A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
OPPOSING HOUSE OF REPRESENTATIVES BILL
405 REGARDING RETAIL ELECTRIC TERRITORIAL
SERVICE AREAS; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, certain segments of the Florida electric
industry have proposed legislation providing for certified
electric territories; and
WHEREAS, such legislation has been filed in the Florida
House of Representatives (HB 405) and is expected to be filed
in the Florida Senate; and
WHEREAS, House Bill 405 would impair the City's ability
to negotiate a reasonable franchise fee with any utility which
supplied electricity within the City's corporate limits; and
WHEREAS, the legislation would inhibit the City's ability
to fully realize for its customers the significant benefits of.
competition in the wholesale power supply market;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. The City Commission of the City of Boynton
Beach is opposed to electric territory legislation (HB 405) as
proposed and requests the active support of the entire Palm
Beach County -Legislative Delegation in opposing this
legislation.
Section 2. The City Clerk of the City of Boynton
Beach is hereby directed to submit copies of this Resolution
to all appropriate government officials, all cities within
Palm Beach County, and the Board of County Commissioners of
Palm Beach County.
Section 6. This Resolution shall take effect
immediately upon passage.
