Minutes 05-21-14 MINUTES OF THE CODE COMPLIANCE SPECIAL MAGISTRATE HEARINGS HELD IN COMMISION CHAMBERS, CITY HALL, 100 E. BOYNTON BEACH BLVD., BOYTON BEACH, FLORIDA ON WEDNESDAY, MAY 21, 2014 AT 9:00 A.M. PRESENT: Carol Dutra Ellis, Special Magistrate Diane Springer, Code Compliance Coordinator I. CALL TO ORDER Ms. Ellis serves as the Code Enforcement Special Magistrate for the City of Boynton Beach. She reviewed the hearing procedures. The purpose of the hearing is to determine if a violation has occurred or is occurring. She would make a finding regarding the existence of a violation. She was not authorized to excuse violations due to hardship or ignorance or to change the Code. The City Commission adopted the Code and only they could enact or change it. The City would present its case first, and then the Respondent. Respondents could question the City's witnesses and present their own witnesses and evidence. Ms. Ellis could ask questions of any witness that she considered relevant. Testimony is given under oath, and strict rules of evidence do not apply to the hearings. At the conclusion of the hearing, she would enter an Order. If a violation occurred, the Order would provide the appropriate amount of time to rectify the violation. If not rectified by the date specified, she would consider the gravity of the violation, the efforts to comply and any previous violations by the Respondent when setting the fine amounts. All Orders are appealable only to the Circuit Court of Palm Beach County, not the City Commission. If a transcript is needed, Florida Statutes requires the Respondent to obtain one. Ms. Ellis called the meeting to order at 9:12 a. m. II. CASES TO BE HEARD — NEW Case No. 14 -720 Gladys Mensah — Derrick Jackson Property Address: 104 SE 11 Avenue Violation(s): CO CH4 SEC. 4 -4 CO CH4 SEC. 4 -36 CO CH4 SEC. 4 -37 Every dog must have a current tag and registration with Palm Beach County. Proof of rabies vaccinations must be submitted. No tethering of animal permitted. 2 MEETING MINUTES CODE COMPLIANCE BOARD BOYNTON BEACH, FL. MAY 21, 2014 Officer Roy presented the case which resulted from a citizen complaint. The initial inspection was conducted on March 31, 2014. Certified mail was sent on April 9, 2014 and the green card was returned undelivered. Notice was posted at City Hall on May 6, 2014. Staff recommended five days for a compliance date of May 26, 2014 and recommended a Cease and Desist Order for the violations. The Respondent was present. Derrick Jackson, 104 SE 11 Avenue, a tenant at this property explained he registered the dog and complied with all other City requests. Ms. Ellis received evidence of the registration and rabies vaccination certificate issued by the Division of Animal Care and Control. Officer Roy stated the Cease and Desist Order would be for the tethering. Decision Ms. Ellis approved the City's recommendation for a Cease and Desist Order for the tethering of the dog. The Respondent was given five days for a compliance date of May 26, 2014 or a $500 fine per day. Mr. Jackson explained his dog is confined to his patio and while it is being cleaned he keeps the dog on a leash. The dog is not allowed in the home with his two year old son. Ms. Ellis responded even though this was a one -time incident, the Cease and Desist Order must stand as ordered. Case No. 14 -742 William and Barbara Eisenberg Property Address: 320 SW 2 nd Avenue Violation(s): CO CH15 SEC. 15 -120 (D) INC. Please mow overgrown yard and maintain. Courtney Cain, Code Compliance Officer, stated this was a routine inspection which took place on March 31, 2014. The Notice was posted on the property and at City Hall on May 8, 2014 and the Respondents were given ten days to comply. Staff recommended 30 days for a compliance date of June 20, 2014 or a $50 fine per day thereafter. The Respondents were present but chose not to speak. Decision Based on the testimony and recommendation given by the City, Ms. Ellis ordered the Respondents to comply within 30 days for a date of June 20, 2014 or a $50 fine per day thereafter. 