayor Hay recalled the January 1st, 2013 meeting had been cancelled. It had been stated at least two of the members would not be present for the November 20, 2012 meeting, so there cannot be a meeting without a quorum of three. Staff has to juggle their schedules for the meetings, police have to make arrangements and the IT Department has to make accommodations as does the Legal Department. Also the 8 Meeting Minutes Regular City Commission Boynton Beach, FL November 7, 2012 Vice Mayor McCray noted Blanche Girtman was his 6th grade teacher over fifty years ago. Ray Whitely, 7353 Palmdale Drive, President of Boynton United, announced his organization had partnered with Boynton Community High School and the Red Cross on November 18 from 4 to 7 p.m. to have a benefit concert with the proceeds going directly to the Red Cross and the victims of Superstorm Sandy in the northeast. He encouraged everyone to attend and show support. The dynamic Boynton Beach Community Choir would perform and the High School Choir. There would be an exclusive lineup of entertainers. The goal was to raise $200,000 for the Red Cross. Ginger Pederson, 7817 Manor Forest Lane, highlighted the book she had published with Janet DeVries called Pioneering Palm Beach, the Deweys and the South Florida Frontier. The original plat of Boynton Beach filed in 1898 reflects the name Fred and Birdie Dewey. Their lives were a part of the City's history and the book has generated positive press for the City of Boynton Beach. The book can be bought through Amazon, Barnes & Noble online and in stores with 20% of the proceeds of the book going to Palm Beach County Historical Society and 20% to the Audubon Society of Florida. David Merker introduced himself as a candidate for Commission District 1. Dr. Piotr Blass, 311 Tara Lakes Drive, pointed out Sean Casper, a native of Boynton Beach, received 20,000 votes in the recent national election. Hopefully he would win the next time. He offered there was an immediate high tech concern involving putting all power lines underground. With today's technology it should not be such a huge problem to have power lines underground. Dr. Blass was of the opinion Boynton Beach had the best police force. He was puzzled by the immense studies for something that did not need fixing. Chief Immler could handle any problems that would arise. Dr. Blass felt the money should be spent to put the power lines underground. He reiterated his suggestion that the interested parties for District 1 Commissioner simply rotate through the remaining meetings until March to afford the citizens representation. Mayor Hay commented the study of the Police Department did not imply there was anything wrong in the Department. Any department can be enhanced. 5. ADMINISTRATIVE A. Consider an update regarding the Financial Advisory Committee member status and preliminary plans for the upcoming year Ms. LaVerriere recounted during the budget workshops the Commission had considered the Financial Advisory Committee's recommendations and asked the Committee to return with a list of items they desire to study to be discussed and changes made if necessary. There are now more members on the Committee and the first meeting held. Commissioner Holzman asked how many of the recommendations of the Committee were actually implemented. Don Scantlan, Chair of the Finance Committee, 13 Cedar Circle, responded his observations were none of the recommendations were undertaken. There was the fact that several of the recommendations were not to be instituted now, but in future negotiations with several of the bargaining units. Commissioner Holzman commented the time spent and effort put into the topics by the members was amazing for volunteers. However, if the Commission was not going to accept any of the recommendations, as done in the past two years, it wastes the time of the volunteers and staff time allowing the Committee to continue. Commissioner Holzman did not feel the Commission was ready to implement any changes that would be recommended. Additionally, there are only five members of a nine member committee. He suggested the action be held in abeyance until there is a full Committee. 14 Meeting Minutes Regular City Commission Boynton Beach, FL December 4, 2012 on February 9, 2013 the Foundation, with the City and Realtors of Palm Beach County is sponsoring a fundraising event for the Barrier Free Park. It is a 5K run /walk sponsored with the cooperation of Hunters Run. The funds are for the major settlement area to be developed and placement of the last big piece of equipment. Commissioner Holzman suggested, based on previous comments made regarding the lack of volunteerism, it may be in the best interest of the community to waiver from the policy to make sure the advisory boards are full. Mayor Hay indicated any change would have to be brought back to the Commission for discussion first. Vice Mayor McCray recalled the last time he had appointed David Katz for a board it was noted there was an outstanding fine. After the investigation was completed it was determined there was no merit in what had been said and done. Motion Vice Mayor McCray appointed David Katz to serve on the Planning and Development Board. Mayor Hay passed the gavel and seconded the motion. Vote The motion passed 2 -1 (Commissioner Holzman dissenting). There was agreement there could be no other appointments. B. Discuss request for renaming Veterans Park on Ocean Avenue. Ms. LaVerriere reported there was a request from Vivian Brooks, the CRA Director, for the Commission to rename Veterans Park. There is the Bicentennial Veterans Memorial Park located on Federal Highway that creates some confusion for veterans. The Commission could appoint a committee to select a name. The committee could be made up of current members of advisory boards which has been done in the past. 5
