Minutes 04-24-14 MINUTES OF THE RED LIGHT CAMERA VIOLATION HEARINGS HELD IN COMMISSION CHAMBERS, CITY HALL, 100 E. BOYNTON BEACH BLVD., BOYNTON BEACH, FLORIDA, ON THURSDAY, APRIL 24, 2014, AT 9:00 A.M. PRESENT: James D Stokes, Special Magistrate Gwen Mills, Clerk Officer Anthony Petriello, CSO Officer Anthony Verrigni, CSO I. Call to Order Special Magistrate, James D. Stokes, apologized for the delay and called the meeting to order at 9:27 a.m. He explained he is a Special Magistrate appointed pursuant to State statute to sit and adjudicate the red light violation hearings. He is not employed by the City of Boynton Beach or the Police Department. II. Approval of Minutes None Ill. Approval of the Agenda None IV. Swearing in Witnesses Diana Springer, Code Compliance Division, administered the oath. V. Violation Hearings: Failure to comply with steady red signal John Douglas Haynes Notice No. 1851400009465 2893 SE 1 St Place, Boynton Beach, FL. 33435 Officer Anthony Petriello, Boynton Beach Community Service Officer, stated on January 17, 2014, at 4:58 p.m., a vehicle registered to the Petitioner was traveling through an intersection of Boynton Beach Boulevard at Seacrest Boulevard. After reviewing the electronic evidence, a Notice of Violation was issued on January 22, 2014. Officer Petriello stated this was a right on red which the City of Boynton Beach does not enforce. Riolo Notice No. 1851400011537 Officer Anthony Verrigni, Boynton Beach Community Service Officer, stated on January 22, 2014, at 3:38 p.m., a vehicle registered to the Petitioner was traveling through an intersection of Woolbright Road at S Congress Avenue. After reviewing the electronic evidence, a Notice of Violation was issued on February 3, 2014. Janice S. Riolo, 196 Walnut Court, Highland Park, NJ, 08904, agreed the picture was correct. She traveled everyday on the same street on her way to see her husband who was at Parkside Inn. Ms. Riolo explained she went through the amber light and then backed up so as not to go through the red light which she felt was a safer decision. Decision After considering the electronic evidence and the testimony of the Officer, Mr Stokes upheld Notice of Violation 1851400011537 Andrew James Alba Notice No. 1851400011651 Officer Verrigni, stated on January 22, 2014, at 5:16 p.m., a vehicle registered to the Petitioner was traveling through an intersection of Federal Highway at SE 23 Avenue. After reviewing the electronic evidence, a Notice of Violation was issued on February 3, 2014. Andrew James Alba, 109 Habitat Court, Royal Palm Beach, FL. 33411 stated he does a lot of traveling for his work. He explained there was a car behind him driving very aggressively and close to his back bumper In 2011, Mr. Alba was in a car accident for the same reason and felt the better decision was to go through the red light instead of stopping and possibly getting rear ended. Decision After considering the electronic evidence and the testimony of the Officer, Mr. Stokes upheld Notice of Violation 1851400011651 2 MEETING MINUTES RED LIGHT CAMERA VIOLATIONS BOYNTON BEACH, FL. APRIL 24, 2014 Edouard Rene Joseph Notice No. 1851400027871 Officer Petriello stated on February 27, 2014, at 8 a.m., a vehicle registered to the Petitioner was traveling through an intersection of Woolbright Road at SW 8 th Street. After reviewing the electronic evidence, a Notice of Violation was issued on March 4, 2014. Edouard Rene Joseph, 10519 Pinetree Terrace, Boynton Beach, Fl. 33436, explained he sold the vehicle on February 2, 2014. The new owner did not return the license plate in a timely manner and has since received three red light violations including this one. Mr. Joseph appeared at the first two hearings and the violations were dismissed. He has all the necessary documents to show he sold the car prior to the violations. Decision After considering the electronic evidence and testimony presented by the Officer, Mr. Stokes dismissed Notice of Violation 1851400027871. Francky Hilaire Notice No. 1851400024712 11211 S. Military Trail, Boynton Beach, FL. 33436 Officer Petriello, stated on February 20, 2014, at 3.52 a.m., a vehicle registered to the Petitioner was traveling through an intersection of Woolbright Road at SW 8 th Street. After reviewing the electronic evidence, a Notice of Violation was issued on March 3, 2014. Officer Petriello acknowledged Mr Hilaire did stop, but rolled across the stop bar which made the camera go off. Decision After considering the electronic evidence and testimony presented by the Officer, Mr. Stokes dismissed Notice of Violation 1851400024712. Alex Jadson Oliveira Notice No. 1851400017765 Mr. Stokes stated Mr. Oliveria paid the fine prior to the hearing Ashley Shirell Puckett Notice No. 1851400021312 Officer Verrigni stated on February 13, 2014, at 1019 p.m , a vehicle registered to the Petitioner, who was not present, was traveling through an intersection of NW 8 th Street 3 MEETING MINUTES RED LIGHT CAMERA VIOLATIONS BOYNTON BEACH, FL. APRIL 24, 2014 at West Boynton Beach Boulevard. After reviewing the electronic evidence, a Notice of Violation was issued on March 3, 2014. Decision After considering the electronic evidence and the testimony of the Officer, Mr. Stokes upheld Notice of Violation 1851400021312 Elaine Callas Garnett Notice No. 1851400007584 Officer Verrigni stated on January 14, 2014, at 8:26 a.m., a vehicle registered to the Petitioner, who was not present, was traveling through an intersection of Woolbright Road at SW 8 th Street. After reviewing the electronic evidence, a Notice of Violation was issued on January 22, 2014. Decision After considering the electronic evidence and the testimony of the Officer, Mr. Stokes upheld Notice of Violation 1851400007584. Ronen Tish Notice No. 1851400034794 Officer Petriello stated on March 12, 2014, at 4:39 p.m., a vehicle registered to the Petitioner, who was not present, was traveling through an intersection of Woolbright Road at SW 8 th Street. After reviewing the electronic evidence, a Notice of Violation was issued on March 18, 2014. Decision After considering the electronic evidence and the testimony of the Officer, Mr. Stokes upheld Notice of Violation 1851400034794. VI.