3 MEETING MINUTES CODE COMPLIANCE BOARD BOYNTON BEACH, FL. MAY 21, 2014 Case No. 14 -483 Michael J. & Jane A. Morris Property Address: 921 SW 34 Avenue Violation(s): CO CH15 SEC. 15 -120 (D) INC. Remove all construction material from the driveway. Officer Roy presented the case for the above violations which resulted from a citizen complaint. The written notice was sent on March 27, 2014 with ten days to comply. Certified mail was sent April 16, 2014 and the green card was returned signed on April 22, 2014. The property was last inspected on May 19, 2014. The City recommended 60 days for a compliance date of July 20, 2014 or a $50 fine per day thereafter. Officer Roy entered pictures into evidence. Ms. Ellis inquired if the Respondent contacted the City to discuss the violation. Officer Roy responded he spoke with the Respondent on May 20, 2014. Michael Morris, 921 SW 34 Avenue, testified he is the owner and the materials have been taken out and awaiting removal. Decision Based on the testimony and recommendation given by the City, Ms. Ellis ordered the Respondents to comply within 60 days for a date of July 20, 2014 or a $100 fine per day thereafter. Case No. 14 -793 1635 Seacrest LLC — TR The Taxman Property Address: 1106 NW 1 st Street Violation(s): CO CH10 SEC. 10 -52 CO CH13 SEC. 13 -16 CO CH15 SEC. 15 -120 (D) INC. Please remove all inoperable /unregistered vehicles from property. Mow and trim all overgrowth. Apply for and pass inspection for the Business Tax Receipt for your rental property. Luney Guillaume, Code Compliance Officer, presented this case which was a routine inspection conducted on April 02, 2014. The written notice was sent on April 02, 2014 and the signed green card was returned on April 25, 2014. The property was last inspected on May 14, 2014 and the Respondent was present. Officer Guillaume noted the only outstanding violation was the Business Tax Receipt. MAY 21, 2014 violations. The Respondent provided a copy of the rental property application for a Business Tax Receipt dated April 30, 2014. The Respondent stated the property is currently occupied. The tenant was informed to remove the vehicle and all trash on the property. The tenant agreed to take care of these issues by today's hearing date. Decision Based on the testimony and recommendation given by the City, Ms. Ellis ordered the Respondent to contact the City to arrange another inspection within 10 days for a compliance date of May 31, 2014 or pay a $100 per day fine thereafter. Case No. 14 -773 SFRH SF RENTAL LP Property Address: 2621 NE 3 rd Street Violation(s): CO CH13 SEC. 13 -16 CO CH15 SEC. 15 -120 (D) INC. Apply for and pass inspection for Business Tax Receipt. Mow and trim all overgrowth. Glenn Weixler, Code Compliance Officer, presented the case as stated. Initial inspection took place on April 1, 2014. A written notice was issued on April 1, 2014 and 10 days were given to comply. Certified mail was sent on April 23, 2014 and the signed green card was returned on April 29, 2014. The property was last inspected on May 20, 2014. The City recommended 30 days for a compliance date of June 20, 2014. Aaron Gil, SFRH Rental LP, stated he is in agreement with the violations and will comply within the 30 days recommended by the City. Case No. 14 -360 SRP SUB LLC Property Address: 207 SW 1 St Avenue Violation(s): CO CH13 SEC. 13 -16 Apply for and pass inspection for Business Tax Receipt for rental property. BTR application date was October 21, 2013. Officer Cain presented the case that was a City Department referral. Initial inspection took place on February 25, 2014 and 14 days were given to comply. The green card was signed and returned on April 23, 2014. The property was last inspected on May 20, 2014 and Respondent was present. Officer Cain stated the Respondent applied for the Business Tax Receipt on October 21, 2013 but did not arrange for an inspection. The City recommended 10 days for a compliance date of May 31, 2014 or a $200 fine per day thereafter. Lucaster Carr, Code Compliance Director, SRP SUB, LLC., 2700 W. Cypress Creek, Ft. Lauderdale, explained he has been in contact with Officer Cain and was in the process of arranging an inspection. Decision Based on the testimony and recommendation given by the City, Ms. Ellis ordered the Respondent to comply within 10 days for a date of May 31, 2014 or a $200 fine per day thereafter. Case No. 14 -366 SRP SUB LLC Property Address: 457 SW 3 rd Avenue Violation(s): BBA FBC 2010 ED. 105.1 A permit is required for all windows and air conditioning systems installed as noted on the red tag dated January 16, 2014. Officer Cain presented the case initiated by a citizen complaint and a notice was sent on March 10, 2014. There has been compliance with the windows but the air conditioning violation still exists. The green card was signed and returned on April 14, 2014 and the property was last inspected on May 20, 2014. The City recommended 15 days for a compliance date of June 5, 2014 or a $50 per day fine thereafter. Lucaster Carr, Code Compliance Director, SRP SUB, LLC., 2700 W. Cypress Creek, Ft. Lauderdale, explained they are working to get the air conditioning permit within the City's recommended timeframe. Decision Based on the testimony and recommendation given by the City, Ms. Ellis ordered the Respondent to comply within 15 days for a date of June 5, 2014 or a $50 fine per day thereafter. Case No. 14 -363 SRP SUB LLC Property Address: 1053 Coral Drive Violation(s): BBA FBC 2010 ED. 105.1 Secure permits for all unpermitted work — Kitchen and bathroom remodeling — HVAC, front and side door replacements as noted in red tag dated February 13, 2014. 6 MEETING MINUTES CODE COMPLIANCE BOARD BOYNTON BEACH, FL. MAY 21, 2014 Pat Hart, Code Compliance Officer, presented the case which was a City department referral. The initial inspection and written notice was sent on March 19, 2014. Certified mail was sent on April 15, 2014 and the signed green card was returned on April 21, 2014. The property was last inspected on May 20, 2014. A permit was applied for but was rejected. The City recommended 10 days with a compliance date of May 31, 2014 or a $200 fine per day thereafter. Lucaster Carr, Code Compliance Director, SRP SUB, LLC., 2700 W. Cypress Creek, Ft. Lauderdale, explained they have applied for the permits. Decision Based on the testimony and recommendation given by the City, Ms. Ellis ordered the Respondent to comply within 10 days for a date of May 31, 2014 or a $200 fine per day thereafter. Case No. 14 -585 SRP SUB LLC Property Address: 401 NW 8 Court Violation(s): CO CH13 SEC. 13 -16 CO CH10 SEC. 10 -56 (D) House numbers shall be displayed on house at a minimum of four inches. Apply for and pass inspection for the Business Tax Receipt for your rental property. Officer Hart presented the case which was a routine inspection done on March 19, 2014. The written notice was sent on March 19, 2014 with 10 days to comply. The green card was signed and returned on April 24, 2014. A rental inspection was done in February 2014 but failed due to unpermitted work. The property was last inspected on May 20, 2014. The City recommended 10 days for a compliance date of May 31, 2014 or a $200 fine per day thereafter. Lucaster Carr, Code Compliance Director, SRP SUB, LLC., 2700 W. Cypress Creek, Ft. Lauderdale, explained the property has applied for the necessary permits and the Business Tax receipt. Mr. Carr will take care of getting the house numbers put on immediately. Decision Based on the testimony and recommendation given by the City, Ms. Ellis ordered the Respondent to comply within 10 days for a date of May 31, 2014 or a $200 fine per day thereafter for the Business Tax Receipt. 7 MEETING MINUTES CODE COMPLIANCE BOARD BOYNTON BEACH, FL. MAY 21, 2014 The Respondent was also ordered to comply within five days for a date of May 26, 2014 for the house numbers or a $100 fine per day thereafter. Case No. 14 -693 SRP SUB LLC Property Address: 1154 SW 27 Avenue Violation(s): BBA FBC 2010 ED. 105.1 Permit required for water heater, air conditioning system, washing machine hose, bibbs and garage door. Items were replaced without permits as stated on the red tag dated February 27, 2014. Officer Hart presented the case which was a routine inspection done on April 2, 2014 at which time a written notice was sent. Ten days were given to comply. Certified mail was sent on April 18, 2014 and the signed green card was returned on April 24, 2014. Permits were obtained for the water heater and the air conditioning system. The hose bibb for the garage door is still outstanding. The property was last inspected on May 20, 2014. The City recommended 10 days for a compliance date of May 31, 2014 or a $200 fine per day thereafter. Lucaster Carr, Code Compliance Director, SRP SUB, LLC., 2700 W. Cypress Creek, Ft. Lauderdale, stated they are working to get the outstanding permits. Case No. 14 -704 SRB SUB LLC Property Address: 306 SW 4 th Avenue Violation(s): BBA FBC 2010 ED. 105.1 Permit required for garage door, entry door, new HVAC system and electric. Wood fence (Pool barrier) replaced without permits as stated on the red tag dated March 26, 2014. Officer Hart presented the case which was a routine inspection conducted on April 2, 2014 at which time a written notice was sent. Certified mail was sent on April 18, 2014 and the signed green card was returned dated April 23, 2014. A permit for the HVAC system was applied for but rejected. The property was last inspected on May 20, 2014. The City recommended 10 days for a compliance date of May 31, 2014 or a $200 fine per day thereafter. 8 MEETING MINUTES CODE COMPLIANCE BOARD BOYNTON BEACH, FL. MAY 21, 2014 Lucaster Carr, Code Compliance Director, SRP SUB, LLC., 2700 W. Cypress Creek, Ft. Lauderdale, explained the permits have been applied for. He was not sure why the permit for the HVAC was rejected. Decision Based on the testimony and recommendation given by the City, Ms. Ellis ordered the Respondent to comply within 10 days for a date of May 31, 2014 or a $200 fine per day thereafter. Case No. 14 -705 SRB SUB LLC Property Address: 207 SW 1 St Avenue Violation(s): BBA FBC 2010 ED. 105.1 Permit required for garage door and air conditioning system replaced without permits as stated on the red tag dated March 26, 2014. Officer Hart presented the next case which was a routine inspection done on March 27, 2014. The initial notice was sent on April 2, 2014 with 10 days to comply. Certified mail was sent March 18, 2014 and the signed green card was returned April 24, 2014. Respondent applied for the HVAC system. Property was last inspected on May 20, 2014. The City recommended 10 days for a compliance date of May 31, 2014 or a $200 fine per day thereafter. Lucaster Carr, Code Compliance Director, SRP SUB, LLC., 2700 W. Cypress Creek, Ft. Lauderdale, stated they have received the permit for the air conditioning system and the permit for the garage door is in process. Decision Based on the testimony and recommendation given by the City, Ms. Ellis ordered the Respondent to comply within 10 days for a date of May 31, 2014 or a $200 fine per day thereafter. V. OLD BUSINESS A& B. Lien Penalty Certifications — New & Tabled Case No. 13 -2354 SFRH SF RENTAL, LP Property Address: 302 SW 5 Avenue Violation(s): CO CH13 SEC. 13 -16 CO CH15 SEC. 15 -120 (D) INC. 9 MEETING MINUTES CODE COMPLIANCE BOARD BOYNTON BEACH, FL. MAY 21, 2014 Apply for and pass inspection for the Business Tax Receipt for your rental property. Repair or replace wood fence on east side of property. Officer Cain presented the case as stated. Notice of Violation was dated October 25, 2013. The rental property is now empty and therefore the Business Tax Receipt no longer applies. At the Magistrate hearing on January 15, 2014 Respondent was given a compliance date of January 30, 2014 or a fine of $50 per day thereafter. The property was last inspected and the violation still exists. The total days of non - compliance was 110 days with seven inspections for a total of $5500 plus administrative fees of $922.21. Aaron Gil, SFRH Rental LP, stated the fence was repaired and passed inspection. However, Mr. Gil could not produce any documents to support it. Decision Ms. Ellis stated the Respondent had the opportunity to work with the City at the January 15, 2014 hearing, but there was no resolution. She certified the lien and explained the Respondent would have the opportunity to apply for a lien reduction. Case No. 13 -2522 Wells Fargo Bank NA TR Property Address: 1202 Meadows Circle Violation(s): CO CH10 SE. 10 -51.5 INC. All property that is vacant or subject to a current notice of default must be registered with the City. Remove or repair water damaged drywall and construction materials. Officer Hart presented the case as stated. Notice of Violation was November 19, 2014. The Magistrate hearing was February 19, 2014 and no one appeared. The compliance date and proposed fine set by the Magistrate was March 1, 2014 with a fine of $100 per day thereafter. The property was last inspected on May 20, 2014 and the violations still exist. There are 80 days of non - compliance for a total of $480.15 plus administrative fees totaling $730.15. Jeff Paolino, Apogee Team Realty, explained when Wells Fargo took over the property it was inspected by them and a leak in the bathroom was discovered. Work began on the leak which involved repairing the drywall. However, the proper permits were not applied for. The Respondent was then told he had to replace the drywall completely which required another permit. The contractor is working on getting the permit and will replace the drywall at that time. 10 MEETING MINUTES CODE COMPLIANCE BOARD BOYNTON BEACH, FL. MAY 21, 2014 Decision Ms. Ellis explained Respondents must appear at scheduled hearings in order to determine if there has been any compliance. She certified the fine and explained there would be an opportunity to apply for a lien reduction. Ms. Ellis again reminded the Respondent the total owed is as of today's hearing, but will continue to accrue. The Respondent inquired if his case could be tabled until the violation has been cleared. Ms. Ellis responded it would not help the situation since the daily fine would still accrue. Case No. 13 -1646 Emily H. and Giovanni Caliendo Property Address: 916 SE 1 st Street Violation(s): 10 -2 B.B.C. OF ORD. CO CH10 SEC. 10 -24 (A) (1) CO CH10 SEC. 10 -56 (B) Please mow overgrown property. Remove all trash and debris. Repair /Remove broken fence. Remove all Florida Holly. Trim tree to make Stop sign visible, raise canopy of tree to 14 feet above street, garbage cans must be out of public view and paint the building. Officer Hart presented the case. Notice of Violation was sent August 21, 2013. The Magistrate hearing and date were February 19, 2014 at which time Mr. Caliendo did appear. Compliance date and proposed fine set by the Magistrate were April 5, 2014 at $100 per day. The property was inspected on May 21, 2014 and the violations still existed. There are currently 45 days of non - compliance at $100 per day totaling $4,500, five inspections at $96.03 each, filing costs of $250 for a total of $5,230.15. Ms. Ellis inquired if there was any communication with the Respondents. Officer Hart replied he spoke with Mr. Caliendo after the last Magistrate hearing and met him at the property to show him what needed to be done. Officer Hart entered pictures of the property taken on May 21, 2014 into evidence. Officer Hart stated a lot of work has been done on the property, but it still needs additional work. Giovanni Caliendo, owner of the property, reviewed the pictures and inquired if Officer Hart had permission to go onto the property. Officer Hart said the gate was open, but Mr. Caliendo stated the gate was locked and he accused Officer Hart of going onto the property without permission. Mr. Caliendo explained the property is being sold and his neighbors are helping as much as they can. He stated the pictures that were taken were close -ups that do not give a good depiction of the work that has been done. Ms. Ellis inquired if Mr. Caliendo 11 MEETING MINUTES CODE COMPLIANCE BOARD BOYNTON BEACH, FL. MAY 21, 2014 had pictures to show anything different. Mr. Caliendo said he did, but was not able to produce them. Mr. Caliendo commented he contacted his State Representative who sent someone to assist with painting the building. Ms. Ellis explained the prior cases had time lines that were not adhered to. This should have been Mr. Caliendo's opportunity to tell the Magistrate what progress had been made on his property. Decision Ms. Ellis explained Respondents must appear at scheduled hearings in order to determine if there has been any compliance. She certified the fine and explained there would be an opportunity to apply for a lien reduction. Mr. Caliendo stated the property will never come into compliance because Officer Hart will always find something wrong. Mr. Caliendo became somewhat irate and had to be escorted out by police officers. NOTE: This section is taken out of order E. Lien Reductions Case No. 11 -1340 Raymond & Linda Avallone Property Address: 3210 SE 2 nd Street Violation(s): CH15 SEC. 15 -120 (D) INC. Remove trash. Mow grass and weeds. Ms. Springer presented the case. The Notice of Violation was sent June 3, 2011. This case came before the Code Compliance Board on July 20, 2011 and no one appeared. Compliance date set by the Board was July 30, 2011 or a fine of $100 per day. The case complied on December 06, 2011 for 127 days of non - compliance for a total fine of $12,700 plus administrative fees of $634.12. Ms. Springer was contacted on January 6, 2014 when a lien reduction inspection was conducted. The windows, doors and air conditioning compressor needed to be replaced. A hole in the soffit had to be repaired and trash and debris removed. Electrical fixtures needed to be replaced, and the parking lot needed to be repaired and restriped. There were outstanding water bills of approximately $200, and municipal liens totaling $2,600. Ms. Springer was again contacted in April 2014 for a re- inspection at which time the property passed for a lien reduction. Daniel Derogatis, 3210 SE 2 nd Street, the new owner, explained no work was started on the property until the title was cleared. Mr. Derogatis contacted Ms. Springer for the list of violations that were resolved. He also paid the outstanding water bills. Mr. 12 MEETING MINUTES CODE COMPLIANCE BOARD BOYNTON BEACH, FL. MAY 21, 2014 Derogatis is requesting a lien reduction of the fines accrued by the previous owner. Ms. Ellis inquired of the cost for the repairs. Mr. Derogatis replied the windows and doors were approximately $12,000, the paint, man hours and air conditioning system was $3- 4,000 per unit. The water bills for all of the units were also paid which totaled approximately $3,000. There were also two municipal liens for mowing and board up at a cost of $2,600. Decision Based on the testimony of the City and the Respondent, Ms. Ellis approved the lien reduction to $1,000 plus administrative fees of $634.12 for a total of $1,634.12. Case No. 11 -2869 Raymond & Linda Avallone Property Address: 3210 SE 2 nd Street Violation(s): CH10 SEC. 10 -56 (D) Secure all openings to prevent unauthorized individuals from entering the building.
